The “right to repair” movement highlights opportunities to reduce health care costs and promote public health resilience through increased competition in the way in which medical devices are serviced and updated over their lifespan. We review legislative and legal facets of third-party repair of medical devices, and conclude with specific recommendations to help this market function more efficiently to the benefit of patients and health care systems.

The European Commission has recently proposed the introduction of legally binding quotas for women on corporate boards of European companies. This proposal has put the spotlight on the question of whether increasing female representation on the board brings economic benefits to the firm. In order to shed light on the issue, this study investigates the direct and indirect effects of women on the board on firm value. We use a simultaneous equation model to estimate the effects of women on the (...) board on firm value, financial performance, and compliance with ethical and social principles adopted by the firm. We find no evidence that a higher female representation on the board directly affects firm’s value. However, we find indirect effects. Women on the board are positively related with financial performance (measured in terms of return on assets and return on sales) and with ethical and social compliance, which in turn are positively related with firm value. The findings in this study suggest that greater female representation on corporate boards of large European firms can increase firm value indirectly. Further, part of the indirect effect comes from stronger compliance with ethical principles, something that is not captured by accounting-based financial performance. (shrink)

This article argues that while ethical leadership in mainstream theorising is assumed to be a cognitive exercise, leaders’ bodies in fact play a significant role in the social construction of ethical leadership. Their bodies become particularly potent when leaders are depicted via the interplay between visual and verbal modes in the media. In order to extend current understandings of ethical leadership, this study employs a discourse analytic approach to examine how visual and verbal devices convey ethical leadership for two of (...) Australia’s major bank chief executive officers—John Stewart and Ralph Norris—before and during the global financial crisis. Based on the analysis, this article demonstrates that ethical leadership is constructed through the confluence of elite and working class masculinities that is multimodally embodied and disembodied. The article suggests that what it means to be an ethical leader is invariably informed by class-based patriarchal norms that can serve to reinforce the masculinisation of ethics. (shrink)

Provability, Computability and Reflection.

Decision-making capacity (DMC) is the gatekeeping element for a patient’s right to self-determination with regard to medical decisions. A DMC evaluation is not only conducted on descriptive grounds but is an inherently normative task including ethical reasoning. Therefore, it is dependent to a considerable extent on the values held by the clinicians involved in the DMC evaluation. Dealing with the question of how to reasonably support clinicians in arriving at a DMC judgment, a new tool is presented that fundamentally differs (...) from existing ones: the U-Doc. By putting greater emphasis on the judgmental process rather than on the measurement of mental abilities, the clinician as a decision-maker is brought into focus, rendering the tool more of an evaluation guide than a test instrument. In a qualitative study, the perceived benefits of and difficulties with the tool have been explored. The findings show on the one hand that the evaluation aid provides basic orientation, supports a holistic perspective on the patient, sensitizes for ethical considerations and personal biases, and helps to think through the decision, to argue, and to justify one’s judgment. On the other hand, the room for interpretation due to absent operationalisations, related ambiguities, and the confrontation with one’s own subjectivity may be experienced as unsettling. (shrink)

He moves toward these goals through a comprehensive reading of Jean-Jacques Rousseau’s “Socratism” intercalated with Jean Laplanche’s psychoanalytic intervention focused on the (...) universality of untranslatable “enigmatic messages” that shape the (un)conscious of each individual. Through this combination of trajectories, Fain hopes both to deconstruct philosophy’s metaphysical origins along the lines of thinkers from Descartes through Badiou, and also return this fundamental question back to the emergence of the wisdom of eudaimonia, the flourishing of happiness, as a libidinal object.When the teaching, historical periodization, and explication of philosophy takes Rousseau under its wing, it is usually as a political theorist, but, as Fain reminds us, Rousseau explicitly asserts that he is “neither a philosopher nor austere,” but instead a “man of paradox,” a “friend of virtue,” or a “friend of the truth” (qtd. in Fain 5). This is important for it is related to the claims that paradox is an irrevocable trait of thinking, that philosophy requires friends both within and outside its rather blurry boundaries, and that reason cannot, in the end, claim self-grounding knowledge of its own origins and ends. Fain, like Rousseau, writes as a friend of the love of wisdom and “[a]gainst all the odds, the combination of Rousseau with Laplanche amounts to something of a double-dog dare against the ruling conventions of academic philosophy” (ix). The wager has been laid on the table, but it will extend far beyond the contemporary academy.A certain image of Socrates is the central figure around which Fain’s reading of Rousseau is organized. This is Socrates as that oddball Athenian irritant who works to demonstrate, succinctly put, that “virtue is knowledge; happiness is knowledge of the good” (4). This Socrates—and [End Page 92] Socrates is always multiplying—knows the irony of the unknowing and the joy of the virtuously beautiful. Phronēsis will be more foundational than epistēmē and philosophy, in itself—however that “in itself” is construed—will not be sufficient to explain itself. It has a constitutive blind-spot that will need looking into from different perspectives. It will need Rousseau and Laplanche, for instance, as external supports in order to get it into gear, with Laplanche being the psychoanalyst who most systematically brings this “support” of Freud’s Anlehnung—often translated as “anaclitic”—as a relation between the Instinkt of biology and the Trieb of the psyche, into sharper critical relief.Plato, in Theaetetus, succinctly states the origin of philosophy is “wonder” at a point in the conversation focused on questions of becoming and definition, which have already made the Theaetetus “dizzy.” (We all know what that is like.) The mythopoetic—for both Plato and Rousseau—is inseparable from logic’s explanatory force and cannot be extirpated by that force. This article presents an analysis of how a male convert to Islam incorporates events from his life history into a narrative structure in order to construct and maintain a Muslim identity. The study focuses on how the individual and in particular a person's life history becomes social and universal, and how the social and universal becomes particularized and individualized, in the narration of life. The results of the analysis showed that the valued endpoint determines the selection and ordering of different (...) episodes, and the causal connections that are made between them. Many episodes in this convert's life story is similar to other converts' narratives, for example, descriptions of absent significant others during childhood, an inclusion of a Christian phase in life, and the importance attributed to the Qur'an in the process of conversion. The incorporation of these episodes in one's life story and the way the narratives are structured are interpreted as influences from collective narratives. Moreover, the analysis revealed that the selected episodes have important social, individualizing and sedative functions in the flux of discourses in postmodern society. Thus, the individual's Muslim identity is an amalgamation of the particular and the universal and the importance of the narratives lies in the fact that they can integrate particular experiences into a universal structure that gives them a meaning. Purpose The purpose of this paper is to report on empirical work conducted to open up algorithmic interpretability and transparency. In recent years, significant concerns have arisen regarding the increasing pervasiveness of algorithms and the impact of automated decision-making in our lives. Particularly problematic is the lack of transparency surrounding the development of these algorithmic systems and their use. It is often suggested that to make algorithms more fair, they should be made more transparent, but exactly how this can be (...) achieved remains unclear. Design/methodology/approach An empirical study was conducted to begin unpacking issues around algorithmic interpretability and transparency. The study involved discussion-based experiments centred around a limited resource allocation scenario which required participants to select their most and least preferred algorithms in a particular context. In addition to collecting quantitative data about preferences, qualitative data captured participants’ expressed reasoning behind their selections. Findings Even when provided with the same information about the scenario, participants made different algorithm preference selections and rationalised their selections differently. The study results revealed diversity in participant responses but consistency in the emphasis they placed on normative concerns and the importance of context when accounting for their selections. The issues raised by participants as important to their selections resonate closely with values that have come to the fore in current debates over algorithm prevalence. Originality/value This work developed a novel empirical approach that demonstrates the value in pursuing algorithmic interpretability and transparency while also highlighting the complexities surrounding their accomplishment. This article asks how the application of digital technologies is changing the organization of the agri-food system in the context of the third food regime. The academic debate on digitalization and food largely focuses on the input and farm level. Yet, based on the analysis of 280 digital services and products, we show that digital technologies are now being used along the entire food commodity chain. We argue that digital technologies in the third food regime serve on the one hand (...) as a continuation of established information and communication technologies, thus deepening certain features of the existing food regime such as the retail sector’s control over global commodity chains. On the other hand, digital technologies also introduce new forms of control and value extraction based on the use of data and pave the way for large tech companies to take over market shares in the agri-food sector. Finally, we find that multinational agri-food companies are starting to take on the business models of leading digital tech companies, for instance by developing digital platforms throughout the agri-food system. We argue that this shows that the broader economic restructuring of neoliberal capitalism towards digital capitalism is also making its way into the agri-food system. (shrink)

Malpractice issues in psychotherapy and psychological treatments refer to the unethical behavior of a psychologist or psychotherapist toward the patient. The current study reviewed complaints directed at psychologists and psychotherapists in Sweden with regard to possible incidents of malpractice. Eligible cases were retrieved from a database managed by the Health and Social Care Inspectorate [Inspektionen för vård och omsorg (IVO)], an administrative authority responsible for the safety and quality of healthcare and social services delivery. These cases were analyzed using thematic (...) analysis. In total, 33 complaints matched the keywords proposed by IVO, and were scrutinized in detail. The cases primarily involved psychiatric care by a psychologist in outpatient settings, although many cases comprised multiple healthcare providers responsible for the patient’s care, or targeted the healthcare unit as a whole. The results demonstrated that different forms of malpractice occur, and can be classified in two general themes, Incorrect administration and implementation and Attitude and behavior, which involve organizational aspects as well as examples of malpractice and unethical behavior. Implications for clinical practice and future research include further training in ethics and malpractice, video recording or auditing sessions, routine outcome monitoring, and providing patients with information on how to file complaints. This essay examines the scratch as it relates to garbage, scores, and the event. Garbage is that which is cast aside as social systems form themselves, and, as such, is always destined to return. Scores are both methodological maps and experimental artistic methods. And the event, in this context, is the opening that enables both the determination of form and the emergence of the unexpected.

This paper investigates the role of a pre-existing body-model that is an enabling constraint for the incorporation of objects into the body. This body-model is also a basis for the distinction between body extensions (e.g., in the case of tool-use) and incorporation (e.g., in the case of successful prosthesis use). It is argued that, in the case of incorporation, changes in the sense of body-ownership involve a reorganization of the body-model, whereas extension of the body with tools does not involve (...) changes in the sense of body-ownership. From the ideas of Marx and Engels, those of the Marxist theoreticians of the Second International to the debates within Russian Marxism up to World War II, Sheehan masterfully surveys the history of marxist philosophy of science, concluding with a close analysis of the development of the debate among non-Soviet Marxists, placing particular emphasis on the contributions of leading British Marxists in the 1930s. Background: Dignity is a multidimensional construct that includes perception, knowledge, and emotions related to competence or respect. Attitudes to aging are a comprehensive personal view of the experience of aging over the course of life, which can be influenced by various factors, such as the levels of health and self-sufficiency and social, psychological, or demographic factors. Aim: The purpose of this study was to explore the attitudes to aging of home-dwelling and inpatient older adults, and whether dignity and other selected (...) factors belong among the predictors influencing attitudes to aging in these two different groups of older adults. Research design: Cross-sectional study using a set of questionnaires: Patient Dignity Inventory, Attitudes to Aging Questionnaire, and Barthel Index. Pearson and Spearman correlation analyses and multivariable linear regression were used for statistical processing. Participants and research context: 233 inpatients and 237 home-dwelling older adults participated in the research in two regions of the Czech Republic. Ethical considerations: Institutional Review Board approval was received from the authors’ university. Findings: The inpatients had more negative attitudes to aging (M = 74.9±10.9; P <0.0001). The predictors of their attitudes to aging were gender and dignity. Women ( β = −2.969, P = 0.045) and inpatients with poor dignity ratings ( β = −0.332, P <0.0001) had more negative attitudes to aging. The predictors for home-dwelling older adults were education, living arrangement, and dignity. More negative attitudes to aging were found in older adults with lower levels of education ( β = 2.716, P = 0.007) who lived alone ( β = 2.163, P = 0.046) and rated their dignity as low ( β = −0.325, P <0.0001). Discussion and Conclusions: The results of this study add to the understanding that a sense of dignity is an important predictor of attitudes to aging for both home-dwelling older adults and inpatients. Acting for the good of the patient is the most fundamental and universally acknowledged principle of medical ethics. However, given the complexity of modern medicine as well as the moral fragmentation of contemporary society, determining the good is far from simple. In his philosophy of medicine, Edmund Pellegrino develops a conception of the good that is derived from the internal morality of medicine via the physician-patient relationship. It is through this healing relationship that rights, duties, and privileges are defined for (...) both physicians and patients. Moreover, this relationship determines the characteristics or virtues that are necessary to engage in the medical telos. This paper addresses the role of the moral virtues in clinical medicine and the physician-patient relationship. First, it provides a brief background of the Aristotelian foundations of virtue-ethics. Second, it delves into Pellegrino’s philosophy of medicine understood as a practice oriented towards a teleological goal. Third, it relates the telos of medicine to the notion of the medical community as a fundamentally moral community. Finally, it concludes with a section that creates a dialogue between virtue ethics and principlism. (shrink)

In this paper, we discuss the following four alternative ways of understanding the outcomes of resurrection biology. Implications of each of the ways are discussed with respect to concepts of species and extinction. Replication: animals created by resurrection biology do not belong to the original species but are copies of it. The view is compatible with finality of extinction as well as with certain biological and ecological species concepts. Re-creation: animals created are members of the original species but, despite their (...) existence, the species remains extinct. The view is incompatible with all species concepts presented. Non-extinction: animals produced belong to the original species which actually never went extinct. The view may be consistent with phenetic and phylogenetic species concepts as well as with finality of extinction. According to literal resurrection, resurrection biology is successful in reversing extinction through the creation of new members of species that once went extinct. This view presupposes non-finality of extinction and it is compatible with phenetic species concepts. It is notable that no species or extinction concept is consistent with all possible views of resurrection biology nor is any view of resurrection biology consistent with all species or extinction concepts. Thus, one’s views regarding species and extinction determine which views one can adopt regarding resurrection biology and vice versa. (shrink)

This article explores anti-racist education in business schools amidst the backlash against critical race theory in an anti-Black world. I conduct an autoethnography of my experiences as a woman of colour and management educator who has attempted to bring critical discussions of race and racism into my classrooms. The article examines the barriers to anti-racist teaching in business schools and shows how they interweave individual/interpersonal, institutional, and ideological domains of power. Through my stories, I offer an account of the ways (...) anti-racist education may be limited when it relies on the efforts of individual academics and reveal the tolls that anti-racist education can take on the educator, especially when they are navigating wider systems that are hostile to racial justice. By interrogating the challenges of anti-racist education, I also reflect on the practices and conditions that make meaningful anti-racist education possible. (shrink)

Nudges are a way to steer people’s behavior through changes in how choices are presented. Nudge research has been incorporated into public policy in many countries, and nudge research, thus, has the potential to directly influence societies and individuals. As a result, research ethics for nudge research is needed to ensure that nudges developed are not instances of unethical manipulation of people. In this paper, I argue that two types of slippery slopes from ethically fine nudges to ethically problematic ones (...) can take place in nudge research. The conceptual slippery slope follows from (1) the broad way of defining nudges, (2) the multitude of different ways of understanding manipulation of people, (3) many manipulation definitions implying that some nudges are manipulative, and (4) some forms of manipulation of people being prima facie wrong. The empirical slippery slope rests, first, on the possibility of small steps from ethically acceptable to wrong nudges, and second, on the cognitive limits typical to human beings (including nudge researchers). Both slippery slope arguments imply the need to of nudge researchers to create so-called firebreaks. The firebreaks can take the form of ethical justifications. To avoid slippery slopes, certain types of arguments should be excluded from these justifications. (shrink)

This study assessed the International Critical Thinking Essay Test (ICTET-A) for inter-rater reliability, internal reliability, and criterion validity. A self-selecting sample of participants (N = 100) completed the ICTET-A and a comparison test online. We found the ICTET-A items to have moderate to good levels of inter-rater reliability, and overall excellent inter-rater consistency for total test scores. The test had good internal reliability. There was a strong correlation between scores on the ICTET-A and the comparison test. Factor analysis showed that (...) scores were best explained with one factor, suggesting the test measures a single construct. The ICTET-A can therefore be considered a valid measure of critical thinking. Additionally, we propose a short form of the test. (shrink)

From a statistician's viewpoint, the concepts discussed by Chow relating to “statistical” significance bear little resemblance to the concept developed in statistics. Whether or not “statistical significance” has a place in psychological research is a decision for psychologists, not statisticians, to make, but the decision should be based on a less flawed version of what is being considered.
