Governing Animals explores the role of the liberal state in protecting animal welfare. Examining liberal concepts such as the social contract, property rights, and representation, Kimberly K. Smith argues that liberalism properly understood can recognize the moral status and social meaning of animals and provides guidance in fashioning animal policy.

In "Amelioration and Inclusion: Gender Identity and the Concept of Woman," Katharine Jenkins argues that Sally Haslanger's focal analysis of gender problematically excludes nonpassing trans women from the category "woman." However, Jenkins does not explain why this exclusion contradicts the feminist aims of Haslanger's account. In this paper, I advance two arguments that suggest that a trans-inclusive account of "woman" is crucial to the aims of feminism. I claim that the aims of feminism are to understand and combat women's oppression. (...) First, I argue that denial of trans identities reinforces cultural ideas that perpetuate both transphobic violence and sexual violence against women. Consequently, a feminist account of "woman" that fails to respect trans identities indirectly contributes to the oppression of women. Second, I prove that nonpassing trans women are oppressed as women through the internalization of sexual objectification. I then conclude that an account of "woman" that excludes nonpassing trans women cannot successfully advance a complete understanding of women's oppression. (shrink)

This article has two purposes. The first speaks to the compatibilist quality of Charles Mills’ Black Radical Kantianism (BRK), its strengths and weaknesses and the pertinence of W. E. B Du Bois to it. BRK turns from Mills’ previous critique of Kantianism as representative of arassenstaatlichpolitical liberalism, underwritten and tainted by the racial/domination contract, to his current defence of a compatibilist Kantianism as representative of arechtsstaatlichpolitical liberalism supported by a non-ideal racially corrective critique of both that contract and the kind (...) of political liberalism affiliated with it. The second focuses on what I introduce as the ‘Radicalization of Kant in Black’ (RKB). RKB isnota compatibilist project. Rather it re-examines issues first posed by ‘slave- and black-encoded’ blacks coming to act and struggle with the primacy of practical reason under the historically normative authority of freedom and the abolition of enslavement. When a provocateur intentionally provokes a deadly affray, the law of self-defense holds that the provocateur may not use deadly force to defend himself. Why is this so? Provocateurs are often seen as just one example of the problem of actio libera in causa, the causing of the conditions of one’s defense. This article rejects theories that maintain a one-size-fits-all approach to actio libera in causa, and argues that provocateurs need specific rules about why they forfeit their defensive rights. This (...) article further claims that provocateurs need to be distinguished from their cousins, initial aggressors, as initial aggressors engage in conduct that grounds the permissibility of the defender’s behavior whereas the provocateur’s behavior does not justify the respondent’s use of force against him. In addition, this article rejects that the basis of this forfeiture can be found in the doctrines surrounding when and why mitigation for provocation is appropriate for the respondent. Provocateurs forfeit their defensive rights for the very simple reason that they start the fight. This forfeiture occurs when they behave culpably, meaning that they subjectively appreciate that they are running the risk of causing force to be used against them and they engage in this behavior without justification or excuse. The question of when the provocateur’s behavior is justified is incredibly complex. It requires analysis of when it is that one is justified in increasing the risk of another’s wrongdoing. Any analysis of this justification must take seriously the liberty rights of the potential provocateur to engage in otherwise permissible behavior. Moreover, the determination of whether the provocateur is justified will turn on whether the later acts that he puts into motion are themselves justified. Thus, when Charles Bronson in the movie Death Wish presents himself as a victim so that muggers will attack him, the justifiability of his conduct in appearing as a vulnerable victim will turn on whether he is entitled to engage in this conduct, intending to later defend himself. This article argues that in Death Wish-type cases, the reason that the provocateur is not justified is because he becomes a vigilante, thereby usurping the role of the state and undermining rule of law values. The reasons supporting the ‘Racial Contract’ are reasons supporting the ‘metanarrative,’ which explains the Racial Contract. They are not reasons supportive of actions pertinent to undoing the Racial Contract, but reasons supportive of behavior pertinent to objectively confirming the ‘metanarrative’ of the ‘Racial Contract’ and rightfully establishing its place in political philosophy. This paper shall attempt to address these matters and their consequences.

Although formal barriers to women’s social and political participation have crumbled, society remains, to a significant degree, gendered in the roles that women and men play. Women’s and men’s choices regarding work and family are largely responsible for maintaining and reinforcing the differences. While feminists recognize the need to criticize women’s choices, too often they focus on restrictive conditions rather than the choices themselves. Kimberly A. Yuracko argues instead that encouraging women to make choices in accordance with a grounded (...) and well-defined conception of perfectionism—a philosopy concerned with human flourishing—is the most effective way to redress persistent gender inequality. To this end, Yuracko seeks not only to expose the perfectionism underlying current choice critiques, but to articulate a concrete set of feminist perfectionist principles that would improve the quality of individual women’s lives and improve the social standing of women as a whole. This article explores the patient experience of medically unexplained symptoms (MUS) from an existentialist standpoint. Drawing on the work of Jean-Paul Sartre and Simone de Beauvoir, I explore their concepts of existential situation, existential project, authenticity, and praxis. I then analyze the situation of MUS patients in the current cultural and institutional context, elucidating that a lack of explanation for their symptoms puts MUS patients in an existential bind. I illustrate the effects of the experience of MUS on patients’ existential (...) projects. Last, I develop an ethical response in the existentialist tradition from the perspective of patients, providers, and society at large. I argue that there is a collective responsibility to foster conditions more conducive to authentic patient well-being and to improve the experience of patients with medically unexplained symptoms. Situating the Philebus within the greater context of Plato’s late-period reconsideration of his own “theory of Ideas,” this essay offers a coordinated interpretation of two of the dialogue’s central passages—the discussion of the God-Given Method and that of the Fourfold Ontology. These passages prove to be interested not in Ideas apart from their material instantiations, as often seemed the case in the middle period dialogues, but in Ideas as they work on and even in materiality as such, producing an intelligible (...) and even beautiful order in the sensible world. This entails, the essay suggests, something like a shift in the direction of Plato’s philosophical gaze and interest toward material being, and thereby a sort of return home to the embodied human condition. A bold new conception of Heidegger's model of Destrucktion as a method of interpreting history that enables us to reorient and indeed transform its own most troubling legacies.

In this dissertation, I argue that psychology is central to the meaning and purposes of Nietzsche's work. Rather than suspending all ethical judgment or upholding a universal morality, Nietzsche offers models of psychological strength: the teaching of eternal return, the ethics of enemy love, laughter, and his own writing. In Nietzsche's models for psychological strength, my interpretation finds the basis for separating him from both those who find in Nietzsche the roots of totalitarian politics and those who find in Nietzsche's (...) view of the self a playful creativity they suppose supports liberal individualism. ;Through the deficient model of the free spirit of Beyond Good and Evil, I examine the role of honesty in Nietzsche's work and its confrontation with the need for appearances and masks. Through a careful examination of Thus Spoke Zarathustra, I explore the search for a human meaning for the earth, the problem of revenge, the psychological importance of the teaching of eternal return, and its ethical implications. While Zarathustra begins by teaching the Uebermensch, this empty teaching of creativity gives way to the problem of revenge and the need for a new form of redemption. The teaching of eternal returns seeks to overcome the problem of revenge by reconciling the will with the past, freedom with necessity, and the desire for immortality with the temporal character of human life. I argue that the psychological meaning of eternal return takes priority to its cosmological claims and that this teaching encourages an ethics of enemy-love, internalized as self-overcoming. Nietzsche's use of comedy exhibits the possibility of the internal split that combines the capacity for self-knowledge with the possibility of self-overcoming. I argue that Nietzsche stands above his character Zarathustra who teaches doctrines and that his writing manifests such an internalized split, the self-challenging that makes possible philosophy that does not collapse into dogmatism. His autobiographical Ecce Homo takes a comic form to encourage this split, appeal to a democratic audience, and to exemplify Nietzsche's distance above his own characters and their doctrines. Nietzsche thus succeeds where his character fails by offering indirect communication that makes possible the partial connection necessary for political life and by maintaining the distance from his doctrines necessary for new challenges and continued thought. Although it is not yet officially recognized as a clinical entity which is diagnosable, Internet Gaming Disorder (IGD) has been included in section III for further study in the DSM-5 by the American Psychiatric Association (APA, 2013). This is important because there is increasing evidence that people of all ages, in particular teens and young adults, are facing very real and sometimes very severe consequences in daily life resulting from an addictive use of online games. This article summarizes general aspects (...) of IGD including diagnostic criteria and arguments for the classification as an addictive disorder including evidence from neurobiological studies. Based on previous theoretical considerations and empirical findings, this paper examines the use of one recently proposed model, the Interaction of Person-Affect-Cognition-Execution (I-PACE) model, for inspiring future research and for developing new treatment protocols for IGD. The I-PACE model is a theoretical framework that explains symptoms of Internet addiction by looking at interactions between predisposing factors, moderators, and mediators in combination with reduced executive functioning and diminished decision making. Finally, the paper discusses how current treatment protocols focusing on Cognitive-Behavioral Therapy for Internet addiction (CBT-IA) fit with the processes hypothesized in the I-PACE model. In The Ends of Harm, Victor Tadros claims that the general justifying aim of the criminal law should be general deterrence. He also takes seriously that we cannot use people as a means, and thus he argues that we may only punish people in the name of general deterrence who have a ‘duty’ to suffer. Tadros claims that this duty arises as follows: An offender initially has a duty not to harm the victim. If the offender violates that duty, the (...) offender still has a duty to stop the harm from occurring. And if the harm does occur, then the offender has a duty to rectify that harm. This duty to rectify, argues Tadros, requires the defendant not only to compensate the victim but also to protect the victim to the extent that he would have been able to have been harmed to prevent the threat from occurring. Tadros further advances intricate arguments for why the state may therefore punish the offender to protect other potential victims to the extent of the offender’s duty to rectify. This symposium contribution seeks to explore three problems with Tadros’ analysis, ultimately arguing that Tadros’ theory fails on its own terms. First, attempts present a substantial problem for Tadros’ regime because attempts do not give rise to duties to prevent harm because there is no harm to be prevented. Tadros’ attempt to account for attempts, as completed offenses of diversions of security resources, ultimately leads to punishments that bear little resemblance to the crime attempted. Such a wildly counterintuitive result creates problems for a regime premised on general deterrence, which must be understood and respected. Second, Tadros’ regime will often exempt the rich from suffering criminal punishment. Tadros claims that duties to prevent harms from occurring are only enforceable when compensation will be inadequate. However, affluent offenders may be able to fully compensate. Moreover, since the scope of the duty to suffer will be determined by what remains of the duty after the victim is compensated, affluent offenders will be able to compensate more and thereby suffer less. Again, the actual sentences will thereby bear little resemblance to the rationale for criminalization, thus threatening the deterrent message of the law. Moreover, a system that exacerbates distributive inequalities will not achieve public respect. Third, Tadros cannot justify taking the duty that the defendant owes to the victim and forcing the victim to transfer this asset to the state. In his quest to articulate a theory that does not impermissibly use defendants, he ultimately endorses a theory that impermissibly uses their victims. He thus fails to achieve the very goal he sets for himself, which is to achieve general deterrence without impermissibly using anyone. (shrink)

In the Phaedrus, Plato’s Socrates distinguishes himself from the natural scientists of his day and indicates that the true philosophical attitude, the love of realhuman wisdom, shares something essential with the mythical attitude. In the following essay, I argue that Socrates criticizes science here for its failure to attend to aporia, to recognize an essentially questionworthy aspect of the world of human experience, an aspect I will refer to as distance. This essay focuses on and attempts to uncover the truly radical character of Nietzsche’s early “philological” work, specifically asking after the benefit he claims the study of classical culture should have for our present, late-modern historical moment. Taking up his study of the Pre-Platonic thinkers in 1873’s Philosophie im tragischen Zeitalter der Griechen , the first section analyzes Nietzsche’s statement that history’s principle task is the uncovering of Persönlichkeiten . I argue that it is not at all the subjective character (...) of a psychologized individual that Nietzsche has in mind, but rather the moment of persönliche Stimmung or ‘being attuned’ to the world, which grounds and gives rise to thinking. In the second section, I show that the phusis or ‘nature’ to which the thinker is exposed in this attunement is comparable to the tension between the Dionysian and Apollonian natural forces in tragic poetry, as Nietzsche understands it. This dynamic conception of phusis does not provide a metaphysical substrate or an objectively real ground to which we might return via that Greeks, but is rather essentially phenomenal , i.e. it is nothing other than the movement into and out of appearance, which always entails and requires its reception by the human being to whom it appears. In the final section of the essay, this origin proves for Nietzsche not to be located in a distant past moment. Rather, it is the abyssal origin of the tradition that is always already effective in our present moment, informing our contemporary conceptions of our world and ourselves. (shrink)

As the technology for ectogenesis continues to advance, the ethical implications of such developments should be thoroughly and proactively explored. The possibility of full ectogenesis remains hypothetical at present, and myriad concerns regarding the safety and efficacy of the technology must be evaluated and addressed, while pressing moral considerations should be fully deliberated. However, it is conceivable that the technology may become sufficiently well established in the future and that eventually full ectogenesis might be deemed ethically acceptable as a reproductive (...) alternative to gestation within a human womb under certain circumstances. If the safety and efficacy of full ectogenesis are established, if ethical dilemmas are sufficiently well addressed, and if the technology is offered as a reproductive option to cisgender heterosexual individuals or couples desiring to become parents, there is a moral obligation grounded in social justice to ensure that full ectogenesis be made available to individuals or couples identifying as members of sexual‐ or gender‐minority groups who likewise seek to pursue parenthood. We examine the history of access to current family‐building options, including assisted reproductive technology, surrogacy and adoption, for these populations and conclude that in the absence of robust empirical evidence suggesting an increased risk of harm to children of individuals and couples who identify as members of sexual‐ or gender‐minority groups, equitable access to ectogenesis as a pathway to parenthood for sexual and gender minorities must be assured as a matter of reproductive justice. The recent reception of Du Bois’ notion of “double consciousness” in the humanities has affirmed the notion as crucial and pivotal throughout his work. In contrast, its recent reception in the social sciences has tended to reject its centrality and importance. This essay will give general credence to the former position but, more importantly, show why a turn to Rousseau’s conception of amour‐propre may illuminate the importance of “double consciousness” in and for Du Bois’ 1903 work The Souls of Black (...)
