Interest in the notion of the possible financial sacrifice suffered by socially responsible investment (SRI) fund investors for considering ethical, social and environmental issues in their investment decisions has spawned considerable academic interest in the performance of SRI funds. Both the Australian and international research literature have yielded largely mixed results. However, several of these studies are hampered by methodological problems which can obscure the significance of reported results, such as the use of small sample sizes, inconsistencies in the time (...) frames selected to analyse performance and different modelling frameworks used to estimate investment returns. This study attempts to redress some of these issues by investigating the returns performance of 89 ethical funds in Australia over the period 1986-2005. Using a multi-factor CAPM model [Fama, E. F., and K. R. French (1996) J. Finance 51(1), 55] (which controls for factors such as size, book-to-market value and momentum) we find that ethical funds significantly under-perform the market in Australia, particularly in the most recent 5 years of our sample period (2000-2005). Risk adjusted returns (using Jensen's alpha) indicate that average annual underperformance is around 1.52% in the 2000-2005 period for our sample and .88% over the whole sample period. Our results contrast with many previous studies (both Australian and international), which have not found statistically significant differences in the performance of ethical funds relative to market benchmarks and/or a matched sample of conventional funds. Some have suggested that Jon Stewart of The Daily Show with Jon Stewart (TDS) and Stephen Colbert of The Colbert Report (TCR) represent a new kind of journalist. We propose, rather, that Stewart and Colbert are imitators who do not fully inhabit the role of journalist. They are interesting because sometimes they do a better job performing the functions of journalism than journalists themselves. However, Stewart and Colbert do not share journalists' moral commitments. Therefore, their performances (...) are neither motivated nor constrained by these commitments. Using a virtue theory framework, we suggest that this distinction between journalists and their imitators is morally significant because it implies differences in the kinds of excellence these moral agents are pursuing in their work. Rather than evaluating the work of Colbert and Stewart in the role of journalists, we propose analyzing their contributions to media ethics in the role of media critics. (shrink)

The second wave of devastating consequences of the COVID-19 pandemic has been linked to dramatic declines in well-being. While much of the well-being literature is based on descriptive and correlational studies, this paper evaluates a growing body of causal evidence from high-quality randomized controlled trials (RCTs) that test the efficacy of positive psychology interventions (PPIs). This systematic review analyzed the findings from 25 meta-analyses, 42 review papers, and the high-quality RCTs of PPIs designed to generate well-being that were included within (...) those studies. Findings reveal PPIs have the potential to generate well-being even during a global pandemic, with larger effect sizes in non-Western countries. Four exemplar PPIs—that have been tested with a high-quality RCT, have positive effects on well-being, and could be implemented during a global pandemic—are presented and discussed. Future efforts to generate well-being can build on this causal evidence and emulate the most efficacious PPIs to be as effective as possible at generating well-being. However, the four exemplars were only tested in WEIRD (Western, Educated, Industrial, Rich, and Democratic) countries but seem promising for implementation and evaluation in non-WEIRD contexts. This review highlights the overall need for more rigorous research on PPIs with more diverse populations and in non-WEIRD contexts to ensure equitable access to effective interventions that generate well-being for all. In the 1830s and 1840s, there was a decisive conflict between the Danish followers of Hegel and his opponents. The latter criticized Hegel’s philosophy for being overly abstract and having lost touch with reality. Kierkegaard is given credit for this criticism and for establishing a new philosophical direction that rejects abstraction and focuses on the concrete experience of the individual. The present article argues that there was nothing particularly new about Kierkegaard’s rejection of abstract philosophy and his attempt to emphasize (...) actuality and life. In fact, the conflict was wider and extended to many other Danish thinkers at the time who were critical of precisely this point in Hegel. (shrink)

Do moral appraisals shape judgments of intentionality? A traditional view is that individuals first evaluate whether an action has been carried out intentionally. Then they use this evaluation as input for their moral judgments. Recent studies, however, have shown that individuals’ moral appraisals can also influence their intentionality attributions. They attribute intentionality to the negative side effect of a given action, but not to the positive side effect of the same action. In three experiments, we show that this asymmetry is (...) a robust effect that critically depends on the agent’s beliefs. The asymmetry is reduced when agents are described as not knowing that their action can bring about side effects, and is eliminated when they are deemed to hold a false belief about the consequences of their actions. These results suggest that both evaluative and epistemic considerations are used in intentionality attribution. (shrink)

In attempting to improve ethical decision-making in business organizations, researchers have developed models of ethical decision-making processes. Most of these models do not include a role for law in ethical decision-making, or if law is mentioned, it is set as a boundary constraint, exogenous to the decision process. However, many decision models in business ethics are based on cognitive moral development theory, in which the law is thought to be the external referent of individuals at the level of cognitive development (...) that most people have achieved. Other theoretical bases of ethical decision models, social learning, and experientialism, also imply a role for law that is rarely made explicit. Law is a more important aspect of ethical decision-process models than it appears to be in the models. This paper will derive explicit roles for the law from the cognition, experientialism, and social learning theories that are used to build ethical decision-making models for business behavior. This chapter explores mutations in conceptions of popular culture brought by attention to one’s experience of its objects. According to Stanley Cavell, the value of a culture lies not in its “great art” but in its transformative capacity, the same capacity found in the “moral perfectionism” of Emerson and Thoreau. Cavell was the first to account for the necessity of theory and criticism brought about by reflection on Hollywood film. However, he is less concerned with reversing artistic hierarchies or inverting (...) the relation between theory and practice than with the self-transformation required by our encounters with new experiences, what he defines as the “education of grownups”. This does not imply a false revolutionary inversion of aesthetic values but rather a new assessment of importance, which Wittgenstein called for when he asserted the importance of ordinary language philosophy and attention to ordinary practices and life. One typically thinks of the relevance of Kant’s aesthetic theory to Western art in terms of Modernism, thanks in large part to the work of eminent critic and art historian Clement Greenberg. Yet, thinking of Kant’s legacy for contemporary art as inhering exclusively in “Kantian formalism” obscures a great deal of Kant’s aesthetic theory. In his last book, Arthur Danto suggested just this point, urging us to enlarge our appreciation of Kant’s aesthetic theory and its relevance to contemporary art, because, (...) for Danto, “Kant had two conceptions of art.” In this essay, I support and build on Danto’s claim that there are really two conceptions of art at work in Kant’s third Critique, and that the second conception offers a non-Modernist/formalist way that Kant’s aesthetic theory remains relevant to post 1960s art. My ultimate aim is to highlight another facet in the continuing relevance of Kant’s aesthetic theory to post-Expressionist contemporary art, namely, the explicit attention to the differential aesthetic values of nature and art respectively. I shall do this by putting it in dialogue with the art practice of Latvian-American artist, Vija Celmins whose illustrious career since 1960s has made her an ‘artist’s artist’ but who has also recently garnered much wider attention with a retrospective titled “To Fix the Image in Memory.” Celmins takes up artistically a problematic that is quite central philosophically to the concerns of the third Critique, and thus her work illustrates another way in which Kant’s aesthetic theory is of great continuing relevance to the artworld today. A philosophical exploration of the meaning and significance of friendship.This book explains the persistence of friendship today in the light of the history of philosophical approaches to the subject. It considers ideals of intimacy and fusion in the context of claims that such ideals are unrealistic and even dangerous. Adaptation to novel visuomotor transformations for example when navigating a cursor on a computer monitor by using a computer mouse, can be explicit or implicit. Explicit adjustments are made when people are informed about the occurrence and the type of a novel visuomotor transformation and intentionally modify their movements. Implicit adjustments, in contrast, are made without reportable knowledge of a novel visuomotor transformation and without a change intention. The relation of implicit adjustments to explicit adjustments needs further clarification. Here we (...) show that these two types of adjustment occur at the same time and remain functionally independent. The size of total adjustment turned out to be the sum of explicit and implicit adjustments measured in isolation, even when both processes produce opposite outcomes. In perspective our results demonstrate that automatic, implicit processes of motor control are not superseded by intentional, explicit ones, but only superposed. (shrink)

As suggested by David E. Boeyink, casuistry is a promising method for making ethical decisions in journalism because its “case-oriented strategy fits [the] general approach” of many journalists while its stress on consistency guards against arbitrariness. Despite its emphasis on consistency, however, casuistry gives self-interested decision makers enough wiggle room to rationalize whatever is expedient. For this reason, casuistry relies also on character. Yet writers who have studied casuistry have said relatively little about the link between character and casuistry and, (...) when they have, they have focused on the intellectual virtue of phronesis. This article articulates the essential moral virtues necessary to prevent arbitrariness in casuistry when practiced by journalists and demonstrates their relevance in relation to a recent case in which the journalist’s character was a key factor. The article concludes with several strategies for nurturing good character among journalists. (shrink)

This article argues that empathic listening deceives naive sources into thinking that they will be portrayed favorably in news stories. It suggests that a fair practice of interviewing obligates journalists to obtain informed consent from their sources in advance. Journalists may waive this obligation only when the personal integrity of sources is protected against the pragmatic calculations that tend to prevail in journalism ethics.

La justicia social tiene sus fundamentos políticos en el pensamiento de Nancy Fraser en el carácter económico de la sociedad, pero no la comprende con exclusividad, dado que existen dos dimensiones más que la complementan, el reconocimiento cultural y la representación política. En este contexto de estado de emergencia, surge la necesidad de comprender holísticamente el sentido de la justicia social y aplicarlo a la realidad peruana. De esta manera podemos evidenciar las falencias que existen dentro de cada dimensión, y (...) las medidas que el estado peruano ha tomado dentro de cada dimensión para contrarrestar o en su defecto solucionar el impacto de la pandemia. Durante la exposición de los tópicos abordaremos detalladamente que comprende la autora en cuestión acerca de los términos redistribución, reconocimiento y representación, dentro del marco de la Justicia Social y buscaremos extrapolar estas nociones teóricas a la realidad peruana dentro de la coyuntura de la pandemia, las manifestaciones de las particularidades. El presente trabajo saca a relucir no solo la improvisación de las medidas que no satisfacen las necesidades básicas que demandan cada dimensión, sino ofrece, a su vez, una crítica hacia la comprensión política de nuestras autoridades, las cuales no apuntan a alcanzar este estado de justicia social. Dicho estado de justicia tiene como horizonte un verdadero reconocimiento sostenido en cambios estructurales, para ello ineludiblemente se tiene que abordar el problema de la crisis económica, que se expresa en la desigualdad de condiciones y la falta de oportunidades. La justicia social siempre ha representado un ideal de sociedad, hasta el punto de concebirlo como un horizonte inalcanzable. Asociar la justicia con la igualdad o equidad no forma parte de la perspectiva política del país y esto se evidencia en el carácter amortiguador de los decretos legislativos establecidos por el Estado. Sin embargo, la ayuda del Estado no llega a todos los sectores de la población, y si es que llega, es asumida por el propio ciudadano mediante el retiro de su CTS o AFP. La realidad es distinta cuando se trata de las empresas, quienes tienen la potestad de despedir sin goce de haber a sus trabajadores bajo la modalidad de suspensión perfecta de labores. Dicha medida, es “perfecta” para la empresa quien no solo goza de este beneficio sino también puede acceder a un financiamiento de parte del Estado. En la sociedad la figura de la empresa se posiciona como indispensable, debido a que movilizan la economía al otorgar puestos de trabajo. Sin embargo, la integridad de los trabajadores no se ha visto como prioridad para dichas empresas, puesto que se concibe la fuerza de trabajo como un rubro que puede remplazarse con facilidad. De esta manera se evidencia una notable intención por no impartir con equidad mayores beneficios para aquellos que realmente están en una situación de desventaja. Por otro lado, los actos de corrupción acentúan la necesidad de una justicia social no como utopía sino como una obligación moral que se convierte en una exigencia patriótica. Aunque apuntemos a un reconocimiento de nuestras condiciones de existencia, dentro de nuestras particularidades, y a partir de este reconocimiento poder tener representación en las instancias a las que nos correspondan participar no existirá un verdadero reconocimiento sin una verdadera redistribución. The objective of this investigation is to initiate the development of a design-specific methodology for synaesthetic research, which will provide insight into synaesthesia from a designer's point of view. In addition, it aims to explore the possible advantages that the awareness of the phenomenon may have, specifically in the field of design education. The following question will be addressed: Can transdisciplinary studies of visual communication and neuropsychology help designers explore different practical approaches and theoretical views about synaesthesia?

The rise of genomic technologies has catalyzed shifts in the health care landscape through the commercialization of genome sequencing and testing services in the genomics marketplace. The development of consumer genomics into a growing array of information technologies aimed at collecting, curating, and broadly sharing personal data and biological materials reconstitutes the meaning of health and reframes patients into biocitizens. In this context, the good biocitizen is expected to assume personal responsibility for health through consumption of genomic information and acquiescence (...) to public and private efforts at data surveillance and aggregation. These shifts raise fundamental questions about how competing interests of the public, the state, and corporate entities will be reconciled and what trade‐offs are demanded for the promise of precision health. Criminal violence is one of the most pressing problems in Latin America and the Caribbean, with profound political consequences. Its effects on social policy preferences, however, remain largely unexplored. This article argues that to understand such effects it is crucial to analyze victimization experiences and perceptions of insecurity as separate phenomena with distinct attitudinal consequences. Heightened perceptions of insecurity are associated with a reduced demand for public welfare provision, as such perceptions reflect a sense of the state’s failure to provide (...) public security. At the same time, acknowledging the mounting costs and needs that direct experience with crime entails, victimization is expected to increase support for social policies, particularly for health services. Survey data from twenty-four Latin American and Caribbean countries for the period 2008–12 show that perceptions of insecurity indeed reduce support for the state’s role in welfare provision, whereas crime victimization strongly increases such preferences. The expansion of art audiences and the creation of new forms, agents, and models of artistic practice have transformed the very definition of art, challenging elitist notions of "great art." Dewey's _Art as Experience_ was essential to this transformation. This understanding and defense of an art that has not lost contact with ordinary audiences, which was film at first, extends to widespread cultural practices (internet videos, video games, TV series, popular music, etc.). They are places where artistic and hermeneutic authority (...) is reappropriated and where agents are reempowered through the constitution of individual experiences. Yet the question of their status as art remains. My first aim here is to use Dewey's analyses in _Art as Experience_ to assert not only the importance of popular culture in human lives but also its status as art. I shall bring together Stanley Cavell and Dewey, often seen as opposites in their approach to pragmatism, as inventors and defenders of an ordinary aesthetics; then, starting from Robert Warshow and Richard Shusterman, I propose a new theoretical inheritance of _Art as Experience_. Patient safety has been a priority at least since the U.S. Institute of Medicine 's landmark report To Err is Human: Building a Safer Health System, which defined medical error as "[f]ailure of a planned action to be completed as intended or use of a wrong plan to achieve an aim". The report inspired checklists and other protocols to reduce medical error that have since become standard. Nevertheless, the incidence of medical error is still high for a number of reasons, (...) including the systemic nature of medical error, the complexity of healthcare systems, persistent communication problems, weak regulations, and other factors. This article examines the requirements for ethical press apologias, defined as attempts to defend credibility when accused of ethical failure. Facing changing transparency expectations, apologists may fail to fully respond to injured stakeholders. Criticisms of CBS News' flawed report on President Bush's National Guard service illustrated this problem. Hearit's (2005b) paradigm for ethical apologias is applied to ?RatherGate? to see if and where the paradigmatic criteria fell short. A revised paradigm is proposed.

Recent writing on the idea of a form of life has tended to be critical of the use made of this notion by writers such as Peter Winch, D. Z. Phillips and Norman Malcolm. Rightly or wrongly these writers have been regarded as meaning by ‘a form of life’, something like ‘a way or style of life’, and recent explicatory work on the notion has largely tended to discount this as a plausible interpretation of what Wittgenstein meant in his use (...) of the expression. The intention of this paper is not that of direct intervention in this particular dispute, though the conclusions drawn, if correct, would have some bearing on it. The intention is rather to develop, in order to make use of it, the idea of a form of life within the context of a number of philosophical difficulties. I should certainly claim to be drawing upon the remarks made by Wittgenstein in his own use of the expression: but I should not claim to be expounding Wittgenstein. Hence I do not wish to enter into the disputes referred to above about what precisely Wittgenstein meant by the expression, though again, what I say, if not wholly misguided, should have some bearing on these disputes. ABSTRACT A patient whose case notes had been used, without her permission, during a disciplinary inquiry on the conduct of Wendy Savage (her obstetrician) complained that this was a breach of confidentiality. Her complaint cannot be understood as based on a concern about the possible adverse consequences of this use of the notes: rather, her concern was just with the fact that medical information about her had been made known to others. My concern is with the meaning and status of (...) the right to privacy, to which the Savage patient appealed. Such a right cannot be reduced to a property right, since this cannot capture what concerned the Savage patient. A proper understanding of what lies behind her complaint requires us to recognise the way in which facts about oneself—in this case facts about one's body—are intimately bound up with one's self, with one's identity, and thus with one's autonomy. What kinds of fact, and thus what conception of the self, are involved in such a conception of privacy need not everywhere be the same; the crucial point is that privacy and the self are concepts which, whatever their particular content, are internally related [1]. This article aims at putting in context and at pursuing the concept elaborated by the later Putnam of an ethics without ontology, which I associate with certain other contemporary philosophers like Stanley Cavell and Cora Diamond; and in general of a philosophy without ontology. Putnam’s ambition is to get rid of ontology by refocusing reflection on ethics in a realistic spirit. This calls for a reappraisal of the entirety of Putnam’s evolution after the 1980s, especially his “Wittgensteinian turn,” which has (...) sometimes been underappreciated. To say that ethics has nothing to do with ontology is to make a claim not only about ethics, but also about realism. That is why Putnam’s later work matters today, especially his radical break with the fact/value distinction. This does not only concern ethics, for as Diamond has said and as Putnam reiterates in his own style and culture, we must refocus reflection on ethics and on the place of ethics in our forms of life and of language.
