The article argues that feminist emancipation, understood as practices and discourses of self-development and of solidarity as empowerment, has become entangled with the neoliberal project. Indeed, emancipation as self-improvement has become synonymous with moral regulation projects that seek to adapt women to global capitalism. The article explores the relation between emancipation and neoliberal regulation from a situated approach by addressing the experience of Latin American feminisms, with a particular focus on Chile. This approach recognizes by implication that Latin American feminisms (...) are co-extensive, or coeval, with North American and European ones, and are not merely derivative forms. (shrink)

Both Husserl’s and Levinas’ phenomenologies conceive an intrinsic relationship between ethics and the idea of God. It is not clear however how one should understand this relationship and what could be its proper phenomenological value. I argue in this article that the idea of God has a specific henomenological meaning for ethics, as it is conceived both by the later Husserl and by Levinas. This phenomenological meaning resides in the structure of ethical subjectivity, insofar as its relationship with the good, (...) both as striving towards the good and as obligation to be good, necessarily entails the recognition of the idea of God. Both in Husserl’s and in Levinas’ phenomenologies the idea of God bears a necessary relationship to infinity: it is indeed understood as infinitely distant being (Husserl) or as idea of the infinite itself (Levinas), and generates a form of striving towards an ethical ideal (Husserl) or a form of ethical obligation (Levinas). Se destacan entre ellos el programa Realista pospositivista de Satya Mohanty, cuyo objetivo primordial será ofrecer una consideración alternativa de la noción de experiencia subjetiva -antiesencialista (...) pero se opondrá a la disolución deconstructiva del posmodernismo. En el presente trabajo, analizaré cómo una u otra consideración puede responder más eficazmente a reclamos de legitimidad de identidades marginalizadas. In "The Evidence of Experience" Joan Scott challenged the philosophical accounts that support identity politics based on the fact that this tradition puts the razonability of the claims and the efficiency of this policies at risk. Multiples responses have been given to this argument, but the most profound and sharpest critiques were introduced by the Realist Post-positivist Programme. This theory, developed by Satya Mohanty and et al, tries to give an alternative consideration of the notion of "subjective experience"-antiessencialist but the opposite to the posmodernist deconstructive dissolution of this term. In this paper I analyze both positions and I will try to give a consideration on my own in order to offer a better and more efficient response to identity-claims. (shrink)

Background: Nurses are expected to provide comprehensive, holistic and ethically accepted care according to their code of ethics and practice. However, in Malawi, this is not always the case. This article analyses moral competence concept using the Walker and Avant's strategy of concept analysis. Objective: The aim of this article is to analyse moral competence concept in relation to nursing practice and determine defining attributes, antecedents and consequences of moral competence in nursing practice. Method: Analysis of moral competence concept was (...) done using Walker and Avant's strategy of concept analysis. Results: Deductive analysis was used to find the defining attributes of moral competence, which were kindness, compassion, caring, critical thinking, ethical decision making ability, problem solving, responsibility, discipline, accountability, communication, solidarity, honesty, and respect for human values, dignity and rights. The identified antecedents were personal, cultural and religious values; nursing ethics training, environment and guidance. The consequences of moral competence are team work spirit, effective communication, improved performance and positive attitudes in providing nursing care. Conclusion: Moral competence can therefore be used as a tool to improve care in nursing practice to meet patients' problems and needs and consequently increase public's satisfaction in Malawi. The aim of this study was to explore the existence of moral distress among nurses in Lilongwe District of Malawi. Qualitative research was conducted in selected health institutions of Lilongwe District in Malawi to assess knowledge and causes of moral distress among nurses and coping mechanisms and sources of support that are used by morally distressed nurses. Data were collected from a purposive sample of 20 nurses through in-depth interviews using a semi-structured interview guide. Thematic analysis of qualitative data was (...) used. The results show that nurses, irrespective of age, work experience and tribe, experienced moral distress related to patient/nursing care. The major distressing factors were inadequate resources and lack of respect from patients, guardians, peers and bosses. Nurses desire teamwork and ethics committees in their health institutions as a means of controlling and preventing moral distress. There is a need for creation of awareness for nurses to recognize and manage moral distress, thus optimizing their ability to provide quality and uncompromised nursing care. (shrink)

The case of Charlie Gard sparked an ongoing public and academic debate whether in court decisions about medical treatment for children in England & Wales the best interests test should be replaced by a harm threshold. However, the literature has scantly considered (1) what the impact of such a replacement would be on future litigation and (2) how a harm threshold should be introduced: for triage or as standard for decision-making. This article directly addresses these gaps, by first analysing reported (...) cases in England & Wales about medical treatment in the context of a S31 order, thus using a harm threshold for triage and second comparing court decisions about medical treatment for children in England & Wales based on the best interest test with Dutch and German case law using a harm threshold. The investigation found that whilst no substantial increase of parental discretion can be expected an introduction of a harm threshold for triage would change litigation. In particular, cases in which harm is limited, currently only heard when there are concerns about parental decision-making, may be denied a court hearing as might cases in which the child has lost their capacity to suffer. Applying a harm threshold for triage in decisions about withholding or withdrawing life-sustaining treatment might lead to a continuation of medical treatment that could be considered futile. Mesmo com avanços significativos referentes à inclusão das pessoas com deficiência, a comunidade surda ainda enfrenta diversos desafios. Em 2002, a LIBRAS foi reconhecida como meio de comunicação da comunidade surda e, em 2015, a Lei Brasileira de Inclusão garantiu acesso a todos os espaços, inclusive de saúde e a psicoterapia é um desses espaços. O objetivo geral desta pesquisa foi identificar as contribuições e os desafios da psicologia para a realização do atendimento psicoterapêutico acessível em LIBRAS. Os objetivos específicos (...) buscaram compreender a importância da atuação psicológica para surdos; investigar a inclusão da comunidade surda no acesso à saúde e à psicoterapia; identificar os locais que possuem psicoterapia bilíngue em LIBRAS na Bahia; e descrever os desafios e possibilidades da psicoterapia em LIBRAS. É uma pesquisa qualitativa, realizada através da revisão bibliográfica nas bases de dados SciELO, BVS e o acervo do GTPBS/ CRP - 03. Os principais resultados demonstraram que na Bahia existem dois locais que possuem psicólogos bilíngues em LIBRAS. A formação em LIBRAS, o conhecimento sobre a cultura surda e a compreensão da subjetividade da pessoa surda são necessários na formação da/o psicóloga/o que desejam atuar com este público. (shrink)

This paper considers the problem of how to evaluate an offender’s criminal record. This evaluation is part of the sentencing process carried out by a judge, and may be complicated in the case of offenders with a heavy record. We give a comprehensive overview of the approach to an offender’s past record in various (Western) countries, considering the two major approaches: desert-based and utilitarian. The paper describes the determination of the parameters involved in the evaluation, and the construction of a (...) decision support system to be used by a judge about to pass sentence in a criminal case. The system may be used as a stand-alone system, but can also be integrated as a component of a general sentencing support system, e.g. a statistical sentencing information system. The system is a knowledge-based system. The knowledge base (in rule-form) was created primarily by eliciting knowledge from experts (judges, lawyers, academics and probation officers), but also by applying statutory law, case law and legal authoritative texts. It is flexible in the sense, that a user can introduce his1 own preferences (expressed as numerical coefficients) and thereby apply different sentencing principles. Deep brain stimulation (DBS) is a developing technology. New generations of DBS technology are already in the pipeline, yet this particular fact has been largely ignored among ethicists interested in DBS. Focusing only on ethical concerns raised by the current DBS technology is, albeit necessary, not sufficient. Since current bioethical concerns raised by a specific technology could be quite different from the concerns it will raise a couple of years ahead, an ethical analysis should be sensitive to such alterations, or (...) it could end up with results that soon become dated. The goal of this analysis is to address these changing bioethical concerns, to think ahead on upcoming and future DBS concerns both in terms of a changing technology and changing moral attitudes. By employing the distinction between inherent and noninherent bioethical concerns we identify and make explicit the particular limits and potentials for change within each category, respectively, including how present and upcoming bioethical concerns regarding DBS emerge and become obsolete. Many of the currently identified ethical problems with DBS, such as stimulation-induced mania, are a result of suboptimal technology. These challenges could be addressed by technical advances, while for instance perceptions of an altered body image caused by the mere awareness of having an implant may not. Other concerns will not emerge until the technology has become sophisticated enough for new uses to be realized, such as concerns on DBS for enhancement purposes. As a part of the present analysis, concerns regarding authenticity are used as an example. (shrink)

Multiple divergences were found in these views depending on the countries, resources, religious approaches, and political aspects that have been adapted according to the circumstances of each nation. Right from the start of the Spanish Civil War, thousands of prisoners were executed by shooting. Today, many of them remain anonymous, but others, thanks to their writing, have passed into history. In the final hours before their execution, these men and women had the chance to write a few farewell letters to their nearest and dearest. These letters, known by historians as ?chapel letters,? passed either through official channels exercising prior censorship or else were sent clandestinely. In their farewell (...) letters, the condemned to death informed their families of their tragic fate and dedicated their last words to them. Genuine family relics, material and spiritual testaments, instruments of denunciation and propaganda, these chapel letters are regarded as the most sincere documents of any historical period. Since prisoners expressed in them their most intimate feelings and thoughts, they constitute the most exceptional testimony of all epistolary forms practised behind bars. By using an interdisciplinary approach this essay seeks to define the material and functional characteristics of this genre and to contextualise it in the framework of ordinary writings and scribal culture. An icon is part of the visible world, moreover, of things that are visible in a second degree. It is not only a sensitive thing, but a sensitive image of a sensitive entity. As an eikon, it is located in a platonic sense among the lowest degree of the doxa, and within the lowest degree of the scale of being. However it is not a simple sensitive and illusory representation of God, such as one criticized from a Kantian point of (...) view. The profound sense of an icon lies in its opening towards the invisible. An icon tries to capture the invisible. How is this meeting point of the visible and the invisible entangled? Can an icon really allow us to “see” the invisible or is it only a profanation of the invisible? It is my aim to analyze those questions in the following article. (shrink)

La contribución específica de Hans Kellner a la Nueva Filosofía de la Historia se dirige a dar cuenta del revival de la narrativa a partir de los 80 en términos de un revival de la retórica. Sus relecturas de los textos históricos, metahistóricos, literarios y filosóficos nos invitan a apreciar las estrategias retóricas implicadas en ellos, desplegando aquello que habilitan o imposibilitan decir acerca del pasado. Kellner invita a eludir el planteo fundacionista que se ciñe a la cuestión de la (...) validez epistémica del texto, sin caer por ello en la actitud determinista lingüística que fija las estrategias discursivas en tanto estructuras artificiosas y distorsivas de la realidad. Kellner nos desafía a abandonar la metáfora de la distorsión para caracterizar la relación entre representación y realidad. Si en cuanto filósofxs de la historia nos interesa trazar líneas de continuidad y comunidad en la indagación historiográfica, debemos enfocar en sus fuentes retóricas más que en la evidencia documental o la experiencia del pasado cuyo rasgo manifiesto es la fragmentariedad. Su propuesta promueve que nos focalicemos, por un lado, en las innumerables elecciones tomadas entre las diversas modalidades de conocimiento disponibles. Por el otro, nos advierte de la ansiedad provocada por dicha elección en contra de otras opciones descartadas que podrían habernos hecho pensar las cosas de otra manera. Background: Ethical competence in nursing practice helps clinical nurses to think critically, analyse issues, make ethical decisions, solve ethical problems and behave ethically in their daily work. Thus, ethical competence contributes to the promotion of high-quality care. However, studies on ethical competence in Malawi are scanty. Objectives: The aim of this study was to explore ethical competence among clinical nurses in selected hospitals in Malawi. Methodology: A cross-sectional survey was conducted in four selected hospitals in Malawi with a sample of (...) 271 clinical nurses. Data were collected using self-administered questionnaires, which included a Moral Competence Scale for Home Care Nurses. Descriptive statistics and logistic regression were computed for the dataset using STATA version 12.0. Ethical consideration: The study protocol complied with all ethical requirements and was approved by the College of Medicine Research Ethics Committee under the University of Malawi. Results: The clinical nurses in Malawi are ethically competent. However, there is a significantly high number (p 0.05). Three determinants of high ethical competence level (strong will, judgement skills and recognition of discrepancy of intention) were identified through a reduced model after stepwise logistic regression analysis. Furthermore, results show that indicators of ethical competence include caring, confidentiality and observance of nurses dressing code. The study has also confirmed that the Moral Competence Scale for Home Care Nurses is a reliable tool to assess ethical competence in low-resource settings. Conclusion: The majority of nurses who completed the survey had low ethical competence. However, clinical nurses with high ethical competence level are required to competently manage complex ethical challenges in health facilities. Strategies for enhancing ethical competence such as continuing ethics education, establishment of ethics committees and provision of supportive supervision are recommended to enable nurses in Malawi attain a high level of ethical competence. We study probabilistic logic under the viewpoint of the coherence principle of de Finetti. In detail, we explore how probabilistic reasoning under coherence is related to model- theoretic probabilistic reasoning and to default reasoning in System . In particular, we show that the notions of g-coherence and of g-coherent entailment can be expressed by combining notions in model-theoretic probabilistic logic with concepts from default reasoning. Moreover, we show that probabilistic reasoning under coherence is a generalization of default reasoning in System (...) . That is, we provide a new probabilistic semantics for System , which neither uses infinitesimal probabilities nor atomic bound (or big-stepped) probabilities. These results also provide new algorithms for probabilistic reasoning under coherence and for default reasoning in System , and they give new insight into default reasoning with conditional objects. It is commonly thought that that the best system account of lawhood ((Mill (1843), Ramsey (1978)[fp. 1928], Lewis (1973)) makes available a nice explanation for why laws are ‘distinctively appropriate targets of scientific inquiry’ (Hall, 2015). The explanation takes the following general form: laws are especially valuable for agents like us because they efficiently encode a lot of valuable (non-nomic) information in a tractable format. The goal of this paper is to challenge this style of explanation: I argue that the (...) general principle it presupposes is in conflict with our best account of practical rationality. After considering and rejecting a number of proposals for dissolving the tension, I conclude that BSA proponents may need to scale back the explanatory ambitions of their theory; in particular, they may need to give up the hope of non-circular explanations of the value of nomic information. I end by outlining some challenges for the humean world-view that results after this shift. (shrink)

At the outset of an ethnographic inquiry, we navigated national and international resources to search for theoretical and practical guidance on obtaining parents and children’s informed consent/assent. While much theoretical guidance debating ethical issues to children’s participation in research was found, a paucity of published papers offering practical guidance on assent processes and/or visual representations of child assent forms and information sheets was discovered. The purpose of this article is to describe our experiences, both theoretically and practically, of negotiating the (...) process of obtaining informed consent and assent with parents and children for a non-therapeutic qualitative research study. We hope this article instigates a platform for others to explicate their experience and contributes to the construction of a coherent body of knowledge which will clearly delineate important elements that must be considered when negotiating children’s agreement to participate in research.
