Although there is an increasing body of opinion that awards of damages for breach of contract should take account of the claimant’s performance interest, there has been little in the way of analysis of what the performance interest is. Commonly the concept is put forward as simply a reformulation or reconceptualization of the expectation interest, itself hitherto regarded as the one true contractual interest. Such thinking is flawed. A closer analysis of contract doctrine shows there to be two distinct contractual (...) interests; in receiving performance, and in being compensated for losses caused by non-performance. Receiving compensatory damages for non-performance is not the same as receiving performance. At present, this important difference is not fully appreciated, resulting in a failure to develop a principled approach to the claims that can be made following a breach of contract. Recognition of this distinction forces us to confront the fundamental question of how committed we are to the notion that contracts entail a right to performance. This article examines the distinction between these two interests, how the performance interest may be given effect by a damages award, and what the consequences of this analysis are for our understanding of the nature of contractual obligation. This exploratory study investigates the divergent ways that people make sense of their own charisma. Through in-depth, semi-structured qualitative interviews with people who self-identified as charismatic (_n_ = 11), findings reveal that self-identified charismatic people hold divergent views regarding (1) who they believe benefits from their charisma (self or others), (2) how they believe they came to be charismatic (developed or innate), (3) how they experience self-confidence (self-conscious or self-assured), and (4) how they manage rejection (preparation or resilience). Taken together, (...) these divergent views reflect at least two charisma profiles—what we term _opportunistic charisma_ (i.e., charisma employed for personal gain) and _humanistic charisma_ (i.e., charisma employed to empower others)—with implications for humanistic management theory and practice. Recent evidence on intertemporal choice suggests that decision-makers may exhibit both increasing and decreasing impatience simultaneously, called inverse-S discounting. This paper introduces trichotomic discounted utility to model inverse-S discounting. Under trichotomic discounted utility the decision-maker distinguishes between short-term delays, medium-term delays, and long-term delays. Exponential discounting holds within each category, but not necessarily across each category. We provide preference foundations for trichotomic discounted utility in the timed outcomes framework and in the consumption streams framework. The key axiom is a weakening (...) of the time consistency axiom that allows for both increasing and decreasing impatience. We also consider a weak, local version of time consistency, and show that this plausible condition is satisfied only by discount functions with exponential “pieces”. (shrink)

Through a discussion of the work of Marie Cardinal and Annie Ernaux, this article aims to problematize the anglophone academic world's tendency to associate French feminisms predominantly with avant-garde or highly theoretical texts. The work of Ernaux and Cardinal is presented alongside a discussion of its reception by readers and critics in France, and by academics in English-speaking countries. The first part of the article identifies aspects of Ernaux's and Cardinal's works which cannot be encompassed within a critical framework based (...) on the dichotomy between naïve realism on the one hand and the politically and linguistically radical text on the other. Ernaux's plain language, for instance, is clearly very unlike the linguistic experimentation of ‘feminine writing’; nonetheless the emphasis on social class in her writing constitutes a political intervention which is at least equally valid. The reception study in the second part of the article provides further evidence of the relevance to gender politics in France of Cardinal's The Words to Say It (1975) and texts published by Annie Ernaux in the 1980s and 1990s. The ambivalent response of critics seems to indicate the troubling nature of writing which combines the codes of realism and autobiography (or autobiographical fiction in Cardinal's case) with the depiction of taboo subjects such as menstruation, or a daughter's response to her mother's debilitating illness and death. The article also charts the widespread popularity of these texts in France, particularly with women readers, and gives some examples of the pleasures described in letters to the authors. In conclusion, we argue that the ambivalent space between popular and high culture occupied (albeit differently) by Ernaux and Cardinal may be particularly effective in terms of gender politics, and that even in the late 1990s, the personal may be as political as ever. What is a veteran teacher, and how do veteran teachers contribute to schools and education? This international volume contributes to our understanding of veteran teachers with new conceptual studies and empirical research from different countries around the world. It is explores what we mean by a ‘veteran teacher’; the factors that encourage teachers to remain in the profession; the characteristics of a successful veteran teacher; and the values with which veteran teachers associate themselves. Rather than supporting stereotypes about teachers at (...) different stages in their professional lives, this book both scrutinises prevalent stereotypes and explores the great variety of veteranship in teaching, in different cultures and different subject matter domains. Teacher retention is an increasingly difficult issue and there are severe problems of high staff turnover and attrition in many countries - so recognition of the qualities of more experienced teachers is timely, as well as valuing the potential contributions of veteran teachers in schools. The book also addresses broader issues about teachers’ lives and identities, the vulnerability of different groups of teachers to the effects of change and reform, and the various forms of teacher knowledge and teacher development.
