The Anthology of the Works of Ugo Spirito captures the trajectory of Ugo Spirito's complex body of thought that spanned more than fifty years, from 1921 to 1977.

The Cyrenaic school of philosophy (named after its founder Aristippus’ native city of Cyrene in North Africa) flourished in the fifth and fourth centuries BCE. Ugo Zilioli’s book provides the first book-length introduction to the school in English. The book begins by introducing the main figures of the Cyrenaic school beginning with Aristippus and by setting them into their historical context. Once the reader is familiar with those figures and with the genealogy of the school, the book offers an overview (...) of ancient and modern interpretations of the Cyrenaics, to provide readers with alternative accounts of the doctrines they endorsed and of the role they played in the context of ancient thought. Finally, the book offers a reconstruction of Cyrenaic philosophy and shows how the ethical side of their speculation connected with the epistemology and ontology they endorsed and that, as a result, the Cyrenaics were able to offer a quite sophisticated philosophy. Indeed, Zilioli demonstrates that they represented, in ancient philosophy, an important and original metaphysical position and alternative to the kind of realism endorsed by Plato and Aristotle. Protagoras was an important Greek thinker of the fifth century BC, the most famous of the so called Sophists, though most of what we know of him and his thought comes to us mainly through the dialogues of his strenuous opponent Plato. In this book, Ugo Zilioli offers a sustained and philosophically sophisticated examination of what is, in philosophical terms, the most interesting feature of Protagoras' thought for modern readers: his role as the first Western thinker to argue for relativism. Zilioli relates Protagoras' relativism with modern forms of relativism, in particular the 'robust relativism' of Joseph Margolis, gives an integrated account both of the perceptual relativism examined in Plato's Theaetetus and the ethical or social relativism presented in the first part of Plato's Protagoras and offers an integrated and positive analysis of Protagoras' thought, rather than focusing on ancient criticisms and responses to his thought. Researchers studying health systems in low-income countries face a myriad of ethical challenges throughout the entire research process. In this article, we discuss one of the greatest ethical challenges that we encountered during our fieldwork in West Africa: the difficulty of protecting the confidentiality of participants while locally disseminating results of health systems research to stakeholders. This reflection is based on experiences of authors involved in conducting evaluative research of interventions aimed at improving health systems in West Africa. Our observation (...) and collaboration with the research projects’ stakeholders informed our analysis. Examples from two research projects illustrate the issues raised. We found that in some cases there is a risk that local stakeholders may be able to identify research participants, or at least groups of participants, during the dissemination of results, even if they are anonymized. Four factors can interact and influence this challenge: 1) hierarchical structure, 2) small milieu, 3) immersion in a few sites, and 4) vested interests of decision-makers. For example, local stakeholders can sometimes find out when and where the data were collected. Moreover, health systems, especially rural healthcare centres, in West African countries can be small settings, so people often know each other. Some types of participants have unique characteristics or positions in the health system that may make them more easily identifiable by local stakeholders familiar with the environment. We identified a number of potential strategies that can help researchers minimize this difficulty and improve ethical research practices. These strategies pertain to the development of the study design, the process of obtaining informed consent, the dissemination of results, and the researchers’ reflexivity. Researchers must develop and adopt strategies that enable them to respect their promise of confidentiality while effectively disseminating sometimes sensitive results. Reflections surrounding ethical issues in global health research should be deepened to better address how to manage competing ethical responsibilities while promoting valuable research uptake. In order to present a hopefully comprehensive framework of what is the stake of the growing use of robot soldiers, the paper focuses on: the different impact of robots on legal systems, e.g., contractual obligations and tort liability; how robots affect crucial notions as causality, predictability and human culpability in criminal law and, finally, specific hypotheses of robots employed in “just wars.” By using the traditional distinction between causes that make wars just and conduct admissible on the battlefield, the aim (...) is to clarify how advancement of military robotics technology is transforming a 2,000-year-old legal debate on the concept of “just war.” For the first time, legal systems will hold political authorities and military commissioners responsible for what an artificial soldier autonomously decides to do. Advances in artificial intelligence, as well as its increased presence in everyday life, have brought the emergence of many new phenomena, including an intriguing appearance of what seems to be a variant of body dysmorphic disorder, coined “Snapchat dysmorphia”. Body dysmorphic disorder is a DSM-5 psychiatric disorder defined as a preoccupation with one or more perceived defects or flaws in physical appearance that are not observable or appear slight to others. Snapchat dysmorphia is fueled by automated selfie filters that reflect (...) unrealistic sociocultural standard. In this paper, we discuss how body dysmorphic disorder and related body image distortions could arise, using the conceptual resources provided by the active inference framework. We suggest that these disorders involve dysfunctional self-modelling which entails maladaptive internalization of sociocultural preferences during adolescent identity formation. Identity formation is hereby described as cycles of interpersonal active inference that arbitrate between identity exploration and commitment. We propose that impaired self-modelling is unable to reduce interpersonal uncertainty during identity exploration, which, over time, degenerates into uncontrollable epistemic habits that isolate the body image from corrective sensory evidence. In light of these insights, we subsequently explore some of the consequences of image-centered social media platforms on the identity formation process. We conclude that heightened interpersonal uncertainty in this novel context could precipitate the onset of body dysmorphic disorder and related body image distortions, particularly when selfie filters are involved. Many liberals cannot help distrusting deliberative democracy theory. In their view, the theory offers no sufficient guarantee that the outcomes of democratic deliberation will be respectful of individual interests generating what they conceive as basic moral rights. The purpose of this text is to provide one argument showing that liberal rights are sufficiently protected within deliberative democracy theory. The argument does not rest on the idea of moral rights or material justice. It rests on the conditions of legitimate law deliberative (...) democracy theory presupposes, namely, the conditions that make concrete the idea of legitimacy as “actual public justification.”. A comparative investigation in the metaphysics of material objects and persons in ancient philosophy, this book provides radically new insights into key themes and areas of ancient thought by drawing on Greek and Buddhist philosophies. The paper examines today’s debate on the new responsibilities of Internet service providers in connection with legal problems concerning jurisdiction, data processing, people’s privacy and education. The focus is foremost on the default rules and safe harbour clauses for ISPs liability, set up by the US and European legal systems. This framework is deepened in light of the different functions of the services provided on the Internet so as to highlight multiple levels of control over information and, correspondingly, different types (...) of liability. Dans cet article, nous nous intéresserons aux différents mécanismes grâce auxquels une délibération publique à la fois ouverte, libre et inclusive, peut parvenir à de bonnes décisions, avant d’envisager ce que la délibération peut apporter en cas de désaccord. Nous nous concentrerons plus particulièrement ici sur la fonction constructive (...) de la démocratie, c’est-à-dire sur cette capacité qu’a la démocratie délibérative d’identifier et de formuler, de manière épistémiquement instructive, les problèmes de justice auxquels doit faire face le corps politique. Il faudra donc d’abord expliquer comment la démocratie permet de colliger l’information et de la mettre à disposition de chacun, afin d’expliquer ensuite comment la délibération peut permettre l’émergence d’accords entre les individus. The aims of this paper are to discuss the mechanisms which allow an open, free and inclusive forum of deliberation to achieve correct decisions and to discuss the impact of deliberation on disagreement. I concentrate on the constructive function of democracy which designates the capacity of deliberative democracy to identify and frame the problems of justice faced by a polity in epistemically positive ways. I first explain how democracy can pool information. This is then used to explain how deliberation can enable agreement to emerge. This is followed by a discussion of the limits of deliberation and how it is unable to resolve some disagreements. The final element of my discussion is an explanation of the role of deliberation in framing political disagreements. I argue that deliberation helps in avoiding unsustainable political disagreements which could bring about political decay. (shrink)

This book explores how the design, construction, and use of robotics technology may affect today's legal systems and, more particularly, matters of responsibility and agency in criminal law, contractual obligations, and torts. By distinguishing between the behaviour of robots as tools of human interaction, and robots as proper agents in the legal arena, jurists will have to address a new generation of "hard cases." General disagreement may concern immunity in criminal law (e.g., the employment of robot soldiers in battle), personal (...) accountability for certain robots in contracts (e.g., robo-traders), much as clauses of strict liability and negligence-based responsibility in extra-contractual obligations (e.g., service robots in tort law). This essay takes, as its starting point, Andreas Malm’s effort, in How to Blow Up a Pipeline: Learning to Fight in a World on Fire, to legitimize and normalize property destruction in the context of the climate movement. The sabotage of energy infrastructures, I counter, cannot make sense, for it poses a threat to coherence, removing without replacing the material and discursive conditions that grant the climate movement its meaning and purpose within late capitalism and late liberalism. Recent protests entailing (...) the defacement of paintings share with ecocriticism an investment in an essentially liberal, pedagogical and moral covenant, one that urges witnesses to undergo an individual process of reflection in order to acquire or affirm values and priorities friendlier to the environment. Sabotage, by contrast, violates this covenant; blowing up a pipeline may be said to have met its goals by reducing and slowing the supply of oil, regardless of what the public learned from sabotage’s mediatization. Drawing on psychoanalytic accounts of aesthetic education, I argue that sabotage introduces absurdity into a category—action—that the climate movement otherwise insists is self-identical. Sabotage does this by subtracting the world wherein putatively future-bound actions, including having and raising a child, mean what they do. I test out this claim in a reading of Nell Zink’s novel The Wallcreeper and Benedikt Erlingsson’s film Woman at War (Kona fer í stríð), two absurdist comedies that formally amplify the semiotic crisis induced by sabotage and, in so doing, enable us to confront the necessary dislocation of politics from sense. This paper assesses James M. Buchanan's claim of following a positive approach in stark contrast to the normative approach to public finance of Richard A. Musgrave. The goal of this paper is to shed light on the foundations of modern American public finance by analysing one aspect of the methodology of its two most prominent fathers. I show (1) that it is difficult to distinguish Musgrave's and Buchanan's theories of public goods along the positive/normative dividing line and (2) that Buchanan's (...) theory can also be considered normative. In the first three parts, I follow the Weberian methodological tradition in looking for value judgements in the theories, and by reflecting on the nature of ideal types. In the last part, I propose a broader interpretation of Buchanan's methodological stance within the academic context of the 1960s. (shrink)

In the organelles of plants and mammals, recent evidence suggests that genomic instability stems in large part from template switching events taking place during DNA replication. Although more than one mechanism may be responsible for this, some similarities exist between the different proposed models. These can be separated into two main categories, depending on whether they involve a single‐strand‐switching or a reciprocal‐strand‐switching event. Single‐strand‐switching events lead to intermediates containing Y junctions, whereas reciprocal‐strand‐switching creates Holliday junctions. Common features in all the (...) described models include replication stress, fork stalling and the presence of inverted repeats, but no single element appears to be required in all cases. We review the field, and examine the ideas that several mechanisms may take place in any given genome, and that the presence of palindromes or inverted repeats in certain regions may favor specific rearrangements. The contribution describes the legal phenomenon as a playing field characterized by a progressive regression of the law, understood as a sovereign will from top to bottom, both in the vision of formalist legal positivisms in continental Europe and in realist terms, in the United States. Soft law represents the main strategy to subordinate the law to the interests of the economy, elasticizing environmental law, making it favorable to the market, reducing ecology to the simplistic metric of CO2 emissions. The (...) consequence is a retreat of the statist vertical normativity of law which is not replaced by a de facto power granted to those who control the technology, built by design to close spaces for pluralism and democratic action, in the interest of surveillance and concentrated power in private and government oligopolies. The author concludes by advocating the urgency for genuinely innovative categories, particularly in the legal education, such as the commons, capable of including sustainability into a “new ecological jurisprudence committed to inclusion and solidarity rather than exclusion and struggle”. The use of cyber force can be as severe and disruptive as traditional armed attacks are. Cyber attacks may neither provoke physical injuries nor cause property damages and still, they can affect essential functions of today’s societies, such as governmental services, business processes or communication systems that progressively depend on information as a vital resource. Whereas several scholars claim that an international treaty, much as new forms of international cooperation, are necessary, a further challenge should be stressed: authors of cyber (...) attacks can be non-state actors, and identifying the party responsible for such a use of force, whether non-state actors or national sovereign states, is often impossible. Accordingly, several programmes on online security and national defence have been developed by sovereign states to tackle this menace and yet, the endurance of Western democracies and their aim to protect basic rights have already been tested by such programmes over the past years. The new scenarios of cyber force do not only concern the field of international law, since they may represent the main threat in the fields of national and constitutional law as well. (shrink)

En 1937, le philosophe russe Simon Frank (1877-1950) publia la Connaissance et l’être, une traduction française abrégée de Predmet znanija, auprès de la maison d’édition parisienne Fernand Aubier. Grâce à cette traduction, il attira l’attention de philosophes francophones, parmi lesquels se trouvait le suisse Pierre Thévenaz (1913-1955), qui donna une présentation s’intitulant « Connaissance et être d’après Simon Frank » à une rencontre de la Société romande de philosophie à Lausanne le 7 décembre 1940. Ce qui suit est une transcription (...) du texte manuscrit de cette présentation. Dans ce texte, Thévenaz s’appuie principalement sur la Connaissance et l’être afin d’exposer la pensée de Frank. Cependant, son objectif n’est pas seulement de résumer la pensée de ce dernier, mais aussi d’en dégager quelques problèmes philosophiques. The Jewish Law (Halakahh) is probably the older legal system working in our time. It is established on a hierarchy of different texts. The oldest and more authoritative is the Torah (the five books of Moshe), then come the Mishnah, the Talmud, the compilation as Maimonide’s Mishne Torah and Caro’s Shulchan Arukh, then the responsa of the rabbis. While the authorship of the later texts is more or less clear, the one of the Torah is highly problematic, also in the (...) self-understanding of Jewish hermeneutics. This question is discussed in the present paper not from a philological-historical point of view, but from a semiotic one, trying to understand what devices and regimes of enunciation are enacted by the text in order to establish its semiotic-juridical effects. A special double enunciation frame is proposed as the mark of the legislative power in the text, in correlation with another textual device, a sort of divine “signature”. The further evolution of the authorship of the Jewish Law is discussed in its relation with the question of the autonomy in the interpretation of the sacred text. (shrink)

The not exact correspondence between its contents reported by Pausanias and some details of the narrative in Thucydides enables us to reconstruct with a greater precision the movements of Phormio after the two battles. On the other hand, the quite unnoticed exact correspondence between (...) the Spartan allies listed in the inscription as reported by Pausanias and the catalogue of Spartan naval allies in Thuc. 2, 9, 3, as well as the absence from these lists of Anactorion, although her ships had joined the Peloponnesian fleet at least in the earliest phases of that campaign, give grounds for the suggestion that Thucydides’ catalogue mirrors the make-up of the Peloponnesian fleet that actually fought in 429 and that just the inscription seen by Pausanias may have been (one of) his source(s). Different disciplines have analyzed binary choices to model collective behavior in human systems. Several situations in which social dilemma arise can be modeled as N-person prisoner’s dilemma games including homeland security, public goods, international political economy among others. The purpose of this study is to develop an analytical solution to the N-person prisoner’s dilemma game when boundedly rational agents interact in a population. Previous studies in the literature consider the case in which cooperators and defectors have the same learning factors. (...) We obtain an analytical equation to find equilibria in the N-person prisoner’s dilemma game in the general case when agents have different learning factors. We also introduce a more realistic approach where probability values are bounded between zero and one and therefore eliminates the possibility of infeasible probability values. Since no analytic solution can be derived in this case, agent based simulation is used to analyze the asymptotic behavior of the resulted dynamical system. (shrink)
