The science and technology of genetic testing is rapidly advancing with the consequences that genetic testing may well offer the prospect of being able to detect the onset of future disabilities. Some recent research also indicates that certain behavioural profiles may have a strong genetic basis, such as the determination to succeed and win or the propensity for risk-taking, which may be of interest to third parties. However, as this technology becomes more prevalent there is a danger that the genetic (...) information may be misused by entities such as employers, insurance companies, educational facilities, and finance companies and that people with particular genetic profiles may be discriminated against.This book explores the different types and the potential uses of genetic testing. The book highlights the ethical and legal dilemmas and the challenges arising as a result of emerging and rapidly advancing genetic science. Chapters in the book assess the importance and impact of the US Genetic Information Non-Discrimination Act (GINA) in the employment and health insurance contexts asking whether it is proving to be an effective tool in addressing the issue of genetic discrimination and alleviating individuals' fears of discrimination. The book then goes on to make the case for regulation at the European Union level in order to protect the privacy of genetic information and to prevent the discriminatory use of genetic information in Europe. It considers what can be learnt from the experience of the US in addressing ethical and legal issues as well as the impact that the UN Convention on the Rights of Persons with Disabilities is having on this debate within the EU. This book offers an interdisciplinary analysis of the social practice of taste in the wake of Pierre Bourdieu¿s sociology of taste. For the first time, this book unites sociologists and other social scientists with artists and curators, art theorists and art educators, and art, design and cultural historians who engage with the practice of taste as it relates to encounters with art, cultural institutions and the practices of everyday life, in national and transnational contexts. The volume is divided into four (...) sections. The first section on ¿Taste and art¿, shows how art practice was drawn into the sphere of ¿good taste¿, contrasting this with a post-conceptualist critique that offers a challenge to the social functions of good taste through an encounter with art. The next section on ¿Taste making and the museum¿ examines the challenges and changing social, political and organisational dynamics propelling museums beyond the terms of a supposedly universal institution and language of taste. PurposeThe ability to hear ourselves speak has been shown to play an important role in the development and maintenance of fluent and coherent speech. Despite this, little is known about the developing speech motor control system throughout childhood, in particular if and how vocal and articulatory control may differ throughout development. A scoping review was undertaken to identify and describe the full range of studies investigating responses to frequency altered auditory feedback in pediatric populations and their contributions to our understanding (...) of the development of auditory feedback control and sensorimotor learning in childhood and adolescence.MethodRelevant studies were identified through a comprehensive search strategy of six academic databases for studies that included real-time perturbation of frequency in auditory input, an analysis of immediate effects on speech, and participants aged 18 years or younger.ResultsTwenty-three articles met inclusion criteria. Across studies, there was a wide variety of designs, outcomes and measures used. Manipulations included fundamental frequency, formant frequency, frequency centroid of fricatives, and both fundamental and formant frequencies. Study designs included contrasts across childhood, between children and adults, and between typical, pediatric clinical and adult populations. Measures primarily explored acoustic properties of speech responses. Some studies additionally examined the association of these acoustic responses with clinical measures, and neural measures using electrophysiology and magnetic resonance imaging.ConclusionFindings indicated that children above 4 years generally compensated in the opposite direction of the manipulation, however, in several cases not as effectively as adults. Overall, results varied greatly due to the broad range of manipulations and designs used, making generalization challenging. Differences found between age groups in the features of the compensatory vocal responses, latency of responses, vocal variability and perceptual abilities, suggest that maturational changes may be occurring in the speech motor control system, affecting the extent to which auditory feedback is used to modify internal sensorimotor representations. Varied findings suggest vocal control develops prior to articulatory control. Future studies with multiple outcome measures, manipulations, and more expansive age ranges are needed to elucidate findings. (shrink)

The boundaries of honesty are the focal point of this exploration of the individualistic origins of modernist ethics and the consequent need for a more pragmatic approach to business ethics. The tendency of modernist ethics to see honesty as an individual responsibility is described as a contextually naive approach, one that fails to account for the interactive effects between individual choices and corporate norms. By reviewing the empirical accounts of managerial struggles with ethical dilemmas, the article arrives at the contextual (...) preconditions for encouraging the development of reflective moral agents in modern corporations. Uterus transplantation is an emerging technology adding to the arsenal of treatments for infertility; specifically the only available treatment for uterine factor infertility. Ethical investigations concerning risks to uteri donors and transplant recipients have been discussed in the literature. However, missing from the discourse is the potential of uterus transplantation in other groups of genetically XY women who experience uterine factor infertility. There have been philosophical inquiries concerning uterus transplantation in genetically XY women, which includes transgender women and women with (...) complete androgen insufficiency syndrome. We discuss the potential medical steps necessary and associated risks for uterus transplantation in genetically XY women. Presently, the medical technology does not exist to make uterus transplantation a safe and effective option for genetically XY women, however this group should not be summarily excluded from participation in trials. Laboratory research is needed to better understand and reduce medical risk and widen the field to all women who face uterine factor infertility. (shrink)

BackgroundThe ARRIVE (Animal Research: Reporting of In Vivo Experiments) guidelines are widely endorsed but compliance is limited. We sought to determine whether journal-requested completion of an ARRIVE checklist improves full compliance with the guidelines.MethodsIn a randomised controlled trial, manuscripts reporting in vivo animal research submitted to PLOS ONE (March–June 2015) were randomly allocated to either requested completion of an ARRIVE checklist or current standard practice. Authors, academic editors, and peer reviewers were blinded to group allocation. Trained reviewers performed outcome adjudication (...) in duplicate by assessing manuscripts against an operationalised version of the ARRIVE guidelines that consists 108 items. Our primary outcome was the between-group differences in the proportion of manuscripts meeting all ARRIVE guideline checklist subitems.ResultsWe randomised 1689 manuscripts (control: n = 844, intervention: n = 845), of which 1269 were sent for peer review and 762 (control: n = 340; intervention: n = 332) accepted for publication. No manuscript in either group achieved full compliance with the ARRIVE checklist. Details of animal husbandry (ARRIVE subitem 9b) was the only subitem to show improvements in reporting, with the proportion of compliant manuscripts rising from 52.1 to 74.1% (X2 = 34.0, df = 1, p = 2.1 × 10−7) in the control and intervention groups, respectively.ConclusionsThese results suggest that altering the editorial process to include requests for a completed ARRIVE checklist is not enough to improve compliance with the ARRIVE guidelines. Other approaches, such as more stringent editorial policies or a targeted approach on key quality items, may promote improvements in reporting. (shrink)

When examining the relevance of Bentham’s thinking to debates on cultural value, we should look, first of all, at the significance of utility as an independent ethical principle. Bentham finds the term ‘utility’ in the philosophy of David Hume, condemns Hume’s use of this term as ambiguous, and establishes utility as an independent ethical principle that is opposed to Hume’s preference for delicacy of sentiment and good taste. I argue that Hume is averse to the very thing that Bentham (...) places at the centre of his ethics, namely a reckoning that we can all make with how pleasure shapes our sense of self. Bentham places us under an obligation to work out what our pleasures mean for us, how they situate us in the world, and how others will respond to what gives us the most pleasure. This working hypothesis on what gives each of us the most pleasure, must be conveyed in neutral, non-judgemental terms. Bentham espouses simple amusements, including games of push-pin and solitaire, as examples of how a recalculation of the possibilities for increasing pleasure and diminishing pain can take place, in defiance of cultural evaluations of what is ‘high’ and ‘low’. These distinctions of high and low culture are only one example of how definitions of culture affect the social organization of pleasure, within a broader conception of cultural value. Bentham asks whether definitions of cultural value are equitable and just, when seen in relation to the ethical aim of prolonging pleasure and diminishing pain. (shrink)

All rights reserved.We present new observations of the low-mass companion to HD 984 taken with the Gemini Planet Imager as a part of the GPI Exoplanet Survey campaign. Images of HD 984 B were obtained in the J and H bands. Combined with archival epochs from 2012 and 2014, we fit the first orbit to the companion to find an 18 au orbit with a 68% confidence interval between 14 and 28 au, an eccentricity (...) of 0.18 with a 68% confidence interval between 0.05 and 0.47, and an inclination of 119°with a 68% confidence interval between 114°and 125°. To address the considerable spectral covariance in both spectra, we present a method of splitting the spectra into low and high frequencies to analyze the spectral structure at different spatial frequencies with the proper spectral noise correlation. Using the split spectra, we compare them to known spectral types using field brown dwarf and low-mass star spectra and find a best-fit match of a field gravity M6.5 ±1.5 spectral type with a corresponding temperature of K. Photometry of the companion yields a luminosity of log=2.88 ± 0.07 dex with DUSTY models. Mass estimates, again from DUSTY models, find an age-dependent mass of 34 ±1 to 95 ±4 M Jup. These results are consistent with previous measurements of the object. (shrink)

In The Decline and Fall of the Catholic Church in America, the sociologist David Carlin offers insightful explanations for why Catholicism began to unravel in the 1960s. Facing the aftershocks of Vatican II, the collapse of their cohesive urban neighborhoods, and the onslaught of the cultural revolution, American Catholics experienced a “perfect storm” from which they have yet to recover. Carlin sees little reason for optimism about the future. Among other things, he notes thebishops’ “appallingly poor” handling of the (...) sex abuse scandal and their tolerance of homosexuality in the seminaries. While agreeing with mostof Carlin’s analysis, this reviewer is more optimistic about the future prospects of the Church in America. (shrink)

While many ground religious tolerance on a sense of unity or enrichment resulting from religious diversity, the acclaimed scholars contributing to this volume place under scrutiny a fascinating alternative proposal for a pathway to religious tolerance: that the serious consideration of religious diversity tends to reveal the weakness of support many have for their religious commitments and that the humility produced tends to result in religious tolerance. The authors illuminate the debate within philosophyabout the way beliefs are supported, the controversy (...) between internalism and externalism, and disagreement about how humility and tolerance are related. In response to Quinn we identify cladistics to be about natural classifications and their discovery and thereby propose to add an eighth cladistic definition to Quinn’s list, namely the systematist who seeks to discover natural classifications, regardless of their affiliation, theoretical or methodological justifications.

Theoretical defenses of the principle of double effect (pde) due to Quinn, Nagel and Foot are claimed to face severe difficulties. But this leaves those of us who see something in the case-based support for the pde without a way of accounting for our judgments. This article proposes a novel principle it calls the mismatch principle, and argues that the mismatch principle does better than the pde at accounting for our judgments about cases and is also theoretically defensible. However, (...) where the pde makes claims about the permissibility of actions, the mismatch principle makes claims only about the evaluation of agents; and where the pde explains the cases in terms of intending harm, the mismatch principle explains them in terms of a quite different feature of the agent's will. Religious diversity exists whenever seemingly sincere, knowledgeable individuals hold incompatible beliefs on the same religious issue. Diversity of this sort is pervasive, existing not only across basic theistic systems but also within these theistic systems themselves. Religious Diversity explores the breadth and significance of such conflict. Examining the beliefs of various theistic systems, particularly within Christianity, Judaism, Hinduism and Buddhism, Basinger discusses seemingly incompatible claims about many religious issues, including the nature of God and the salvation of humankind. He considers (...) particularly the work of Hick, Gellman, Plantinga, Schellenberg, Alston, Wainwright, and Quinn, applying their perspectives on 'exclusivism' and 'pluralism' as they become relevant to the issues in question. Basinger's survey of the relevant literature, proposed solutions, and fresh insights offer an invaluable contribution not only for philosophers of religion and philosophical theologians but for anyone interested in the increasingly significant question of what a religious believer can or cannot justifiably say about their religious perspective. Moral puzzles about actions which bring about very small or what are said to be imperceptible harms or benefits for each of a large number of people are well known. Less well known is an argument by Warren Quinn that standard theories of rationality can lead an agent to end up torturing himself or herself in a completely foreseeable way, and that this shows that standard theories of rationality need to be revised. We show where Quinn's argument goes (...) wrong, and apply this to the moral puzzles. (shrink)

This paper comprises three sections. First, we offer a traditional defence of deontology, in the manner of, for example, W.D. Ross (1965). The leading idea of such a defence is that the right is independent of the good. Second, we modify the now standard account of the distinction, in terms of the agent-relative/agentneutral divide, between deontology and consequentialism. (This modification is necessary if indirect consequentialism is to count as a form of consequentialism.) Third, we challenge a value-based defence of deontology (...) proposed by Quinn (1993), Kamm (1989, 1992), and Nagel (1995). (shrink)

Doxing is the intentional public release onto the Internet of personal information about an individual by a third party, often with the intent to humiliate, threaten, intimidate, or punish the identified individual. In this paper I present a conceptual analysis of the practice of doxing and how it differs from other forms of privacy violation. I distinguish between three types of doxing: deanonymizing doxing, where personal information establishing the identity of a formerly anonymous individual is released; targeting doxing, that discloses (...) personal information that reveals specific details of an individual’s circumstances that are usually private, obscure, or obfuscated; and delegitimizing doxing, which reveals intimate personal information that damages the credibility of that individual. I also describe how doxing differs from blackmail and defamation. I argue that doxing may be justified in cases where it reveals wrongdoing, but only if the information released is necessary to reveal that such wrongdoing has occurred and if it is in the public interest to reveal such wrongdoing. Revealing additional information, such as that which allows an individual to be targeted for harassment and intimidation, is unjustified. I illustrate my discussion with the examples of the alleged identification of the creator of Bitcoin, Satoshi Nakamoto, by Newsweek magazine, the identification of the notorious Reddit user Violentacrez by the blog Gawker, and the harassment of game developer Zoe Quinn in the ‘GamerGate’ Internet campaign. A high level of confidence in the identity of individuals is required to let them die as ordered by an advance directive. Thus, if we are animalists, then we should lack the confidence required to apply lethal advance directives to the cheerfully demented, or so I argue. In short, there is consensus among animalists that the best way to avoid serious objections to their account is to adopt an ontology that denies the existence of brains, hands, tables, chairs, iced-tea, and (...) lemonade. The adoption of such an ontology reduces the justificatory force of commonsense, which is key in arguing that we are animals and that we persist as long as we are biologically alive. With this loss of justification comes the loss of a high level of confidence that Quinn-pre-dementia’s lethal advanced directive applies to Quinn-post-dementia, via identity. If we do not have a high level of confidence that Quinn-pre-dementia’s advanced directive applies to Quinn-post- dementia, then it is not enough (on its own) to let Quinn-post-dementia die. (shrink)

Warren Quinn and Philippa Foot have given versions of the Doctrine of Doing and Allowing justifying a moral distinction between doing something to bring about harm, and doing nothing to prevent harm. They argue that it is justified to allow one person to die so that one can save a larger number of people, but not to kill one person to achieve the same purpose. In this chapter, I show that the examples typically used to support the DDA do (...) not in fact do so. Contrary to the deontological ethics supported by the DDA, I argue that it can be justified to minimize harm by killing a smaller number of people, in preference to letting a greater number die. But unlike for the consequentialist, my position is that the distinction between killing and letting die does have moral significance. I shall examine what other non-consequentialist considerations, besides the appeal to positive and negative rights, could account for the distinction; and suggest a middle position between the deontological and consequentialist approaches to the ethics of killing. Warren Quinn suggests a presumption against usefully involving others in foreseeably harmful agency. Frances Kamm offers her Party Case, in which one throws a party only because one expects one’s guests will feel indebted to clean up, to argue that Quinn’s presumption should not apply to all agency undertaken because it will bring about this involvement but only to agency in which this involvement is intended. I offer impermissible and intentional variants of Party Case and consider other cases (...) to argue that the permissibility of usefully involving others depends on their independent rights, rather than whether their involvement is intended. University (...) of Notre Dame Notre Dame, Indiana PHILIP L. QUINN Di,alogue with the Other: The Inter-religious Dialogue. By DAVID TRACY. Louvain Theological and Pastoral Monographs, 1. Louvain : Peeters; Grand Rapids, Mich.: Eerdmans, 1990. Pp. 123. $12.95. With this book David Tracy continues the hermeneutical project he launched in the Analogical Imagination: a concern to converse with the classics and to encounter the ' other '. However, here the ' other ' is extended beyond the traditional Western classics to the religions of the world and the often neglected archaic traditions. Tracy is surely correct when he says: " I believe that we are fast approaching the day when it will not be possible to attempt Christian systematic theology except in serious conversation with the other great ways" (p. xi). Here he follows a pioneering line drawn in Chicago by Tillich, Eliade and Kitagawa. Tracy brings to this venerable tradition his particular concern with hermeneutics and his experience with Jewish-Christian and Buddhist-Christian dialogue. The essays are further united by Tracy's desire to restore the unity between the mystical and prophetic within the Christian tradition. Employing Kenneth Burke's analysis of rhetoric, Chapter one shows that Freud and Lacan can be interpreted in terms of a clash of prophetic and mystical rhetorics respectively. Both are concerned with the ' other ', Freud more instrumentally and didactically and Lacan more subversively and anarchically but not nihilistically or in the way of Zen. In this chapter Tracy has a tendency towards overdetermination. Still, the brunt of his argument is that all discourse has concealed foundations, the archaeology of which will help illuminate the opera· tive rhetoric. Furthermore, the mystical/prophetic typology used in religion can illuminate secular issues, viz., the debate between Freud and Lacan. However, Tracy does not pay full attention to the nature of the 'other', but too easily assimilates it. For instance, is Freud's attention to the subconscious analogous to religious rhetoric's regarding the otherness of God? And does it really serve Tracy's purpose to start BOOK REVIEWS 531 the book by remammg within such very western waters despite the brave navigational direction he charted in the introduction? Chapter two revisits the classics: he uses the writings of William James to throw light on the criteria for interreligious dialogue. These criteria are used to affirm the authenticity of religions; these are not intended to " replace the dialogue but, at best, heuristically to inform it" (p. 27). Tracy offers a good and sensitive appreciation of James (despite his anachronistic elements), but his conclusions are somewhat thinly related to James's work and relate more closely to Tracy's own hermeneutical approach. The three criteria that he advances are: first, the notion of " immediate luminousness," understood as manifestation in a Heideggerian sense (and in keeping with von Balthasar) ; second, the necessity of coherence, understood as the compatibility of religious belief with science, art, and other humanistic traditions; and third, an ethical-pragmatic criterion related to James's notion of "fruits." With regard to the second, Tracy is aware of the problem of assuming a neutral form of "reason" in adjudicating such coherence. Still, his study would have been more helpful with specific examples to highlight some of the intractable problems in such a task. For instance, autonomy has been granted to the sciences by most western Christians but has not been by some other religious traditions in certain parts of the world, and so the notion of coherence begs the question. Tracy needs to grapple with the issues raised by Macintyre and Winch (among others) to move beyond the potentially sterile dichotomy implied in his notion of coherence. With regard to the third criterion there is question begging, too. Would Abraham have passed this test in his willingness to kill his son? Or... (shrink)

David Boonin has recently advanced several challenges to the self-defense justification of punishment. Boonin argues that the self-defense justification of punishment justifies punishing the innocent, justifies disproportionate punishment, cannot account for mitigating excuses, and does not justify intentionally harming offenders as we do when we punish them. In this paper, I argue that the self-defense justification, suitably understood, can avoid all of these problems. To help demonstrate the self-defense theory’s attraction, I also develop some contrasts between the self-defense justification, (...) Warren Quinn’s better known ‘auto-retaliator’ argument, and desert-based justifications of punishment. In sum, I show that the self-defense justification of punishment is more resilient than commonly supposed and deserves to be taken seriously as a justification of punishment. (shrink)

This paper is a critical and exploratory discussion of Plantinga’s claim that certain propositions which self-evidently entail the existence of God could be properly basic. In the critical section, I argue that Plantinga fails to show that the modem foundationalist’s criterion for proper basicality, according to which such propositions could not be properly basic, is self-referentially incoherent or otherwise defective. In the exploratory section, I try to build a case for the view that, even if such propositions could be properly (...) basic, they would seldom, if ever, be properly basic for intellectually sophisticated adult theists in our culture. ABSTRACTThe goal of this paper is to locate indirect legislation within Bentham’s art of legislation, and to distinguish it, as far as possible, from direct legislation. Along the way, some parallels are drawn between indirect legislation on the one hand, and the Nudge theory of Thaler and Sunstein on the other. It will be argued that many expedients categorized by Bentham as indirect legislation are simultaneously exercises of direct legislation. Another set of indirect expedients act on knowledge, and involve efforts (...) to eliminate asymmetries of information between potential offender and potential victim by providing official standards and disseminating a plethora of factual information. Other forms of indirect legislation threaten the coherence of Bentham’s theory of law, firstly by regarding all government actions as exercises in legislation, and secondly by turning the formers of public opinion into legislators. Insofar as some forms of indirect legislation operate by sleight of hand, they conflict with Bentham’s commitment to transparency in the exercise of public power, reflecting a tension between reality and appearance which runs through his thought. David Webster explores the notion of desire as found in the Buddhist Pali Canon. Beginning by addressing the idea of a 'paradox of desire', whereby we must desire to end desire, the varieties of desire that are articulated in the Pali texts are examined. A range of views of desire, as found in Western thought are presented as well as Hindu and Jain approaches. An exploration of the concept of ditthi (view or opinion) is also provided, exploring the way (...) in which 'holding views' can be seen as analogous to the process of desiring. Other subjects investigated include the mind-body relationship, the range of Pali terms for desire, and desire's positive spiritual value. The problem of justifying legal punishment has been at the heart of legal and social philosophy from the very earliest recorded philosophical texts. However, despite several hundred years of debate, philosophers have not reached agreement about how legal punishment can be morally justified. ABSTRACTThis essay is a translation of one of Salomon Maimon’s ethical writings, accompanied by a brief introduction. In it, Maimon proposes a correction of the Kantian moral principle of duty, as it is articulated both by Kant’s Groundwork for a Metaphysics of Morals and his Critique of Practical Reason. In particular, Maimon’s essay reveals the influence of Reinhold’s critique of Kant’s moral philosophy, especially regarding the role of incentives behind moral action. It reveals as well Maimon’s commitment to the primacy (...) of the theoretical over the practical, drawn from his reading of Maimonides and Spinoza. The essay, therefore, marks an important moment in the development of Maimon’s assimilation of Kantian philosophy, one often neglected in scholarship on his work. (shrink)
