(1) What may be gained by applying concepts generalised from economics to methodological problems? The perspective of cost-benefit analysis ('CBA' for short) may help the researcher to see what sorts of questions he should take into account when dealing with particular methodological problems. This claim is supported by applying generalised CBA-thinking to two standard problems of methodology. (2) In the practice of research the handling of basic statements does not normally constitute any problem, and no conscious decision is involved. In (...) the methodological reconstruction the key questions are: 'How can a particular basic statement be criticised?' and 'What are the costs of defending a statement that is "problematic"?' The problem of the empirical 'base' is an investment problem: whether or not to invest time and effort into processing a particular basic statement into a falsifying hypothesis for the theory we wish to test. The valuation of the costs of rejecting or, as the case may be, of defending a basic statement, are objective. (3) With respect to theories, in basic science, the issue is not one of acceptance or rejection of a single theory, but rather of theory preference. Both the rational response to a falsification and rational theory preference are governed by CBA-considerations. The option for one of two competing theories is based upon a CBA where the valuation of benefits and costs is objective. Theory change is an objective process, at least in those fields, where theorising is closely controlled by empirical testing: the better theory drives out the less good theory. The costs of defending a theory that is less good than its competitor are mainly epistemic resources forgone. The use of CBA in methodology not only is compatible with Popper's position, but it may pay to view Popper's methodology as an application of CBA to epistemic situations. (shrink)

Essays dealing with the question of how "sense of place" is constructed, in a variety of locations and media.

The Interpolation Theorem, first formulated and proved by W. Craig fifty years ago for predicate logic, has been extended to many other logical frameworks and is being applied in several areas of computer science. We give a short overview, and focus on the theory of software systems and modules. An algebra of theories TA is presented, with a nonstandard interpretation of the existential quantifier ∃. In TA, the interpolation property of the underlying logic corresponds with the quantifier combination property ∃Σ (...) ∃П S ≡ ∃(Σ ∪ П) S. It is shown how the Modularization Theorem, the Factorization Lemma and the Normal Form Theorem for module expressions can be proved in TA. (shrink)

Confidentiality is both a fundamental principle of medical ethics and a legal obligation.In exceptional situations not covered by legal provisions, doctors may want to waive confidentiality against the wishes of the patient. Swiss law calls for an authority to rule on such cases. In the Canton of Geneva this authority is the Commission for Professional Confidentiality. This paper concerns 41 cases managed by this commission. The study shows that the majority of these requests to the Commission concern the reporting of (...) patients who are not incompetent but need the protection of a legal guardianship. In rare cases, there is another interest higher than confidentiality: public order or functioning of justice. The Commission found that the measure requested was justified in the majority of cases brought before it. This study focuses on exceptional cases but it throws into relief the conflict between the principle of autonomy on the one hand and the need for patient protection and social justice on the other. The dissertation considers what is at stake when theoretical wonder ceases to be an originating affect for speculative thought and becomes, instead, a limiting concept for critical philosophy. It attempts to show that: wonder functions for its classical proponents in an entirely different context than that presupposed by the aesthetics of the sublime . This difference can be ascribed to the way in which the feeling of the sublime is operative in the overcoming of modern theodicy , whereas wonder is (...) an intimation of what Edward O. Wilson has recently called, the "consilient perspective" . Whereas, wonder suggests the beginnings of an overarching conceptual unity linking together mind and nature, the sublime, by contrast, is part of an ontology of freedom, in which our subjective capacity to withstand the blows of natural contingency without resorting to conceptual redescription or aesthetic totalization reveals the workings of an underlying "faculty of resistance." The resultant ambivalence of the sublime feeling is elucidated differently by Kant and Schiller, such that the former regards it as the cognitive lucidity resulting from the self-cancellation of the passions, whereas the latter views it as a function of the will, insofar as it suggests a subjective capacity to attend to things differently. Finally, it is suggested that the true source of sublimity in Kant and Schiller is the force of personality to lend unity and meaning to phenomena which would otherwise lack such. (shrink)

Dans son article de 1915 sur l'inconscient, Freud pose la question suivante: « Nous disions qu'il y avait des représentations conscientes et des représentations inconscientes; mais y a-t-il aussi des motions pulsion-nelles, des sentiments, des sensations inconscients, ou bien, dans leur cas, de telles alliances de mots sont-elles dénuées de sens?».

Dans son article de 1913, «L’intérêt de la psychanalyse», Freud déclarait que la philosophie pouvait profiter des lumières de la psychanalyse parce que celle-ci peut dévoiler la motivation subjective et individuelle de doctrines philosophiques prétendument issues d’un travail logique et impartial, et ainsi désigner à la critique les points faibles du système d’un philosophe. Mon texte présente quelques exemples de l’utilisation de la psychanalyse pour identifier l’impact de l’inconscient sur la pensée de certains philosophes tels que Parménide, Berkeley, Kant, Sartre. (...) À la lumière de ces exemples, j’examine brièvement quelques questions à propos du conseil de Freud : Est-il praticable ? Quand peut-on l’appliquer ? Comment en rendre l’application moralement acceptable ? Selon quels critères juger de la valeur de vérité d’interprétations psychanalytiques de ce genre ? Quels sont les bénéfices, et en valent-ils la peine ?In his article of 1913, " The Claims of Psycho-Analysis to Scientific Interest", Freud stated that philosophy could profit from psychoanalysis because it can indicate the subjective and individual motives of philosophical theories which are ostensibly based on impartial logical work, and in this way it can draw critical attention to the weak spots in a philosopher’s system. This paper presents a few examples of the use of psychoanalysis to identify the impact of the unconscious on the theories of certain philosophers, e.g., Parmenides, Berkeley, Kant, Sartre. In the light of these examples, I examine briefly a number of questions concerning Freud’s recommendation : Can it be put into practice ? In what circumstances ? How can it be applied in a way that is morally defensible ? By what criteria can one evaluate the truth value of such psychoanalytic interpretations ? Shoah, Evil and Philosophy. To speak of the philosophy of the Shoah presupposes a philosophy of philosophy -that would stand in the pre- or post-position of a meaning and the subsumption of an object under a concept. But there is no concept of the Shoah because there is no intelligibility that could justify it. Of this «incomprehensible incontestable» as Victor Hugo said of God, literature can only approach the massive enigma. The «banality of Evil» prevents one from thinking that Evil (...) thinks, and with such a radicality that it demands of the existence itself, and a fortiori of that of the Shoah, irrefutable proofs. By blurring the hypothesis of a flawless equivalence of intelligibility and existence, the Shoah questions the question of meaning. RÉSUMÉ. Parler de philosophie de la Shoah présuppose une philosophie de la philosophie qui se tiendrait dans la pré- ou post-position d’un sens et la subsomption d’un objet sous un concept. La différance consigne ainsi l’impossibilité de la guérison dialectique et de l’accomplissement salutaire où s’annuleraient le différemment, l’attente, la non-venue. La radicalité propre à la pensée rosenzweigienne tient dans son élan doublement antipolitique et antiphilosophique. Elle est de l’ordre d’une « dissimilation » par rapport à la tradition de la métaphysique occidentale et de la philosophie politique qui lui est associée. Pour bien comprendre cette disposition, le texte s’efforce de montrer comment les « éléments » Dieu-Monde-Homme et leurs interrelations complexes, Création-Révélation-Rédemption, détiennent un caractère temporel. Ce texte analyse l’opération heideggérienne telle qu’elle se déploie en particulier dans les quatre volumes publiés des Cahiers noirs comme une introduction de la philosophie dans le nazisme. Pour en comprendre les contenus effectifs, l’auteur repère et décrit deux facteurs intensifs qui forment ensemble l’armature théorique de l’antisémitisme heideggérien et la condition de son énonciation comme relevant de la Seynsgeschichte : la traduction métapolitique d’une part, par où la fin de la métaphysique s’accomplit destinalement dans le peuple historial porteur de (...) l’estre, les Allemands ; le « même quant à l’essence » d’autre part qui discerne, à travers ce qui se présente dans la multiplicité ontique des étants intramondains, cela qui est le même et qui est assigné au peuple historique porteur du triomphe de l’étant sur l’être, les Juifs. Quelle est alors l’essence du judaïsme mondial? C’est « le principe de destruction dans l’espace-temps de l’Occident chrétien, c’est-à-dire de la métaphysique », retourné en son « essence » contre lui-même. L’autodestruction du judaïsme serait ainsi l’aboutissement du déploiement d’un principe métaphysique qui finit dans l’anéantissement des anéantisseurs. (shrink)

Si les expositions de peinture font l'objet d'une large fréquentation, Hegel est bien souvent décrié, surtout dans les milieux artistiques. Cette présentation de son Esthétique voudrait montrer, en privilégiant les analyses concrètes comme celle de la peinture hollandaise du XVIIe, toute la fécondité de cette approche philosophique. Loin du dogmatisme, Hegel conçoit l'art historiquement, jugeant les œuvres, mais récusant par avance toute norme académique. L'historicité de l'art est-elle solidaire de sa fin, de son dépassement? L’injustice est, chez Spinoza, transgression de la loi positive et la rébellion populaire toujours contraire à la loi : jamais la multitude ne peut être légitimée à se révolter. Pourtant elle est caractérisée comme specie juris, apparence ou fausse apparence de droit, contraire à l’interprétation vraie des lois. Gouvernants comme gouvernés sont donc capables d’injustice. Il faut donc expliquer ce à quoi sont tenus les uns comme les autres pour comprendre comment les normes juridiques sont produites.
