In his 1958 seminal paper “Saints and Heroes”, J. O. Urmson argued that the then dominant tripartite deontic scheme of classifying actions as being exclusively either obligatory, or optional in the sense of being morally indifferent, or wrong, ought to be expanded to include the category of the supererogatory. Colloquially, this category includes actions that are “beyond the call of duty” (beyond what is obligatory) and hence actions that one has no duty or obligation to perform. But it is a (...) controversial category. Some have argued that the concept of supererogation is paradoxical because on one hand, supererogatory actions are (by definition) supposed to be morally good, indeed morally best, actions. But then if they are morally best, why aren't they morally required, contrary to the assumption that they are morally optional? In short: how can an action that is morally best to perform fail to be what one is morally required to do? The source of this alleged paradox has been dubbed the ‘good-ought tie-up’. In our article, we address this alleged paradox by first making a phenomenological case for the reality of instances of genuine supererogatory actions, and then, by reflecting on the relevant phenomenology, explaining why there is no genuine paradox. Our explanation appeals to the idea that moral reasons can play what we call amerit conferring role. The basic idea is that moral reasons that favor supererogatory actions function to confer merit on the actions they favor—they play a merit conferring role—and can do without also requiring the actions in question. Hence, supererogatory actions can be both good and morally meritorious to perform yet still be morally optional. Recognition of a merit conferring role unties the good-ought tie up, and (as we further argue) there are good reasons, independent of helping to resolve the alleged paradox, for recognizing this sort of role that moral reasons may play. Mindfulness-based interventions (MBIs) are being actively implemented in a wide range of fields – psychology, mind/body health care and education at all levels – and there is growing evidence of their effectiveness in aiding present-moment focus, fostering emotional stability, and enhancing general mind/body well-being. However, as often happens with popular innovations, the burgeoning interest in and appeal of mindfulness practice has led to a reductionism and commodification – popularly labelled ‘McMindfulness’ – of the underpinning principles and ethical foundations of such (...) practice which threatens to subvert and militate against the achievement of the original aims of MBIs in general and their educational function in particular. It is argued here that mindfulness practice needs to be organically connected to its spiritual roots if the educational benefits of such practice are to be fully realised. (shrink)

We here propose an account of what it is for an agent to be objectively justified in holding some belief. We present in outline this approach, which we call transglobal reliabilism, and we discuss how it is motivated by various thought experiments. While transglobal reliabilism is an externalist epistemology, we think that it accommodates traditional internalist concerns and objections in a uniquely natural and respectful way.

This article discusses the moral principles underlying the idea of humanitarian intervention. The analysis is in two parts, one historical and the other philosophical. First, the article examines arguments made in late medieval and early modern Europe for using armed force to punish the violation of natural law and to defend communities from tyranny and oppression, regardless of where they occur. It seeks to understand how moralists writing before the emergence of modern international law conceived what we now call humanitarian (...) intervention.In the context of international law, humanitarian intervention is usually understood to be an exception to the nonintervention principle. However, the natural law tradition regards international law as less important than the moral imperative to punish wrongs and protect the innocent.Second, the article considers how humanitarian intervention is justified within the reformulation of the natural law tradition displayed in recent efforts to theorize morality along Kantian lines. In this reformulation, humanitarian intervention is a product of the duty of beneficence and, more specifically, of the right to use force to protect the innocent. The article draws upon the biblical injunction “Thou shalt not stand idly by the blood of thy neighbor,” which has become a centerpiece of the modern reformulation, and briefly explores its application to humanitarian intervention in the context of international relations today. This reformulation of natural law explains why, despite modern efforts to make it illegal, humanitarian intervention remains, in principle, morally defensible. (shrink)

Leadership Ethics uses moral theory, as well as empirical research in psychology, to evaluate the reasons everyday leaders give to justify breaking the rules. Written for people without a background in philosophy, it introduces readers to the moral theories that are relevant to leadership ethics: relativism, amoralism, egoism, virtue ethics, social contract theory, situation ethics, (...) communitarianism, and cosmopolitan theories such as utilitarianism and transformational leadership. Unlike many introductory texts, the book does more than simply acquaint readers with different approaches to leadership ethics. I advocate a two part view concerning vagueness. On one hand I claim that vagueness is logically incoherent; but on the other hand I claim that vagueness is also a benign, beneficial, and indeed essential feature of human language and thought. I will call this view transvaluationism, a name which seems to me appropriate for several reasons. First, the term suggests that we should move beyond the idea that the successive statements in a sorites sequence can be assigned differing truth (...) values in some logically coherent way that fully respects the nature of vagueness -a way that [1] fully eschews any arbitrarily precise semantic transitions. We should transcend this impossible goal by accepting that vagueness harbors logical incoherence. Second, just as Nietzsche held that one can overcome nihilism by embracing what he called the transvaluation of all values, my position affirms vagueness, rather than despairing in the face of the logical absurdity residing at its very core. This affirmation amounts to a transvaluation of truth values, as far as sorites sequences are concerned. Third, the term ’transvaluationism’ has a nice ring to it, especially since one of the principal philosophical approaches to vagueness is called supervaluationism. I will call the first claim of transvaluationism, that vagueness is logically incoherent, the incoherence thesis . I will call the second claim, that vagueness is benign, beneficial, and essential, the legitimacy thesis . The legitimacy thesis, taken by itself, seems overwhelmingly plausible; anyone who denies it assumes a heavy burden of proof. But prima facie, it seems dubious that the legitimacy thesis can be maintained in conjunction with the incoherence thesis. For, there is reason to doubt whether there is any cogent way to embrace the incoherence thesis without thereby becoming mired in what Williamson (1994) calls global nihilism about vagueness -the view that vague terms are empty (i.e., they do not, and cannot, apply to anything). Global nihilism, Williamson argues, has such destructively negative consequences that it does not deserve to be taken seriously -for instance, the consequence that vastly many of our common sense beliefs are false, and the consequence that these beliefs are not even useful (since the constituent terms in ’Common sense beliefs are useful’ are vague and hence this statement turns out, given the [2] incoherence thesis, to be false itself). In short, the idea that one can adopt the incoherence thesis and then somehow transcend nihilism might initially seem hopelessly optimistic; transvaluationism would then be an unattainable, chimerical, goal rather than an intelligible and conceptually stable position concerning vagueness. Given certain widely held philosophical views about how language and thought must map onto the world in order for statements and the beliefs they express to be true -views that fall appropriately under the label ’referential semantics’ -transvaluationism probably is a chimerical goal. In his PhD proposal, now published as Seeing Sociological, Garfinkel [2006] formulated action in terms of a mutually constitutive structure—the Noesis-Noema Structures. This structure can be traced to Aaron Gurwitsch’s gestalt psychology and Law of Good Gestalt which theorises how participants prioritise functional Gestalts over other possible meanings of what is perceivable in their surroundings. While Gurwitsch illustrated his theory using images, in this paper we revisit Gurwitsch’s theory in light of the advances in recording real-time interaction to consider Gestalt (...) in spatio-temporality of real-time interaction. We consider the Law of Good Gestalt in terms of the dimensions of time and space, and postulate two analytical principles—the Principle of Good Momentary Gestalt and the Principle of Good Temporal Gestalt—for analysing a multi-angle video segment of a monologue taken from a training event. The analysis examines how the monologue was embedded in a multi-layer projection structure, so that during the time of the monologue, the trainer and trainees can be seen as achieving a transition between one activity to another while sustaining the frame of the training event. Through this, the analysis highlights the multi-layered structure of participants’ field of perception that constitutes their experience of the social activity, and explores a “method” to reconstruct such a structured field of perception through re-coupling meanings to the assemblages of multimodal resources recoverable on video. The factors preventing registered nurses from failing students in practice are multifaceted and have attracted much debate over recent years. However, writers rarely focus on what is needed to fail an incompetent pre-registration nursing student in their final placement. This hermeneutic study explored the mentor experience of failing a pre-registration nursing student in their final placement. A total of 19 mentors were recruited from 7 different healthcare organisations in both inner city and rural locations in the southeast of England. Participants (...) took part in individual reflective interviews about their experience of failing a pre-registration nursing student in their final placement. These experiences were interpreted through a hermeneutic discovery of meaning. The new horizon of understanding which developed as a result of this research is framed within the context of moral stress, moral integrity and moral residue with the overall synthesis being that these mentors’ stories presented a new horizon of moral courage. Lockheed Martin Corp. has funded research to generate a framework and methodology for developing semantic reasoning applications to support the discipline oflntelligence Analysis. This chapter outlines that framework, discusses how it may be used to advance the information sharing and integrated analytic needs of the Intelligence Community, and suggests a system I software architecture for such applications.

By reflecting on a variety of cartoon representations of teachers and their work, this paper outlines a semiotic approach to undertaking research on teachers' professional cultures.

We introduce an innovative technique that quantifies human expertise development in such a way that humans and artificial systems can be directly compared. Using this technique we are able to highlight certain fundamental difficulties associated with the learning of a complex task that humans are still exceptionally better at than their computer counterparts. We demonstrate that expertise goes through significant developmental transitions that have previously been predicted but never explicated. The first signals the onset of a steady increase in global (...) awareness that begins surprisingly late in expertise acquisition. The second transition, reached by only a very few experts in the world, shows a major reorganisation of global contextual knowledge resulting in a relatively minor gain in skill. We are able to show that these empirical findings have consequences for our understanding of the way in which expertise acquisition may be modelled by learning in artificial intelligence systems. This point is emphasised with a novel theoretical result showing explicitly how our findings imply a non-trivial hurdle for learning for suitably complex tasks. (shrink)

This article is a contribution to the critical sociology of science perspective introduced and developed by Pierre Bourdieu. The paper proposes a transversalist theory of science and technology production and diffusion. It is here argued that science and technology are comprised of multiple regimes where each regime is historically grounded, possesses its own division of labour, modes of cognitive and artifact production and has specific audiences. The major regimes include the disciplinary regime, utilitarian regime, transitory regime and research-technology regime. Though (...) each regime is autonomous, they are simultaneously closely interlaced. In science and technology, autonomy is not antithetical to interdependence and reciprocity. This study demonstrates for the four specified regimes of production and diffusion that differentiation is not contrary to interaction. In science, differentiation and interaction comprise two sides of the same coin. All regimes exhibit a measure of transversality. (shrink)

Neuhouser’s book is one of the most important contributions to the revival of Hegelian philosophy that has been taking place in Anglo-American philosophy over the last few years. Much of the debate in moral and political philosophy of the last few years has been set in terms of “the right” versus “the good,” and it is tempting to want to put Hegel in one of those categories and thereby also to classify him as either a “liberal,” a “communitarian,” or perhaps (...) a “romantic.” Neuhouser develops a powerful case for understanding him as none of these things. Instead he wants to understand Hegel as developing a social and political philosophy around the central conception of “self-determi- nation.” At first blush, that makes Hegel sound very much like the post-Kantian many now take him to be, but Neuhouser argues that, however true that might be, Hegel is best understood as continuing and developing certain key Rousseauian insights. In Neuhouser’s treatment, both Hegel and Kant are “post- Rousseauians,” and his understanding of what this means throws new and great light on understanding why Hegel’s social philosophy may still be of importance to us. Pressures are mounting upon Australian retailers including their ability to grow profit. Price deflation for many items, a lack of wage growth, and, the rise of huge online platforms is just some of the factors now creating difficulties for retailers. In the absence of sales growth, profit can only be improved with a focus on the cost side of the business. And, it is this focus that has brought about the potential for unethical decision making. This case study examines the (...) role of accountants in influencing this decision making. Accountants are often seen as the experts when it comes to cost control. Consequently, they have a unique opportunity to use their position to help ensure that when governance processes surrounding cost (and profit) management are established, or when key decisions are made, these are undertaken on an ethical basis. This teaching case explores this issue within three scenarios relevant to the current Australian retail industry. Firstly, the ethical concerns of the use of power by the big retailers to reduce costs within international and domestic supply chains are examined. Secondly, recent instances of questionable practices to inflate profits through rebate, and other, accounting methods are analysed. Finally, the design of remuneration systems is discussed within the context of whether these are creating unethical biases within organisational decision making. (shrink)

The fact of a religiously plural world is one that is readily acknowledged by believers and non-believers alike. For religious believers, however, this fact poses a set of problems. Religions, at least most of the world's great religions, seem to present conflicting visions of the truth and competing accounts of the way to salvation. Faced with differing accounts of God in Judaism, Buddhism, Islam or Hinduism, what, for example can the Christian claim for the truth of Christian beliefs about God? (...) John Hick, reflecting on the phenomenological similarity of worship in some of the great religious traditions, asks ‘whether people in church, synagogue, mosque, gurdwara and temple are worshipping different Gods or are worshipping the same God?’ . He rejects two possible answers to this question: that there exist many Gods, or that one religion, for example Christianity, worships the true God while all other religions worship false gods, which exist only in their imaginations. We propose an approach to epistemic justification that incorporates elements of both reliabilism and evidentialism, while also transforming these elements in significant ways. After briefly describing and motivating the non-standard version of reliabilism that Henderson and Horgan call “transglobal” reliabilism, we harness some of Henderson and Horgan’s conceptual machinery to provide a non-reliabilist account of propositional justification (i.e., evidential support). We then invoke this account, together with the notion of a transglobally reliable belief-forming process, to give an account of doxastic (...) justification. (shrink)

Today it is no news to point out that Kant’s doctrine of space as a form of intuition is motivated by epistemological considerations independent of his commitment to Euclidean geometry. These considerations surface—apparently without his own recognition—in Poincaré’s, Science and Hypothesis, the very work that helped turn analytically-minded philosophers away from the Critique. I argue that we should view Poincaré as refining Kant’s doctrine of space as the form of intuition, even as we see both views as arbitrarily limited—in Kant’s (...) case, to Euclidean transformations, and, in Poincaré's, to geometries of constant curvature. Both run together the question whether space is an a priori form of intuition with the question whether there are a priori constraints on its applied geometry. At his best, Kant sees—what Poincaré does not—that they are connected by a form of cognition consisting in the intuition of homogeneous pluralities, of totalities apprehended as unities. (shrink)

Law and emotion has evolved into a vibrant and diverse field, drawing in legal scholars and interdisciplinary partners from across the social sciences, hard sciences, and humanities. This introduction to the special section on law and emotion traces the history and theoretical underpinnings of this movement and situates the special section within it. The insights of emotion research can help legal scholars and practitioners to better calibrate law to human realities and to foster a desired set of emotional experiences among (...) law’s subjects. Law, in turn, offers to researchers a forum within which to explore emotion in a dynamic and influential real-world setting. The introduction ends with a call to disciplined interdisciplinarity. Thinking about international affairs has oscillated between idealism and realism throughout the modern period. Moralists continue to search for a way to combine what is reasonable in each in an ethically defensible middle between those extremes.

Friedrich Nietzsche’s The Birth of Tragedy1 is by many measures both his most accessible and his most difficult work. As Michael Tanner notes, [W]hat marks off [The Birth of Tragedy] as sharply different from everything he wrote afterwards is its initially conventional mode of presentation, that of academic essay. This article explores the crucial moments of scientists’ research activities when they decide to shift to a radical new domain or to perpetuate a project. We introduce what we have called the “respiration model” which describes and analyses key cognitive components which occur in this complex process. Respiration either privileges epistemic expectations which are rooted in socio-cognitive metrics of “concentration” or in a functionality-multiple horizon context which we refer to as “extension”. The global justice movement has often been associated with opposition to the broad programme of ‘neoliberalism’ and associated patterns of ‘corporate globalisation’, creating a widespread impression that this movement is opposed to liberalism more broadly conceived. Our goal in this article is to challenge this widespread view. By engaging in critical interpretive analysis of the contemporary ‘corporate accountability’ movement, we argue that the corporate accountability agenda is not opposed to the core values of a liberal project. Rather, it is seeking (...) to reconfigure the design of liberal institutions of individual rights-protection, adjusting these for new material conditions associated with economic globalisation, under which powerful corporations alongside states now pose direct and significant threats to individual rights. This activist agenda is, therefore, much less radical in its challenge to the prevailing liberal global order than it may initially appear, since it functions to buttress rather than corrode many core normative commitments underpinning the liberal political project.Keywords: liberalism; corporate accountability; business regulation; human rights; global justice movement. Lane et al. are right: Troublesome memories can be therapeutically recontextualized. Reconsolidation of negative/traumatic memories within the context of positive/prosocial affects can facilitate diverse psychotherapies. Although neural mechanisms remain poorly understood, we discuss how nonlinear dynamics of various positive affects, heavily controlled by primal subcortical networks, may be critical for optimal benefits.
