Background: Organ donation and transplantation have made it possible to both save life and to improve the quality of life for a large number of patients. In the last years there has been an increasing gap between the number of patients who need organs and organs available for transplantation, and the focus worldwide has been on how to meet the organ shortage. This also rises some ethical challenges. Objective: The objective of this study was to explore healthcare professionals' experience of (...) ethics related to care and interaction with critically ill patients with severe brain injuries and their families. Research design: A hermeneutic phenomenological approach was used to explore the participants' experiences. Methods for collecting data were a combination of participant observations and in-depth interviews. Participants and research context: Two ICUs in a Norwegian university hospital were recruited for data collection. A total of 12 cases were observed, and 32 of the healthcare professionals involved were interviewed. Ethical considerations: The study was approved by the Regional Committee for Research Ethics. Permission to the study in the ICUs was obtained from the Chief Physician in the two ICUs respectively. The right of the participants was ensured by written, voluntary, and informed consent. Findings: From the thematic analysis, a structure of the participants' experiences emerged as a process. While the patients' condition was clarified through phases of prognostic ambiguity, gradual clarification and prognostic certainty, interaction with the families was characterized by ambiguity that involved withholding. The prognostic process had a great impact on how the healthcare professionals interacted with the family. The interaction challenged the participants' caring values in various ways and captured an important structure in their experiences of the ethical interaction with the patients' families. These challenges distinguish caring for families in donation situations from caring for relatives of critically ill patients in general. Discussion: In the discussion we have illuminated how professional ethics may be threatened by more pragmatic and utilitarian arguments contained in regulations and transplant act. Conclusion: Ethical questions should be discussed more both in educations of healthcare professionals and in clinical practice. (shrink)

Across cultures people construct spatial representations of time. However, the particular spatial layouts created to represent time may differ across cultures. This paper examines whether people automatically access and use culturally specific spatial representations when reasoning about time. In Experiment 1, we asked Hebrew and English speakers to arrange pictures depicting temporal sequences of natural events, and to point to the hypothesized location of events relative to a reference point. In both tasks, English speakers (who read left to right) arranged (...) temporal sequences to progress from left to right, whereas Hebrew speakers (who read right to left) arranged them from right to left, replicating previous work. In Experiments 2 and 3, we asked the participants to make rapid temporal order judgments about pairs of pictures presented one after the other (i.e., to decide whether the second picture showed a conceptually earlier or later time-point of an event than the first picture). Participants made responses using two adjacent keyboard keys. English speakers were faster to make “earlier” judgments when the “earlier” response needed to be made with the left response key than with the right response key. Hebrew speakers showed exactly the reverse pattern. Asking participants to use a space-time mapping inconsistent with the one suggested by writing direction in their language created interference, suggesting that participants were automatically creating writing-direction consistent spatial representations in the course of their normal temporal reasoning. It appears that people automatically access culturally specific spatial representations when making temporal judgments even in nonlinguistic tasks. (shrink)

In quantum mechanics, the expression for entropy is usually taken to be -kTr(ln), where is the density matrix. The convention first appears in Von Neumann's Mathematical Foundations of Quantum Mechanics. The argument given there to justify this convention is the only one hitherto offered. All the arguments in the field refer to it at one point or another. Here this argument is shown to be invalid. Moreover, it is shown that, if entropy is -kTr(ln), then perpetual motion machines are possible. (...) This and other considerations support the conclusion that this expression is not the quantum-mechanical correlate of thermodynamic entropy. Its usefulness in quantum-statistical mechanics can be explained by its being a convenient quantification of information, but information and entropy are not synonymous. There are good reasons to endorse scientific realism and good reasons to endorse common-sense realism. However, it has sometimes been suggested that there is a tension between the two which makes it difficult to endorse both. Can the common-sense picture of the world be reconciled with the strikingly different picture presented to us by our best confirmed theories of science? This chapter critically examines proposals for doing so, and it offers a new one, which is essentially this. It is a (...) psychological fact that we have certain common-sense beliefs. In the framework of reductive physicalism, all beliefs, including the common-sense ones, are nothing but brain states and processes. Being scientifically realist about these brain states and accepting the reductive-physicalist view of the mind, we can account for the psychological fact that we have certain common-sense beliefs with certain contents, without committing to the idea that the contents of these common-sense beliefs have to be true of the world. In this coherentist approach we are not required to relinquish our common-sense beliefs, since although they are false according to science, this very same science shows that holding those beliefs is fully rational. This book provides a conceptual foundation for statistical mechanics, which is - more generally - a conceptual framework for understanding natural kinds, which later became the conceptual framework for our reductive-physicalist view of the mind called Flat Physicalism.

Hannah Arendt was fearful not only of a populist President speaking in the name of the people and unbound by legality. She was also concerned that popular support could be harnessed by those responsible for limiting it. In other words, she was fearful of the American Supreme Court relying on popular support. This is the meaning of her obscure depiction of the American Supreme Court as “the true seat of authority in the American Republic” but unfit to power. I argue (...) that Arendt's characterization of authority as requiring “neither coercion nor persuasion” means that the Court's source of legitimacy is expertise rather than public support. Yet the current dominant understanding among American Justices as well as scholars is that public support is the source of the Court's authority. In Arendt's mind, such an understanding means that the Court has become the seat of power. The corruption of the Court's authority and constitutional law as a language of expertise capable of resisting public opinion will inevitably follow. (shrink)

Manipulating sensory and motor cues can cause an illusionary perception of ownership of a fake body part. Presumably, the illusion can work as long as the false body part’s position and appearance are anatomically plausible. Here, we introduce an illusion that challenges past assumptions on body ownership. We used virtual reality to switch and mirror participants’ views of their hands. When a participant moves their physical hand, they see the incongruent virtual hand moving. The result is an anatomically implausible configuration (...) of the fake hand. Despite the hand switch, participants reported significant body ownership sensations over the virtual hands. In the first between-group experiment, we found that the strength of body ownership over the incongruent hands was similar to that of congruent hands. Whereas, in the second within-group experiment, anatomical incongruency significantly decreased body ownership. Still, participants reported significant body ownership sensations of the switched hands. Curiously, we found that perceived levels of agency mediate the effect of anatomical congruency on body ownership. These findings offer a fresh perspective on the relationship between anatomical plausibility and assumed body ownership. We propose that goal-directed and purposeful actions can override anatomical plausibility constraints and discuss this in the context of the immersive properties of virtual reality. (shrink)

Abstract The idea of ?election? cannot be approached, it seems, through traditional or classical philosophical conceptuality. This idea requires another type of discourse. Not simply because this idea refers to an entirely other body of texts, that of the Biblical tradition, but more radically since it commands another modality of thought which must at once suspend and pursue philosophical concepts to the point where they express themselves otherwise than according to the rationality of their own deployment. In truth, the idea (...) of ?election? calls thus for a redefinition of the rapport between singularity and universality, one no longer structured and circumscribed by ?truth?, but rather inspired by a novel and irreducible modality of ?justice?. A ?justice? which opens to the possibility for an ?ethics?, not as ?communicative dialogue?, ?mutual recognition? or a series of established and rationally grounded laws, but a ?place? of incessant and irresolute, non-intentional and unconditional exposition to the Other. We agree with Cramer et al. that pure cases of behavioral disorders with no symptom overlaps are rare. However, we argue that disorders do exist and the network idea is limited and limiting. Networks of symptoms are observed mainly at behavioral levels. The core deficit is commonly at the cognitive or brain levels, and there the story is completely different.

This article considers ethical dilemmas that nurse managers may confront and suggests an ethical decision-making model that could be used as a tool for resolving such dilemmas. The focus of the article is on the question: Can nurse managers choose the ethically right solution in conflicting situations when nurses’ rights collide with patients’ rights to quality care in a world of cost-effective and economic constraint? Managers’ responsibility is to ensure and facilitate a safe and ethical working environment in which nurses (...) are able to give quality care to their patients. In nursing it is frequently declared that managers’ main obligations are to patients’ needs and their rights to receive quality care. However, managers’ ethical responsibilities are not only to patients but also to the nurses working in their institution. This article describes a real (but disguised) situation from an Israeli health care context to illustrate the dilemmas that may arise. The question is posed of whether nurse managers can maintain patients’ and nurses’ rights and, at the same time, fulfill their obligation to the conflicting demands of the organization. Postpartum mood disorders develop shortly after childbirth in a significant proportion of women and have severe effects. Two evolutionary explanations are currently available. The first is that poor postpartum mental health is a consequence of an evolutionary trade-off – a compromise of neurological changes in the maternal brain during pregnancy which, on the one hand, maintain pregnancy, and on the other, increase the likelihood for postpartum women to develop psychopathology. The second explanation is that poor postpartum mental health is a (...) disease of civilization. This theoretical paper demonstrates that both explanations ignore the crucial event of childbirth. I elaborate on environmental features of childbirth, a physiological process that is substantially different in the current versus evolutionary childbirth and postpartum setting, and argue that maternal brain neuroplasticity and biochemical alterations are not an evolutionary trade-off, but an adaptation. Additionally, the incidents of poor postpartum mental health are better viewed as a maladaptation of the typical modern environments – an evolutionary mismatch. Thus, the potential to suffer from poor mental health in postpartum is an external, contingent happening, dependent on contemporary childbirth and postpartum environments, and not due to any essential property women possess as a result of evolutionary compromise. In fact, women are probably adapted to feel like superwomen right after birth, a state of mind that is an aid in adapting to motherhood. Distinguishing between evolutionary concepts in the context of pregnancy, birth, and motherhood is vital for developing more accurate preventions and interventions. (shrink)

In recent papers, Eric Schwitzgebel argues that if physicalism is true, then the United States is probably conscious. My primary aim here is to demonstrate that the source of Schwitzgebel’s conditional argument is the “Problem of Other Minds,” which is a general problem; wherefore, Schwitzgebel’s conclusion should be revised and applied not only to physicalism, but to most contemporary theories of the mind. I analyze the difference between Schwitzgebel’s argument and other arguments against functionalism, arguing that the difference between them (...) is rooted in referring to the causal role of the whole system, rather than referring to the casual role of the system’s parts. This key difference between functionalism and behaviorism explains why the source of Schwitzgebel’s argument stems from the problem of other minds. I conclude that however counterintuitive from a metaphysical point of view, the United States may have its own stream of consciousness, but it has nothing to do with physicalism in particular. The legal language of lawyers and judges is generally dry and factual but an examination of the rulings of Israeli Supreme Court justices shows that at least some of them use very picturesque speech to support their positions. This paper describes the use of figurative language as employed by Israeli Supreme Court justices in their writing of verdicts. Examples of the use of metaphors, metonymy, word play, imagery, oxymorons, parables and allegory are cited and discussed.

This article proposes an analysis of the social process of unsilencing in the specific context of heterosexual relationships. Unsilencing is the process in which an individual woman becomes empowered to the extent of voicing what is silenced by structural hierarchies that shape her experiences of the heterosexual relationships she is involved in. I connect the process of unsilencing to the sociological notion of “negotiated order” and a feminist notion of the self as fragmented and continually changing. Unsilencing is conceived as (...) a response to power operating on three levels: emotional connection that empowers a contesting meaning structure; a process of distancing that empowers the individual in overcoming positioning processes; and an increased sense of authenticity in relation to the set of emotional management, language and beliefs embedded in the contesting meaning structure. Interventionism is an approach to the foundations of statistical mechanics which says that to explain and predict some of the thermodynamic phenomena we need to take into account the inescapable effect of environmental perturbations on the system of interest, in addition to the system's internal dynamics. The literature on interventionism suffers from a curious dual attitude: the approach is often mentioned as a possible framework for understanding statistical mechanics, only to be quickly and decidedly dismissed. The present paper is an (...) attempt to understand this attraction-repulsion story. It offers a version of interventionism that appears to be defensible, and shows that this version can meet the main objections raised against it. It then investigates some of the philosophical ideas underlying interventionism, and proposes that these may be the source of the resentment interventionism encounters. This paves the way to see some features and consequences of interventionism, often taken to be shortcomings, as philosophically advantageous. (shrink)

This work examines Richard Kilvington's Sophisma 47, in the context of the Doctrine of Obligations. Its aim is to revise the thesis of P. V. Spade, who attributes to Kilvington an intermediate position between Burley and Swyneshed, and interprets the Doctrine of Obligations in general as a Theory of Counterfactuals.

The text provides a political reading of Shakespeare’s Macbeth, claiming that the play is responding to the curious connection between witchcraft and state power in the preceding century, as well as contemporary political events. Namely, practices variously labeled as witchcraft, magic, conjuring were an integral aspect of English politics and struggles over royal succession in the sixteenth century; even more so were the witch hunts and attempts by British monarchs to control witchcraft. These issues reached a head with the accession (...) of James VI of Scotland to the English throne in 1603, and the Gunpowder Plot in 1605. On the surface, Shakespeare’s play, written in the immediate aftermath of the failed attempt at regicide, brings these historical and political issues together in an effort to legitimize James’ rule. However, the article shows that a closer look reveals a more complicated, indeed subversive undercurrent at play. Paradoxically, while Macbeth does provide James with legitimacy, at the same time it calls into question the grounds of that legitimacy. (shrink)

The appearance of multiple realization of the special sciences kinds by physical kinds can be fully explained within a type-identity reductive physicalist framework, based on recent findings in the foundations of statistical mechanics. This has been shown in Hemmo and Shenker. However, while this account is available for special sciences like biology and thermodynamics, it is unavailable for psychology. Therefore the only coherent physicalist account of psychology is a type-type identity account. The so-called “non reductive” physicalism turns out to be (...) an incoherent idea, and functionalism and supervenience cannot salvage it. At the same time, within a type-identity account properly understood one can give a full account of the anomaly of psychology and understand in what sense the special sciences - including psychology - are autonomous. The present study examines the representation of Arabic and Hebrew in Covarrubias’s Tesoro de la lengua castellana o española from a comparative perspective. Analyzing the lexicographer’s ideological and meta-linguistic discourse, I reconstruct his postulates regarding the respective histories of Arabic and Hebrew, their interrelationship, and place in the history of Spanish. In light of these postulates, and taking into account the lexicographer’s access to knowledge, sources, and informants, I examine some of his etymological practices, focusing on his attempts to use (...) grammatical and lexical knowledge of Hebrew to illuminate Arabic etymologies of Spanish words. Combining the ideological and technical levels of the text, I reflect on the interplay of knowledge and ignorance in Covarrubias’s treatment of Semitic languages. (shrink)
