As of this writing, twenty‐one states have passed laws barring transgender youth‐athletes from competing on public‐school sports teams in accordance with their gender identity. Proponents of these regulations claim that transgender females in particular have inherent physiological advantages that threaten a “level playing field” for their cisgender competitors. Existing evidence is limited but does not support these restrictions. Gathering more robust data will require allowing transgender youth to compete (rather than preemptively barring them), but even if trans females are shown (...) to retain some advantage, this would not have greater moral significance than the many other “fair” physical and economic advantages found across sports. These regulations deprive transgender youth, an exceptionally vulnerable population, from the vast physical, mental, and social benefits of sports. While we advocate for transgender inclusion under our current, gender‐segregated model of sport, we propose changes to the overarching structure that would promote a more inclusive and fairer athletic environment. How do the ways we argue represent a practical philosophy or a way of life? Are concepts of character and ethos pertinent to our understanding of academic debate? Open peer commentary on the article “Beyond Individual-Centred 4E Cognition: Systems Biology and Sympoiesis” by Mads Julian Dengsø & Michael David Kirchhoff. Abstract: A move to sympoiesis entails a conceptual overhaul of autopoiesis, a key facet of the enactive approach to cognition. In this commentary, I invite more systematic thinking about the concept of autopoiesis and enactivist commitments to it, given the inconsistencies regarding individuality raised in the target article.

The article argues that there are different ways of justifying suspension of judgement. We suspend judgement not only privatively, that is, because we lack evidence, but also positively, that is, because there is evidence that provides reasons for suspending judgement: suspension is more than the rational fallback position in cases of insufficient evidence. The article applies the distinction to recent discussions about the role of suspension for inquiry, Turri's puzzle about withholding, and formal representations of suspension.

This chapter considers infants' understanding that acts of attention — looking and pointing — as object-directed, that is, as implying a relation between the agent who produces them and the object at which they are directed. Sensitivity to the object-directed structure of these actions provides an essential framework for understanding the phenomenological, psychological, and behavioural implications of these actions. The evidence reviewed indicates that although young infants sometimes orient appropriately in response to others' gaze shifts and points, they seem not (...) to understand these actions as object-directed until late in the first year of life. Findings of relatively early success at orienting but later success in action understanding raise questions about the mechanisms by which action understanding emerges, and these are considered at the end of the chapter. The United Network for Organ Sharing (UNOS) waiting list was designed as a just and equitable system through which the limited number of organs is allocated to the millions of Americans in need of a transplant. People have trusted the system because of the belief that everyone on the list has an equal opportunity to receive an organ and also that allocation is blind to matters of financial standing, celebrity or political power. Recent events have revealed that certain practices and (...) policies have the potential to be exploited. The policies addressed in this paper enable those on the list with the proper resources to gain an advantage over other less fortunate members, creating a system that benefits not the individual most in medical need, but the one with the best resources. These policies are not only unethical but threaten the balance and success of the entire UNOS system. This paper proposes one possible solution, which seeks to balance the concepts of justice and utility. (shrink)

Affects have often been characterised as a hindrance to the rational thinker. In this paper I reconsider the role of affects in philosophical inquiry in the light of recent work on the emotions which suggests that affects play a role in framing the ways in which we experience the world. I explore affects as motivators and curtailers of philosophical inquiry drawing on work by Hookway. I suggest that although Hookway is correct in identifying the motivating role of affects, his account (...) is too sparse and does not take account of the wider role which affects play in philosophical inquiry. Drawing on phenomenological psychiatry I argue that affects play a pre-reflective role which enables successful ‘explicit’ reasoning to begin. Building on this I use accounts by de Sousa on emotions as salience providers and William James on the role of temperament in philosophical inquiry to supplement and fill the gaps left by Hookway’s account. Here I draw a distinction between sporadic and sustained affects, claiming that a full account of the role of affects in philosophy ought to take account of both. This paper ultimately provides an examination of how the recent work on emotions affects the way we may view philosophical inquiry. (shrink)

Cognitive control processes are advantageous when routines would not lead to the desired outcome, but this can be ill-advised when automated behavior is advantageous. The aim of this study was to identify neural dynamics related to the ability to adapt to different cognitive control demands – a process that has been referred to as ‘metacontrol.’ A sample of N = 227 healthy subjects that was split in a ‘high’ and ‘low adaptability’ group based on the behavioral performance in a task (...) with varying control demands. To examine the neurophysiological mechanisms, we combined event-related potential (ERP) recordings with source localization and machine learning approaches. The results show that individuals who are better at strategically adapting to different cognitive control demands benefit from automatizing their response processes in situations where little cognitive control is needed. On a neurophysiological level, neither perceptual/attentional selection processes nor conflict monitoring processes paralleled the behavioral data, although the latter showed a descriptive trend. Behavioral differences in metacontrol abilities were only significantly mirrored by the modulation of response-locked P3 amplitudes, which were accompanied by activation differences in insula (BA13) and middle frontal gyrus (BA9). The machine learning result corroborated this by identifying a predictive/classification feature near the peak of the response-locked P3, which arose from the anterior cingulate cortex (BA24; BA33). In short, we found that metacontrol is associated to the ability to manage response selection processes, especially the ability to effectively downregulate cognitive control under low cognitive control requirements, rather than the ability to upregulate cognitive control. The article investigates Dostoevsky’s juridical discourse and demonstrates that the apologist of the Russian soul had a genuinely European mind. In his novel The Idiot in particular, in which the death penalty and imprisonment are explored, Dostoevsky unmasks—more radically even than Victor Hugo—the supposedly civilised and lenient forms of modern criminal justice. Dostoevsky’s criticism is ahead of its time; his arguments resemble those subsequently put forward by Foucault. A comparison with Anatoly Pristavkin’s report on post-Communist crime and jurisdiction underscores the (...) topicality of these reflections. (shrink)

This article offers a comprehensive and critical analysis of Eric Heinze’s book Hate Speech and Democratic Citizenship (Oxford University Press, 2016). Heinze’s project is to formulate and defend a more theoretically complex version of the idea (also defended by people like Ronald Dworkin and James Weinstein) that general legal prohibitions on hate speech in public discourse compromises the state’s democratic legitimacy. We offer a detailed synopsis of Heinze’s view, highlighting some of its distinctive qualities and strengths. We then develop a (...) critical response to this view with three main focal points: (1) the characterisation of democratic legitimacy as something distinct from (and whose demands aren’t identical with those of) legitimacy per se; (2) the claim that the requirements of democracy are hypothetical, rather than categorical, imperatives; and relatedly (3) the question of how we should reconcile the requirements of democratic legitimacy with the costs that may follow from prioritising democratic legitimacy. We argue that there are significant difficulties for Heinze’s account on all three fronts. (shrink)

In 1900, art historians André Jolles and Aby Warburg constructed an experimental dialogue in which Jolles supposed he had fallen in love with the figure of a young woman in a painting: “A fantastic figure—shall I call her a servant girl, or rather a classical nymph?…what is the meaning of it all?…Who is the nymph? Where does she come from?” Warburg’s response: “in essence she is an elemental spirit, a pagan goddess in exile,” serves as the touchstone for this wide-ranging (...) and theoretical exploration of female representation in iconography. In _Nymphs_, the newest translation of Italian philosopher Giorgio Agamben’s work, the author notes that academic research has lingered on the “pagan goddess,” while the concept of “elemental spirit,” ignored by scholars, is vital to the history of iconography. Tracing the genealogy of this idea, Agamben goes on to examine subjects as diverse as the aesthetic theories of choreographer Domineco da Piacenza, Friedrich Theodor Vischer’s essay on the “symbol,” Walter Benjamin’s concept of the dialectic image, and the bizarre discoveries of photographer Nathan Lerner in 1972. From these investigations, there emerges a startlingly original exploration of the ideas of time and the image. Of her two granddaughters, Grandma Yvette clearly prefers Ruby Taylor's perfect--and perfectly Jewish--cousin, Sarah. They do everything together, including bake cookies and have secret sleep overs that Ruby isn't invited to. Twelve-year-old Ruby suspects Grandma Yvette doesn't think she's Jewish enough. The Jewish religion is matrilineal, which means it's passed down from mother to child, and unlike Sarah, Ruby's mother isn't Jewish. But when Sarah starts acting out--trading in her skirts and cardigans for ripped jeans and stained t-shirts, getting in (...) trouble at school--Ruby can't help but be somewhat pleased. Then Sarah suddenly takes things too far, and Ruby is convinced Sarah is possessed by a dybbuk, an evil spirit... that Ruby may or may not have accidentally released from Grandma Yvette's basement. Ruby is determined to save her cousin, but a dybbuk can only be expelled by a "pious Jew." If Ruby isn't Jewish enough for her own grandmother, how can she possibly be Jewish enough to fight a dybbuk? (shrink)

The experience of pain appears to be associated, from early infancy and across pain stimuli, with a consistent facial expression in humans. A social function is proposed for this: the communication of pain and the need for help to observers, to whom information about danger is of value, and who may provide help within a kin or cooperative relationship. Some commentators have asserted that the evidence is insufficient to account for the consistency of the face, as judged by technical means (...) or in the perceptions of observers, or that facial expression is epiphenomenal to a gross behavioural defensive response to pain. The major criticism is that it is unnecessary to invoke evolutionary mechanisms beyond the emergence of an unconditioned facial response to pain in neonates, subsequently shaped and maintained by instrumental and social reinforcement throughout life. These criticisms are addressed, acknowledging the need for further data to address some, and elaborating the areas in which evolutionary and operant mechanisms would predict different behavioural interactions, rather than acting synergistically. Several supportive commentaries propose extending evolutionarily-based hypotheses to sex differences, the complexities of others' responses within the social relationship, and the role of empathy. A number of commentators provided valuable suggestions for experimental paradigms or methodological issues. Overall, addressing these issues indicates the need for further conceptual development and for collection of data specifically in relation to these hypotheses. (shrink)

Adolescence is an important developmental period marked by a transition from primarily parental-controlled eating to self-directed and peer-influenced eating. During this period, adolescents gain autonomy over their individual food choices and eating behavior in general. While parent-feeding practices have been shown to influence eating behaviors in children, little is known about how these relationships track across adolescent development as autonomy expands. The purpose of this qualitative study was to identify factors that impact food decisions and eating autonomy among adolescents. Using (...) the food choice process model as a guide, four focus groups were conducted with 34 adolescents. Focus group discussion was semi-structured, asking teens about influences on their food choices across different food environments, their involvement with food purchasing and preparation, and perceived control over food their choices. Focus group transcripts were analyzed using deductive and inductive code creation and thematic analysis. This study found six leading influences on adolescents' food choices and identified additional factors with prominence within specific environmental contexts. This study distinguished a broader spectrum of factors influencing adolescent food choice that extend beyond “convenience” and “taste” which have previously been identified as significant contributors. The degree of control that teens reported differed by eating location, occasion, and social context. Finally, adolescents demonstrated various levels of engagement in behaviors related to their eating autonomy. Identifying the emergent themes related to adolescent autonomy was the first step toward the goal of developing a scale to evaluate adolescent eating autonomy. (shrink)

Amanda Porterfield documents the claim that for Puritan men and women alike the ideals of selfhood were conveyed by female images. Constructed largely by men, Porterfield argues, these female images taught self-control, shaped pious ideals, and also established the standards against which the moral character of actual women was measured. Porterfield's work reflects a synthesis of literary critical and historical methods, combining analysis of Puritan theological writings with detailed examinations of historical records of changing patterns of church membership and (...) domestic life. This chapter considers potential applications of grounding to the formulation of physicalism. I begin with an overview of competing conceptions of the physical and of physicalism. I then consider whether grounding physicalism overcomes well-known and seemingly fatal problems with supervenience physicalism. I conclude that while grounding physicalism improves upon supervenience physicalism in certain respects, it arguably falls victim to some of the same difficulties.

It is often assumed that a commitment to scientific realism naturally, if not necessarily, accompanies a commitment to naturalizing metaphysics. If one denies that our scientific theories are approximately true, it would be unclear why one should index metaphysics to them. My aim is to show that the project of naturalizing metaphysics does not require realist assumptions. I will identify two success conditions for the project of disentangling naturalized metaphysics from realism: 1) the narrow success condition, which requires the antirealist (...) to explain why naturalized metaphysics is preferable to non-naturalized metaphysics, and 2) the broad success condition, which requires the antirealist to explain why naturalized metaphysics is preferable to metaphysical quietism. I believe that the antirealist can meet these conditions. Although I will not defend any definitive way of meeting them, I will explore argumentative avenues open to the antirealist. In particular, I will consider some conceptions of naturalized metaphysics, discuss their antirealist-compatible expected payoffs, and consider whether those payoffs enable the antirealist to meet the success conditions of the project. I will find that the antirealist has several argumentative avenues open to them. (shrink)

The growing proportion of elderly people in society, together with recent advances in robotics, makes the use of robots in elder care increasingly likely. We outline developments in the areas of robot applications for assisting the elderly and their carers, for monitoring their health and safety, and for providing them with companionship. Despite the possible benefits, we raise and discuss six main ethical concerns associated with: (1) the potential reduction in the amount of human contact; (2) an increase in the (...) feelings of objectification and loss of control; (3) a loss of privacy; (4) a loss of personal liberty; (5) deception and infantilisation; (6) the circumstances in which elderly people should be allowed to control robots. We conclude by balancing the care benefits against the ethical costs. If introduced with foresight and careful guidelines, robots and robotic technology could improve the lives of the elderly, reducing their dependence, and creating more opportunities for social interaction.
