From 1922 to 1924, the Iroquois Confederacy — a federal union of six aboriginal nations — sought resolution of a dispute between themselves and Canada at the League of Nations. In this paper, the historical events of the 1920s League are employed as a case study to explore the development of the international society of states in the early 20th century as it relates to the indigenous peoples of North America. Specifically, it will be argued that the early modern practice (...) of excluding Amerindians from international political forums is related to the negative representation of indigenous peoples in the dominant theoretical discourse of the time: social contract theory. The diplomatic activities of the Iroquois, and the members of the League during this time period, demonstrate exactly how social contract theory has relied on presenting indigenous peoples as residing in a non-political and non-sovereign form, thus denying them the right to participate at the international level on par with other peoples. This book presents a collection of contemporary discourses that reconsider the relationship of democracy as a political ideology and American ideal and education as the foundation of preparing democratic citizens in America.

This paper contributes to biodiversity and species extinction literature by examining the relationship between corporate accountability in terms of species protection and factors affecting such accountability from forward-thinking companies. We use triangulation of theories, namely deep ecology, legitimacy, and we introduce a new perspective to the stakeholder theory that considers species as a ‘stakeholder’. Using Poisson pseudo-maximum likelihood regression, we examine a sample of 200 Fortune Global companies over 3 years. Our results indicate significant positive relations between ecologically conscious companies (...) that are accountable for the protection of biodiversity and species extinction and external assurance, environmental performance, partnerships with socially responsible organizations and awards for sustainable activities. Our empirical results appear to be robust in controlling for possible endogeneities. Our findings contribute to the discussion on the concern of species loss and habitat destruction in the context of corporate accountability, especially in responding to the sixth mass extinction event and COVID-19 crisis. Our results can also guide the policymakers and stakeholders of the financial market in better decision making. (shrink)

In his Aesthetics, Dietrich von Hildebrand analyzes an interesting form of beauty adhering to audible and visible things that he calls second order beauty. In this paper, I will attempt to develop something which von Hildebrand recognizes, but which he himself does not fully develop: the religious significance of second order beauty. In particular, I wish to show that an aesthetic experience of this second order beauty can engender an encounter with God not in the “abstract,” but rather as a (...) concrete, individual, living person. The aim of this chapter is to address the role of memory in past-life convictions. Although it is commonly accepted in the modern media - and popular western culture more generally - that people believe they have lived before because the memory contains detailed verifiable facts, little is known about how people actually reason about the veracity of their previous existence. To our knowledge, the current project is the most extensive research that probes the role of memory in past life (...) convictions. More specifically, we explore two questions. First, to what extent does memory lead to past-life belief, and is this conviction based on external validation or via the episodic sense of personal identity contained in the memory? Second, what is the conception of self on which one's current self is taken to be the same as the past-life self? -/- In what follows, we propose that memory plays an important role in convincing people that they have lived before. Fundamentally, this memory is episodic insofar as it represents the event as happened to the encoder. This memory contrasts with semantic memory - memory of facts...Further, we contend that it is the episodic sense of personal identity (rather than external validation) that typically contributes to the belief in a past life. Finally, we argue that the conception of self implicated in past-life belief is the non-trait conception. Of course, this fits naturally with the idea that the belief in a past life issues partly from the episodic sense of identity, since it is the non-trait conception of self that is implicated in the episodic sense of identity... -/- Our proposal in this chapter can be construed as a psychological extension of Reid's point in the context of past-life belief. People assume that they are the same person as someone in earlier times, despite large variations in the traits between those individuals, and they think this partly because of the testimony of their episodic memory. If our account is correct, then it makes the belief in a past life less bizarre, at least psychologically. For we are suggesting that the episodic sense of personal identity that led to your conviction that you existed at the time of your sixteenth birthday celebrations some decades ago, is also involved in other people's convictions that they existed 200 years ago. This proposal is also situated in recent cognitive approaches to the study of religion and religious experiences, which suggests that extraordinary convictions are often underpinned by the ordinary processes of social cognition (e.g. see Barrett 2000; Barrett 2007; Boyer 2001; Lawson and McCauley 1990; for reincarnation, see White Forthcoming-a,-b). Debate concerning virtual reality is often drawn in terms of sharply defined dichotomies--for example, between "real" (or "actual") and "virtual," "authentic" and "inauthentic," and "natural" and "artificial." In this paper we offer an alternative approach by suggesting a conception of a virtual world that highlights a continuity and commonality with our sense of everyday reality. We accomplish this in part by an examination of the English picturesque garden as if it were a virtual world partially constructed out of ideas and (...) objects collected during travels to foreign lands on the Grand Tour. Such foreign travel transformed not only the English person's sense of self, but also altered the English landscape. We conclude that in one sense the "real" England is also a "virtual" reality. This paper proposes the ‘AGENCY model’ of conscious state attribution, according to which an entity's displaying certain relatively simple features (e.g. eyes, distinctive motions, interactive behavior) automatically triggers a disposition to attribute conscious states to that entity. To test the model's predictions, participants completed a speeded object/attribution task, in which they responded positively or negatively to attributions of mental properties (including conscious and non-conscious states) to different sorts of entities (insects, plants, artifacts, etc.). As predicted, participants responded positively to conscious (...) state attributions only for those entities that typically display the simple features identified in the AGENCY model (eyes, distinctive motion, interaction) and took longer to deny conscious states to those entities. Kelly Aguirre, Phil Henderson, Cressida J. Heyes, Alana Lentin, and Corey Snelgrove engage with different aspects of Robert Nichols’ Theft is Property! Dispossession and Critical Theory. Henderson focuses on possible spaces for maneuver, agency, contradiction, or failure in subject formation available to individuals and communities interpellated through diremptive processes. Heyes homes in on the ritual of antiwill called “consent” that systematically conceals the operation of power. Aguirre foregrounds tensions in projects of critical theory scholarship that aim for dialogue (...) and solidarity with Indigenous decolonial struggles. Lentin draws attention to the role of race in undergirding the logic of Anglo-settler colonial domination that operates through dispossession, while Snelgrove emphasizes the link between alienation, capital, and colonialism. In his reply to his interlocutors, Nichols clarifies aspects of his “recursive logics” of dispossession, a dispossession or theft through which the right to property is generated. (shrink)

The endoplasmic reticulum (ER) organelle is the key intracellular site of both protein and lipid biosynthesis. ER dysfunction, termed ER stress, can result in protein accretion within the ER and cell death; a pathophysiological process contributing to a range of metabolic diseases and cancers. ER stress leads to the activation of a protective signalling cascade termed the Unfolded Protein Response (UPR). However, chronic UPR activation can ultimately result in cellular apoptosis. Emerging evidence suggests that cells undergoing ER stress and UPR (...) activation can release extracellular signals that can propagate UPR activation to target tissues in a cell non‐autonomous signalling mechanism. Separately, studies have determined that the UPR plays a key regulatory role in the biosynthesis of bioactive signalling lipids including sphingolipids and ceramides. Here we weigh the evidence to combine these concepts and propose that during ER stress, UPR activation drives the biosynthesis of ceramide lipids, which are exported and function as cell non‐autonomous signals to propagate UPR activation in target cells and tissues. This paper describes the research carried out into small and medium enterprises (SMEs) and corporate responsibility (CR) in the Northwest of England during Phase I of Responsibility Northwest, a partnership programme designed to significantly increase the CR of the region. By engaging with significant numbers of SMEs and SME support providers across the region, key insights were gained in three key areas: • The current attitudes to, understanding of, and management of CR issues in the SME sector.• The barriers to (...) greater implementation of CR management.• The opportunities for overcoming the barriers and improving regional CR. The research revealed a large diversity both in terms of understanding of the issues and their management. Seven key barriers to improve CR performance were identified which centred round the inappropriateness and inaccessibility of current CR approaches and support services on CR, certain characteristics of SMEs which tend to reduce their interest and opportunities for engaging in CR activities and supply-chain barriers. Fortunately there was significant agreement on the mechanisms which should be used to overcome these barriers, in particular the importance of delivering CR support through existing business networks that are valued and trusted by SMEs. These results have been used to create the partnership programme, Responsibility Northwest Phase II that runs until 2008 and aims to significantly increase the overall CR of Northwest England. Martin Heidegger and Michel Foucault are two of the most important and influential thinkers of the twentieth century. Each has spawned volumes of secondary literature and sparked fierce, polarizing debates, particularly about the relationship between philosophy and politics. And yet, to date there exists almost no work that presents a systematic and comprehensive engagement of the two in relation to one another. _The World of Freedom_ addresses this lacuna. Neither apology nor polemic, the book demonstrates that it is not merely (...) interesting but necessary to read Heidegger and Foucault alongside one another if we are to properly understand the shape of twentieth-century Continental thought. Through close, scholarly engagement with primary texts, Robert Nichols develops original and demanding insights into the relationship between fundamental and historical ontology, modes of objectification and subjectification, and an ethopoetic conception of freedom. In the process, his book also reveals the role that Heidegger's reception in France played in Foucault's intellectual development—the first major work to do so while taking full advantage of the recent publication of Foucault's last Collège de France lectures of the 1980s, which mark a return to classical Greek and Roman philosophy, and thus to familiar Heideggerian loci of concern. Much more than an obligation to protect our clients' rights, ethics is better understood as the very fabric that underpins and supports our most basic efforts in working with clients and interacting with others in our everyday lives. Robert Lee brings together a diverse group of voices in the Gestalt field to demonstrate the interrelations between the ethics of the therapeutic endeavor and the Gestalt tradition, from theory to practice to extensions beyond the analytic setting.

This article offers a preliminary critical-historical reconstruction of the concept of dispossession. Part I examines its role in eighteenth- and nineteenth- century struggles against European feudal land tenure. Drawing upon Marx’s critique of French anarchism in particular, I identify a persistent limitation at the heart of the concept. Since dispossession presupposes prior possession, recourse to it appears conservative and tends to reinforce the very proprietary and commoditized models of social relations that radical critics generally seek to undermine. Part II turns (...) to use of the term in Indigenous struggles against colonization, both in order to better grasp the stakes of the above problematic and suggest a way beyond it. Through a reconstruction of arguments by Indigenous scholars and activists, I seek to show the coherence and novelty of their formulation by suggesting that dispossession has come to name a unique historical process, one in which property is generated under conditions that require divestment and alienation from those who appear, only retroactively, as its original owners. In this way, theft and property are related in a recursive, rather than strictly unilinear, manner. Part III provides a specific historical example in the form of nineteenth-century US property law concerning squatters and homesteaders. (shrink)

This article examines the application of social contract theorizing to questions pertaining to the rights of indigenous peoples today, with particular reference to recent work by Jeremy Waldron. It is argued that such theorizing must be examined with reference not only to the content of its claims, but also with respect to its general mode of argumentation and its political function in specific contexts. Read in this light, social contract theory may function to unduly deny the claims of indigenous peoples, (...) oftentimes by shifting the register of debate to a relatively abstract and counter-factual level and relieving settler-colonial societies of the burden of proof. The role of epistemology in philosophy of religion has transformed the discipline by diverting questions away from traditional metaphysical issues and toward concerns about justification and warrant. Leaders responsible for these changes, including Plantinga, Alston and Draper, use methods and arguments fromScottish Enlightenment figures. In general theists use and cite techniques pioneered by Reid and non-theists use and cite techniques pioneered by Hume, a split reduplicated among cognitive scientists of religion, with Justin Barrett and Scott Atran respectively framing their results (...) in Reid’s and in Hume’s language and argument. This state of affairs sets our agenda. First we identify Reid’s use in the epistemology of religion and in the cognitive science of religion. Then we turn to Reid’s texts in an effort to assess the interpretations and extrapolations of Reid given by participants in these debates. The answers to our research questions shed light on what Reid would believe today, were he apprised of the latest research in epistemology of and cognitive science of religion. (shrink)

The Editor THE LOGIC OF OUR LANGUAGE ROBERT L. ARRINGTON Wittgenstein wrote in the Tractatus that "logic is not a body of doctrine, but a mirror-image of the world. " 1 In (...) line with his suggestion that a proposition is a 'picture', Wittgenstein argued that propositions 'show' the logical structure of the real. He was insistent, however, that "the apparent logical form of a proposition need not be its real one. " 2 As a result of this we can misunderstand the structure of fact. Philosophical problems arise just when "the logic of our language is mis understood. " 3 It is common knowledge that much of this view of logic was rejected by Wittgenstein himself in the Philosophical Investi gations. There we are told that language has no ideal or sublime 4 logic which mirrors the structure of the extra-linguistic world. Consequently, inferences from the structure of language to the structure of that extra-linguistic world are invalid. Reality can be 'cut up' in any of a number of ways by language. Wittgenstein adopted a view of philosophy which would render that discipline a non-explanatory, non-critical study of the multiple ways in which language can be used. (shrink)

We argue that all human beings have a special type of dignity which is the basis for (1) the obligation all of us have not to kill them, (2) the obligation to take their well-being into account when we act, and (3) even the obligation to treat them as we would have them treat us, and indeed, that all human beings are equal in fundamental dignity. We give reasons to oppose the position that only some human beings, because of their (...) possession of certain characteristics in addition to their humanity (for example, an immediately exercisable capacity for self-consciousness, or for rational deliberation), have full moral worth. What distinguishes human beings from other animals, what makes human beings persons rather than things, is their rational nature, and human beings are rational creatures by virtue of possessing natural capacities for conceptual thought, deliberation, and free choice, that is, the natural capacity to shape their own lives. This essay attends to the specificity of indigenous peoples’ political critique of state power and territorialized sovereignty in the North American context as an indispensible resource for realizing the decolonizing potential latent within the field of critical prison studies. I argue that although the incarceration of indigenous peoples is closely related to the experience of other racialized populations with regard to its causes, it is importantly distinct with respect to the normative foundation of its critique. Indigenous sovereignty calls forth an (...) alternative normativity that challenges the very existence of the carceral system, let alone its racialized organization and operation. (shrink)

In various places we have defended the position that a new human organism, that is, an individual member of the human species, comes to be at fertilization, the union of the spermatozoon and the oocyte. This individual organism, during the ordinary course of embryological development, remains the same individual and does not undergo any further substantial change, unless monozygotic twinning, or some form of chimerism occurs. Recently, in this Journal Jason Morris has challenged our position, claiming that recent findings in (...) reproductive and stem cell biology have falsified our view. He objects to our claim that a discernible substantial change occurs at conception, giving rise to the existence of a new individual of the human species. In addition, he objects to our claim that the embryo is an individual, a unified whole that persists through various changes, and thus something other than a mere aggregate of cells. Morris raises a number of objections to these claims. However, we will show that his arguments overlook key data and confuse biological, metaphysical, and ethical questions. As a result, his attempts to rebut our arguments fail. (shrink)
