Recent stories of corporate insiders avoiding losses and, in some cases, generating enormous personal profits as their companies crumbled have led investors to question the integrity of American business and the fairness of the United States stock markets. The SEC tries to ensure the fairness of the stock markets by making and enforcing laws against unfair practices such as insider trading. In the United States, when insiders trade stock based on non-public information, they have broken the law and betrayed the (...) trust that has been placed in them.This study used student subjects to test the relationship between the likelihood of trading based on insider information and subjective probabilities of deterrents and motivations for insider trading. Expected gain, guilt, cynicism, and fairness of laws were the determinants that had a significant relationship with the intent to trade based on insider information. This study also found support for prospect theory with regard to insider trading. The results indicate that subjects are more likely to trade based on insider information to avoid a loss than to achieve an abnormal gain. The study also finds evidence of social desirability response bias. (shrink)

_Presenting Dewey’s new view of philosophical inquiry_ This critical edition of _The Influence of Darwin on Philosophy and Other Essays in Contemporary Thought _presents the results of John Dewey’s patient construction, throughout the previous sixteen years, of the radically new view of the methods and concerns of philosophical inquiry. It was a view that he continued to defend for the rest of his life. In the 1910 _The Influence of Darwin on Philosophy and Other Essays in Contemporary Thought_—the first collection (...) of Dewey’s previously published, edited essays—John Dewey provided readers with an overview of the scope and direction of his philosophical vision in one volume. The order in which the eleven essays were presented was a reverse chronology, with more recently published essays appearing first. The collection of eleven essays offered a detailed portrait of Dewey’s proposed reconstruction of the traditional concepts of knowledge and truth. It furthermore elaborated on how his new logic and his proposal regarding knowledge and truth fit comfortably together, not only with each other but also with a pragmatically proper understanding of belief, reality, and experience. Because material in the _Collected Works of John Dewey, 1882–1953_ was published chronologically, however, the essays published together in the 1910 Darwin book have appeared in seven different volumes in the _Collected Works_. This new, critical edition restores a classic collection of essays authored and edited by John Dewey as they originally appeared in the volume. The edition is presented with ancillary materials, including responses by Dewey’s critics and an introduction by Douglas Browning. (shrink)

Abstract. For the past two decades, I have been developing an integrative Christian marriage theory, based in part on a grounding concept of natural law and an overarching theory of covenant. The natural law part of this theory starts with an account of the natural facts, conditions, interests, needs, and qualities of human life, interaction, and generation—what I call the “premoral” goods or realities of life. It then identifies the natural inclinations of humans to form enduring and exclusive monogamous marriages (...) and to preserve these units as the central site for intimacy, procreation, and nurture of children. In this paper, I first summarize this natural law theory of marriage and then compare it to the formulations of other modern Christian thinkers. I also defend this theory against various modern critics of natural law—in part by reinterpreting some traditional natural law teachings that in my view have been misunderstood, in part by looking at the interesting convergences between the insights into sex, marriage, and family life offered by contemporary Christian theological ethicists and by evolutionary biologists and biological anthropologists. Recent summaries of psychologist James H. Leuba's pioneering studies on the religious beliefs of American scientists have misrepresented his findings and ignored important aspects of his analyses, including predictions regarding the future of religion. Much of the recent interest in Leuba was sparked by Edward J. Larson and Larry Witham's commentary in Nature , “Scientists Are Still Keeping the Faith.” Larson and Witham compared the results of their 1996 survey of one thousand randomly selected American scientists regarding their religious (...) beliefs with a similar survey published eighty years earlier by Leuba. Leuba's original studies are themselves problematical. Nonetheless, his notion that different fields of science have different impacts on the religion‐science relationship remains valid. Especially significant is his appreciation of religion as a dynamic, compelling force in human life: any waning of traditional beliefs does not mean a decrease in religious commitment but calls for a new spirituality in harmony with modern scientific teachings. Leuba's studies, placed in proper context, offer a broad historical perspective from which to interpret data about religious beliefs of scientists and the impact of science and scientists on public beliefs, and opportunity to develop new insight into the religion‐science relationship. ‘Sentience’ sometimes refers to the capacity for any type of subjective experience, and sometimes to the capacity to have subjective experiences with a positive or negative valence, such as pain or pleasure. We review recent controversies regarding sentience in fish and invertebrates and consider the deep methodological challenge posed by these cases. We then present two ways of responding to the challenge. In a policy-making context, precautionary thinking can help us treat animals appropriately despite continuing uncertainty about their sentience. In (...) a scientific context, we can draw inspiration from the science of human consciousness to disentangle conscious and unconscious perception (especially vision) in animals. This paper addresses what we consider to be the most pressing challenge for the emerging science of consciousness: the measurement problem of consciousness. That is, by what methods can we determine the presence of and properties of consciousness? Most methods are currently developed through evaluation of the presence of consciousness in humans and here we argue that there are particular problems in application of these methods to nonhuman cases—what we call the indicator validity problem and the extrapolation problem. The first (...) is a problem with the application of indicators developed using the differences between conscious and unconscious processing in humans to the identification of other conscious vs. nonconscious organisms or systems. The second is a problem in extrapolating any indicators developed in humans or other organisms to artificial systems. However, while pressing ethical concerns add urgency to the attribution of consciousness and its attendant moral status to nonhuman animals and intelligent machines, we cannot wait for certainty and we advocate the use of a precautionary principle to avoid causing unintentional harm. We also intend that the considerations and limitations discussed in this paper can be used to further analyze and refine the methods of consciousness science with the hope that one day we may be able to solve the measurement problem of consciousness. One of the primary concerns in animal research is ensuring the welfare of laboratory animals. Modern views on animal welfare emphasize the role of animal sentience, i.e. the capacity to experience subjective states such as pleasure or suffering, as a central component of welfare. The increasing official recognition of animal sentience has had large effects on laboratory animal research. The Cambridge Declaration on Consciousness (Low et al., University of Cambridge, 2012) marked an official scientific recognition of the presence of sentience (...) in mammals, birds, and cephalopods. Animal sentience has furthermore been recognized in legislation in the European Union, UK, New Zealand and parts of Australia, with discussions underway in other parts of the world to follow suit. In this paper, we analyze this shift towards recognition of sentience in the regulation and practice in the treatment of laboratory animals and its effects on animal welfare and use. (shrink)

In this essay, we discuss Simona Ginsburg and Eva Jablonka’s The Evolution of the Sensitive Soul from an interdisciplinary perspective. Constituting perhaps the longest treatise on the evolution of consciousness, Ginsburg and Jablonka unite their expertise in neuroscience and biology to develop a beautifully Darwinian account of the dawning of subjective experience. Though it would be impossible to cover all its content in a short book review, here we provide a critical evaluation of their two key ideas—the role of Unlimited (...) Associative Learning in the evolution of, and detection of, consciousness and a metaphysical claim about consciousness as a mode of being—in a manner that will hopefully overcome some of the initial resistance of potential readers to tackle a book of this length. Exploring not only the still famous theories of Plato and Aristotle, this work also touches on techniques in education which are either no longer prevalent – Roman Oratory, the Jesuits – or in some cases were never widely adopted or appreciated: John Milton, for example. Animal welfare is a concept that plays a role within both our moral deliberations and the relevant areas of science. The study of animal welfare has impacts on decisions made by legislators, producers and consumers with regards to housing and treatment of animals. Our ethical deliberations in these domains need to consider our impact on animals, and the study of animal welfare provides the information that allows us to make informed decisions. This thesis focusses on taking a philosophical perspective to (...) answer the question of how we can measure the welfare of animals. Animal welfare science is an applied area of biology, aimed at measuring animal welfare. Although philosophy of animal ethics is common, philosophy focussing on animal welfare science is rare. Despite this lack, there are definitely many ways in which philosophical methods can be used to analyse the methodologies and concepts used in this science. One of the aims of the work in this thesis is to remedy this lack of attention in animal welfare. Animal welfare science is a strong emerging discipline, but there is the need for conceptual and methodological clarity and sophistication in this science if it is to play the relevant informative role for our practical and ethical decision-making. There is thus is a strong role here for philosophical analysis for this purpose. The central aim of this thesis is to provide an account of how we can measure subjective animal welfare, addressing some of the potential problems that may arise in this particular scientific endeavour. The two questions I will be answering are: what is animal welfare, and how do we measure it? Part One of the thesis looks at the subjective concept of animal welfare and its applications. In it, I argue for a subjective welfare view - that animal welfare should be understood as the subjective experience of individuals over their lifetimes - and look at how the subjective welfare concept informs our ethical decision-making in two different cases in applied animal ethics. Part Two of the thesis looks more closely at the scientific role of welfare. Understanding welfare subjectively creates unique measurement problems, due to the necessarily private nature of mental states and here I address a few of these problems, including whether subjective experience is measurable, how we might validate indicators of hidden target variables such as welfare, how we can make welfare comparisons between individual animals and how we might compare or integrate the different types of experience that make up welfare. I end with a discussion of the implications of all these problems and solutions for the practice of welfare science, and indicate useful future directions for research. (shrink)

The performance of natural behavior is commonly used as a criterion in the determination of animal welfare. This is still true, despite many authors having demonstrated that it is not a necessary component of welfare –some natural behaviors may decrease welfare, while some unnatural behaviors increase it. Here I analyze why this idea persists, and what effects it may have. I argue that the disagreement underlying this debate on natural behavior is not one about which conditions affect welfare, but a (...) deeper conceptual disagreement about what the state of welfare actually consists of. Those advocating natural behavior typically take a “teleological” view of welfare, in which naturalness is fundamental to welfare, while opponents to the criterion usually take a “subjective” welfare concept, in which welfare consists of the subjective experience of life by the animal. I argue that as natural functioning is neither necessary nor sufficient for understanding welfare, we should move away from the natural behavior criterion to an alternative such as behavioral preferences or enjoyment. This will have effects in the way we understand and measure welfare, and particularly in how we provide for the welfare of animals in a captive setting. (shrink)

The keeping of captive animals in zoos and aquariums has long been controversial. Many take freedom to be a crucial part of animal welfare and, on these grounds, criticise all forms of animal captivity as harmful to animal welfare, regardless of their provisions. Here, we analyse what it might mean for freedom to matter to welfare, distinguishing between the role of freedom as an intrinsic good, valued for its own sake and an instrumental good, its value arising from the increased (...) ability to provide other important resources. Too often, this debate is conducted through trading intuitions about what matters for animals. We argue for the need for the collection of comparative welfare data about wild and captive animals in order to settle the issue. Discovering more about the links between freedom and animal welfare will then allow for more empirically informed ethical decisions regarding captive animals. (shrink)

One of the biggest problems in applications of animal welfare science is our ability to make comparisons between different individuals, both within and across species. Although welfare science provides methods for measuring the welfare of individual animals, there’s no established method for comparing measures between individuals. In this paper I diagnose this problem as one of underdetermination—there are multiple conclusions given the data, arising from two sources of variation that we cannot distinguish: variation in the underlying target variable (welfare experience) (...) and in the relationship of measured indicators to the target. I then describe some of the possible methods of making comparisons, based on the use of similarity assumptions that will have greater or lesser justification in different circumstances, and the alternative methods we may use when direct comparisons are not possible. In the end, all our available options for making welfare comparisons are imperfect, and we need to make explicit context-specific decisions about which will be best for the task at hand while acknowledging their potential limitations. Future developments in our understanding of the biology of sentience will help strengthen our methods of making comparisons. (shrink)

This paper tells the story of consciousness from each of the three 'person' perspectives of the English language, with the author arguing for the equally fundamental social and personal bases of human consciousness. The 'lived' second-person position of ecological psychology is the starting point for the organic, yet socially embedded, consciousness of the non-symbolic human infant. First- and third-person positions are 'reflective' sociohistorical perspectives enabled by the development of symbolic functioning. The paper presents Llinás's compelling evolutionary account but supplements this (...) third-person narrative to do justice to the profound transformation of conscious experience in the human species. Prefacing its account of consciousness from a first-person perspective, the paper argues for a developmental model that privileges both the organic and the sociohistorical bases of consciousness. Our introspections may not tease apart these influences, but they must be acknowledged as we consider what Gelernter refers to as the 'tides of our minds'. (shrink)

Hardt and Negri interpret contemporary sovereignty and politics in the light of a theory of contemporary globalization that is taken to supersede Marxism and former ideological standpoints of the Left. In particular, Hardt and Negri highlight how their reading of empire and multitude breaks with the teleology of Marxism and accepts the openness of events. They advertise the novelty, which is held to consist in their recognition of a thoroughly socialized and globalized world in which there exists no predetermined historical (...) subject of liberation. Hardt and Negri, however, exemplify the continuity between Marxist and post?Marxist ideological standpoints. The continuity between classical Marxism and Hardt and Negri's notion of empire and its supersession resides in the affinity between the normative values that shape Marx's reading of history and the emancipatory character of the multitude, which frames the notion of empire. Hardt and Negri offer a radical Leftist reading of globalization that contrasts with alternative ideological notions that inform more orthodox interpretations of globalization, and thereby points to the ideological character of theories of globalization. Mikhalevich & Powell (2020) argue that it is wrong, both scientifically and morally, to dismiss the evidence for sentience in invertebrates. They do not offer any examples, however, of how their welfare should be considered or improved. We draw on animal welfare science to suggest some ways that would not be excessively demanding.

Close attention to Kant’s comments on animal minds has resulted in radically different readings of key passages in Kant. A major disputed text for understanding Kant on animals is his criticism of G. F. Meier’s view in the 1762 ‘False Subtlety of the Four Syllogistic Figures’. In this article, I argue that Kant’s criticism of Meier should be read as an intervention into an ongoing debate between Meier and H. S. Reimarus on animal minds. Specifically, while broadly aligning himself with (...) Reimarus, Kant distinguishes himself from both Meier and Reimarus on the role of judgement in human consciousness. (shrink)

This discussion follows a series of high profile cases involving a terminally ill child, Charlie Gard. These cases are significant as they trace the complexities that arise when parents and medical teams do not agree as well as addressing the question of whether there is a right to access experimental treatment.

Birch’s criterion for the precautionary principle imposes a high evidential standard that many cases will fail to meet. Reliable, relevant anecdotal evidence suggestive of animal sentience should also fall within the scope of the precautionary principle. This would minimize potential suffering (as happened in the case of cephalopods) while further evidence is gathered.

Internet recruitment methods for research are rapidly evolving as technology and participant preferences do as well. This brings data security concerns, balanced with respect to persons for research participants. Internet recruitment research strategies are still important given the importance of creating private and accessible pathways for potentially marginalized populations or people experiencing stigmatized mental health conditions to participate in research. This manuscript describes the case of social media recruitment for a mental health and racism study in Fall 2022 that was (...) infiltrated by bots. We contextualize it in the context of data quality literature, with considerations for future directions including strategies for study design and management, and further research questions. One of the biggest ethical issues in animal agriculture is that of the welfare of animals at the end of their lives, during the process of slaughter. Much work in animal welfare science is focussed on finding humane ways to transport and slaughter animals, to minimise the harm done during this process. In this paper, we take a philosophical look at what it means to perform slaughter humanely, beyond simply reducing pain and suffering during the slaughter process. In particular, we (...) will examine the issue of the harms of deprivation inflicted in ending life prematurely, as well as shape of life concerns and the ethical implications of inflicting these harms at the end of life, without the potential for future offsetting through positive experiences. We will argue that though these considerations may mean that no slaughter is in a deep sense truly ‘humane’, this should not undermine the importance of further research and development to ensure that while the practice continues, animal welfare harms are minimised as far as possible. The study of introspection has, up until now, been predominantly human-centric, with regrettably little attention devoted to the question of whether introspection might exist in non-humans, such as animals and artificial intelligence (AI), and what distinct forms it might take. In their target article, Kammerer and Frankish (this issue) aim to address this oversight by offering a non-anthropocentric framework for understanding introspection that could be used to address these questions. However, their discussions on introspection in animals and AIs were quite (...) brief. In this commentary, we will build on their suggestions to offer some methodological guidance for how future research into introspection in animals and AIs might proceed. (shrink)

Jurgen Habermas is by far the most preeminent and influential philosopher in Germany today. The scope of his writings is remarkable. Their influence extends over a wide range of disciplines that include philosophy, social theory, hermeneutics, anthropology, linguistics, ethics, educational theory, and public policy. The impact of Habermas's writings on theology alone reaches from fundamental to political theology, from moral to practical theology. The significance of Habermas, Modernity, and Public Theology is twofold. First, it represents a genuine dialogue, an actual (...) conversation, between Habermas and theologians. While theologians have appealed to Habermas's work in innumerable articles and monographs, he himself until now has remained silent. This book, then, is unique insofar as it offers the true give and take of dialogue. Second, this book focuses on Habermas's most recent work, especially his interpretation of modernity, his theory of communicative action, and his development of a discourse ethics. In so doing, it corrects some of the prevalent misreadings of Habermas within the theological literature devoted to him. In examining the relation between critical theory and a public and practical theology, the contributors note both the promise and limitations of Habermas's basic arguments and insights. They challenge Habermas as much as they learn from him. Sharing the conviction that religious traditions contain sources for interpreting human nature and society, they argue that if Habermas would attend more to the role of religion within life and society, he would more fully realize his project for a communicative rationality under the conditions of modernity and would offer amore comprehensive understanding of rationality, society, and modernity. Taking his own turn at the end of the book, Habermas responds to each of the contributors, comments on the broader theological reception of his work, and offers his own fascinating views on the function and development of religion in modernity and on the status and claim to truth of theological discourse. The work concludes with an extremely useful annotated bibliography covering Habermas's own writings, general introductions to Habermas and to critical theory, and works devoted to specific aspects of Habermas's thought. Rethinking R.G. Collingwood reviews Collingwood's thought via his own rethinking of Hegel. It establishes the revisionary character of Collingwood's defence of liberal civilization in theory and practice. Collingwood is seen as avoiding the pitfalls of Hegel's teleological historicism by developing an open and contestable reading of the rationality of liberal civilization, which neither reduces practice to theory nor philosophy to history. The contemporary relevance of Collingwood's standpoint is demonstrated by comparing it with those of recent defenders and critics of liberalism (...) Rawls, Lyotard and MacIntyre. (shrink)

Recent artificial intelligence advances, especially those of large language models (LLMs), have increasingly shown glimpses of human-like intelligence. This has led to bold claims that these systems are no longer a mere “it” but now a “who,” a kind of person deserving respect. In this paper, I argue that this view depends on a Cartesian account of personhood, on which identifying someone as a person is based on their cognitive sophistication and ability to address common-sense reasoning problems. I contrast this (...) with a different account of personhood, one where an agent is a person if they are autonomous, responsive to norms, and culpable for their actions. On this latter account, I show that LLMs are not person-like, as evidenced by their propensity for dishonesty, inconsistency, and offensiveness. Moreover, I argue current LLMs, given the way they are designed and trained, cannot be persons—either social or Cartesian. The upshot is that contemporary LLMs are not, and never will be, persons. In this challenging study in metaphilosophy, Douglas Browning makes a case for viewing ontology as a legitimate and viable philosophical pursuit. Beginning with a sustained analysis of the process of attempting to construct a system that is true of the whole of reality, he proceeds to focus upon the issues of the need for and availability of controls upon speculative construction. He concludes by arguing for the importance of one such speculative control, namely, an appeal to the structural traits (...) of the practical stratum of our lives. In the course of his discussion Browning also develops original theories of stances, appearing, and the general structure of theoretical investigation. The book is divided into two parts. The first is devoted to consideration of the overall shape of the ontological enterprise as a process of moving from the pole of initial ontological questioning toward the pole of the provision of an acceptable system. While each of these two poles is discussed in turn in some detail, it is the mediating process of inquiry and construction, of "doing" ontology, to which Browning devotes most of his attention. His examination of this process reveals serious difficulties, one of which, he argues, provides the most serious threat to the acceptability of ontology as a viable project. This difficulty centers on the issue of discovering a manner of access to reality that is sufficiently favored over the others to provide a cue for the constructive imagination. In the second part, Browning proposes a way of overcoming this difficulty. After presenting a general argument for the primacy of the practical stance in our lives, he makes and defends a number of proposals regarding the general structure of the arena of acting that this stance discloses. The book ends by showing the extent to which an appeal to this structure would ensure, not the success, but the viability of ontological investigation. (shrink)
