A number of companies including Google and BMW are currently working on the development of autonomous cars. But if fully autonomous cars are going to drive on our roads, it must be decided who is to be held responsible in case of accidents. This involves not only legal questions, but also moral ones. The first question discussed is whether we should try to design the tort liability for car manufacturers in a way that will help along the development and improvement (...) of autonomous vehicles. In particular, Patrick Lin’s concern that any security gain derived from the introduction of autonomous cars would constitute a trade-off in human lives will be addressed. The second question is whether it would be morally permissible to impose liability on the user based on a duty to pay attention to the road and traffic and to intervene when necessary to avoid accidents. Doubts about the moral legitimacy of such a scheme are based on the notion that it is a form of defamation if a person is held to blame for causing the death of another by his inattention if he never had a real chance to intervene. Therefore, the legitimacy of such an approach would depend on the user having an actual chance to do so. The last option discussed in this paper is a system in which a person using an autonomous vehicle has no duty of interfering, but is still held responsible for possible accidents. Two ways of doing so are discussed, but only one is judged morally feasible. (shrink)

Psychological science is maturing and therefore transitioning from explorative to theory-driven research. While explorative research seeks to find something “new,” theory-driven research seeks to elaborate on already known and hence predictable effects. A consequence of these differences is that the quality of explorative and theory-driven research needs to be judged by distinct criterions that optimally support their respective development. Especially, theory-driven research needs to be judged by its methodological rigor. A focus on innovativeness, which is typical for explorative research, will (...) instead incentivize bad research practices (e.g., imprecise theorizing, ignoring previous research, parallel theories). To support the advancement of psychology, we must drop the innovation requirement for theory-driven research and instead require the strongest methods, which are marked by high internal and external validity. Precise theorizing needs to substitute novelty. Theories are advanced by requiring explicit, testable assumptions, and an explicit preference for one theory over another. These explicit and potentially wrong assumptions should not be silenced within the peer-review process, but instead be scrutinized in new publications. Importantly, these changes in scientific conduct need to be supported by senior researchers, especially, in their roles as editors, reviewers, and in the hiring process. An important obstacle to further theory-driven research is to measure scientific merit using researchers’ number of publications, which favors theoretically shallow and imprecise writing. Additionally, it makes publications the central target of scientific misconduct even though they are the main source of information for the scientific community and the public. To advance the field, researchers should be judged by their contribution to the scientific community (e.g., exchange with and support of colleagues, and mentoring). Another step to advance psychology is to clearly differentiate between measurement model and theory, and not to overgeneralize based on few stimuli, incidences, or studies. We will use ideas from the theory of science to underline the changes necessary within the field of psychology to overcome this existential replication crisis. (shrink)

In this article, we introduce a theory on the dynamic development of affective processes, affect regulation, and the relationship between emotions and sport performance. The theory focusses on how affective processes emerge and develop during competitive sport involvement. Based on Scherer’s component process model, we postulate six components of emotion that interact with each other in a circular fashion: triggering processes, physiological reactions, action tendencies, expressive behaviors, subjective experience, and higher cognitive processes. The theory stresses the dynamics of affective processes (...) and describes the consequences for performance in competitive sports. It assumes that the peculiarities of different sports must be taken into account in order to understand the affective processes, and offers starting points on which strategies can be used to effectively regulate affective states. Consequences for research and practice are derived and discussed. To study the development of affective processes, future research should test the assumptions in ecologically valid contexts, such as real competitions or competition-like situations, using multi-component measures of emotions. This study aims to describe social network and social participation and to assess associations with depressive symptoms in older persons with increased risk for dementia in Germany. We conducted a cross-sectional observational study in primary care patients (aged 60-77) as part of a multicenter cluster-randomized controlled trial (AgeWell.de). We present descriptive and multivariate analyses for social networks (Lubben Social Network Scale and subscales) and social participation (item list of social activities) and analyze associations of these variables with depressive symptoms (Geriatric (...) Depression Scale). Of 1030 included patients, 17.2% were at risk for social isolation (Lubben Social Network Scale < 12). Looking at the subscales, a reduced non-family network was found almost twice as often as a reduced family network. Patients with depressive symptoms had significantly smaller social networks than patients without depression (p < 0.001). They rather engaged in social activities of low involvement level or no weekly social activity at all (p < 0.001). The study shows associations of depressive symptoms with a decreased social network and less social participation in elderly participants. Sufficient non-family contacts and weekly social activities seem to play an important role in mental health and should be encouraged in elderly primary care patients. (shrink)

Zusammenfassung Während der Fahrt der Flotte Alexanders durch den Indischen Ozean sichteten seine Seeleute angeblich ein Seeungeheuer. Die an der Unternehmung beteiligten Autoren Nearchos, Onesikritos und Orthagoras nahmen die ungewöhnliche Begegnung in ihre Werke auf, gaben diese aber in unterschiedlicher Weise wieder. Obwohl es sich dabei um eine in mehrerer Hinsicht interessante Episode handelt, besitzt sie einen besonders hohen Quellenwert, um Rückschlüsse über Alexanders Positionierung gegenüber den altorientalischen Kontexten seiner Herrschaft anzustellen. Schließlich behaupteten bereits die neuassyrischen Herrscher, auf dem Meer (...) am Rande der Welt Seeungeheuer gesichtet zu haben, womit ein allumfassender Herrschaftsanspruch einherging. Die achaimenidischen Großkönige benutzten dasselbe Argument, um Universalherrschaft und dadurch legitime Herrschaft zu kommunizieren. Kontextualisiert man die Sichtung des Seeungeheuers in den Fragmenten der Werke der Feldzugsteilnehmer in den Diskurs um Universalherrschaft des ersten Jahrtausends v. Chr., so lassen sich Alexanders Bestrebungen feststellen, sich zu den Konzepten legitimer Herrschaft nicht-makedonischer Prägung zu positionieren und sich in einer Weise als rechtmäßiger Herrscher zu präsentieren, die auch für seine asiatischen Untertanen verständlich war. Die am Alexanderzug teilnehmenden Autoren nahmen die hierfür benutzten Ideologeme in ihre Werke auf, passten sie aber entsprechend ihrer literarischen Absichten an. (shrink)

The trans-jurisdictional discourse on criminal justice is often hampered by mutual misunderstandings. The translation of legal concepts from English into other languages and vice versa is subject to ambiguity and potential error: the same term may assume different meanings in different legal contexts. More importantly, legal systems may choose differing theoretical or policy approaches to resolving the same issues, which sometimes – but not always – lead to similar outcomes. This book is the second volume of a series in which (...) eminent scholars from German-speaking and Anglo-American jurisdictions work together on comparative essays that explore foundational concepts of criminal law and procedure. Software systems play an ever more important role in our lives and software engineers and their companies find themselves in a position where they are held responsible for ethical issues that may arise. In this paper, we try to disentangle ethical considerations that can be performed at the level of the software engineer from those that belong in the wider domain of business ethics. The handling of ethical problems that fall into the responsibility of the engineer has traditionally been addressed (...) by the publication of Codes of Ethics and Conduct. We argue that these Codes are barely able to provide normative orientation in software development. The main contribution of this paper is, thus, to analyze the normative features of Codes of Ethics in software engineering and to explicate how their value-based approach might prevent their usefulness from a normative perspective. Codes of Conduct cannot replace ethical deliberation because they do not and cannot offer guidance because of their underdetermined nature. This lack of orientation, we argue, triggers reactive behavior such as “cherry-picking,” “risk of indifference,” “ex-post orientation,” and the “desire to rely on gut feeling.” In the light of this, we propose to implement ethical deliberation within software development teams as a way out. Throughout the biological and biomedical sciences there is a growing need for, prescriptive ‘minimum information’ (MI) checklists specifying the key information to include when reporting experimental results are beginning to find favor with experimentalists, analysts, publishers and funders alike. Such checklists aim to ensure that methods, data, analyses and results are described to a level sufficient to support the unambiguous interpretation, sophisticated search, reanalysis and experimental corroboration and reuse of data sets, facilitating the extraction of maximum value from data sets (...) them. However, such ‘minimum information’ MI checklists are usually developed independently by groups working within representatives of particular biologically- or technologically-delineated domains. Consequently, an overview of the full range of checklists can be difficult to establish without intensive searching, and even tracking thetheir individual evolution of single checklists may be a non-trivial exercise. Checklists are also inevitably partially redundant when measured one against another, and where they overlap is far from straightforward. Furthermore, conflicts in scope and arbitrary decisions on wording and sub-structuring make integration difficult. This presents inhibit their use in combination. Overall, these issues present significant difficulties for the users of checklists, especially those in areas such as systems biology, who routinely combine information from multiple biological domains and technology platforms. To address all of the above, we present MIBBI (Minimum Information for Biological and Biomedical Investigations); a web-based communal resource for such checklists, designed to act as a ‘one-stop shop’ for those exploring the range of extant checklist projects, and to foster collaborative, integrative development and ultimately promote gradual integration of checklists. Given its non-invasive nature, there is increasing interest in the use of transcutaneous vagus nerve stimulation across basic, translational and clinical research. Contemporaneously, tVNS can be achieved by stimulating either the auricular branch or the cervical bundle of the vagus nerve, referred to as transcutaneous auricular vagus nerve stimulation and transcutaneous cervical VNS, respectively. In order to advance the field in a systematic manner, studies using these technologies need to adequately report sufficient methodological detail to enable comparison of results between (...) studies, replication of studies, as well as enhancing study participant safety. We systematically reviewed the existing tVNS literature to evaluate current reporting practices. Based on this review, and consensus among participating authors, we propose a set of minimal reporting items to guide future tVNS studies. The suggested items address specific technical aspects of the device and stimulation parameters. We also cover general recommendations including inclusion and exclusion criteria for participants, outcome parameters and the detailed reporting of side effects. Furthermore, we review strategies used to identify the optimal stimulation parameters for a given research setting and summarize ongoing developments in animal research with potential implications for the application of tVNS in humans. Finally, we discuss the potential of tVNS in future research as well as the associated challenges across several disciplines in research and clinical practice. (shrink)

At the beginning of 2020, COVID-19 became a global problem. Despite all the efforts to emphasize the relevance of preventive measures, not everyone adhered to them. Thus, learning more about the characteristics determining attitudinal and behavioral responses to the pandemic is crucial to improving future interventions. In this study, we applied machine learning on the multi-national data collected by the International Collaboration on the Social and Moral Psychology of COVID-19 (N = 51,404) to test the predictive efficacy of constructs from (...) social, moral, cognitive, and personality psychology, as well as socio-demographic factors, in the attitudinal and behavioral responses to the pandemic. The results point to several valuable insights. Internalized moral identity provided the most consistent predictive contribution—individuals perceiving moral traits as central to their self-concept reported higher adherence to preventive measures. Similar was found for morality as cooperation, symbolized moral identity, self-control, open-mindedness, collective narcissism, while the inverse relationship was evident for the endorsement of conspiracy theories. However, we also found a non-negligible variability in the explained variance and predictive contributions with respect to macro-level factors such as the pandemic stage or cultural region. Overall, the results underscore the importance of morality-related and contextual factors in understanding adherence to public health recommendations during the pandemic. (shrink)

Background -/- Innovative neurosurgical treatments present a number of known risks, the natures and probabilities of which can be adequately communicated to patients via the standard procedures governing obtaining informed consent. However, due to their novelty, these treatments also come with unknown risks, which require an augmented approach to obtaining informed consent. -/- Objective -/- This paper aims to discuss and provide concrete procedural guidance on the ethical issues raised by serious unexpected complications of novel deep brain stimulation treatments. -/- (...) Approach -/- We illustrate our analysis using a case study of the unexpected development of recurrent stereotyped events in patients following the use of deep brain stimulation (DBS) to treat severe chronic pain. Examining these unexpected complications in light of medical ethical principles, we argue that serious complications of novel DBS treatments do not necessarily make it unethical to offer the intervention to eligible patients. However, the difficulty the clinician faces in determining whether the intervention is in the patient's best interests generates reasons to take extra steps to promote the autonomous decision making of these patients. -/- Conclusion and recommendations -/- We conclude with clinical recommendations, including details of an augmented consent process for novel DBS treatment. Summary The article examines unofficial imperial nicknames, sobriquets and appellatives, from Octavian Augustus to Julian the Apostate, in the light of traditions of Roman political humour, and argues that in the political field during the Principate there were two co-existing competing modes of emperors’ naming: along with an official one, politically loyal, formalised and institutionally legitimised, there existed another – unofficial, sometimes oppositional and even hostile towards individual emperors, frequently licentious, humorously coloured and, in this regard, deeply rooted in (...) Roman Republican traditions of political humour. Many of the known imperial nicknames and appellatives belong to a specific kind of folklore and express popular public opinion. They survived for us because of ancient authors’ interest in using such material for their literary and ideological intentions, particularly to express better the individual characteristics of the historical personages. But, for the very same purposes, Greek and Roman writers could invent some names and sobriquets, following special rhetorical and moralising principles, or mere love of ridicule. All in all, most imperial nicknames, both authentic and made-up, reveal a rather good quality of humour and mockery constructed by expressive linguistic devices and various rhetorical tropes. An apt derisive nickname marked anti-values, mocked the ruler’s badness and could vilify his reputation to the extreme, stigmatise his personality, or else become a widely-used quasi-cognomen. Many nicknames and appellatives were of ephemeral, ad hoc nature, their sense and effect largely dependent on the particular context; but, taken as a whole, they demonstrate the possible scope of and common trends in naming practice. The political system of the Principate and its very atmosphere of hypocrisy did promote double meaning and double thinking reflected in the double system of the rulers’ nomenclature. Imperial nicknames were a counter-hegemonic transcript and a weapon in the struggle for symbolic capital. All the efforts which many emperors took to control their nomina were ultimately powerless against the strength of the inevitable humorous counter-naming by the ruled. (shrink)

With the earliest known reference to angling with a fly dating from the Chou Dynasty, more than 2,300 years ago, it should come as no surprise that when asked to justify their passionate devotion to fly fishing, many anglers will refer to the rich and venerable literature the sport has generated. Ranging from Plutarch's references to Nile fishing in the Life of Antonius, to Pliny the Elder's Historia Naturalis, to the fifteenth century classic, Dame Julian Berner's The Treatyse of (...) Fysshynge wyth an Angle, to the sport's bible, the 17th century The Compleat Angler by Izaak Walton, to literary treatments in the work of authors such as John Donne, Gerard Manley Hopkins, William Butler Yeats, Ezra Pound and Ernest Hemingway, the wealth of literature devoted to fly fishing appears to be out of proportion to what is, ultimately, just a way of seducing an animal with a brain the size of a pea into inhaling a hook upon which some feathers, furs and tinsels have been lashed. What then, one may legitimately ask, is it about this sport that creates fanatical devotion on the part of its practitioners, who tend to regard it with such zeal and passion as is commonly reserved for art and religion? This paper will philosophically extend Julian Leff’s Avatar therapy paradigm (AT) for voice-like hallucinations that was initially proposed for treatment-resistant Schizophrenia patients into the realm of gesture-enhanced embodied cognition and Virtual Reality (VR), entitled g+TA (gesture-enhanced Avatar Therapy). I propose an philosophy of technology approach of embodied rhetorics of triadic kinetic “actions” in the sense of Charles Sanders Peirce that transforms the voice hallucination incorporated by an avatar- and that can confront acousmatic voice-like hallucinations with a method of gesture (...) synchronization and dyssynchronization and gestural refusal of interaction that the player with the Avatar can resist in full embodiment. This paper therefore introduces a gesture-enhanced, extended version of Cybertherapy with Avatars that tackle multimodal bodily experience of voice-like hallucinations beyond mere visual or auditory stimulation. This is put forward theoretically in a 4E-cognition approach that expands Avatar Therapy with gestures into VR. (shrink)

Constantine, the first Christian Emperor, bequeathed war against Persia to his son Constantius, a legacy which haunted the next two decades, culminating in Julian′s debacle in 363. Much has been written on the timing, motives, and strategy of these campaigns but the same role model appears at their beginning and end: Alexander the Great. Here, I wish to re-examine the evidence for his presence: recent scholarship has minimized it at one end and maximized at the other.

In an article in this journal, Christopher Cowley argues that we have ‘misunderstood the special nature of medicine, and have misunderstood the motivations of the conscientious objectors’. We have not. It is Cowley who has misunderstood the role of personal values in the profession of medicine. We argue that there should be better protections for patients from doctors' personal values and there should be more severe restrictions on the right to conscientious objection, particularly in relation to assisted dying. We argue (...) that eligible patients could be guaranteed access to medical services that are subject to conscientious objections by: removing a right to conscientious objection; selecting candidates into relevant medical specialities or general practice who do not have objections; demonopolizing the provision of these services away from the medical profession. Can we employ the property of rationality in establishing what rationality requires? According to a central and formal thesis of John Broome’s work on rational requirements, the answer is ‘no’ – at least if we expect a precise answer. In particular, Broome argues that (i) the property of full rationality (i.e. whether or not you are fully rational) is independent of whether we formulate conditional requirements of rationality as having a wide or a narrow logical scope. That is, (ii) by (...) replacing a wide-scope requirement with a corresponding narrow-scope requirement (or vice versa), we do not alter the situations in which a person is fully rational. As a consequence, (iii) the property of full rationality is unable to guide us in determining whether a rational requirement has a wide or a narrow logical scope. We cannot resolve the wide/narrow scope debate by appealing to a theory of fully rational attitudes. This paper argues that (i), (ii) and (iii) are incorrect. Replacing a wide- with a corresponding narrow-scope requirement (or vice versa) can alter the set of circumstances in which a person is fully rational. The property of full rationality is therefore not independent of whether we formulate conditional requirements of rationality as having a wide or a narrow logical scope. As a consequence, the property of full rationality can guide us in determining what rationality requires – even in cases where we expect a precise answer. (shrink)

Within the debate concerning reason and rationality, instrumental incoherence was for a long time conceived of as the paradigm of irrationality. However, with the emergence of the so-called ‘bootstrapping objection’ and the debate concerning the ‘scope’ of rational requirements, the innocuous status of the normative significance of (instrumental) coherence became subject to. This led to a paradigmatic shift in how to understand the relationship between rational requirements and normativity. While there now exists considerable doubt that rational requirements are normative, it (...) is commonly agreed that one’s normative point of view is a key feature of one’s rationality. Here the question is not only if one can hold a particular normative judgement and still be rational; what is significant too is whether your normative outlook coheres appropriately with your motivation. In fact, it is now commonly agreed that rationality requires us to intend to make the world fit with our first-personal ought beliefs. Enkrasia (i.e. coherence between your normative views and your motivation) is thus seen as a rational ideal and as a source of rational requirements. Nevertheless, many elementary questions regarding the application, content, and significance of an enkrasia-requirement remain unanswered, or subject to debate. This special issue on ‘The Nature of the Enkratic Requirement of Rationality’ aims to answer some of these fundamental questions. (shrink)

In the Soviet scientific literature of 1920‒30 the concept of probability was holly debated. The frequency concept which was proposed by R. von Mises became popular among Soviet physicists belonging to the L.I. Mandelstam community. Landau and Lifshitz were also close to this concept in their famous course of theoretical physics. A.Khinchin, a mathematician who cooperated with Kolmogorov, opposed to the frequency conception. In this paper we try to demonstrate that the frequency position was connected with the anthropomorphous approach to (...) physics, whereas Khinchin’s positions implied the criticism of anthropomorphism and put forward the ideal of objective knowledge. For Protosociology the "Diskurs "-theory has a special significance. Validity-dimensions of speech and their evaluation in the procedure of argumentation indicate generalized presuppositions of interactive processes. These validity-dimensions can be reconstructed in lingusitic characterisations of "normative language" (P.W. Taylor). Thus it is possible to make first steps to a theory of validity. Protosociology provides a special reconstruction of argumentative speech on the level "interpersonality, structure of communicative acting and collective identity". The aim of Protosociology within a context of problems of (...) "Diskurs"-theory would have to establish normative values for an evaluation of such validity-dimensions. A logic of "Diskurs" would have to be developed as a kind of logic of "relevance". (shrink)

At first place the article should serve as clarification of the term "lifeworld" ("Lebenswelt) by means of selected lifeworld-conceptions of 20th. century philosophy.I would like to explikate the attempts of reflexive reference to lifeworld which exist in the concept of Husserl, Heidegger, Wittgenstein and Searle. According to the explanations of Husserl and Heidegger my main interest lies in the problematic of validity. The relation between lifeworld and reflection shall be dealt with in the light of the philosophy of language (Wittgenstein, (...) Searle).At least I would like to discuss the relation between tifeword and science. (shrink)

Can we have a posteriori knowledge of modal facts? And if so, is that knowledge fundamentally a posteriori, or does a priori intuition provide the modal component of what is known? Though the latter view seems more straightforward, there are also reasons for taking the first option seriously.

Metaphors involve immense explanatory power and positive impact predominantly in the scientific education and popularization. Still the use of metaphors in science might be a double-edged sword. Introduction of the computer metaphor to many scientific fields in the last century resulted in reductionist approaches, oversimplifications and mechanistic explanations in science as well as in humanities. In this short commentary we developed further the computer metaphor by prof. Noble and the illusions this metaphor led to in genetics, linguistics and consequently DNA (...) linguistics. (shrink)
