This book, formed as a series of essays in honour of Professor Carl Baudenbacher, addresses the very art of judicial reasoning, and features contributions from many of the foremost current or former national, supranational, or international judges. This unique volume is intended first and foremost for legal scholars, but its approachable style makes it readily accessible for students and for those with a general interest in the application of the law and justice in today's multi-layered world. The collection of essays (...) is rather more philosophical and reflective as opposed to doctrinal. Each contribution focuses on the nature and operation of justice, the independence of the judiciary, and on judicial style primarily from the perspective of the judges themselves. The book provides perspectives on what it means to be accountable and independent as a judge, the role of language and languages in the quest for justice, while other contributions acquaint readers with the some of the structures of courts themselves, or indeed question for whom judgments are written. Stress in health care is affected by moral factors. When people are prevented from doing ‘good’ they may feel that they have not done what they ought to or that they have erred, thus giving rise to a troubled conscience. Empirical studies show that health care personnel sometimes refer to conscience when talking about being in ethically difficult everyday care situations. This study aimed to construct and validate the Stress of Conscience Questionnaire (SCQ), a nine-item instrument for assessing stressful situations (...) and the degree to which they trouble the conscience. The items were based on situations previously documented as causing negative stress for health care workers. Content and face validity were established by expert panels and pilot studies that selected relevant items and modified or excluded ambiguous ones. A convenience sample of 444 health care personnel indicated that the SCQ had acceptable validity and internal consistency (Cronbach’s alpha exceeded 0.83 for the overall scale). Explorative factor analysis identified and labelled two factors: ‘internal demands’ and ‘external demands and restrictions’. The findings suggest that the SCQ is a concise and practical instrument for use in various health care contexts. (shrink)

We show that Bell inequalities can be violated in the macroscopic world. The macroworld violation is illustrated using an example involving connected vessels of water. We show that whether the violation of inequalities occurs in the microworld or the macroworld, it is the identification of nonidentical events that plays a crucial role. Specifically, we prove that if nonidentical events are consistently differentiated, Bell-type Pitowsky inequalities are no longer violated, even for Bohm's example of two entangled spin 1/2 quantum particles. We (...) show how Bell inequalities can be violated in cognition, specifically in the relationship between abstract concepts and specific instances of these concepts. This supports the hypothesis that genuine quantum structure exists in the mind. We introduce a model where the amount of nonlocality and the degree of quantum uncertainty are parameterized, and demonstrate that increasing nonlocality increases the degree of violation, while increasing quantum uncertainty decreases the degree of violation. In this paper, we clarify what proponents of the Growing Block Theory (GBT) should and what they should not say, and what they consistently can say. Once all the central tenets of the view are on the table, we address both David Braddon-Mitchell’s and Trenton Merricks’ recent eulogies for GBT, based on what is representative of a certain type of argument meant to show that GBT is internally incoherent. We argue that this type of argument proceeds from a mistaken assumption (...) about GBT’s core, viz. that GBT works with an untensed notion of what, in the metaphysically most fundamental sense, there is. We conclude that this type of argument accordingly misfires and that for all we know, we might be living on the brink of reality. (shrink)

We argue that sensitivity to the distinction between the tensed notion of being something and the tensed notion of being located at the present time serves as a good antidote to confusions in debates about time and existence, in particular in the debate about how to characterise presentism, and saves us the trouble of going through unnecessary epicycles. Both notions are frequently expressed using the tensed verb ‘to exist’, making it systematically ambiguous. It is a commendable strategy to avoid using (...) that verb altogether in these contexts and to use quantification and a location predicate instead. (shrink)

We argue that presentism, understood as a view about time and existence, can perspicuously be defined in opposition to all other familiar contenders without appeal to any notion of presentness or cognate notions such as concreteness. Given recent worries about the suitability of such notions to cut much metaphysical ice, this should be welcomed by presentism's defenders. Realism about tense is the view that the contrast between what was, what is and what will be the case is real, and not merely a projection of our ways of thinking. Does this view entail realism about temporal passage, namely the view that time really passes, in the same sense of ‘real’? We argue that the answer is affirmative for many versions of tense realism, and indeed for all sensible versions. We thereby address an important conceptual issue regarding these (...) two forms of realism and rebut recent claims that tense realism is compatible with anti-realism about temporal passage. In recent publications, Kit Fine devises a classification of A-theories of time and defends a non-standard A-theory he calls fragmentalism, according to which reality as a whole is incoherent but fragments into classes of mutually coherent tensed facts. We argue that Fine's classification in not exhaustive, as it ignores another non-standard A-theory we dub dynamic absolutism, according to which there are tensed facts that stay numerically the same and yet undergo qualitative changes as time goes by. Temporaryism—the view that not always everything always exists—comes in two main versions: presentism and expansionism (aka the growing block theory of time). Both versions of the view are commonly formulated using the notion of being present, which we, among others, find problematic. Expansionism is also sometimes accused of requiring extraordinary conceptual tools for its formulation. In this paper, we put forward systematic characterizations of presentism and expansionism which involve neither the notion of being present nor unfamiliar conceptual tools. ABSTRACT We critically review two extant paradigms for understanding the systematic interaction between modality and tense, as well as their respective modifications designed to do justice to the contingency of time’s structure and composition. We show that on either type of theory, as well as their respective modifications, some principles prove logically valid whose truth might sensibly be questioned on metaphysical grounds. Nihel Jhou (2021) takes issue with our argument to the conclusion that realism about tense implies realism about temporal passage (Correia and Rosenkranz 2020). Here we review his criticism and defend our conclusion by improving the original argument so as to do justice to the more demanding notion of temporal passage Jhou invokes.

Participation in victim-offender mediation can reduce the risk of reoffending. However, relatively little is known about how VOM affects the intermediate psychological changes underlying this effect. It was hypothesized that VOM increases feelings of responsibility, guilt, and shame among offenders as well as empathy toward the victim. It was also expected that VOM leads to feelings of moral failure among offenders, increasing their intention to desist, and improving their relation with the victim, relatives, and community. Lastly, it was hypothesized that (...) offenders may experience reduced rejection, concerns about condemnation, threat to their social moral identity, and victim blame following VOM. To this end, we compared psychological changes in offenders who participated in a VOM program in the Netherlands with those of offenders who were willing to but did not participate. A quasi-experimental, pre- and postmeasure research design was used to compare these groups. Our findings tentatively suggest that offenders who participate in VOM have more responsibility-taking and victim empathy, feel more guilt and shame, and experience higher moral failure than offenders who do not participate in VOM do. Offenders also reported feeling significantly less awkward about meeting the victim again after VOM. Future research should address how and to what degree these psychological changes translate into a lower risk of reoffending. (shrink)

Despite Vision Zero’s moral appeal and its expansion throughout the world, it has been criticized on different grounds. This chapter is based on an extensive literature search for criticism of Vision Zero, using the bibliographic databases Philosopher’s Index, Web of Science, Science Direct, Scopus, Google Scholar, PubMed, and Phil Papers, and by following the references in the collected documents. Even if the primary emphasis was on Vision Zero in road traffic, our search also included documents criticizing Vision Zero policies in (...) other safety areas, such as public health, the construction and mining industries, and workplaces in general. Based on the findings, we identify and systematically characterize and classify the major arguments that have been put forward against Vision Zero. The most important arguments against Vision Zero can be divided into three major categories: moral arguments, arguments concerning the rationality of Vision Zero, and arguments aimed at the practical implementation of the goals. We also assess the arguments. Of the 13 identified main arguments, 6 were found to be useful for a constructive discussion on safety improvements. (shrink)

Although there has been a vast amount of research about suicide, very few studies focus on the inner world of the suicidal patient. A secondary analysis of two exemplar narrative interviews with Norwegian patients reveals a glimpse of the inner world of suicidal patients’ longing for consolation. The results of a phenomenological hermeneutic study inspired by Ricoeur’s philosophy reveal five themes and one main theme. The themes are: ‘longing for closeness’, ‘desiring connectedness’, ‘struggling to open up inner dialogue’, ‘breaking into (...) outer dialogue’, and ‘liberating inner and outer dialogue’. The main theme is ‘struggling to become ready for consolation’. These results describe a process of becoming ready for consolation, which, when interpreted in the light of the model of consolation by Norberg et al., reveals that the end of the process of becoming ready for consolation is consolation itself as praxis. ObjectiveTo determine whether gait and accelerometric features can predict disorientation events in young and older adults.MethodsCognitively healthy younger and older participants navigated on a treadmill through a virtual representation of the city of Rostock featured within the Gait Real-Time Analysis Interactive Lab system. We conducted Bayesian Poisson regression to determine the association of navigation performance with domain-specific cognitive functions. We determined associations of gait and accelerometric features with disorientation events in real-time data using Bayesian generalized mixed effect models. The accuracy (...) of gait and accelerometric features to predict disorientation events was determined using cross-validated support vector machines and Hidden Markov models.ResultsBayesian analysis revealed strong evidence for the effect of gait and accelerometric features on disorientation. The evidence supported a relationship between executive functions but not visuospatial abilities and perspective taking with navigation performance. Despite these effects, the cross-validated percentage of correctly assigned instances of disorientation was only 72% in the SVM and 63% in the HMM analysis using gait and accelerometric features as predictors.ConclusionDisorientation is reflected in spatiotemporal gait features and the accelerometric signal as a potentially more easily accessible surrogate for gait features. At the same time, such measurements probably need to be enriched with other parameters to be sufficiently accurate for individual prediction of disorientation events. (shrink)

Consolation is needed when a human being suffers (i.e. feels alienated from him-or herself, from other people, from the world or from his or her ultimate source of meaning). The aim of this study was to illuminate the meaning of consolation. Tape-recorded narrative interviews were carried out with 18 professionals from various spheres. The transcribed interviews were interpreted hermeneutically. A model of consolation is outlined in a drawing. It states that the mediator and the receiver of consolation must become ready (...) for consolation before it can take place. To be ready means to be present and available. Availability means expressing suffering and listening respectively, and thereby opening up for communion and consoling dialogue. Communion brings about contact with the sacred dimension that human beings share and thus with goodness, light, joy, beauty and life. Consolation involves a shift of perspective and an experience of meaning in spite of suffering. (shrink)

The finance industry is required to respond to public criticism of perceived immoral behaviour. To create legitimacy, financial firms not only undertake corporate social responsibility activities, but also support such activities with precise justifications. In this paper, we study CSR justifications appearing in annual and sustainability reports from the Swedish finance industry. Our objective is to investigate the ethical character of CSR justifications in the finance industry. This is an interesting topic, both because CSR carries ethical meaning and because CSR (...) justifications play a role in actual business activities. A secondary aim of this article is to test whether decoupled corporate claims about CSR can be recoupled, which would potentially help companies to act responsibly. The observed CSR justifications avoided the fundamental question of whether the finance industry does in fact have responsibilities, and they did not manifest awareness of stakeholders’ demands for CSR. Seemingly value-based CSR activities often lacked ethical justifications. These characteristics do not harmonize with the responsible image that the contemporary finance industry wants to portray. Our counterintuitive finding is that amorality prevails in the justifications that banks give for undertaking CSR activities. (shrink)

Justification as Ignorance offers an original account of epistemic justification as both non-factive and luminous, vindicating core internalist intuitions without construing justification as an internal condition knowable by reflection alone. Sven Rosenkranz conceives of justification, in its doxastic and propositional varieties, as a kind of epistemic possibility of knowing and of being in a position to know. His account contrasts with recent alternative views that characterize justification in terms of the metaphysical possibility of knowing. Instead, he develops a suitable (...) non-normal multi-modal epistemic logic for knowledge and being in a position to know that respects the finding that these notions create hyperintensional contexts. He also defends his conception of justification against well-known anti-luminosity arguments, shows that the account allows for fruitful applications and principled solutions to the lottery and preface paradoxes, and provides a metaphysics of justification and its varying degrees of strength that is compatible with core assumptions of the knowledge-first approach and disjunctivist conceptions of mental states. As we move towards a more global legal community, often with accompanying injustice and violence, Mireille Delmas-Marty demonstrates that there is an urgent need to reconstruct the national and international legal landscapes. Legal reasoning can be applied to concepts such as human rights for European citizens in the new world order. In this book the author argues for a rule of law that is common in every sense of the word: accessible to all rather than reserved exclusively for officials, common (...) to the various legal sectors despite increasing specialization, and common to diverse States. Proponents of situated affectivity hold that “tools for feeling” are just as characteristic of the human condition as are “tools for thinking” or tools for carpentry. An agent’s affective life, they argue, is dependent upon both physical characteristics of the agent and the agent’s reciprocal relationship to an appropriately structured natural, technological, or social environment. One important achievement has been the distinction between two fundamentally different ways in which affectivity might be intertwined with the environment: the “user-resource-model” and the “mind-invasion-model.” (...) The twofold purpose of this paper is to complement the debate about situated affectivity in general and about “mind invasion” in particular by, firstly, connecting it to situationist research in social psychology and, secondly, broadening the perspective to not only accommodate decidedly detrimental “invasions” but also potentially beneficial forms of “mind shaping” that include the manipulation of an agent’s experiential life and behaviour through the moulding of both the agent’s environment and the agent’s body. One of the topics that often comes up in ethical discussions of deep brain stimulation (DBS) is the question of what impact DBS has, or might have, on the patient’s self. This is often understood as a question of whether DBS poses a “threat” to personal identity, which is typically understood as having to do with psychological and/or narrative continuity over time. In this article, we argue that the discussion of whether DBS is a “threat” to continuity over time is (...) too narrow. There are other questions concerning DBS and the self that are overlooked in discussions exclusively focusing on psychological and/or narrative continuity. For example, it is also important to investigate whether DBS might sometimes have a positive (e.g. a rehabilitating) effect on the patient’s self. To widen the discussion of DBS, so as to make it encompass a broader range of considerations that bear on DBS’s impact on the self, we identify six features of the commonly used concept of a person’s “true self”. We apply these six features to the relation between DBS and the self. And we end with a brief discussion of the role DBS might play in treating otherwise treatment-refractory anorexia nervosa. This further highlights the importance of discussing both continuity over time and the notion of the true self. (shrink)

Is more information always better? Or are there some situations in which more information can make us worse off? Good (1967) argues that expected utility maximizers should always accept more information if the information is cost-free and relevant. But Good's argument presupposes that you are certain you will update by conditionalization. If we relax this assumption and allow agents to be uncertain about updating, these agents can be rationally required to reject free and relevant information. Research about codes of corporate ethics has hitherto taken a hypothetical, correct meaning of codes for granted. The article problematises the dichotomous categories intrinsic and subjective meanings of codes. I address the question if professionals in finance accept codes of business. The particular mentality of stockbrokers and traders constructs the way they judge restrictions such as company codes of ethics. While neglecting dimensions of ethics beyond known rules, brokers and traders distrust good ethics as a possible end in itself. In decision theory, this question is often addressed by representation theorems, going back to Ramsey (1926), which tell us how to define or measure subjective probability by observable preferences. However, standard representation theorems make strong rationality assumptions, in particular expected utility maximization. How do we ascribe subjective probability to agents which do not satisfy these strong rationality assumptions? The framework of Solomonoff prediction assigns prior probability to hypotheses inversely proportional to their Kolmogorov complexity. There are two well-known problems. First, the Solomonoff prior is relative to a choice of Universal Turing machine. Second, the Solomonoff prior is not computable. However, there are responses to both problems. Different Solomonoff priors converge with more and more data. Further, there are computable approximations to the Solomonoff prior. I argue that there is a tension between these two responses. Sociability and Its Enemies contributes both to contemporary studies of political theory and to discourse on postwar Germany by reconstructing the arguments concerning the nature and value of sociability as a form of interaction and interconnection particular to modern bourgeois society. Jakob Norberg argues that the writings of Hannah Arendt, Jürgen Habermas, Carl Schmitt, and the historian Reinhart Koselleck present conflicting responses to a hitherto neglected question or point of contention: whether bourgeois sociability should serve as a therapeutic practice (...) and politically relevant ideal for postwar Germany. This paper discusses the robotization of the workplace, and particularly the question of whether robots can be good colleagues. This might appear to be a strange question at first glance, but it is worth asking for two reasons. Firstly, some people already treat robots they work alongside as if the robots are valuable colleagues. It is worth reflecting on whether such people are making a mistake. Secondly, having good colleagues is widely regarded as a key aspect of what can make (...) work meaningful. In discussing whether robots can be good colleagues, the paper compares that question to the more widely discussed questions of whether robots can be our friends or romantic partners. The paper argues that the ideal of being a good colleague has many different parts, and that on a behavioral level, robots can live up to many of the criteria typically associated with being a good colleague. Moreover, the paper also argues that in comparison with the more demanding ideals of being a good friend or a good romantic partner, it is comparatively easier for a robot to live up to the ideal of being a good colleague. The reason for this is that the “inner lives” of our friends and lovers are more important to us than the inner lives of our colleagues. (shrink)

In this paper, we discuss the relation between recent philosophical discussions about meaning in life (from authors like Susan Wolf, Thaddeus Metz, and others) and the ethics of artificial intelligence (AI). Our goal is twofold, namely, to argue that considering the axiological category of meaningfulness can enrich AI ethics, on the one hand, and to portray and evaluate the small, but growing literature that already exists on the relation between meaning in life and AI ethics, on the other hand. We (...) start out our review by clarifying the basic assumptions of the meaning in life discourse and how it understands the term ‘meaningfulness’. After that, we offer five general arguments for relating philosophical questions about meaning in life to questions about the role of AI in human life. For example, we formulate a worry about a possible meaningfulness gap related to AI on analogy with the idea of responsibility gaps created by AI, a prominent topic within the AI ethics literature. We then consider three specific types of contributions that have been made in the AI ethics literature so far: contributions related to self-development, the future of work, and relationships. As we discuss those three topics, we highlight what has already been done, but we also point out gaps in the existing literature. We end with an outlook regarding where we think the discussion of this topic should go next. (shrink)

This book argues that we need to explore how human beings can best coordinate and collaborate with robots in responsible ways. It investigates ethically important differences between human agency and robot agency to work towards an ethics of responsible human-robot interaction.

This paper discusses two opposing views about the relation between artificial intelligence (AI) and human intelligence: on the one hand, a worry that heavy reliance on AI technologies might make people less intelligent and, on the other, a hope that AI technologies might serve as a form of cognitive enhancement. The worry relates to the notion that if we hand over too many intelligence-requiring tasks to AI technologies, we might end up with fewer opportunities to train our own intelligence. Concerning (...) AI as a potential form of cognitive enhancement, the paper explores two possibilities: (1) AI as extending—and thereby enhancing—people’s minds, and (2) AI as enabling people to behave in artificially intelligent ways. That is, using AI technologies might enable people to behave as if they have been cognitively enhanced. ExcerptCarl Schmitt’s The Crisis of Parliamentary Democracy is a work of conceptual clarification. The thesis of the book is that democracy and parliamentarism must be differentiated rather than confused and conflated. In the nineteenth century, it may have seemed like a democratic system must have a parliament, but Schmitt contends that democracy and parliamentarism embody distinct and separable principles: “democracy can exist without... parliamentarism and parliamentarism without democracy.”1 Since popular sovereignty and democracy are the most powerful political ideas of the (...) modern western European cultural region—Schmitt speaks of the “victory of democracy”2—this disconnection is a strike against parliamentarism; Schmitt’s definitional work seeks to reduce the belief in the necessity and prestige of parliamentary politics. Writing in the early 1920s, Schmitt also suggests that the parliamentary tradition has lost much of its persuasive force for the contemporary public. From his vantage point, new and vigorous political movements represented by Marxist communism and Italian fascism reject any inclusion into the framework of a parliamentary debate; there is no cause, then, for “parliamentary optimism.”3 The theorists and leaders of the new, uncompromising ideological fronts show no interest in a resumption of an ordered interchange of opinions and policy ideas, which means that the age of discussion will not be sustained or renewed. Recent studies on neural pathways in a broad spectrum of vertebrates suggest that, in addition to migration and an increase in the number of certain select neurons, a significant aspect of neural evolution is a “parcellation” (segregation-isolation) process that involves the loss of selected connections by the new aggregates. A similar process occurs during ontogenetic development. These findings suggest that in many neuronal systems axons do not invade unknown territories during evolutionary or ontogenetic development but follow in their ancestors' paths (...) to their ancestral targets; if the connection is later lost, it reflects the specialization of the circuitry.The pattern of interspecific variability suggests (1) that overlap of circuits is a more common feature in primitive (generalized) than in specialized brain organizations and (2) that most projections, such as the retinal, thalamotelencephalic, corticotectal, and tectal efferent ones, were bilateral in the primitive condition. Specialization of these systems in some vertebrate groups has involved the selective loss of connections, resulting in greater isolation of functions. The parcellation process may also play an important role in cell diversification.The parcellation process as described here is thought to be one of several underlying mechanisms of evolutionary and ontogenetic differentiation. This research investigates how top management team national diversity (TMTND) and corporate social responsibility (CSR) institutional uncertainty affect strategic CSR focus in foreign-owned subsidiaries. The paper develops a theoretical framework based on institutional theory and upper echelon perspectives to test a sample of MNE subsidiaries. Survey data were collected from subsidiaries in Thailand and Taiwan. Non-symmetric analysis suggests that while TMTND plays an important role in establishing a CSR focus, it is not conducive in itself to high-performance outcomes. Performance is (...) measured by market share, sales growth, and profitability for each subsidiary. The results also show that there are notable differences between the subsidiaries located in Thailand and Taiwan as to what extent CSR strategic focus and top management team national diversity are relevant for high-performance outcomes. The study demonstrates that the links between CSR, TMTND, and subsidiary performance are much more complex than previously assumed. (shrink)
