Considerable controversy has recently arisen regarding the patenting of medical and surgical processes in the United States. One such patent, viz. for a "chevron" incision used in ophthalmologic surgery, has especially occasioned heated response including a major, condemnatory ethics policy statement from the American Medical Association as well as federal legislation denying patent protection for most uses of a patented medical or surgical procedure. This article identifies and discusses the major legal, ethical and public policy considerations offered by proponents and (...) opponents of such patents. The existing literature divides up into those who favor such patents essentially without qualification, and those who condemn and wish to outlaw them. We advance a compromise position where administrative and legislative action is called for to provide more specific guidelines regarding the patentability of such processes by the Patent and Trademark Office. Our position, in sum, will be that too much is at stake in this complicated area for either the blanket prohibition, or wholesale, uncritical acceptance, of the patenting of medical and surgical processes or techniques. Decaying wood, while an abundant and stable resource, presents considerable nutritional challenges due to its structural rigidity, chemical recalcitrance, and low nitrogen content. Despite these challenges, certain insect lineages have successfully evolved saproxylophagy (consuming and deriving sustenance from decaying wood), impacting nutrient recycling in ecosystems and carbon sequestration dynamics. This study explores the uneven phylogenetic distribution of saproxylophagy across insects and delves into the evolutionary origins of this trait in disparate insect orders. Employing a comprehensive analysis of gut microbiome data, (...) from both saproxylophagous insects and their non‐saproxylophagous relatives, including new data from unexplored wood‐feeding insects, this Hypothesis paper discusses the broader phylogenetic context and potential adaptations necessary for this dietary specialization. The study proposes the “Detritivore‐First Hypothesis,” suggesting an evolutionary pathway to saproxylophagy through detritivory, and highlights the critical role of symbiotic gut microbiomes in the digestion of decaying wood. In early 2020, the COVID-19 pandemic forced a large portion of the world into quarantine, leading to an extensive period of stress making it necessary to explore regulatory techniques that are effective at stimulating long-lasting positive emotion. Previous research has demonstrated that anticipating positive events produces increases in positive emotion during discrete stressors. We hypothesized that state and trait positive anticipation during the COVID-19 pandemic would be associated with increased positive emotions. We assessed how often participants thought about a future (...) positive/negative/neutral event, activity, or goal through a daily reconstruction method that represented a “day in the life” of people in the United States during the early stages of the COVID-19 pandemic. The results of multi-level modeling and mediational analyses demonstrated that higher optimism, one form of trait positive anticipation, was related to higher state positive anticipation, which was in turn related to higher positive emotions during the current episode, which persisted to the next episode. In addition, both optimism and state positive anticipation were related to adaptive responses to the pandemic. These findings suggest that anticipation of future emotional experiences and hopefulness for the future can be a powerful predictor of positive emotions during global pandemics and perhaps other similar chronic stressors. When assessing the history of Afrikaners domination in South Africa and its current fragile status in the new dispensation, what becomes clear is that their claims for cultural recognition and protection turn contemporary Western discourse regarding multiculturalism on its ear. In this paper, I organize my discussion of recognition of Afrikaners in contemporary South Africa by first giving some background on Afrikaners, as well as their history and current status in South Africa. I go on to examine how the notions (...) of “cultural identity” and “cultural worth” problematize and complicate these ideas as they are employed in Western discourse of multiculturalism. (shrink)

Our primary aim in this paper is to sketch the account of virtue that we think most amenable to virtue measurement. Our account integrates Whole Trait Theory from psychology with a broadly neo-Aristotelian approach to virtue. Our account is ‘ecumenical’ in that it has appeal for a wide range of virtue ethicists. According to WTT, a personality trait is composed of a set of situation-specific trait-appropriate responses, which are produced when certain “social-cognitive” mechanisms are triggered by the perception of trait-relevant (...) stimuli in a person’s external and/or internal environment. Moving from this starting point, we discuss our conception of a virtue and respects in which it both aligns with and diverges from Aristotle’s conception. We discuss roles for practical wisdom and motivation in our conception of virtue, and highlight respects in which WTT provides an amenable empirical framework into which key Aristotelian elements can be integrated. We conclude with brief remarks about our conception as an empirically adequate and measurable account. (shrink)

Background Encounters of moral distress have long-term consequences on healthcare workers’ physical and mental health, leading to job dissatisfaction, reduced patient care, and high levels of burnout, exhaustion, and intentions to quit. Yet, research on approaches to ameliorate moral distress across the health workforce is limited. Research Objective The aim of our study was to qualitatively explore multi-professional perspectives of healthcare social workers, chaplains, and patient liaisons on ways to reduce moral distress and heighten well-being at a southern U.S. academic (...) medical center. Participants & Research Context Purposive sampling and chain-referral methods assisted with recruitment through hospital listservs, staff meetings, and newsletters. Interested participants contacted the principal investigator and all interviews were conducted in-person. Consent was attained prior to interviews. All interviews were recorded and transcribed verbatim. Research Design Directed content analysis was used to deductively organize codes and to develop themes in conjunction with the National Academy of Medicine’s National Plan for Health Workforce Well-Being. Rigor was attained through peer-debriefing, data triangulation methods, and frequent research team meetings. Ethical Considerations Ethics approval was obtained from the university and medical center institutional review boards. Findings Themes demonstrate that rather than offering interventions in the aftermath of moral distress, multilevel daily practices ought to be considered that pre-emptively identify and reduce morally distressing encounters through (1) the care team, (2) management and leadership, and (3) the health care industry. Strategies include interdisciplinary decision-making, trusting managerial relationships, and organizational policies and practices that explicitly invest in mental health promotion and diverse leadership opportunities. Conclusion Moral distress interventions ought to target short-term stress reactions while also addressing the long-term impacts of moral residue. Health systems must financially commit to an ethical workplace culture that explicitly values mental health and well-being. (shrink)

The last thirty years have seen a resurgence of interest in virtue among philosophers, psychologists, and educators. This co-authored book brings an interdisciplinary response to the study of virtue: it not only provides a framework for quantifying virtues, but also explores how we can understand virtue in a philosophically-informed way that is compatible with the best current thinking in personality psychology. The volume presents a major contribution to theemerging science of virtue and character measurement.

ABSTRACT We appreciate and respond to Cokelet’s thoughtful criticisms of our book. First, he points to deliberative forms of practical wisdom as objectionable to anti-rationalist’s. In response, we point to non-conscious (yet complex) forms of deliberation that occur as individuals automatically process and respond to virtue-relevant stimuli. Second, Cokelet states that reflecting upon one’s life as a whole may be unnecessary and ineffective for virtue development. We clarify that reflection is not the only means of virtue cultivation, and even flawed (...) reflection is likely helpful. Finally, Cokelet recommends aiming for ‘theoretical neutrality’ by recasting these core tenets as empirical hypotheses. We argue against a neutral perspective that accommodates antirationalist views that we think are on the wrong track. Non-neutral claims help generate testable empirical hypotheses that can move virtue science forward. (shrink)

How far does a researcher’s responsibility extend when an incidental finding is identified? Balancing pertinent ethical principles such as beneficence, respect for persons, and duty to rescue is not always straightforward, particularly in neuroimaging research where empirical data that might help guide decision making are lacking. We conducted a systematic survey of perceptions and preferences of 396 investigators, research participants, and Institutional Review Board members at our institution. Using the partial entrustment model as described by Richardson, we argue that our (...) data supports universal reading by a neuroradiologist of all research MRI scans for incidental findings and providing full disclosure to all participants. Analyzed F. Galton's data on the sensory, psychomotor, and physical attributes of 1,639 females and 4,849 males. The reliability of the measures, developmental trends in mean scores, correlations of the measures with age, correlations among measures, occupational differences in scores, and sibling correlations are described. Developmental trends during later childhood, adolescence, and early maturity are compared to those described in contemporary developmental psychological literature.

Using the quasi-experimental setting of the Michael Vick dogfighting case, the researchers employed rich interview content to explore the question, “When a critical event occurs in the animal advocacy field, what motivates advocacy groups to respond?” The investigation reveals that what was thought to be one critical event was in actuality three unique yet interrelated critical events— the revelation of the transgressions; the punishment of the perpetrator; and the decision about whether to ally with the perpetrator in advocacy. The study (...) shows that legitimacy concerns, occasionally paired with reflections on organizational identity, influenced the decision-making of advocacy organizations across all three critical events, as each held the potential either to legitimize or to delegitimize the advocacy organizations and/or the perpetrator. The literature on public perceptions of, and attitudes towards, nanotechnology used in the agrifood sector is reviewed. Research into consumer perceptions and attitudes has focused on general applications of nanotechnology, rather than within the agrifood sector. Perceptions of risk and benefit associated with different applications of nanotechnology, including agrifood applications, shape consumer attitudes, and acceptance, together with ethical concerns related to environmental impact or animal welfare. Attitudes are currently moderately positive across all areas of application. In his target article, Yarkoni prescribes descriptive research as a potential antidote for the generalizability crisis. In our commentary, we offer four guiding principles for conducting descriptive research that is generalizable and enduring: prioritize context over control; let naturalistic observations contextualize structured tasks; operationalize the target phenomena rigorously and transparently; and attend to individual data.

Children from low-SES families are known to show delays in aspects of language development which underpin reading acquisition such as vocabulary and listening comprehension. Research on the development of morphological skills in this group is scarce, and no studies exist in French. The present study investigated the involvement of morphological knowledge in the very early stages of reading acquisition (decoding), before reading comprehension can be reliably assessed. We assessed listening comprehension, receptive vocabulary, phoneme awareness, morphological awareness as well as decoding, (...) word reading and non-verbal IQ in 703 French first-graders from low-SES families after 3 months of formal schooling (November). Awareness of derivational morphology was assessed using three oral tasks: Relationship Judgment (e.g., do these words belong to the same family or not? heat-heater … ham-hammer); Lexical Sentence Completion [e.g., Someone who runs is a …? (runner)]; and Non-lexical Sentence Completion [e.g., Someone who lums is a…? (lummer)]. The tasks differ on implicit/explicit demands and also tap different kinds of morphological knowledge. The Judgement task measures the phonological and semantic properties of the morphological relationship and the Sentence Completion tasks measure knowledge of morphological production rules. Data were processed using a graphical modeling approach which offers key information about how skills known to be involved in learning to read are organized in memory. This modeling approach was therefore useful in revealing a potential network which expresses the conditional dependence structure between skills, after which recursive structural equation modeling was applied to test specific hypotheses. Six main conclusions can be drawn from these analyses about low SES reading acquisition: (1) listening comprehension is at the heart of the reading acquisition process; (2) word reading depends directly on phonemic awareness and indirectly on listening comprehension; (3) decoding depends on word reading; (4) Morphological awareness and vocabulary have an indirect influence on word reading via both listening comprehension and phoneme awareness; (5) the components of morphological awareness assessed by our tasks have independent relationships with listening comprehension; and (6) neither phonemic nor morphological awareness influence vocabulary directly. The implications of these results with regard to early reading acquisition among low SES groups are discussed. (shrink)

In this article, I articulate and defend an account of corporations motivated by John Searle’s discussion of them in his Making the Social World. According to this account, corporations are abstract entities that are the products of status function Declarations. They are also connected with, though not reducible to, various people and certain of the power relations among them. Moreover, these connections are responsible for corporations having features that stereotypical abstract entities lack (e.g., the abilities to take actions and make (...) profits). (shrink)

This paper analyzes a recent case in which a court, like the Daubert Court, was asked to demarcate legitimate from illegitimate science. The court was the International Court of Justice (ICJ), and it was asked by the state of Australia to find the state of Japan in violation of the International Convention for the Regulation of Whaling because of its licensing of a research program that engaged in killing whales ostensibly “for purposes of scientific research.” Australia premised a good portion (...) of its argument on a four-part definition of “scientific research,” reminiscent of the four notorious “Daubert criteria,” and the claim that the Japanese research program, “JARPA II,” failed to comply with this definition. The paper suggests that the Court’s judgment, which forced Japan to temporarily cease whaling, illustrates the merits for courts of avoiding the temptation to engage in demarcation exercises. Applied Ethics has developed first in the English-Speaking world, but since the 1970's onward, the field also developed in the french part of Canada, especially Québec. This book presens three major contributions of the field in that context for a French public; in France, applied ethics is a quite recent development (1990's). Theoretical analysis of three authors is followed by interviews with the same persons to go further in the clarifications. The authors are Pierre Fortin, Guy Durand and Georges A. (...) The Way of Ideas died an ignoble death, committed to the flames by behaviorist empiricists. Ideas, pictures in the head, perished with the Way. By the time those empiricists were supplanted at the helm by functionalists and causal theorists, a revolution had taken place in linguistics and the last thing anyone wanted to do was revive images as the medium of thought. Currently, some but not all cognitive scientists think that there probably are mental images - experiments in cognitive psychology (...) (e.g. Shepard and Metzler 1971) have shown it to be plausible to posit mental images. Even so, the phenomenon of mental imagery has been largely regarded as peripheral in cognition, perhaps even epiphenomenal. Images cannot fix the content of thought (intentions, rules), the Wittgenstein story went. The central processes of thought, so the post-Wittgenstein story goes, require a propositional representation system, a language of thought, universal and modeled on the machine languages of computers. The language of thought is compositional, productive, and, leading advocates argue, has a causal semantics. Images lack all of these essential qualities and so are hopeless as key players in thinking. (shrink)
