Money, for instance, was not continuous, but was kept in place only sporadically and with the broadest hints of violence. In Guatemala City, sixteen-year-old Mayan kids in army camouflage with submachine guns were stationed on every street corner where there was (...) a bank. But the local remained thoroughly distant from any would-be universal. An elderly middle-aged Mayan man at a market outside the capital balked rather indignantly when I gave him a paper bill to pay for the chair we had agreed I would buy; the woman at the stand next to him urged him to accept the money saying. “Se sirve! Se sirve!” (It—paper money—works! It works!)Nor was geography continuous. Knowledge of the country was both guarded and somewhat fantastic. It was impossible to obtain a map of the interior (guerrilla trouble). We spent one long afternoon negotiating our way into a bureaucratic building where, after signing our names in a notebook, we were allowed a glimpse at some antique maps that, in my memory at least, verged on watercolors. We hooked up with a Chinese archeologist from Iowa State who directed us to Sayache, which we reached after a six-hour busride and a trip across the Uxamachinto River in a mahogany dugout. There was one hotel in town, owned by a man who was also mayor, judge, and, clearly, king. He joined us for dinner. In the dining room we saw an old map that showed Guatemala with a large bulge stretching northeast to the Gulf of Mexico. The longlasting territorial dispute between Guatemala and Britain that resulted in the creation of British Honduras, which then became Belize, had been finally resolved, at least on this framed print which showed Belize as fully dissolved into Guatemala. When I asked the mayor about the map he replied that Belize belonged to Guatemala, had always been part of Guatemala. In response to some tentative question of mine about negotiation or tactics, he said of Belize, pounding his fist on the table, “Tomalo!” (Take it!)Alien, Point-Blank, Green, and ActualThe vagaries of mapping and the intermittent condition of value that these old home movies demonstrate strike me as suggestive for figuring the relations between poetry to its institutional or generic neighbors, theory and literary criticism. In a larger and more theoretically committed piece I would want to specify the different discursive regimes with some precision, but here I will use “theory” as a shorthand for everything that goes on in literature departments, even though this shortcircuits the large conflicts currently raging about the nature of the profession; “poetry,” in this same shorthand, should therefore equal what gets taught and reproduced in creative writing departments and writing workshops, though ultimately I will be proposing a differently oriented writing as what I want for poetry. But for now the words on the map will be “poetry” and “theory”—even if they also flood me with defensiveness and apathy, especially when it comes to theory. “Theory”? Postcolonial studies? Marxism? Queer theory? Deconstruction? Cultural studies? Film studies? What is the investment in holding onto this dichotomy?AL: There’s a familiar split in the notion of what a creative act is. That split, in our culture, (...) involves an idea of creativity as being natural and expressive: a poet has no need to have thought about anything in order to make a poem; the enemy is the analytical. This is a long-standing divisive space, certainly within the academy but also in the culture at large.JM: Over the past thirty years or so that space became institutionalized to greater and lesser degrees within the academy in the United States in the familiar tensions that came to exist in many universities between Creative Writing programs and programs in literary theory. Although both kinds of programs acquired substantial institutional power at a roughly similar pace, they’ve often seemed to move along parallel tracks that communicated with each other poorly or at cross-purposes. How do you see their prospects developing midway through the nineties?CB: Let me come at this in a different way. I think there’s enormous value in poets teaching literature in graduate as well as undergraduate programs. We need to have many different perspectives and methodologies in the classroom. The aim of the paper is to compare and contrast a few select ways in which the poetic use of parataxis can convey a specific political message. Parataxis is understood here broadly, as a certain organizational principle based on a cycle of denarrativization and renarrativization. The first part of the paper reflects on the role the paratactic technique has played within the language of the reactionary populists, both historically and in the recent years. Then, building on the observation that the (...) denarrativized, seemingly „straightforward” nature of the paratactic speech makes it particularly useful for the purposes of right-wing populism, I ask whether parataxis can be reclaimed as a progressive force. In order to answer this question, I go back to some of the issues discussed by Ron Silliman, Fredric Jameson and Bob Perelman in the context of the Language movement and the so-called New Sentence. Here, the work of de- and renarrativization performed as a consequence of the paratactic loosening of conventional textual links and structures is seen as a direct response to the denarrativized nature of everyday life under late capitalism. In the final part of the paper, I contrast the New Sentence parataxis with a more practical, more spontaneous approach embodied by June Jordan. The paratactic structures of her writing remain focused on denarrativization in all of its disruptive and provocative potential, allowing for a certain kind of immediate political intervention. Bob Hale presents a broadly Fregean approach to metaphysics, according to which ontology and modality are mutually dependent upon one another. He argues that facts about what kinds of things exist depend on facts about what is possible. Modal facts are fundamental, and have their basis in the essences of things--not in meanings or concepts.

There are many modal epistemologies available to us. Which should we endorse? According to Bob Hale, we can start to answer this question by examining the architecture of modal knowledge. That is, we can try to decide between the following claims: knowing that p is possible is essentially a matter of having a well-founded belief that there are no conflicting necessities—a necessity-based approach—and knowing that p is necessary is essentially a matter of having a well-founded belief that there are no (...) conflicting possibilities—a possibility-based approach. Hale argues for the first of these claims, but I contend that his arguments fail. However, it doesn't follow that we should endorse a possibility-based approach. I repurpose Hale's arguments to show those who would endorse possibility-based approaches need to say more about our modal knowledge concerning logic and mathematics; if they can't, then they ought to endorse a hybrid modal epistemology that doesn't give priority to one modality across the board. Additionally, those who endorse possibility-based views may be committed to Peter van Inwagen's modal skepticism. (shrink)

Background: In Ontario, Canada, patients who lack decision-making capacity and have no family or friends to act as substitute decision-makers currently rely on the Office of the Public Guardian and Trustee to consent to long-term care (nursing home) placement, but they have no legal representative for other placement decisions. Objectives: We highlight the current gap in legislation for difficult transition cases involving unrepresented patients and provide a novel framework for who ought to assist with making these decisions and how these (...) decisions ought to be made. Research design: This paper considers models advanced by Volpe and Steinman with regard to who ought to make placement decisions for unrepresented patients, as well as current ethical models for analyzing how these decisions should be made. Participants and research context: We describe an anonymized healthcare transition case to illustrate the fact that there is no legally recognized decision-maker for placement destinations other than long-term care facilities and to show how this impacts all stakeholders. Ethical considerations: The case provided is an anonymized vignette representing a typical transition case involving an unrepresented patient. Findings: As a result of a gap in provincial legislation, healthcare providers usually determine the appropriate placement destination without a clear framework to guide the process and this can cause significant moral distress. Discussion: We argue for a team decision-making approach in the short term, and a legislative change in the long-term, to respect the patient voice, evaluate benefit and risk, enhance collaboration between healthcare providers and patients, and promote social justice. We believe that our approach, which draws upon the strengths of interprofessional teams, will be of interest to all who are concerned with the welfare and ethical treatment of the patients for whom they care. Conclusions: One of the main strengths of our recommendation is that it provides all members of the healthcare team (including nurses, social workers, therapists, and others) an increased opportunity to advocate on behalf of unrepresented patients. This paper argues that we should assign certainty a central place in epistemology. While epistemic certainty played an important role in the history of epistemology, recent epistemology has tended to dismiss certainty as an unattainable ideal, focusing its attention on knowledge instead. I argue that this is a mistake. Attending to certainty attributions in the wild suggests that much of our everyday knowledge qualifies, in appropriate contexts, as certain. After developing a semantics for certainty ascriptions, I put certainty to explanatory (...) work. Specifically, I argue that by taking certainty as our central epistemic notion, we can shed light on a variety of important topics, including evidence and evidential probability, epistemic modals, and the normative constraints on credence and assertion. Although many organizations around the world have engaged in corporate social responsibility programing, there is little evidence of social impact. This is a problematic omission since many programs carry the stigma of marketing ploys used to bolster organizational image or reduce consumer skepticism. To address this issue and build on existing scholarship, the purpose of this study was to evaluate a socially responsible youth employability program in the United Kingdom. The program was developed through the foundation of a professional British (...) soccer team to bolster employability and life skills for marginalized London youth. Program funding was provided by a large multinational bank as part of their CSR agenda. This evaluation was undertaken to understand the beneficiary impacts associated with program deployment. Results from the pre-intervention/post-intervention, sequential mixed-method evaluation show statistically significant differences among several “soft” beneficiary outcomes. However, results are mixed regarding whether the “hard” outcome of employment was achieved by program participants. Qualitative findings buttress these results, indicating a high level of motivation for work, attitude enhancement, and satisfaction with program delivery. (shrink)

The New Rhetoric is founded on the idea that since “argumentation aims at securing the adherence of those to whom it is addressed, it is, in its entirety, relative to the audience to be influenced,” says Chaïm Perelman and L. Olbrechts-Tyteca, and they rely, in particular, for their theory of argumentation on the twin concepts of universal and particular audiences: while every argument is directed to a specific individual or group, the orator decides what information and what approaches will (...) achieve the greatest adherence according to an ideal audience. This ideal, Perelman explains, can be embodied, for example, "in God, in all reasonable and competent men, in the man deliberating or in an elite.” Like particular audiences, then, the universal audience is never fixed or absolute but depends on the orator, the content and goals of the argument, and the particular audience to whom the argument is addressed. These considerations determine what information constitutes "facts" and "reasonableness" and thus help to determine the universal audience that, in turn, shapes the orator's approach. /// The adherence of an audience is also determined by the orator's use of values, a further key concept of the New Rhetoric. Perelman's treatment of value and his view of epideictic rhetoric sets his approach apart from that of the ancients and of Aristotle in particular. Aristotle's division of rhetoric into three genres–forensic, deliberative, and epideictic–is largely motivated by the judgments required for each: forensic or legal arguments require verdicts on past action, deliberative or political rhetoric seeks judgment on future action, and epideictic or ceremonial rhetoric concerns values associated with praise or blame and seeks no specific decisions. For Aristotle, the epideictic genre was of limited importance in the civic realm since it did not concern facts or policies. Perelman, in contrast, believes not only that epideictic rhetoric warrants more attention, but that the values normally limited to that genre are in fact central to all argumentation. "Epideictic oratory," Perelman argues, "has significant and important argumentation for strengthening the disposition toward action by increasing adherence to the values it lauds.” These values are central to the persuasiveness of arguments in all rhetorical genres since the orator always attempts to "establish a sense of communion centered around particular values recognized by the audience.”. This book is a collection of essays written by Bob Hale (three co-authored), with a critical introduction from Kit Fine. They comprise Hale’s final years of work, adding to and extending beyond his landmark monograph Necessary Beings: An Essay on Ontology, Modality, and the Relations Between Them (OUP, 2013, 2nd edition 2015). The essays develop and consolidate several key themes in Hale’s work, most notably the notion of definition, especially as it extends beyond definition of a word to definition of (...) a thing more generally, and its relations to essence and existence; how the recently influential notion of truthmaking relates to and illuminates some of these issues; and ontological questions connected with Hale’s metaphysical commitments on the one hand, and his commitments in the foundations of mathematics on the other. Several of the essays engage with and respond to work by Kit Fine, and contributions to Being Necessary: Themes of Ontology and Modality from the Work of Bob Hale (OUP 2018). BackgroundIn the Canadian Alliance for Healthy Hearts and Minds (CAHHM) cohort, participants underwent magnetic resonance imaging (MRI) of the brain, heart, and abdomen, that generated incidental findings (IFs). The approach to managing these unexpected results remain a complex issue. Our objectives were to describe the CAHHM policy for the management of IFs, to understand the impact of disclosing IFs to healthy research participants, and to reflect on the ethical obligations of researchers in future MRI studies.MethodsBetween 2013 and 2019, 8252 participants (...) (mean age 58 ± 9 years, 54% women) were recruited with a follow-up questionnaire administered to 909 participants (40% response rate) at 1-year. The CAHHM policy followed a restricted approach, whereby routine feedback on IFs was not provided. Only IFs of severe structural abnormalities were reported.ResultsSevere structural abnormalities occurred in 8.3% (95% confidence interval 7.7–8.9%) of participants, with the highest proportions found in the brain (4.2%) and abdomen (3.1%). The majority of participants (97%) informed of an IF reported no change in quality of life, with 3% of participants reporting that the knowledge of an IF negatively impacted their quality of life. Furthermore, 50% reported increased stress in learning about an IF, and in 95%, the discovery of an IF did not adversely impact his/her life insurance policy. Most participants (90%) would enrol in the study again and perceived the MRI scan to be beneficial, regardless of whether they were informed of IFs. While the implications of a restricted approach to IF management was perceived to be mostly positive, a degree of diagnostic misconception was present amongst participants, indicating the importance of a more thorough consent process to support participant autonomy.ConclusionThe management of IFs from research MRI scans remain a challenging issue, as participants may experience stress and a reduced quality of life when IFs are disclosed. The restricted approach to IF management in CAHHM demonstrated a fair fulfillment of the overarching ethical principles of respect for autonomy, concern for wellbeing, and justice. There is public support in the United States and Europe for accounting for animal welfare in national policies on food and agriculture. Although an emerging body of research has measured animals’ capacity to suffer, there has been no specific attempt to analyze how this information is interpreted by the public or how exactly it should be reflected in policy. The aim of this study was to quantify Americans’ preferences about farming methods and the suffering they impose on different species to (...) generate a metric for weighing the trade-offs between different approaches of promoting animal welfare. A survey of 502 residents of the United States was implemented using the online platform Mechanical Turk. Using respondent data, we developed the species-adjusted measure of suffering-years, an analogue of the disability-adjusted life year, to calculate the suffering endured under different farming conditions by cattle, pigs, and chickens, the three most commonly consumed animals. Nearly one-third of respondents reported that they believed animal suffering should be taken into account to a degree equal to or above human suffering. The 2016 suffering burden in the United States according to two tested conditions was approximately 66 million SAMYs for pigs, 156 million SAMYs for cattle, and 1.3 billion SAMYs for chickens. This calculation lends early guidance for efforts to reduce animal suffering, demonstrating that to address the highest burden policymakers should focus first on improving conditions for chickens. Authored by an extraordinary and politically diverse roster of public officials, scholars, and educators, these chapters describe our nation's civic education problem, assess its causes, offer an agenda for reform, and explain the high stakes at risk if we fail.

The article builds on current research into the effects and harms of hate speech in the lives of its victims. It introduces the anthropological concept of everyday violence to focus on hate speech as an everyday experience as opposed to a sequence of separate hate speech acts. Methodologically, the study is based on a qualitative approach and analyses data collected via semi-structured interviews (N=33) with people who have experienced hate speech in four EU member states (Italy, Germany, the Czech Republic (...) and Portugal). The analysis documents four overlapping themes of how hate speech manifests as the everyday experience of “living hated”—hate speech as a flow; its spatial dimension of moving across online and offline contexts; its long-term effects, leading to what we call “cumulative desensitization” (aggravated during the COVID-19 pandemic); and the role of support systems and their (in)effectiveness. The article concludes by suggesting possible applications as well as avenues for future research that could provide a deeper understanding of hate speech as the daily life experience of its targets. The past decade has seen a protracted debate over the semantics of epistemic modals. According to contextualists, epistemic modals quantify over the possibilities compatible with some contextually determined group’s information. Relativists often object that contextualism fails to do justice to the way we assess utterances containing epistemic modals for truth or falsity. However, recent empirical work seems to cast doubt on the relativist’s claim, suggesting that ordinary speakers’ judgments about epistemic modals are more closely in line with contextualism than relativism (...) (Knobe & Yalcin 2014; Khoo 2015). This paper furthers the debate by reporting new empirical research revealing a previously overlooked dimension of speakers’ truth-value judgments concerning epistemic modals. Our results show that these judgments vary systematically with the question under discussion in the conversational context in which the utterance is being assessed. We argue that this ‘QUD effect’ is difficult to explain if contextualism is true, but is readily explained by a suitably flexible form of relativism. (shrink)

Axis specification is the first step in defining specific regions of the developing embryo. Embryos exploit asymmetries, either pre‐existing in the egg or triggered by external cues, to establish embryonic axes. The axial information is then used to generate regional differences within the embryo. In this review, we discuss experiments in animals which address three questions: whether the unfertilized egg is constructed with pre‐determined axes, what cues are used to specify the embryonic axes, and how these cues are interpreted to (...) generate the initial regional differences within the embryo. Based on mapping the data onto an animal phylogeny, we then propose a scenario for how this primary developmental decision occurred in ancestral metazoans. (shrink)

There are many introductions to the animal ethics literature. There aren't many introductions to the practice of doing animal ethics. Bob Fischer's Animal Ethics: A Contemporary Introduction fills that gap, offering an accessible model of how animal ethics can be done today. The book takes up classic issues, such as the ethics of eating meat and experimenting on animals, but tackles them in an empirically informed and nuanced way. It also covers a range of relatively neglected issues in animal ethics, (...) such as the possibility of insect sentience and the ethics of dealing with pests. Finally, the book doesn't assess every current practice using standard ethical theories, but tries to evaluate some of them using the moral frameworks endorsed by those involved. So, for instance, there is a chapter on the way that animal care and use committees try to justify some of the educational uses of animals, and the chapter on zoos considers the way that international zoological societies justify compromising animal welfare. The book wraps up with a discussion of the future of animal ethics. One leading approach to justification comes from the reliabilist tradition, which maintains that a belief is justified provided that it is reliably formed. Another comes from the ‘Reasons First’ tradition, which claims that a belief is justified provided that it is based on reasons that support it. These two approaches are typically developed in isolation from each other; this essay motivates and defends a synthesis. On the view proposed here, justification is understood in terms of an agent’s reasons for belief, (...) which are in turn analyzed along reliabilist lines: an agent's reasons for belief are the states that serve as inputs to their reliable processes. I show that this synthesis allows each tradition to profit from the other's explanatory resources. In particular, it enables reliabilists to explain epistemic defeat without abandoning their naturalistic ambitions. I go on to compare my proposed synthesis with other hybrid versions of reliabilism that have been proposed in the literature. (shrink)

Relativism and expressivism offer two different semantic frameworks for grappling with a similar cluster of issues. What is the difference between these two frameworks? Should they be viewed as rivals? If so, how should we choose between them? This chapter sheds light on these questions. After providing an overview of relativism and expressivism, I discuss three potential choice points: their relation to truth conditional semantics, their pictures of belief and communication, and their explanations of disagreement.

This collection contains studies on justice, juridical reasoning and argumenta tion which contributed to my ideas on the new rhetoric. My reflections on justice, from 1944 to the present day, have given rise to various studies. The ftrst of these was published in English as The Idea of Justice and the Problem of Argument. The others, of which several are out of print or have never previously been published, are reunited in the present volume. As justice is, for me, the (...) prime example of a "confused notion", of a notion which, like many philosophical concepts, cannot be reduced to clarity without being distorted, one cannot treat it without recourse to the methods of reasoning analyzed by the new rhetoric. In actuality, these methods have long been put into practice by jurists. Legal reasoning is fertile ground for the study of argumentation: it is to the new rhetoric what mathematics is to formal logic and to the theory of demonstrative proof. It is important, then, that philosophers should not limit their methodologi cal studies to mathematics and the natural sciences. They must not neglect law in the search for practical reason.
