Recent stories of corporate insiders avoiding losses and, in some cases, generating enormous personal profits as their companies crumbled have led investors to question the integrity of American business and the fairness of the United States stock markets. The SEC tries to ensure the fairness of the stock markets by making and enforcing laws against unfair practices such as insider trading. In the United States, when insiders trade stock based on non-public information, they have broken the law and betrayed the (...) trust that has been placed in them.This study used student subjects to test the relationship between the likelihood of trading based on insider information and subjective probabilities of deterrents and motivations for insider trading. Expected gain, guilt, cynicism, and fairness of laws were the determinants that had a significant relationship with the intent to trade based on insider information. This study also found support for prospect theory with regard to insider trading. The results indicate that subjects are more likely to trade based on insider information to avoid a loss than to achieve an abnormal gain. The study also finds evidence of social desirability response bias. (shrink)

_Presenting Dewey’s new view of philosophical inquiry_ This critical edition of _The Influence of Darwin on Philosophy and Other Essays in Contemporary Thought _presents the results of John Dewey’s patient construction, throughout the previous sixteen years, of the radically new view of the methods and concerns of philosophical inquiry. It was a view that he continued to defend for the rest of his life. In the 1910 _The Influence of Darwin on Philosophy and Other Essays in Contemporary Thought_—the first collection (...) of Dewey’s previously published, edited essays—John Dewey provided readers with an overview of the scope and direction of his philosophical vision in one volume. The order in which the eleven essays were presented was a reverse chronology, with more recently published essays appearing first. The collection of eleven essays offered a detailed portrait of Dewey’s proposed reconstruction of the traditional concepts of knowledge and truth. It furthermore elaborated on how his new logic and his proposal regarding knowledge and truth fit comfortably together, not only with each other but also with a pragmatically proper understanding of belief, reality, and experience. Because material in the _Collected Works of John Dewey, 1882–1953_ was published chronologically, however, the essays published together in the 1910 Darwin book have appeared in seven different volumes in the _Collected Works_. This new, critical edition restores a classic collection of essays authored and edited by John Dewey as they originally appeared in the volume. The edition is presented with ancillary materials, including responses by Dewey’s critics and an introduction by Douglas Browning. (shrink)

Recent summaries of psychologist James H. Leuba's pioneering studies on the religious beliefs of American scientists have misrepresented his findings and ignored important aspects of his analyses, including predictions regarding the future of religion. Much of the recent interest in Leuba was sparked by Edward J. Larson and Larry Witham's commentary in Nature , “Scientists Are Still Keeping the Faith.” Larson and Witham compared the results of their 1996 survey of one thousand randomly selected American scientists regarding their religious (...) beliefs with a similar survey published eighty years earlier by Leuba. Leuba's original studies are themselves problematical. Nonetheless, his notion that different fields of science have different impacts on the religion‐science relationship remains valid. Especially significant is his appreciation of religion as a dynamic, compelling force in human life: any waning of traditional beliefs does not mean a decrease in religious commitment but calls for a new spirituality in harmony with modern scientific teachings. Leuba's studies, placed in proper context, offer a broad historical perspective from which to interpret data about religious beliefs of scientists and the impact of science and scientists on public beliefs, and opportunity to develop new insight into the religion‐science relationship. Abstract. For the past two decades, I have been developing an integrative Christian marriage theory, based in part on a grounding concept of natural law and an overarching theory of covenant. The natural law part of this theory starts with an account of the natural facts, conditions, interests, needs, and qualities of human life, interaction, and generation—what I call the “premoral” goods or realities of life. It then identifies the natural inclinations of humans to form enduring and exclusive monogamous marriages (...) and to preserve these units as the central site for intimacy, procreation, and nurture of children. In this paper, I first summarize this natural law theory of marriage and then compare it to the formulations of other modern Christian thinkers. I also defend this theory against various modern critics of natural law—in part by reinterpreting some traditional natural law teachings that in my view have been misunderstood, in part by looking at the interesting convergences between the insights into sex, marriage, and family life offered by contemporary Christian theological ethicists and by evolutionary biologists and biological anthropologists. This book consists of a collection of essays written between 1965 and 1981. Some have been published elsewhere; others appear here for the first time. Although dealing with different figures and different periods, they have a common theme: all are concerned with examining how the method of hy pothesis came to be the ruling orthodoxy in the philosophy of science and the quasi-official methodology of the scientific community. It might have been otherwise. Barely three centuries ago, hypothetico deduction was in (...) both disfavor and disarray. Numerous rival methods for scientific inquiry - including eliminative and enumerative induction, analogy and derivation from first principles - were widely touted. The method of hypothesis, known since antiquity, found few proponents between 1700 and 1850. During the last century, of course, that ordering has been inverted and - despite an almost universal acknowledgement of its weaknesses - the method of hypothesis (usually under such descriptions as 'hypothetico deduction' or 'conjectures and refutations') has become the orthodoxy of the 20th century. Behind the waxing and waning of the method of hypothesis, embedded within the vicissitudes of its fortunes, there is a fascinating story to be told. Leibniz viewed the principle of continuity, the principle that all natural changes are produced by degrees, as a useful heuristic for evaluating the truth of a theory. Since the Cartesian laws of motion entailed discontinuities in the natural order, Leibniz could safely reject it as a false theory. The principle of continuity has similar implications for analyses of Leibniz's theory of consciousness. I briefly survey the three main interpretations of Leibniz's theory of consciousness and argue that the standard account entails (...) a discontinuity that Leibniz could not allow. I argue that the principle of continuity and the textual data favor an interpretation according to which a conscious mental state just is a perception that is distinct to a sufficient degree. The growing interest in ethics and ethical behavior has not manifested itself in an ethical analysis of television programming beyond a journalism context. This study examines one social/ethical issue - lying in prime time network television situation comedies. Results show sitcom characters who lie are motivated primarily by self-interest. This egoistic approach raises questions of ethical maturity and provides a model of behavior that may have negative implications for society.

An ongoing debate in the philosophy of emotion concerns the relationship between two prima facie aspects of emotional states. The first is affective: felt and/or motivational. The second, which I call object-identifying, represents whatever the emotion is about or directed towards. “Componentialists” – such as R. S. Lazarus, Jesse Prinz, and Antonio Damasio – assume that an emotion’s object-identifying aspect can have the same representational content as a non-emotional state’s, and that it is psychologically separable or dissociable from the emotion’s (...) affective aspect. Some further hold that emotions have no object-identifying aspects of their own, and can properly be said to be about things only in virtue of their associations with other mental states (such as beliefs or perceptions). By contrast, “blenderists” – such as Peter Goldie, York Gunther, and Matthew Ratcliffe – insist that the two aspects are indissociable, because the affective aspect “infuses” the object-identifying aspect, altering the subject’s concept or percept of the object. As a result, an emotion’s object-identifying aspect cannot possibly have the same representational content as any non-emotional state’s. I argue that the strongest blenderist arguments fail to rule out plausible componentialist alternatives, and that the blenderists’ broader motivations are orthogonal to structural issues. (shrink)

Intuitionistic meta-methodologies, which abound in recent philosophy of science, take the criterion of success for theories of scientific rationality to be whether those theories adequately explicate our intuitive judgments of rationality in exemplary cases. Garber's (1985) critique of Laudan's (1977) intuitionistic meta-methodology, correct as far as it goes, does not go far enough. Indeed, Garber himself advocates a form of intuitionistic meta-methodology; he merely denies any special role for historical (as opposed to contemporary or imaginary) test cases. What all such (...) positions lack is a base from which to inform, criticize, or restructure our core methodological intuitions. To acquiesce in this is to deny that exemplary cases can serve the sort of warranting role required for intuitionism. This point is reinforced by a series of reasons for denying the warranting role of pre-analytic judgments of rationality. These reasons point the way toward an improved approach to meta-methodology. The just war tradition began life, primarily in the writings of Augustine and other Church Fathers, as a reaction to pacifism. In my view, contemporary just war adherents should also see pacifism as their main rival. The key question of the just war tradition is how to justify war, given that war involves intentionally attacking or killing innocent people. And this justificatory enterprise is not an easy one. Today some theorists argue that some, but not all, soldiers are liable to (...) be attacked, especially those who fight in an unjust war. In this view, some of those who fight and kill in unjust wars should not be excused for following orders or even for their ignorance. Yet, it is often hard to tell if one is fighting in an unjust war, or whether military orders are unjust. I will argue that, especially in light of new work by just war adherents, the moral risks of participating in war are so high that pacifism, at least in its contingent form, should be seen as a reasonable option. The new versions of the just war doctrine bring us much closer to pacifism than their adherents would admit. (shrink)

As late twentieth-century discourses of modernity and postmodernity invoke their Enlightenment heritage in a search for the origins of their present achievements and predicaments, Adam Smith's works are still seen as a canonic representative of that heritage. Smith has long been evoked as the ‘father’ of economics and the original proponent of laissez-faire capitalism, but the political changes in recent decades have reconstituted his iconic status. With the full range of Smith's published and unpublished writings and lectures now widely available, (...) there has been a huge growth in the scholarly literature on Smith which has subjected this traditional view to searching questions. The overwhelming conclusion to emerge is that Smith's works display a subtlety and complexity that is at odds with the received image of Smith as the spokesman of modernity, but the diversity of interpretation raises some difficult methodological issues. In 1710 G. W. Leibniz published Theodicy: Essays on the Goodness of God, the Freedom of Man, and the Origin of Evil. This book, the only one he published in his lifetime, established his reputation more than anything else he wrote. The Theodicy brings together many different strands of Leibniz's own philosophical system, and we get a rare snapshot of how he intended these disparate aspects of his philosophy to come together into a single, overarching account of divine justice in (...) the face of the world's evils. At the same time, the Theodicy is a fascinating window into the context of philosophical theology in the seventeenth century. Leibniz had his finger on the intellectual pulse of his time, and this comes out very clearly in the Theodicy. He engages with all of the major lines of theological dispute of that time, demonstrating the encyclopaedic breadth of his understanding of the issues. Leibniz's Theodicy remains one of the most abiding systematic accounts of how evil is compatible with divine goodness. Any treatment of the problem of evil must, at some point, come to grips with Leibniz's proposed solution. This volume refreshes and deepens our understanding of this great work. Leading scholars present original essays which critically evaluate the Theodicy, providing a window on its historical context and giving close attention to the subtle and enduring philosophical arguments. In the last two decades there has been a meteoric rise of international criminal tribunals and courts and also a strengthening chorus of critics against them. Today it is hard to find strong defenders of international criminal tribunals and courts. This book attempts such a defense against an array of critics. It offers a nuanced defense, accepting many criticisms but arguing that the idea of international criminal tribunals can be defended as providing the fairest way to deal with mass atrocity (...) crimes in a global arena. Fairness and moral legitimacy will be at the heart of this defense. The authors take up the economic and political arguments that have been powerfully expressed, as well as arguments about sovereignty, punishment, responsibility, and evidence; but in the end they show that these arguments do not defeat the idea of international criminal courts and tribunals. Constitutivists about one's cognitive access to one's mental states often hold that for any rational subject S and mental state M falling into some specified range of types, necessarily, if S believes that she has M, then S has M. Some argue that such a principle applies to beliefs about all types of mental state. Others are more cautious, but offer no criterion by which the principle's range could be determined. In this paper I begin to develop such a criterion, (...) arguing that although the principle applies when M is a belief, it does not apply when M is an emotion. I account for this asymmetry by focusing on differences in the commitments that belief and emotion conceptually involve, and briefly sketch out a psychological explanation of those differences. I conclude that one can reasonably split one's epistemological loyalties between constitutivism regarding meta-beliefs and non- constitutivism regarding beliefs about one's emotions. (shrink)

Can one’s belief that one romantically loves another be false? If so, under what conditions may one come to reasonably doubt, or at least suspend belief, that one does so? To begin to answer these questions, I first outline an affective/volitional view of love similar to psychologist R. J. Sternberg’s “triangular theory”, which analyzes types of love in terms of the degrees to which they include states of passion, emotion, and commitment. I then outline two sources of potential bias that (...) may cause one to believe that one romantically loves another when one does not. Partly on the basis of those potential sources of bias and partly on the basis of more specific issues, I then argue that at least to the extent that one is aware of these issues, one may reasonably doubt that one is experiencing romantic love’s emotional feelings, and one may reasonably doubt that one is making romantic love’s commitments. Finally, I order by relative dubitability the propositions that must be true about one’s passions, emotions, and commitments toward another in order for one to romantically love them. (shrink)
