The appeal of the moral principle according to which we should treat like cases alike is so great that it verges on the axiomatic, or on the platitudinous. Recently, however, the principle has been challenged in deeply interesting ways. These ways are interesting because they do not invite skepticism about morality at large, but about the specific claim that what is good (or bad) for an agent in a given situation must be good (or bad) for any other similarly situated (...) agent. I here assess the post-challenge viability of the principle. In a sense, the principle survives, but this is neither an unqualified victory nor an inspiring result. The examination of these matters contains an important (and under-investigated) lesson about the nature of moral experience. (shrink)

Victor Tadros’ The Ends of Harm is the most recent systematic attempt to defend the good old utilitarian justification of punishment. The attempt fails for a variety of reasons, which are here explored. First, the attempt presupposes an implausible account of human’s psychology. Second, the attempt confuses an attack on retributivism with an attack on certain criminal justice systems. Finally, Tadros admits that his justification of punishment is best seen as a mere step along the road to full-blown abolitionism – (...) and so he unwittingly admits the extraordinarily thin sense in which he could be said to be really attempting to justify punishment. A partir daí, busca reacender o debate, sempre necessário, sobre teoria, analogia e conceito, à luz da produção do conhecimento científico, destacando abordagens supradisciplinares e transparadigmáticas. Para tanto, socorre-se de diferentes áreas do conhecimento científico, a sociologia clássica e contemporânea, elementos da biologia, aspectos da cibernética, para demostrar que a (...) ciência, de modo geral, considerando suas múltiplas disciplinas, intercambia de forma cada vez mais dinâmica raciocínios analógicos, com vistas a dar conta da crescente complexidade em que se encontra.: This paper begins by discussing a classical theme in epistemology, namely analogy, concept, and theory using. El presente artículo tiene como objetivo develar la implicación de los nexos entre la cultura y los procesos de comprensión y desarrollo psíquico para la concepción e instrumentación de una enseñanza desarrolladora atendiendo a que el desarrollo psíquico del sujeto es una condición esencial para lograr su papel activo y creador en el desarrollo social. Por ello su tránsito a niveles cualitativamente superiores, constituye una prioridad para los sistemas educativos. La teoría histórico - cultural del desarrollo psíquico le da especial (...) importancia al papel de la cultura y su asimilación en la formación y desarrollo de la personalidad. Además, disciplinas como la semiótica reconocen el papel del texto y los procesos textuales en la conservación, transmisión y re-creación de la cultura. El estudio realizado se basa en la sistematización de postulados básicos de la teoría histórico - cultural del desarrollo psíquico y la semiótica de la cultura. This article aims at revealing the implications of the links between culture and the processes of understanding and psychic development towards the conception and implementation of developmental teaching taking into account that an individual's psychic development is an essential condition to fulfil its active and creative role in social development. That is why its movement to qualitatively superior levels is a priority for educational systems. The historical-cultural theory gives special importance to the role of culture and its assimilation in the formation and development of the personality. Furthermore, disciplines such as semiotics recognize the role of texts and textual processes in the conservation, transmission and recreation of culture. This study is based on the systematization of basic postulates of the historical-cultural theory of psychic development and Culture Semiotics. (shrink)

The living forms represented in this paper are sets of parts that spontaneously increase in organization. Their organizations are measured by an information-theoretic function derived from the work of Boltzmann and Shannon. We briefly review its derivation in the context of the troubled role of mathematics in biology, and then define the function. We illustrate its nature by measuring the 22 different organizations of a set of eight things; and we facilitate its use by defining the parameters that determine an (...) amount of organization. The measure is then applied to show that the organization of limb pairs on free-living arthropods, based on data given by Cisne, confirms a pattern of increasing organization in their evolution from the Cambrian era to the present. Further applications measure the changes in organizations of ideal (theoretical) life forms, and contrasting changes in inanimate systems. Our main results represent the reproduction of unicellular organisms, and the formation of hierarchies, as processes of increasing organization. (shrink)

De oude idealen van regering door de best opgeleiden, die weten hoe zij met de verantwoordelijkheid van de macht moeten omgaan, zijn thans vervangen door technologie in vele vormen, die slechts een schijn van democratie in stand houden.

Der Aufsatz bietet einen Einblick in die Möglichkeiten, Normen zu umgehen - einer Praxis mit, wie gezeigt wird, langer Tradition. Die dargestellten Methoden reichen von einer Beeinflussung des Wissens des Täters, über das Heranziehen "anderer", seien es Menschen oder Maschinen, um die gewünschte aber verbotene Handlung vorzunehmen, bis hin zu Änderungen in den Kausalverläufen. Der Grund für diese Umgehungsmöglichkeiten liegt im Formalismus deontologischer Systeme, die im Gegensatz zu utilitaristischen Positionen gerade nicht auf die Folgen einer Handlung abstellen.

During the last decades the physico-chemical conception of self-organization of chemical systems has been created. The chemical systems in natural-historical processes do not have any creator: they rise up from irreversible processes by self-organization. The issue of self-organization in physics has led to a new interpretation of the laws of nature. As Ilya Prigogine has shown, they do not express certainties but possibilities and describe a world that must be understood in a historical way. In the new philosophical understanding of (...) nature priority is not ascribed to any single type or level of entity, but to historical processes, to processes of endless generation and change.
