Dans son ouvrage La libération animale, Peter Singer développe trois grandes idées : le principe d'égale considération des intérêts, le rejet du spécisme et la nécessité de mettre un terme à certains types d'exploitation des animaux, notamment ceux qui ont trait à la recherche et à l'élevage industriel. Cette oeuvre phare a connu un retentissement immense, à tel point que sa publication, en 1975, a été présentée comme le moment clef dans l'émergence du mouvement éponyme. Cependant, le mouvement de libération (...) animale ne saurait se réduire à la seule pensée singerienne. Ce mouvement extrêmement protéiforme a fait l'objet de débats intenses à l'interne, entre les défenseurs des animaux eux-mêmes qui privilégient des approches diverses, comme à l'externe, entre ceux qui défendent le statu quo ou contestent les arguments animalistes. L'objet de ce recueil est de revenir sur le lien entre le mouvement de libération animale et les théories de Peter Singer qui, à tort ou à raison, en est perçu comme le père fondateur. Comment l'éthique animale de l'auteur a-t-elle été accueillie depuis la publication de La libération animale, et comment a-t-elle évolué? Quelle place la doctrine utilitariste occupe-t-elle dans le travail de Singer et dans les débats qu'il a engendrés? C'est en effet dans cette doctrine parente que résident les écueils auxquels s'est heurté le travail de l'auteur. C'est aussi là que son système a trouvé sa force et sa simplicité caractéristiques. According to Alasdair Cochrane, liberty can have value for most animals only because it allows them to obtain other desirable things, such as well-being. With this he concludes that humans can continue to use other animals as long as they treat them well. In this article, I reject this conclusion by arguing against the positive conception of liberty in favor of its negative or republican conception. I suggest that it is sufficient for a being to be capable of agency in (...) order to have an interest in liberty, which deserves to be protected by the right to be free. (shrink)

Ethical dilemmas and decision-making are a persistent feature of the everyday operations of animal shelters and animal protection organizations. These organizations frequently face difficult decisions about how to treat the animals in their care, decisions that are made all the more difficult by limited funding, material resources, and human labor. Moreover, animal protection organizations must also determine how to act within and toward the wider social and institutional environment in which non-human animals are routinely exploited. The first section of The (...) Ethics of Animal Shelters contains practical recommendations developed by ethicists in response to the ethical challenges identified by employees of the Montreal Society for the Prevention of Cruelty to Animals. These challenges arise across the organization's activities, including its internal structure; shelter operations; public campaigns and advocacy work; dealing with the public, animal agriculture and governmental agencies; and their work with feral animals. The second section offers philosophical analyses of the ethical challenges unique to animal shelters. Issues explored include the killing of shelter animals; shelter animals' diets; medical decision-making procedures; adoption policies; and the role shelters might play in transforming social attitudes and norms. Legal systems in the Western world currently regard animals as property. This status implies that they are not subjects of rights. None of the recent legal measures aimed at protecting animals have conferred on them the legal status of person, which is arguably a necessary condition to benefit from the most fundamental individual rights. In this chapter, we argue that the type of control of animals that is based on property rights and domination is ethically unacceptable. We also argue that (...) extending personhood and its corresponding rights to all sentient beings is the best way to ensure that they are not made to suffer unnecessarily and that they are protected from domination. While there may exist morally legitimate occurrences of human control over other animals, justice requires that we abolish all forms of their exploitation. (shrink)

Daniel Bell and Wang Pei’s recent monograph, Just Hierarchy, seeks to defend hierarchical relationships against more egalitarian alternatives. This paper addresses their argument, offered in one chapter of the book, in favour of a hierarchical relationship between human and nonhuman animals. This relationship, Bell and Pei argue, should conform to what they call “subordination without cruelty:” it is permissible to subordinate and exploit animals for human ends, provided that we do not treat them cruelly. We focus on three aspects of (...) their view: their argument for a hierarchical view; their understanding of cruelty; and their account of the heightened duties they claim we owe to nonhuman animals who are intelligent, domesticated, and/or “cute.” We argue that the reasons that Bell and Pei offer fail to support their conclusions, and that, even if one accepts a hierarchical view, the conclusions that Bell and Pei draw about the permissibility of practices such as killing animals for food do not follow. We conclude by emphasizing philosophers’ responsibility to thoroughly test their arguments and to engage with existing debates, especially when the practices they seek to justify involve harms of great magnitude. BackgroundIn Parkinson's disease, the side of motor symptoms onset may influence disease progression, with a faster motor symptom progression in patients with left side lateralization. Moreover, worse neuropsychological outcomes after subthalamic nucleus deep brain stimulation have been described in patients with predominantly left-sided motor symptoms. The objective of this study was to evaluate if the body side of motor symptoms onset may predict motor outcome of bilateral STN-DBS.MethodsThis retrospective study included all consecutive PD patients treated with bilateral STN-DBS at Grenoble (...) University Hospital from 1993 to 2015. Demographic, clinical and neuroimaging data were collected before and 1 year after surgery. The predictive factors of motor outcome at one-year follow-up, measured by the percentage change in the MDS-UPDRS-III score, were evaluated through univariate and multivariate linear regression analysis.ResultsA total of 233 patients were included with one-year follow-up after surgery [143 males ; 121 right body onset; 112 left body onset; mean age at surgery, 55.31 ± 8.44 years; mean disease duration, 11.61 ± 3.87]. Multivariate linear regression analysis showed that the left side of motor symptoms onset did not predict motor outcome.ConclusionsIn this retrospective study, the body side of motor symptoms onset did not significantly influence the one-year motor outcome in a large cohort of PD patients treated with bilateral STN-DBS. We report the identification of a recurrent, 520-kb 16p12.1 microdeletion associated with childhood developmental delay. The microdeletion was detected in 20 of 11,873 cases compared with 2 of 8,540 controls and replicated in a second series of 22 of 9,254 cases compared with 6 of 6,299 controls. Most deletions were inherited, with carrier parents likely to manifest neuropsychiatric phenotypes compared to non-carrier parents. Probands were more likely to carry an additional large copy-number variant when compared to matched controls. The clinical (...) features of individuals with two mutations were distinct from and/or more severe than those of individuals carrying only the co-occurring mutation. Our data support a two-hit model in which the 16p12.1 microdeletion both predisposes to neuropsychiatric phenotypes as a single event and exacerbates neurodevelopmental phenotypes in association with other large deletions or duplications. Analysis of other microdeletions with variable expressivity indicates that this two-hit model might be more generally applicable to neuropsychiatric disease. © 2010 Nature America, Inc. Because I am inclined to agree with the spirit (if not always the substance) of Trollinger's remarks, I would like to respond with some thoughts on the manner in which she tends to frame (...) this debate, because I believe that this has crucial implications and may explain the cause of some of the very problems she mentions.Charlene Morton writes that a "bias for procedural knowledge... unwittingly immerses school music in the polemic arising from the false hierarchical dichotomy between 'hard' and 'soft' forms of knowledge."1 By this she means that the Cartesian mind/body split, which has led to our conception of thinking and doing as exclusive matters, is not remedied by our discovery of the importance of purely procedural knowledge, because we merely reinforce this dichotomy through acknowledging the latter term as a separate category from theoretical knowledge. Trollinger is correct in asserting that the act of performance is often overlooked and is not treated as a serious concern in music education and I believe that this may be largely due to this dichotomy, which manifests itself in the way that we divorce performance from its original holistic context.In general, if we accept this argument, then debates about performance versus listening, theorizing, and so on are inherently problematic because the discourse itself reinforces an artificial dichotomy. If we fail to address the remnants of this "Cartesian anxiety," then in our attempts to address a lack of concern over performance, we may be left with a performance model that is purely utilitarian, in the sense that the body can only justifiably occupy a central place in the curriculum if there are direct, utilitarian outcomes that we can associate with it and so long as those outcomes are supported by the free market. In North America, progressive educators have been struggling for some time against the concept of school as a locus of training for the market place. This model becomes more difficult to resist, I would argue, as long as we continue to compartmentalize performance and other aspects of musicianship. Such practices reinforce an artificial distinction between procedural and theoretical forms of knowing (and, by extension, between mental and manual forms of labor) that Apple, Giroux, and other critical pedagogues would argue atomizes student knowledge in preparation for the marketplace; yet musicianship can serve many other valuable purposes.2 [End Page 231]Trollinger, in using the word "holistic," reminds us of the connection between body and mind that exists in performance. Further, she correctly states that until relatively recently, those who taught music were musicians. I would add that in Canada (where I teach), the idea that music should be taught by musicians has often been used to justify its exclusion from schools, which is indicative of our tendency to exclude those things that we deem corporeal from the life of the mind. In my home province of Ontario, recent emphasis on "the basics" has meant that music programs have vanished in great numbers, while music study is relegated to the conservatories which, with their widespread tendency to essentialize musical experience as performance in the most limited sense of the word, have contributed further to this dichotomy.My point is that all of us, including Trollinger, may wish to reconsider the nomenclature that we carry into this debate from the outset. Because the word "performance" has become strongly associated with this particular pole (it is no accident that we use this word to describe car engines and stock returns) I suggest we can best elevate our estimation of the term by replacing it with the word "musicianship." In this way we can repair some of the damage done by the Cartesian split and the consequent de-valuing of performance that has occurred through separation from its original context. Within such an integrated model, it would become problematic to debate the relative importance of performing, listening, theorizing, or any number of activities with regard to the overall goals of musicianship... The Palgrave Handbook of Practical Animal Ethics is a recent addition to anthologies in the field, joining The Oxford Handbook of Animal Ethics, and The Routledge Handbook of Animal Ethics. Edited by Andrew Linzey and Clair Linzey of the Oxford Centre for Animal Ethics, the book boasts more than 30 contributors, many of them philosophers, but also including sociologists, scientists, theologians, lawyers, psychologists, and animal advocates. The editors were intentionally multidisciplinary in their approach, noting that “there is currently no book (...) series that is a focus for multidisciplinary research in the field,” and calling attention to the need not only for philosophical inquiry into what we owe animals, but also into the “social, legal, cultural, religious and political” influences that “legitimate animal abuse” (p. viii).The book is divided up into four sections: “The Ethics of Control,” “The Ethics of Captivity,” “The Ethics of Killing,” and “The Ethics of Causing Suffering.” Each of these sections includes an editorial introduction and multiple entries spanning diverse issues, including animal research, animal agriculture, hunting, fishing, zoos, the role of animals in religion, the role of language in structuring thought about nonhuman animals, and others. Similarly, the chapters span issues affecting many species, including farmed animals, fish, deer, elephants, whales and dolphins, rodents, companion animals (e.g., dogs and cats), and others.While the book is billed as a “practical” handbook of animal ethics, it does wade into some conceptual territory, tackling such issues as the ethical permissibility of confining and controlling animals, the question of whether (painless) death harms nonhuman animals, and the comparative wrongness of killing humans and nonhuman animals. This said, it largely stays away from more detailed discussion of normative ethical theory and the moral standing of nonhuman animals, focusing instead on the specific ways that humans treat nonhuman animals. In focusing more on practical than theoretical ethics, the Palgrave Handbook of Practical Animal Ethics both complements and differentiates itself from some other anthologies in the field.The book has several strengths to recommend it, the first being the logic of its organization. The ethically problematic aspects of humans’ treatment of nonhuman animals frequently map onto one or more of the categories of causing suffering, killing, and confining. The organization of chapters under these section headings helps to provide a rational structure to the text, as well as an easy way for the reader to navigate which sections they would like to tackle first (although there is some overlap between sections). With this, the explicit and sustained focus on the ethics of control (section 1) is a welcome and differentiating feature of the text. Much prior work in animal ethics has addressed questions of harming and killing animals, but the ethical permissibility of control per se has received comparatively lesser attention.The multidisciplinary nature of the book is also a selling point. In any anthology on animal ethics, the reader can expect entries from academic philosophers, but the book's inclusion of empirical scientific reviews, sociological and legal analyses, and work in discourse analysis are strengths. One danger in focusing exclusively on what we ought to think and do is that it ignores the influences on how we actually think and act. Many of the book's entries address these influences and thus round out the normative analysis.The middle two sections of the book seem most successful to this reviewer. The section on the ethics of killing contains two well-argued conceptual chapters, coupled with practical analyses of fishing, deer hunting, and religious perspectives on killing nonhuman animals. While animal research and animal agriculture are not directly addressed in this section, the conceptual arguments can be applied to the killing of nonhuman animals in these contexts. The section on the ethics of captivity is not as conceptually strong but contains excellent empirical chapters on the welfare of elephants, whales, and dolphins in captivity. Prior work in normative ethics has established how confinement can be harmful to nonhuman animals by directly causing suffering or depriving them of opportunities for satisfaction (see, e.g., DeGrazia, 2002). However, it is important to complement such theoretical frameworks with substantiation of how captivity actually is harmful to nonhuman animals in virtue of the interests they have and how captivity infringes upon such interests. These chapters argue that captivity is fundamentally (and not conditionally) incompatible with the welfare of elephants, whales, and dolphins.If I have one criticism of the book, it is that it could be stronger on certain conceptual issues. Acknowledging its practical and not theoretical focus, it is nonetheless true that if controlling, confining, killing, and causing suffering to nonhuman animals is wrong, then it is important to say something about why it is wrong—even if that explanation amounts to a short synopsis of more theoretical work done elsewhere. While the question of killing is addressed well, the section on the ethics of causing suffering does not address directly why (or under what conditions) causing suffering is wrong. The chapters in this section are worthwhile reading and review practices causing animal suffering in a variety of contexts. Nonetheless, some additional conceptual front matter would have strengthened the section overall.From a conceptual standpoint, the sections on the ethics of control and captivity seem to hang together. Confinement is a form of control and might be argued against on the grounds that it deprives nonhuman animals of opportunities for satisfaction, directly causes physical injury, or causes psychological distress, anxiety, or boredom. These kinds of arguments fit into interest-based accounts of animal welfare, which in turn can be subsumed under a principle of nonmaleficence: We should not cause harm to animals under some specified set of conditions; confinement harms animals in ways x, y, or z; therefore, we should not confine animals in this way.While such interest-based arguments do make an appearance in the text, several of the book's authors also elaborate an autonomy-based argument against control and confinement: Nonhuman animals have their own kind of autonomy, and just as infringing upon the autonomy of paradigmatic persons is wrong, infringing upon nonhuman animals’ autonomy is also wrong. The problem with this argument is that different kinds of autonomy are likely to be at stake. The wrongness of infringing upon paradigmatic persons’ autonomy is often explained by the facts that we are self-conscious, capable of abstract thought (including language use), and capable of intentionally choosing the kind of life that we want to live (e.g., relating to long-term projects or schemes of personal ethics). It could be argued that because nonhuman animals are not capable of exercising this kind of autonomy, they therefore cannot be harmed by its infringement.Some of the book's authors chip away at this presumption, noting (inter alia) that nonhuman animals have desires to move around and do things that are thwarted by confinement or control, that these desires constitute a form of agency, and that (following previous scholarship) nonhuman animals possess some forms of self-awareness. Specifically, the chapters from Valéry Giroux and Carl Saucier-Bouffard, Lori Gruen, and Carlos Naconecy consider such arguments. Naconecy draws upon David DeGrazia's (2009) analysis of animal self-awareness in making his argument. Though the issue deserves more treatment than I can give it here, it seems that nonhuman animals’ autonomy and self-awareness, even if granted, are of a different sort than that possessed by paradigmatic persons. Specifically, (most) nonhuman animals cannot feel wronged by having their preferences overridden because they are not the kinds of beings who are capable of abstractly considering themselves as autonomous and worthy of self-direction. They may desire things, and thwarting these desires might sometimes harm them, but that is a different kind of argument.Infringing upon nonhuman animals’ (more limited kind of) autonomy might nonetheless be wrong, but if different sorts of autonomy are at stake, then moral arguments relating to paradigmatic persons cannot be directly transposed to nonhuman animals. Some additional argument(s) must be supplied, but (on my reading) the book's contributors stop short of this. Nonetheless, as stated above, the ethics of control and questions of nonhuman animals’ autonomy are not as well trod as other issues in animal ethics. Despite my taking issue with some of the details, the discussions contained in the book's first two sections are worthy reading and help to advance the field.Overall, the book's chapters are well written and cogently argued, and given its breadth, different readers will find different things to value in it. The Palgrave Handbook of Practical Animal Ethics is a welcome addition to the literature. (shrink)

What does it mean to invoke a social structural explanation, and how do such explanations relate to individualistic ones? This article explores recent philosophical debates concerning the nature and usages of social structural explanation. I distinguish between two central kinds of social structural explanation: those that are autonomous from psychology, and those that are not. This distinction will help clarify the explanatory power (...) that each type of SSE has, points of convergence with methodological traditions such as critical theory and rational choice theory, and the difficulties that each type of SSE faces. Sugar, pork, beer, corn, cider, scrapple, and hoppin' John all became staples in the diet of colonial America. The ways Americans cultivated and prepared food and the values they attributed to it played an important role in shaping the identity of the newborn nation. In A Revolution in Eating, James E. McWilliams presents a colorful and spirited tour of culinary attitudes, tastes, and techniques throughout colonial America. Confronted by strange new animals, plants, and landscapes, settlers in the colonies and West (...) Indies found new ways to produce food. Integrating their British and European tastes with the demands and bounty of the rugged American environment, early Americans developed a range of regional cuisines. From the kitchen tables of typical Puritan families to Iroquois longhouses in the backcountry and slave kitchens on southern plantations, McWilliams portrays the grand variety and inventiveness that characterized colonial cuisine. As colonial America grew, so did its palate, as interactions among European settlers, Native Americans, and African slaves created new dishes and attitudes about food. McWilliams considers how Indian corn, once thought by the colonists as "fit for swine," became a fixture in the colonial diet. He also examines the ways in which African slaves influenced West Indian and American southern cuisine. While a mania for all things British was a unifying feature of eighteenth-century cuisine, the colonies discovered a national beverage in domestically brewed beer, which came to symbolize solidarity and loyalty to the patriotic cause in the Revolutionary era. The beer and alcohol industry also instigated unprecedented trade among the colonies and further integrated colonial habits and tastes. Victory in the American Revolution initiated a "culinary declaration of independence," prompting the antimonarchical habits of simplicity, frugality, and frontier ruggedness to define American cuisine. McWilliams demonstrates that this was a shift not so much in new ingredients or cooking methods, as in the way Americans imbued food and cuisine with values that continue to shape American attitudes to this day. This paper argues that some widely used laws of implication are false, and arguments based upon them invalid. These laws are Exportation, Commutation, (as well as various restricted forms of these), Exported Syllogism and Disjunctive Syllogism. All these laws are false for the same reason – that they license the suppression or replacement in some position of some class of propositions which cannot legitimately be suppressed or replaced. These laws fail to preserve the property of sufficiency of premiss set for (...) conclusion. They are false, and can be seen to be false, independently of their respon- sibility for the paradoxes. Hence the main ‘independent’ argument for the paradoxes – that they follow from an allegedly immaculate set of laws – is undermined. Counterexamples to all these laws are produced. (shrink)

Prudential value is the good for a person. It is often identified with well-being, so that well-being is not one prudential value among many, but instead the most general category of prudential value. This chapter considers the main theories of well-being—including eudaimonism, desire satisfactionism, and hedonism—in light of two main theoretical desiderata: subject-relativity and normativity. A good theory of well-being ought to explain how its conception of well-being is good for the person whose well-being it is. This, however, is often absent from reported research and provides the reader with little evidence by which to judge the merits of the chosen methodology and its influence on the study. The purpose of this paper is to set out the case for critical realism as a framework to guide appropriate action in practice development (...) and realistic evaluation for understanding the consequences of those actions.It is evident that critical realism and critical social science share common ground. Emancipatory practice development (ePD) is based on the philosophy of critical social science and therefore by virtue is linked to the tenets of critical realism. Until now, the evaluation of ePD programme has been well served by 4th-generation evaluation. However, this paper outlines the need for a different approach to evaluation, one that is based on critical realism, that is concerned with emancipation, and that can be used in the ever-changing environment of clinical practice. Realistic evaluation not only links strongly to ePD programmes, but also serves as the basis for effective research questions that will test the outcomes of the research and inform the transferability of ePD mechanisms into differing contexts. From 1998 to 2005, six elections took place in postcommunist Europe that had the surprising outcome of empowering the opposition and defeating authoritarian incumbents or their designated successors. Valerie J. Bunce and Sharon L. Wolchik compare these unexpected electoral breakthroughs. They draw three conclusions. First, the opposition was victorious because of the hard and creative work of a transnational network composed of local opposition and civil society groups, members of the international democracy assistance community and graduates of successful electoral challenges (...) to authoritarian rule in other countries. Second, the remarkable run of these upset elections reflected the ability of this network to diffuse an ensemble of innovative electoral strategies across state boundaries. Finally, elections can serve as a powerful mechanism for democratic change. This is especially the case when civil society is strong, the transfer of political power is through constitutional means, and opposition leaders win with small mandates. (shrink)

There is a bias in neuroscience toward localizing and modularizing brain functions. Single cell recording, imaging studies, and the study of neurological deficits all feed into the Gallian view that different brain areas do different things and the things being done are confined to particular processing streams. At the same time, there is a growing sentiment that brains probably don’t work like that after all; it is better to conceive of them as fundamentally distributed units, multi‐tasking at every level. This (...) sentiment, however, is much less congenial to the tried‐and‐true experimental protocols available today and to theorizing about the brain in general. This essay examines the tension between current experimental methods and large-scale views of the brain. We argue that this disconnection between experiment and what really are guiding theoretical metaphors seriously impedes progress in neuroscience. (shrink)

Hubris among CEOs is generally considered to be undesirable: researchers in finance and in management have documented its unwelcome effects and the media ascribe many corporate failings to CEO hubris. However, the literature fails to provide a precise definition of CEO hubris and is mostly silent on how to prevent it. We use work on hubris in the fields of mythology, psychology, and ethics to develop a framework defining CEO hubris. Our framework describes a set of beliefs and behaviors, both (...) psycho-pathological and unethical in nature, which characterize the problematic relationship of the hubris-infected CEO towards his or her own self, others and the world at large. We then demonstrate how the development of authentic leadership may contribute to preventing or attenuating hubris by addressing its psycho-pathological nature through the true self and meaningful relationships with others. In addition to its psycho-pathological dimension, CEO hubris also contains an ethical dimension. We therefore propose that the development of the virtue of reverence might contribute to the prevention or attenuation of CEO hubris, because reverence makes the individual aware of his or her place in the world order and membership of the community of humans. Theorists of legal translation generally describe it as an interdisciplinary activity whose methodology draws deeply upon comparative law. In practice, how can we apply this theoretical paradigm to translator training? This article examines methods of integrating comparative law with the acquisition of knowledge and know-how that constitute the translator’s core competences, emphasizing the resolution of legal terminology problems resulting from incongruencies between legal systems. Given that the goal is to compare law for the purposes of translation, it is useful to (...) approach these problems from a functionalist viewpoint, principally through confronting a range of cases and situations likely to challenge the professional translator. Therefore, the author proposes including, along with other teaching methods, targeted work on terminological problems which necessitate the study of comparative law. This article uses social dominance theory (SDT) to explore the dynamic and systemic nature of the initiation and maintenance of organizational corruption. Rooted in the definition of organizational corruption as misuse of power or position for personal or organizational gain, this work suggests that organizational corruption is driven by the individual and institutional tendency to structure societies as group-based social hierarchies. SDT describes a series of factors and processes across multiple levels of analysis that systemically contribute to the initiation and (...) maintenance of social hierarchies and associated power inequalities, favoritism, and discrimination. I posit that the same factors and processes also contribute to individuals’ lower awareness of the misuse of power and position within the social hierarchies, leading to the initiation and maintenance of organizational corruption. Specifically, individuals high in social dominance orientation, believing that they belong to superior groups, are likely to be less aware of corruption because of their feeling of entitlement to greater power and their desire to maintain dominance even if that requires exploiting others. Members of subordinate groups are also likely to have lower awareness of corruption if they show more favoritism toward dominant group members to enhance their sense of worth and preserve social order. Institutions contribute to lower awareness of corruption by developing and enforcing structures, norms, and practices that promote informational ambiguity and maximize focus on dominance and promotion. Dynamic coordination among individuals and institutions is ensured through the processes of person-environment fit and legitimizing beliefs, ideologies, or rationalizations. (shrink)

In this essay, I hope to make clearer what the points of division between the materialists and the sceptics are. I argue that the rifts are quite deep and turn on basic differences in understanding the scientific enterprise. In section I, I outline the disagreements between David Chalmers and me, arguing that consciousness is not a brute fact about the world. In section II, I point out the fundamental difference between the materialists and the sceptics, suggesting that this difference is (...) not something that further discussion or argumentation can overcome. In the final section, I outline one view of scientific explanation and conclude that the source of conflict really turns on a difference in the rules each side has adopted in playing the game. As of this writing, twenty‐one states have passed laws barring transgender youth‐athletes from competing on public‐school sports teams in accordance with their gender identity. Proponents of these regulations claim that transgender females in particular have inherent physiological advantages that threaten a “level playing field” for their cisgender competitors. Existing evidence is limited but does not support these restrictions. Gathering more robust data will require allowing transgender youth to compete (rather than preemptively barring them), but even if trans females are shown (...) to retain some advantage, this would not have greater moral significance than the many other “fair” physical and economic advantages found across sports. These regulations deprive transgender youth, an exceptionally vulnerable population, from the vast physical, mental, and social benefits of sports. While we advocate for transgender inclusion under our current, gender‐segregated model of sport, we propose changes to the overarching structure that would promote a more inclusive and fairer athletic environment. In trying to characterize the relationship between psychology and neuroscience, the trend has been to argue that reductionism does not work without suggesting a suitable substitute. I offer explanatory extension as a good model for elucidating the complex relationship among disciplines which are obviously connected but which do not share pragmatic explanatory features. Explanatory extension rests on the idea that one field can "illuminate" issues that were incompletely treated in another. It has been more than 20 years since the U.S. Supreme Court's landmark decision in Daubert v. Merrell Dow Pharmaceuticals, Inc. on the admissibility of scientific expert witness testimony in legal proceedings. It is time, perhaps, to look back at the history of Daubert decisions to determine whether it and its progeny have lived up to their collective promises to keep bad science out of the courtroom, while allowing in good, especially where the mind and brain sciences are concerned.In this (...) essay, I argue that, although the decision in Daubert describes a general test for the admissibility of scientific evidence, it has not been applied consistently to data and conclusions drawn from the behavioral sciences.... Current guidance from the American Society for Reproductive Medicine (ASRM) and the American College of Obstetricians and Gynecologists (ACOG) indicates that body mass index (BMI) ought not be used alone for in vitro fertilization (IVF) exclusionary policies, but the reasons for using BMI alongside other criteria are less clear. This article aims to fill a gap in the literature on this point and follow the findings to a logical conclusion regarding the role of BMI in IVF policies of the future. (...) The article discusses why BMI might be useful in IVF policies, explores evidence that other metrics may be sufficient to estimate population-level risk, and addresses whether policies ought to continue to use BMI. Because BMI has a morally problematic history, results in disproportionate outcomes along racialized lines, and has the potential to reinforce negative stereotypes, the article suggests that providers ought to replace BMI with other metrics.
