Our primary focus is on analysis of the concept of voluntariness, with a secondary focus on the implications of our analysis for the concept and the requirements of voluntary informed consent. We propose that two necessary and jointly sufficient conditions must be satisfied for an action to be voluntary: intentionality, and substantial freedom from controlling influences. We reject authenticity as a necessary condition of voluntary action, and we note that constraining situations may or may not undermine voluntariness, depending on the (...) circumstances and the psychological capacities of agents. We compare and evaluate several accounts of voluntariness and argue that our view, unlike other treatments in bioethics, is not a value-laden theory. We also discuss the empirical assessment of individuals? perceptions of the degrees of noncontrol and self-control. We propose use of a particular Decision Making Control Instrument. Empirical research using this instrument can provide data that will help establish appropriate policies and procedures for obtaining voluntary consent to research. (shrink)

One critique of the early Daoist texts associated with Laozi and Zhuangzi is that they neglect the human and lack a proper sense of ethical personhood in maintaining the primacy of an impersonal dehumanizing “way.” This article offers a reconsideration of the appropriateness of such negative evaluations by exploring whether and to what extent the ethical sensibility unfolded in the Zhuangzi is aporetic, naturalistic, and/or religious. As an ethos of cultivating life and free and easy wandering by performatively enacting openness (...) and responsiveness to things in an immanent this-worldly context, the Zhuangzi is oriented toward the relational attunement of disposition and practice rather than toward metaphysics or religion in a transcendent sense. It consequently suggests an immanent anarchic ethics without principles while neither forgetting nor reifying the sacred and the mundane in its playful illumination of the biospiritual dynamics of cultivating life. In this book—the first large-scale survey of the complex relationship between Hegel’s idealism and Anglo-American analytic philosophy—Tom Rockmore argues that analytic philosophy has consistently misread and misappropriated Hegel. According to Rockmore, the first generation of British analytic philosophers to engage Hegel possessed a limited understanding of his philosophy and of idealism. Succeeding generations continued to misinterpret him, and recent analytic thinkers have turned Hegel into a pragmatist by ignoring his idealism. Rockmore explains why this has happened, defends Hegel’s idealism, and (...) points out the ways that Hegel is a key figure for analytic concerns, focusing in particular on the fact that he and analytic philosophers both share an interest in the problem of knowledge. It is common to focus on the duties of the wrongdoer in cases that involve injustice. Presumably, the wrongdoer owes her victim an apology for having wronged her and perhaps compensation for having harmed her. But, these are not the only duties that may arise. Are other beneficiaries of an injustice permitted to retain the fruits of the injustice? If not, who becomes entitled to those funds? In recent years, the Connection Account has emerged as an influential account that purports (...) to explain cases such as Embezzlement. This account holds that benefiting from injustice can give rise to a corrective duty - that is, a duty of compensation - owed specifically to the victim of the injustice from which the recipient benefits. This duty is grounded in the connection between the victim and the beneficiary of a given injustice. This paper has two aims. First, I show that we must reject the Connection Account on the grounds that it risks failing correctly to identify those who become entitled to the fruits of injustice. I achieve this by developing and defending the fairness objection. Second, I offer an alternative account: the Moral Taintedness Account. This account states that, when identifying who is entitled to the fruits of injustice, the cause and the degree of the harm suffered by a victim are both relevant considerations, though it does not matter whether the victim is the victim of the injustice that gave rise to the fruits in question. This account avoids the problem associated with the Connection Account, and yields intuitive conclusions in an important range of test cases. (shrink)

Can work be done for pay, and still be loving? While many feminists believe that marketization inevitably leads to a degradation of social connections, we suggest that markets are themselves forms of social organization, and that even relationships of unequal power can sometimes include mutual respect. We call for increased attention to specific causes of suffering, such as greed, poverty, and subordination. We conclude with a summary of contributions to this Special Issue.

The majority of traditional students enrolled at most colleges and universities are a part of what has been termed the Millennial Generation, also known as Generation Y, which typically describes the group of individuals born in most of the 1980s and 1990s. This cohort’s life has been shaped by corporate scandals, economic instability, and worldwide tragedies. Concurrently, business ethics has become a popular topic in the news within the last 2 decades due to the increase in the number of high-profile (...) business scandals. Unfortunately, this trend has also been accompanied by an increased number of reported incidents of academic dishonesty at many major universities. Two underresearched factors that may be related to academic dishonesty and cheating behavior are religiosity and spirituality. This article attempts to shed more light on the relationship between religious beliefs and unethical behavior, with a focus on millennial college students. It is posited that religiosity and spirituality influence an individual’s attitudes, views, decisions, and ultimately behaviors. The results of this study indicate that religiosity but not spirituality is a predictor of students’ attitudes toward cheating and cheating behavior. (shrink)

In this study, Tom Sorell seeks to rehabilitate views that are often instantly dismissed in analytic philosophy. His book serves as a reinterpretation of Cartesianism and responds directly to the dislike of Descartes in contemporary philosophy. To identify what is defensible in Cartesianism, Sorell starts with a picture of unreconstructed Cartesianism, which is characterized as realistic, antisceptical but respectful of scepticism, rationalist, centered on the first person, dualist, and dubious of the comprehensiveness of natural science and its supposed independence of (...) metaphysics. Bridging the gap between history of philosophy and analytic philosophy, Sorell also shows for the first time how some contemporary analytic philosophy is deeply Cartesian, despite its outward hostility to Cartesianism. ABSTRACT ABSTRACT: Nietzsche, we are often told, had an account of 'self' or 'mind' or a 'philosophical psychology', in which what he calls our 'drives' play a highly significant role. This underpins not merely his understanding of mind, in particular, of consciousness and action. but also his positive ethics, be they understood as authenticity, freedom, knowledge, autonomy, self-creation, or power. But Nietzsche did not have anything like a coherent account of 'the drives' according to which the self, the relationship between (...) thought and action, or consciousness could be explained; consequently, he did not have a stable account of drives on which his positive ethics could rest. By this, I do not mean that his account is incomplete or that it is philosophically indefensible: both would leave open, misleadingly, the possibility of a rational reconstruction of Nietzsche’s views; both would already assume more unity and coherence than we find in his texts. Specifically, as I show through detailed analysis, Nietzsche provides varied and inconsistent accounts of what a 'drive' is, how much we can know about drives, and the relationship between drives and conscious deliberations about action. I conclude by questioning the hunt for a Nietzschean theory: is this the best way to be reading him? (shrink)

I present a way of thinking about gender that I have found helpful in evaluating various proposed feminist projects. By considering gender and value as independent dimensions, relationships of "difference" can be more clearly perceived as involving relationships of lack, of complementarity, or of perversion. I illustrate the use of my gender/value "compass" with applications to questions of self-identity, rationality, and knowledge. This way of thinking about gender allows a conceptualization of feminism that neither erases nor emphasizes gender distinctions.

Magnetic resonance imaging is a noninvasive imaging tool that utilizes a strong magnetic field and radio frequency waves to visualize in great detail organs, soft tissue, and bone. Unlike conventional x-rays, there is no exposure to ionizing radiation and at most field strengths the procedure is considered safe for nearly every age group. Because it is non-invasive and possesses excellent spatial resolution, the use of MRI as a research tool has increased exponentially over the past decade. Uses have ranged from (...) add-ons to a clinical study to studies of brain development in typically developing children. In addition, a major effort has been made in recent years to use MRI to study brain function. Because the clinical utility of fMRI has not yet been realized, fMRI is still considered highly exploratory, and we cannot yet identify incidental findings of a functional nature. (shrink)

Lawyers tend to look to the law to resolve disputes and to create certainty about the rights and responsibilities of parties to relationships. There is a particularly acute need for certainty in the context of global trade in surrogacy services, both because of the number of parties who may be involved in creating familial relationships and because of the vulnerabilities created as a result of surrogacy arrangements. Kriegel’s self-representationalist theory of phenomenal consciousness pursues two projects. The first is to offer a positive account of how conscious experience arises from physical brain processes. The second is to explain why consciousness misleadingly appears to be irreducible to the physical i.e. to ‘demystify’ consciousness. This paper seeks to determine whether SR succeeds on the second project. Kriegel trades on a distinction between the subjective character and qualitative character of conscious states. Subjective character is the property of being a conscious (...) state at all, while qualitative character determines what it is like to be in that state. Kriegel claims that SR explains why subjective character misleadingly appears irreducible, thereby neutralising the apparent irreducibility of consciousness. I argue that although SR credibly demystifies subjective character, it cannot explain why qualitative character also appears irreducible. I conclude that we should pursue the possibility of a hybrid position that combines SR with an account that does explain the apparent irreducibility of qualitative character. (shrink)

Around the world, the population is ageing in ways that pose new challenges for healthcare providers. To date these have mostly been formulated in terms of challenges created by increasing costs, and the focus has been squarely on life-prolonging treatments. However, this focus ignores the ways in which many older people require life-enhancing treatments to counteract the effects of physical and mental decline. Several scholars have argued that Internet use might be fundamentally incompatible with Confucian ethics, because the values that are embedded in the Internet might be in conflict with Confucian values. In addition, the design of various social network services considers very little of non-Western values in its engineering. Against this background, this article explores the philosophical question of whether Internet use, particularly social network services, is compatible with the fundamental values and norms of Confucian ethics. In addition, the article discusses (...) the Confucian notion of tian xia, and argues that tian xia, as a basic structuring principle of Confucian philosophy, helps to innovate a different social media. How ought we to understand the sources and limits of the authority of family members to make health care decisions for their decisionally incapacitated relatives? This question is becoming increasingly crucial as the population ages and the power of medical technology waxes. It is also becoming increasingly contested, as faith in advance directives shows signs of waning, and the moral complexities of intimate relationship become more theoretically patent.This last point—the newly visible moral richness of intimate relationship—provides this paper with its (...) field. I am interested in probing the images of the relationship between self and other, particularly self and intimate other, that seem presupposed by some leading attempts to determine the basis for proxy decision-making authority, and what constraints it must observe. In the light of both recent work in the philosophy of mind and considerations closer to common experience, the reigning images seem too slight to support the weight of current practices and beliefs about proxy authority; supplanting them with images more faithful to our experience will have implications for our practice with proxies. Professor Imwinkelried is surely right: the propriety of bioethicists serving as expert witnesses in litigation is problematic, and, I would add, it should remain problematic. Such testimony most certainly does not belong everywhere it will be offered by lawyers and litigants in an effort to advance their interests. Yet in contrast to some commentators, Imwinkelried and I both see a place for bioethicists serving as expert witnesses, although we differ significantly on how to understand and justify this place. In any (...) event, serious questions regarding the proper place for expert bioethicist testimony in the courtroom do exist, not only for law but also bioethics as well.The threshold question regarding the prospect of bioethicists serving as expert witnesses would seemingly have to be: “could a bioethicist qualify as an expert witness under the controlling rules of evidence?” Imwinkelried, however, does not perceive any need to even entertain this question as he claims that “technical evidentiary standards are inapplicable when information is presented to a judge to permit the judge to perform… a legislative or law-making function.”. Recent simulation studies have pointed to the higher power of the test for the mediated effect vs. the test for the total effect, even in the presence of a direct effect. This has motivated applied researchers to investigate mediation in settings where there is no evidence of a total effect. In this paper we provide analytical insight into the circumstances under which higher power of the test for the mediated effect vs. the test for the total effect can be expected (...) in the absence of a direct effect. We argue that the acclaimed power gain is somewhat deceptive and comes with a big price. On the basis of the results, we recommend that when the primary interest lies in mediation only, a significant test for the total effect should not be used as a prerequisite for the test for the indirect effect. However, because the test for the indirect effect is vulnerable to bias when common causes of mediator and outcome are not measured or not accounted for, it should be evaluated in a sensitivity analysis. Patricia Elliot distorts my work, in summarizing my position as one of advocating a revaluing of feminine qualities. After clarifying my position, I flesh out in greater detail my argument that complete gender neutrality is neither necessary nor sufficient for a non-sexist society. Distinguishing between the source and the locus of value enables environmental philosophers to consider not only what is of value, but also to try to develop a conception of valuation that is itself ecological. Such a conception must address difficulties caused by the original locational metaphors in which the distinction is framed. This is done by reassessing two frequently employed models of valuation, perception and desire, and going on to show that a more adequate ecological understanding of valuation emerges when (...) these models are fully contextualized in the intersecting life worlds of the ecological community. Ecological evaluation takes place in ongoing encounters between these worlds and a crucial part in this process is assigned to living beings that are “open-endedly open,” that is, open not only to what the world affords them and others, but open to an indefinite field of possible valuational encounters between all kinds of beings. Ecological valuation overcomes some of the conceptual failings of contemporary attempts to evaluate nature: “The Economics of Ecology and Biodiversity” and “Valuing Nature.”. (shrink)

In England and Wales, Section 15 of the Sexual Offences Act criminalizes the act of meeting a child—someone under 16—after grooming. The question to be pursued in this paper is whether grooming—I confine myself to online grooming—is justly criminalized. I shall argue that it is. One line of thought will be indirect. I shall first try to rebut a general argument against the criminalization of acts that are preparatory to the commission of serious offences. Grooming is one such act, but (...) there are others, sometimes associated with terrorism. According to me, the general argument misapplies certain considerations about autonomy that are alleged to be in force in other areas of criminal law. Contrary to that general argument, criminalization of preparatory acts does not, in general, bypass the agency of citizens. Moreover, the criminalization of preparatory acts can disrupt activity that would have led to very serious crime, and with relatively low costs to the perpetrators, costs that reflect the non-occurrence of the more serious crime. There is evidence that grooming is harmful in itself, and so another point against the general argument is its assumption that preparatory offences are often harmless or at least victimless. There are objections to some of the undercover policing techniques that lead to a Section 15 prosecution, but these objections are not all weighty. (shrink)

I was initially assigned the working title, “Pursuing Equality in Health Care for the Elderly Is Futile.” I prefer to think of that particular dead end of health policy as one of listening to the wrong music for too long. Hence, this article reprises and revises the title song of the early 1980s movie, Urban Cowboy, but with Johnny Lee’s original lyrics adapted as “Looking for better health [rather than either ‘love’ or ‘love of equality’] in all the wrong places.” (...) The better goal is to achieve more progress in improving health for more people, including the elderly. It need not be as futile as the pursuit of the elusive abstraction of “equality” for all — but only if we first move away from a path-dependent approach of recent times that remains too narrowly focused on statistical disparities in health care services received by particular groups. The sublime has come under severe criticism in recent years. Jane Forsey, for instance, has argued that all theories of the sublime “rest on a mistake”. In her article, “The Pleasures of Contra-purposiveness: Kant, the Sublime, and Being Human,” Katerina Deligiorgi () provides a rejoinder to Forsey. Deligiorgi argues—with the help of Kant—that a coherent theory of the sublime is possible, and she provides a sketch for such a theory. Deligiorgi makes good progress in the debate over the sublime. But (...) here I raise two questions in relation to her account. The aim of these questions is to help clarify and augment her theory and thus extend the discussion about the tenability and relevance of the sublime. The first question is about the pleasure of the sublime. The pleasure, she claims, comes from our catching a glimpse of ourselves as agents in the world. But, I argue, Deligiorgi's conception of agency is insufficient for explaining the pleasure of sublimity, and this is because she does not take into account what I call the “ends of reason,” those ends that matter most to us as agents. The second question pertains to the phenomenology of the sublime. The worry here is that Deligiorgi overcomplicates the subject's experience and, in doing so, greatly restricts the scope of the sublime. (shrink)
