Resumen: Especialmente la investigación sociológica empírica realizada desde la perspectiva cualitativa se encuentra con frecuencia con la sorpresa de que los sujetos observados no hablan sobre el fenómeno estudiado. El artículo que se presenta se hace la pregunta sobre hasta qué punto este callar puede considerarse una prueba sociológica y, sobre todo, una prueba de qué. Para ello, primero parte de una experiencia concreta de investigación, un estudio que inquiriendo sobre el próximo futuro a una muestra de distintas categorías de (...) la sociedad española se encuentra con una elevada preocupación sobre el cambio climático en la perspectiva cuantitativa, pero un silencio casi absoluto sobre el fenómeno en la perspectiva cualitativa. Después de avanzar algunas interpretaciones sobre el hallazgo, se ve la necesidad de conceptualizar qué es un discurso para la sociología empírica, haciendo especialmente referencia a Foucault y Boltanski, y cuáles son sus elementos básicos e imprescindibles. Así y con base en la obra de Schutz sobre la relevancia, se alcanza la tesis de que una de las explicaciones por las que un fenómeno tan relevante como el cambio climático no llegue a la palabra de los sujetos es porque se trata de un fenómeno socialmente sedimentado y sin discurso.: Sometimes results from qualitative perspective in empirical sociological research shows that observed subjects do not talk about the phenomenon studied. This paper asks about the extent to which this silence can be considered a sociological evidence. If so, then an evidence of what. First it is presented a study that inquiries about the near future to Spanish society about climate change in a qualitative perspective, but an almost absolute silence about the subject by the qualitative perspective. After some interpretations about these results, it becomes necessary to redefine the concept of discourse for the sociological research, with special references to Foucault and Boltanski, in order to point out its basic and essential elements. In this way, we proposed that a phenomenon as relevant as climate change does not reach to daily conversation because it is socially sedimented and it has not got a discourse. (shrink)

A large body of evidence suggests that the Personalized System of Instruction (PSI) improves learning. In courses that use PSI, the material is divided into units, students must pass a test on each unit before advancing to the next unit, there’s no group-level instruction, and students advance in the course at their own pace. While studies find that PSI improves learning outcomes in a wide range of settings, researchers haven’t studied the effectiveness of PSI in critical thinking classes. In this (...) paper, I argue that teaching critical thinking with PSI can effectively promote critical thinking skills. I describe a course that uses PSI to teach critical thinking and I present evidence from pre- and post-tests that indicates that students substantially improved their reasoning skills in this course. I also discuss the costs and drawbacks of using this method of instruction and consider ways of addressing these problems. (shrink)

This paper presents an account of the nature of stem cells based on the philosophical concept of disposition. It is argued that stem cells can be conceived as dispositional objects, and adopting this attitude allows overcoming some of the controversies surrounding the nature of stemness (most notably, the state vs. entity debate) because it offers a framework that accommodates the lessons from different theories. Additionally, the account is simultaneously useful for interpreting stem cell experiments and guiding potential interventions. The account (...) shows how different levels, both molecular and emergent network-level, play the primary causal role in explaining some empirical results, and hence they suggest that the explanations can be mechanistic or topological, respectively. Our World in Data, editado por la Universidad de Oxford, es una publicación en línea que, basándose en la evidencia empírica, analiza y presenta datos completos sobre diversas temáticas a escala global. El trabajo muestra varios ejemplos de prácticas de Historia Económica a partir de los datos de PIB per cápita y gasto público social que facilita (...) la web. Pricing policies and fair-trade practices are critical for sustaining commercial relationships between firms and customers. Nevertheless, in current business practices, fairness has been mistakenly reduced to a minimalistic ethic wherein justice only demands legal and explicit norms to which commercial parties voluntarily agree. Aimed at giving a different explanation of commercial agreements, this paper will introduce a Virtue Ethics (VE) explanation of the relationship between pricing and the common good by taking up classical concepts related to justice in commerce. In (...) particular, we will explore three principles associated with the notion of fairness in commerce as defined in Neo-Aristotelian ethics towards a relationship between a common good and justice in pricing, i.e., proportionality, benevolence and well-being. To exemplify how these criteria of justice apply to decision-making in commercial practices, we will discuss several cases of fair and unfair commercial relationships. (shrink)

In his Encomium of Helen, Gorgias provides us with a variety of arguments in order to show that Helen was not to be held accountable for having eloped with Paris. The main thesis advanced in this article is that these arguments, despite their apparent diversity, are given a unitary structure by the concept of force, and by the analogy that Gorgias estalishes between persuasion, the emotions, and sense-perception on the one hand, and this concept on the other. If this argument (...) is successful, it shows that practically none of our actions are such that we are morally responsible for them. I discuss the cogency of this argument in connection with Aristotle’s objections to it. (shrink)

Este trabajo pretende detallar la concepción metafilosófica del socratismo y del aristotelismo precisando la interrelación entre teoría y praxis que ambos proyectos desarrollan. A partir de un diagnóstico común a Michel Foucault y Pierre Hadot, según el cual el saber filosófico era inseparable en la antigüedad de una “existencia filosófica”, se expone cómo concibieron tanto Sócrates como Aristóteles este peculiar “modo de vida”, concluyéndose que las raíces del “biós theoretikós” aristotélico se encuentran en la “vida examinada” defendida por el maestro (...) de Platón. En el transcurso de esta investigación, además, se pone de manifiesto que la dimensión teórica de la filosofía resulta prioritaria en ambos pensadores, si bien el descubrimiento de la verdad, propósito último de la teoría, acarrea consecuencias prácticas imposibles de alcanzar por una vía distinta de la contemplación filosófica. Se resuelve, por tanto, que la tensión entre la filosofía como “ciencia de la verdad” y como “ejercicio de vida” es un rasgo esencial del quehacer filosófico tal y como fue tematizado por estos dos grandes pensadores. En el ámbito del derecho procesal penal, particularmente en el contexto del tránsito, existe una carencia de disposiciones legales que regulen el aspecto probatorio para demostrar infracciones por parte de las autoridades competentes. Específicamente, la falta de regulación sobre el uso de fotografías o videos como evidencia dificulta el proceso de aplicación de la ley, ya que ni el COIP ni la LOTTTSV ni sus reglamentos abordan adecuadamente cómo deben obtenerse pruebas mediante medios digitales. Esta laguna normativa plantea interrogantes sobre (...) qué aspectos pueden capturarse en contenido digital, cómo llevar a cabo dicho proceso y qué requisitos deben cumplir los dispositivos utilizados. Ante esta situación, se justifica la necesidad de realizar una investigación exhaustiva para determinar qué aspectos deben incorporarse en la normativa de tránsito con el fin de garantizar un debido proceso. El objetivo principal de esta investigación fue identificar las deficiencias en la regulación del aspecto probatorio en casos de infracciones de tránsito, así como proponer recomendaciones para mejorar el marco normativo existente. Se buscó determinar qué aspectos deben ser incorporados en la normativa de tránsito para garantizar un debido proceso y una aplicación justa de la ley. Para abordar esta problemática, se llevó a cabo una investigación cualitativa con un enfoque descriptivo. Se empleó el método dogmático-jurídico analítico-sintético para analizar en detalle la legislación existente y las lagunas normativas relacionadas con la obtención de pruebas digitales en casos de infracciones de tránsito. Además, se realizaron entrevistas a expertos en derecho procesal penal y se recopiló información de jurisprudencia relevante. Este enfoque metodológico permitió una comprensión profunda de los desafíos y las posibles soluciones en este ámbito. Los resultados de la investigación revelaron importantes lagunas en la regulación del aspecto probatorio en casos de infracciones de tránsito. Se identificaron problemas relacionados con la falta de claridad en los procedimientos de obtención de pruebas digitales y la ausencia de criterios específicos para la admisibilidad de dichas pruebas en los procesos legales. Además, se destacó la necesidad de establecer estándares claros y procedimientos adecuados para garantizar la integridad y fiabilidad de la evidencia digital en el contexto del tránsito. Esta investigación resalta la importancia de abordar las deficiencias en la regulación del aspecto probatorio en casos de infracciones de tránsito. Se recomienda la implementación de medidas específicas para mejorar la recopilación y admisibilidad de pruebas digitales, así como la revisión y actualización de la normativa existente. Esto contribuirá a garantizar un proceso legal justo y transparente en el ámbito del tránsito, fortaleciendo así el Estado de derecho y la confianza en el sistema judicial. (shrink)

RESUMEN En este artículo trato de establecer que, según el Tractatus, la posibilidad de pensar que el espacio lógico fuera vacío es equivalente a la posibilidad de pensar que el mundo no hubiera existido. Tal representación viene dada por la última línea de una tabla de verdad que es una descripción completa del espacio lógico: es la línea en la que todas las proposiciones elementales son falsas. En primer lugar, argumentaré que una proposición elemental sería falsa -más que no tener (...) un valor de verdad- si fuera evaluada con respecto a un mundo posible en el que alguno de los objetos nombrados en esa proposición no existe. A continuación, tendré que mostrar que es posible que los objetos tractarianos no hubieran existido para poder concluir que es posible pensar que los objetos tractarianos no hubieran existido. Por último, estoy obligado a ofrecer una nueva interpretación del pasaje sobre la substancia.ABSTRACT In this paper I intend to establish that, according to the Tractatus, the possibility of thinking that the logical space were empty is equivalent to the possibility of thinking that the world had not existed. Such a representation is given by the bottom line of a truth-table which is a complete description of logical space: it is the line where all elementary propositions are false. Firstly, I will argue that an elementary proposition would be false -rather than lacking a truth-value- if it were evaluated with respect to a possible world in which some named object in that proposition does not exist. Then I will have to show that it is possible that the tractarian objects had not existed in order to conclude that it is possible to think that the tractarian objects had not existed. Modalities of Evil during National Socialism Resumen: Considerando que los diversos actos y atrocidades perpetrados por el nacionalsocialismo no pueden reducirse a una única teoría, a una única causa o a una única raíz, el presente artículo se propone analizar las diferentes expresiones que el mal adoptó durante el III Reich. Para ello, analizaremos los términos arendtianos de “banalidad del mal” y “mal radical”; presentaremos nuestra propuesta de lo que hemos denominado “espontaneidad del mal”; expondremos el mal que se veían (...) obligados a realizar los prisioneros de los campos de concentración; y, finalmente, atenderemos tanto a la complicidad activa como pasiva por parte del pueblo alemán. Abstract: Considering that several acts and atrocities perpetrated by National Socialism cannot be reduced to a singular theory, to a singular cause nor to a singular root, the purpose of this essay is to analyze the different expressions that evil adopted in the Third Reich. In order to do that, we will analyse the Arendtian terms “banality of evil” and “radical evil”; we will introduce the term “spontaneity of evil”; we will show the evil that prisoners of concentration camps were forced to perform; and, finally, we will pay as much attention to active as to passive collusion carried out by German people. Jackson has ellaborated an argument to show that our experiences or qualitative states gather information which cannot be obtained in any other way. Functionalists reject in many ways that experience may bring new information. The point of this paper is to argue that, if func-tionalism is right, if experiences or "qualia" are not informative, then functionalism cannot report about them. The functionalist criticism of Jackson's argument makes it impossible for any functionalist theory to know experience.

Explorar y debatir múltiples perspectivas sobre los acontecimientos del pasado es una orientación curricular tan aceptada entre los investigadores, como poco frecuente en nuestras aulas de historia. Como en entregas anteriores de esta serie de artículos, se analiza aquí esta orientación curricular a la luz de las investigaciones y experiencias publicadas, tratando de esclarecer en qué consiste, sus claves, sus prácticas más habituales y por qué resulta valiosa para los estudiantes. La multiperspectividad está en la misma esencia de la historia (...) como disciplina. Se opone a la memoria, caracterizada por relatos cerrados que imponen una única versión del pasado. En esta tensión entre disciplina y memoria, la práctica de la enseñanza de la historia ha apostado habitualmente por la segunda. Pero aprender a analizar, valorar y debatir las distintas versiones del mundo del pasado tiene mucho más valor curricular. Multiperspetividad no sólo significa comprender la verdadera naturaleza polémica, abierta y crítica de la historia, sino que es la misma base de la ciudadanía democrática. (shrink)

This is the framework for the fundamental part of the article, in which I will examine the various types of responsibility of (...) ordinary people in our western countries with regard to poverty in the world. The responsibility for taking collective and political actions to solve the problem stems from this analysis. Until this is not achieved, the responsibility for individual actions is maintained. And the meta-responsibility of showing our responsibility for this problem is required for those whose task is to communicate ideas. (shrink)

UEFA’s Financial Fair Play (FFP) regulations represent the most restrictive regulatory intervention European club football has ever seen. Put simply, it demands from clubs to operate on the basis of their own football-related incomes. While the policy has attracted considerable attention from the economic and social sciences, very few contributions systematically investigate it from a philosophical-ethical perspective. The present paper fills this research gap by posing questions on FFP in relation to fair play as a normative concept. We draw on (...) sport economic assessments concerning potential outcomes of FFP and argue that the policy should go beyond the mere pragmatic goal of promoting financial sustainability and truly aim for creating a level playing field, otherwise it should not be labeled ‘fair play’. The paper defends an interactive theory of the distinctiveness of criminal law. It argues that criminal law’s distinctive behavior can be connected to the interaction between five traits: it is an institutional practice administered by a large and special bureaucracy, playing a substantial role in authorizing the use of coercive police force, leading to a harsh sanctioning regime linked, at least in part, with core wrongs and notions of personal responsibility. Although none of these features is exclusive to criminal law, (...) their interaction leads to modes of behavior that set it apart from other institutions. The paper argues that putting attention on the effects of this interaction provides us with powerful tools to both understand and asses the value and problems of criminal law. (shrink)

The paper reads Kant’s notion of radical evil as anticipating and clarifying problematic aspects of what Arendt called ‘the banality of evil’. By reconstructing Arendt’s varied analyses of this notion throughout her later writings, I show that the main theoretical challenge posed by it concerns the adjudication of responsibility for evil deeds that seem to lack recognisable evil intentions. In order to clarify this issue, I turn to a canonical text in which the relationship between evil and responsibility plays a (...) central role: Kant’s Religion within the Boundaries of Mere Reason. Relying on an interpretation of this writing by Arendt’s mentor Karl Jaspers published in 1935, in evident connection to National Socialism, I challenge Arendt’s own interpretation of Kant’s notion of radical evil, which, I argue, represents an antecedent, rather than a contrast, to ‘the banality of evil’. Pocos temas han generado más debates en el campo de la filosofía política a lo largo de las últimas décadas que el de la justicia. Sin embargo, la mayoría de estos debates han girado en torno a qué tipo de equilibrio entre libertad e igualdad puede considerarse como justo, o qué tipo de instituciones legales y judiciales serían necesarias para ofrecer mayores niveles de justicia a los ciudadanos. Este trabajo pretende abordar el problema de la justicia desde un punto de (...) vista radicalmente distinto. A saber, la forma en la que el sujeto –el ‘hombre de carne hueso’, en palabras de Unamuno– experimenta la justicia. Dejando a un lado los ya mencionados aspectos institucionales, el objetivo de este artículo es explorar la forma en que el término justicia opera como un significante vacío en relación con la ley; y cómo esto, a su vez, permite la formación de infinidad de nociones subjetivas de justicia. Despite the increase in the research field of ethics in artificial intelligence, most efforts have focused on the debate about principles and guidelines for responsible AI, but not enough attention has been given to the “how” of applied ethics. This paper aims to advance the research exploring the gap between practice and principles in AI ethics by identifying how companies are applying those guidelines and principles in practice. Through a qualitative methodology based on 22 semi-structured interviews and two focus groups, (...) the goal of the current study is to understand how companies approach ethical issues related to AI systems. A structured analysis of the transcripts brought out many actual practices and findings, which are presented around the following main research topics: ethics and principles, privacy, explainability, and fairness. The interviewees also raised issues of accountability and governance. Finally, some recommendations are suggested such as developing specific sector regulations, fostering a data-driven organisational culture, considering the algorithm’s complete life cycle, developing and using a specific code of ethics, and providing specific training on ethical issues. Despite some obvious limitations, such as the type and number of companies interviewed, this work identifies real examples and direct priorities to advance the research exploring the gap between practice and principles in AI ethics, with a specific focus on Spanish companies.
