ABSTRACT Between April 1820 and April 1822, stimulated by the restoration of the Cádiz Constitution, Bentham devoted himself to writing a number of works on the constitutional reform and colonial rule of Spain, which have been sources of a scholarly debate over Bentham's views on colony. By examining those works, this essay aims to supplement the scholarly debate by drawing attention to a thesis that Bentham developed in his criticism and evaluation of the Cádiz Constitution: a thesis concerning the irreconcilable (...) incompatibilities of liberal constitution and colonisation. I focus on Bentham's critical analyses of the Constitution, and indicate that Spain's colonial rule of Ultramaria not only intensified the weaknesses of the Constitution, but also rendered its merits useless, if not harmful, to the public in both hemispheres. Moreover, I explore the tension that Bentham detected between liberal constitutionalism and colonialism. I maintain that, in Bentham's observation, the civil rights granted by the Cádiz Constitution to the Ultramarians stood to facilitate the enlightenment of citizens and the formation of civil society. As a consequence, the delusion of the Spanish ruling few would be exposed, and the Ultramarians’ discontent with exploitation by such foreign rulers would sow the seeds of disobedience and resistance. One of the greatest problems facing luxury goods firms in a globalizing market is that of counterfeiting. The purpose of this paper is to analyze the different types of counterfeiting that take place in thefashion industry and the ethical issues raised. We argue that the problem partly lies in the industry itself. Copying of designs is endemic and condoned, which raises several ethical dilemmas in passing judgment on the practice of counterfeiting. We analyze the ethical issues in a number of (...) different types of counterfeiting encountered in the fashion industry. We conclude with some observations on the general implications for ethics in intellectual property rights. (shrink)

Five experiments investigated how people use categories to make inductions about objects whose categorisation is uncertain. Normatively, they should consider all the categories the object might be in and use a weighted combination of information from all the categories: bet-hedging. The experiments presented people with simple, artificial categories and asked them to make an induction about a new object that was most likely in one category but possibly in another. The results showed that the majority of people focused on the (...) most likely category in making inductions, although there was a group of consistently normative responders who used information from both categories (about 25% of our college population). Across experiments the overall pattern of results suggests that performance in the task is improved not by understanding the underlying principles of bet-hedging but by increasing the likelihood that multiple categories are in working memory at the time of the induction. This paper presents an autobiographical narrative of two aspects of my history; two events that permeated my moral consciousness and influenced my political development and a sequence of changes in my dominant theoretical and epistemological perspectives. The two events were, as a teenager, the intense experience of briefly witnessing Apartheid culture and, as a young adult, becoming deeply engaged in feminist activism. My intellectual journey began in cognitive developmental theory and progressed to a cultural, discursive perspective in which the role (...) of affect is seen as integrated. It remains unclear whether such genetic variants are associated with disease aggressiveness. The NCI-SPORE Genetics Working Group retrospectively collected clinicopathologic information and genotype data for 36 SNPs which at the time had been validated to be associated with PC risk from 25,674 cases with PC. Cases were grouped according to race, Gleason score and aggressiveness. Statistical analyses were used to compare the frequency (...) of the SNPs between different disease cohorts. After adjusting for multiple testing, only PC-risk SNP rs2735839 was significantly and inversely associated with aggressive and high-grade disease in European men. Similar associations with aggressive and high-grade disease were documented in African-American subjects. The G allele of rs2735839 was associated with disease aggressiveness even at low PSA levels in both European and African-American men. Our results provide further support that a PC-risk SNP rs2735839 near the KLK3 gene on chromosome 19q13 may be associated with aggressive and high-grade PC. Future prospectively designed, case-case GWAS are needed to identify additional SNPs associated with PC aggressiveness. (shrink)

The current COVID-19 pandemic and the previous SARS/MERS outbreaks of 2003 and 2012 have resulted in a series of major global public health crises. We argue that in the interest of developing effective and safe vaccines and drugs and to better understand coronaviruses and associated disease mechenisms it is necessary to integrate the large and exponentially growing body of heterogeneous coronavirus data. Ontologies play an important role in standard-based knowledge and data representation, integration, sharing, and analysis. Accordingly, we initiated the (...) development of the community-based Coronavirus Infectious Disease Ontology in early 2020. -/- As an Open Biomedical Ontology (OBO) library ontology, CIDO is open source and interoperable with other existing OBO ontologies. CIDO is aligned with the Basic Formal Ontology and Viral Infectious Disease Ontology. CIDO has imported terms from over 30 OBO ontologies. For example, CIDO imports all SARS-CoV-2 protein terms from the Protein Ontology, COVID-19-related phenotype terms from the Human Phenotype Ontology, and over 100 COVID-19 terms for vaccines (both authorized and in clinical trial) from the Vaccine Ontology. CIDO systematically represents variants of SARS-CoV-2 viruses and over 300 amino acid substitutions therein, along with over 300 diagnostic kits and methods. CIDO also describes hundreds of host-coronavirus protein-protein interactions (PPIs) and the drugs that target proteins in these PPIs. CIDO has been used to model COVID-19 related phenomena in areas such as epidemiology. The scope of CIDO was evaluated by visual analysis supported by a summarization network method. CIDO has been used in various applications such as term standardization, inference, natural language processing (NLP) and clinical data integration. We have applied the amino acid variant knowledge present in CIDO to analyze differences between SARS-CoV-2 Delta and Omicron variants. CIDO's integrative host-coronavirus PPIs and drug-target knowledge has also been used to support drug repurposing for COVID-19 treatment. -/- CIDO represents entities and relations in the domain of coronavirus diseases with a special focus on COVID-19. Ontologies, as the term is used in informatics, are structured vocabularies comprised of human- and computer-interpretable terms and relations that represent entities and relationships. Within informatics fields, ontologies play an important role in knowledge and data standardization, representation, integra- tion, sharing and analysis. They have also become a foundation of artificial intelligence (AI) research. In what follows, we outline the Coronavirus Infectious Disease Ontology (CIDO), which covers multiple areas in the domain of coronavirus diseases, including etiology, transmission, epidemiology, pathogenesis, diagnosis, (...) prevention, and treatment. COVID-19 often manifests with different outcomes in different patients, highlighting the complexity of the host-pathogen interactions involved in manifestations of the disease at the molecular and cellular levels. In this paper, we propose a set of postulates and a framework for systematically understanding complex molecular host-pathogen interaction networks. Specifically, we first propose four host-pathogen interaction (HPI) postulates as the basis for understanding molecular and cellular host-pathogen interactions and their relations to disease outcomes. These four postulates cover the evolutionary dispositions involved (...) in HPIs, the dynamic nature of HPI outcomes, roles that HPI components may occupy leading to such outcomes, and HPI checkpoints that are critical for specific disease outcomes. Based on these postulates, an HPI Postulate and Ontology (HPIPO) framework is proposed to apply interoperable ontologies to systematically model and represent various granular details and knowledge within the scope of the HPI postulates, in a way that will support AI-ready data standardization, sharing, integration, and analysis. As a demonstration, the HPI postulates and the HPIPO framework were applied to study COVID-19 with the Coronavirus Infectious Disease Ontology (CIDO), leading to a novel approach to rational design of drug/vaccine cocktails aimed at interrupting processes occurring at critical host-coronavirus interaction checkpoints. Furthermore, the host-coronavirus protein-protein interactions (PPIs) relevant to COVID-19 were predicted and evaluated based on prior knowledge of curated PPIs and domain-domain interactions, and how such studies can be further explored with the HPI postulates and the HPIPO framework is discussed. Cosmopolitans including Charles Beitz, David Richards, Brian Barry, Thomas Pogge and Gillian Brock propose the device of an original global position to work out global principles of justice. However, John Rawls does not agree with this kind of proposal. In this paper, I add two key original contributions, which go beyond previous arguments by cosmopolitans and advance the current debates. First, to argue against Rawls’s objection to the global original position, I demonstrate the importance of the distinction between accepting (...) a particular substantive principle and accepting the original position procedure. Second, in order to respond to cultural pluralism, I take a unique approach to show that the idea of the person as free and equal is a fundamental part of the global public culture by examining the most fundamental legal documents: the proto-constitutional documents in international law and the constitutions of the major states. I apply Samuel Huntington’s classification of civilisations to identify the major civilisations and their core states and show that the idea of the person as free and equal is implicit in the constitutions of most influential countries even though these countries are categorised in different civilisations. He argues that necessities of logic and mathematics are determined by God's nature, but that it is events in God's mind - his imagination and choice - that account for necessary truths about concrete creatures.

Brian Hedden defends a radical view about the relationship between rationality, personal identity, and time. On the standard view, personal identity over time plays a central role in thinking about rationality, because there are rational norms for how a person's attitudes and actions at one time should fit with her attitudes and actions at other times. But these norms are problematic. They make what you rationally ought to believe or do depend on facts about your past that aren't part (...) of your current perspective on the world, and they make rationality depend on controversial, murky metaphysical facts about what binds different instantaneous snapshots into a single person extended in time. Hedden takes a different approach, treating the relationship between different time-slices of the same person as no different from the relationship between different people. On his account, the locus of rationality is the time-slice rather than the temporally extended agent. This impersonal, time-slice-centric approach to rationality yields a unified approach to the rationality of beliefs, preferences, and actions where what rationality demands of you is solely determined by your evidence, with no special weight given to your past beliefs or actions. All major western countries today contain groups that differ in their religious beliefs, customary practices or ideas about the right way in which to live. How should public policy respond to this diversity? In this important new work, Brian Barry challenges the currently orthodox answer and develops a powerful restatement of an egalitarian liberalism for the twenty-first century. Until recently it was assumed without much question that cultural diversity could best be accommodated by leaving cultural minorities free to associate (...) in pursuit of their distinctive ends within the limits imposed by a common framework of laws. This solution is rejected by an influential school of political theorists, among whom some of the best known are William Galston, Will Kymlicka, Bhikhu Parekh, Charles Taylor and Iris Marion Young. According to them, this 'difference-blind' conception of liberal equality fails to deliver either liberty or equal treatment. In its place, they propose that the state should 'recognize' group identities, by granting groups exemptions from certain laws, publicly 'affirming' their value, and by providing them with special privileges or subsidies. In Culture and Equality, Barry offers an incisive critique of these arguments and suggests that theorists of multiculturism tend to misdiagnose the problems of minority groups. "Anselm of Canterbury gave the first modal "ontological" argument for God's existence. Yet, despite its distinct originality, philosophers have mostly avoided the question of what modal concepts the argument uses, and whether Anselm's metaphysics entitles him to use them. Here, Brian Leftow sets out Anselm's modal metaphysics. He argues that Anselm has an "absolute", "broadly logical", or "metaphysical" modal concept, and that his metaphysics provides acceptable truth makers for claims in this modality. He shows that his modal argument is (...) committed to the Brouwer system of modal logic, and defends the claim that Brouwer is part of the logic of "absolute" or "metaphysical" modality. The Equal Weight View of disagreement says that if an agent sees that an epistemic peer disagrees with her about p, the agent should change her credence in p to half way between her initial credence, and the peer’s credence. But it is hard to believe the Equal Weight View for a surprising reason; not everyone believes it. And that means that if one did believe it, one would be required to lower one’s belief in it in light of this (...) peer disagreement. Brian Leiter draws on empirical psychology to defend a set of radical ideas from Nietzsche: there is no objectively true morality, there is no free will, no one is ever morally responsible, and our conscious thoughts play almost no significant role in our actions. Nietzsche emerges as not just a great philosopher but a prescient psychologist.

Recently four different papers have suggested that the supervaluational solution to the Problem of the Many is flawed. Stephen Schiffer has argued that the theory cannot account for reports of speech involving vague singular terms. Vann McGee and Brian McLaughlin say that theory cannot, yet, account for vague singular beliefs. Neil McKinnon has argued that we cannot provide a plausible theory of when precisifications are acceptable, which the supervaluational theory needs. And Roy Sorensen argues that supervaluationism is inconsistent with (...) a directly referential theory of names. McGee and McLaughlin see the problem they raise as a cause for further research, but the other authors all take the problems they raise to provide sufficient reasons to jettison supervaluationism. I will argue that none of these problems provide such a reason, though the arguments are valuable critiques. In many cases, we must make some adjustments to the supervaluational theory to meet the posed challenges. The goal of this paper is to make those adjustments, and meet the challenges. (shrink)

After first noting that I seek to broaden the definition of science fiction to a little more loosely defined speculative fiction, this essay explores four different ways in which fiction can work together with both the sciences and the philosophy of perception. This cooperation is needed because there is much about the sensory worlds of humans and non-human animals of which we continue to be ignorant. First, speculative fiction can be a source of hypotheses about the nature of the senses. (...) Second, it can help us understand the inner worlds of beings different from us. Third, speculative fiction often pushes us to investigate the ethical and social dimensions of sensory difference. Finally, speculative fiction can play an important role in reconciling our scientific understanding of the senses with a more commonsense understanding of same. (shrink)

Many researchers believe the tremendous industrial development over the past two centuries is unsustainable because it has led to unintended ecological deterioration. Despite the ever-growing attention sustainable supply-chain management has received, most SSCM research and models look at the consequences, rather than the antecedents or motives of such responsible practices. The few studies that explore corporate motives have remained largely qualitative, and large-scale empirical analyses are scarce. Drawing on multiple theories and combining supply-chain and business ethics literature, we purport that (...) instrumental, relational, and moral motives are behind a firm’s engagement in SSCM practices. Specifically, we examine the links between corporate motives, SSCM practices, and firm performance. Using a sample of 259 supply-chain firms in Germany, we empirically test five hypothesized relationships. Our results reveal that relational and moral motives are key drivers, and that firms exhibiting high levels of moral obligations tend to outperform those primarily driven by amoral considerations. Findings of this study contribute to multiple literatures espousing sustainability management and can help policy makers, stakeholder groups, and scholars develop more robust strategies for encouraging firms to practice SSCM. According to both traditional positivist approaches and also to the sociology of scientific knowledge, social analysts should not themselves become involved in the controversies they are investigating. But the experiences of the authors in studying contemporary scientific controversies—specifically, over the Australian Animal Health Laboratory, fluoridation, and vitamin C and cancer—show that analysts, whatever their intentions, cannot avoid being drawn into the fray. The field of controversy studies needs to address the implications of this process for both theory and practice.

It has been assumed that at the whole organismal level, the mitochondrial reactive oxygen species (ROS) production is proportional to the oxygen consumption. Recently, a number of researchers have challenged this assumption, based on the observation that the ROS production per unit oxygen consumed in the resting state of mitochondrial respiration is much higher than that in the active state. Here, we develop a simple model to investigate the validity of the assumption and the challenge of it. The model highlights (...) the significance of the time budget that mitochondria operate in the different respiration states. The model suggests that under three physiologically possible conditions, the difference in ROS production per unit oxygen consumed between the respiration states does not upset the proportionality between the whole animal ROS production and oxygen consumption. Expanding buprenorphine access in the United States requires evidence-based decision-making that considers both the drug's potential dangers and its potential benefits. Risks associated with buprenorphine misuse and diversion highlight the need for careful, ongoing evaluation during each stage of increased access.

A rich hermeneutic account of the way virtue is understood and developed. Despite its ancient roots, virtue ethics has only recently been fully appreciated as a resource for environmental philosophy. Other approaches dominated by utilitarian and duty-based appeals for sacrifice and restraint have had little success in changing behavior, even to the extent that ecological concerns have been embraced. Our actions often do not align with our beliefs. Fundamental to virtue ethics is an acknowledgment that neither good ethical rules nor (...) good intentions are effective absent the character required to bring them to fulfillment. Brian Treanor builds on recent work on virtue ethics in environmental philosophy, finding an important grounding in the narrative theory of philosophers like Paul Ricoeur and Richard Kearney. Character and ethical formation, Treanor argues, are intimately tied to our relationship with the narratives through which we view the human place in the natural world. By reframing environmental questions in terms of individual, social, and environmental narratives about flourishing, Emplotting Virtue offers a powerful vision of how we might remake our character so as to live more happily, more sustainably, and more virtuously in a diverse, beautiful, wondrous, and fragile world. This paper explores the relationship between psychology and neurobiology in the context of cognitive science. Are the sciences that constitute cognitive science independent and theoretically autonomous, or is there a necessary interaction between them? I explore Fodor's Multiple Realization Thesis (MRT) which starts with the fact of multiple realization and purports to derive the theoretical autonomy of special sciences (such as psychology) from structural sciences (such as neurobiology). After laying out the MRT, it is shown that, on closer inspection, the (...) argument is either circular or self-undermining--the argument either assumes the very autonomy it seeks to demonstrate or the concluded autonomy is contradicted by the theoretical interdependence invoked by the premises of the argument. Next, I explore a concrete example of multiple realization in the explanation of animal behavior: the convergent evolution of jamming avoidance behaviors in three genera of weakly electric fish. Contrary to the image painted by the MRT, the work on these animals involves a high degree of interaction between the various levels of investigation. The fact that our understanding of electric fish behavior involves functional theories and multiple realization without the kind of disunified science that is supposed to follow from such a situation indicates that the mere fact of multiple realization cannot be the basis for an autonomous psychology. Many contemporary explanations of conscious human experience, relying either upon neuroscience or appealing to a spiritual soul, fail to provide a complete and coherent theory. These explanations, the author argues, fall short because the underlying explanatory constituent for all experience are not entities, such as the brain or a spiritual soul, but rather relation and the unique way in which human beings form relations. This alternative frontier is developed through examining the phenomenological method of Martin Heidegger and the semiotic theory (...) of Charles S. Peirce. While both of these thinkers independently provide great insight into the difficulty of accounting for human experience, this volume brings these insights into a new complementary synthesis. This synthesis opens new doors for understanding all aspects of conscious human experience, not just those that can be quantified, and without appealing to a mysterious spiritual principle. (shrink)

Largely a response to Lee Basham’s essay “Malevolent Global Conspiracy.” After presenting an update on the status of conspiracy theories surrounding the 1995 Oklahoma City bombing, I agree with Basham that falsification and paranoia are not effective ways to criticize conspiratorial thinking. However, I am not convinced with the case Basham presents against worries that conspiracy theories often falter by overestimating the ability of large, public institutions to be secretly and effectively controlled. Cet article reprend la question de la traduction de la racine qrn dans le texte d’Habacuc 3. Le terme hébreu qui désigne à la base les « cornes » semble également pouvoir décrire un phénomène lumineux dans deux textes de la Bible hébraïque : Habacuc 3 et Exode 34. Le présent article propose, premièrement, d’analyser l’usage polysémique de qrn en Ha 3 en étudiant le rôle de cette racine comme attribut divin dans la Bible hébraïque ainsi que dans le Proche-Orient (...) ancien. Deuxièmement, il replace l’utilisation polysémique de qrn dans le cadre socio-historique de rédaction du texte d’Ha 3. L’article propose enfin d’associer cette lecture à l’iconographie royale séleucide, qui utilise notamment les cornes rayonnantes dans leur propagande impériale, comme attesté dans la numismatique.
