In this classic analysis, Leo Strauss pinpoints what is original and innovative in the political philosophy of Thomas Hobbes.

In this paper, I explore what gives collective testimony its epistemic credentials, through a critical discussion of three competing accounts of the epistemology of collective testimony. According to the first view, collective testimony inherits its epistemic credentials from the beliefs the testimony expresses— where this can be seen either as the beliefs of all or some of the group’s members, or as the beliefs of group itself. The second view denies any necessary connection to belief, claiming instead that the epistemic (...) credentials of collective testimony derive from the reliability or truth-conduciveness of the statement that expresses the testimony. Finally, the third view claims that the epistemic credentials of collective testimony derive from the fact that it involves undertaking a collective commitment to trustworthiness, which makes the group susceptible to rebuke and blame if its testimony is not trustworthy. I argue that this last account holds the most promise for preserving what is distinctive about testimonial knowledge while still underwriting a robust epistemology of collective testimony. (shrink)

On Tyranny is Leo Strauss's classic reading of Xenophon's dialogue, Hiero or Tyrannicus, in which the tyrant Hiero and the poet Simonides discuss the advantages and disadvantages of exercising tyranny. This article offers a conceptual clarification of the Aristotelian component in environmental virtue ethics (EVE). It demonstrates that throughout the last four decades, contributors to EVE have favored an Aristotelian foundation (though a Humean base also has been proposed), and it presents six theoretical challenges and two underexplored possibilities premised on such an Aristotelian foundation of EVE. These two possibilities concern: 1) Aristotle’s notion of the city-state (polis), denoting not only a densely populated area, but also agricultural land outside the (...) city-walls, implying agrarian virtues were implicit in the Aristotelian framework; this is valuable to modern agriculture, and the ways in which environmentally friendly virtues are integrated into food production and consumption. 2) Aristotle’s understanding of well-being (eudaimonia) as existing not only at an individual level, but also at a collective level; the latter is relevant to the prospect of upscaling eudaimonia to a structural level, within the limits of an ecologically sustainable citizenship. Why do many societies moralize apparently harmless pleasures, such as lust, gluttony, alcohol, drugs, and even music and dance? Why do they erect temperance, asceticism, sobriety, modesty, and piety as cardinal moral virtues? According to existing theories, this puritanical morality cannot be reduced to concerns for harm and fairness: It must emerge from cognitive systems that did not evolve for cooperation (e.g., disgust-based “purity” concerns). Here, we argue that, despite appearances, puritanical morality is no exception to the cooperative function of (...) moral cognition. It emerges in response to a key feature of cooperation, namely that cooperation is (ultimately) a long-term strategy, requiring (proximately) the self-control of appetites for immediate gratification. Puritanical moralizations condemn behaviors which, although inherently harmless, are perceived as indirectly facilitating uncooperative behaviors, by impairing the self-control required to refrain from cheating. Drinking, drugs, immodest clothing, and unruly music and dance are condemned as stimulating short-term impulses, thus facilitating uncooperative behaviors (e.g., violence, adultery, free-riding). Overindulgence in harmless bodily pleasures (e.g., masturbation, gluttony) is perceived as making people slave to their urges, thus altering abilities to resist future antisocial temptations. Daily self-discipline, ascetic temperance, and pious ritual observance are perceived as cultivating the self-control required to honor prosocial obligations. We review psychological, historical, and ethnographic evidence supporting this account. We use this theory to explain the fall of puritanism in western, educated, industrialized, rich, and democratic (WEIRD) societies, and discuss the cultural evolution of puritanical norms. Explaining puritanical norms does not require adding mechanisms unrelated to cooperation in our models of the moral mind. (shrink)

Recent feminist philosophy of language has highlighted the ways that the speech of women can be unjustly impeded, because of the way their gender affects the uptake their speech receives. In this chapter, I explore how similar processes can undermine the speech of a different sort of speaker: Indigenous communities. This involves focusing on Indigeneity rather than gender as the salient social identity, and looking at the ways that group speech, rather than only individual speech, can be unjustly impeded. To (...) do this, I make use of the notion of ‘discursive injustice’ that has been developed by Quill Kukla, and, with reference to three case studies, show how discursive injustice can effectively derail the speech of Indigenous communities. Although this new emphasis has fathered interesting new perspectives, it has also blurred the distinction between mathematics and other scientific fields. This distinction can be clarified by examining the special interaction of thebodyandimagesof mathematics.Mathematics has an objective, ever-expanding hard core, the growth of which is conditioned by socially and historically determined images of mathematics. Mathematics also has reflexive capacities unlike those of (...) any other exact science. In no other exact science can the standard methodological framework usedwithinthe discipline also be used to study the nature of the discipline itself.Although it has always been present in mathematical research, reflexive thinking has become increasingly central to mathematics over the past century. Many of the images of the discipline have been dictated by the increase in reflexive thinking which has also determined a great portion of the contemporary philosophy and historiography of mathematics. We sometimes have to choose between options that are seemingly incomparable insofar as they seem to be neither better than, worse than, nor equal to each other. This often happens when the available options are quite different from one another. For instance, consider a choice between prioritizing either criminal justice reform or healthcare reform as a public policy goal. Even after the relevant details of the goals and possible (...) reforms are filled in, it is plausible that neither goal is better than, worse than, nor equal to the other. Such seemingly incomparable options present a problem for rational choice since it is unclear how an agent might rationally choose between them. What we need are some principles to help govern rational choice when faced with seemingly incomparable options. I here present three such principles. While each principle is individually compelling, I show that they are jointly incompatible. I then argue that the correct response to this inconsistent triad is to reject the principle that rationally censures performing a sequence of choices one knows will result in a suboptimal outcome. The upshot is that when seeming incomparability is involved, an agent can money pump themselves without being less rational for it. (shrink)

Linda Radzick's new book, _The Ethics of Social Punishment_, contains an important discussion of punishment outside the context of the state. By way of celebrating this fine and welcome book, I try to probe some analytical contours concerning punishment seen from the general perspective on which Radzick and I agree. I suggest altogether abandoning the idea that (non-state) punishment needs to be inflicted by an authority. Furthermore, I insist on an account of retributivism that resists the usual accusations of barbarism (...) and bloodthirstiness. (shrink)

The two books set out a sweeping proposal for reforming our criminal law in ways that are at once commonsensical and mindbogglingly radical. But even if one is not on board with such a radical experiment, simply thinking it through holds many unexpected lessons: startlingly new insights about the current regime and about novel ways of doing legal (...) theory, some of which are explored in this essay. My explication of the first proof shows it to beelegant but based on an invalid inference. In myreconstruction of the second proof, the main argumentis that the sign of a logical constant does not denotebecause it possesses the punctuation-mark-nature. The purpose of this paper is to offer an interpretation of the Tractatus’ proof of the unity of logic and language. The kernel of the proof is the thesis that the sole logical constant is the general propositional form. I argue that the Grundgedanke, the existence of the sole fundamental operation N and the analyticity thesis, together with the fact that the operation NN can always be seen as having no specific formal difference between its result and its base, imply (...) that NN is intrinsic to every elementary proposition. I also argue that the picture theory of proposition is an account of the generation of propositions via naming, and that its crucial idea is that naming is the instantiation of the form of a name, which consists in arbitrarily picking out an object as the meaning of the name from those objects sorted out by the form of the name. It follows that the existential quantifier, that is, NN, is intrinsic to naming (and therefore to every elementary proposition). It is then proven that the sole logical constant is the general propositional form. This, together with the truth‐functionality of logical necessity, implies that logic and language are unified via a general rule – logical syntax. (shrink)

Thomas Taylor’s interpretation of Plato’s works in 1804 was condemned as guilty by association immediately after its publication. Taylor’s 1804 and 1809 reviewer thus made a hasty generalisation in which the qualities of Neoplatonism, assumed to be negative, were transferred to Taylor’s own interpretation, which made use of Neoplatonist thinkers. For this reason, Taylor has typically been marginalised as an interpreter of Plato. This article does not deny the association between Taylor and Neoplatonism. Instead, it examines the historical and historiographical (...) reasons for the reviewer’s assumption that Neoplatonic readings of Plato are erroneous by definition. In particular, it argues that the reviewer relied on, and tacitly accepted, ethical and theological premises going back to the historiography of philosophy developed by Jacob Brucker in his Historia critica philosophiae . These premises were an integral part of Brucker’s Lutheran religiosity and thus theologically and ethically biased. If these premises are identified, articulated and discussed critically—which they have not been so far in connection with Taylor’s reception—it becomes less obvious that the reviewer was justified in his assumption that the Neoplatonic reading was erroneous by definition. This, in turn, leaves Taylor’s Plato interpretation in a more respectable position. (shrink)

In this paper I critically discuss Miranda Fricker’s ‘trust-based’ view of collective testimony—that is, testimony that comes from a group speaker. At the heart of Fricker’s account is the idea that testimony involves an ‘interpersonal deal of trust’, to which the speaker contributes a commitment to ‘second-personal epistemic trustworthiness’. Appropriating Margaret Gilbert’s concept of joint commitment, Fricker suggests that groups too can make such commitments, and hence that they, like individuals, can ‘enter into the second-personal relations of trust that characterise (...) testimony’ (Fricker 2012: 272). I argue that this choice to appropriate Gilbert’s concept of joint commitment betrays a deep problem in Fricker’s account—a misconstrual of both the object and the subject(s) of the commitment a speaker makes in testifying. After developing this criticism, I outline an alternative way of construing the speaker’s commitment, which can be applied to both collective and individual testimony. (shrink)

Some transgender and nonbinary people undergo phalloplasty and/or metoidioplasty as part of their medical transition process. Across surgical disciplines, a variety of resources are used to assist patients who are preparing for surgeries, including educational materials, workshops, peer support, and lifestyle changes. For gender-affirming surgeries, patients undergoing assessments to discern whether they are ready to undergo the surgery, and to assist them in achieving preparedness when needed. Little research investigates what resources are useful in helping patients to feel prepared to (...) undergo phalloplasty or metoidioplasty, and how assessments and resources can promote patient autonomy in the process. Respect for patient autonomy is one of the central tenets of ethical healthcare, yet historically, scholarship related to pre-surgical assessments for gender-affirming surgery has focused determining the ideal surgical candidate rather than respecting patient autonomy and ascertaining individual patient needs. This study sought to fill this gap by utilizing data from PROGRESS (Patient-Reported Outcomes of Genital Reconstruction and Experiences of Surgical Satisfaction), a cross-sectional, community-based survey of trans and nonbinary adults from the United States of America and Canada who had undergone one or more of these surgeries. Results revealed most participants (86%, n = 186) felt prepared to undergo surgery, though the majority of our sample (53%, n = 105) did not find referral letter assessments to be helpful. Peer support such as online resources/blogs were rated as highly useful, along with surgical consults. In a multivariable logistic regression, higher perceived preparedness was associated with identifying as queer (inclusive of gay, bi and pansexual compared to being straight), and feeling that one’s assessment process was useful (as opposed to not useful). Type of assessment was not significantly associated with preparedness; therefore, what is most useful when preparing for surgery may vary across individuals. Healthcare professionals who interact with preparing patients should develop new or utilize existing resources to assist patients in identifying their preparation needs and achieving preparedness. Our data supports assessments that center surgical care planning rather than assessing level of gender dysphoria. Future longitudinal research could further refine which assessment processes are most effective in helping patients who are preparing for these surgeries. Assessments should ensure that patients are appropriately prepared to undergo and recover from surgery through a robust process of informed consent. (shrink)

In this essay I examine and discuss the concept “system of philosophy” as a methodological tool in the history of philosophy; I do so in two moves. First I analyze the historical origin of the concept in the seventeenth and eighteenth centuries. Thereafter I undertake a discussion of its methodological weaknesses—a discussion that is not only relevant to the writing of history of philosophy in the seventeenth and eighteenth centuries, but also to the writing of history of philosophy in our (...) times, where the concept remains an important methodological tool. My first move is to analyze Jacob Brucker’s employment of the concept in his influential history of philosophy, Historia critica philosophiae, dating from 1742–1744. To Brucker, a “system of philosophy” is characterized by the following four features: it is autonomous in regard to other, non-philosophical disciplines; all doctrines stated within the various branches of philosophy can be deduced from one principle; as an autonomous system it comprises all branches of philosophy; the doctrines stated within these various branches of philosophy are internally coherent. Brucker employed the concept on the entire history of philosophy, and he gave it a defining role in regard to two other methodological concepts, namely “eclecticism” and “syncretism,” which he regarded as more or less successful forms of systematic philosophy. My second move is to point out the weakness of the concept of “system of philosophy” as a methodological tool in the history of philosophy. I argue that the interdisciplinary nature of much premodern philosophy makes Brucker’s methodological concept “system of philosophy” inadequate, and that we may be better off leaving it behind in our future exploration of premodern philosophy. This paper aims to explain how the Tractatus attempts to unify logic by deriving the truth-functionality of logical necessity from the thesis that a proposition shows its sense. I first interpret the Tractarian notion of showing as the displaying of what is intrinsic to an expression (or a symbol). Then I argue that, according to the Tractatus, the thesis that a proposition shows its sense implies the determinacy of sense, the possibility of the complete elimination of non-primitive symbols, the analyticity (...) thesis and the strong analyticity thesis. The picture theory emerges as what provides the only acceptable account of an elementary proposition, subject to the constraint that a proposition must show its sense. The picture theory and the analyticity thesis then entail the contingency thesis (that an elementary proposition is contingent) and the independence thesis (that elementary propositions are mutually logically independent) which, together with the strong analyticity thesis, imply that all logical propositions are tautologies. The present issue of Science in Context comprises a collection of articles dealing with various, specific aspects of the history of mathematics during the last third of the nineteenth century and the first half of the twentieth. Like the September issue of 2003 of this journal, which was devoted to the history of ancient mathematics, this collection originated in the aftermath of a meeting held in Tel-Aviv and Jerusalem in May 2001, under the title: “History of Mathematics in the Last (...) 25 Years: New Departures, New Questions, New Ideas.” Taken together, these two topical issues are meant as a token of appreciation for the work of Sabetai Unguru and his achievements in the history of mathematics. In Plato’s Gorgias 482c4–484c3, Callicles advances a concept of natural justice: the laws of the polis must agree with nature, that is, human nature. Since human nature is characterised by its desire to get a greater share, nature itself makes it legitimate that stronger human beings get a greater share than weaker ones. Socrates objects: Callicles’ theoretical approach to civic life poses a threat to the polis’ community, its citizens, and to the friendship amongst its citizens. However, Socrates accepts Callicles’ (...) premise, that the laws of the polis must agree with nature. Still, he disagrees with Callicles about the nature of human nature and proposes an alternative theory of human nature, eventually leading to his alternative concept of natural justice. The article explains the arguments underpinning these two concepts of natural justice, including the conflicting understandings of human nature. (shrink)

In a stable theory, a stationary type $q \in S\left$ internal to a family of partial types ${\cal P}$ over A gives rise to a type-definable group, called its binding group. This group is isomorphic to the group $Aut\left$ of permutations of the set of realizations of q, induced by automorphisms of the monster model, fixing ${\cal P}\,\mathop \cup \nolimits \,A$ pointwise. In this article, we investigate families of internal types varying uniformly, what we will call relative internality. We prove (...) that the binding groups also vary uniformly, and are the isotropy groups of a natural type-definable groupoid. We then investigate how properties of this groupoid are related to properties of the type. In particular, we obtain internality criteria for certain 2-analysable types, and a sufficient condition for a type to preserve internality. (shrink)

Der Aufsatz bietet einen Einblick in die Möglichkeiten, Normen zu umgehen - einer Praxis mit, wie gezeigt wird, langer Tradition. Die dargestellten Methoden reichen von einer Beeinflussung des Wissens des Täters, über das Heranziehen "anderer", seien es Menschen oder Maschinen, um die gewünschte aber verbotene Handlung vorzunehmen, bis hin zu Änderungen in den Kausalverläufen. Der Grund für diese Umgehungsmöglichkeiten liegt im Formalismus deontologischer Systeme, die im Gegensatz zu utilitaristischen Positionen gerade nicht auf die Folgen einer Handlung abstellen.

Negligence, the creation of an unjustifiable risk of harm, plays a pivotal role in both criminal and civil law. This article takes up two negligence-related problems unique to its role in the criminal law. The first has to do with its "harm" component, the second with its "unjustifiability" component. The first problem is why the criminal law distinguishes so sharply between negligent wrongdoing that results in harm and negligent wrongdoing that does not, when it does not distinguish equally sharply between (...) intentional wrongdoing that results in harm and intentional wrongdoing that does not. The answer has to do with a peculiar feature in the logic of intention and with the symmetric way we ascribe responsibility for blameworthy and praiseworthy actions. My second problem is why the criminal law judges the blameworthiness of negligent actions on the basis of the harm wrought rather than the gap between the harm wrought and the justification for risking it. The answer has to do with a more general feature of the criminal law, the refusal to recognize "partial defenses" and "partial offenses.". (shrink)

Libertarians believe certain things about rights and responsibilities, about when one person is to be held responsible for invading the rights of another. Libertarians also believe certain things about consent, about when someone should be held to a contract he has entered into. What they don't realize is that the first set of beliefs doesn't mix well with the second set of beliefs—that their intuitions about rights and responsibilities quite simply don't square with their intuitions about consent. This essay explores the case against strict liability offenses as part of the more general debate about proportional punishment. This debate takes on a very different look in light of a formal result derived by the authors elsewhere, that is briefly summarized and whose implications are pursued here. Traditional objections that consequentialists have mounted against the deontologists’/retributivists’ defense of proportionality fall by the wayside, but a new threat to the proportionality requirement replaces it: the ease with which any such requirement (...) can be circumvented. In other words, as my mouth moved to speak, now in Spanish and now in English, I was able to capture and translate not only the words being said but also the feelings and emotions and the deeper meaning of what was being communicated. For example, when the young man asked, "¿Voy a estar bien?" ["Am I going to be OK?"] I could "hear" his real question, "Am I dying?" When the doctor said, "Your CD4+ cell count is less than 200," I heard him say, "Couldn't you have chosen another place to die?" Conscious of my role, however, I limited myself to performing my duties as professionally and precisely as possible.The following day, I consulted with a professional interpreter who worked at the same hospital, and I asked her how I could be more helpful to the young man.
