Around the world, many liberal democracies are facing in recent years serious challenges and threats emanating inter alia from the rise of political populism. Such challenges and threats are feeding an almost existential discourse about the crisis of democracy, and recent legal and political developments in Israel aimed at weakening the power of the Supreme Court and other rule of law institutions have also been described in such terms. This Article primarily intends to explore the relevance of the discourse surrounding (...) the decline of liberal democracy, and its possible relevance for Israeli democracy, by examining the principal similarities and differences between specific legislative and administrative measures recently taken or contemplated in Israel and in two Central European states: Poland and Hungary. We focus on three sets of illiberal measures adopted or contemplated in Hungary, Poland, and Israel: (i) measures directed at limiting the power of the judiciary; (ii) measures intended to restrict the operation of civil society organizations; and (iii) measures directed at curbing dissent to governmental policies and at influencing the discourse in the media and academia. Although Israeli democratic institutions still retain much of their independence and vitality, we nonetheless find some degree of similarity between measures taken or contemplated by Hungary, Poland, and Israel, despite the many differences between their legal systems, historical contexts, political cultures, and the distinct stages of backsliding they seem to experience. The conceptual history of Bildung, the German term for self-formation, encapsulates the ethical revolution of modern German thought, associated with the Kantian moment and its aftermath. Reshaped in modernity to respond to a post-Kantian, critical sensibility, the modern term emphasizes the reflexive, active process of self-formation, in contrast with the medieval theological sensibility which emphasized the receptive imprint of the image of God. In this article, I unpack Moses Mendelsohn’s idiosyncratic notion of Bildung. I show that what is unique, indeed, (...) singular in Mendelssohn’s notion of Bildung is the way it merges the traditional, theological notion with the modern one. For Mendelssohn, to imitate God is to come to value one’s contingent being. The imitation of the ideal, the most perfect, is tantamount to embracing the perfectible, and the process of perfection or self-actualization. Dreams are a remarkable experiment in psychology and neuroscience, conducted every night in every sleeping person. They show that the human brain, disconnected from the environment, can generate an entire world of conscious experiences by itself. Content analysis and developmental studies have promoted understanding of dream phenomenology. In parallel, brain lesion studies, functional imaging and neurophysiology have advanced current knowledge of the neural basis of dreaming. It is now possible to start integrating these two strands of research to address fundamental (...) questions that dreams pose for cognitive neuroscience: how conscious experiences in sleep relate to underlying brain activity; why the dreamer is largely disconnected from the environment; and whether dreaming is more closely related to mental imagery or to perception. Most solutions to the skeptical paradox about justified belief assume closure for justification, since the rejection of closure is widely regarded as a non-starter. I argue that the rejection of closure is not a non-starter, and that its problems are no greater than the problems associated with the more standard anti-skeptical strategies. I do this by sketching a simple version of the unpopular strategy and rebutting the three best objections to it. What intelligent person has never pondered the meaning of life? For Yuval Lurie, this is more than a puzzling philosophical question; it is a journey, and in this book he takes readers on a search that ranges from ancient quests for the purpose of life to the ruminations of postmodern thinkers on meaning. He shows that the question about the meaning of life expresses philosophical puzzlement regarding life in general as well as personal concern about one’s own life in (...) particular. Lurie traces the emergence of this question as a modern philosophical quandary, riddled with shifts and turns that have arisen over the years in response to it. _Tracking the Meaning of Life _is written as a critical philosophical investigation stretching over several traditions, such as analytic philosophy, phenomenology, and existentialism. It maps out a journey that explores pivotal responses to this question, drawing especially on the thought of Tolstoy, Wittgenstein, Sartre, and Camus and exploring in depth the insights these thinkers offer regarding their own difficulties concerning the meaning of life. Dolev's ambitious project is to show that the traditional debate in the philosophy of time between the so-called ‘tensed’ and ‘tenseless’ theorists is not a sustainable one. The key to the negative portion argument is that both the tensed and tenseless view of time can be understood only from within their respective ontological frameworks. Moreover, that there is only really an appearance of understanding within these frameworks, since neither framework furnishes us with the wherewithal to genuinely understand temporal language. Moving (...) past these frameworks is the goal Dolev sets us. The positive aspect of the text tries to teach us how to transcend this merely ontological dispute and engage in phenomenological considerations of time itself. The conclusion to the positive project is that we cannot postulate an adequate metaphysical system of time, though we can understand what time is if we treat it as the time of our experiences in everyday life.The prospect that we might be able to move past the existing debate into fresh philosophical terrain is exciting. This article explores various analytical issues involved in conceptualizing the interrelationships of gender, class, race and ethnicity and other social divisions. It compares the debate on these issues that took place in Britain in the 1980s and around the 2001 UN World Conference Against Racism. It examines issues such as the relative helpfulness of additive or mutually constitutive models of intersectional social divisions; the different analytical levels at which social divisions need to be studied, their ontological base and their relations (...) to each other. In this ‘age of information’, some worry that we get our news from online ‘echo chambers’, news feeds on our social media accounts that contain information from like‐minded sources. Filtering our information in this way seems prima facie problematic from an epistemic perspective. I vindicate this intuition by offering an explanation of what is wrong with online echo chambers that appeals to a particular kind of motivated reasoning, or bias due to one’s interests. This sort of bias affects, not which (...) evidence one is exposed to, but how one makes use of the evidence that one has, on the basis of one’s interests. I argue that consulting an online echo chamber often facilitates and amplifies this bias. I then draw some general conclusions about the potential downside of having ready access to so much information. (shrink)

To sell a new drug, pharmaceutical companies must discover a compound, run clinical trials to test its efficacy and safety, get it approved by regulatory bodies, produce the drug, and market it. As this process brings the drug through so many hands, there are risks of many kinds of corruption. The pharmaceutical industry has recently gone from being one of the most admired industries to being described by the majority of Americans as “dishonest, unethical, and more concerned with profits than (...) with individual and public health.” Legal scholar Marc Rodwin suggested that the pharmaceutical industry can be viewed through the lens of institutional corruption as defined by legal scholar Lawrence Lessig, whereby widespread or systemic practices undermine the main purposes of drug therapy — healing illness, preventing medical problems, and alleviating suffering. Many drugs do serve these goals, yet a significant number of drugs churned out by pharmaceutical companies are ineffective or have dangerous side effects that could have been predicted had the companies conducted the appropriate research. Spinoza is commonly perceived as the great metaphysician of coherence. The Euclidean manner in which he presented his philosophy in the _Ethics _has led readers to assume they are facing a strict and consistent philosophical system that necessarily follows from itself. As opposed to the prevailing understanding of Spinoza and his work, _The Role of Contradictions in Spinoza's Philosophy_ explores an array of profound and pervasive contradictions in Spinoza’s system and argues they are deliberate and constitutive of his philosophical thinking (...) and the notion of God at its heart. Relying on a meticulous and careful reading of the _Theological-Political Treatise_ and the _Ethics_, this book reconstructs Spinoza's philosophy of contradictions as a key to the ascending three degrees of knowledge leading to the _Amor intellectualis Dei_. The paper examines the effects of intersecting social divisions on constructions of multi‐layered citizenships and the politics of belonging in contemporary Britain. It starts with conceptual clarifications of the notions of citizenship, belonging and intersectionality and then turns to examine contemporary politics of belonging in contemporary Britain, focusing on the current debate on the ‘death of multiculturalism’ and on ‘social cohesion’. The hematopoietic system consists of more than ten differentiated cell types, all of which are derived from a single type of hematopoietic stem cell. The accessibility and interest of this system have made it a model for understanding normal and abnormal differentiation of mammalian cells. Newer techniques have generated a mass of data that requires integrative approaches for analysis and interpretation. The traditional view of the differentiation program holds that a small number of regulators are involved in each stage of (...) cell specification. However, this may not be the case. Recent analyses have shown that almost all substantial subsets of genes, including the set of broadly expressed transcription factors, are expressed in patterns that are unique for each lineage. Further, much of this difference between lineages can be captured in two‐dimensional graphs. Understanding the biologic significance, mechanisms and constraints underlying these differences is a challenge for experimentalists and computational biologists alike. Proportionality in Action presents an empirical and comparative exploration of the proportionality doctrine, based on detailed accounts of the application of the framework by apex courts in six jurisdictions: Germany, Canada, South Africa, Israel, Poland and India. The analysis of each country is written and contextualized by a constitutional scholar from the relevant jurisdiction. Each country analysis draws upon a large sample of case law and employs a mixed methodological approach: an expansive coding scheme allows for quantitative analysis providing comparable (...) and quantifiable measurements, which is enriched by qualitative analysis that engages with the substance of the decisions and captures nuance, contextualizing the data and providing it with meaning. The book concludes with a comparative chapter that synthesizes some of the most interesting findings. The article explores the Israeli Supreme Court main judgment regarding the legality of the use of special interrogation methods in order extract information concerning future acts of terror. The Judgment's main conclusion was that while there might be a justification for using exceptional interrogation measures in order to save lives, based on the concept of lesser evil as embedded in the criminal defense of necessity, the government is nevertheless not authorized to use such means in the absence of explicit legislation (...) to that effect. The article presents and evaluates the Judgment, particularly the relation between the substantive moral questions involved and the aspect of authorization. (shrink)

This article focuses on questions of pure fact-of-the-matter and asks whether two omniscient judges may disagree over the legal answer to a straightforward question of a matter of fact. There are approaches to legal theory among some western and Jewish philosophers of law whereby at least superficially it is possible that two or more contradictory legal statements regarding a given reality can be equally correct. The article provides a critical analysis of three different models derived from the Jewish legal literature, (...) and reviews the contributions of Jewish sources to the understanding of the phenomenon of disagreements concerning matters of fact. ABSTRACT Atheists and agnostics have a vexed relationship. Atheists often regard agnostics as timid, or perhaps as disguised apologists. Agnostics often regard atheists as dogmatic hypocrites: they proclaim something on insufficient evidence, while accusing theists of this. This dynamic is familiar from the academic and popular literature. Here, I consider a more radical conflict between the two, based on Kripkean semantics for empty terms applied to atheism. Sorensen : 373–388) christened the Kripke-inspired formulation of atheism ‘Unicorn Atheism’ and argued from (...) there to the incoherence of agnosticism. But, I argue, the objection fails and instead presents an opportunity to reformulate agnosticism. By appreciating the relevance of Kripkean semantics to the issue, a better understanding of the two positions, and their conflict, emerges. (shrink)

Online social networks have rapidly become a prominent and widely used service, offering a wealth of personal and sensitive information with significant security and privacy implications. Hence, OSNs are also an important—and popular—subject for research. To perform research based on real-life evidence, however, researchers may need to access OSN data, such as texts and files uploaded by users and connections among users. This raises significant ethical problems. Currently, there are no clear ethical guidelines, and researchers may end up performing ethically (...) questionable research, sometimes even when more ethical research alternatives exist. For example, several studies have employed “fake identities” to collect data from OSNs, but fake identities may be used for attacks and are considered a security issue. Is it legitimate to use fake identities for studying OSNs or for collecting OSN data for research? We present a taxonomy of the ethical challenges facing researchers of OSNs and compare different approaches. We demonstrate how ethical considerations have been taken into account in previous studies that used fake identities. In addition, several possible approaches are offered to reduce or avoid ethical misconducts. We hope this work will stimulate the development and use of ethical practices and methods in the research of online social networks. (shrink)

The article discusses some of the major issues which need to be examined in a gendered reading of citizenship. However, its basic claim is that a comparative study of citizenship should consider the issue of women's citizenship not only by contrast to that of men, but also in relation to women's affiliation to dominant or subordinate groups, their ethnicity, origin and urban or rural residence. It should also take into consideration global and transnational positionings of these citizenships. The article challenges (...) the gender-blind and Westocentric character of many of the most hegemonic theorizations of citizenship, focusing in particular on the questions of membership in ‘the community’, group rights and social difference and the ways binaries of public/private and active/passive have been constructed to differentiate between different kinds of citizenships. The article argues that in order to be able to analyse adequately people's citizenship, especially in this era of ethnicization on the one hand and globalization on the other hand, and with the rapid pace at which relationships between states and their civil societies are changing, citizenship should best be analysed as a multi-tiered construct which applies, at the same time to people's membership in sub-, cross- and supra-national collectivities as well as in states. For millennia, war was viewed as a supreme test. In the period 1750-1850 war became much more than a test: it became a secular revelation. This new understanding of war as revelation completely transformed Western war culture, revolutionizing politics, the personal experience of war, the status of common soldiers, and the tenets of military theory.

A well known skeptical paradox rests on the claim that we lack warrant to believe that we are not brains in a vat. The argument for that claim is the apparent impossibility of any evidence or argument that we are not BIVs. Many contemporary philosophers resist this argument by insisting that we have a sort of warrant for believing that we are not BIVs that does not require having any evidence or argument. I call this view ‘New Rationalism’. I argue (...) that New Rationalists are committed to there being some evidence or argument for believing that we are not BIVs anyway. Therefore, New Rationalism, since its appeal is that it purportedly avoids the problematic commitment to such evidence or argument, undermines its own appeal. We cannot avoid the difficult work of coming up with evidence or argument by positing some permissive sort of warrant. (shrink)

In this paper I claim that as bitter as the eternalist/presentist rivalry is, as far as both camps are concerned, a third position—which I defend—is more disturbing. The reason is that what eternalists and presentists agree on is more fundamental than what they disagree about. They agree that time carves, to use Orilia’s term, “ontological inventories.” This in a way answers the “fundamental question”—what is time? They disagree about the contents of the inventories, but that, I suggest, is a secondary (...) issue. Thus, an argument against what they agree about would be more detrimental to their joint project—analyzing tense in ontological terms—than the internal disagreement they are engaged in. I develop this thesis by responding to Orilia’s paper “Two Metaphysical Perspectives on the Duration of the Present”. I criticize the specialized use Orilia makes of the notion of an “ontological inventory” in the context of the metaphysics of time, but also Quine’s approach to ontology, on which Orilia’s account relies. The gist of my criticism is that it is question begging to rely on the notion of an “ontological inventory” for giving content to the presentism/eternalism debate, and for arguing that there can’t be an alternative. Currently, the dominant enforcement paradigm is based on the idea that states deal with 'bad people' - or those pursuing their own self-interests - with laws that exact a price for misbehavior through sanctions and punishment. At the same time, by contrast, behavioral ethics posits that 'good people' are guided by cognitive processes and biases that enable them to bend the laws within the confines of their conscience. In this illuminating book, Yuval Feldman analyzes these paradigms and provides a (...) broad theoretical and empirical comparison of traditional and non-traditional enforcement mechanisms to advance our understanding of how states can better deal with misdeeds committed by normative citizens blinded by cognitive biases regarding their own ethicality. We present a classical hydrodynamic analog of free relativistic quantum particles inspired by de Broglie’s pilot wave theory and recent developments in hydrodynamic quantum analogs. The proposed model couples a periodically forced Klein–Gordon equation with a nonrelativistic particle dynamics equation. The coupled equations may represent both quantum particles and classical particles driven by the gradients of locally excited Faraday waves. Exact stationary solutions of the coupled system reveal a highly nonlinear mechanism responsible for the self-propulsion of free particles, leading to (...) the onset of unsteady motion. Although the model is essentially nonrelativistic, a stabilizing mechanism for any particle traveling close to the wave signaling speed emerges through the coupling with the wavefield. Consequently, inline particle oscillations comparable to de Broglie’s wavelength are realized through this fully-classical model, suggesting a new classical interpretation for the motion of relativistic quantum particles. The roots of the ideal of authenticity in modern Western thought are numerous and complex. In this article, I explore their development in relation to Rousseau’s paradoxical conclusion that complete satisfaction is an aspiration that not only cannot be fulfilled but whose actual realization will make a person miserable. I argue that there is an unresolved tension between the notion of humans as creatures who by nature strive to eliminate suffering to achieve static serenity and the idea that their natural (...) goal in society is to constantly change and enrich themselves. The purpose of this article is not to construct another pessimistic interpretation according to which our most profound desire – happiness – cannot be achieved, but rather, by understanding natural inequality as a historical phenomenon, to shed light on Rousseau’s idea that happiness should be rejected because it contradicts the new foundation of morality: the realization of people’s uniqueness. According to Moderatism, a belief about specific material objects is perceptually justified iff, absent defeaters, one has the appropriate course of experience and it is assumed that there is an external world. I grant Moderatism and instead focus on Extended Rationality, according to which it is epistemically rational to believe evidentially warranted propositions and to accept those unwarrantable assumptions (...) that make the acquisition of perceptual warrants possible and are therefore constitutive of ordinary evidential warrants. I suggest that, even though Extended Rationality might be true, it cannot do the work that Coliva wants it to do. Although my objections do not show that it is false, they can serve to clarify what sorts of problem a theory of justification or rationality could possibly address. This provides an alternative to Coliva’s view of the skeptical problem and the question, on what does rationality hinge? (shrink)

PurposeThe purpose of the paper is to draw a new map confronting the issue of privacy in the new media age in general, and in the State of Israel in particular.Design/methodology/approachThe paper presents an in‐depth review based on professional literature covering the topics of privacy, new media, social networks, and Israel. The paper considers all citizens of Israel, the vast majority, however, of which are Jewish.FindingsThe study has found that even though Israeli social network users may be aware of online (...) privacy issues, their adoption of online sharing and exposure, while partly due to third person effect, is to a great extent a reflection of the Israeli collective ethos which emphasises the importance of community and emotional and material sharing.Originality/valueThe study proposes a new classification of privacy exposures and violations by analyzing the nature of privacy violations inherent in the new media. Is pure mathematics - arithmetic as well as geometry - reducible to formal logic? Russell answered in the affirmative, considering this so significant as to constitute a fatal blow to Kant's synthetic-apriori philosophy of mathematics. But either pure arithmetic and pure geometry include the full, extra-logical content of their unique axioms and hence their unique theorems, or they do not. If they do, then this reductionism is trivially unsound. It they do not - if they include only the logic of (...) demonstration and exclude everything else - then it is trivially true, but insignificant. The research reported here was the first empirical examination of strategic voting under the Sequential Voting by Veto (SVV) voting procedure, proposed by Mueller (1978). According to this procedure, a sequence of n voters must select s out of s+m alternatives (m=n=2; s>0). Hence, the number of alternatives exceeds the number of participants by one (n+1). When the ith voter casts her vote, she vetoes the alternative against which a veto has not yet been cast, and the s remaining non-vetoed (...) alternatives are elected. The SVV procedure invokes the minority principle, and it has advantages over all majoritarian procedures; this makes SVV a very desirable means for relatively small groups to make collective decisions. Felsenthal and Machover (1992) pointed out three models of voting under SVV: sincere, optimal, and canonical. The current research investigated, through laboratory experiments, which cognitive model better accounts for the voters' observed behavior and the likelihood of obtaining the optimal outcome as a function of the size of n (when s=1). The findings suggest that while voters under SVV use all three models, their choice is conditioned by group size. In the small groups (n=3), the canonical mode was a better predictor than the sincere model. In the larger groups (n=5), the sincere model was a better predictor than the canonical model. The aim of the article is to further assess and develop feminist standpoint theory by introducing the notion of the `situated imagination' as constituting an important part of this theory as well as that of `situated knowledge'. The article argues that the faculty of the imagination constructs as well as transforms, challenges and supersedes both existing knowledge and social reality.
