ObjectivesThe end of life is an ethically challenging time requiring complex decision-making. This study describes ethical frameworks among physician trainees, explores how these frameworks manifest and relates these frameworks to experiences delivering end-of-life care.DesignWe conducted semistructured in-depth exploratory qualitative interviews with physician trainees about experiences of end-of-life care and moral distress. We analysed the interviews using thematic analysis.SettingAcademic teaching hospitals in the United States and United Kingdom.ParticipantsWe interviewed 30 physician trainees. We purposefully sampled across three domains we expected to be (...) associated with individual ethics in order to elicit a diversity of ethical and experiential perspectives.ResultsSome trainees subscribed to a best interest ethical framework, characterised by offering recommendations consistent with the patient’s goals and values, presenting only medically appropriate choices and supporting shared decision-making between the patient/family and medical team. Others endorsed an autonomy framework, characterised by presenting all technologically feasible choices, refraining from offering recommendations and prioritising the voice of patient/family as the decision-maker.ConclusionsThis study describes how physician trainees conceptualise their roles as being rooted in an autonomy or best interest framework. Physician trainees have limited clinical experience and decision-making autonomy and may have ethical frameworks that are dynamic and potentially highly influenced by experiences providing end-of-life care. A better understanding of how individual physicians’ ethical frameworks influences the care they give provides opportunities to improve patient communication and advance the role of shared decision-making to ensure goal-aligned end-of-life care. As befits an emerging field of enquiry, there is on-going discussion about the scope, role and future of the medical humanities. One relatively recent contribution to this debate proposes a differentiation of the field into two distinct terrains, ‘medical humanities’ and ‘health humanities,’ and calls for a supersession of the former by the latter. In this paper, we revisit the conceptual underpinnings for a distinction between ‘the medical’ and ‘health’ by looking at the history of an analogous debate between ‘medical (...) geography’ and ‘the geographies of health’ that has, over the last few years, witnessed a re-blurring of the distinction. Highlighting the value of this debate within the social sciences for the future development of the medical humanities, we call for scholars to take seriously the challenges of critical and cultural theory, community-based arts and health, and the counter-cultural creative practices and strategies of activist movements in order to meet the new research challenges and fulfill the radical potential of a critical medical humanities. In Memory: A Self-Referential Account, Fernández offers a functionalist account of the metaphysics of memory, which is portrayed as presenting significant advantages over causal and narrative theories of memory. In this paper, I present a series of challenges for Fernández’s functionalism. There are issues with both the particulars of the account and the use of functionalism more generally. First, in characterizing the mnemonic role of episodic remembering, Fernández fails to make clear how the mental image type that plays this role (...) should be identified. Second, I argue that a functionalist approach, which appeals to the overall structure of the memory system and tendencies of mental state types, is ill-suited to the metaphysical question about episodic remembering that is of interest to the causal and narrative theorists with which Fernandez engages. Fernández’s self-referential account of memory has many other virtues, but functionalism is a poor fit for episodic remembering. (shrink)

There has yet to be a culture discovered which lacks music. Music is a part of our existence, but we do not fully understand it. In this paper, working in the tradition of Aristotle, Wittgenstein and Langer, I elucidate some of the connections between music and the emotions. Using contemporary philosophy of mind theories of emotion, I explain how we can have a better understanding of our emotive responses to music. I follow the pattern through representational painting and abstract painting (...) to music, and show how each functions as an intentional object for the object of our emotions in response to each art form. Most ethics committees which review research protocols insist that potential research participants reserve unconditional or absolute ‘right’ of withdrawal at any time and without giving any reason. In this paper, I examine what consent means for research participation and a sense of commitment in relation to this right to withdraw. I suggest that, once consent has been given (and here I am excluding incompetent minors and adults), participants should not necessarily have unconditional or absolute rights to withdraw.This does not imply (...) that that there should be a complete absence of rights, or, indeed, an abandonment of the right to withdraw. The point of this paper is to show that the supposed unconditional or absolute nature of these rights may be self‐defeating and so fail to respect the autonomy of participants. In addition, and on a more positive note, I suggest that, attaching certain conditions on the right to withdraw, may better respect the autonomy of these participants by underlining the idea that autonomy is more than mere whim or indifference to the fate of others. On the contrary, research staff are currently unable to ‘push’ participants, who may merely have logistical difficulties unrelated to the research itself, but who really want to stay the course, for fear of coercing them. Furthermore, researchers now try to ‘screen out’ people they think may be unreliable to protect the science of the study and so groups at risk of dropping out may be unfairly denied access to research treatments. I conclude that on‐going negotiation between the relevant parties could be on balance the only truly acceptable way forward but concede certain important limitations to take into account. (shrink)

The relationship between career counselling and widening participation is increasingly capturing the attention of educational researchers, especially those interested in its social justice implications. International research on first-in-family students demonstrates the continual class-based barriers they are faced with which influence their progression into and through higher education. Career counselling has an important role to play in both supporting first-in-family students to not only enter university but also set them on a career trajectory which allows them to fulfil their aspirations. However, (...) access to effective forms of career counselling remains fragmented and highly dependent on social class. This article explores how first-in-family students engage in what we call ‘DIY career counselling,’ where they draw on their informal networks and the internet to enhance their understanding of their future prospects and possible trajectories. Their efforts suggest a strong desire to learn more about what university can offer them and how they can position themselves advantageously in the job market; furthermore, their efforts also suggest a consumerist awareness that the career counselling on offer in their secondary schools was lacking. Background During the pandemic, social and health care professionals operated in ‘crisis conditions’. Some existing rules/protocols were not operational, many services were closed/curtailed, and new ‘blanket’ rules often seemed inappropriate or unfair. These experiences provide fertile ground for exploring the role of virtues in professional life and considering lessons for professional ethics in the future. Research design and aim This article draws on an international qualitative survey conducted online in May 2020, which aimed to explore the ethical challenges experienced by (...) social workers during Covid-19. Participants and research context 607 social workers responded from 54 countries, giving written online responses. This article first summarises previously published findings from the survey regarding the range of ethical challenges experienced, then develops a new analysis of social workers’ accounts of ethically challenging situations from a virtue ethics perspective. This analysis took a narrative ethics approach, treating respondents’ accounts as stories featuring the tellers as moral agents, with implicit or explicit implications for their professional ethical identity and character. The article is illustrated with accounts from the 41 UK respondents, drawing particularly on two case examples. Ethical considerations Ethical approval was gained from Durham University and anonymity was ensured for participants. Findings/results This article explores the nature of the ethical space created during the pandemic showing how practitioners were able to draw more on ‘inner resources’ and professional discretion than usual, displaying virtues such as professional wisdom, care, respectfulness and courage as they took account of the specific contexts of their work, rather than simply adhering to blanket rules. Conclusion Exploring practice through a virtue ethical lens provides valuable lessons for ‘building back better’ in social and health care professions. (shrink)

Until at least 4 years of age, children, unlike adults, interpret some as compatible with all. The inability to draw the pragmatic inference leading to interpret some as not all, could be taken to indicate a delay in pragmatic abilities, despite evidence of other early pragmatic skills. However, little is known about how the production of these implicature develops. We conducted a corpus study on early production and perception of the scalar term some in British English. Children's utterances containing some (...) were extracted from the dense corpora of five children aged 2;00 to 5;01 ( N = 5,276), and analysed alongside a portion of their caregivers' utterances with some ( N = 9,030). These were coded into structural and contextual categories allowing for judgments on the probability of a scalar implicature being intended. The findings indicate that children begin producing and interpreting implicatures in a pragmatic way during their third year of life, shortly after they first produce some. Their production of some implicatures is low but matches their parents' input in frequency. Interestingly, the mothers' production of implicatures also increases as a function of the children's age. The data suggest that as soon as they acquire some, children are fully competent in its production and mirror adult production. The contrast between the very early implicature production we find and the relatively late implicature comprehension established in the literature calls for an explanation; possibly in terms of the processing cost of implicature derivation. Additionally, some is multifaceted, and thus, implicatures are infrequent, and structurally and contextually constrained in both populations. (shrink)

The topics of equity, diversity, inclusion, decolonization, and Indigenization have been neglected in academic and research integrity. In this article, I offer examples of how these issues are being addressed and argue that academic integrity networks and organizations ought to develop intentional strategies for equity, diversity and inclusion, and decolonization in terms of leadership, scholarship, and professional opportunities. I point out that existing systems perpetuate the conditions that allow for overrepresentation of reporting among particular student groups including international students, students (...) of colour, and those for whom English is an additional language. While metaphysics is traditionally seen as dealing with the essence of things, for Wittgenstein it is grammar. But what does he mean by "grammar"? And does he mean the same thing by this word throughout his philosophical career? In this investigation, I strive to contribute to answering to these questions. I argue that Wittgenstein's notion of grammar has evolved and changed over the years of his philosophising.

We discuss whether the two systems approach can advance understanding of children's developing counterfactual thinking. We argue that types of counterfactual thinking that are acquired early in development could be handled by the temporal updating system, whereas those that emerge in middle childhood require thinking about specific events in time.

Throw: Harry throws a stone at Dick, hitting him. Intuitively, there is a moral difference between the first and the second case of each of these pairs.1 In the second case, the agent’s behavior is morally worse than his behavior in the first case. But in each pair, the agent’s behavior has the same outcome: in No Check and Shoot, the outcome is that a child dies, and Jim saves $40; in No Catch and Throw, the outcome is that Dick (...) is hit by a stone. Let us call these pairs of cases “the paradigm pairs.” The paradigm pairs, and others like them, provide evidence that common sense morality is not consequentialist: common sense morality does not judge the moral worth of actions just in terms of their consequences. But it has proved extremely difficult to provide an account of a morally relevant difference between the members of pairs like the ones above. With the last Holocaust survivors quietly passing away, one might also expect to see accountability debates slowing to a trickle. Surprisingly, however, recent years show an upswing in corporate World War II-related atonement debates. Interest in corporate participation in mass atrocity has expanded worldwide; yet what constitutes ethical corporate behavior during and after war remains understudied. This article considers these questions through a study of the French National Railways’ roles during the German occupation and its more recent struggle to make (...) amends. This study demonstrates that ethical business leadership requires taking responsibility for past as well as current decisions. Most executives grappling with complex corporate histories work in isolation, in part because the scholarship on business ethics fails to provide guidance. Without such guidance, corporations often respond to accusations about their pasts with carefully crafted statements and legal strategies rather than deep expressions of moral leadership. To assist in remedying this tendency, this paper simultaneously encourages companies to engage in deeper reflection on corporate history, while urging scholars to help guide corporations through critical ethical conversations. This article discusses empirical legal research on trial courts and adjudication and divides them into three dimensions of analysis, macro, meso, and micro, to frame the discussion of empirical legal studies into courts and adjudication, the various methods researchers use, and significant findings. Empirical research may be theoretical, pragmatic or policy oriented. A large body of research approaches the study of (...) courts and adjudication from an organizational perspective, looking at court structures and how they affect daily operation. Examining trial court judges' approaches to their work, including adjudication, using survey research has also been undertaken in non-English speaking jurisdictions. Each type of research design has specific strengths and advantages, as well as limitations, but each contributes to advancing knowledge about the nature, role, and reality of trial courts and adjudication. In this article we review Western discourse on the relationship between Daoism and anarchist political theory. In particular, we focus on the anarchist reading of Daoism given by Roger Ames, and the more recent contrasting argument against reading Daoism as an anarchism by Alex Feldt. Centering our discussion on the Daodejing 道德經, we argue that, on the one hand, Laozi’s 老子 political theory is less easily reconcilable with anarchist thinking than Ames suggests. On the other hand, we dispute Feldt’s argument (...) that Laozi’s sage-ruler must, of necessity, maintain the capacity for coercive control. Counter to both Ames and Feldt, we suggest that Laozi’s sage-ruler is better framed as a maternal overseer, in contrast to other more paternalistic extrapolations of Daoist thinking, such as that offered in the Hanfeizi 韓非子. In reading Laozi’s thinking as a form of state “maternalism,” we aim to give a more distinctive voice to the nuances of early Daoist political theory. (shrink)

Here I set the stage for developing a Kantian account of punishment attuned to social and economic injustice and to the need for prison reform. I argue that we cannot appreciate Kant's own discussion of punishment unless we read it in light of the theory of justice of which it is a part and the fundamental commitments of that theory to freedom, autonomy and equality. As important, we cannot properly evaluate Kant's advocacy of the law of retribution unless we recognize (...) his theory of justice as an ideal theory. Once we understand both Kant's larger account of justice and its relationship to his less basic commitments, we discover grounds to accept that larger theory, but reject components like the law of retribution with their basis in empirical conclusions we may not share with Kant. We also open the way to develop an account of punishment responsive to social circumstances. (shrink)

This paper offers a preliminary enquiry into a largely neglected topic: the concept of time in the post-medieval, pre-Newtonian era. Although Aristotle's theory of time was predominant in the sixteenth and early seventeenth centuries, it was, in this period, subjected to the most serious attack since that by the ancient Neoplatonists. In particular, in the work of Bernadino Telesio, Giordano Bruno and Francesco Patrizi we have concerted attempts to reconsider Aristotle's definition of time. Although the approach of each is different, (...) all three endeavour to dissociate time from movement and to conceive it as part of an independent duration. They were probably inspired by Neoplatonism, and they offer important antecedents to Newton's theory of absolute time. (shrink)

Though the overall numbers of women judges remain small, higher proportions of women have been appointed to many lower courts in common law, and particularly in civil law, countries. This paper investigates whether the experiences of judging and judicial work differ among women and men magistrates in Australia’s lower courts. The particular focus is satisfaction with their work as judges. In so doing, it helps build up a picture of the extent of the gendered nature of the judiciary as an (...) occupation. Measures of overall job satisfaction identify few gender differences; more refined measures highlight areas of divergence between men and women magistrates, suggesting gendered experiences of judicial work which result from particular characteristics of the occupation, as presently constituted, rather than the nature of judging itself. The benefits of belonging for academic performance and persistence have been examined primarily in terms of subjective perceptions of social belonging, but feeling ability belonging, or fit with one’s peers intellectually, is likely also important for academic success. This may particularly be the case in male-dominated fields, where inherent genius and natural talent are viewed as prerequisites for success. We tested the hypothesis that social and ability belonging each explain intentions to persist in physical science, technology, engineering, and math (pSTEM). (...) We further explore whether women experience lower social and ability belonging than men on average in pSTEM and whether belonging more strongly relates to intentions to persist for women. At three time points throughout a semester, we assessed undergraduate pSTEM majors enrolled in a foundational calculus or physics course. Women reported lower pSTEM ability belonging and self-efficacy than men but higher identification with pSTEM. End-of-semester social belonging, ability belonging, and identification predicted intentions to persist in pSTEM, with a stronger relationship between social belonging and intentions to persist in pSTEM for women than men. These findings held after controlling for prior and current academic performance, as well as two conventional psychological predictors of academic success. (shrink)

This article illuminates why Nicolás Palacios’s 1904 monograph, Raza chilena:Libro escrito por un Chileno i para los Chilenos [Chilean Race: A Book Written by a Chilean for Chileans], is central to the creation of a myth of Chilean racial homogeneity at the turn of the twentieth century. Placing Palacios in the context of Latin American eugenic discourse, it demonstrates how he selected a specific racial origin story in order to accommodate his belief in racial hierarchy while also depicting race mixing (...) in a positive light. Specifically, the article highlights how the myth of Chilean racial homogeneity elided the difference between the term “mestizo,” which was applied to people of mixed racial heritage, and “white.” I contend that Palacios sought to differentiate Chileans from other Latin Americans by emphasizing their racial distinctiveness. The article therefore highlights that Latin American eugenics was concerned with the creation of national narratives that historicized particular racial mixtures in order to reify and affirm national differences. As such, it connects to literature regarding the history of eugenics, race, nation, and the creation of whiteness. (shrink)
