There is no evidence to suggest that even as late as January 1672, when Newton was elected a Fellow of the Royal Society, anyone had any inkling of his new theory of colours. His name exploded on the scientific scene as the inventor and constructor of a new kind of telescope—what later became known as the reflector . Had the erudition of the London virtuosi been a little broader, they would have known that in fact he was not the inventor (...) of the telescope, even though the precise form he gave it was his. Not only was the idea a hundred years old, during which period it was repeatedly suggested by various writers, but also Newton himself took the idea straight from the most recent of these suggestions, namely that included in James Gregory's Optica promota of 1663. The situation becomes even more ironic when we realize that the new instrument was admired for wrong reasons and on merits that were far from Newton's intentions. Nevertheless, admired it was, and there was a good reason for this: Newton's instrument was in fact the first reflector actually to be constructed and, moreover, for a few weeks it performed quite well. Several astonomers became interested because of the high magnifying power relative to its dimensions. (shrink)

The ArgumentThe inclusion of an item within a theory may be essential or accidental, and if the former then the explanation of its meaning and of its inclusion in the theory cannot be by accidental events and circumstances. Since all events and circumstances – be they social, political, religious, psychological, etc. – are accidental vis-à-vis the ideas they occasion, they cannot serve as explanation of these ideas. The only way to explain the ideas is by showing their essentiality to the (...) theory rather than their importance to the people. Thus, the place of spirits and souls within seventeenth-century science is explained by Platonic ideology.This demands a concept of nature which is thoroughly efficient causative, and a concept of explanation which is thoroughly informative. This means that theories must explain any given effect by a cause which is separable from it and is conceptually heterogeneous to it. Such a nature and such an explanation are inherently paradoxical and irrational, which explains the preponderance of these traits in seventeenth-century science as created by Kepler, through Galileo and Descartes to Newton.The primary efficient-causal and explanatory agency is force, which is ontically distinct from matter and from the motion it causes in matter. Soul, spirit and active principle are mere variants of force. Thus, their presence in seventeenth-century science is explained only by their being conceptually essential to any Platonic philosophy of nature. (shrink)

In this chapter, Dahan Katz defends relational conceptions of retribution and desert. She clarifies the ways in which such relational conceptions avoid major worries associated with retributive theory, while addressing further worries that arise distinctively with respect to such an approach. In doing so, Dahan Katz provides further defense of the response-retributive theory of punishment that she has proposed elsewhere, while defending a wider set of views within the retributive tradition.

Hospital systems commonly face the challenge of determining just ways to allocate scarce drugs during national shortages. There is no standardised approach of how this should be instituted, but principles of distributive justice are commonly used so that patients who are most likely to benefit from the drug receive it. As a result, clinical indications, in which the evidence for the drug is assumed to be established, are often prioritised over research use. In this manuscript, we present a case of (...) a phase II investigational trial of intravenous thiamine for delirium prevention in patients undergoing haematopoietic stem cell transplantation to emphasise several shortcomings in the overarching prioritisation of clinical over research uses of scarce drugs. Specifically, we present the following considerations: clinical use may not have stronger evidence than research use; a strong scientific rationale for research use may outweigh the claim for clinical indications in which there is weak evidence; treatment within the context of a clinical trial may be the standard of care; and research use may not only benefit patients receiving the treatment but also offers the prospect of improving future clinical care. In summary, we argue against allocation schemes that prohibit all research uses of scarce drugs and instead recommend that allocation schemes include a balanced approach that weighs risks and benefits of access to scarce drugs irrespective of the research versus clinical use designation. Unfortunately, for many of my contemporary American Jews, access to the gem-stones of the Chasidim has been denied. Chasidic works are overwhelmingly in Hebrew, and few good translations exist. This book provides an introduction to the basic terms and ideas of Chasidic texts. It is written for the interested lay reader who may be new to Torah study, as well as the yeshiva student who is knowledgeable about Biblical narratives and Talmudic law but may be new to the world of Chasidus. By analysing Rousseau's conception of the general will, Zev Trachtenberg characterises the attitude of civic virtue Rousseau believes individuals must have to cooperate successfully in society. Rousseau holds that culture affects political life by either fostering or discouraging civic virtue. However, while the cultural institutions Rousseau endorses would motivate citizens to obey the law, they would not prepare citizens to help frame it. Rousseau's view of culture thus works against his account of legitimacy, and Trachtenberg concludes that Rousseau's political theory (...) as a whole is inconsistent. (shrink)

I have in mind the more immediate form of human association evoked by the word community. Let me offer a rough-and-ready distinction. The social contract tradition prompts us to think of society in terms of the cooperative human enterprise of protecting individuals’ interests; the concept of society calls to mind formal voluntary agreements and associations, contracts, the economy, ultimately laws and rights. 3 We can think of community, by contrast, in affective terms; it calls to mind the direct human relations of people who share a place and mode of living. 4 A society has laws and a government; a community has customs and a culture.In this essay, then, I want to explore the relationship between property and community. The poem opens with his words “Something there is that doesn’t love a wall”—a phrase he repeats later, making it a kind of slogan for the position on property he personifies. That position seems to reject human attempts to inscribe the arbitrary divisions of property holdings on the land. The narrator sees in natural processes an attempt to cast off this artificial imposition: that which doesn’t love a wall “sends the frozen-ground-swell under it, /And spills the upper boulders in the sun.” He recognizes that asserting a separation between the two parcels of property by erecting a wall is futile. For, he recognizes, the two parcels are one, connected underneath the wall by natural forces that work unconsciously but actively against human efforts to divide them.The neighbor, by contrast, speaks for an individualistic belief in the value of marking property holdings. “Good fences make good neighbors” are his only words in the poem, repeated in the last line like a counter-slogan to the narrator’s. The neighbor first offers his slogan in response to the fact that the wall is not needed for the practical purpose of keeping his and the narrator’s goods separate. Their goods do not need a wall to be kept apart: they have no cows to wander back and forth across the line, and the narrator’s “apple trees will never get across/And eat the cones under [the neighbor’s] pines.” For the neighbor, that is, the utility of the wall is not economic. Rather it serves to define the sort of relationship he wishes to have with those who surround him: his slogan expresses an ideology of human separation. In the neighbor’s eyes, apparently, all that makes a neighbor is the mere fact of owning an adjacent farm, hence what makes a good neighbor is his separateness. For what else could characterize the goodness of neighbors who are made good by fences?The neighbor thus personifies a position on property that disvalues community. The two books set out a sweeping proposal for reforming our criminal law in ways that are at once commonsensical and mindbogglingly radical. Should the process of ecological restoration be considered a type of moral reparation? In a recent issue of this journal, Ben Almassi (2017) has argued that ecological restoration should be understood as a moral repair, i.e., as "a model for rebuilding the moral conditions of relationships" (20). Ideas of restorative justice and moral repair are appropriate to address human injustice and wrongdoing. But these concepts are vacuous and lose their meaning when addressing the ethics of human activities regarding the natural (...) world because of the essential character of the restoration process: the replacement or substitution of new entities for pre-existing entities in an attempt to reverse the irreversible. At best, the idea of moral reparations to nature is a weak metaphor with no practical efficacy; at worst, it totally misconceives the relationship between human activity and the natural environment in the process of ecological restoration and provides yet another dangerous and disingenuous justification of human arrogance and domination of the natural world. In the guise of the act of moral reparations, humans are instead attempting to assume the powers of God, to control the natural and human world. My previous criticisms of the ethics and meaning of ecological restorations—especially regarding the substitution of new individuals and the artifactual nature of restorations—can be used to undermine Almassi's thesis of moral repair as a goal of ecological restoration practice. In addition an analysis of the Book of Job in the Old Testament demonstrates that not even God—much less humans—can restore and replace what has been destroyed. (shrink)

Challenging previous interpretations of Levinas that gloss over his use of the feminine or show how he overlooks questions raised by feminists, Claire Elise Katz explores the powerful and productive links between the feminine and religion in Levinas’s work. Rather than viewing the feminine as a metaphor with no significance for women or as a means to reinforce traditional stereotypes, Katz goes beyond questions of sexual difference to reach a more profound understanding of the role of the feminine (...) in Levinas’s conception of ethical responsibility. She combines feminist interpretations of Levinas with interpretations that focus on his Jewish writings to reveal that the feminine provides an important bridge between his philosophy and his Judaism. Katz’s reading of Levinas’s conception of the feminine against the backdrop of discussions of women of the Hebrew bible points to important shifts in contemporary philosophy toward the creation of life and care for the other. Ontological separation plays a key role in Aristotle’s metaphysical project: substances alone are ontologically χωριστόν. The standard view identifies Aristotelian ontological separation with ontological independence, so that ontological separation is a non-symmetric relation. I argue that there is strong textual evidence that Aristotle employs an asymmetric notion of separation in the Metaphysics—one that involves the dependence of other entities on the independent entity. I argue that this notion allows Aristotle to prevent the proliferation of substance-kinds and thus to secure the (...) unity of his metaphysical system. (shrink)

This paper reviews evidence concerning the nature of grouping in music and language and their interactions with other linguistic and musical systems. I present brief typological surveys of the relationship between constituency and acoustic parameters in language and music, drawing from a wide variety of languages and musical genres. The two domains both involve correspondence between auditory discontinuities and group boundaries, reflecting the Gestalt principles of proximity and similarity, as well as a nested, hierarchical organization of constituents. Typically, computational-level theories (...) of musical grouping take the form of a function from acoustic properties through grouping representations to syntactic or interpretive constituents. Linguistic theories tend to be cast as functions in the opposite direction. This study argues that the difference in orientation is not grounded in principled differences in information flow between the two domains, and that reconceptualizing one or both theories allows for gains in analytical understanding. There are also obvious differences between musical and linguistic grouping. Grappling with those differences requires one to think in detail about modularity, information flow, levels of description, and the functional nature of cognitive domains. (shrink)

Using the social-psychological literature on the antecedents of environmental behaviour and comparative data from Germany, India, Israel and South Korea, we test four value types that correspond with environmental behaviour. Our cross-national context represents varying social, economic, cultural and environmental configurations, giving credence to the effects of values. The authors collected survey data among students on a variety of environmental behaviours and on questions that comprise Schwartz's value scale. The results show similarities between the countries in the effect of biospheric (...) values and differences in the effects of the other values tested. We also find that biospheric value is the most important value type for explaining environmental behaviour, and that biospheric values, universalism and benevolence – three key values that we analyse – have different effects on environmental behaviour, and therefore should be treated separately rather than in a unified self-transcendence value orientation. We finally demonstrate the importance of conformity in the analysis of environmental behaviour. Our conclusions point to the importance of further exploring the mechanism that links values and environmental behaviour while contextualising it in different national and cultural settings. Consider the existence of six identical trees of the same species across a variety of environments. The first tree is in a wild and isolated landscape. The second is in a wilderness park. The third is in a heavily forested “tree plantation” owned by International Paper. The fourth is in the Ramble in Central Park. The fifth is in a suburban yard. The sixth is inside the six-story atrium of a Manhattan skyscraper. This paper begins with the intuition that the (...) identical trees have different values because they exist in different environments and biological-social contexts. To understand the different evaluations of the trees we must think along a spectrum that incorporates both axiology and ontology. This thought experiment is useful in exploring arguments about both the management and the preservation of the natural world. The conclusion is that we must think along a spectrum of natural being and value to understand the dualism between humanity and nature and thereby avoid the domination of the natural environment. In "Literal Meaning," John Searle claims to refute the view that sentences of a natural language have a meaning independent of the social contexts in which their utterances occur. The present paper is a reply on behalf of this view. In the first section, I show that the issue is not a parochial dispute within a narrow area of the philosophy of language, of interest only to specialists in the area, but is at the heart of a wide range of (...) important philosophical problems, those on which the recent linguistic turn in philosophy has properly taken a grammatical perspective. Contemporary philosophy standardly accepts Frege's conceptions of sense as the determiner of reference and of analyticity as (necessary) truth in virtue of meaning. This paper argues that those conceptions are mistaken. It develops referentially autonomous notions of sense and analyticity and applies them to the semantics of natural kind terms. The arguments of Donnellan, Putnam, and Kripke concerning natural kind terms are widely taken to refute internalist and rationalist theories of meaning. This paper shows that the counter-intuitive consequences about the (...) reference of natural kind terms depend as much on Frege's conceptions of sense and analyticity as on what such theories of meaning say about the senses of natural kind terms. Rather than refuting the internalist and rationalist theories of meaning, the arguments of Donnellan, Putnam, and Kripke are best recast as refutations of their own Fregean assumptions. The paper also shows how autonomous notions of sense and analyticity enable us to reconstruct such theories, formulate an internalist/ rationalist account of semantic knowledge, and preserve Donnellan's, Putnam's, and Kripke's insights about reference. Sense, Reference, and Philosophy develops the far-reaching consequences for philosophy of adopting non-Fregean intensionalism, showing that long-standing problems in the philosophy of language, and indeed other areas, that appeared intractable can now be solved. Katz proceeds to examine some of those problems in this new light, including the problem of names, natural kind terms, the Liar Paradox, the distinction between logical and extra-logical vocabulary, and the Raven paradox. In each case, a non-Fregean intentionalism provides a philosophically more satisfying solution.

Once shunned, interdisciplinarity has now become fashionable-but badly in need of unpacking. The transfer of ideas from one field to another requires full understanding of the ways in which they are used and understood, where they come from and where they are going. This book calls attention to certain linguistic tools that served scholars in the past and that are still relevant today-if properly employed. It offers a roadmap that inter-relates problems within and between the sciences-human and natural. Throughout, the (...) book interpolates excerpts from scholarly texts that light the road. Spelling out how research may go beyond the mere assembly of facts, it invites the reader to join a sequence of steps that highlights the processes which problem solving entails. Ruth Katz (Ph.D. Columbia University) is one of the founding members of the Department of Musicology at the Hebrew University of Jerusalem. Upon receiving the prestigious Israel Prize in 2012, her work was cited for shedding light on such things as the interdisciplinary processes implicated in "the origin of opera, the history of Western notation, the relationship of stylistic change to the history of ideas, music's place in philosophy, and the role of musical aesthetics in cognition." She founded the Excellence Program at the University and co-founded the Laboratory for the study of music. Her most recent book, hailed as "magisterial," is entitled A Language of Its Own: Sense and Meaning in the Making of Western Art Music (University of Chicago Press, 2009).
