This paper is a response to a recent BMJ Blog: ‘The duty to treat: where do the limits lie?’ Members of the Surrey Heartlands Integrated Care Service Clinical Ethics Group reflected on arguments in the Blog in relation to resuscitation during the COVID-19 pandemic.Clinicians have had to contend with ever-changing and conflicting guidance from the Resuscitation Council UK and Public Health England regarding personal protective equipment requirements in resuscitation situations. St John Ambulance had different guidance (...) for first responders.The situation regarding resuscitation led the CEG to consider ethical aspects of health care professionals’ responses to the need for resuscitation during COVID-19. Members agreed that professionals should, ideally, have the level of PPE required for an aerosol generating procedure. However, there was no consensus regarding professionals’ duty to care when this is not available. On the one hand, it was agreed that the casualty/patient’s interests regarding resuscitation should be prioritised due to professionals’ contract with the public and professional privilege. On the other hand, risk thresholds were considered relevant to individual decision-making and professionals’ duty to care. All agreed that decision-making should not be influenced by rewards or reprimands. It was agreed also that decisions to resuscitate should not be considered as moral heroism or supererogatory - regardless of PPE availability - but rather as ‘minimally decent’. We agreed that it may be acceptable for professionals, with good reasons, to opt out of resuscitation attempts and these should be reflected on and discussed before the event. (shrink)

A large number of cross-references to various bodies of text are used in legal texts, each serving a different purpose. It is often necessary for authorities and companies to look into certain types of these citations. Yet, there is a lack of automatic tools to aid in this process. Recently, citation graphs have been used to improve the intelligibility of complex rule frameworks. We propose an algorithm that builds the citation graph from a document and automatically labels each edge according (...) to its purpose. Our method uses the citing text only and thus works only on citations who’s purpose can be uniquely identified by their surrounding text. This framework is then applied to the US code. This paper includes defining and evaluating a standard gold set of labels that cover a vast majority of citation types which appear in the “US Code” but are still short enough for practical use. We also proposed a novel linear-chain conditional random field model that extracts the features required for labeling the citations from the surrounding text. We then analyzed the effectiveness of different clustering methods such as K-means and support vector machine to automatically label each citation with the corresponding label. Besides this, we talk about the practical difficulties of this task and give a comparison of human accuracy compared to our end-to-end algorithm. (shrink)

We have synthesized a 582,970-base pair Mycoplasma genitalium genome. This synthetic genome, named M. genitalium JCVI-1.0, contains all the genes of wild-type M. genitalium G37 except MG408, which was disrupted by an antibiotic marker to block pathogenicity and to allow for selection. To identify the genome as synthetic, we inserted "watermarks" at intergenic sites known to tolerate transposon insertions. Overlapping "cassettes" of 5 to 7 kilobases (kb), assembled from chemically synthesized oligonucleotides, were joined by in vitro recombination to produce intermediate (...) assemblies of approximately 24 kb, 72 kb ("1/8 genome"), and 144 kb ("1/4 genome"), which were all cloned as bacterial artificial chromosomes in Escherichia coli. Most of these intermediate clones were sequenced, and clones of all four 1/4 genomes with the correct sequence were identified. The complete synthetic genome was assembled by transformation-associated recombination cloning in the yeast Saccharomyces cerevisiae, then isolated and sequenced. A clone with the correct sequence was identified. The methods described here will be generally useful for constructing large DNA molecules from chemically synthesized pieces and also from combinations of natural and synthetic DNA segments. 10.1126/science.1151721. SummaryThe recent atonement literature reveals a growing trend accepting the thesis that the Reformer’s doctrine just is the biblical doctrine of penal substitution. This is the claim of William Lane Craig in his recent works on the atonement. In the present article, we challenge these set of claims in Craig’s recent works and advance an alternative theory of the atonement that has some significant footing in the Reformed theological tradition, most notably reflected in the theologian, William Ames. Finally, (...) we lay out several reasons why Craig’s doctrine of the atonement fails to capture the biblical data on the atonement and fails to avoid the legal fiction problem parasitic on most, if not all, accounts of penal substitution. Is the quantum state part of the furniture of the world? Einstein found such a position indigestible, but here I present a different understanding of the wavefunction that is easy to stomach. First, I develop the idea that the wavefunction is nomological in nature, showing how the quantum It or Bit debate gets subsumed by the corresponding It or Bit debate about laws of nature. Second, I motivate the nomological view by casting quantum mechanics in a “classical” formalism (Hamilton–Jacobi (...) theory) and classical mechanics in a “quantum” formalism (Koopman–von Neumann theory) and then comparing and contrasting classical and quantum wave functions. I argue that Humeans about laws can treat classical and quantum wave functions on a par and that doing so yields many benefits. (shrink)

The 1904 World's Fair in St. Louis sponsored both an International Congress of Arts and Sciences aimed at unity of knowledge and an anthropology exhibit of diverse peoples. Jointly these represented a quest for unifying knowledge in a diverse world that was fractured by isolated specializations and segregated peoples. In historical perspective, the Congress's quest for knowledge is overshadowed by Ota Benga who was part of the anthropology exhibit. The 1904 World's Fair can be viewed as a Euro-American ritual, a (...) global pilgrimage, which sought to celebrate the advances and resolve the challenges of modernity and human diversity. Three years later Afropentecostalism dealt with these same issues with different methods and rituals. This ritual system became the most culturally diverse and fastest growing religious movement of the twentieth century. I suggest that the anthropological method of Frank Hamilton Cushing, the postcritical epistemology of Michael Polanyi, and the Afropente-costal ritual movement initiated by William J. Seymour are all attempts to develop a postmodern epistemology that is simultaneously constructive, focused on discerning reality, and broad enough to allow for human consciousness and diverse human communities. I explore this confluence of scientific and participatory epistemology through six theses. (shrink)

The idea of a canonical transformation emerged in 1837 in the course of Carl Jacobi's researches in analytical dynamics. To understand Jacobi's moment of discovery it is necessary to examine some background, especially the work of Joseph Lagrange and Siméon Poisson on the variation of arbitrary constants as well as some of the dynamical discoveries of William Rowan Hamilton. Significant figures following Jacobi in the middle of the century were Adolphe Desboves and William Donkin, while the delayed posthumous publication (...) in 1866 of Jacobi's full dynamical corpus was a critical event. François Tisserand's doctoral dissertation of 1868 was devoted primarily to lunar and planetary theory but placed Hamilton–Jacobi mathematical methods at the forefront of the investigation. Henri Poincaré's writings on celestial mechanics in the period 1890–1910 succeeded in making canonical transformations a fundamental part of the dynamical theory. Poincaré offered a mathematical vision of the subject that differed from Jacobi's and would become influential in subsequent research. Two prominent researchers around 1900 were Carl Charlier and Edmund Whittaker, and their books included chapters devoted explicitly to transformation theory. In the first three decades of the twentieth century Hamilton–Jacobi theory in general and canonical transformations in particular would be embraced by a range of researchers in astronomy, physics and mathematics. Anyone interested in the philosophy of theater will need to address Professor Hamilton’s accomplishment.The (...) leading idea in The Art of Theater is that theatrical performance is an independent art form. That is, theatrical performance, as such, is not, as Aristotle suggested by his demotion of spectacle, a mere adjunct to literature, or essentially a medium for illustrating dramatic and comedic texts. Theatrical performance itself is an art in its own right. This view of theater art has been increasingly apparent in the practices of modern theater in the West, but these practices—as exemplified by Gordon Craig, Vsevolod Meyerhold, Jacques Copeau, Bertolt Brecht, Antonin Artaud, Jerzy Grotowski, and, more recently, Robert Wilson—merely revealed what has always been the case: that theater is at root a performing art.Although for centuries theater in the West had been conceptualized as a text-based art, Hamilton maintains that this tradition is local. Theatrical performances in other cultures need not be the enactment of antecedently written-out texts. Furthermore, even within Western culture, most of us see and discuss plays without ever reading the texts upon which they are based. The counterfactual mental state of negligent criminal activity invites skepticism from those who see mental states as essential to responsibility. Here, I offer a revision of the mental state of criminal negligence, one where the mental state at issue is actual and not merely counterfactual. This revision dissolves the worry raised by the skeptic and helps to explain negligence’s comparatively reduced culpability.

For many philosophers, bad-history wrongdoers are primarily interesting because of what their cases might tell us about the interaction of moral responsibility and history. However, philosophers focusing on blameworthiness have overlooked important questions about blame itself. These bad-history cases are complicated because blame and sympathy are both fitting. When we are careful to consider the rich natures of those two reactions, we see that they conflict in several important ways. We should see bad-history cases as cases about whether and how (...) we should blame, rather than as cases giving us ready insight into the nature of moral responsibility. (shrink)

In Recovering Hegel from the Critique of Leo Strauss, Sara MacDonald and Barry Craig provide a study unique in its focus on Leo Strauss’s reading of Hegel. While MacDonald and Craig find value in Strauss’s thought, they argue that his pessimism concerning modernity lies in a misunderstanding of both modernity’s greatest philosophical advocate, G.W.F. Hegel, and modernity’s virtues.

This article is an introduction to and advertisement of Erwin Schrödinger’s little-known real-valued wave equation, the first published time dependent Schrödinger equation. I argue that this equation is not merely a historical curiosity. Not only does it show that quantum mechanics need not be viewed as essentially complex-valued, but the real formalism also provides a deep insight into the puzzling nature of time reversal in a quantum world. In the pages of philosophy journals debate rages these days between "political" and "comprehensive liberals," a debate inaugurated by John Rawls’s seminal 1985 paper entitled "Justice as Fairness: Political not Metaphysical," from which the above quotation is drawn. As the quotation suggests, a political liberal is someone who believes that liberal justice should be defined and defended in terms that are independent of "comprehensive" philosophical and religious doctrines, that is, independent of doctrines that purport to describe, in some comprehensive way, (...) the sources of meaning, purpose, and worth in human life. A comprehensive liberal, by contrast, is someone who believes some such comprehensive doctrine must be invoked in defense of liberal justice. In this debate it is perhaps fair to say that political liberals have the more prestigious roll call, for in addition to Rawls, prominent political liberals include Thomas Nagel, Brian Barry, Ronald Dworkin, Charles Larmore, and Bruce Ackerman. In a recent article Martha Nussbaum identified three problems with the Stoic doctrine of respect for dignity: its exclusive focus on specifically human dignity, its indifference to the need for external goods, and its ineffectiveness as a moral motive. This article formulates a non-Stoic doctrine of respect for dignity that avoids these problems. I argue that this doctrine helps us to understand such moral phenomena as the dignity of nonhuman animals as well as the core human values of life, freedom, (...) and equality. I end by arguing that Nussbaum underestimates the mutual support between motives of respect and other moral motives such as compassion. (shrink)

The commentaries of professors René Muller and James Phillips exemplify the two most prevalent, contrasting attitudes regarding the role and relevance of ontology for existential psychotherapy. Whereas Muller embraces the need for foundational ontology, Phillips, following the psychiatrist turned philosopher Karl Jaspers, is steadfastly suspicious of it and committed to an ontical approach based on descriptions of the experience of particular individuals. In this paper data from a Tanzanian horticultural population are used to assess whether mother’s kin network size predicts several measures of children’s health and well-being, and whether any kin effects are modified by household socioeconomic status. This hypothesis is further tested with a questionnaire on maternal attitudes towards kin. Results show small associations between measures of maternal kin network size and child mortality and children’s growth performance. Together these results suggest that kin positively influence child health, but the effects (...) are small and it is unlikely that the high prevalence of undernutrition observed in this setting is influenced by the availability of kin. Accessibly written, 'Beyond the learning curve' is a thought provoking and challenging new text for students and researchers in the cognitive sciences.

Some have thought that the process of the expansion of the universe can be used to define an absolute ‘cosmic time’ which then serves as the absolute time required by tensed theories of time. Indeed, this is the very reason why many tense theorists are happy to concede that special relativity is incompatible with the tense thesis, because they think that general relativity, which trumps special relativity, and on which modern cosmology rests, supplies the means of defining temporal becoming using (...) cosmic time. I argue that cosmic time is not up to the task, and that these tense theorists should rethink their strategy in dealing with the theories of relativity. Immanent critique has been a defining feature of the programme of critical social theory. It is a methodology that underpins theoretical diagnoses of contemporary society, based on its linking normative and empirical modes of analysis. Immanent critique distinctively seeks to discern emancipatory or democratizing tendencies. However, the viability of immanent critique is currently in question. Habermas argued that it was necessary to revise the normative foundations of critical social theory, late-capitalist developments tended to undermine immanent critique. Although there is a (...) need for critical social theory to incorporate aspects of alternative interpretations of the contemporary period, the logics of influential theoretical perspectives on the present, especially postmodernism, the risk society and globalization, will be shown to be inconsistent with some of immanent critique's presuppositions. The synthetic aspirations of critical social theory nevertheless persist in recent attempts to reconcile positive liberty and social justice. (shrink)

Now, in this intriguing introduction to Indian philosophy, the diversity of Indian thought is emphasized. It is structured around six schools of thought that have received classic status. We attempt to remedy that by placing canon in its historical and philosophical context, exploring and rejecting several common accounts, and presenting some basics of how canon works. In lieu of an abstract, here is a brief excerpt of the content:Journal of the History of Ideas 63.3 (2002) 521-537 [Access article in PDF] Two Routes "to Concreteness" in the Work of the Bakhtin Circle Craig Brandist In 1918 the young Georg Lukács published an obituary of the last major Baden School neo-Kantian Emil Lask in which the latter's varied work was commended for being "underlain by an essential common drive [Drang]: the drive to concreteness." 1 This "drive" (...) was especially problematic, however, in the work of thinkers overtly committed to neo-Kantianism, a doctrine that was in its own time a byword for abstruseness and academic abstraction. Just how concrete could a neo-Kantian idealism become without abandoning its core insistence that the world is "produced" by indwelling categories of mind? Lask pursued this problem with a thoroughness unmatched by any other German neo-Kantian, and in doing so he became an important influence on, among others, Lukács, Max Weber, and Martin Heidegger. This article discusses the prevalence of the same "drive" in the varied work of those Russian champions of neo-Kantianism, the Bakhtin Circle, where "concreteness" is invoked so frequently that it almost begins to take on the character of a mantra. The case of the Bakhtin Circle is especially illustrative because the "drive to concreteness," which all members of the Circle shared, resulted in a significant difference of opinion about the extent to which the central theses of neo-Kantianism can be salvaged. Like Lask, Bakhtin was particularly keen to maintain the core of neo-Kantian ideas, while Voloshinov and, following behind him, Medvedev, were much less averse to breaking with the central project of German idealism itself. In each case the Brentanian notion of intentionality, the doctrine that consciousness is always consciousness of something, plays a central role. Consciousness exists in acts directed towards objects, existent or otherwise, that are given to consciousness. Brentano and his followers were invariably anti-Kantian, and they were extremely hostile to the central tenet of neo-Kantian idealism, that objects of consciousness are "produced" from categories dwelling in a transcendental [End Page 521] "consciousness in general" (Bewusstsein überhaupt). While it is far from certain that Brentanian and Kantian principles are incompatible at every level, there is no doubt that any attempt to integrate the notion of intentionality into neo-Kantianism was going to threaten the basis of neo-Kantianism as such. 2 As Gabriel Motzkin notes, Lask's attempt to carry such a project through to its logical conclusion ultimately led to "the destruction of the neo-Kantian empire from within." 3 The Bakhtinian project led in precisely this direction, and this article examines the way in which the work of the Circle shows distinct and ultimately incompatible responses to the crisis of the "empire." Revising neo-Kantianism: Ernst Cassirer and Emil Lask The abstract, or what Bakhtin terms the "theoretist," character of neo-Kantianism derived from two fundamental and interrelated features. The first was a principled opposition to all distinctions between cognition and perception, and the second was an identification of subjectivity with the system of objectifying functions that have their true being in cultural documents. According to neo-Kantian principles, nothing is "given" and everything is posited in an act of subjective spontaneity: objects are constituted from transcendental categories dwelling in "pure consciousness." Summing up the philosophical project of Hermann Cohen, the leader of the Marburg School, Ernst Cassirer noted that "any appeal to a merely given should fall aside; in place of every supposed foundation in things there should enter the pure foundations of thinking, of willing, of artistic and religious consciousness." 4Though seeking to broaden his own enquiry beyond the "trichotomy of the Kantian Critiques," Cassirer, the last major Marburg neo-Kantian, remained wedded to the neo-Kantian project of deriving the transcendental preconditions of the "formations" in which the "objective spirit... consists and exists" and dealt only with a universal subject devoid of practical limitations. 5 Cassirer drew close to phenomenology in the 1920s, when he embarked on his great project The Philosophy of Symbolic Forms, presenting...
