As we move towards a more global legal community, often with accompanying injustice and violence, Mireille Delmas-Marty demonstrates that there is an urgent need to reconstruct the national and international legal landscapes. Legal reasoning can be applied to concepts such as human rights for European citizens in the new world order. In this book the author argues for a rule of law that is common in every sense of the word: accessible to all rather than reserved exclusively for officials, common (...) to the various legal sectors despite increasing specialization, and common to diverse States. The strong sensorimotor account of perception gives self-induced movements two constitutive roles in explaining visual consciousness. The first says that self-induced movements are vehicles of visual awareness, and for this reason consciousness ‘does not happen in the brain only’. The second says that the phenomenal nature of visual experiences is consists in the action-directing content of vision. In response I suggest, first, that the sense in which visual awareness is active should be explained by appeal to the role of attention (...) in visual consciousness, rather than self-induced movements; and second, that the sense in which perceptual consciousness does not happen in the brain only should be explained by appeal to the relational nature of perceptual consciousness, appeal to which also shows why links with action cannot exhaust phenomenal content. Consolation is needed when a human being suffers (i.e. feels alienated from him-or herself, from other people, from the world or from his or her ultimate source of meaning). The aim of this study was to illuminate the meaning of consolation. Tape-recorded narrative interviews were carried out with 18 professionals from various spheres. The transcribed interviews were interpreted hermeneutically. A model of consolation is outlined in a drawing. It states that the mediator and the receiver of consolation must become ready (...) for consolation before it can take place. To be ready means to be present and available. Availability means expressing suffering and listening respectively, and thereby opening up for communion and consoling dialogue. Communion brings about contact with the sacred dimension that human beings share and thus with goodness, light, joy, beauty and life. Consolation involves a shift of perspective and an experience of meaning in spite of suffering. (shrink)

The U.S. scientific community has long led the world in research on such areas as public health, environmental science, and issues affecting quality of life. These scientists have produced landmark studies on the dangers of DDT, tobacco smoke, acid rain, and global warming. But at the same time, a small yet potent subset of this community leads the world in vehement denial of these dangers. -/- Merchants of Doubt tells the story of how a loose-knit group of high-level scientists and (...) scientific advisers, with deep connections in politics and industry, ran effective campaigns to mislead the public and deny well-established scientific knowledge over four decades. Remarkably, the same individuals surface repeatedly-some of the same figures who have claimed that the science of global warming is "not settled" denied the truth of studies linking smoking to lung cancer, coal smoke to acid rain, and CFCs to the ozone hole. "Doubt is our product," wrote one tobacco executive. These "experts" supplied it. -/- Naomi Oreskes and Erik M. Physicians, registered nurses (RNs) and enrolled nurses (ENs) engaged in geriatric (n = 49) and surgical (n = 59) care at a large hospital in Sweden gave 180 accounts of morally difficult care episodes. In total, the ENs (n = 40) gave 78, the RNs (n = 38) 55 and the physicians (n = 30) 47 accounts; there were 83 from geriatric care and 97 from surgical care. Forty-nine participants were male, and 59 were female; there were no differences in (...) gender in the form and content of the moral reasoning disclosed in either morally difficult care episodes or in the complete interviews when coded as mainly narrative or propositional, or as showing a care or a justice orientation. The ENs showed a care orientation, while RNs and physicians, to an equal degree, showed both a justice and a care orientation. The ENs also used narrative reasoning more often than RNs and physicians. No differences were seen between the two health care specialties. (shrink)

Structured interviews were held with 149 registered nurses in seven countries in America, Asia, Australia and Europe concerning the feeding of severely demented patients who do not accept food. The most common reasons for nurses being willing to change their decision to feed or not to feed were an order from the medical head, a request from the patient's husband and/or the staff meeting. There was a connection between the willingness to feed and the ranking of ethical principles. Nurses who (...) were most prone to feed the patient most often gave a high rank to the ethical principle of sanctity of life, while those who primarily chose not to feed the patient gave a high rank to the ethical principle of autonomy. All nurses stressed the ethical principle of beneficence. Les infirmiers/ères les plus enclins de nourir la malade le plus souvent donnaient un rang supérieur au principe éthique de la sainteté de vie, pendant que ceux et celles qui choisissaient de ne pas nourrir la malade donnaient un rang supérieur au principe éthique de l'autonomie. Tous insistaient sur l'importance du principe éthique de la bienfaisance. Die gewöhnlichsten Gründe des Pflegepersonals für die Bereitwilligkeit, ihre Entscheidung, zu ernähren oder nicht, zu ändern, waren Anordnungen vom medizinischen Chef, Anfragen vom Ehemann der Patientin und/oder einer Personalsitzung. Es bestand ein Zusammenhang zwischen der Bereitwilligkeit zur Ernährung und dem Rang der ethischen Prinzipien. Die Pflegenden, die sich am meisten neigten, die Patientin zu ernähren, gaben dem ethischen Prinzip der Heiligkeit des Lebens einen hohen Rang, während die, die meistens vorzogen, die Patientin nicht zu ernähren, gaben dem ethischen Prinzip der Autonomie einen hohen Rang. It is commonly assumed that grounding relations are asymmetric. Here I develop and argue for a theory of metaphysical structure that takes grounding to be nonsymmetric rather than asymmetric. Even without infinite descending chains of dependence, it might be that every entity is grounded in some other entity. Having first addressed an immediate objection to the position under discussion, I introduce two examples of symmetric grounding. I give three arguments for the view that grounding is nonsymmetric (I call this view (...) ‘metaphysical interdependence’). These arguments are: (i) that metaphysical interdependence is the only theory able to reconcile competing intuitions about grounding; (ii) that it is the only theory consistent with both ‘gunk’ and ‘junk’; and (iii) that offers a satisfactory solution to the problem concerning whether or not grounding is itself grounded. Attempts to elucidate grounding are often made by connecting grounding to metaphysical explanation, but the notion of metaphysical explanation is itself opaque, and has received little attention in the literature. We can appeal to theories of explanation in the philosophy of science to give us a characterization of metaphysical explanation, but this reveals a tension between three theses: that grounding relations are objective and mind-independent; that there are pragmatic elements to metaphysical explanation; and that grounding and metaphysical explanation share a (...) close connection. Holding fixed the mind-independence of grounding, I show that neither horn of the resultant dilemma can be blunted. Consequently, we should reject the assumption that grounding relations are mind-independent. (shrink)

Sometime around their first birthday most infants begin to engage in relatively sustained bouts of attending together with their caretakers to objects in their environment. By the age of 18 months, on most accounts, they are engaging in full-blown episodes of joint attention. As developmental psychologists (usually) use the term, for such joint attention to be in play, it is not sufficient that the infant and the adult are in fact attending to the same object, nor that the one’s attention (...) cause the other’s. The latter can and does happen much earlier, whenever the adult follows the baby’s gaze and homes in on the same object as the baby is attending to; or, from the age of six months, when babies begin to follow the gaze of an adult. We have the relevant sense of joint attention in play only when the fact that both child and adult are attending to the same object is, to use Sperber and Wilson’s (1986) phrase, ‘mutually manifest’. Psychologists sometimes speak of such jointness as a case of attention being ‘shared’ by infant and adult, or of a ‘meeting of minds’ between infant and adult, all phrases intended to capture the idea that when joint attention occurs everything about the fact that both subjects are attending to the same object is out in the open, manifest to both participants. This paper develops an account of metaphysical explanation according to which metaphysical explanations are answers to what-makes-it-the-case-that questions. On this view, metaphysical explanations are not to be considered entirely objective, but are subject to epistemic constraints imposed by the context in which a relevant question is asked. The resultant account of metaphysical explanation is developed independently of any particular views about grounding. Toward the end of the paper an application of the view is proposed that takes metaphysical explanations conceived in (...) this way to characterize reality's structure. According to this proposal, reality's structure is partly constituted by a projection of our explanatory practices onto reality. (shrink)

The finance industry is required to respond to public criticism of perceived immoral behaviour. To create legitimacy, financial firms not only undertake corporate social responsibility activities, but also support such activities with precise justifications. In this paper, we study CSR justifications appearing in annual and sustainability reports from the Swedish finance industry. Our objective is to investigate the ethical character of CSR justifications in the finance industry. This is an interesting topic, both because CSR carries ethical meaning and because CSR (...) justifications play a role in actual business activities. A secondary aim of this article is to test whether decoupled corporate claims about CSR can be recoupled, which would potentially help companies to act responsibly. The observed CSR justifications avoided the fundamental question of whether the finance industry does in fact have responsibilities, and they did not manifest awareness of stakeholders’ demands for CSR. Seemingly value-based CSR activities often lacked ethical justifications. These characteristics do not harmonize with the responsible image that the contemporary finance industry wants to portray. Our counterintuitive finding is that amorality prevails in the justifications that banks give for undertaking CSR activities. (shrink)

Naomi Scheman argues that the concerns of philosophy emerge not from the universal human condition but from conditions of privilege. Her books represents a powerful challenge to the notion that gender makes no difference in the construction of philosophical reasoning. At the same time, it criticizes the narrow focus of most feminist theorizing and calls for a more inclusive form of inquiry.

Verification and validation of numerical models of natural systems is impossible. This is because natural systems are never closed and because model results are always nonunique. Models can be confirmed by the demonstration of agreement between observation and prediction, but confirmation is inherently partial. Complete confirmation is logically precluded by the fallacy of affirming the consequent and by incomplete access to natural phenomena. Models can only be evaluated in relative terms, and their predictive value is always open to question. The (...) primary value of models is heuristic. (shrink)

Grounding talk has become increasingly familiar in contemporary philosophical discussion. Most discussants of grounding think that grounding talk is useful, intelligible, and accurately describes metaphysical reality. Call themrealistsabout grounding. Some dissenters reject grounding talk on the grounds that it is unintelligible, or unmotivated. They would prefer to eliminate grounding talk from philosophy, so we can call themeliminitivistsabout grounding. This paper outlines a new position in the debate about grounding, defending the view that grounding talk is (or at least can be) (...) intelligible and useful. Grounding talk does not, however, provide a literal and veridical description of mind-independent metaphysical reality. A central intuition regarding self-knowledge is that if I say (or think) that I believe that it is raining – to use a familiar example – I do not merely state a fact about my mental life but also express my view of the world: I take it to be the case that it is raining. The notion of avowal is supposed to capture this duality of perspectives: whilst occupying one’s first-person perspective, one self-attributes a mental attitude, which is a (...) fact that is supposed to be true independent of one’s own perspective. Another way of putting this is that avowal is a self-attribution of an intentional mental attitude that is first-personal and commissive. Many grant that avowal and its commissive form are essential to the first-person character of self-knowledge – which I call the commitment view. However, only a few argue that avowal remains essential in achieving self-knowledge of one’s substantial mental attitudes, i.e., attitudes that are significant to a person’s life and self-conception, such as one’s values, deeper desires, and cares. In fact, current orthodoxy is skeptical that avowal has any role to play in acquiring substantial self-knowledge. According to this skeptical view of avowal, such attitudes are often distorted in the first-person perspective and are better reflected in someone’s behavior, i.e., in the relevant patterns of action and reaction. Rather than avowing an attitude, interpreting these patterns is supposed to provide substantial self-knowledge. The paper proceeds by first clarifying the commitment view (section 2) and the skeptical view (section 3). I will then offer two arguments against the skeptical view. First, I will show that substantial mental attitudes cannot, as the skeptical view needs to assume, be discovered in patterns of action and reaction (section 4). Secondly, I will inquire the complex relation between avowal and patterns of action and reaction and argue that a gap between the two cannot be determined nor understood without the agent’s perspective, including their avowal (section 5). Both arguments establish that the skeptic cannot deny a necessary role for avowal. This reflects the agential nature of substantial mental attitudes and challenges the dominant skeptical view of substantial self-knowledge. (shrink)

This ambitious philosophical anthology combines analyses and surveys of contemporary theorising on social identity.

The turn to cosmopolitanism in educational research on citizenship education is indicative of a wider discourse of cosmopolitanism evident throughout social and cultural policy. This discourse represents a more 'light-hearted' use of the term than the philosophical tradition offers. This discourse should not be dismissed, however, but, instead, attention should be paid to who the citizen is that is addressed by such language. An analysis informed by Foucault's concept of governmentality draws attention to the way in which the discourse of (...) cosmopolitanism relates to the entrepreneurial self and the form of accountability demanded of the knowledge economy. A particular understanding of citizenship and of our relations to others becomes apparent. In educational research on citizenship education, cosmopolitanism is afforded a problem-solving role in relation to globalisation and, more specifically, diversity. Attention is drawn to a meta-level, of the role of particular forms of research in answering to the demand for accountability. Research practice in educational research, or more specifically, education policy sociology concerned with citizenship education, is conducted in terms of the policy language it seeks to critique. Rather than seeking the openness associated with cosmopolitanism, therefore, such research is itself accountable to the demands for particular knowledge of the citizenry. This treatment is also evident in contemporary urban planning policy, similarly concerned with cosmopolitanism as a response to diversity and inclusion. In the current discourse of cosmopolitanism, 'diversity', 'inclusion' and indeed 'citizenship' operate in particular ways through social and educational policy that rather than being dismissed should be addressed due to their role in the construction of contemporary citizenship. Research about codes of corporate ethics has hitherto taken a hypothetical, correct meaning of codes for granted. The article problematises the dichotomous categories intrinsic and subjective meanings of codes. I address the question if professionals in finance accept codes of business. The particular mentality of stockbrokers and traders constructs the way they judge restrictions such as company codes of ethics. While neglecting dimensions of ethics beyond known rules, brokers and traders distrust good ethics as a possible end in itself. This article presents the framework Capability Sensitive Design (CSD), which consists of merging the design methodology Value Sensitive Design (VSD) with Martha Nussbaum's capability theory. CSD aims to normatively assess technology design in general, and technology design for health and wellbeing in particular. Unique to CSD is its ability to account for human diversity and to counter (structural) injustices that manifest in technology design. The basic framework of CSD is demonstrated by applying it to the hypothetical design case of a (...) therapy chatbot for mental health. By applying CSD to a design case, the merits of this new framework over the standard VSD approach become apparent. Also, the application demonstrates what a technology design would look like when attention is paid to capabilities right from the start of the design process. (shrink)

The Oxford Handbook of Philosophy and Race provides up-to-date explanation and analyses by leading scholars of contemporary issues in African American philosophy and philosophy of race. The increased governmental focus on happiness since the late 1990s, and particularly since the economic crash of 2008, has been informed predominantly by a conceptualisation of happiness promoted by the field of positive psychology, and adopted and developed in fields such as behavioural economics and more recently in fields such as neuroeducation. Concepts, or traits, associated with feeling happy or satisfied with our lives, such as resilience, are now promoted across both public and private domains as a means to improve (...) our quality of life, our productivity and our attainment. The promotion of this positive psychological notion of happiness in the context of education not only presents these traits as virtues of the productive learning citizen but also effects a delegitimisation of the negative. Analysis of curricula programmes, seen alongside the shift taken towards a focus on the individual as brain, highlights the pedagogical and political implications of this. (shrink)

U.S. corporations have long tried to enact a favorable business environment via political activities such as lobbying and campaign contributions. This particular strategy is receiving increased attention due to the recent Supreme Court decision, Citizens United v. Federal Election Commission, which establishes that corporations have the same rights with regard to political activities as individuals. In this work, we examine the nature of corporate political activity and the need for accountability; define transparency in the context of corporate political activity; and (...) examine the antecedents for corporate political disclosure. We then test our model on the S&P 100 using an index of corporate political disclosure that we developed. We find that opportunities to participate in political activities, dependence on government contracts and prior disclosure on other topics such as the environment lead to more disclosure. The intensity of the regulatory environment appears to have no influence. (shrink)

Buddhism and Jainism share the concepts of karma, rebirth, and the desirability of escaping from rebirth. The literature of both traditions contains many stories about past, and sometimes future, lives which reveal much about these foundational doctrines. Naomi Appleton carefully explores how multi-life stories served to construct, communicate, and challenge ideas about karma and rebirth within early South Asia, examining portrayals of the different realms of rebirth, the potential paths and goals of human beings, and the biographies of ideal (...) religious figures.
