During the last 25 years, rape law has undergone a profound transformation, as the articles in this symposium clearly show. To mention just three of the more striking doctrinal reformations: All states have repealed the most egregious aspects of die marital rape exception; most have abandoned the “utmost resistance” requirement; and all have enacted rape shield laws to protect complaining witnesses from intrusive inquiries into their sexual history. All three reforms were the product of feminist agitation, all three were aimed (...) toward the general end of redirecting rape law toward the protection of women's, rather than men's, interests, and all three did, to some degree, broaden and democratize the scope of the law's protection: Wives, prostitutes, promiscuous girls, and women not inclined to risk their deaths by fighting off their rapists “to the utmost” are now protected by the law of rape against sexual assault, at least in theory, and at least to the same degree as non-wives and non-prostitutes, fighters, and virgins. All of this, virtually every contributor to this symposium agrees, is very much to the good. (shrink)

We explore men’s negotiation of emotional expression within larger social discourses around masculinity. Drawing on the phenomenon of men’s crying within the competitive sports context, we demonstrate that although the prevailing image of men’s emotion is one of constricted expression and experience, inexpressivity is representative neither of typical nor ideal masculinity in contemporary dominant culture. We first review the literature on prevailing cultural beliefs about normative male emotional expression, then focus on literature specific to men’s tears. Turning to a discussion (...) of masculinity and sports participation, we offer possible explanations for why counter normative emotional expressions may be particularly prevalent and public in the context of men’s competitive sports, despite wider cultural discourses that appear to discourage men’s openly expressive behavior. There has been consistent interest in telepathy within psychoanalysis from its start. Relational psychoanalysis, which is a relatively new development in psychoanalytic theory and practice, seems more receptive to experiences between patient and analyst that suggest ostensibly anomalous communicative capacities. To establish this openness to telepathic phenomena with relational approaches, a selection of papers recently published in leading academic journals in relational psychoanalysis is examined. This demonstrates the extent to which telepathy-like experiences are openly presented and seriously considered in the (...) relational community. The article then discusses those characteristics of the relational approach that may facilitate greater openness to telepathic experience. The argument is that relational psychoanalysis provides a coherent framework in which otherwise anomalous phenomena of patient–analyst interaction can be understood. (shrink)

Robin Celikates investigates the relevance of the self-understanding of ordinary agents and of their practices of critique for the theoretical and emancipatory project of critical theory.

One of the most striking innovations in Aristotle’s philosophical writing is also one of its most characteristic features. That feature is Aristotle’s idea that terms central to philosophy, including ‘cause’ [aition], ‘good’, and even the verb ‘to be’, are, as he likes to put it, “said in many ways.” To be sure, philosophers before Aristotle give some evidence of having recognized the phenomenon of being said in many ways. Plato, in particular, suggests that things in this world that we call (...) “just” are only namesakes of the Just Itself. But, beyond that, homonymy seems to have been, even for Plato, no more than a source of ambiguity for wordplay. Aristotle is apparently the first philosopher to propose a taxonomy of homonymy and to view the identification and analysis of homonymies as a genuinely philosophical project. (shrink)

This paper investigates whether gender affects ethically sensitive decisions of a personal or business nature. Data from 51 practicing accountants from both public accounting and private industry suggest that while differences exist between female and male accountants in responses to specific situations, overall responses are quite similar. Statistically significant differences were found for only five of the sixteen ethically sensitive situations. Further, when personal and business situations of a similar nature were paired together, two of the eight differences between personal (...) and business responses were significantly different between females and males. Taken as a whole, the results refute the suggestion that the ethical decision making of organizations may be enhanced as more women enter the business field. (shrink)

In his posthumously published lectures, Politics in Commercial Society, István Hont argues that Jean-Jacques Rousseau and Adam Smith should be understood as theorists of commercial society. This article challenges Hont’s interpretation of both thinkers and shows that some of his key claims depend on conflating the terms ‘commercial society’ and ‘commercial sociability’. I argue that, for Smith, commercial society should not be defined in terms of the moral psychology of commercial sociability, before questioning Hont’s Epicurean interpretation of Smith’s theory of (...) sociability. I then turn to Rousseau and outline some of the difficulties involved with classifying him as a theorist of commercial society, the most important of which is that he often appeared to be more deeply opposed to commercial progress than Hont suggests. I conclude by highlighting some of the most salient differences between Rousseau’s and Smith’s views of the politics of eighteenth-century Europe. (shrink)

We prove that everyn-modal logic betweenKnandS5nis undecidable, whenever n ≥ 3. We also show that each of these logics is non-finitely axiomatizable, lacks the product finite model property, and there is no algorithm deciding whether a finite frame validates the logic. These results answer several questions of Gabbay and Shehtman. The proofs combine the modal logic technique of Yankov–Fine frame formulas with algebraic logic results of Halmos, Johnson and Monk, and give a reduction of the representation problem of finite relation (...) algebras. The Laboratory for Research on the Structure of Matter, University of Pennsylvania, was built in 1965 as part of the Advanced Research Projects Agency's Interdisciplinary Laboratories program intended to foster interdisciplinary research and training in materials science. The process that led to the construction of the four-story structure served as the focus of intense debates over the meaning and process of interdisciplinary research in universities. The location of the building, its size, internal design, and functionalities were all subject to heated (...) negotiations among patrons, scientists, and university administrators, to find the proper place of interdisciplinary materials science on the University of Pennsylvania's campus. Building on the recent work on laboratory architecture, this paper argues that the negotiations and controversies over the LRSM building were concrete representations of the broader struggle over the appropriate place of interdisciplinary research and training within a university. The effectiveness of decision rules depends on characteristics of both rules and environments. A theoretical analysis of environments specifies the relative predictive accuracies of the “take-the-best” heuristic (TTB) and other simple strategies for choices between two outcomes based on binary cues. We identify three factors: how cues are weighted; characteristics of choice sets; and error. In the absence of error and for cases involving from three to five binary cues, TTB is effective across many environments. However, hybrids of equal weights (...) (EW) and TTB models are more effective as environments become more compensatory. As error in the environment increases, the predictive ability of all models is systematically degraded. Indeed, using the datasets of Gigerenzer et al. (1999, Simple Heuristics That Make Us Smart, New York: Oxford University Press), TTB and similar models do not predict much better than a naïve model that exploits dominance. Finally, we emphasize that the results reported here are conditional on binary cues. (shrink)

Equality of Opportunity is widely thought of as the normative ideal most relevant to the design of educational institutions. One widely discussed interpretation of this ideal is Rawls' principle of Fair Equality of Opportunity. In this paper I argue that theories, like Rawls, that give priority to the achievement of individual autonomy, are committed to giving that same priority to a principle of sufficient opportunity. Thus, the Rawlsian's primary focus when designing educational institutions should be on sufficiency and not equality. (...) The paper then argues this commitment has at least three attractive implications. Firstly, it enables defenders of Fair Equality of Opportunity to overcome Richard Arneson's powerful objections. Secondly, it suggests a revised version of the principle of Fair Equality of Opportunity that is more plausible. Thirdly, it has attractive practical implications for educational provision. (shrink)

Snap‐shots of live theatre: the use of photography to research governance in operating room nursingThe use of photography is an underreported method of research in the nursing literature. This paper explores its use in an ethnographic research project, the fieldwork of which was undertaken by the first author. The aim was to examine the governance of operating room nursing in the clinical setting and the theoretical orientation was the work of Michel Foucault. The focus of this paper is on how (...) photography was used as a means of data generation. To establish some context we begin by drawing on writers from sociology and anthropology to provide an overview of the status of vision and visual research methods in contemporary social research. We then move to a brief discussion of the uses of photography in social research and the limitations imposed by ethical considerations of its use in clinical nursing settings. As well, the process and approach involved in this research project, and issues of analysis are discussed. Three ‘snap‐shots’ of operating room nursing, taken by participants, are presented. Each is analysed in terms of its contributions to the research process as well as its substantive contribution to the theoretical framework and the research aims. (shrink)

At the beginning of the Posterior Analytics, Aristotle says that “all learning and all rational teaching arises from previously existing knowledge”. How, then, can we have any knowledge? If all our knowledge is acquired by learning that depends on previously existing knowledge, then we would have an infinite regress of still prior knowledge, with the result that we cannot learn anything without having learned something else first. If we reject this possibility, then the only one that remains is that we (...) have some knowledge that we did not learn. This might happen in two ways: either we have some knowledge that we never acquired at all, or we have some knowledge that we acquired but without learning it. We would have knowledge that we never acquired if there was never a time at which we did not have it (which would entail, of course, that we were born with it). Plato held that we do have such knowledge, and indeed that all the genuine knowledge that we have is innate in this way. Aristotle, however, denies that we have innate knowledge (for instance at An. Post. II.19, 100a10). Since he nevertheless does think that we have knowledge, he must think that we have some knowledge which we did not acquire by learning. In fact, he does present such a view in Posterior Analytics II.19, where he claims that our knowledge of the principles ( ¢¡¤£¦¥¨§ ) of sciences comes to us through perception and induction and that the state of knowledge of them is “intelligence” or “thought” ( © ). Aristotle says explicitly that in this process the mind is passive; therefore, it is reasonable for us to regard it as not being a kind of learning (or at any rate as a kind of rational learning). While many of Bernard Mandeville's contemporary critics read him as trying to ridicule and subvert all ideas of morality and virtue, others criticized him for insisting on too demanding a conception of virtue as self-denial. In this article, I take the latter line of criticism as my point of departure and evaluate whether Mandeville's ‘origins of virtue’ thesis can be reconciled with his claims about virtue requiring self-denial. To do so, I trace the changes to Mandeville's account of virtue between (...) the different editions of The Fable of the Bees and An Enquiry Into the Origin of Honour, placing particular emphasis on the conceptual distinctions introduced in the 1723 edition of the Fable. I show that there are important tensions in Mandeville's argument and I evaluate potential ways in which they might be resolved. The most important inconsistency, I argue, is that it is unclear whether Mandeville's speculative historical explanation of the origins of virtue can support the strongest claims he makes about virtue requiring a complete conquest of the passions, even if it can support weaker conceptualizations of virtue as self-denial. Can room be found in between the matter and void of a Newtonian universe for an immaterial and immortal soul? Can followers of Locke with his agnosticism about the nature of substances claim to know that some of them are immaterial? Samuel Clarke, well versed in Locke's thought and a defender both of Newtonian science and Christian orthodoxy, believed he could do both and attempted to prove his case by means of some hard-boiled reductionism. Anthony Collins, a deist whose only (...) lapse from materialism concerned God himself, rejected Clarke's argument. In this paper I discuss their controversy' in order to bring out the state of debate about material systems and consciousness among people influenced by Locke and Newton in the early eighteenth century, and I also assess Clarke's reductionist premise, as he himself frequently invites "the impartial reader" to do. There is surprisingly little attention in Information Technology ethics to respect for persons, either as an ethical issue or as a core value of IT ethics or as a conceptual tool for discussing ethical issues of IT. In this, IT ethics is very different from another field of applied ethics, bioethics, where respect is a core value and conceptual tool. This paper argues that there is value in thinking about ethical issues related to information technologies, especially, though not exclusively, issues (...) concerning identity and identity management, explicitly in terms of respect for persons understood as a core value of IT ethics. After explicating respect for persons, the paper identifies a number of ways in which putting the concept of respect for persons explicitly at the center of both IT practice and IT ethics could be valuable, then examines some of the implicit and problematic assumptions about persons, their identities, and respect that are built into the design, implementation, and use of information technologies and are taken for granted in discussions in IT ethics. The discussion concludes by asking how better conceptions of respect for persons might be better employed in IT contexts or brought better to bear on specific issues concerning identity in IT contexts. Calorie restriction results in an increased lifespan and reduced fecundity of rodents. In a natural environment the availability of food will vary greatly. It is suggested that Darwinian fitness will be increased if animals cease breeding during periods of food deprivation and invest saved resources in maintenance of the adult body, or soma. This would increase the probability of producing viable offspring during an extended lifespan. The diversion of limited energy resources from breeding to maintenance of the soma is seen (...) as an evolutionary adaptation, fully compatible with the ‘disposable soma’ theory of the evolution of ageing. For Kant and for feminists, self-respect is a morally central and morally powerful concern. In this paper I focus on some questions about the relation of self-respect to two other stances toward the self, humility and arrogance. Just as arrogance is usually treated as a serious vice, so humility is widely regarded as an important virtue. Indeed, it is supposed to be the virtue that opposes arrogance, keeping it in check or preventing it from developing in the first place. I’ve (...) argued elsewhere that, on Kant’s account, arrogance is a vice of disrespect for other people and for oneself. Humility is not, however, unproblematic from a Kantian perspective, and he is more concerned to identify bad forms of it than to praise it as a virtue or recommend it as a cure for arrogance. Feminist ethics draws our attention to the ways in which character traits, attitudes, beliefs, and stances take on differential moral valences in contexts of oppression, and what might be a virtue for members of dominant groups can be vices for members of subordinate groups. How, then, are we to understand and assess humility? The upshot of Kantian and feminist analyses is two-fold: First, humility is not the virtue opposing arrogance; rather, self-respect is. Second, humility is at best an ancillary, instrumental, contextual virtue and the servant of self-respect; but at worst, it is as serious a vice as arrogance, indeed, an aspect of it. (shrink)

The first half of this paper replies to three postmodernist challenges to belief in objective intrinsic value. One lies in the claim that the language of objective value presupposes a flawed, dualistic distinction between subjects and objects. The second lies in the claim that there are no objective values which do not arise within and/or depend upon particular cultures or valuational frameworks. The third comprises the suggestion that belief in objective values embodies the representational theory of perception. In the second (...) half, a defence is offered of belief in objective intrinsic value. Objectivists hold that axiological properties supply interpersonal reasons for action for any relevant moral agent. The intrinsically valuable is understood as what there is reason to desire, cherish or foster in virtue of the nature of the state or object concerned. The concept of intrinsic value is shown to be instantiated, and defended against a range of criticisms. (shrink)

Aquinas holds that by its nature the human will has happiness as its ultimate end in every choice, and yet he holds that one can and ought to love God more than oneself or one’s own happiness. This generates the so-called “problem of love”: how can an eudaimonist like Aquinas account for non-selfish love? I argue that Aquinas’s doctrine of goodness as the will’s object and his distinction between the love of desire and the love of friendship solve this problem (...) and indicate that Aquinas’s eudaimonism is only “subordinated eudaimonism.” By its nature the will has happiness—total inhering goodness—as its ultimate object secundum quid, and God—total subsisting goodness—as ultimate object simpliciter. Nevertheless, Aquinas argues on philosophical grounds and with the support of Aristotle’s Liber de Bona Fortuna that God Himself would have to move the will if one were to love God above oneself even in the order of nature. SummaryR. G. Collingwood presented his major work of political philosophy, The New Leviathan, as an updated version of Thomas Hobbes's Leviathan. However, his reasons for taking Hobbes's great work as his inspiration have puzzled and eluded many Collingwood scholars, while those interested in the reception of Hobbes's ideas have largely neglected the New Leviathan. In this essay I reveal what Collingwood saw in Hobbes's political philosophy and show how his reading of Hobbes both diverges from other prominent interpretations of the (...) time and invites us to reassess Hobbes's complex association with the origins of liberalism. In doing so, I focus on Collingwood's science of mind, his ideas on society and authority, and his dialectical theory of politics, in each case showing how he engaged with Hobbes in order to elucidate his own vision of civilisation. That vision is based on the development of social consciousness, which involves people coming to understand the body politic as a joint enterprise whereby they confer authority upon those who rule.
