The article deals with a study of a distinct criminal punishment established in the Criminal Code and the Code of Punishment Enforcement of the Republic of Lithuania—restriction of liberty, as an alternative to imprisonment. Without investigating extensively the course of development of this penalty, in the article it is sought to overview the development trends of restriction of liberty; analyse the problems of enforcing this penalty and suggest measures to eliminate them; investigate whether the legal regulation of Lithuania is in (...) line with the provisions of the main international instruments relating to non-custodial sanctions (1990 United Nations Standard Minimum Rules for Non-custodial Measures (the so-called Tokyo Rules), Recommendation R (92) 16 of the Committee of Ministers of the Council of Europe to Member States on the European rules on community sanctions and measures, Recommendation Rec (2000) 22 of the Committee of Ministers of the Council of Europe to Member States on improving the implementation of the European rules on community sanctions and measures); review the progressive legal regulation of restriction of liberty in place in individual states and provide a comparison between the national and foreign experience in relation to the penalty of restriction of liberty. In addition, the article offers guidelines for the improvement of the legal regulation and implementation of the legal institute of restriction of liberty. (shrink)

In this article there is analysed an independent criminal punishment – public works, which was determined by the Criminal Code and the Punishment Enforcement Code of the Republic of Lithuania as alternative punishment to freedom deprivation punishment. Without looking into the process of historical development, it is made an attempt to overview the tendency of public works’ spreading, to analyse the problems of public works’ realisation and how to deal with them. There is compared Lithuanian legal regulations with international documents, (...) which are related with alternative punishment as alternative to freedom deprivation punishment. There is also looked over public works’ legal regulations in foreign countries, an experience of public works implementation in Lithuania and abroad and, the most important, there had been given landmarks of public works institution improvement. The article is based upon the documents of the United Nations and the Council of Europe, legal regulations and practice of public works in foreign countries, opinion and studies of foreign scientists and the other authors, the data of statistics and questioning of the officers of correctional inspections. In this book Strawson is again considering topics as the existence of the exterior world, the moral attitudes, the universal... The novelty is not so in his original ideas as in the fact that these are useful to keep on completing the doctrine of a "descriptive" and "naturalist" metaphy-sick against "revisionism" such as the scepticism in its different modalities.

One of the greatest challenges of consciousness research is to understand the relationship between consciousness and its implementing substrate. Current research into the neural correlates of consciousness regards the biological brain as being this substrate, but largely fails to clarify the nature of the brain-consciousness connection. A popular approach within this research is to construe brain-consciousness correlations in causal terms: the neural correlates of consciousness are the causes of states of consciousness. After introducing the notion of the neural correlate of (...) consciousness, we argue (see Against Causal Accounts of NCCs) that this causal strategy is misguided. It implicitly involves an undesirable dualism of matter and mind and should thus be avoided. A non-causal account of the brain-mind correlations is to be preferred. We favor the theory of the identity of mind and brain, according to which states of phenomenal consciousness are identical with their neural correlates. Research into the neural correlates of consciousness and the theory of identity (in the philosophy of mind) are two major research paradigms that hitherto have had very little mutual contact. We aim to demonstrate that they can enrich each other. This is the task of the third part of the paper in which we show that the identity theory must work with a suitably defined concept of type. Surprisingly, neither philosophers nor neuroscientists have taken much care in defining this central concept; more often than not, the term is used only implicitly and vaguely. We attempt to open a debate on this subject and remedy this unhappy state of affairs, proposing a tentative hierarchical classification of phenomenal and neurophysiological types, spanning multiple levels of varying degrees of generality. The fourth part of the paper compares the theory of identity with other prominent conceptions of the mind-body connection. We conclude by stressing that scientists working on consciousness should engage more with metaphysical issues concerning the relation of brain processes and states of consciousness. Without this, the ultimate goals of consciousness research can hardly be fulfilled. (shrink)

Contract cheating is currently one of the most serious academic integrity issues around the globe. Numerous studies have been conducted, mostly in English speaking countries. So far, no such research has been conducted in Czechia, and consequently there have been no specific data available on Czech students’ fraudulent behaviour. For this study, we created a questionnaire to obtain primary data on student usage of essay mills and their self-reported exposure to contract cheating. The questionnaire focused on students and graduates of (...) Czech universities and collected a total of 1016. Of that number, 8% of respondents admit having engaged in contract cheating. The questionnaire responses yielded useful information and insight into students’ attitudes regarding contract cheating and the extent of this phenomenon in Czechia. We now know more about their reasons for contract cheating and have insight into their thoughts regarding possible discovery. (shrink)

Este trabajo discute qué razones tenemos para pensar que existe un espacio ontológico modal y por qué debemos pensar que este espacio está constituido por una pluralidad de mundos posibles. Después se presentan tres teorías metafísicas sobre la naturaleza de los mundos posibles: la concepción realista extrema de David Lewis, la concepción realista moderada de Alvin Plantinga y la concepción de los mundos posibles como universales estructurales máximos. Un breve examen comparativo tratará de mostrar por qué la tercea opción es (...) la más prometedora o, al menos, parece serlo. El trabajo finalmente considera el panorama que tiene por delante una defensa plenamente desarrollada de la teoría modal basada en universales. (shrink)

This article investigates the categories of variegated social formations and structural historical heterogeneity, which have been developed from Latin American Marxism as a theoretical attempt that aims to account for the complexity of the debates around historical time. For this, the work of René Zavaleta Mercado (Bolivia) and Aníbal Quijano (Peru) is analyzed, revealing their connections and divergences. It is concluded that there are important meeting points, but also disagreements.

The forceful impact of Michel Foucault’s work in the humanities and social sciences is apparent from the sheer abundance of its uses, appropriations, and refigurations. This article calls for greater self-conscious reflexivity about the relationship between our uses of Foucault and the opportunities afforded by his work. We argue for a clearer distinction between analytics and concepts in Foucault-inspired work. In so doing we draw on key moments of methodological self-reflection in Foucault’s Collège de France lectures and elsewhere. This distinction (...) helps identify different ways that Foucault might be put to productive use today as well as what can go wrong therein, a concern we develop with reference to Giorgio Agamben’s post-Foucaultian contributions to political theory. We are eager to open up a possibility that has been infrequently explored despite Foucault’s contemporary influence—-the idea that critique in and through Foucault is empirical critique. This idea can help facilitate a gain in reflexivity in the broader landscapes of contemporary theory, inquiry, and critique. (shrink)

Critical congenital heart disease screening is rapidly becoming the standard of care in the United States after being added to the Recommended Uniform Screening Panel in 2011. Newborn screens typically do not require affirmative parental consent. In fact, most states allow parents to exempt their baby from receiving the required screen on the basis of religious or personally held beliefs. There are many ethical considerations implicated with allowing parents to exempt their child from newborn screening for CCHD. Considerations include the (...) treatment of religious exemptions in our current legal system, as well as medical and ethical principles in relation to the rights of infants. Although there are significant benefits to screening newborns for CCHD, when a parent refuses for religious or personal beliefs, in the case of CCHD screening, the parental decision should stand. Putnam's Model- Theoretic Argument has been generally held as invalid. In this work, attention is addressed to two broad facts understated by critics and commentators: (i) there are, at least, two different model-theoretic arguments. One is directed against realism and the other is directed to naturalistic semantics. The general rejection affects the former, but it is open to discussion if it affects the latter; (ii) on the other hand, the model-theoretic argument construed as a reductio argument has not - prima (...) facia - ontological consequences, but only restrains our methodology to deal with the intentional realm. El trabajo presenta la conjetura de que los mundos posibles son universales estructurales máximos. En primer lugar, se explican brevemente las diferentes concepciones actualistas existentes sobre los mundos posibles y los problemas sistemáticos que deben enfrentar. Se argumenta que la conjetura presentada muestra cómo todas esas concepciones pueden ser unificadas en una teoría única y simple. En segundo lugar, se explica por qué la mejor alternativa para la constitución del espacio modal son los universales trascendentes. Finalmente, se indican brevemente algunas (...) dificultades para la concepción presentada. Una justificación definitiva de la conjetura deberá consistir principalmente en la solución de esas dificultades. The work presents the conjecture that possible worlds are maximal structural universals. First, the paper explains roughly the different actualist extant conceptions of possible worlds and the systematic problems they have to face. It is argued that the conjecture presented shows how all those different conceptions can be unified in a single simple theory. Second, it is explained why the best alternative for the constitution of the modal space is a domain of transcendent universals. Finally, some difficulties for the conception are briefly indicated. A definitive justification of the conjecture presented should consist mainly in tackling those difficulties. (shrink)

The term etonism is from «Etona» that means flag, marks, evidence, and reason in Kikôngo. The variants in Umbûndu: etonolo or etonuilo means, allegations, reasons, indulgence (tolerance). The Nyaneka form is etŏnya: 1) reasons, 2) allegations, 3) indulgence and 5) the justice and the tolerance. Etona is Angolan artist (sculptor/painter). In his sculpture they are morphologically evidenced three treatments in the surface of the matter, namely 1) flat treatment; 2) rude treatment and finally 3) accidental treatment. Each one is a (...) code: #1. The flat treatment indicates well-knowledge; a man of superior class; race or tribe or religion of majority; thought well-organized and structured. In painting, the hot intensity indicates dominance, prosperity, energy, intense desires; #2. The rude treatment reveals an acquired knowledge without academism, self-taught; medium class men; speech out of the scientific perimeters but with certain admissibility; race, tribe or religion of lot of people, but not of majority. In his painting, the neutral intensity marks the balance and inspires recomfort nurtured from two opposed poles (hot and cold); #3. The accidental part of the sculpture indicates some knowledge’s lack (pure empiricism); inferior class; race, tribe, religion of minority. In the painting, the cold intensity is naturally contrary of #1. Etonism is the tolerant reason between #1=I, #2=YOU and #3=HE. All of them form the coherent society that we call WE: the Etonian jusphilosophy that African peoples need for stability of their democracies and finishing their War. (shrink)

Mediation is a process in which two parties agree to resolve their dispute by negotiating over alternative solutions presented by a mediator. In order to construct such solutions, the mediator brings more information and knowledge, and, if possible, resources to the negotiation table. In order to do so, the mediator faces the challenge of determining which information is relevant to the current problem, given a vast database of knowledge. The contribution of this paper is the automated mediation machinery to resolve (...) this issue. We define the concept of a Mediation Problem and show how it can be described in Game Description Language. Furthermore, we present an algorithm that allows the mediator to efficiently determine which information is relevant to the problem and collect this information from the negotiating agents. We show with several experiments that this algorithm is much more efficient than the naive solution that simply takes all available knowledge into account. (shrink)

It is argued that instantiation, i.e. the relation between particular objects and properties (conceived as universals or tropes) is indeed an ontologically robust relation. The relation of instantiation is required to explain the difference between a state of affairs of, for example, a being F, and the mereological fusion [ a + F]. If instantiation is a true relation, then Bradley’s Regress ensues. It is argued, nevertheless, that the regress cannot be taken as a reason to reject the existence of (...) instantiation or to reject the existence of properties as entities numerically different from particular objects to which the properties should be related. All the nominalist alternatives suffer from similar regresses. Bradley’s Regress should, therefore, be addressed head-on. After dismissing all the applicable ways in which an infinite regress may be deemed vicious, it is argued that Bradley’s Regress is — in a sense — harmless. (shrink)

We provide a brief overview of the shift toward the intrinsic view of brain activity, describing in particular the structural and functional connectivity patterns of the “Default mode network”. We then consider the Default mode network in a specifically cognitive setting and ask what changes the focus on the Default mode network and other sorts of intrinsic activity require from models put forward by cognitive neuroscientists.

Alonso Briceño, el primer filósofo chileno, sostuvo que, para todo x, el ser de x = la haecceitas de x y –además– que hay una distinción ‘formal’ entre el ser de x y la esencia de x. En general, hay una distinción ‘formal’ entre los ítems z y v si y solo si: (i) z  v, y (ii) z y v son mutuamente inseparables. Se sigue de estas tesis que el ‘ser’ debe tomarse como un componente ontológico específico en (...) los objetos particulares y que es idéntico con la haecceitas del objeto. Esto se denomina aquí “la intuición de Briceño”. En este trabajo se considera la relevancia que la intuición de Briceño podría tener para dos de las teorías más importantes acerca de la naturaleza de los objetos particulares: las teorías en las que los objetos particulares están constituidos por un sustrato y sus propiedades, y las teorías en las que los objetos particulares son cúmulos de tropos. Se argumenta que en ambos casos la intuición de Briceño, esto es, la idea de que hay un tropo específico de ser en el objeto particular, trae consigo ventajas sistemáticas importantes y, lo que es más, permite la unificación teórica de ambas perspectivas, normalmente consideradas como incompatibles entre sí. La discusión acerca de la capacidad de nuestra inteligencia de acceder al conocimiento de la realidad en sí es y sigue siendo una de las más antiguas y apasionantes de la filosofía. Piaget revolucionó la historia de la psicología y la pedagogía a partir de sus descubrimientos científicos relativos al modo en que el ser humano conoce. Sin embargo, por su misma inclinación filosófica, su constructivismo pedagógico quedó fuertemente arraigado en tradiciones filosóficas inmanentistas, a punto tal que la asociación entre (...) constructivismo pedagógico y antirrealismo constituye una suerte de lugar común y un cierto presupuesto dogmático. Lo cierto es que esta asociación no constituye la única alternativa posible y, hasta cierto punto, ni siquiera parece responder cabalmente a los principios o consecuencias últimas de los hallazgos del constructivismo de Piaget. Es posible justificar el constructivismo pedagógico desde posiciones realistas, siempre y cuando se revisen algunos supuestos que la modernidad ha instalado de manera no muy crítica en los círculos educativos y filosóficos. La revisión de la noción de representación, concebida según la tradición aristotélica y aggiornada por los aportes del constructivismo, permite abrir un camino de conciliación entre el constructivismo pedagógico y un tipo de realismo que sea, a la vez, robusto y plural. This article examines the dominant agricultural model in Colombia of which the emergence of biofuels is an inevitable and major consequence. Some uncertainties and complexities of the introduction of biofuels and the use of genetically modified crops are analyzed, including a general reflection on the possibilities of producing biofuels on the basis of a model of ecological agriculture.

En una serie de trabajos Carol Cleland ha argumentado por los últimos veinte años que la búsqueda de una definición de la vida es no solo inútil sino contraproducente. Una definición en términos de condiciones necesarias y suficientes nos podría cegar para la tarea mucho más importante de desarrollar una teoría universal de la vida. La principal justificación para este alegato es que la vida es una clase natural. Términos para clases naturales no poseen definiciones ideales, porque pretenden hacer referencia (...) a rasgos objetivos del mundo y no hacer explícito el contenido de nuestro pensamiento o lenguaje. Se argumenta aquí que la vida es, en efecto, una clase natural y, luego, la semántica para el término vida no puede darse por una definición ideal con condiciones necesarias y suficientes. Sin embargo, la semántica del término vida no excluye la posibilidad de hallar una ‘definición real’ adecuada de la esencia de la vida, esto es, de qué es la vida. Una definición real no es la enunciación del significado de un término sino de una esencia. (shrink)
