In this paper we analyse how the risks associated with research on transgenic plants are regulated in Sweden. The paper outlines the way in which pilot projects in the plant sciences are overseen in Sweden, and discusses the international and national background to the current regulatory system. The historical, and hitherto unexplored, reasons for the evolution of current administrative and legislative procedures in plant science are of particular interest. Specifically, we discuss similarities and differences in the regulation of medicine and (...) plant science, and we examine the tendency towards dichotomizing risk — focusing on social/ethical risks in medicine and biological risks in plant science. The context of this article is the Synpraxia research project, an inter-disciplinary program combining expertise in sciences and the humanities. (shrink)

Explanatory realism is the view that explanations work by providing information about relations of productive determination such as causation or grounding. The view has gained considerable popularity in the last decades, especially in the context of metaphysical debates about non-causal explanation. What makes the view particularly attractive is that it fits nicely with the idea that not all explanations are causal whilst avoiding an implausible pluralism about explanation. Another attractive feature of the view is that it allows explanation to be (...) a partially epistemic, context-dependent phenomenon. In spite of its attractiveness, explanatory realism has recently been subject to criticism. In particular, Taylor :197–219, 2018). has presented four types of explanation that the view allegedly cannot account for. This paper defends explanatory realism against Taylor’s challenges. We will show that Taylor’s counterexamples are either explanations that turn out to provide information about entities standing in productive determination relations or that they are not genuine explanations in the first place. This article shows how activists in the open data movement re-articulate notions of democracy, participation, and journalism by applying practices and values from open source culture to the creation and use of data. Focusing on the Open Knowledge Foundation Germany and drawing from a combination of interviews and content analysis, it argues that this process leads activists to develop new rationalities around datafication that can support the agency of datafied publics. Three modulations of open source are identified: First, by regarding (...) data as a prerequisite for generating knowledge, activists transform the sharing of source code to include the sharing of raw data. Sharing raw data should break the interpretative monopoly of governments and would allow people to make their own interpretation of data about public issues. Second, activists connect this idea to an open and flexible form of representative democracy by applying the open source model of participation to political participation. Third, activists acknowledge that intermediaries are necessary to make raw data accessible to the public. This leads them to an interest in transforming journalism to become an intermediary in this sense. At the same time, they try to act as intermediaries themselves and develop civic technologies to put their ideas into practice. The article concludes with suggesting that the practices and ideas of open data activists are relevant because they illustrate the connection between datafication and open source culture and help to understand how datafication might support the agency of publics and actors outside big government and big business. The recent explosion of interest in epigenetics is often portrayed as the dawning of a scientific revolution that promises to transform biomedical science along with developmental and evolutionary biology. Much of this enthusiasm surrounds what we call the epigenetic switch hypothesis, which regards certain examples of epigenetic inheritance as an adaptive organismal response to environmental change. This interpretation overlooks an alternative explanation in terms of coevolutionary dynamics between parasitic transposons and the host genome. This raises a question about whether epigenetics (...) researchers tend to overlook transposon dynamics more generally. To address this question, we surveyed a large sample of scientific publications on the topics of epigenetics and transposons over the past fifty years. We found that enthusiasm for epigenetics is often inversely related to interest in transposon dynamics across the four disciplines we examined. Most surprising was a declining interest in transposons within biomedical science and cellular and molecular biology over the past two decades. Also notable was a delayed and relatively muted enthusiasm for epigenetics within evolutionary biology. An analysis of scientific abstracts from the past twenty-five years further reveals systematic differences among disciplines in their uses of the term epigenetic, especially with respect to heritability commitments and functional interpretations. Taken together, these results paint a nuanced picture of the rise of epigenetics and the possible neglect of transposon dynamics, especially among biomedical scientists. (shrink)

Abstract“A Misleading Parallel”. Wittgenstein on Conceptual Confusion in Psychology and the Semantics of Psychological Concepts. After the Philosophical Investigations, except for details, were largely finished in 1945, Wittgenstein, in his final years, undertook an intensive study of the grammar of our psychological concepts and the philosophical misinterpretations we often assign to them. Anyone looking through these extensive collections of philosophical remarks will probably quite often find it difficult to understand which questions Wittgenstein was addressing with individual remarks or groups of (...) remarks and where the philosophical problems lay for which he was trying to find a solution, whether therapeutic or otherwise appropriate.In the article at hand I do not claim to fathom the full range of Wittgenstein’s thoughts on the philosophy of psychology even in the most general way. Rather it is my intention to shed some light on a diagnosis which he made for the psychology of his time. In part 1 of this paper I would like to provide a brief sketch of what Wittgenstein considered to be the conceptual confusion prevalent in psychology and to suggest why he did not expect the methods of an experimental (natural) science to be successful in solving the problems that concern us in psychology. In part 2 I’ll attempt to analyze how psychological concepts, according to Wittgenstein, might be construed in order to avoid any type of conceptual confusion. (shrink)

Construction grammar organizes its basic elements of description, its constructions, into networks that range from concrete, lexically-filled constructions to fully schematic ones, with several levels of partially schematic constructions in between. However, only few corpus studies with a constructionist background take this multi-level nature fully into account. In this paper, we argue that understanding language variation can be advanced considerably by systematically formulating and testing hypotheses at various levels in the constructional network. To illustrate the approach, we present a corpus (...) study of the Dutch naar-alternation. It is found that this alternation primarily functions at an intermediate level in the constructional network. (shrink)

Recent examples of rapid evolution under natural selection seem to require that the disciplines of ecology and evolution become better integrated. This inference makes sense only if one’s understanding of these disciplines is based on Hutchinson’s two-speed model of the ecological theater and the evolutionary play. Instead, these disciplines are more accurately viewed as occupying distinct “epistemic niches.” When so understood, we see that rapid evolution under selection, even if it is generally true, does not imply that evolutionary explanations are (...) improved by the inclusion of ecological details. Nor are ecological explanations necessarily improved by the inclusion of information about trait variation, heritability, effective population size, or other standard evolutionary factors. To illustrate, I develop a version of Kitcher’s “gory details” argument to show that, even for some trait that is under strong directional selection, a dynamically sufficient explanation of its ecological relationships should ignore most of the information explaining why that trait is evolving. The wholesale integration of ecology and evolution looks even less appealing when empirical sufficiency, a purely practical requirement, is taken into account. As a way forward, I propose an eco-evo partitioning framework. This strategy enables researchers to estimate the empirical sufficiency of a purely ecological, a purely evolutionary, or a combined eco-evo approach. (shrink)

Section I analyzes Sellars’s thought in light of some of his influential predecessors, specifically Ludwig Wittgenstein, Rudolf Carnap, John Cook Wilson, and Kazimierz Ajdukiewicz. The second group of essays explores from different perspectives Sellars’s place within the analytic tradition, including his relation with analytic Kantianism and analytic pragmatism. We present the first comprehensive theory of fairness that conceives of fairness as having two dimensions: a comparative and an absolute one. The comparative dimension of fairness has traditionally been the main interest of Broomean fairness theories. It has been analysed as satisfying competing individual claims in proportion to their respective strengths. And yet, many key contributors to Broomean fairness agree that ‘absolute’ fairness is important as well. We make this concern precise by introducing the Fairness formula and the absolute (...) priority rule and analyse their implications for comparative fairness. (shrink)

Integrating the study of human diversity into the human evolutionary sciences requires substantial revision of traditional conceptions of a shared human nature. This process may be made more difficult by entrenched, 'folkbiological' modes of thought. Earlier work by the authors suggests that biologically naive subjects hold an implicit theory according to which some traits are expressions of an animal's inner nature while others are imposed by its environment. In this paper, we report further studies that extend and refine our account (...) of this aspect of folkbiology. We examine biologically naive subjects' judgments about whether traits of an animal are 'innate', 'in its DNA' or 'part of its nature'. Subjects do not understand these three descriptions to be equivalent. Both innate and in its DNA have the connotation that the trait is species-typical. This poses an obstacle to the assimilation of the biology of polymorphic and plastic traits by biologically naive audiences. Researchers themselves may not be immune to the continuing pull of folkbiological modes of thought. (shrink)

Research on patients with damage to ventromedial frontal cortices suggests a key role for emotions in practical decision making. This field of investigation is often associated with Antonio Damasio’s Somatic Marker Hypothesis—a putative account of the mechanism through which autonomic tags guide decision making in typical individuals. Here we discuss two questionable assumptions—or ‘myths’—surrounding the direction and interpretation of this research. First, it is often assumed that there is a single somatic marker hypothesis. As others have noted, however, Damasio’s ‘hypothesis’ (...) admits of multiple interpretations (Dunn et al. [2006]; Colombetti [2008]). Our analysis builds upon this point by characterizing decision making as a multi-stage process and identifying the various potential roles for somatic markers. The second myth is that the available evidence suggests a role for somatic markers in the core stages of decision making, that is, during the generation, deliberation, or evaluation of candidate options. On the contrary, we suggest that somatic markers most likely have a peripheral role, in the recognition of decision points, or in the motivation of action. Wie ist die gegenwärtige Norm der Menschenwürde, wie sie auch im Grundgesetz enthalten ist, vor dem Hintergrund der Theorien des vehementen Moralkritikers Nietzsche einzuschätzen? Welchen Stellenwert hat die Würde des Menschen im Zeitalter des Posthumanismus überhaupt? Im ersten Teil skizziert der Autor zunächst die wichtigsten philosophischen Konzeptionen der Menschenwürde von Cicero bis Kant. Dabei macht er deutlich, welche Probleme die gegenwärtige Rezeption historischer Konzeptionen aufwirft. (...) This article considers the prospects of inference to the best explanation as a method of confirming causal claims vis-à-vis the medical evidence of mechanisms. I show that IBE is actually descriptive of how scientists reason when choosing among hypotheses, that it is amenable to the balance/weight distinction, a pivotal pair of concepts in the philosophy of evidence, and that it can do justice to interesting features of the interplay between mechanistic and population level assessments.

Philosophers investigating the interpretation and use of conditional sentences have long been intrigued by the intuitive correspondence between the probability of a conditional `if A, then C' and the conditional probability of C, given A. Attempts to account for this intuition within a general probabilistic theory of belief, meaning and use have been plagued by a danger of trivialization, which has proven to be remarkably recalcitrant and absorbed much of the creative effort in the area. But there is a strategy (...) for avoiding triviality that has been known for almost as long as the triviality results themselves. What is lacking is a straightforward integration of this approach in a larger framework of belief representation and dynamics. This paper discusses some of the issues involved and proposes an account of belief update by conditionalization. (shrink)

Conditionals with conditional constituents pose challenges for _the Thesis_, the idea that the probability of a conditional is the corresponding conditional probability. This note is concerned with two proposals for overcoming those challenges, both inspired by early work of van Fraassen: the _Bernoulli Semantics_ associated with Stalnaker and Jeffrey, and augmented with a mechanism for obtaining “local probabilities” by Kaufmann; and a proposal by Bacon which I dub _Ordinal Semantics_. Despite differences in mathematical details and emphasis of presentation, both proposals (...) lend themselves for use as a basis for a modal-theoretic interpretation of embedded conditionals. The goal of this note is to compare the two frameworks by implementing a model for the interpretation of conditionals in each, based on the same underlying probability model for non-conditional sentences. I show that in the Ordinal model, certain sentences are assigned probabilities that do not accord with intuitions. This problem is familiar from the literature on Bernoulli models and can be addressed by introducing Kaufmann-style local probabilities into Ordinal models. I then show that Bernoulli Semantics has other limitations, in that it assigns probabilities in violation of the Thesis to certain very complex formulas. The upshot is that a fusion of the theories may be our best shot at getting the predictions right. (shrink)

A measure of coherence is said to be reliability conducive if and only if a higher degree of coherence (as measured) results in a higher likelihood that the witnesses are reliable. Recently, it has been proved that several coherence measures proposed in the literature are reliability conducive in a restricted scenario (Olsson and Schubert 2007, Synthese 157:297–308). My aim is to investigate which coherence measures turn out to be reliability conducive in the more general scenario where it is any finite (...) number of witnesses that give equivalent reports. It is shown that only the so-called Shogenji measure is reliability conducive in this scenario. I take that to be an argument for the Shogenji measure being a fruitful explication of coherence. In this paper I offer an anti-Humean critique to Williamson and Russo’s approach to medical mechanisms. I focus on one of the specific claims made by Williamson and Russo, namely the claim that micro-structural ‘mechanisms’ provide evidence for the stability across populations of causal relationships ascertained at the (macro-) level of (test) populations. This claim is grounded in the epistemic account of causality developed by Williamson, an account which—while not relying exclusively on mechanistic evidence for justifying causal judgements—appeals nevertheless to (...) mechanisms, and rejects their anti-Humean interpretation in terms of capacities, powers, potencies, etc. By using (and expanding on) Cartwright’s basic critique against Humean mechanisms, I suggest that, in order to move beyond the level of plausibility, Williamson and Russo’s position is in need of a clarification as to the occurent reading of the components, functioning and interferences of mechanisms. Relatedly, as concerns Williamson’s epistemic account of causation, I argue that this account is in need of a more straightforward answer as to what truth-makers its causal claims should have. It is widely recognized that the innate versus acquired distinction is a false dichotomy. Yet many scientists continue to describe certain traits as “innate” and take this to imply that those traits are not acquired, or “unlearned.” This article asks what cognitive role, if any, the concept of innateness should play in the psychological and behavioural sciences. I consider three arguments for eliminating innateness from scientific discourse. First, the classification of a trait as innate is thought to discourage empirical research (...) into its developmental origin. Second, this concept lumps together a number of different biological properties that ought to be treated as distinct. Third, innateness is associated with the outmoded folk biological theory of essentialism. In response to these objections, I consider two attempts to revise the concept of innateness which aim to make it more suitable for scientific explanation and research. One proposal is that innateness can be defined in terms of the biological property of environmental canalization. On this view, a trait is innate to the extent that it is developmentally buffered against a range of different environments. Another proposal is that innateness serves as an explanatory primitive for cognitive science. This view holds that there exist a sharp boundary between psychological and biological explanations and that to identify a trait as innate means that it falls into the latter explanatory domain. Sometimes we receive evidence in a form that standard conditioning (or Jeffrey conditioning) cannot accommodate. The principle of maximum entropy (MAXENT) provides a unique solution for the posterior probability distribution based on the intuition that the information gain consistent with assumptions and evidence should be minimal. Opponents of objective methods to determine these probabilities prominently cite van Fraassen’s Judy Benjamin case to undermine the generality of maxent. This article shows that an intuitive approach to Judy Benjamin’s case supports maxent. This (...) is surprising because based on independence assumptions the anticipated result is that it would support the opponents. It also demonstrates that opponents improperly apply independence assumptions to the problem. (shrink)

In this paper, I will present a puzzle for logical analyses, such as Russell’s analysis of definite descriptions and Recanati’s analysis of ‘that’-clauses. I will argue that together with Kripke’s disquotational principles connecting sincere assent and belief such non-trivial logical analyses lead to contradictions. Following this, I will compare the puzzle about logical analysis with Frege’s puzzle about belief ascriptions. We will see that although the two puzzles do have similarities, the solutions to Frege’s puzzle cannot be applied mutatis mutandis (...) to the puzzle about logical analysis. Hence, to say it with Kripke, the main thesis of this paper is that the puzzle is a puzzle. A complete solution to the puzzle promises a better understanding of both logical analyses and belief ascriptions. (shrink)

Research over the last two decades has identified a group of meiosis‐specific proteins, consisting of budding yeast Spo13, fission yeast Moa1, mouse MEIKIN, and Drosophila Mtrm, with essential functions in meiotic chromosome segregation. These proteins, which we call meiosis I kinase regulators (MOKIRs), mediate two major adaptations to the meiotic cell cycle to allow the generation of haploid gametes from diploid mother cells. Firstly, they promote the segregation of homologous chromosomes in meiosis I (reductional division) by ensuring that sister kinetochores (...) face towards the same pole (mono‐orientation). Secondly, they safeguard the timely separation of sister chromatids in meiosis II (equational division) by counteracting the premature removal of pericentromeric cohesin, and thus prevent the formation of aneuploid gametes. Although MOKIRs bear no obvious sequence similarity, they appear to play functionally conserved roles in regulating meiotic kinases. Is it appropriate to blame people unequally if the only difference between them was a matter of luck? Suppose Alice would drive recklessly if she could, Belen drove recklessly but didn’t harm anyone, and Cleo drove recklessly and killed a child. Luck-advocates emphasize that in real life we do blame such agents very unequally. Luck-skeptics counter that people aren’t responsible for factors beyond their control, or beyond their quality of will. I’ll defend a somewhat reconciliatory view. I’ll concede to the (...) skeptics that these agents are equally culpable. Nonetheless, I’ll suggest with the luck-advocates that it’s fitting to blame them unequally. That’s because their culpability is unequally significant for us: Cleo’s culpability concerns us more than Belen’s, and Belen’s more than Alice’s—just like the fault of a close aggressor concerns us more than that of an aggressor far off in place and time. And it’s fitting for us to respond with more blame to faults that concern us more. Indeed, blaming people simply in proportion to their culpability manifests a form of fetishism, or problematic mere-matter-of-principle concern. So while many skeptical tenets may hold, in substance the luck-advocates are right. (shrink)

The study of human-human communication and the development of computational models for human-agent communication have diverged significantly throughout the last decade. Yet, despite frequently made claims of “super-human performance” in, e.g., speech recognition or image processing, so far, no system is able to lead a half-decent coherent conversation with a human. In this paper, we argue that we must start to re-consider the hallmarks of cooperative communication and the core capabilities that we have developed for it, and which conversational agents (...) need to be equipped with: incremental joint co-construction and mentalizing. We base our argument on a vast body of work on human-human communication and its psychological processes that we reason to be relevant and necessary to take into account when modeling human-agent communication. We contrast those with current conceptualizations of human-agent interaction and formulate suggestions for the development of future systems. (shrink)

In order to explain that sentences containing empty definite descriptions are nevertheless true or false, Russell famously analyzes sentences of the form ‘The F is G’ as ‘There is exactly one F and it is G’. Against this it has been objected that Russell’s analysis provides the wrong truth-conditions when it comes to non-doxastic attitude ascriptions. For example, according to Heim, Kripke, and Elbourne (HKE), there are circumstances in which (1) is true and (2) is false. Hans wants the ghost (...) in his attic to be quiet tonight.Hans wants there to be exactly one ghost in his attic and for it to be quiet tonight. After all, the argument goes, unlike (2), (1) can be true without Hans wanting there to be exactly one ghost in his attic. Kaplan and Neale famously reply that the HKE objection presupposes that non-doxastic attitudes are closed under entailment, which they are not. For Rostworowski, on the other hand, the problematic principle used by the HKE objection is a substitutivity principle for non-doxastic attitude ascriptions. This is further supported by the fact that, as Elbourne points out, Russell’s analysis already leads to a problem similar to the HKE objection together with substitutivity alone. By questioning substitutivity for non-doxastic attitude ascriptions, Rostworowski tries to block both the HKE objection and Elbourne’s variant of the HKE objection. In this paper, I will argue that Russell’s analysis of definite descriptions leads to a variant of the HKE objection even in the context of doxastic attitude ascriptions. Since, as we will see, doxastic attitude ascriptions do not seem to suffer from the substitutivity problems discussed by Rostworowski in the context of non-doxastic attitude ascriptions, this will further exacerbate the problem for Russell’s analysis. I will then discuss the possibility to reject substitutivity for doxastic attitude ascriptions using a contextualist analysis of attitude ascriptions. However, we will see that, independent of whether we accept substitutivity for doxastic attitude ascriptions, a complete solution of the doxastic problem has to reject Russell’s analysis of the truth-conditions of sentences of the form ‘The F is G’. Concluding, I will show that, unlike Russell’s analysis, the Frege–Strawson analysis of definite descriptions, according to which a sentence of the form ‘The F is G’ presupposes that there is exactly one F, rather than asserting it, provides an explanation of the HKE objection, Elbourne’s variant of the HKE objection, and the doxastic problem presented in this paper. This will speak not only in favor of a Fregean analysis of definite descriptions, but also of a Fregean conception of propositions. (shrink)

With the widespread use of artificial intelligence, it becomes crucial to provide information about these systems and how they are used. Governments aim to disclose their use of algorithms to establish legitimacy and the EU AI Act mandates forms of transparency for all high-risk and limited-risk systems. Yet, what should the standards for transparency be? What information is needed to show to a wide public that a certain system can be used legitimately and responsibly? I argue that process-based approaches fail (...) to satisfy, as knowledge about the development process is insufficient to predict the properties of the resulting system. Current outcome-based approaches [Mitchell et al., 2019; Loi et al., 2021] are also criticized for a lack of attention to the broader socio-technical system and failure to account for empirical results that show that people care about more than just the outcomes of a process [as reported by Meyerson et al. (Procedural justice and relational theory: Empirical, philosophical, and legal perspectives, Taylor & Francis, 2021)]. Instead, I propose value-based transparency, on which the information we need to provide is what values have been considered in the design and how successful these have been realized in the final system. This can handle the objections to other frameworks, matches with current best practices on the design of responsible AI and provides the public with information on the crucial aspects of a system’s design. Using a variant of Schiffer’s puzzle regarding de re belief, I recently presented a new argument against the so-called Naive Russellian theory, consisting of the following theses: ( \(NR_{1}\) ) The propositions we say and believe are Russellian propositions, i.e., structured propositions consisting of the objects, properties, and relations our thoughts and speech acts are about; ( \(NR_{2}\) ) Names (and other singular terms) are directly referential terms, i.e., the propositional content of a name is just its referent; ( \(NR_{3}\) (...) ) A sentence of the form ‘_A_ believes/disbelieves that _S_’ is true in a context _c_ if and only if the referent of _A_ in _c_ believes/disbelieves the proposition expressed by _S_ in _c_. In this paper, I will argue that my variant of Schiffer’s puzzle is not only a problem for the Naive Russellian theory, but for every theory of belief ascriptions entailing ( \(NR_{3}\) ). Such theories are also called _relational analyses of belief ascriptions_. Here the main alternative to a Neo-Russellian theory, consisting of ( \(NR_{1}\) ) and ( \(NR_{2}\) ), is a Fregean theory, according to which the propositions we say and believe are Fregean propositions, i.e., structured propositions consisting of ways the objects, properties, and relations our thoughts and speech acts are about are presented to the speaker or agent. I will argue that such variants of the relational analysis are committed to principles very similar to the principles used by my Schiffer puzzle. Concluding, I will discuss Fregean and Neo-Russellian alternatives to the relational analysis, and I will argue that, although there are Neo-Russellian alternatives to the relational analysis which provide a solution to my variant of Schiffer’s puzzle, there seem to be no such Fregean alternatives. Inference to the Best Explanation is usually employed in the Scientific Realism debates. As far as particular scientific theories are concerned, its most ready usage seems to be that of a theory of confirmation. There are however more uses of IBE, namely as an epistemological theory of testimony and as a means of categorising and justifying the sources of evidence. In this paper, I will present, develop and exemplify IBE as a theory of the quality of evidence - taking examples (...) from medicine and showing that IBE can thereby provide the epistemological underpinning and justify the criteria of grading quality of mechanistic evidence that have been recently provided in the Clarke et al. paper on how evidence of medical mechanisms is to be construed alongside population studies. Das vorliegende Themenheft „Ethik der Integrität“ der Zeitschrift für Praktische Philosophie vereint Beiträge aus der Rechts-, Moral- und Umweltphilosophie, die sich mit den deskriptiven und normativen Möglichkeiten und Grenzen von „Integrität“ beschäftigen. Die Untersuchung von Integrität nimmt dabei die Anwendung des Konzepts auf menschliche Personen und nichtmenschliche Naturwesen wie Tiere, Pflanzen und Ökosysteme in den Blick. Integrität impliziert im weitesten Sinne die Annahme, Wesen könnten und sollten als „ganze“ betrachtet, auch gegen innere und äußere Widerstände in der Lage sein, gemäß (...) ihrer eigenen „Zwecke“ zu verfahren. Zwar taucht integritas bereits bei Cicero in De officiis und bei Thomas v. Aquin in Summa theologiae vereinzelt auf, doch nimmt die Begriffsverwendung vor allem in der zweiten Hälfte des 20. Jahrhunderts zu. Es scheint offenkundig ein Bedürfnis danach zu bestehen, z.T. recht unterschiedliche Phänomene als „Ganzheiten“ zu beschreiben und deren „Intaktheit“ positiv zu bewerten. Personen sollten hiernach in elementaren, ihre Identität dennoch im umfassenden Sinne betreffenden Aspekten in „Übereinstimmung“ mit sich selbst leben können. Die Integrität der Natur wird in wichtigen klimapolitischen Verträgen wie dem Abkommen von Paris sowie bei der Kodifizierung der Rechte der Natur z. B. in der Verfassung von Ecuador als Wert normativ vorausgesetzt. Das naturwissenschaftliche Paradigma des Anthropozäns verwendet ebenfalls eine umfassende Perspektive auf Mensch und Natur, die auch als Plädoyer für die Schutzwürdigkeit der Erde als „ganzer“ ausgedeutet wird. Noch wissen wir nicht, ob dem Konzept der Integrität im 21. Jahrhundert eine ähnliche „Karriere“ bevorsteht, wie sie der Begriff der Würde im 20. Jahrhundert erlebt hat. Dieses Heft ist ein Versuch, die verschiedenen Verwendungskontexte zu überblicken und einige stichprobenartig zu überprüfen. (shrink)

Before engaging with the already intensive and still increasing personal branding activities in many fields of practice, a scholarly approach would call for a more specific definition of the concept of personal branding processes and the resulting human brands. A multi-step analysis of the growing body of literature on personal branding is employed, integrating a framework that covers six key research streams of personal branding, (1) terminology and definition, (2) underlying theories, (3) classes and categories, (4) benefits, (5) antecedents, and (...) (6) key ingredients and applications, complemented by challenges the domain of personal branding has to cope with. The analysis shows that personal branding is an interdisciplinary concern, which is still in its infancy and in which universally valid personal branding frameworks or even theories cannot be identified yet. Personal branding appears as a source for new academic impulses, as it may sensitize scholars to opportunities for intensifying collaboration with practitioners and with other academic domains to enrich and disseminate knowledge in their fields. Recent developments in the field of artificial intelligence (AI) present profound challenges for law. These challenges stem from law’s anthropocentrism, which is often left unspoken. This essay examines both the epistemic and normative dimensions of anthropocentrism within German Law, with a focus on Private Law. It defends the proposition that law’s anthropocentrism does not inherently oppose the idea of granting AI some form of legal capacity. Rather, so the essay argues, it is essentially a question of regulatory prudence to determine (...) the conditions and criteria under which the law should grant a legal status, legal capacity, or partial legal capacity to AI entities. Nonetheless, it is crucial to acknowledge that the core principles of private law as well as questions of liability for fault and negligence are rooted in human agency and cannot be directly applied to AI. It will be argued that the legal discourse on the recognition of AI is to be understood as a fundamentally political discourse. The political dimension of that discourse will be analyzed through the lens of the political theories of Hannah Arendt and Jaques Rancière, among others. (shrink)

Advance directives are propagated as instruments to maintain patients’ autonomy in case they can no longer decide for themselves. It has been never been examined whether patients’ and healthy persons themselves are inclined to adhere to these documents. Patients’ and healthy persons’ views on whether instructions laid down in advance directives should be followed because that is (or is not) “the right thing to do”, not because one is legally obliged to do so, were studied and compared with that of (...) medical staff. Method: Vignette study presenting five cases. Cancer patients, healthy persons, nursing staff and physicians (n = 100 in each group) were interviewed. An adherence score was calculated (maximum value 5). The adherence score is found to be low in all groups, yet lowest in patients (1.55; standard deviation 1.13) and healthy controls (1.60; 1.37). The scores are significantly different between nursing staff on the one hand and patients and healthy controls on the other (p < 0.005 and p < 0.05, respectively), and between doctors and patients (p < 0.05). Interviewees who want these documents to be followed tend to live alone and to have already written an advance directive. Conclusions: Cancer patients and healthy persons widely disregard instructions laid down in advance directives and consider them less binding than physicians and nursing staff do. Only a minority tends to adhere more to advance directives. To improve decision-making at the end of life when patients are no longer able to decide for themselves alternative concepts, such as advanced care planning, should be considered. (shrink)
