Modern medicine provides unprecedented opportunities in diagnostics and treatment. However, in some situations at the end of a patient’s life, many physicians refrain from using all possible measures to prolong life. We studied the incidence of different types of treatment withheld or withdrawn in 6 European countries and analyzed the main background characteristics.

This book offers a critical examination of those theories and advances a new argument for punishment's justification, calling it the 'duty view'.

Clinical ethics consultations are sometimes deemed complete at the moment when the consultants make a recommendation. In CECs that involve actual ethical conflict, this view of a consult's endpoint runs the risk of overemphasizing the conflict's resolution at the expense of the consult's process, which can have deleterious effects on the various parties in the conflict. This overly narrow focus on reaching a decision or recommendation in consults that involve profound moral disagreement can result in two types of adverse, lingering (...) sequelae: moral distress or negative moral emotions. The problem, succinctly named, is that such consults have insufficient “closure” for patients, families, and providers. To promote closure, and avoid the ills of moral distress and the moral emotions, I argue that CECs need to prioritize assisted conversation between the different stakeholders in these conflicts, what is often referred to as “bioethics mediation.”. Kant speaks repeatedly about the relations between ends or aims and scientific research, but the topic has mostly been ignored. What is the role of ends, especially (though not exclusively) practical ones, in his views on science? I will show that while Kant leaves ample space for recognizing a function of ends both in the definition and the pursuit of inquiry, and in the further practical application of scientific cognition, he does not claim that science is simply (...) an instrument for achieving practical ends. I explain his complex conception, pointing out that Kant argues (1) that the sciences require ends for their very definition, (2) that ends come in fundamentally different kinds, (3) that the relation between science and ends requires the rational determination and hierarchization of all our ends, with “wisdom” as the highest, and (4) that this determination and hierarchization – which ought to be done by metaphysics – has itself to be carried out in a “scientific way”. I show further that (5) Kant gives sui generis weight to the epistemic aims and standards of science and to the autonomy of science from our practical lives. This places his position between separatism and anti-separatism with regard to the relation between science and our ends or values. (shrink)

Means–ends decoupling has recently been suggested as one consequence of the problems organizations face in trying to comply with institutional rules in contexts of institutional complexity. Such decoupling is characterized by the adoption, implementation, and scrutiny of particular codes of practice, which tend not to deliver the outcomes they were developed to produce. Recent scholarship focusing on this issue has suggested that such decoupling is a consequence of the trade-off organizations need to make between compliance and goal achievement, most (...) especially when the latter is difficult to evaluate. Although recent scholarship has suggested that this tension might be mitigated by the activities of developers of compliance rules, in this article, we explore how actors internal to organizations, in this case, two charitable organizations, mitigate this tension via nonconformance with particular codes. We focus on how the process of accounting for nonconformance results in the discursive coupling of means and ends as actors creatively develop vocabularies of motive, which respond to anticipated social criticism. Theodor Adorno’s reputation as a cultural critic has been well-established for some time, but his status as a philosopher remains unclear. In _Adorno and the Ends of Philosophy_ Andrew Bowie seeks to establish what Adorno can contribute to philosophy today. Adorno’s published texts are notably difficult and have tended to hinder his reception by a broad philosophical audience. His main influence as a philosopher when he was alive was, though, often based on his very lucid public lectures. Drawing on (...) these lectures, both published and unpublished, Bowie argues that important recent interpretations of Hegel, and related developments in pragmatism, echo key ideas in Adorno’s thought. At the same time, Adorno’s insistence that philosophy should make the Holocaust central to the assessment of modern rationality suggests ways in which these approaches should be complemented by his preparedness to confront some of the most disturbing aspects of modern history. What emerges is a remarkably clear and engaging re-interpretation of Adorno’s thought, as well as an illuminating and original review of the state of contemporary philosophy. _Adorno and the Ends of Philosophy_ will be indispensable to students of Adorno’s work at all levels. This compelling book is also set to ignite debate surrounding the reception of Adorno’s philosophy and bring him into the mainstream of philosophical debate at a time when the divisions between analytical and European philosophy are increasingly breaking down. Many principles characterize educational justice in terms of the relationship between educational inputs, outputs and distributive standards. Such principles depend upon the causal pathway view of education. It is implicit in this view that the causally effective aspects of education can be understood as separate from the normative aspects of education. Yet this view relies on an impossible division of labor between empirical and normative work in educational research: it treats the causal roles that are understood and explained objectively through (...) empirical research as separate from the normative theorizing that informs the assessment of particular policies and practices. Such principles therefore rely on unreliable causal claims and are unable to make prescriptions about practices even according to their own conceptions of justice. Furthermore, such principles obscure other relevant considerations of justice that pertain to the internal processes of education and the structural relation of education to external social conditions. Even in the Netherlands, where the practice of physician-assisted death (PAD) has been legalized for over 20 years, there is no such thing as a ‘right to die’. Especially patients with extraordinary requests, such as a wish for PAD based on psychiatric suffering, advanced dementia, or (a limited number of) multiple geriatric syndromes, encounter barriers in access to PAD. In this paper, we discuss whether these barriers can be justified in the context of the Dutch situation where PAD is legally (...) permitted for those who suffer unbearably and hopelessly as a result of medical conditions. Furthermore, we explore whether there are options to address some of the barriers or their consequences, both within the Dutch legal framework or by adjusting the legal framework, and whether these options are feasible. We conclude that although there are insufficient arguments to overrule the doctor’s freedom of conscience in the Netherlands, there are ways to address some of the barriers, mainly by offering support to doctors that would be willing to support a request. Moreover, we believe it is morally required to reduce or mitigate where possible the negative consequences of the barriers for patients, such as the long waiting time for those who suffer from psychiatric disorders, because it is unlikely the adjustments suggested to the system will ensure reasonable access for these patient groups. In this article I argue that the mechanical inexplicability of natural ends in the third Critique is best understood against the background of a fairly traditional picture of the metaphysics of living things, one embraced by Kant himself. On this picture, the distinctive unity of a living thing was to be explained by a soul, form, or monad. The constraints placed on the understanding in the first Critique, however, make such an explanation impossible: because the principle of a living (...) thing in virtue of which it constitutes a whole—rather than a mere aggregate of things—is simple, it cannot be met with in space. By ruling out a widely accepted explanans for a well-recognized explanandum, in other words, Kant’s first Critique makes living things inexplicable in precisely those ways suggested by the third. As the gap between the need for and supply of human organs continues to widen, the aim of securing additional sources of these “gifts of the body” has become a seemingly overriding moral imperative, one that could—and some argue, should—override the widespread ban on organ markets. As a medical practice, organ transplantation entails the inherent risk that one human being, a donor, will become little more than a means to the end of healing for another human being and that he (...) or she will come to have a purely instrumental value. With the establishment of organ markets, not only will the harms of instrumentalization be a reality—the ends of medicine will be further compromised and confused. (shrink)

Empirical research on public opinion has tended to misjudge the normative rationales for modern democracy. Although it is often presumed that citizens' policy preferences are the opinions of interest to democratic theorists, and that democracy requires a highly informed citizenry, neither of these premises represents a dominant position in mainstream democratic theory. Besides incorrect assumptions about major tenets of democratic theory, empirical research on civic engagement is running into dead ends that will require normative analysis to overcome. Bringing political (...) philosophy back in to the study of public opinion can not only remedy shortcomings in the empirical literature, but can also underscore how relevant that literature is for a wide range of problems in democratic practice. This work presents an original interpretation of Kant's account which is based on rethinking the nature of Critical Philosophy. Gary Banham presents the argument that the Critique of Judgment needs to be read as a whole. Aesthetics is investigated in relation to all three critiques with the recovery of a larger sense of the 'aesthetic' resulting. This paper analyzes Kant's thesis in the Tugendlehre that there are certain ends that we are obligated to adopt. It contends that none of the three arguments which Kant advances in support of this thesis succeeds and that the attempted reconstruction by Nelson Potter likewise fails. It then maintains that the argument does work, if one brings in, as an implicit premise, transcendental freedom. Finally, it is argued that this late doctrine of obligatory ends marks a significant advance (...) over the treatment of broad duties in the Grundlegung and can serve as a basis for defending Kant's ethics against the familiar emptiness charge. Der Beitrag untersucht die These Kants in der Tugendlehre , daß es bestimmte Zwecke gibt, zu deren Verfolgung wir verpflichtet sind. Dabei stellt sich heraus, daß keines der drei Argumente, die Kant zur Stützung dieser These verwendet, durchgreift und daß der diesbezügliche Rekonstruktionsversuch von Nelson Potter ebenso fehlschlägt. Es wird weiterhin die Ansicht vertreten, daß die Argumentation dann überzeugt, wenn man die transzendentale Freiheit als Prämisse einbezieht. Schließlich wird gezeigt, daß diese späte Lehre Kants von den Zwecken, die zugleich Pflicht sind, einen erheblichen Fortschritt gegenüber der Behandlung der weiten Pflichten in der Grundlegung bedeutet und eine Grundlage dafür bietet, Kants Ethik gegen den üblichen Vorwurf des leeren Formalismus in Schutz zu nehmen. In this paper I examine the genesis of Kant’s conception of a realm of ends, arguing that Kant first started to think of morality in terms of striving to be a member of a realm of ends, understood as an ideal community, in the early 1760s, and that he was influenced in this by his encounter with the Swedish mystic Emanuel Swedenborg. In 1766 Kant published Dreams of a Spirit Seer, a commentary on Swedenborg’s magnum opus, Heavenly Secrets. (...) Most commentators take Kant’s attitude towards Swedenborg to have been entirely negative, and argue that, at the most, Kant’s encounter with him had a purely negative impact on Kant’s development, inducing him to reject certain of his early metaphysical positions. I argue, in contrast, that Swedenborg had a positive influence on Kant’s development, particularly on his ethics, for Kant’s conception of a realm of ends is modeled on Swedenborg’s conception of heaven as a community of spirits governed by moral laws. A substantial consideration of a film genre that is a distinctive part of American popular art.

In this essay I first provide a brief explanation of the principle of double effect (PDE) and the propositions that it entails regarding the distinction betweenintention and foresight (I/F distinction) and the distinction’s relevance to ethical evaluation. Then I address several recent critiques of PDE and the I/F distinctionby influential ethicists including Judith Jarvis Thomson, Tom Beauchamp and James Childress, and Jonathan Bennett. I argue that none of these critiques issuccessful. In the process of refuting the critiques, I also give (...) prima facie reason to believe that the I/F distinction is relevant to evaluation of agents and their actions and that PDE is a defensible ethical principle. From the perspective of an African ethic, analytically interpreted as a philosophical principle of right action, what are the proper final ends of a publicly funded university and how should they be ranked? To answer this question, I first provide a brief but inclusive review of the literature on Africanising higher education from the past 50 years, and contend that the prominent final ends suggested in it can be reduced to five major categories. Then, I spell out an (...) intuitively attractive African moral theory and apply it to these five final ends, arguing that three of them are appropriate but that two of them are not. After that, I maintain that the African moral theory prescribes two additional final ends for a public university that are not salient in the literature. Next, I argue that employing the African moral theory as I do enables one to rebut several criticisms of Africanising higher education that have recently been made from a liberal perspective. I conclude by posing questions suitable for future research. (shrink)

Historically, the view, prevalent in contemporary economics and decision theory as well as philosophy, that rational action consists simply in satisfying one’s desires, whatever they may be, as efficiently as possible, is to be found first in Book II of Hume’s Treatise of Human Nature. This view has counterintuitive and self-refuting implications, in that it recognizes as rational behavior that may reveal a clear degree of irresponsibility or psychological instability. Accordingly, many Hume scholars have tried to show recently that this (...) view was not Hume’s; and that, on the contrary, Hume did supply an account of rational final ends--in his discussion of the calm passions, the “steady and general view” that corrects the biases and contingencies of an individual’s desires and perceptions, and elsewhere. But a detailed reconstruction of Hume’s views on these matters that assembles all the relevant texts does not support this thesis. Instead, it undermines it. Hence the counterintuitive and self-refuting implications of Hume’s view of rational action must be allowed to stand. (shrink)

This is a critique of Peirce, Nietzsche, Wittgenstein, Buchler, Derrida, and Rorty as anti-realists, showing that each of these philosophers affirms some form of self-undermining relativism that cannot account for itself.

The sublime has come under severe criticism in recent years. Jane Forsey, for instance, has argued that all theories of the sublime “rest on a mistake”. In her article, “The Pleasures of Contra-purposiveness: Kant, the Sublime, and Being Human,” Katerina Deligiorgi () provides a rejoinder to Forsey. Deligiorgi argues—with the help of Kant—that a coherent theory of the sublime is possible, and she provides a sketch for such a theory. Deligiorgi makes good progress in the debate over the sublime. But (...) here I raise two questions in relation to her account. The aim of these questions is to help clarify and augment her theory and thus extend the discussion about the tenability and relevance of the sublime. The first question is about the pleasure of the sublime. The pleasure, she claims, comes from our catching a glimpse of ourselves as agents in the world. But, I argue, Deligiorgi's conception of agency is insufficient for explaining the pleasure of sublimity, and this is because she does not take into account what I call the “ends of reason,” those ends that matter most to us as agents. The second question pertains to the phenomenology of the sublime. The worry here is that Deligiorgi overcomplicates the subject's experience and, in doing so, greatly restricts the scope of the sublime. (shrink)

Vardoulakis explores the connection between sovereignty and stasis in the work of Agamben. It considers some of Agamben's most famous formulations of sovereignty, such in Homo Sacer. But the focus is on some seemingly obscure references to Spinoza in Agamben's works. Vardoulakis argues that these references reveal the logic of Agamben's political philosophy -- including a politics of reading that influences his account of the philosophical tradition.

In ‘Force of law’ Derrida appears to suggest that emancipatory ideals and human rights have a continuing relevance. This may seem a surprising proposition from a theorist often interpreted as critical of humanist and Enlightenment principles. This paper argues, however, that Derrida does not reject, outright, humanist, Enlightenment and emancipatory strategies but instead deconstructs these in order to propose alternate ‘ethical’ and ‘political’ possibilities. Focusing on ‘The ends of man’, ‘Force of law’ and ‘Autoimmunity’ this paper argues that Derrida (...) does not advocate an anti-humanism but instead gestures toward an alternate unconditional hospitality, responsibility, friendship, justice and democracy-to-come, displacing the anthropomorphism of humanism and advocating instead an openness to a heterogeneous otherness.
