Drawing on Brown and Fraser’s (in: Giles, Scherer (eds) Social markers in speech, Cambridge University Press, Cambridge, pp 33–62, 1979) framework for the analysis of communicative situations and Fuentes Rodríguez’s (Lingüística pragmática y Análisis del discurso, Arco Libros, Madrid, 2000; in Estudios de Lingüística: Investigaciones lingüísticas en el siglo XXI, 2009. https://doi.org/10.14198/ELUA2009.Anexo3.04 ) model of pragmatic analysis, this paper examines three home-made recordings featuring some of the members of the terrorist cell responsible for the 2017 vehicle-ramming attacks in Barcelona (...) and Cambrils weighted as evidence during the trial held between November 2020 and May 2021 in the Spanish National High Court. The aim of this qualitative analysis is to test whether the linguistic evidence available supports the allegation that the participation in these recordings by one of the accused, Mohamed Houli Chemlal, had been planned by his interlocutors. Results show, first, that the exchanges analyzed present features indicative of both spontaneity and (limited) planification. Second, that Houli makes key contributions to the unfolding of the interactions shown in the recordings and that he does so in a cooperative and apparently relaxed manner, which could at best provide only partial support to his allegations. It is claimed that forensic linguistic analysis can generate valuable insights within terrorism-related legal proceedings. (shrink)

Our aesthetic judgments are embedded in and shaped by unjust social orders. But can our aesthetic judgments themselves—“this is beautiful; that is not”—be unjust? This article argues that they can. Admitting that this is so does not require us to be unduly revisionary with respect to our concept of justice. Rather, the thought that aesthetic judgments are unjust flows naturally from familiar egalitarian constraints.

Can Bradley's Regress be solved by positing relational tropes as truth-makers? No, no more than Russell's paradox can be solved by positing Fregean extensions. To call a trope relational is to pack into its essence the relating function it is supposed to perform but without explaining what Bradley's Regress calls into question, viz. the capacity of relations to relate. This problem has been masked from view by the (questionable) assumption that the only genuine ontological problems that can be intelligibly raised (...) are those that can be answered by providing a schedule of truthmakers. There is growing need for hybrid curricula that integrate constructivist methods from Science and Technology Studies (STS) into both engineering and policy courses at the undergraduate and graduate levels. However, institutional and disciplinary barriers have made implementing such curricula difficult at many institutions. While several programs have recently been launched that mix technical training with consideration of “societal” or “ethical issues,” these programs often lack a constructivist element, leaving newly-minted practitioners entering practical fields ill-equipped to unpack the politics of knowledge (...) and technology or engage with skeptical publics. This paper presents a novel format for designing interdisciplinary coursework that combines conceptual content from STS with training in engineering and policy. Courses following this format would ideally be team taught by instructors with advanced training in diverse fields, and hence co-learning between instructors and disciplines is a key element of the format. Several instruments for facilitating both student and instructor collaborative learning are introduced. The format is also designed for versatility: in addition to being adaptable to both technical and policy training environments, topics are modularized around a conceptual core so that issues ranging from biotech to nuclear security can be incorporated to fit programmatic needs and resources. The article proposes an account of the prevailing classical Chinese conception of reasoning and argumentation that grounds it in a semantic theory and epistemology centered on drawing distinctions between the similar and dissimilar kinds of things that do or do not fall within the extension of ‘names’. The article presents two novel interpretive hypotheses. First, for pre-Hàn Chinese thinkers, the functional role associated with the logical copula is filled by a general notion of similarity or sameness. Second, these thinkers’ basic (...) explanation of reasoning is that it is a process of moving from a comparison of whether something is similar to a ‘model’ or ‘standard’ to a judgment about whether that thing is part of a certain kind. Classical texts treat judgment as the attitude of predicating a ‘name’ of something, or, equivalently, of distinguishing whether something is the kind of thing denoted by a certain term. Reasoning is treated as a process of considering how some acts of term predication, or drawing distinctions, normatively commit one to making further, analogous predications or drawing further, analogous distinctions. Inference is thus understood as the act of distinguishing something as a certain kind of thing as a result of having distinguished it as similar to a relevant ‘model’ or ‘standard’. The article concludes by summarizing the consequences of the proposed account of early Chinese semantic and logical theories for the interpretation of other areas of classical Chinese thought. An extensive literature has demonstrated that encoding information in a self-referential manner enhances subsequent memory performance. This ‘self-reference effect’ is generally elicited in paradigms that require participants to evaluate the self-descriptiveness of personality characteristics. Extending work of this kind, the current research explored the possibility that explicit evaluative processing is not a necessary precondition for the emergence of this effect. Rather, responses to self cues may enhance item encoding even in the absence of explicit evaluative instructions. We explored this hypothesis (...) by testing memory for items encoded in either an evaluative or relational context. The relational context was achieved by requesting participants to report the spatial relationship between target stimuli, and visual or verbal referent cues. The results revealed a self-referent memory advantage, regardless of the encoding context or triggering cue. The theoretical implications of these findings are considered. (shrink)

Over the last few decades feminists, science and technology studies scholars and others have grappled with how to take materiality into account in understanding social practices, subjectivity and events. One key area for these debates has been drug use and addiction. At the same time, neuroscientific accounts of drug use and addiction have also arisen. This development has attracted criticism as simplistically reinstating material determinism. In this article we draw on 80 interviews with health professionals directly involved in drug-related public (...) policy and service provision in three countries to identify the main ways the neuroscience of addiction (and thus the agency of the brain) is understood. We analyse these understandings using contemporary posthumanist theory to develop new options for conceptualizing matter in public responses to addiction. We close by calling for a new approach to addiction and the brain based on a process model of materiality and public debate. (shrink)

This essay examines the theory of ritual propriety presented in the Xúnzǐ and criticisms of Xunzi-like views found in the classical Daoist anthology Zhuāngzǐ. To highlight the respects in which the Zhuāngzǐ can be read as posing a critical response to a Xunzian view of ritual propriety, the essay juxtaposes the two texts' views of language, since Xunzi's theory of ritual propriety is intertwined with his theory of language. I argue that a Zhuangist critique of the presuppositions of Xunzi's stance (...) on language also undermines his stance on ritual propriety. Xunzi contends that state promulgation of anelaborate code of ritual propriety is a key to good social order (zhi) and that state regulation of language is a key to smooth communication and thus also good order. The Zhuāngzǐ provides grounds for doubting both contentions. Claiming that ritual propriety causally produces social order is analogous to claiming that grammar causally produces smooth linguistic communication, when in fact it is more likely our ability to communicate that allows us to develop shared rules of grammar. Humans have fundamental social and communicative capacities that undergird our abilities to speak a language or engage in shared ritual performances. It is these more fundamental capacities, not their manifestation in a particular system of grammar or ritual norms, that provide the root explanation of our ability to communicate or to live together harmoniously. The Xunzi-Zhuangzi dialectic suggests that ritual is indispensable, but normatively justified rituals will be less rigid, less comprehensive, less fastidious, and more spontaneous than a Xunzian theorist would allow. The COVID-19 pandemic has impacted data collection for longitudinal studies in developmental sciences to an immeasurable extent. Restrictions on conducting in-person standardized assessments have led to disruptive innovation, in which novel methods are applied to increase participant engagement. Here, we focus on remote administration of behavioral assessment. We argue that these innovations in remote assessment should become part of the new standard protocol in developmental sciences to facilitate data collection in populations that may be hard to reach or engage due (...) to burdensome requirements. We present a series of adaptations to developmental assessments and a detailed discussion of data analytic approaches to be applied in the less-than-ideal circumstances encountered during the pandemic-related shutdown. Ultimately, these remote approaches actually strengthen the ability to gain insight into developmental populations and foster pragmatic innovation that should result in enduring change. (shrink)

By Edward Slingerland. New York: Oxford University Press, 2003. Pp. xii + 352. $60.00.This provocative work is the most ambitious general study of pre-Qin thought to appear in more than a decade. It deals with what is increasingly recognized as one of the period's key themes, the ethical ideal of perfected (...) action and the processes of cultivation, or uncultivation, by which it might be achieved. The book has two specific aims, one substantive, one methodological (p. vii). The substantive aim is to show that the notion of wu-wei, which Slingerland renders as "effortless action," functioned as a shared ideal and problematic for both Daoists and Confucians and that internal tensions in this ideal motivated much of the development of Warring States thought (p. 5). The methodological aim is to illustrate the fruitfulness of conceptual-metaphor theory, familiar from the work of Lakoff and Johnson, by employing it to articulate and support the book's substantive theses (p. vii).For Slingerland, wu-wei is "a state of personal harmony in which actions flow freely and instantly from one's spontaneous inclinations... and yet nonetheless accord perfectly with the dictates of the situation at hand, display an almost supernatural efficacy, and (in the Confucian context at least) harmonize with the demands of conventional morality" (p. 7). Slingerland expands on this characterization in various ways, without making it entirely clear how all the features he identifies fit together. On the one hand, he explains that wu-wei is a phenomenological feature of the agent's subjective mental state: "wu-wei properly refers not to what is actually happening (or not happening) in the realm of observable action but rather to... the phenomenological state of the doer" (p. 7), primarily one of effortlessness and unselfconsciousness (pp. 29-33). But wu-wei is also "action that... accords in every particular with the normative order of the cosmos" (p. 5), so beyond its phenomenological features, it must include an objective normative component as well. Another remark suggests that wu-wei fundamentally is not a phenomenological state after all, since "it represents not a transitory state but rather a set of dispositions" (p. 7). Probably these various statements are meant to emphasize that the crux of wu-wei is to achieve and sustain a certain sort of psychological state, which then reliably generates effortless, normatively appropriate, efficacious action.The phrase 'wu-wei' plays essentially no role in Confucian texts and is absent from large chunks of the Zhuangzi. So Slingerland's thesis that wu-wei is the joint [End Page 97] ideal of both Daoist and Confucian thought faces a daunting justificatory challenge, which he proposes to meet by applying conceptual metaphor theory (p. 10). On his interpretation, wu-wei is not to be understood literally, as "non-doing," since in the state denoted by wu-wei, the agent is not actually inactive, doing nothing at all (p. 11). This gap between literal meaning and actual reference indicates that the term 'wu-wei' functions metaphorically, referring to "a metaphorically conceived situation" in which an action occurs even though the agent exerts no effort (p. 11). Slingerland hypothesizes that wu-wei became a technical term for effortless action because it is the most general of a network of conceptual metaphors for effortlessness and unselfconsciousness, including families of metaphors for "following" (p. 29), "ease" (p. 30), and "forgetting" (p. 33). Physicists use different theories to describe the world on different scales. In particular, they use the standard model of particle physics at very high energies, but move to various effective field theories, such as quantum electrodynamics, when modelling lower energy scattering processes. One way to explain this methodological fact is pragmatic in spirit. According to this view, physicists move to an effective field theory at lower energies in order to extract predictions and qualitative understanding which would be difficult or impossible (...) to extract directly from a more fundamental theory. By contrast, another way of accounting for the methodological data is metaphysical in spirit. On this view, the reason that physicists use different theories at different scales is that the world actually exhibits different nomic structure on different scales. These two positions have recently been thrown into sharp relief in a debate between Woodward (2016) and Batterman (2021), with Woodward taking the pragmatist line and Batterman the metaphysical line. One difficulty with the metaphysical answer is that its content is unclear: in what sense exactly could an effective field theory provide a better representation of the nomic structure of the world in its domain of applicability than our world’s fundamental theory? This talk attempts to provide an answer to this question by developing a simple metaphysical model. I start by assuming a set of possible worlds which are nomically possible according to some fundamental theory (I suggest that one is free to adopt either a Humean or Non-Humean view of these fundamental nomic necessities). I then introduce an equivalence relation between possible worlds: two worlds are scale-E equivalent if they assign the same values to physical quantities below energy scale E (up to some finite level of precision P). The key question now is whether this relation induces equivalence classes on the set of nomically possible worlds. I argue that in the case of current quantum field theories this does indeed occur, as evidenced by the possibility of “integrating out” high energy degrees of freedom in the renormalisation group framework. The formation of equivalence classes in the fundamental theory's possibility space indicates that some of its high energy features do not make a difference to its low energy dynamical behaviour. This suggests the following reading of the claim that an effective field theory provides a better representation of the nomic structure of the world in its domain of applicability: the solutions of the effective field theory stand in one-to-one correspondence with equivalence classes induced by the scale-E equivalence relation, whereas the fundamental theory overcounts the physical possibilities which are relevant at scale E. In this sense, the effective field theory provides a more natural representation of low energy physics than the fundamental theory. I conclude by explaining how this metaphysical model offers a reduction compatible understanding of multiple realisability, once again pointing to renormalisation group results in quantum field theory to support this. Philosophical analysis of spontaneous symmetry breaking (SSB) in particle physics has been hindered by the unavailability of rigorous formulations of models in quantum field theory (QFT). A strategy for addressing this problem is to use the rigorous models that have been constructed for SSB in quantum statistical mechanics (QSM) systems as a basis for drawing analogous conclusions about SSB in QFT. On the basis of an analysis of this strategy as an instance of the application of the same mathematical formalism (...) to different domains and as an instance of drawing analogies between domains, I conclude that certain structural explanations can be exported from QSM to QFT but that causal explanations cannot. Frege attempted to provide arithmetic with a foundation in logic. But his attempt to do so was confounded by Russell's discovery of paradox at the heart of Frege's system. The papers collected in this special issue contribute to the on-going investigation into the foundations of mathematics and logic. After sketching the historical background, this introduction provides an overview of the papers collected here, tracing some of the themes that connect them.

Democratic deliberation places the burden of self‐governance on its citizens to provide mutual justifying reasons (Gutmann & Thompson, 1996). This article concerns the limiting effect that group identity has on the efficacy of democratic deliberation for equality in education. Under conditions of a powerful majority, deliberation can be repressive and discriminatory. Issues of white flight and race‐based admissions serve to illustrate the bias of which deliberation is capable when it fails to substantively take group identity into account. As forms of (...) Gilbert's (1994) plural subjects, identity group members holding the group identity can experience agency as the freedom to believe together with members of their group. I argue that attending to how group members acquire group beliefs through trust is a reasonable accommodation of group identity in deliberation. (shrink)

The partner choice approach to understanding the evolution of cooperation builds on approaches that focus on partner control by considering processes that occur prior to pair or group formation. Proponents of the partner choice approach rightly note that competition to be chosen as a partner can help solve the puzzle of cooperation. I aim to build on the partner choice approach by considering the role of signalling in partner choice. Partnership formation often requires reliable information. Signalling is thus important in (...) the context of partner choice. However, the issue of signal reliability has been understudied in the partner choice literature. The issue deserves attention because – despite what proponents of the partner choice approach sometimes claim – that approach does face a cheater problem, which we might call the problem of false advertising in biological markets. Both theoretical and empirical work is needed to address this problem. I will draw on signalling theory to provide a theoretical framework within which to organise the scattered discussions of the false advertising problem extant in the partner choice literature. I will end by discussing some empirical work on cooperation, partner choice, and punishment among humans. (shrink)

El presente texto tiene por objetivo plantear una propuesta educativa que complejice la manera de pensar de los adolescentes escolarizados y, por lo tanto, su manera de convivir con la incertidumbre, el devenir y la otredad. Con miras a ello, se parte de la formulación de un “método” –palabra clave en este trabajo– basado en las filosofías de la Escuela de Frankfurt y Edgar Morin, que sea capaz de hacerse cargo de la multidimensionalidady multirreferencialidad de la realidad: el pensar dialéctico (...) y complejo. Se considera que solo un pensar de estascaracterísticas, un pensar que convierte al sujeto en estratega, construirá ciudadanos capaces de hacerse cargo desus democracias. Se procura esclarecer la conexión entre educación y política para poner la primera como basey motor de la segunda. A continuación, se describe la propuesta educativa para formar ciudadanos complejos, la cual se basa en la recuperación de una cultura profunda capaz de complejizar el pensar de los adolescentes yalejarlos de discursos simplistas y totalizadores. Finalmente, se concluye que la única manera de evitar nuevas barbaries como la de Auschwitz –como campo de exterminio, pero, sobre todo, como metáfora del lugar al que se puede llevar el conocimiento sin un pensamiento educado que lo guíe– es promover una educación para lacomplejidad, la comprensión y la libertad. Zhuangzi: Ways of Wandering the Way presents a richly detailed, philosophically informed interpretation of the personal and interpersonal ethics found in the Daoist classic Zhuangzi, introducing a unique Daoist approach to ethics focusing on the concept of a way and our capacity for following ways. Zhuangist thought reframes our relation to our social and natural setting while offering a distinctive, intriguing view of dao, agency, and the structure and grounds for action. At the same time, it embodies an ethical and (...) epistemic modesty that rejects the idea of there being any uniquely privileged form of the good life or any authoritatively correct way to interact with others. The Zhuangist dao is inherently plural, provisional, and protean, and we are likely to find a variety of justifiable ways of wandering along it. Any number of these might contribute to a well-lived, fulfilling life, marked by appropriate social interaction, provided it is pursued with adept responsiveness to our circumstances and awareness of our place in the larger scheme of things. The book examines what prominent threads of discourse in the Zhuǎngzǐ have to say about the nature and content of dào, how we might guide our path along dào, the personal training and cultivation involved, and the criteria by which to evaluate our performance. The discussion illustrates how a Zhuangist outlook in metaethics, ethics, moral psychology, and moral epistemology remains relevant to readers today. (shrink)

This paper is an attempt to examine issues and problemsraised by agricultural biotechnology by drawing on the richnessof contemporary ideas in ethical theory and thereby contribute tothe project of establishing new approaches to these problems. Thefundamental argument is that many of the negative aspects ofagricultural biotechnology are generated at the level of theunderlying conceptual frameworks that shape the technology''sinternal modes of organization, rather than the unintendedeffects of the application of an inherently benevolent set oftechniques. If ``food ethics'''' is to address (...) the adverse impacts ofagricultural biotechnology, it must ultimately challenge theseconceptual frames, which, I argue, emerge from Enlightenment,liberal, political, and economic theory.The translation of traditional bioethics (focusing on principlessuch as autonomy and rights, justice, and well being) into foodethics does not produce the critical tools that are ableadequately to challenge the harmful legacy of Enlightenmentthinking. What is needed are reorientations of ethics that arecapable of formulating concepts and approaches that to someextent break with the presuppositions that underpin biotechnologyat its foundation. This paper suggests that narrative andfeminist critiques of medical bioethics are a good place to startin this project. (shrink)

One area in which children’s rights are rarely considered in the USA is that of autonomy over their bodies. This right is routinely ignored in the arena of health care decision making. Children are routinely excluded from expressing their opinions involving medical decisions that affect them. This article discusses the complex reasons why children’s voices are typically not heard in the USA, the consequences of their disempowerment, and the ethical obligations of health care providers to advocate for the rights of (...) children, even in the absence of a legal mandate to do so. The author discusses an inscription of the late fourth or early third century BC carved on a bronze plaque found in the first excavations at Dodona, on which a Zakynthian, by name Agathon, records a link of proxeny between himself and his family and the Epirote koinon of the Molossians, through Kassandra, the Trojan prophetess. The plaque is decorated by a prominent phallus with testicles, which the author interprets as referring to the continuity, past and future, of the "geneá" of (...) Agathon.
