«Mettre les faits d’accord avec la philosophie de Platon»: voilà une maxime qui remonte au Commentaire de Proclus au premier livre des Éléments d’Euclide, oeuvre centrale pour la constitution du savoir au Cinquecento et plus particulièrement pour la définition du statut opératoire des mathématiques. Au cours du XVIe siècle, Euclide apparaît en effet comme le véritable médiateur entre platonisme et aristotélisme, au demeurant moins par son oeuvre de géomètre que par son geste épistémologique qui semble tracer l’unique voie possible pour (...) accéder à la connaissance de toutes les choses, soit sensibles soit métaphysiques. Les interprétations de Jacopo Mazzoni ("In universam Platonis et Aristotelis philosophiam praeludia, sive de comparatione Platonis et Aristotelis", 1597) et de Francesco Barozzi ("Opusculum, in quo una oratio, et duae quaestiones: Altera de certitudine, et altera de medietate mathematicarum continentur", 1560), que j’examine dans mon article, offrent deux perspectives différentes, qui redonnent une actualité philosophique au néoplatonisme mathématique de Proclus. Different disciplines have analyzed binary choices to model collective behavior in human systems. Several situations in which social dilemma arise can be modeled as N-person prisoner’s dilemma games including homeland security, public goods, international political economy among others. The purpose of this study is to develop an analytical solution to the N-person prisoner’s dilemma game when boundedly rational agents interact in a population. Previous studies in the literature consider the case in which cooperators and defectors have the same learning factors. (...) We obtain an analytical equation to find equilibria in the N-person prisoner’s dilemma game in the general case when agents have different learning factors. We also introduce a more realistic approach where probability values are bounded between zero and one and therefore eliminates the possibility of infeasible probability values. Since no analytic solution can be derived in this case, agent based simulation is used to analyze the asymptotic behavior of the resulted dynamical system. (shrink)

In this article I analyze the justification of rawlsian anti-perfectionism, present in both A Theory of Justice and Political Liberalism. My aim is to show how justice as fairness, Rawls's conception of justice, lacks stability because of it. As an alternative to his anti-perfectionism, I propose, in the second part, the idea of progress as practical perfectionism by John Dewey. I argue that a perfectionist liberalism of this kind does not undermine reasonable pluralism as Rawls argued. Also I argue that (...) it is indispensable to establish a liberal society that is stable. In the end, I briefly show how the private sphere could be affected once the idea of progress is part of a conception of liberal justice. (shrink)

This book explores how the design, construction, and use of robotics technology may affect today's legal systems and, more particularly, matters of responsibility and agency in criminal law, contractual obligations, and torts. By distinguishing between the behaviour of robots as tools of human interaction, and robots as proper agents in the legal arena, jurists will have to address a new generation of "hard cases." General disagreement may concern immunity in criminal law (e.g., the employment of robot soldiers in battle), personal (...) accountability for certain robots in contracts (e.g., robo-traders), much as clauses of strict liability and negligence-based responsibility in extra-contractual obligations (e.g., service robots in tort law). Since robots are here to stay, the aim of the law should be to wisely govern our mutual relationships. (shrink)

The paper focuses on concerns and legal challenges brought on by the use of algorithms. A particular class of algorithms that augment or replace analysis and decision-making by humans, i.e. data analytics and machine learning, is under scrutiny. Taking into account Balkin’s work on “the laws of an algorithmic society”, attention is drawn to obligations of transparency, matters of due process, and accountability. This US-centric analysis on drawbacks and loopholes of current legal systems is complemented with the analysis of norms (...) and principles of the EU data protection law, or “GDPR”. The aim is twofold. On the one hand, the intent is to shed light on some crucial differences between the US and EU law on the regulation of algorithmic operators, both public and private. Whereas, in the USA, scholars debate whether and to what extent new duties and responsibilities of algorithmic operators, e.g. information fiduciaries, have to amend the current framework of self-regulation and light government—as shown by the White House’s Office of Science and Technology Policy report from November 2016—in EU law much of the new duties and responsibilities of algorithmic operators have been passed upon them as data controllers. Whether such approaches will successfully tackle the normative challenges of the algorithmic society is, on the other hand, an open issue that will likely represent the main topic of debate over the next years. Disagreement may concern: the terms framing the legal question in e.g. statistical purposes of the data processing; how such terms are related to each other in legal reasoning ; and legal hard cases that will increasingly have to do with the principles that are at stake also but not only in data protection. By entrusting such legal hard cases to algorithms, or some sort of smart artificial agent, humans still bear full responsibility for the judgment of what is socially, ethically, and legally “plain” and “hard” in social affairs. The balance between delegation of decisions to algorithms and non-delegation will be the leitmotiv of the algorithmic society. Since the devil is in the detail, the current paper is devoted to some of them. (shrink)

Con esso si realizza un progetto, formulato in anni lontani (1983) dallo stesso autore, che contemplava varie sezioni di cui l'ultima - "Christiana" comprendeva i saggi che costituiscono la prima metà del volume; a questi ne sono stati aggiunti altri, sulle medesime tematiche, che risalgono ad anni successivi. Precede i saggi un contributo di carattere metodologico ("Tipologia storica (...) delle religioni e comparazione: il caso del dualismo"). A comparative investigation in the metaphysics of material objects and persons in ancient philosophy, this book provides radically new insights into key themes and areas of ancient thought by drawing on Greek and Buddhist philosophies. Ugo Zilioli explicates the neglected tradition of philosophers who in different ways made material objects either redundant or ontologically dispensable in the ancient world. At the same time, while eliminating objects from the material apparatus of the world, some of those philosophers conceived of selves and (...) persons as the only truly existing items. The most recent tool for acting on the world, the exosomatization of cognitive activities, is often considered an autonomous and objective replacement of knowledge construction. We show the intrinsic limits of the mechanistic myths in AI, from classical to Deep Learning techniques, and its relation to the human construction of sense. Human activities in a changing ecosystem – in their somatic and sensible dimensionalities proper to any living experiences – are at the core of our analysis. By this, we stress (...) the key role of the knowing subject, far away from any allegedly objective big collections of data. The production of organized structures of physics, biology and in societal analysis will be compared and distinguished by trying to set on more robust grounds the constructive as well as the disruptive roles of entropic, negentropic, anti-entropic dynamics that are different concepts in different domains, to be handled with care: the use of machine learning and optimization methods as tools and models to analyse and manage human activities in view of their scientific and political ideology of technoscientific governance. They suppose that which they try to produce is objective, that is, standardized and controllable behaviours. In this dialogue we stress a mirror symmetry between the lack of theoretical interpretation of scientific data and the lack of democracy in this fiction of neutrality. Moreover, bad analogies constitute an obstacle to grasp the anteriority of biological and ecological constraints which enable and limit all artificial products of human intelligence. We will thus stress biological specificity, the role of normativity and constraints in evolution, of labour in structuring the human historical construction of sense by common activities. (shrink)

Au cours du xix e siècle, les théories transformistes et l’évolutionnisme permettaient de penser d’une nouvelle manière l’historicité de la nature et de la vie, y compris celle de l’homme. Historisation de la nature et naturalisation de l’homme marchent ensemble, mais la forme attribuée à la temporalité naturelle et la place de l’homme dans l’histoire de la vie restent sujets à des conceptions fort différentes dans les champs scientifiques et philosophiques et continuent à être objet de discussion tout au long (...) du xx e siècle. La question de l’articulation entre l’historicité biologique et anthropologique joue également un rôle décisif dans les œuvres de Friedrich Nietzsche et de Michel Foucault. Nous essayerons ici de contextualiser leurs réflexions à ce sujet, de montrer leurs relations et leurs spécificités, ainsi que leur actualité. (shrink)

En este artículo analizo el concepto de la democracia como un sistema de justicia procedimental en contraste con la democracia como mecanismo de toma de decisión y ejercicio del poder político de Schumpeter. La idea de la democracia como un sistema de justicia procedimental que expongo está vinculada al pensamiento de John Rawls. Al final del artículo muestro cómo esta conceptualización, en el contexto de las sociedades plurales, garantiza en mejor medida las libertades y la igualdad generando condiciones de estabilidad (...) institucional. Over the years of the printing of the Utopia by Thomas More, the paradigm of the bene ordinata res publica takes shape in Italian culture. It is a model both political and urbanistic, which is inspired by the neo-Platonic revival of the Fifteenth and Sixteenth century and concretized by the «new style» of Renaissance architects. The rationalization of the civitas, evident from the geometric definition of the urban plans, introduces a principle of order and measuring to which it is assigned (...) the task to re-form and harmonize the multiple instances of a real State – naturaliter unstable, corrupt, conflictual – within the form of an achievable eutopia. L’un des principaux arguments évoqués contre l’art contemporain au début des années 1990 en France (lors du débat autour de ce qui fut appelé la « crise de l’art contemporain ») consista en l’affirmation que puisqu’aujourd’hui n’importe quoi peut être de l’art, alors l’art d’aujourd’hui c’est n’importe quoi. Ce texte entend montrer que ce raisonnement en deux parties relève d’une confusion qui, une fois clarifiée, permettra de cerner la spécificité de l’art contemporain et des jugements qui peuvent être émis à (...) son égard. This paper discusses the representation of foreign gods as demons found in the Greek translation of the Hebrew Bible. It investigates the category of δαιμόνιον in some Septuagint texts against the background of the Hellenistic literature, and the relationship between the notion of demon and that of idol. In doing this, it shows the relevance of the Septuagint for a better understanding of religious notions emerging during the Hellenistic period. Moreover, focusing on some uses of εἴδωλον in the Pentateuch, the (...) paper proposes a new interpretation for the word in the Greek version of the decalogue, in light of papyrological evidence. In the “Vienna lecture”, the whole of the world’s history is at one moment depicted through the allegory of a wavy sea without borders. In The Idea of Phenomenology, the philosopherstoryteller is caught up in a heavy sea, but at the end, they finally manage to “drop the anchor on the shore of phenomenology”. With the break into the “mainland of absolute givenness” through phenomenological reduction, allegorical representation should lose its philosophical justification. However, metaphors which evoke allegories continue to proliferate (...) even in the most rigorous phenomenological descriptions. Despite its inherent metaphoricity, so vivid that at the crucial points of Husserl’s analyses often reappears a mythical clash of land and sea, the phenomenological interpretation of the world seems nonetheless essentially non-allegorical. In order to present a hopefully comprehensive framework of what is the stake of the growing use of robot soldiers, the paper focuses on: the different impact of robots on legal systems, e.g., contractual obligations and tort liability; how robots affect crucial notions as causality, predictability and human culpability in criminal law and, finally, specific hypotheses of robots employed in “just wars.” By using the traditional distinction between causes that make wars just and conduct admissible on the battlefield, the aim (...) is to clarify how advancement of military robotics technology is transforming a 2,000-year-old legal debate on the concept of “just war.” For the first time, legal systems will hold political authorities and military commissioners responsible for what an artificial soldier autonomously decides to do. The paper examines how the new scenario affects both principles of military conduct and notions of justice in resorting to war. (shrink)

The Cyrenaic school of philosophy (named after its founder Aristippus’ native city of Cyrene in North Africa) flourished in the fifth and fourth centuries BCE. Ugo Zilioli’s book provides the first book-length introduction to the school in English. The book begins by introducing the main figures of the Cyrenaic school beginning with Aristippus and by setting them into their historical context. Once the reader is familiar with those figures and with the genealogy of the school, the book offers an overview (...) of ancient and modern interpretations of the Cyrenaics, to provide readers with alternative accounts of the doctrines they endorsed and of the role they played in the context of ancient thought. Finally, the book offers a reconstruction of Cyrenaic philosophy and shows how the ethical side of their speculation connected with the epistemology and ontology they endorsed and that, as a result, the Cyrenaics were able to offer a quite sophisticated philosophy. Indeed, Zilioli demonstrates that they represented, in ancient philosophy, an important and original metaphysical position and alternative to the kind of realism endorsed by Plato and Aristotle. The paper examines today’s debate on the new responsibilities of Internet service providers in connection with legal problems concerning jurisdiction, data processing, people’s privacy and education. The focus is foremost on the default rules and safe harbour clauses for ISPs liability, set up by the US and European legal systems. This framework is deepened in light of the different functions of the services provided on the Internet so as to highlight multiple levels of control over information and, correspondingly, different types (...) of liability. The new responsibilities of ISPs concern the original “end-to-end” architecture of the medium and policies on design rather than responsibility for user content and individual messages. (shrink)

El siguiente artículo trata de la cuestión del hombre como animal político (ζῷον πολιτικόν), como se desprende tanto de las obras ético-políticas de Aristóteles (la Política) como de sus textos más puramente biológicos (la Investigación sobre los animales). Frente a algunos problemas de las principales interpretaciones de esta cuestión, en este artículo se vincula el problema de la politicidad humana con el de la comunidad (κοινωνία), a la que también pertenece el hombre: de hecho, el hombre es uno ζῷον πολιτικόν (...) porque es uno ζῷον κοινωνικόν. The Jewish Law (Halakahh) is probably the older legal system working in our time. It is established on a hierarchy of different texts. The oldest and more authoritative is the Torah (the five books of Moshe), then come the Mishnah, the Talmud, the compilation as Maimonide’s Mishne Torah and Caro’s Shulchan Arukh, then the responsa of the rabbis. While the authorship of the later texts is more or less clear, the one of the Torah is highly problematic, also in the (...) self-understanding of Jewish hermeneutics. This question is discussed in the present paper not from a philological-historical point of view, but from a semiotic one, trying to understand what devices and regimes of enunciation are enacted by the text in order to establish its semiotic-juridical effects. A special double enunciation frame is proposed as the mark of the legislative power in the text, in correlation with another textual device, a sort of divine “signature”. The further evolution of the authorship of the Jewish Law is discussed in its relation with the question of the autonomy in the interpretation of the sacred text. (shrink)
