At the forefront of international concerns about global legislation and regulation, a host of noted environmentalists and business ethicists examine ethical issues in consumption from the points of view of environmental sustainability, economic development, and free enterprise.

The problem of evil typically allows the existence of evil to go unchecked. However, in order to be able to press the problem of evil against the theist, the skeptic must offer an account of evil. We examine several of these God-independent accounts and show how difficult it is to define evil without ultimately relying on the metaphysics of value that theism provides. On the other hand, according to the God-dependent account of evil that we endorse, God is logically and (...) metaphysically antecedent to evil. Theories of consciousness have a long and controversial history. One well-known proposal — integrated information theory — has recently been labeled as ‘pseudoscience’, which has caused a heated open debate. Here we discuss the case and argue that the theory is indeed unscientific because its core claims are untestable even in principle.

The Roman philosopher Boethius is best known for the _Consolation of Philosophy_, one of the most frequently cited texts in medieval literature. In the _Consolation_, an unnamed Boethius sits in prison awaiting execution when his muse Philosophy appears to him. Her offer to teach him who he truly is and to lead him to his heavenly home becomes a debate about how to come to terms with evil, freedom, and providence. The conventional reading of the _Consolation_ is that it is (...) a defense of pagan philosophy; nevertheless, many readers who accept this basic argument find that the ending is ambiguous and that Philosophy has not, finally, given the prisoner the comfort she had promised. In _The Prisoner's Philosophy_, Joel C. Relihan delivers a genuinely new reading of the _Consolation_. He argues that it is a Christian work dramatizing not the truths of philosophy as a whole, but the limits of pagan philosophy in particular. He views it as one of a number of literary experiments of late antiquity, taking its place alongside Augustine's _Confessions_ and _Soliloquies_ as a spiritual meditation, as an attempt by Boethius to speak objectively about the life of the mind and its relation to God. Relihan discerns three fundamental stories intertwined in the _Consolation_: an ironic retelling of Plato's _Crito,_ an adaptation of Lucian's _Jupiter Confutatus,_ and a sober reduction of _Job_ to a quiet dialogue in which the wounded innocent ultimately learns wisdom in silence. Relihan's claim that Boethius's text was written as a Menippean satire does not rest merely on identifying a mixture of disparate literary influences on the text, or on the combination of verse and prose or of fantasy and morality. More important, Relihan argues, Boethius deliberately dramatizes the act of writing about systematic knowledge in a way that calls into question the value of that knowledge. Philosophy's attempt to lead an exile to God's heaven is rejected; the exile comes to accept the value of the phenomenal world, and theology replaces philosophy to explain the place of human beings in the order of the world. The other side says they are like the symbol structures in computers. This paper explores whether DICTION text analysis software reveals distinctive language markers of a verbal tone of hubris in annual letters to shareholders signed by CEOs of major companies. We analyze 193 letters to shareholders, comprising about 368,000 words, focusing initially on 23 letters signed by CEOs who are alleged to be hubristic: Browne, Goodwin, and Murdoch. Their language use is statistically significantly high in terms of the DICTION master variable, REALISM. Based on further analysis, we contend that language high (...) in REALISM is not a distinctive marker of hubris but is likely to be a genre effect that is common in CEO letters to shareholders. We draw attention to the restricted capacity of DICTION to capture subtlety of language in CEO letters to shareholders. (shrink)

In a recent judgment1 the Court of Protection was highly critical of health professionals for continuing to provide clinically-assisted nutrition and hydration in the face of disagreement about the patient’s best interests, without seeking to resolve the issue. This hearing had been set up specifically to consider whether GU’s dignity had been properly protected, and if not why not, given concerns raised by the Official Solicitor about what she considered to be “a complete abrogation of responsibility to consider properly or (...) at all, and to determine whether it was in GU’s best interests and therefore lawful to continue to give him an invasive medical treatment, CANH.” In April 2014, at 63 years old and living in Thailand, GU sustained severe injuries after suffering from an electrocution accident. He sustained a cardiorespiratory arrest with a significant delay before cardiopulmonary resuscitation was started and was unconscious and unresponsive. In September 2014 he was transferred to the UK. In August 2018, GU’s brother made a request for a best interests decision concerning the continuation of CANH. The family met to discuss this and all except GU’s son, agreed that continuing CANH was not in GU’s best interests. In view of the fact that there was not unanimity among the family, a decision was made that CANH should continue. Commenting on this decision, Mr Justice Hayden said ‘the apparent assumption that in the face of family disagreement ‘ therefore will continue to be cared for by nursing staff ” is a troubling non sequitur’ and stressed that ‘family dissent to a medical consensus should never stand in the way of an incapacitated patients’ best interests being properly identified’. We offer a particularist defense of conspiratorial thinking. We explore the possibility that the presence of a certain kind of evidence—what we call "fortuitous data"—lends rational credence to conspiratorial thinking. In developing our argument, we introduce conspiracy theories and motivate our particularist approach (§1). We then introduce and define fortuitous data (§2). Lastly, we locate an instance of fortuitous data in one real world conspiracy, the Watergate scandal (§3).

It is the encounter between Thomas Merton in the last year of his life with my Tibetan Buddhist teacher, Chogyam Trungpa, Rinpoche, early in his teaching career in (...) the West. This encounter has deeply influenced my life of dialogue, for they initiated what I came to understand as a new kind of interreligious dialogue—the dialogue of contemplative practice. He proposed that we should collaborate on a book bringing together sacred writings of the Catholic and Vajrayana Buddhist traditions.”2 In another reflection, Trungpa commented, “Meeting Thomas Merton was wonderful; he was like a child, and at the same time, he was full of energy and life.”3 Still later, Trungpa was to conclude, “I had the feeling that I was meeting an old friend, a genuine friend … [Father Merton] was the first genuine person I met from the West.”4Later, Trungpa was deeply saddened by Merton’s premature death, feeling he had lost a heart friend, a genuine dialogue partner. Thirteen years later, Trungpa launched a series of seven landmark dialogue conferences at the fledgling university that he had founded, Naropa Institute in Boulder, Colorado. From the beginning, Trungpa dedicated these gatherings to “Fr. Merton” and said that he sought to cultivate the kind of conversations between genuine contemplatives that he had discovered with Merton. Theologian. Conspirator. Martyr. Saint. Dietrich Bonhoeffer was killed in the waning days of World War II, having been implicated in the July 20th assassination attempt on Hitler. Since his death, Bonhoeffer’s life and writings have inspired contradictory responses. He is often seen as a model for Christian pacifist resistance, and more recently for violent direct political action. Bonhoeffer’s name has been invoked by violent anti-abortion protestors as well as political leaders calling for support on a ‘war on terror’ in the (...) aftermath of 9/11. Petra Brown critically analyses Bonhoeffer’s writing preceding and during his conspiracy involvement, particularly his recurring concept of the ‘extraordinary.’ Brown examines this idea in light of ‘the state of exception,’ a concept coined by the one-time Nazi jurist and political theorist, Carl Schmitt. She also draws on the existentialist philosopher Sören Kierkegaard to consider what happens when discipleship is understood as obedience to a divine command. This book aims to complicate an unreflective admiration of Bonhoeffer’s decision for conspiracy, and draws attention to the potentially dangerous implications of his emerging political theology. An Amnesty International briefing, published in July 2020, highlights the grave risks health workers are facing globally, particularly in the face of the COVID-19 pandemic.1 The report uses data from 63 countries across the world from January to June 2020 and is rich with examples. While recognising that information about the pandemic is constantly evolving, and each country is in a separate phase of the outbreak, Amnesty International draws attention to several troubling trends. By virtue of the role undertaken by (...) health workers, they face a greater exposure to COVID-19, which has contributed to many of the concerns they now deal with. The briefing notes the evidence of the higher death rate from health workers compared with the general population in countries ranging from Denmark to Argentina, while also pointing out the significantly higher death rate in BAME health workers raised by the BMA in the UK.2 PPE shortages had been reported in nearly all of the 63 countries analysed. Many health workers globally stated that they had to buy their own PPE and others described cases of ‘improvisation’, when suitable PPE was not available, such as using bin bags or raincoats. Furthermore, health workers in several countries had experienced increases in workload with formal measures to extend health workers’ contracted hours passed in some countries as well as further changes to their terms and conditions of service. There were also reports of increased mental stress, particularly from those working in ICUs; the increased work and stress is not being matched with suitable compensation or remuneration. Despite many countries passing special benefits for health workers, it was commonly stated that these benefits had not been received yet or that they did not apply to all health workers, with cleaners and other lower-paid yet vital roles excluded. Ethics and Qualities of Life looks at what enters into ethical judgment and choice. Interpretation of a case and of what the options are is always a factor, as is a sense of the possible values at stake. Intuitions also enter in, but often are unreliable. For a long time it seemed only fair that oldest sons inherited, and struck few people as unfair that women were not allowed to attend universities. A moral judgment is putatively part of a moral (...) order in a society that any reasonable person would accept. But what counts as "reasonable" is generally contestable. The unreliability of intuitions leads naturally to ethical theory. Kantian, contractualist, and consequentialist theories all have some important truth in them, but not the whole truth. Contractualism lacks the resources required for a fully determinate account of what counts as "reasonable". Broad general rules are important to Kant and are at the center of everyday morality. But can Kantian ethics explain why they have to have this central role? Our evolving social contract now contains elements that once would have seemed counter-intuitive to most people. But could consequentialists have predicted with entire confidence the consequences of social changes that we now think were desirable? The last part of this book contains a double argument. One is that ethical theory is employed by humans in a state of semi-ignorance of relevant factors, grasping at likely truths and evolved intuitions. The other is that consequentialist considerations have a major role at the fundamental level, but much more in justification or criticism than in ethical discovery. (shrink)

All of these essays focus on the concept of modernity in the philosophical work of Jurgen Habermas - an ambitious and carefully argued intellectual project that invites, indeed demands, rigorous scrutiny. Following an introductory overview of Habermas's work by Richard Bernstein, Albrecht Wellmer's essay places the philosopher within the tradition of Hegel, Marx, Weber, and Critical Theory. Martin Jay discusses Habermas's views on art and aesthetics, and Joel Whitebook examines his interpretations of Freud and psychoanalysis, Anthony Giddens offers a (...) critical reading of Habermas's major work, "The Theory of Communicative Action. Richard Rorty criticizes the whole thrust of his program by way of a comparison with the work of the French philosopher of postmodernity, Jean-Francois Lyotard. And Thomas McCarthy concentrates on the question of the selectivity of rationalization processes in the modern age. Habermas himself has three contributions - on Marcuse, on neoconservativism, and a reply to the other essayists. Richard J. Bernstein is T. Wistar Brown Professor of Philosophy at Haverford College. Contrastive epistemologists say knowledge displays the ternary relation “S knows p rather than q”. I argue that “S knows p rather than q” is often equivalent to “S knows p rather than not-p” and hence equivalent to “S knows p”. The result is that contrastive knowledge is often binary knowledge disguised.

This paper investigates the compatibility of Hegel’s analyses of the mechanization of work in industrial society with Hegel’s notion of freedom as rational self-determination. Work as such is for Hegel a crucial moment on the way to a more complete realization of human freedom, but, as I maintain with Adorno, the technological developments of the last two centuries raise the question of whether the nature of work itself has changed since the industrial revolution. In his Jena lectures, Hegel recognized significant (...) problems that the mechanization of work poses for human freedom that—on my assessment—his later, mature thought does not sufficiently address. One finds, however, a more comprehensive depiction of the same worries that Hegel mentioned in his Jena lectures in Adorno’s critique of the dominant forms of labor in contemporary society and his understanding of technological rationality, which according to Adorno, dominates the contemporary world. I suggest, furthermore, that juxtaposing Hegel’s and Adorno’s thoughts on technology and the mechanization of work reveals Adorno’s philosophy of technology to be an extension, rather than a critique, of the spirit of Hegel’s own philosophical project as immanent critique of the necessary entailments of any given concept. Dispositionalism is the view that the world is, ultimately, just a world of objects and their irreducible dispositions, and that such dispositions are, ultimately, the sole explanatory ground for the occurrence of events. This view is motivated, partly, by arguing that it affords, while non‐necessitarian views of laws of nature do not afford, an adequate account of our intuitions about which regularities are non‐accidental. I, however, argue that dispositionalism cannot adequately account for our intuitions about which regularities are non‐accidental. Further, (...) I argue that, intuitions aside, if we suppose that our world contains objects along with their irreducible dispositions, we must suppose, on pain of logical incoherence, that it contains laws of nature that are incompatible with a dispositionalist ontology. Indeed, if we suppose a world of objects and irreducible dispositions, we will have to suppose that the most prominent views of laws of nature currently on offer are all inadequate. (shrink)

In this paper we examine a puzzle recently posed by Aaron Preston for the traditional realist assay of property (quality) instances. Consider Socrates (a red round spot) and red1—Socrates’ redness. For the traditional realist, both of these entities are concrete particulars. Further, both involve redness being `tied to’ the same bare individuator. But then it appears that red1 is duplicated in its ‘thicker’ particular (Socrates), so that it can’t be predicated of Socrates without redundancy. According to Preston, this suggests that (...) a concrete particular and its property instances aren’t genuinely related. We argue that Preston’s proffered solution here—to treat property instances as “mental constructs”—is fraught with difficulty. We then go on to show how, by fine-tuning the nature of bare particulars, treating them as abstract modes of things rather than concrete particulars, the traditional realist can neatly evade Preston’s puzzle. Previous papers on ethics consultation in medicine have taken a positivistic approach and lack critical scrutiny of the psychosocial, political, and moral contexts in which consultations occur. This paper discusses some of the contextual factors that require more careful research. We need to know more about what prompts and inhibits consultation, especially what factors effectively prevent house officers and nonphysicians from requesting consultation despite perceived moral conflict in cases. The attitudes and institutional power of attending medical staff seem important, especially (...) where innovative interventions raise ethical questions. Ethics consultants also need to address the thorny problems of the origin(s) of the consultant's authority, whistleblowing, conflicts of interest that affect the consultant, persistently poor communications in hospitals, systemic inequity in the availability or quality of services for some, and the standing of the consultant's recommendations, including their appearance in the patient's medical record. Brown (bio)1As anyone who is familiar with more recent theological debate can attest, the appraisal of the liberal democratic tradition has undergone a radical reevaluation in the wake of Stanley Hauerwas’s and Alasdair MacIntyre’s scathing critiques. As a result of their blistering assault, religious ethicists and philosophers now find themselves (...) operating within a discursive milieu that is almost the photo negative of the one they previously inhabited. For what has followed After Virtue and After Christendom is a situation in which compliance with liberal democratic norms is now perceived as actively inveighing against justice rather than as an integral prerequisite to its pursuit.There are cracks, however, beginning to emerge in the MacIntyre/Hauerwas edifice. For what is becoming disputed and increasingly so among a growing chorus of religious ethicists and philosophers is whether their critical reading of liberal democracy offers the most [End Page 155] helpful or even the most biblical way to think through its own moral dimensions as well as those undergirding its relationship with justice.It is the emergence of these criticisms that forms the basis for this essay. For the thesis that I wish to advance below is that liberal democracy offers religious ethicists and philosophers alike a moral framework and vocabulary from which it is possible to comprehend and enact the normative precepts encapsulated within a biblical understanding of justice. Accordingly, some aspects of my argument will build upon the rhetorical trajectories that have been already charted by the ethicists and philosophers I mention above.What distinguishes my approach, however, is that I will proceed from a more focused examination of some of the ethical and political undercurrents found within contemporary Jewish thought. More specifically, I want to probe the ethical philosophy of Emmanuel Levinas and the political philosophy of Michael Walzer, for I believe the juxtapositional methodology of interpretation which informs each of their perspectives is illustrative of an interstitial hermeneutic that helps further illuminate the moral compatibility between biblical and democratic accounts of justice.2By now, MacIntyre’s and Hauerwas’s critiques of the liberal democratic tradition have been so thoroughly documented, discussed, and dissected that a review of their perspectives cannot help but have a certain pleonastic quality.Probably the most significant and disturbing problem that MacIntyre and Hauerwas see belying the liberal democratic tradition stems from its conception of time and space, or more precisely, its lack thereof. For what they discover upon a more careful probing of its moral and epistemological underpinnings is a pursuit of transcendence not dissimilar to Gnostic metaphysics. In the case of liberalism, however, the existential encumbrances to be excised are not corporeal and carnal in nature, but historical and social. [End Page 156]Such conditionalities, surmise liberal theorists, are so shot through with conceptual prejudices that they comprise an interpretative straight-jacket that vitiates against the kind of objectivity necessary to engage in a nonparochial process of moral and political discernment. For it is precisely this ability “to be able to stand back from any and every situation in which one is involved, from any and every characteristic that one may possess, and to pass judgment on it from a purely universal and abstract point of view that is totally detached from all social particularity” which MacIntyre sees as constituting “the essence of moral agency” of modern liberalism (AV 31–32). Therefore, “liberalism is successful,” maintains Hauerwas, “exactly because... [it] provide[s] that philosophical account of society designed to deal with” the moral and political implications such a social and historical denuding portends, namely “a system of rules that will constitute procedures for resolving disputes as they pursue their various interests.”1However, what liberalism defines as success MacIntyre and Hauerwas see as anything but. Instead, both judge its “system of rules” to be an insidious prescription for a particularly virulent form of moral nihilism and political bankruptcy. Next SectionObjectives To evaluate the adequacy of paediatric informed consent and its augmentation by a supplemental computer-based module in paediatric endoscopy. Methods The Consent-20 instrument was developed and piloted on 47 subjects. Subsequently, parents of 101 children undergoing first-time, diagnostic upper endoscopy performed under moderate IV sedation were prospectively and consecutively, blinded, randomised and enrolled into two groups that received either standard form-based informed consent or standard form-based informed consent plus a commercial (Emmi Solutions, Inc, Chicago, Il), sixth grade level, (...) interactive learning module (electronic assisted consent). Anonymously and electronically, the subjects' anxiety (State Trait Anxiety Inventory), satisfaction (Modified Group Health Association of America), number of questions asked, and attainment of informed consent were assessed (Consent-20). Statistics were calculated using t test, paired t test, and Mann Whitney tests. Results The ability to achieve informed consent, as measured by the new instrument, was 10% in the control form-based consent group and 33% in the electronic assisted consent group (p<0.0001). Electronically assisting form-based informed consent did not alter secondary outcome measures of subject satisfaction, anxiety or number of questions asked in a paediatric endoscopy unit. Conclusions This study demonstrates the limitations of form-based informed consent methods for paediatric endoscopy. It also shows that even when necessary information was repeated electronically in a comprehensive and standardised video, informed consent as measured by our instrument was incompletely achieved. The supplemental information did, however, significantly improve understanding in a manner that did not negatively impact workflow, subject anxiety or subject satisfaction.
