This essay examines Catharine Cockburn's moral philosophy as it is developed in her Defence of Mr. Locke's Essay on Human Understanding. In this work, Cockburn argues that Locke's epistemological principles provide a foundation for the knowledge of natural law. Sheridan suggests that Cockburn's objective in defending Locke's moral epistemology was conditioned by her own prior commitment to a significantly un-Lockean theory of morality. Ever since Heidegger lectured on Nietzsche, philosophers have stressed the active side of the Übermensch, the self who aggressively consumes and exploits value. Sheridan Hough, however, argues that there is a distinctly receptive and passive side to the Nietzschean self, and thus a pervasive doubleness in Nietzsche's thought that hasn't been explored before. This doubleness is the focus of Hough's attention here. Hough argues that Nietzsche's favorite way to describe the self is to use opposed pairs of metaphors. The (...) sea and the land, the pursuit of archaeology and the "granite stratum" of the self, the child and pregnancy are tropes he uses to show the self as both an active critic of culture and a creation of that culture. Noon and shadow exemplify this dual thinking. The free spirit, according to Nietzsche, is dogged by a shadow, a shadow cast by the free spirit's efforts to overcome himself. Perfect noon—emblematic of the Übermensch—is the moment of ecstatic release for the free spirit. Thus the Übermensch is not a separate "superhuman" being but rather an ecstatic moment in the experience of free spirits. Hough succeeds in showing that the doubleness motif strikes deeper into the heart of Nietzsche's thinking than has been realized. Favorite Nietzschean images, such as that of pregnancy, suddenly take on new meaning when considered in this light. Careful to avoid a reductionist view, Hough adds significantly to our understanding of Nietzsche's contribution to modern thought. (shrink)

The U.S. Supreme Court declared procreation to be a fundamental right in the early twentieth century in a case involving Oklahoma's Habitual Criminal Sterilization Act, an act that permitted unconsented sterilization of individuals convicted of certain crimes. The right that the Court articulated in that case is a negative right: it requires that the government not place unjustified roadblocks in the way of people seeking to procreate, but it does not require the government to take positive steps to help people (...) procreate if they wish to. I argue that a positive legal right is morally necessary in the United States, given the profound significance of procreation, the current barriers to access to care, and the related issues of individual and societal justice. I assume at the outset that the right to procreate should be expansive enough to include a right to noncoital reproduction. The absence of a positive right to procreate reflects not just constitutional tradition but also a governmental and societal commitment to a longstanding set of reproductive hierarchies by which those who fall outside of the traditional framing of family too frequently find their procreative dreams hindered. Reconceiving procreative rights to include a positive right would create greater opportunities to argue and lobby for increased access to technologies that are out of reach for many. (shrink)

: In a short and much-neglected passage in the second Critique, Kant discusses the threat posed to human freedom by theological determinism. In this paper we present an interpretation of Kant’s conception of and response to this threat. Regarding his conception, we argue that he addresses two versions of the threat: either God causes appearances directly or he does so indirectly by causing things in themselves which in turn cause appearances. Kant’s response to the first version is that God cannot (...) cause appearances directly because they depend essentially on the passive sensibility of finite beings. Kant’s response to the second version is that human beings are endowed with transcendental freedom, which blocks the causal transitivity that is presupposed by this version. At the end of ‘The Age of the World Picture,’ Heidegger offers a brief sentence, ‘Keiner stirbt für blosse Werte’ (No one dies for mere values.). This sentence underscores one of the central themes of Heidegger’s later essays, the nihilism that results from living in an economy of value. This way of life is lived by a certain kind of human being, one who treats a culture’s embedded habits and practices as value systems to be exploited and exhausted. A more (...) difficult problem presents itself: what is it like to be a person who has mastered this economy of value? This paper sets out to examine this question, and to propose another perspective: no one dies for mere values, but how does Heidegger’s rendition of the Übermensch manage to live? How does one live for mere values? I argue that Heidegger’s technological examples (e.g., the hydroelectric plant) have two salient features: each is ‘infectious’ and ‘exhaustible,’ features that are not consonant with the appropriative use of our habits and practices. I will focus on the condition Heidegger describes, and the person who makes this condition manifest, and conclude with a proposal for a ‘Nietzschean corrective.’. (shrink)

In The Frontiers of Justice, Martha Nussbaum argues that social contract theory cannot accommodate political duties to animals because it requires the parties to the contract to enjoy rough physical and mental equality. Her interpretation of the social contract tradi­tion is unpersuasive; social contract theory requires only that the parties be equally free and deserving of moral consideration. Moreover, social contract theory is superior to her capabilities approach in that it allows us to limit the scope of the community of (...) justice to animals we are capable of recognizing as subjects of justice and with whom we have a political relationship. Stand your ground laws (SYG) allow an individual to use deadly force against a perceived attacker anywhere that he or she has a legal right to be, without the requirement to attempt retreat before using deadly force. This article offers an analysis of SYG laws through a Sartrean existentialist lens. Drawing off existing empirical research and case examples, I make three claims: First, SYG laws have existential import to the extent that they influence individuals’ beliefs, behavior, and judgments. Second, this (...) existential import makes individuals more likely to perceive situations as threatening and find reasons to be afraid. Third, the phenomenological experience of negative emotions such as fear and anger affects our ability to make careful and reasoned judgments regarding the amount of threat we face. I build my case for these three claims using Sartre’s concept of fundamental project, or the image of self used to organize one’s existential possibilities. I also use Sartre’s phenomenological account of emotion and Robert Solomon’s account of emotion, which has Sartrean roots. I argue that, based on my analysis, the right to use self-defense should include the duty to retreat when possible. (shrink)

Georg Wilhelm Hegel’s dialectic plays a crucial role in some of the thought of the most prominent Black thinkers. The role it plays has received little attention. In this dissertation, I begin to fill this lacuna in Africana Philosophy by examining the arguments of William Edward Burghardt Du Bois in “The Conservation of Races,” Frantz Fanon in Black Skin, White Masks and The Wretched of the Earth, and Cyril Lionel Robert James in The Black Jacobins: Toussaint L’Ouverture and the San (...) Domingo Revolution and Notes on Dialectics: Hegel, Marx, Lenin. I argue that forms of praxis are the result of their engagement with Hegel’s dialectic: reflexive practice, absolute praxis, and organic praxis respectively. I show that in each of these cases Hegel’s dialectical approach to history (dialectical thinking) was essential to their own attempts to understand the possibility of a positive transformation of the pervasively racist world they inhabited. This essay contrasts Damaris Masham and Catharine Trotter Cockburn’s respective moral philosophies. It argues that their views are both remarkably innovative, yet strikingly similar. By focusing on Masham and Cockburn’s accounts of agency and virtue, it is demonstrated that both thinkers take human nature as a sort of guide to moral behavior – i.e., it shows that the moral agent operates under the perception of moral principles as arising from human nature. While both thinkers are known to have been directly (...) influenced by John Locke, it is also argued that both of their moral philosophies bear significant dissimilarities to Lockean morality. In recent years, scholars have come to understand emotions as dynamic and socially constructed—the product of interdependent cultural, relational, situational, and biological influences. While researchers have called for a multilevel theory of emotion construction, any progress toward such a theory must overcome the fragmentation of relevant research across various disciplines and theoretical frameworks. We present affect control theory as a launching point for cross-disciplinary collaboration because of its empirically grounded conceptualization of social mechanisms operating at the interaction, relationship, and cultural (...) levels, and its specification of processes linking social and individual aspects of emotion. After introducing the theory, we illustrate its correspondence with major theories of emotion construction framed at each of four analytical levels: cultural, interactional, individual, and neural. In a crossed-out section in his Fisk University commencement address on Otto von Bismarck, W. E. B. Du Bois mentions that Hegel was one of the figures that influenced him early on in his intellectual development. I argue that although Du Bois uses Hegelian language and employs a Hegelian conception of history in his address “The Conservation of Races,” he abandons both in his essay “Sociology Hesitant.” He became critical of the teleological conception of history because it rests on determinism, (...) which in his view denies the possibility for social change. With what I call his “mystical holism,” Du Bois is at odds with Hegel’s methodological holism, a distinguishing characteristic of absolute idealism. Du Bois’s dynamic idealism, which grows out of opposition to Hegelian idealism, leaves us with hope for a world without racism or at the very least in a better position to develop idealism as an anti-racist system of philosophical thought. Although it is not yet officially recognized as a clinical entity which is diagnosable, Internet Gaming Disorder (IGD) has been included in section III for further study in the DSM-5 by the American Psychiatric Association (APA, 2013). This is important because there is increasing evidence that people of all ages, in particular teens and young adults, are facing very real and sometimes very severe consequences in daily life resulting from an addictive use of online games. This article summarizes general aspects (...) of IGD including diagnostic criteria and arguments for the classification as an addictive disorder including evidence from neurobiological studies. Based on previous theoretical considerations and empirical findings, this paper examines the use of one recently proposed model, the Interaction of Person-Affect-Cognition-Execution (I-PACE) model, for inspiring future research and for developing new treatment protocols for IGD. The I-PACE model is a theoretical framework that explains symptoms of Internet addiction by looking at interactions between predisposing factors, moderators, and mediators in combination with reduced executive functioning and diminished decision making. Finally, the paper discusses how current treatment protocols focusing on Cognitive-Behavioral Therapy for Internet addiction (CBT-IA) fit with the processes hypothesized in the I-PACE model. (shrink)
