Zusammenfassung Zur ordnungsgemäßen Durchführbarkeit des Spielbetriebs setzen die deutschen Profisportligen Li­zenzierungsverfahren ein. Dabei stehen insbesondere zur Eindämmung der Rattenrennen-Proble­matik und zur Sicherstellung der finanziellen Stabilität der teilnehmenden Klubs und damit zum Vermeiden negativer Externalitäten die finanzwirtschaftlichen Anforderungen im Fokus. In den ver­gangenen Jahren kam es trotz dieser Vorkehrungen in den fünf größten deutschen Profisportligen im Basketball, Eishockey, Fußball, Handball sowie Volleyball mehrfach zu finanziellen Schieflagen. Vor dem Hintergrund wird in diesem Beitrag die finanzwirtschaftliche Lizenzierung der Profisport­ligen anhand von sechs Haupt- (...) und 62 Subkriterien strukturiert und umfassend analysiert. Ziel die­ser vergleichenden Untersuchung ist die Herausarbeitung von Gemeinsamkeiten und Unterschieden sowie die Ableitung von Stärken und Schwächen. Aus sportökonomischer Perspektive werden auf dieser Basis Verbesserungsmöglichkeiten der Lizenzierungsverfahren entwickelt. (shrink)

Die Theorie des Thomas Hobbes hat in der Vergangenheit stark abweichende Deutungen erfahren und Anlass zu zahlreichen lang anhaltenden Debatten geliefert. Die Diskussion hat jedoch allgemein darunter gelitten, dass Hobbes' Schriften von der berwiegenden Anzahl der Interpreten wie ein in sich zusammenh ngender Textkorpus behandelt und die Unterschiede zwischen den verschiedenen Werken nicht hinreichend gew rdigt worden sind. In besonderem Ma e trifft das auf die Naturzustandstheorie zu, die im Zentrum der Hobbes'schen Argumentation steht und in gro em Ma f (...) r die Entstehung und das Fortdauern der genannten Debatten verantwortlich zu machen ist. Ziel der vorliegenden Arbeit ist es, die verschiedenen Fassungen der Naturzustandstheorie endlich einer umfassenden vergleichenden Analyse zu unterziehen, und zwar unter konsequenter Einbeziehung des gerade in der deutschen Hobbes-Forschung kaum beachteten Textes des lateinischen Leviathan. Wie sich eindrucksvoll zeigt, vermag der eingehende Vergleich der Schriften nicht nur einen wichtigen Beitrag zum Verst ndnis von Hobbes' philosophischer Entwicklung und zur Bestimmung des Stellenwertes des lateinischen Leviathan zu leisten. Er liefert auch einen wichtigen Beitrag zur kritischen Bewertung der vorliegenden Hobbes-Interpretationen und zur Aufl sung einiger zentraler Debatten. (shrink)

Die ethischen Aspekte der Verwendung von Placebos in klinischen Versuchsreihen wurden im letzten Jahrzehnt ausführlich und kontrovers diskutiert. Es fehlt dennoch eine gründliche vergleichende Analyse der verschiedenen internationalen Richtlinien, ihrer Terminologien und ihrer auf Placebo bezogenen Prinzipien. Das zentrale Problem ist die Rechtfertigung von Placebo bei einer nachgewiesen wirksamen Therapie. Alle aktuellen Versionen der untersuchten Richtlinien schlagen solche Rechtfertigungen vor, unterscheiden sich hierbei jedoch beträchtlich. Zunächst werden wir ein formales allgemeines Prinzip herausarbeiten. Dann werden wir drei verschiedene Kategorien (...) von Kriterien darstellen: das Schadensrisiko oder die Belastung, zwingende wissenschaftliche Gründe und die Erhältlichkeit einer nachgewiesen wirksamen Therapie. Die Analyse zeigt bedeutende normative Abweichungen und Widersprüche innerhalb und zwischen den einzelnen Richtlinien. Besonders frappierend ist es, dassmancheRichtlinien es erlauben, Versuchsteilnehmer dem Risiko eines schweren Schadens auszusetzen, während andere gerade dies untersagen. Abschließend versuchen wir zu zeigen, wie sich die normativen Unterschiede bei der Entscheidungsfindung von Forschern und Ethikkommissionen auswirken können. (shrink)

From the point of view of the history and philosophy of science, the relationship of Descartes' to Aristotle's concept of nature has not been grasped in an entirely satisfactory way. In this article, the two concepts will be subjected to a comparative analysis, beginning with the outstanding feature that both concepts of nature are characterized by a contradistinction to the non-natural: Aristotle separates nature and technology; Descartes opposes nature to thinking. My thesis is that these meanings have found (...) privileged application in specific contexts of experience: the field of application especially suitable for the Aristotelian concept is the experience of everyday life, while for the Cartesian concept it is subjective experience. Historically, the relationship between meaning and experience is of help in understanding the conditions in which the two concepts arose. The topical relevance of the concepts to modern society is a consequence of the continued existence of the favored contexts of experience. Roughly stated, we sometimes still perceive in an Aristotelian way and at other times think in a Cartesian way. (shrink)

The focus of the paper is the comparison between the two composite aluminum panels, respectively Alpolic and Durabond. The paper is going to explore their reaction when interacting with Tirana`s climatological factors and their tension strength through an experiment, in order to find out which panel displays the best performance. The construction urge is constantly evolving, especially in Tirana mostly because it is the main industrial and economical district of Albania. It is distinguished that innovative technology is being used in (...) facades of the new buildings. One of the features that finds massive use in façade coating in the city is the application of ventilated facades equipped with external aluminum composite panels. This paper is going to deal with two buildings with different typologies of external coating, including the different types of aluminum panels. The analysis will focus on identifying each panel property such as tension strength; their respond to various external factors; their thermal conductivity; and their manufacturing companies which have been selected and produced. Within this paper graphics displays of the records will be included, offering concentrated information and a high level of reliability for both aluminum composite panels. (shrink)

In this article I will present and analyze the concept of all-unity of the two most famous Russian philosophers—Vladimir Soloviev and Semyon Frank. As will be argued, the concept of all-unity is part of an old philosophical tradition. At the same time, it is an original idea of the Russian thought of the Silver Age.

The world can be divided between atheism and theism, a division that also fuels its social conflicts, moral outlook, and social evolution. If not for the question of why God did not create everything in peace, harmony, and reconciliation, we might not have seen this division. Atheism thrives and lives on the consideration of a merciful God allowing suffering, hardship, and punishment while theism on the belief in divine tests practiced through higher values. However, the arguments for theism and atheism (...) are still ongoing while affecting humanity at large. Even though theism is not as strong globally as it was at some time in the past, it still has a considerable influence in many major areas of the world. Islamic theism is a major influence driving the politics and addressing social conflicts in the Middle East and many other parts of the world. This discussion analyses both Islamic theism and atheism comparatively arguing for Islamic theism and against atheism. As atheism has no authoritative sources like Islamic theism has in the Quran and Hadith the atheistic perspectives are largely dependent upon its leading proponents and history. The discussion finds atheism is great for those who have wealth, resources, and influence while theism is best suited to make positive changes for humanity as a whole. Atheism is then a luxury while theism is a necessity. The reader is strongly urged to consider the footnotes for greater understanding. (shrink)

The dynamic of changes in the rules in team games materialize from research and debate between experts and coaches before being implemented by the International Federations. In Handball, the last changes occurred in 2016, and one of them was to substitute the goalkeeper with an additional field player allowing teams to play “empty goal” while using the additional field player.This study aimed to analyze and characterize the use of the 7 vs. 6 strategical-tactical option for the attack in the 2020 (...) Men’s European Championship. We also analyzed whether the game time and partial score influenced the use of 7 vs. 6 and its efficiency. Observational methodology and a mixed ad hoc instrument combining field format and category systems validated by experts were used. Data were taken from 28 matches involving teams in the first 12 positions in the 2020 Men’s European Championship. The total number of offensive sequences in an organized attack method in 7 vs. 6 with an empty goal were analyzed. Sequential analysis techniques with lags, prospective and retrospective, and polar coordinate analysis were used. The results showed that these solutions had poor efficiency, except for the Portuguese National Team; teams using the 7 vs. 6 tactic option had no negative consequences or increased risk with the opponent response; partial score influenced the decision to use 7 vs. 6 strategic option, and game time was associated with 7 vs. 6 play options and detected patterns. Der Text "Sing-li-tchin-thsiouan die wahrhafte Darstellung der Naturphilosophie (erster Theil)" kann als erstes Dokument einer transkulturellen abendländisch-chinesischen Perspektive im Bereich der Tierphilosophie gelten. Es handelt sich um die deutsche Übersetzung (1840) eines Mandschu-Texts durch Hans Conon von der Gabelentz. Obwohl für das Werk eines Chinesen erachtet, geht die Schrift auf einen chinesischen Urtext (1753) des Jesuiten Alexandre de Lacharme zurück. Eher implizit und allusiv begegnen sich in den inhaltlichen und übersetzungsgeschichtlichen Zusammenhängen cartesianische, neokonfuzianische und mandschurische Denkelemente. Im ersten Teil des (...) Beitrags erfolgt eine hinführende Analyse der translationsgeschichtlichen Kontexte sowie relevanter Aspekte neokonfuzianischer Philosopheme. Danach geht es im zweiten Teil um die tierphilosophisch relevanten Positionen im neunten Kapitel des Textes aus vergleichender Analyseperspektive. Abschließend wird das in diesen Betrachtungen und Hintergründen angelegte weiterführende Potential für die Entwicklung einer transkulturellen Tierphilosophie erörtert. This article is aimed to compare the efficacy and acceptability of exercise intervention with other nonpharmacological therapies in improving attention in ADHD patients and then rank those therapies. Methods. Relevant RCT studies from the Cochrane Library, Web of Science, Psycinfo, and PubMed were systematically searched from January 2011 to January 2020. The literature was screened, and the researchers extracted and used Stata16 and WinBugs1.4 independently to analyze the data. Results. The improvement of “attention deficit” in ADHD patients was measured in (...) 83 independent studies with 4,998 participants and 14 nonpharmacological therapies. Therapies were ranked as follows, according to the efficacy and acceptability of the cumulative probability area under the curve : meditation and cognitive; sport intervention therapy; vitamin and mineral; cognitive behavioral therapy; computer training; psychological education; working memory training; neurofeedback therapy; polyunsaturated fatty acids; mineral supplements; meditation; vitamin; biofeedback therapy; and school-based training. However, because the effect size of meditation and cognitive therapy was at a marginally significant level ), the robustness of the results was far lower than that of sport intervention therapy. Therefore, careful interpretation is needed in practice. Conclusion. Considering the efficacy and acceptability of various nonpharmacological therapies, sport intervention has a more stable effect on the improvement of attention deficit. Secondly, meditation and cognitive therapy, cognitive behavioral therapy, and computer training can also be effective complementary tools. (shrink)

In this paper we analyse how the risks associated with research on transgenic plants are regulated in Sweden. The paper outlines the way in which pilot projects in the plant sciences are overseen in Sweden, and discusses the international and national background to the current regulatory system. The historical, and hitherto unexplored, reasons for the evolution of current administrative and legislative procedures in plant science are of particular interest. Specifically, we discuss similarities and differences in the regulation of medicine (...) and plant science, and we examine the tendency towards dichotomizing risk — focusing on social/ethical risks in medicine and biological risks in plant science. The European project European and Latin American Systems of Ethics Regulation of Biomedical Research Project (EULABOR) has carried out the first comparative analysis of ethics regulation systems for biomedical research in seven countries in Europe and Latin America, evaluating their roles in the protection of human subjects. We developed a conceptual and methodological framework defining ‘ethics regulation system for biomedical research’ as a set of actors, institutions, codes and laws involved in overseeing the ethics of biomedical research on (...) humans. This framework allowed us to develop comprehensive national reports by conducting semi-structured interviews to key informants. These reports were summarised and analysed in a comparative analysis. The study showed that the regulatory framework for clinical research in these countries differ in scope. It showed that despite the different political contexts, actors involved and motivations for creating the regulation, in most of the studied countries it was the government who took the lead in setting up the system. The study also showed that Europe and Latin America are similar regarding national bodies and research ethics committees, but the Brazilian system has strong and noteworthy specificities. (shrink)

This paper analyses the main perceptions of capitalism and crises from a mainstream and heterodox perspective. Broadly defined within the neoclassical structure, the mainstream approaches support the idea of long-term stability of capitalism and describe crises as exogenous events. The heterodox perceptions, on the contrary, perceive crises as an internal feature of capitalism and propose to reframe the global economy within the limits of the socio-environmental systems. Despite the historical recurrence of crises, the neoclassic capitalist framework and the related mainstream (...) perceptions are still dominating the international economic debate. Most of the crises have then been addressed with reforms oriented to adjust some elements of the system without changing the overall economic structure. On the contrary, limited numbers of initiatives have been implemented to reorganise the economy according to the heterodox perspectives. Within this context, further analysis would be needed to investigate the feasibility of the proposed heterodox solutions. By discussing the main perceptions of capitalism and crises and by considering the ethical implications of the mainstream and the heterodox approaches, the present paper contributes to the existing debate around stability of capitalism and provides a starting point for analysis oriented to investigate the feasibility of alternative economic structures. The approach to analysing population ageing and its impacts on the economy has evolved in recent years. There is increasing interest in the development and use of products and services related to gerontechnology as well as other social innovations that may be considered as central parts of the "silver economy." However, the concept of silver economy is still being formed and requires detailed research. This article proposes a typology of models of the silver economy in the European Union at the (...) national and regional levels. This typology was created by comparing the Active Ageing Index to the typology of varieties and cultures of capitalism and typology of the welfare states. The vision and mission statements of 24 environmental organisations were analysed under the premise that the language used in these statements reflects and influences the priorities of their operation. A dominant perspective, hinging on the concept of 'sustainable development', merged the profile of government agencies and non-governmental groups. The language reflected an utilitarian ethics: the environment was more generally portrayed as resources than as nature. Aesthetic remarks were exceptional, even among groups focusing on wildlife. Despite a broadly claimed link between (...) human welfare and habitat viability, environmental issues were not broadly referred to by humanitarian organisations, while conservation groups comply with societal priorities and needs. Organisational statements seem more concerned about political legitimation by audiences with specific expectations than about articulating purposes with internal structural consequences or goals that advocate change or reflect organisational uniqueness. Modern science and technology originated in Western Europe within a specific culture, but they have now been adopted and developed by several Eastern countries as well. We analyze the features of Western culture that may explain the rise of modern science with its associated economic development. A comparative analysis of Eastern cultures will then help us evaluate how far could contemporary science be successfully integrated within very different cultures. The article makes a comparative analysis of R. Swinburne’s Cartesian dualism and E. Stump’s Thomistic hylomorphism. These authors are among the few contemporary philosophers who argue for strong dualist positions contrary to physicalism in the philosophy of mind. The main motivation for the comparative analysis lies in the fact that Swinburne’s and Stump’s projects compete both with strong physicalist tendencies and with each other. The author of the article analyses the content of Swinburne’s and Stump’s systems, (...) and provides the main criticism of Cartesian dualism and Thomistic hylomorphism. The distinction between Cartesian dualism and Thomistic hylomorphism is examined. A number of similarities between the positions of Swinburne and Stump are highlighted, but philosophically significant differences are also observed. The author concludes that, despite having its own significant philosophical problems, Stump’s Thomistic hylomorphism is superior to Swinburne’s dualism in a number of aspects and has more prospects for defense. Till now, comprehensive and quantitatively meaningful analyses of stock market participation outcomes of retail investors have been limited by data sources in developing countries. This article devised a special questionnaire related to stock investment to measure the financial literacy and stock investment return for the subjects with stockownership in China and to theoretically and empirically study the effects of objective FL, self-assessed FL, and their composite FL on SIR. The results of the comparative analysis showed that self-assessed FL (...) has a greater effect on SIR than objective FL, and the effect is mediated by risk preference. In addition, we found that competent and overconfident respondents have higher SIR, while under confident respondents cannot gain from the stock market. We also found that risk preference has a positive mediating effect in the relationship between competence and overconfidence and SIR, and a negative mediating effect in the relationship between under confidence and SIR. We thus concluded that confident investors can gain more stockholding returns via taking more risks regardless of the level of their actual financial knowledge. Our findings would be a meaningful complement to the studies of stock market participation. (shrink)

Consumer indirect misbehavior in access-based consumption is a significant challenge for enterprises. The literature is in short of a deep understanding of the antecedent conditions of consumer indirect misbehavior in this context and limited by inconsistent findings, calling for developing a holistic and integrative theoretical framework. This study integrates three commonly used theoretical perspectives in the consumer misbehavior literature to present holistic archetypes of consumer indirect misbehavior formation. In accordance with this theoretical objective, we adopted an emerging approach for configurational (...) analysis, i.e., fuzzy-set qualitative comparative analysis, to analyze the complex combinations of six influencing factors. We collected data using a scenario-based field survey of 264 experienced consumers of a popular bike-sharing service in China. The scenarios were developed based on relevant literature and a Delphi study. The fsQCA results reveal multiple configurations for high and low levels of consumer misbehavior intention. Specifically, perceived benefits and moral definition play important roles, while the effect of sanctions is highly dependent on other factors. These results lead us to derive three theoretical propositions for antecedent conditions leading to consumers’ indirect misbehavior intentions in access-based consumption. This study enriches our understanding of the causes of misbehavior and provides novel insights for management practitioners to take appropriate countermeasures. (shrink)

This paper presents a comparative analysis of three American and three European corporate failures. The first part of the analysis is based on a theoretical framework including six areas of ethical climate; tone at the top; bubble economy and market pressure; fraudulent financial reporting; accountability, control, auditing, and governance; and management compensation. The second and third parts consider the analysis of these cases from fraud perspective and in terms of firm-specific characteristics and environmental context. The research (...) analyses shed light on the fact that, despite major differences between Europe and U.S. in terms of political institutions, laws and regulations as well as managerial practices, there are significant similarities between six groups. The analysis also demonstrates that, the ethical dilemma has been coupled with ineffective boards, inefficient corporate governance and control mechanisms, distorted incentive schemes, accounting irregularities, failure of auditors, dominant CEOs, dysfunctional management behavior and the lack of a sound ethical tone at the top. Significant similarities were also observed in the analysis from the fraud triangle perspective. However, there are several major differences between the six corporate failure cases particularly with regard to ownership structure, coverage in media, and legal, regulatory and governance frameworks. This research study may have several academic and practical contributions, particularly because of multidisciplinary, international features, and comparative analyses used in the paper. (shrink)

As China and the United States strive to be the primary global leader in AI, their visions are coming into conflict. This is frequently painted as a fundamental clash of civilisations, with evidence based primarily around each country’s current political system and present geopolitical tensions. However, such a narrow view claims to extrapolate into the future from an analysis of a momentary situation, ignoring a wealth of historical factors that influence each country’s prevailing philosophy of technology and thus their (...) overarching AI strategies. In this article, we build a philosophy-of-technology-grounded framework to analyse what differences in Chinese and American AI policies exist and, on a fundamental level, why they exist. We support this with Natural Language Processing methods to provide an evidentiary basis for our analysis of policy differences. By looking at documents from three different American presidential administrations––Barack Obama, Donald Trump, and Joe Biden––as well as both national and local policy documents (many available only in Chinese) from China, we provide a thorough comparative analysis of policy differences. This article fills a gap in US–China AI policy comparison and constructs a framework for understanding the origin and trajectory of policy differences. By investigating what factors are informing each country’s philosophy of technology and thus their overall approach to AI policy, we argue that while significant obstacles to cooperation remain, there is room for dialogue and mutual growth. World history suffers from a paucity of clearly articulated, convincing explanations. While the rise of postmodernism and challenges to Eurocentrism did lead to some important correctives, the pendulum has swung too far the other direction, with a corresponding danger of 'throwing the baby out with the bathwater'. We need careful, theoretically informed debates about ways of organizing world history. What constitutes a good historical explanation? What should guide historians to choose relevant facts? Which theoretical schools could be made useful, and (...) to what ends? These questions are especially relevant to the main topic of this book: the 'great divergence' between the west and the rest of the world, and how this historical rupture is to be explained. The book provides extensive critical analyses of some of the key claims in world history, analyzing their strengths as well as their major weaknesses--too often rooted in insufficient familiarity of historians with theories they discard. It also historicizes the field and the debates to partly account for what caused some theories to become more influential and others to fall into oblivion--despite the fact that the more influential frameworks are seriously flawed and some of the more marginalized ideas are more coherent and plausible. The book offers insights regarding the theoretical and political relevance of older debates about the transition to capitalism and historical materialism. Three major schools of thought in world history are critically examined through an in-depth theoretical and comparative analysis that has not been undertaken elsewhere: the so-called 'California School', World Systems Analysis, and Marxist theories of history, capitalism, and the transition from feudalism to capitalism. Murphy argues that, despite some of the more recent criticisms of older approaches to world history, the older theories remain indispensable for the writing of world history and for coming to terms with issues of global poverty, inequality and eco-catastrophe. This work sought to carry out a comparative analysis of in vitro fertilization (IVF) vis-à-vis St. Thomas Aquinas’ Natural Law Theory. Both of them emanated from problem of infertility. IVF makes use of artificial insemination for fertilization which is quite contrary to the natural process of sexual reproduction. This work makes use of analytic method to analyse comparatively in vitro fertilization and St. Thomas Aquinas’ Natural Law Theory. Thus, this work conceives that IVF is one of the (...) assisted reproductive technologies in the scientific exploration of genetic engineering and bio-technology which emanated to tackle the problem of genetic inheritance outside marriage. It contravenes the coital or natural reproduction which conforms to St. Thomas Aquinas’ second precept of natural law. Again, IVF is artificial as such it is pruned to many complications. There is no adequate information given by the medical practitioners or providers of this service on the health hazards or risks involve in IVF. In addition, in vitro fertilization makes provision for donor gamete and surrogate motherhood which may have many negative implications both for the couples, off-spring, gestation mother, and society at large. Conservative agriculture practice adoption literature advocates that adoption is caused by many factors comprising cognitive, social, economic, personal, and CAP-related factors. Evaluating the adoption of CAPs as the outcome is complex and challenging with regression-based models as the systemic interdependencies of the factors offer diverse or varying results. Farmer production and environmental orientations as cognitive stances are notable interpreters of CAP adoption. The appetite level for risk-taking, innovativeness, and trust facilitates the adoption of CAPs. However, a causal-predictive technique should be (...) used to investigate the adoption of CAP. Hence, this study engages in a configuration approach using a fuzzy-set qualitative comparative analysis to analyze the patterns of different types of farmers' orientations, personal level of trust on extension services, and innovativeness risk-taking attitude on the intention to adopt CAPs. The analysis is based on the 155-farmer data collected employing a structured interview from Pakistan. The results suggest that a higher level of environment orientation and innovativeness is sufficient to increase the intention to adopt CAPs. Moreover, a higher intention to adopt CAPs is achieved with a lower production orientation, a higher personal level of innovativeness, and a risk-taking attitude of the farmer. The innovativeness can help to develop the intention to adopt the CAPs among the environment and production-oriented farmers. Causal solutions offer a unique understanding that the farmers' environment and production orientation can combine to suggest inclined to adopt CAPs by having an attitude of innovativeness and risk-taking. The causal solutions achieved significant predictive validity in the holdout samples. Policy and farmer-level suggestions were made to raise the intention to adopt CAPs among the farmers. (shrink)

This article examines, in a comparative perspective, the integration policy of the two, in many respects, very similar, neutral states, with particular emphasis on the period after the signing of the Single European Act. Despite the converging political and economic objectives, the decisions of both countries were determined by different economic and political conditions. For Austria, the integration processes were perceived as an important step, towards reconstruction of the economy, the abolition of trade barriers with the most important economic (...) partner. In political terms integration – enhanced Austria’s position within European Community. Unlike the Austrian Government, the authorities in Bern have acted under much more polarized conditions. Neutrality played still very important role in its international policies and the social fears connected mostly to the loss of political and economic independence were vivid. The Swiss authorities were thus forced to choose the bilateral path, which was not preferred by EU countries, but more socially acceptable, and therefore easier to implement. (shrink)

The purpose of this research paper is to semantically analyze the concept of transhumanism in the publications of Russian scientists, as well as to study the influence of the idea of transhumanism as the leading philosophy of human improvement on the global differentiation of the world through a comparative analysis of the level of life expectancy in the Russian Federation, the USA, and China. Findings indicate that, in general, when setting the right goals based on the Russian cosmism (...) and transhumanism concepts can and should bring certain positive benefits to humanity. First of all, this involves treatment of incurable and complex diseases and enhancement of human capabilities in space expansion. The scientific contribution and practical significance of the research lie in the development of three exponential models of life expectancy growth in accordance with the indicator of economic development that is based on the gross domestic product per capita level. Context: The enactive paradigm in the cognitive sciences is establishing itself as a strong and comprehensive alternative to the computationalist mainstream. However, its own particular historical roots have so far been largely ignored in the historical analyses of the cognitive sciences. Problem: In order to properly assess the enactive paradigm’s theoretical foundations in terms of their validity, novelty and potential future directions of development, it is essential for us to know more about the history of ideas that has led to (...) the current state of affairs. Method: The meaning of the disappearance of the field of cybernetics and the rise of second-order cybernetics is analyzed by taking a closer look at the work of representative figures for each of the phases: Rosenblueth, Wiener and Bigelow for the early wave of cybernetics, Ashby for its culmination, and von Foerster for the development of the second-order approach. Results: It is argued that the disintegration of cybernetics eventually resulted in two distinct scientific traditions, one going from symbolic AI to modern cognitive science on the one hand, and the other leading from second-order cybernetics to the current enactive paradigm. Implications: We can now understand that the extent to which the cognitive sciences have neglected their cybernetic parent is precisely the extent to which cybernetics had already carried the tendencies that would later find fuller expression in second-order cybernetics. There has been a lot of discussion and debate on the issue of Islamization of Contemporary Knowledge among Muslim intellectuals. Two Muslim thinkers, namely al-Attas and al-Fārūqī were foremost in the attempt to conceptualise the problem of the Muslim Ummah and the issue of Islamization of knowledge as an epistemological and socio-political solution. This article aims to examine, compare and analyse the ideas of both scholars with respect to the various interpretations of the concept of Islamization of knowledge their (...) definition of the concept, their philosophical framework, and their methodology for achieving the goals of Islamization. It aims at understanding the similarities and differences and the strengths and weaknesses of their conceptions, philosophical framework and methodology. Background Respect for patients’ autonomy is usually considered to be an important ethical principle in Western countries; privacy is one of the implications of such respect. Healthcare professionals frequently encounter ethical dilemmas during their practice. The past few decades have seen an increased use of courts to resolve intractable ethical dilemmas across both the developed and the developing world. However, Chinese and American bioethics differ largely due to the influence of Chinese Confucianism and Western religions, respectively, and there is a (...) dearth of comparative studies that explore cases of ethical dilemmas between China and the United States. Methods This paper discusses four typical cases with significant social impact. First, it compares two cases concerning patient privacy: the “Shihezi University Hospital Case”, in which a patient was used as a clinical teaching object without her permission, and the “New York-Presbyterian Hospital Case”, in which the hospital allowed the filming of a patient’s treatment without his consent. Second, it compares two cases regarding patient autonomy and potentially life-saving medical procedures: the “Case of Ms. L”, concerning a cohabitant’s refusal to sign a consent form for a pregnant woman’s caesarean, and the “Case of Mrs. V”, concerning a hospital’s insistence upon a blood transfusion for a dissenting patient. This paper introduces the supporting and opposing views for each case and discusses their social impact. It then compares and analyses the differences between China and the United States from cultural and legislative perspectives. Conclusions Ethical dilemmas have often occurred in China due to the late development of bioethics. However, the presence of bioethics earlier in the US than in China has not spared the US of ethical dilemmas. This paper highlights lessons and inspiration from the cases for healthcare professionals and introduces readers to the role and weight of privacy and autonomy in China and in the US from the perspectives of different cultures, religions and laws. Given recent technological advances, we now are able to invade personal privacy as never before. The challenge in the business community is to make the most of the opportunities presented by the growth in communication technology while, at the same time, protecting what remains of individual privacy. The conflict between technological advances and privacy concerns is not new, but it has grown exponentially in recent years, and the development of a data protection scheme in the European Union lends a certain (...) economic urgency to meeting the challenge.Pursuant to a Directive adopted by the European Union, privacy protections throughout the EU must become more stringent and consistent throughout EU member countries. One area of great concern to the United States is the Directive's requirement for certain minimum standards of privacy protection in countries receiving information from member countries. Given the limited protections available in the United States, it does not appear that the United States meets these minimum standards. In this paper we compare two micro foundations for modelling human behaviour and decision making. We focus on perfect strategic rationality on the one hand and a simple reinforcement mechanism on the other hand. Iterated prisoner’s dilemmas serve as the play ground for the comparison. The main lesson of our analysis is that in the space of all possible 2 × 2 PDs different micro foundations do matter. This suggests that researchers can not safely rely on the assumption that (...) implementing simple models of decision making will yield the same results that may be obtained when more sophisticated decision rules are built into the agents. A school of thought traceable to the political writings of Bodin and Hobbes believes that "order" is the cardinal principle which takes precedence over "justice" - which is reduced to conformity. The main concern of this book is to analyse this tradition through study of its progenitors.

The article analyses the legal status of the natural gas market regulatory institutions in Lithuania and in the member states of the European Union. First, the authors assess the most important elements of the legal status of the natural gas market regulators in the EU member states, namely, the degree of autonomy (type of institution, appointment and dismissal procedures of management, duration of the terms of office, sources of funding) and the measures aimed at ensuring accountability, transparency, and prevention of (...) conflicts of interest. Second, the legal status of the National Control Commission for Prices and Energy, which carries out functions of regulation and control of the natural gas sector in Lithuania, is examined. Finally, the authors conclude that the imperfections in the regulation of the legal status of the Commission result in several negative effects and provide reasoned proposals regarding the improvement of the legal status of the Commission. While religious politics have been a widely discussed topic in the social sciences in recent decades, few studies develop general explanations based on systematic and detailed comparative analysis. This article seeks to explain when and how successful religious parties rise. To that end, I comparatively analyze the politicization of German Catholicism in the second half of the nineteenth century and Turkish Islam in the post-1970 period and briefly examine the negative case of nineteenth-century German Protestantism. According to the (...) theory of revival-reaction-politicization I propose, successful religious parties rise when major religious revivals confront social counter-mobilization and state repression, provided that existing political parties do not effectively represent religious defense. The study's findings challenge the pervasive tendency to treat Christian and Islamic politics as incommensurable. (shrink)

Objective Analyze racial differences in comfort with medical research using an alternative to the traditional approach that treats white people as a raceless norm.Methods Quantitative analysis of survey responses (n = 1,570) from Black and white residents of the US to identify relationships between perceptions of research as a right or a risk, and comfort participating in medical research.Results A lower proportion of white respondents reported that medical experimentation occurred without patient consent (p < 0.001) and a higher proportion (...) of white respondents reported that it should be their right to participate in medical research (p = 0.02). Belief in one’s right to participate was significantly predictive of comfort (b = 0.37, p < 0.001). Belief in experimentation without consent was significantly predictive of comfort for white respondents but not for Black respondents in multivariable analysis.Conclusions A rights-based orientation and less concern about the risks of medical research among white respondents demonstrate comparative advantage. Efforts to diversify medical research may perpetuate structural racism if they do not (1) critically engage with whiteness and its role in comfort with participation, and (2) identify and respond specifically to the needs of Black patients. Academic and public debate is continuing about whether digital nomadism, a new Internet-enabled phenomenon in which digital workers adopt a neo-nomadic global lifestyle, represents ‘real’ emancipation for knowledge workers—or if it is, instead, the opposite. Based on a field study of digital nomadism, and accepting a pluralist approach to emancipation, we analyse the ‘emancipatory project(s)’ that digital nomads engage in. This analysis, following Weberian idealtypes, employs a tripartite structure: unsatisfactory conditions (what people want to overcome); emancipatory means (actions (...) taken); and emancipatory ends (desired outcomes). We critically compare digital nomadism to the traditional descriptions of emancipatory projects in nation-state contexts, as found in prior literature, using the same analytical framework. Juxtaposing these idealtypes, we discuss similarities and differences and analyse their inherent assumptions, logics and ethical stances. We conclude that digital nomadism generates an emancipation that is very much ‘real’ for digital nomads, whose experience cannot be disregarded, but with a ‘postmodern’ ethos that is at odds with modernity and its ethos originating from the Enlightenment. Using 2015 International Social Survey Program (ISSP) data on 38,179 individuals from 36 countries in 9 relatively homogeneous global regions, we analyze the gender differences and the gender gap in perceived workplace harassment (PWH) with particular attention to gender equality's and gender egalitarianism's roles in molding these differences. We find that despite large regional differences, women in most countries are more likely than men to perceive workplace harassment, although this likelihood is higher in countries that score favorably on our gender (...) equality measures. Hence, political empowerment and better economic opportunities alter women's perceptions of workplace harassment, increasing the probability of their experiencing it. Our results also underscore the important roles of values and gender egalitarian practices. Whereas enhanced gender egalitarianism values increase women's perceptions of workplace harassment, concrete practices tend to reduce them. Especially for management, this result highlights the importance of actually implementing gender equality policies at a corporate level, because a discrepancy between corporate values and practices on this issue will only accentuate the perception of harassment. Entscheidungen der Therapiebegrenzung und in der Betreuung am Lebensende sind häufig komplex und von ethischen Problemen begleitet. Im Mittelpunkt der Untersuchung steht die entscheidende Frage, wie hilfreich existierende „Ethik-Richtlinien“, die eine ethische Orientierung bei solchen Entscheidungen geben sollen, in der klinischen Praxis tatsächlich sind. Die Frage, welchen Nutzen „Ethik-Richtlinien“ bei der Entscheidungsfindung haben oder haben können, wird hier exemplarisch an einem klinischen Fallbeispiel aus einer Ethik-Kooperationsstudie in der Intensivmedizin analysiert. Vergleichend werden hierzu „Ethik-Richtlinien“ aus Deutschland, der Schweiz und aus Großbritannien (...) herangezogen, die Gegenstand eines internationalen Projekts zur Analyse von Richtlinien waren. Die Möglichkeiten und Grenzen einer ethischen Orientierung an „Ethik-Richtlinien“ bei Entscheidungsproblemen der Therapiebegrenzung und in der Betreuung am Lebensende werden anhand der Fallstudie diskutiert und illustriert. Abschließend werden Schlussfolgerungen für die Entwicklung ethischer Richtlinien für die klinische Praxis formuliert. (shrink)

Scholars of religion have always been fascinated by asceticism. Some have even regarded this radical way of life-- the withdrawal from the world, combined with practices that seriously affect basic bodily needs, up to extreme forms of self-mortification --as the ultimate form of a true religious quest. This view is rooted in hagiographic descriptions of prominent ascetics and in other literary accounts that praise the ascetic life-style. Scholars have often overlooked, however, that in the history of religions ascetic beliefs and (...) practices have also been strongly criticized, by followers of the same religious tradition as well as by outsiders. The respective sources provide sufficient evidence of such critical strands but surprisingly as yet no attempt has been made to analyze this criticism of asceticism systematically. This book is a first attempt of filling this gap. Ten studies present cases from both Asian and European traditions: classical and medieval Hinduism, early and contemporary Buddhism in South and East Asia, European antiquity, early and medieval Christianity, and 19th/20th century Aryan religion. Focusing on the critics of asceticism, their motives, their arguments, and the targets of their critique, these studies provide a broad range of issues for comparison. They suggest that the critique of asceticism is based on a worldview differing from and competing with the ascetic worldview, often in one and the same historical context. The book demonstrates that examining the critics of asceticism helps understand better the complexity of religious traditions and their cultural contexts. The comparative analysis, moreover, shows that the criticism of asceticism reflects a religious worldview as significant and widespread in the history of religions as asceticism itself is. (shrink)

Mysticism is a spiritual search for hidden truth or wisdom that aims to unite with the metaphysical realm. Mysticism is a direct experience of oneness with God. It is a diverse set of practices, discourses, teachings, articles, texts, institutions, traditions, and experiences related to the instruction of human transformation. Mysticism encompasses everything associated with God. Mystical experiences are unique to each individual. This paper delves into the mystical thoughts of two multi-genius thinkers, the greatest philosophers and mystical poets: Rabindranath Tagore (...) and Muhammad Iqbal. It also shows the relationship between man and God in the writing of Tagore and Iqbal. Also, it deals with how Tagore and Iqbal combine nature, different aspects of the self, and images of the divine. They hold that God’s presence permeates all of creation and that mysticism and humanism are the primary sources of an individual’s spiritual power. They think that God is within man, and man is a reflection of this divine spirit, which is God. Tagore imparts a system of Indian mystical thought in which the Gita’s theism, Vedic metaphysics, the Upanishad’s teachings, the mystical philosophy of the Bauls, the doctrine of love of Vaishnava, and Sufism exist in synthesis. Iqbal emphasizes that the ultimate goal of human life is to accomplish the will of the Almighty. Tagore and Iqbal’s writing contains many similar ideas, images, techniques, and analyses. Health care decision making for patients without decisional capacity is ethically and legally challenging. Advance directives (living wills) have proved to be of limited usefulness in clinical practice. Therefore, academic attention should focus more on substitute decision making by the next of kin. In this article, we comparatively analyse the legal approaches to substitute medical decision making in England and Germany. Based on the current ethico-legal discourse in both countries, three aspects of substitute decision making will be highlighted: (1) (...) (2) What should be the respective roles and decisional powers of patient-appointed versus court-appointed substitute decision-makers? ArgumentIn calling psychoanalysis a “school of suspicion”, Ricoeur marks at once its use in a disposition characteristic of modernity: the disposition of suspicion. Modernity gives rise to various forms of suspicion, to modern forms of ressentiment and practices of disciplining oneself as well as to an epistemology of suspicion. In this essay, I shall analyze the epistemological function of suspicion – which as the “paradigm of clues” becomes the leading paradigm of the human sciences in the last third of the (...) nineteenth century – and its close interrelationship with the techniques of power. As I shall demonstrate through a comparative reading of psychoanalytical, literary, and criminological texts, the modern production of knowledge in the human sciences cannot be separated from the modern “micro-physics of power,” which for Foucault was established in the eighteenth century, and the technologies of the self. I shall situate the paradigm of clues within the framework of the modern disposition of suspicion in order to combine the epistemological reflections with an analysis of cultural history. Thus I will first examine the paradigm of clues from the perspectives of cultural theory and semiotics, in order to illuminate the structural unreliability of the episteme as well as the way it is closely linked to the techniques of power. In what follows, I will apply this view to Bertillon's photographic identification system, the psychoanalytical concept of the trace, and Kafka's short story The Burrow. (shrink)

Schopenhauer and Adorno on Bodily Suffering explores how the works of both philosophers revolve around an entwinement of pessimism and optimism, which links statements regarding the wrongness of the world to analyses of the human capability to experience compassion with bodily suffering and to the redeeming qualities of the arts.

The Chinese translation of Coca Cola is thought to be a well-known good translation, and many people discussed the translation or brand translation with it as an example. A large number of books or articles generally and abstractly conclude that the Chinese translation leaves people a kind of feeling of coolness and cleanness, pleases and attracts consumers’ attention and their favor, however there is not still a book or an article studying systematically and scientifically how good the translation is, neither (...) wholly from perspectives of linguistics, culture and aesthetic translation. Based on the literature review and comparative analysis with cultural translation study and translation aesthetics, the thesis is to discover how good the translation is, based on the analysis of Chinese translation of Coca Cola from the aspects of linguistics, culture and translation aesthetics, and to build a criticism model of translation of brand names, in addition, to analyze the enlightenment of this translation in other translation activities. At First, the article analyses Hamann’s path to self-knowledge and self-love as a path of Socratic ignorance, which is indeed the highest form of knowledge. For Hamann Socrates is the predecessor of Christ, and Socratic ignorance (I know that I know nothing) is the path to divinization. Subsequently, it is pointed out, how Hryhorii Skovoroda explains the path of self-knowledge and self-love. To illustrate this thought, he makes use of the Ovidian Narcissus myth. Concerning the figure of Narcissus, Skovoroda distinguishes (...) the following three aspects: 1. The Egyptian Narcissus, 2. The Hebraic Narcissus and 3. The Christian Narcissus, i.e. Jesus Christ. These three aspects and corresponding assertions of the Bible designate Skovoroda’s path to divinization. Finally, it points out similarities between Hamann’s and Skovoroda’s understanding of self-knowing and self-love and their fundamental impact for the philosophy of Franz von Baader and his criticism of modern subjectivism.
