Background Biobank participants often do not understand much of the information they are provided as part of the informed consent process, despite numerous attempts at simplifying consent forms and improving their readability. We report the first assessment of biobank enrollees’ comprehension under an "integrated consent” process, where patients were asked to enroll in a research biobank as part of their normal healthcare experience. A number of healthcare systems have implemented similar integrated consent processes for biobanking, but it is unknown how (...) much patients understand after enrolling under these conditions. Methods: We recruited patients who enrolled in a biobank while in a healthcare setting when receiving ordinary care. We assessed knowledge of consent materials using 11 true/false questions drawn from a well-known biobank knowledge test. After reviewing the results from 114 participants, we revised the consent form and repeated the knowledge assessment with 144 different participants. Results: Participants scored poorly on the knowledge test in both rounds, with no significant differences in overall scores or individual items between the rounds. In Phase 1, participants answered 53% of the questions correctly, 25% incorrectly, and 22% “I don’t know.” In Phase 2, participants answered 53% of questions correctly, 24% incorrectly, and 23% “I don’t know.” Participants scored particularly poorly on questions about data sharing and accessing medical records. Conclusions: Enrollees under an integrated consent model had significant misunderstandings that persisted despite an attempt to improve information specifically about those topics in a consent form. These results raise challenges for current approaches that attribute misunderstanding to overly complex consent forms. They also suggest that the pressures of the clinic may compound other problems with patient understanding of biobank consent. As health systems increasingly blend research and care, they may need to rethink their approach to educating patients about participation in a biobank. (shrink)

Using state-of-the-art observational datasets and results from a large archive of computer model simulations, a consortium of scientists from 12 different institutions has resolved a long-standing conundrum in climate science—the apparent discrepancy between simulated and observed temperature trends in the tropics. Research published by this group indicates that there is no fundamental discrepancy between modeled and observed tropical temperature trends when one accounts for: the uncertainties in observations; and the statistical uncertainties in estimating trends from observations. These results refute a (...) recent claim that model and observed tropical temperature trends “disagree to a statistically significant extent”. Wenn wir Peter Singers Konklusion in „Famine, Affluence, and Morality“ (1972) akzeptieren, dann handeln wir im Alltag sehr viel häufiger falsch, als es uns lieb ist. Anstatt über die Natur von Altruismus zu philosophieren, könnten wir auch möglichst effektiv Hungerleidenden helfen. Ist es daher etwa moralisch verwerflich – weil egoistisch – zu philosophieren? In diesem Beitrag beleuchte ich die Gründe, die wir haben, Philosophie in den Mittelpunkt unseres Lebens zu stellen. Ich argumentiere, dass Philosophieren – genauso wie die Beschäftigung mit (...) Kunst und Wissenschaft – nur dann gerechtfertigt sein kann, wenn es praktische Gründe jenseits von Gründen des persönlichen Nutzens und der Moral gibt. Dabei schliesse ich an Susan Wolfs Idee an, dass diese Tätigkeiten ein Leben mit Sinn erfüllen können. I will begin with an examination of how musical meanings are politically rendered, and how these understandings are attached to moral consequences. Highly resistant to classification, musical meanings are those things we come to understand about ourselves through music, as opposed to musical knowledge which is demonstrable know-how. (...) While marching bands and flute sonatas can be judged with scores estimated to the 100th decimal point, the meanings that are created between the standards of practice of a given genre and the worldview of the listener or performer are provisional at best. Seen in this light, even seemingly secure or knowable realms like Christian heavy metal or anti-war movies are in fact highly un-objective and unpredictable. The challenge this paper seeks to uncover is participation on the hither side of fact, where understandings are rendered in a world that is contingent, political, and always in motion. We need not be students of French post-structuralism to recognize that we are part of many ever-evolving human-made systems, some of control, regulation, reward, punishment, and pleasure, but each with their own gravitation pull.1 I like Susan Sontag's take the best when she wrote that every place, every history has its own "sensibility," its own ineffable way of being in the world.2 Sensibilities—perhaps a clearer way of referring to politics in the context of art and experience—do not exist apart from their environment, yet they are more elusive than an idea or recognizable behavior.3 The sensibility of a time and place makes possible multiple discourses through which we make meaning.4 Some discourses, Foucault would remind us, are intensified by a history's particular sensibility and so appear louder than others. Such a discourse might speak so loudly that it shapes the meanings we make, drowning out options, and thus appearing obvious or commonsensical. The logic of musical assessment and evaluation—scoring marching bands and flute sonatas to the 100th decimal—is one such example.In spite of authoritative voices and reasonable discourses, each history's sensibility has its own escape routes, its own distortions and contradictions. I am fascinated by how we comply with or resist these pulls, as they are matters of agency and identity, matters of equity and social justice. In the present-day context of neo-liberalism and conservative values, especially 21st Century American fundamentalism, we would do well to ask how—not whether—such a fundamentalist sensibility shapes our ways of doing and knowing.5 My attempt is to locate music education in such a project.Shortly after the invasion of Iraq, I wrote a short piece on the fundamentalist imagination and its pull on the arts and education.6 This research took place at the 2003 MENC biennial where Bennett Reimer asks philosophy SRIG participants to consider (among other things) the role of metaphor in music education.7 I viewed the fundamentalist imagination as antithetical to metaphor: to paraphrase, the fundamentalist philosophy of education was "a philosophy for, not with, its initiates. Judgments are passed, not reached; answers are given, not argued... [Most importantly,] it is an educational method that emphasizes and then measures what is literal."8Since then, the voices of American literalism have appeared in increasingly loud volume seeking to discourage interpretation and argument in favor of handed-down teachings and binary logic. Supreme Court Justice Antonin Scalia decries the folly of a "living" constitution, in favor of a strict or literal reading. Retired Cardinal Bernard Law of Boston, in response to a common ground initiative by the late Joseph Bernadin, labels an appeal to "dialogue" a "fundamental flaw."9 Law sniffed, "Dissent from revealed truth or the authoritative [End Page 145] teaching of the church cannot... Many of our attitudes are non-culpable: there was nothing that we should have done to avoid holding them. I argue that we can still be blameworthy for non-culpable attitudes: they can impair our relationships in ways that make our full practice of apology and forgiveness intelligible. My argument poses a new challenge to indirect voluntarists, who attempt to reduce all responsibility for attitudes to responsibility for prior actions and omissions. Rationalists, who instead explain attitudinal responsibility by appeal to reasons-responsiveness, can (...) make sense of blameworthiness for non-culpable attitudes. According to relational egalitarians, equality is not primarily about the distribution of some good but about people relating to one another as equals. However, compared with other theorists in political philosophy – including other egalitarians – relational egalitarians have said relatively little on what role personal responsibility should play in their theories. For example, is equality compatible with responsibility? Should economic distributions be responsibility-sensitive? This article fills this gap. I develop a relational egalitarian framework for personal responsibility and show that (...) relational equality commits us to responsibility. I develop two sets of arguments. First, I draw on relational theories of moral responsibility – particularly Strawsonian views – to show that valuable egalitarian relationships require responsibility. Second, I show why relational equality sometimes requires that economic distributions be sensitive to responsibility and choice. I also defend a seemingly paradoxical result: being committed to responsibility, relational egalitarianism not only justifies some distributive inequalities but some relational inequalities too. Overall, relational egalitarianism gives a nuanced and coherent answer as to why and how responsibility matters from within egalitarianism. That it does should be an important argument in its favour. Although he is best known as the founder of pragmatism, the name that Charles Sanders Peirce prefers to use for his comprehensive system of thought is "synechism" because the principle of continuity is its central thesis. This paper arranges and summarizes numerous quotations and citations from his voluminous writings to formalize and explicate his distinctive mathematical conceptions of hyperbolic and topical continuity, both of which are derived from the direct observation of time as their paradigmatic manifestation, and then apply them (...) in normative science and metaphysics, especially logic as semeiotic and cosmology. The resulting conclusion is that the intelligibility of the universe is plausibly explained by conceiving it as one immense sign, a vast inferential process: a semiosic continuum whose connected constituent signs are indefinite until deliberately marked off, with God the Creator as its overall dynamical object in the infinite past and God completely revealed as its overall final interpretant in the infinite future. This paper traces Spinoza’s engagement with early-modern poetics. Historians of philosophy regularly locate Spinoza within the philosophical traditions of his time. I argue that, by placing him in a parallel poetic culture, we can extend our appreciation of the expectations and debates to which he is responding, and the ways he uses poetry in his philosophical work. I make three claims: that Spinoza’s conception of imagination is fundamentally poetic; that he offers a genealogical resolution to a debate about the relative (...) value of poetic inspiration and poetic art; and that he provides a carefully balanced analysis of the ways in which poetry can support philosophical understanding. Current debates about reasons and reasoning often draw comparisons between epistemic and practical reasons and reasoning and presuppose substantial unity between the practical and epistemic domains. This stance seems to conflict with a stark Humean contrast between the two domains: With respect to practical reasons and reasoning, Hume highlights the role of impressions, especially the passions, in motivating and rationalizing action, while apparently downplaying the potential relevance of beliefs, reason, or reasons. With respect to epistemic reasons and theoretical reasoning, he (...) urges us to proportion our belief to the evidence (EHU 10.4), which suggests a significant epistemic role for evidential reasons. My contribution ar-gues that there is nonetheless a convincing and interesting unified Humean account of reasons and reasoning across both domains. To present my case, I first narrow down the unity claim that I am interested in. I then closely engage with Hume’s claims in epistemology, the philos-ophy of action, and metaethics to develop the unified Humean account. (shrink)

Artificial intelligent (AI) systems used in medicine are often very reliable and accurate, but at the price of their being increasingly opaque. This raises the question whether a system’s opacity undermines the ability of medical doctors to acquire knowledge on the basis of its outputs. We investigate this question by focusing on a case in which a patient’s risk of recurring breast cancer is predicted by an opaque AI system. We argue that, given the system’s opacity, as well as the (...) possibility of malfunctioning AI systems, practitioners’ inability to check the correctness of their outputs, and the high stakes of such cases, the knowledge of medical practitioners is indeed undermined. They are lucky to form true beliefs based on the AI systems’ outputs, and knowledge is incompatible with luck. We supplement this claim with a specific version of the safety condition on knowledge, Safety*. We argue that, relative to the perspective of the medical doctor in our example case, his relevant beliefs could easily be false, and this despite his evidence that the AI system functions reliably. Assuming that Safety* is necessary for knowledge, the practitioner therefore doesn’t know. We address three objections to our proposal before turning to practical suggestions for improving the epistemic situation of medical doctors. (shrink)

I argue against the claim that it is trivial to state that Sidgwick used the method of wide reflective equilibrium. This claim is based on what could be called the Triviality Charge, which is pressed against the method of wide reflective equilibrium by Peter Singer. According to this charge, there is no alternative to using the method if it is interpreted as involving all relevant philosophical background arguments. The main argument against the Triviality Charge is that although the method of (...) wide reflective equilibrium is compatible with coherentism (understood as a form of weak foundationalism) as well as moderate foundationalism, it is not compatible with strong foundationalism. Hence, the claim that a philosopher uses the method of wide reflective equilibrium is informative. In particular, this is true with regard to Sidgwick. (shrink)

Suicide is a complex act whose meanings, while sometimes tragic, vary widely. This chapter surveys the ethical landscape surrounding algorithmic methods of suicide prevention especially as it pertains to social media activity and to the moderation of online suicide communities. We begin with a typology of suicide, distinguishing between varied goals in which suicide may factor as a means. Suicides should be understood as an act with varied eliciting desires, meanings, consequences, and ethics. Further,while many suicides may be grounded on (...) irrational desire, we argue that a desire to suicide may nonetheless be rational in some cases. We then offer a survey of the attempts by social media corporations to create suicide prediction algorithms and launch interventions aimed at preventing suicide as well as an overview of the current ethical debate. We argue that the values embedded within algorithmic suicide prevention nudges are “thick” in a substantive sense and deserving of scrutiny. Given that debates about the rationality, meaning, and permissibility of suicide are common and subject to intracultural and cross-cultural differences, we maintain that the task of suicide prediction is ill-suited to algorithmic approaches. Despite an algorithm’s ability to quantify a complex phenomenon like suicide risk and its appearance of objectivity, any suicide prediction algorithm is thoroughly subjective and involves moral judgments all the way down. Any such algorithm would necessarily impose a normative stance on suicide onto its user base that is subject to reasonable intra and cross-cultural disagreement. (shrink)

We propose the Prototime Interpretation of quantum mechanics, which claims that quantum entanglement occurs in a "prototemporal" realm which underlies spacetime. Our paper is tentative and exploratory. The argument form is inference to the best explanation. We claim that the Prototime Interpretation (PI) is worthy of further consideration as a superior explanation for perplexing quantum phenomena such as delayed choice, superposition, the wave-particle duality and nonlocality. In Section One, we introduce the Prototime Interpretation. Section Two identifies its advantages. The method of metaphysics: Metaphysics is empirical but depends not, like the sciences, on recondite experience but on close attention to aspects of everyday experience we ordinarily scarcely notice. "Real" is a broader concept than "exists" (which applies only to particulars) and also applies to phenomena, kinds, and laws, which are real, but not, of course, existent entities. But "there are real kinds, laws, etc." doesn't imply that all the kinds and laws we believe are real, are. I call my (...) approach "Innocent Realism" because--though it's certainly not naive--it requires attending to experience, so far as possible, without substantial preconceptions. There is one real world, enormously varied but also integrated. It includes physical stuff, kinds, laws, etc. and, here on earth, a vast array of human artifacts, physical, social, intellectual, and imaginative, all intimately interconnected. All this requires human mindedness (a better word than "mind" because it doesn't suggest that human mentality is an organ like the heart or the liver). Rather, it's a complex congeries of dispositions and abilities: to understand even such a relatively simple thing as what's involved in someone's believing something, we need to take account of the person's dispositions to behavior, verbal and otherwise; to the neurophysiological realizations of these dispositions; and to their connections to the world and to words in the person's linguistic community--this last requiring other people's words-world connection. "Virtual" reality is just one more computer artifact, clever, no doubt, but not metaphysically startling. It's oversold, but this is advertising hype, not serious metaphysics. (shrink)

Background: Hospitals are experiencing an estimated 16.5% turnover rate of registered nurses costing from $44,380 - $63,400 per nurse—an estimated $4.21 to $6.02 million financial loss annually for hospitals in the United States of America. Attrition of all nurses is costly. Most past research has focused on the new graduate nurse with little focus on the mid-career nurse. Attrition of mid-career nurses is a loss for the profession now and into the future. Research objective: The purpose of the study was (...) to explore relationships of professional values orientation, career development, job satisfaction, and intent to stay in recently hired mid-career and early-career nurses in a large hospital system. Research design: A descriptive correlational study of personal and professional factors on job satisfaction and retention was conducted. Participants and research context: A convenience sample of nurses from a mid-sized hospital in a metropolitan area in the Southwestern United States was recruited via in-house email. Sixty-seven nurses met the eligibility criteria and completed survey documents. Ethical considerations: Institutional Review Board approval was obtained from both the university and hospital system. Findings: Findings indicated a strong correlation between professional values and career development and that both job satisfaction and career development correlated positively with retention. Discussion: Newly hired mid-career nurses scored higher on job satisfaction and planned to remain in their jobs. This is important because their expertise and leadership are necessary to sustain the profession into the future. Conclusion: Nurse managers should be aware that when nurses perceive value conflicts, retention might be adversely affected. The practice environment stimulates nurses to consider whether to remain on the job or look for other opportunities. (shrink)

Kant’s duties of love include the duties of beneficence, gratitude, and sympathetic participation. But what is it that allows Kant to bring such seemingly quite heterogeneous duties under one concept, especially under the concept of love? I will argue that it is benevolence as an essential element of love that takes on this unifying role. In order to understand this role of benevolence as the unifying element of the three duties of love, the concept of benevolence will first be analyzed (...) (part 1). Against this background, all three duties of love are then reassessed. Beneficence will be shown to be a proactive form of benevolence (part 2), gratitude to be a reactive form of benevolence (part 3), and sympathetic participation is understood as a form of reciprocal benevolence (part 4). Current Generative Artificial Intelligence models have become incredibly close to the human level of linguistic and artistic excellence, defying our conception of artworks as uniquely human products, resulting in an authorship problem, i.e., whether artificial agents can be regarded as genuine authors of their products. This paper provides a definition of institutional authorship to evaluate this possibility, using John Searle’s Speech Act Theory and Theory of Institutions. To apply the definition, we focus on artistic cases, assuming the institutional theory of (...) art. According to the institutional authorship definition proposed, authorship is the product of an agent’s declarative acts in the context of relevant institutions granting the agent’s deontic powers for performing such acts. These acts depend on sincerity conditions encompassing intentional states, which bind the product with an agent. We conclude that artificial agents cannot satisfy the institutional definition of authorship due to their inability to be institutional agents, meaning they cannot be authors. (shrink)

In this article, I explore, through the novels of Elena Ferrante, the role played by the ‘abject’ in mediating ageing in women, focusing on its role in the movement from a disempowered to a more powerful subject position. The article has three sections. The first describes the role of the abject in constituting the feminine, focusing on the place of temporality and ageing in this process. Represented by the symbolic figure of the hag, the old woman is a source of (...) primal fear which forms the foundation of a violently misogynistic gendered (self-)formation. However, following Barbara Creed, there are two representational forms of the hag, that of victim (hag) and that of monster (Hag), which I argue also suggest alternative subjectivities associated with ageing femininity. In the second section, I explore the movement from one form to the other by means of conceptual models drawn from Simone de Beauvoir and Margaret Morganroth Gullette, in which process a battle over the symbolic meaning of abjection is central. Moreover, ageing itself is significant in mediating the shift from an oppressed/fragmented to a powerful/integrated subject position. Whilst the structures of feeling involved in this subjectivity are emergent, fiction and imaginative literature may provide helpful early depictions and in the last section I illustrate the psychosocial domain with material drawn from two early novels by Elena Ferrante. The idea is to bring together concepts from phenomenology and the philosophy of age with methods from the field of qualitative social research. Experiences of groundlessness are viewed through the lens of Karl Jaspers’ terminology, leading to conceptualizing a dynamic of stabilizing beliefs yielding in the context of aging and old age. Although modern modal logic came about largely after Peirce’s death, he anticipated some of its key aspects, including strict implication and possible worlds semantics. He developed the Gamma part of Existential Graphs with broken cuts signifying possible falsity, but later identified the need for a Delta part without ever spelling out exactly what he had in mind. An entry in his personal Logic Notebook is a plausible candidate, with heavy lines representing possible states of things where propositions denoted by attached (...) letters would be true, rather than individual subjects to which predicates denoted by attached names are attributed as in the Beta part. New transformation rules implement various commonly employed formal systems of modal logic, which are readily interpreted by defining a possible world as one in which all the relevant laws for the actual world are facts, each world being partially but accurately and adequately described by a closed and consistent model set of propositions. In accordance with pragmaticism, the relevant laws for the actual world are represented as strict implications with real possibilities as their antecedents and conditional necessities as their consequents, corresponding to material implications in every possible world. Despite their ethical challenges, recommender systems (RS) are widely endorsed as a necessary solution to the problem of information overload. After clarifying how the harmful effects of information overload can be characterized in distinct ways, I explore the often overlooked potential benefits of abundant online spaces. I argue that these spaces afford valuable opportunities to experience spontaneous freedom. I then put forth a more comprehensive evaluation of the role RS should assume in algorithmically structuring the online space. Gadamer elaborates on his experiences in education and politics, touching on the collapse of the Weimar Republic, the early Frankfurt School, Heidegger and the Nazis, university life in East Germany, and the prospects (...) for Europe in the coming years. Hans-Georg Gadamer was probably Heidegger’s leading interpreter in Germany, and in the 1950s and 1960s he became the world’s leading exponent of hermeneutics. His hermeneutical theory explains how it is that ancient art and philosophy still speak to us today. The present volume contains 14 contributions presented at a colloquium on "Structure and Approximation in Physical Theories" held at Osnabruck in June 1980. The articles are presented in the revised form written after the colloquium and hence also take account of the results of the discussion at the colloquium. It is a striking feature that the problem of approximation in physical theories has only recently found some attention in the philosophy of science, although the working physicist is con stantly confronted (...) with those questions. No interesting theory of exact science exactly fits its experimental data; almost every relation between different theories is an approximate one. There fore an adequate reconstruction of physical theories must take into account and conceptualize the moment of approximation. The majority of the articles in this book is centered around this subject. There are at least two elaborate, 'structuralistic' approaches to the formalization of physical theories in which the aspect of approximation has been incorporated: the approach due to P. Suppes, J. Sneed, W. Stegmuller ("S-approach") and the approach of G. Lud wig and his co-workers ("L-approach"). The articles in this book correspondingly fall into three classes: presentation, elaboration and critique of the L-approach [Hartkamper/Schmidt, Ludwig, Neumann, Werner, Schmidt, Mayr, Kamiah, Majer, Grafe] or of the S-approach [Moulines, Balzer, Cooke], and articles referring to both approaches or concerned with related matters [Scheibe, Pfarr, Castrigiano]. Context: Philosophical debates in recent decades have developed new ways of dealing with old philosophical problems such as reality, truth, knowledge, language, communication, and action. These new approaches deserve serious consideration because they can improve the discourse of radical constructivism. Problem: This paper discusses the following problem: How can we overcome dualistic and ontological approaches to basic philosophical problems – problems that are relevant to all scientific domains? Method: The method applied here can be roughly described as a transition from (...) entities/substantives/identities to actions and processes, the actions and processes from which so-called entities result. Action-orientation – or an actor-based process – is necessarily combined with sense-orientation as provided by culture and society. Results: The paper demonstrates how the problems mentioned above can be reformulated in a non-dualistic and non-ontological way. Implications: Opening up constructivist thinking to insights provided by neighbouring philosophical approaches facilitates interdisciplinary cooperation and helps overcome dualistic remnants – as well as the cognitive one-sidedness of traditional constructivism. Respect for patient autonomy is a central principle of medical ethics. However, there are important unresolved questions about the characteristics of an autonomous decision, and whether some autonomous preferences should be subject to more scrutiny than others. In this paper, we consider whether _inappropriately adaptive preferences_—preferences that are based on and that may perpetuate social injustice—should be categorised as autonomous in a way that gives them normative authority. Some philosophers have argued that inappropriately adaptive preferences do not have normative authority, (...) because they are only a reflection of a person’s social context and not of their true self. Under this view, medical professionals who refuse to carry out actions which are based on inappropriately adaptive preferences are not in fact violating their patient’s autonomy. However, we argue that it is very difficult to articulate a systematic and principled distinction between normal autonomous preferences and inappropriately adaptive preferences, especially if this distinction needs to be useful for clinicians in real-life situations. This makes it difficult to argue that inappropriately adaptive preferences are straightforwardly non-autonomous. Given this problem, we argue that there are significant theoretical issues with contemporary understandings of autonomy in bioethics. We discuss what this might mean for the practice of medicine and for medical ethics education. (shrink)

What Babies Know (WBK) argues that core knowledge has a unique place in cognitive architecture, between fully perceptual and fully conceptual systems of representation. Here I argue that WBK's core knowledge is on the perception side of the perception/cognition divide. I discuss some implications of this conclusion for the roles language learning might play in transcending core knowledge.

Whether the mind is thought to be physical or non-physical, philosophers generally agree that there is an intimate connection between the mind and the self. Dualists have always maintained that the person is his mind and that he just happens to have a particular body. There has also been support for this in classical and contemporary literature on personal identity in the discussions of numerous hypothetical cases involving the transfer of “mental contents” from one body to another, often in the (...) form of “brain transplants”. In connection with each case the following question was raised: Does mental continuity guarantee that one will be the same person or is spatio-temporal continuity necessary? Most philosophers have thought that spatio-temporal continuity is not necessary, but that mental continuity is. Finally, very recently there has been much interest in two types of abnormal phenomena—the “split-brain” and multiple personalities—which give indications of there being more than one mental stream associated with a single body and, as a result, philosophers discussing these phenomena have thought that there is good reason to think of there being more than one self involved in such cases.
