As countries around the world work to restrict unhealthy food and beverage marketing to children, the U.S. remains reliant on industry-self regulation. The First Amendment’s protection for commercial speech and previous gutting of the Federal Trade Commission’s authority pose barriers to restricting food marketing to children. However, false, unfair, and deceptive acts and practices remain subject to regulation and provide an avenue to address marketing to young children, modern practices that have evaded regulation, and gaps in the food and beverage (...) industry’s self-regulatory approach. Slips of the tongue, unwitting favoritism and stereotyped assumptions are just some examples of microaggression. Nearly all of us commit microaggressions at some point, even if we don’t intend to. Yet over time a pattern of microaggression can cause considerable harm by reminding members of marginalized groups of their precarious position. The Ethics of Microaggression is a much needed and clearly written exploration of this pervasive yet complex problem. What is microaggression and how do we know when it is occurring? (...) Many of our cognitive capacities are the result of enculturation. Enculturation is the temporally extended transformative acquisition of cognitive practices in the cognitive niche. Cognitive practices are embodied and normatively constrained ways to interact with epistemic resources in the cognitive niche in order to complete a cognitive task. The emerging predictive processing perspective offers new functional principles and conceptual tools to account for the cerebral and extra-cerebral bodily components that give rise to cognitive practices. According to this emerging perspective, many (...) cases of perception, action, and cognition are realized by the on-going minimization of prediction error. Predictive processing provides us with a mechanistic perspective that helps investigate the functional details of the acquisition of cognitive practices. The argument of this paper is that research on enculturation and recent work on predictive processing are complementary. The main reason is that predictive processing operates at a sub-personal level and on a physiological time scale of explanation only. A complete account of enculturated cognition needs to take additional levels and temporal scales of explanation into account. This complementarity assumption leads to a new framework—enculturated predictive processing—that operates on multiple levels and temporal scales for the explanation of the enculturated predictive acquisition of cognitive practices. Enculturated predictive processing is committed to explanatory pluralism. That is, it subscribes to the idea that we need multiple perspectives and explanatory strategies to account for the complexity of enculturation. The upshot is that predictive processing needs to be complemented by additional considerations and conceptual tools to realize its full explanatory potential. (shrink)

In response to the obesity epidemic, much discussion in the public health and child advocacy communities has centered on restricting food and beverage marketing practices directed at children. A common retort to appeals for government regulation is that such advertising and marketing constitutes protected commercial speech under the First Amendment. This perception has allowed the industry to function largely unregulated since the Federal Trade Commission 's foray into the topic, termed KidVid, was terminated by an act of Congress in 1981. (...) The FTC has since focused on self-regulation as a potential solution to such concerns. However, this method of control has proven ineffective to protect children, and has led to growing recognition that federal regulation may be necessary.Since KidVid, the evidence has only mounted that children are uniquely vulnerable to the effects of advertising. Over the same time period, the exposition of commercial speech jurisprudence has plateaued, as the Supreme Court has not decided a pure commercial speech case since 2002. (shrink)

Jack Goody’s work on the origins, spatial extent and defining characteristics of modernity has vigorously questioned claims that only European history led to assorted modern characteristics: capitalism, science, democracy, romantic love, and inwardly-motivated personal restraint. He argues that many societies which experienced the Bronze Age urban revolution share certain important material similarities (and some differences) which set them apart from others, and are best understood by constructing an analytical grid rather than categorical stages. With respect to alleged affective differences, Goody (...) takes a more strongly relativist stance, rejecting any developmental divide in the prevalence of romantic love, internalized self-discipline, etc. These useful steps nonetheless generate new problems. One concerns the relationship between material/technical changes, which seem to suggest a few very general historical periods (one marked by early metallurgy, writing, etc., and another by the modern energy revolution), and affective traits, which have no history in this schema. A second concerns periodization itself; while agreeing that periods defined by the experience of one region (e.g. a feudal era) are usually unhelpful, some general terms (such as early modern) do seem essential for conceptualizing developments that, though less epochal than writing or fossil fuels, are nonetheless important. This paper is one of four interrelated action papers resulting from the 2008 National Summit on Legal Preparedness for Obesity Prevention and Control. Summit participants engaged in discussions on the current state of the law with respect to obesity, nutrition and food policy, physical activity, and physical education. Participants also identified gaps in the law at all jurisdictional levels and relevant to numerous sectors and disciplines that have a stake in obesity prevention and control.The companion paper, “Assessment of Laws and (...) Legal Authorities for Obesity Prevention and Control,”identified numerous laws and policies enacted to target the three domains of healthy lifestyles, healthy places, and healthy societies. That paper identified several gaps in the law that require attention and action. This paper addresses those gaps and presents applicable laws and legal authorities that public health professionals and lawyers can consider to implement to close the gaps. (shrink)

This article presents an analytic critique of the predominant revisionist theoretical paradigm of just war (henceforth: revisionism). This is accomplished by means of a precise description and explanation of the practicability problem that confronts it, namely that soldiers that revisionism would deem “unjust” are bound to fail to fulfil the duties that revisionism imposes on them, because these duties are overdemanding. The article locates the origin of the practicability problem in revisionism’s overidealized conception of a soldier as an individual rational (...) agent analogous to the aggressor or defender in a case of lethal self-defense, who is capable of reflecting on the morality of his status in war and of the killing he performs and thus of recognizing his revisionist duties. Revisionism, however, ignores the following fact: Killing in war is not a natural human behavior. This is why training soldiers to kill is—and arguably always has been—a necessity for the existence of war and the killing that occurs in it. Moreover, this training involves a certain level of moral desensitization to violence whose goal is to prevent soldiers from thoroughly reflecting on the morality of the killing they engage in. Hence, war and killing can only exist if soldiers are trained in such a way that they do not reflect on whether they could be addressees of revisionist duties in the first place. This means that military training is a “constitutive condition” of soldiers and war, which is why it cannot excuse their noncompliance with revisionist duties, thus making these duties categorically overdemanding. The argument here draws on the paradigmatic example of modern US military killing conditioning (MC), but embeds it into a broader military-historical perspective that describes how soldiers have always needed to be mentally and morally influenced in order to enable war and killing. The article’s explanation of revisionism’s practicability problem has a constructive consequence for future theory-building in the ethics of war: It implies that a potentially revised ethical theory of war must necessarily analyze the institutions that allocate belligerent resources, if it aims to morally assess battlefield behavior in a practicable manner. For several decades, research on situated cognition and affectivity has neglected cases in which environmental features in the niche have a negative impact on agents’ cognitive and affective wellbeing. Recently, however, a new research cluster has emerged that explores how things, technologies, and organisational systems across corporate, healthcare, and educational sectors wrongfully harm certain kinds of agents. This article contributes to this research cluster by integrating work on negative niche construction, structural oppression, enculturation, and self-narration. It thereby offers a new (...) perspective on the negative, structurally oppressive impact of the socio-culturally shaped niche on enculturated self-narration. The main argument is that master plots, understood as narrative arrangements that dominate in the socio-culturally shaped niche, contribute to the structural oppression of enculturated self-narrators with systematically undermined socio-cultural identities. An analysis of the influence of pronatalist master plotting on enculturated self-narration serves to illustrate and strengthen the overall argument. (shrink)

The First Amendment to the US Constitution protects commercial speech from government interference. Commercial speech has been defined by the US Supreme Court as speech that proposes a commercial transaction, such as marketing and labeling. Companies that produce products associated with public health harms, such as alcohol, tobacco, and food, thus have a constitutional right to market these products to consumers. This article will examine the evolution of US law related to the protection of commercial speech, often at the expense (...) of public health. It will then identify outstanding questions related to the commercial speech doctrine and the few remaining avenues available in the United States to regulate commercial speech including the use of government speech and addressing deceptive and misleading commercial speech. Obesity is a public health problem in the United States. Experts have identified the regulation of food marketing as a policy strategy to address obesity and poor nutrition. However, the First Amendment can be a barrier to reducing exposure to problematic food marketing. In recent years, courts have become increasingly protective of speech, and particularly of “commercial speech,” or advertising, which can make it more difficult to regulate certain marketing practices.

This paper examines the scholarship, evidence, and assumptions that place the origins of Chinese drama in shamanic ritual. The paper is roughly divided in two parts: the first contextualizes the use of shamanism within the theories of art and literature of one of the first scholars to link the origins of Chinese theatre to shamanism, Wang Guowei, to show that Wang’s view of the relationship between shamanism and drama differs from mainstream interpretations. The second part assesses the views of modern (...) ethnographers and historians of China on the role of shamanism in theater, with a focus on the work of the scholar Piet van der Loon. (shrink)

Mental capacities, philosophers of mind and cognition have recently argued, are not exclusively realised in brain, but depend upon the rest of the body and the local environment. In this context, the concept of ‘scaffolding’ has been employed to specify the relationship between embodied organisms and their local environment. The core idea is that at least some cognitive and affective capacities are causally dependent upon environmental resources. However, in-depth examinations of specific examples of scaffolding as test cases for current theorising (...) about scaffolding have remained scarce. The aim of the current paper is to help close this gap. To this end, I will offer a characterisation of key aspects of ‘scaffolding’ that can help specify scaffolding relations. In a second step, I will analyse fictional textual narrative as a test case for accounts of cognitive and affective scaffolding. The key claim of this paper will be that fictional textual narrative can be considered as a scaffold that transforms our capacities in social understanding and empathising in the course of ontogeny. According to Thomas Metzinger, many human cognitive processes in the waking state are spontaneous and are deprived of the experience of epistemic agency. He considers mind wandering as a paradigm example of our recurring loss of epistemic agency. I will enrich this view by extending the scope of the concept of epistemic agency to include cases of depressive rumination and creative cognition, which are additional types of spontaneous cognition. Like mind wandering, they are characterized by unique phenomenal and functional properties (...) that give rise to varying degrees of epistemic agency. The main claim of this paper will be that the experience of being an epistemic agent within a certain time frame is a relational phenomenon that emerges from the organism’s capacity to interact with its cognitive niche. To explore this relation, I develop a new framework that integrates phenomenological considerations on epistemic agency with a functional account of the reciprocal coupling of the embodied organism with its cognitive niche. This account rests upon dynamical accounts of strong embodied and embedded cognition and recent work on cognitive niche construction. Importantly, epistemic agency and organism-niche coupling are gradual phenomena ranging from weak to strong realizations. The emerging framework will be employed to analyze mind wandering, depressive rumination, and creative cognition as well as their commonalities and differences. Mind wandering and depressive rumination are cases of weak epistemic agency and organism-niche coupling. However, there are also important phenomenological, functional, and neuronal differences. In contrast, creative cognition is a case of strong epistemic agency and organism-niche coupling. By providing a phenomenological and functional analysis of these distinct types of spontaneous cognition, we can gain a better understanding of the importance of organism-niche interaction for the realization of epistemic agency. Theory suggests that stimulus evaluations automatically evoke approach–avoidance behavior. However, the extent to which approach–avoidance behavior is triggered automatically is not yet clear. Furthermore, the nature of automatically triggered approach–avoidance behavior is controversial. We review research on two views on the type of approach–avoidance behavior that is triggered automatically (arm flexion/extension, distance change). Present evidence supports the distance-change view and corroborates the notion of an automatic pathway from evaluation to distance-change behavior. We discuss underlying mechanisms (direct stimulus–response links, outcome anticipations, (...) goals) as well as implications regarding the flexibility of the evaluation–behavior link. (shrink)

Deepfakes are algorithmically modified video and audio recordings that project one person’s appearance on to that of another, creating an apparent recording of an event that never took place. Many scholars and journalists have begun attending to the political risks of deepfake deception. Here we investigate other ways in which deepfakes have the potential to cause deeper harms than have been appreciated. First, we consider a form of objectification that occurs in deepfaked ‘frankenporn’ that digitally fuses the parts of different (...) women to create pliable characters incapable of giving consent to their depiction. Next, we develop the idea of ‘illocutionary wronging’, in which an individual is forced to engage in speech acts they would prefer to avoid in order to deny or correct the misleading evidence of a publicized deepfake. Finally, we consider the risk that deepfakes may facilitate campaigns of ‘panoptic gaslighting’, where many systematically altered recordings of a single person's life undermine their memory, eroding their sense of self and ability to engage with others. Taken together, these harms illustrate the roles that social epistemology and technological vulnerabilities play in human ethical life. (shrink)

We ought to treat others’ moral views with respect, even when we disagree. But what does that mean? This paper articulates a moral obligation to make ourselves open to sincere moral persuasion by others. Doing so allows us to participate in valuable relationships of reciprocal respect for agency. Yet this proposal can sound tritely agreeable. To explore its full implications, the paper applies the general obligation to one of the most challenging topics of moral disagreement: the morality of abortion. I (...) consider and reject arguments that abortion decisions have special features exempting them from the obligation to be open to moral persuasion. Further, I argue that viewing fetal ultrasound images can accomplish morally persuasion. Accordingly, in at least some cases a woman seeking abortion has an obligation to view fetal ultrasound images as a means of being open to moral persuasion. However, this conclusion does not support recent laws compelling women seeking abortion to view ultrasound images; such laws are in fact incompatible with the respect for agency that underwrites the obligation to be open to persuasion. Many of our cognitive capacities are shaped by enculturation. Enculturation is the acquisition of cognitive practices such as symbol-based mathematical practices, reading, and writing during ontogeny. Enculturation is associated with significant changes to the organization and connectivity of the brain and to the functional profiles of embodied actions and motor programs. Furthermore, it relies on scaffolded cultural learning in the cognitive niche. The purpose of this paper is to explore the components of symbol-based mathematical practices. Phylogenetically, these practices are the (...) result of concerted organism-niche interactions that have led from approximate number estimations to the emergence of discrete, symbol-based mathematical operations. Ontogenetically, symbol-based mathematical practices are associated with plastic changes to neural circuitry, action schemata, and motor programs. It will be suggested that these practices rely on previously acquired capacities such as subitizing and counting. With these considerations in place, I will argue that computations, understood in the sense of Turing (1936), are a specific kind of symbol-based mathematical practices that can be realized by human organisms, machines, or by hybrid organism-machine systems. In sum, this paper suggests a new way to think about mathematical cognition and computation. (shrink)

You couldn’t know them, because these claims are false.1 But many American voters believed them.One of the most distinctive features of the 2016 campaign was the rise of “fake news,” factually false claims circulated on social media, usually via channels of partisan camaraderie. Deepfake technology uses machine learning to fabricate video and audio recordings that represent people doing and saying things they've never done. In coming years, malicious actors will likely use this technology in attempts to manipulate public discourse. This paper prepares for that danger by explicating the unappreciated way in which recordings have so far provided an epistemic backstop to our testimonial practices. Our reasonable trust in the testimony of others depends, to a surprising extent, on the regulative effects of the (...) ever-present possibility of recordings of the events they testify about. As deepfakes erode the epistemic value of recordings, we may then face an even more consequential challenge to the reliability of our testimonial practices themselves. (shrink)

The debate between proponents and opponents of a role for empirical psychology in ethical theory seems to be deadlocked. This paper aims to clarify the terms of that debate, and to defend a principled middle position. I argue against extreme views, which see empirical psychology either as irrelevant to, or as wholly displacing, reflective moral inquiry. Instead, I argue that moral theorists of all stripes are committed to a certain conception of moral thought—as aimed at abstracting away from individual inclinations (...) and toward interpersonal norms—and that this conception tells against both extremes. Since we cannot always know introspectively whether our particular moral judgments achieve this interpersonal standard, we must seek the sort of self-knowledge offered by empirical psychology. Yet reflective assessment of this new information remains a matter of substantive normative theorizing, rather than an immediate consequence of empirical findings themselves. (shrink)

Since at least 2016, many have worried that social media enables authoritarians to meddle in democratic politics. The concern is that trolls and bots amplify deceptive content. In this chapter I argue that these tactics have a more insidious anti-democratic purpose. Lies implanted in democratic discourse by authoritarians are often intended to be caught. Their primary goal is not to successfully deceive, but rather to undermine the democratic value of testimony. In well-functioning democracies, our mutual reliance on testimony also generates (...) a distinctively democratic value: decentralized testimonial networks evade control by the state or powerful actors. The deliberate exposure of deception in democratic testimonial networks undermines this value by implicating citizens in their own epistemic corruption, weakening the resilience of democratic society against authoritarian pressure. In this chapter I illustrate that danger through a close reading of recent Russian social media interference operations, showing both their epistemic underpinnings and their ongoing political threat. Learning the psychological origins of our moral judgments can lead us to lose confidence in them. In this paper I explain why. I consider two explanations drawn from existing literature—regarding epistemic unreliability and automaticity—and argue that neither is fully adequate. I then propose a new explanation, according to which psychological research reveals the extent to which we are disturbingly disunified as moral agents.

_Relevance_. Organizations' social responsibility in the market is manifested through the quality of the services they provide, consumer information, care for their health, safety and the integration of environmental requirements into the activities of the organizations. Employees are one of the key stakeholders, and their approach is one way of exposing the organization's CSR issues. From the point of view of organizations' economic responsibility, it is important to strive for competitiveness of goods and services, efficient management and economical use of (...) resources (Carden and Boyd, 2011, etc.). Ethical social sphere emphasizes honest cooperation with stakeholders, taking into account public expectations and customer information. Pedersen (2010), Homburg et al. (2013), Segal (2011) discuss topical issues of social responsibility that define an organization's relationship with its stakeholders in pursuit of organizational customer loyalty and trust and socio-economic justice in the community. In the field of environment protection, the integration of environmental protection legislation into the activities of the company, reduction of pollution, improvement of operational activities, continuous monitoring, anticipation and implementation of necessary changes is important (Delmas et al. 2013, Claydon (2009), Valdes-Vasquez (2011), Fleming (2017), Allen (2016), Shin (2015), etc. A survey of CSR in the market was conducted in small and medium-sized enterprises. 175 respondents participated in the research. _R__esearch aim_. Assess the social responsibility of organizations towards consumers, the environment and the community in terms of employees. _Research methods_. Analysis of scientific literature, questionnaire survey. _Research results and conclusions_. Responsibility in the market for the quality of services provided was assessed on the basis of the following statements: at my workplace there is paid great attention to quality of service (production), effort is made to deliver on our promises to our customers, quality of services declared within the organization does not differ from reality, product quality control system exists in the workplace, consumer complaints are being investigated and the findings improve quality, and not only the legislation is used in customer relations, but generally accepted morals are rated only moderately. Responsibility in the market according to consumer information, caring about their health and safety has been assessed by employees to what extent these statements correspond to the reality: organizations provide detailed product information; I enjoy the services and products of my organization; my organization is concerned with the health of consumers when providing services, products; there has been no evidence that the services (products) provided by my workplace have been detrimental to the welfare of consumers and my organization does not manipulate consumer confidence. From the employees' point of view, the investigated organizations have a higher than average level of responsibility. The lack of responsibility is reflected in the fact that employees disagree that organizations do not manipulate consumer confidence. Promoting environmental protection is important in terms of market responsibility. Responsibility in the market is defined by these statements: the organization uses technologies that comply with organic standards; organizes environmental initiatives; uses only tools and technologies that reduce the negative impact on the environment; the organization takes care of the ecologic education of its employees, the organization takes care of all waste to be recycled, the waste is sorted, and green ideas are encouraged financially in the workplace. Having assessed the respondents' attitudes towards meeting environmental requirements, it could be indicated that the surveyed organizations have a medium level of responsibility, while employees indicate that organizations do not financially promote green ideas or contribute to the organization of environmental initiatives. Based on the results obtained there was ascertained higher than average level of social responsibility of organizations in the market, therefore, in the case under review, the activities of organizations in the context of applying social responsibility principles should be improved according to all categories defining social responsibility in the market. __. High levels of social cohesion have been shown to be beneficial both for social entities and for their residents. It is therefore not surprising that scholars from several disciplines investigate which factors contribute to or hamper social cohesion at various societal levels. In recent years, the question of how individuals deal with the increasing diversity of their neighborhoods and society as a whole has become of particular interest when examining cohesion. The present study takes this a step further by combining (...) sociological and psychological approaches in investigating whether the group-level acceptance of diversity, a core feature of cohesive societies, is related to prevailing mentalities of individuals once the social structure of a community is accounted for. We hypothesize that after controlling for individual sociodemographic and for structural variables, three individual characteristics play an important role for the level of acceptance of diversity in a given entity. We propose that individual intergroup anxiety acts as a motor of the rejection of diversity whereas individual empathy should act as a safeguard. Furthermore, we propose that right-leaning political orientation has a negative influence on the acceptance of diversity. This study is based on a large, representative sample of the German general population. To draw comparisons among different social entities, the sample was divided by federal states. Data were analyzed by using a two-step approach for analyzing group-level outcomes in multilevel models. The analyses confirmed our hypothesis that intergroup anxiety at the individual level hampers the acceptance of diversity in a given sociopolitical entity. Furthermore, we found that intergroup anxiety is impacted by the economic situation in a federal state, as economic weakness intensified the fear of others. Surprisingly, neither empathy nor political orientation played a role for the acceptance of diversity. Implications for future research on social cohesion as well as for the work of policy makers are discussed. (shrink)

Generative AI systems like ChatGPT and Midjourney can produce prose or images. But can they produce art? I argue that this question, though natural and intriguing, is the wrong one to ask. A better question is this: can generative AI yield distinct or novel forms of aesthetic value? And I argue that the answer is yes. Generative AI can be used to put us in contact with the artificial sublime – a type of aesthetic value that Kant famously argues is (...) impossible. Kant claims that sublimity (a fusion of trepidation and wonderment) can only arise from encounters with nature, or perhaps close artistic depiction of natural scenes. I show how generative AI can yield encounters both with incalculable profundity (Kant’s mathematical sublime) as well as overwhelming moral chaos (Kant’s dynamical sublime). There are lessons not only for art criticism, but also for the philosophical theory of value. (shrink)

This short piece draws on political philosophy to show how social media interference operations can be used by hostile states to weaken the apparent legitimacy of democratic governments. Democratic societies are particularly vulnerable to this form of attack because democratic governments depend for their legitimacy on citizens' trust in one another. But when citizen see one another as complicit in the distribution of deceptive content, they lose confidence in the epistemic preconditions for democracy. It is a philosophical truism that we must think of others as moral agents, not merely as causal or statistical objects. But why? I argue that this follows from the best resolution of an antinomy between our experience of morality as necessarily binding on the will and our knowledge that all moral beliefs originate in contingent histories. We can address this antinomy only by understanding moral deliberation via interpersonal relationships, which simultaneously vindicate and constrains morality’s bind on the will. This (...) means that moral agency is fundamentally social. I model an attitude toward our causal nature on sociologist Erving Goffman’s concept of ‘civil inattention’; our social practice of agency requires that we give minimal attention to the contingent origins of moral judgments in ourselves and others. Understood this way, seeing ourselves as moral agents requires avoiding appeal to causal aetiology to settle substantive moral disagreement. (shrink)

O presente artigo se propõe a questionar o estatuto da filosofia ocidental a partir da percepção de que a filosofia africana foi vilipendiada pelo eurocentrismo e ressaltar nessa relação filosófica, o conceito do Ubuntu, considerado um dos termos fundadores da ética africana, representando uma práxis sócio-cultural, espiritual e política, sendo, portanto, um termo utilizado para conceituar a filosofia que permeia a convivência social coletiva. Enquanto uma ética comunitária, o Ubuntu assinala para o caráter complexo de uma filosofia relacionada à humanidade, (...) conectando de forma biocêntrica, humanos e não-humanos, sensível e o inteligível concomitantemente, fato este que se choca com o conceito elegido pelo pensamento filosófico eurocêntrico. Para alcançar o objetivo pretendido será utilizado o método filosófico para revisar conceitos e a própria historia da filosofia no ocidente, através de pesquisa exploratória com fulcro bibliográfico e uma abordagem que parte da especulação filosófica e histórica, utilizando os principais nomes da filosofia africana e da história da filosofia no ocidente. There are two problems with the logic of Cesario's argument for abandoning existing research on social bias. First, laboratory findings of decisional bias have social significance even if Cesario is right that the research strips away real-world context. Second, the argument makes overly skeptical demands of a research program seeking complex causal linkages between micro- and macro-scale phenomena.

The article discusses the possible consequences that can be faced by a Member State of the European Union if its national court does not comply with the obligation to make a reference for a preliminary ruling to the Court of Justice. The TFEU does not specify any sanctions applicable to a state when its national court disregards its obligation under Article 267 TFEU. Therefore, the analysis focuses on the practice of the Court of Justice and its interpretation by scholars. At (...) the outset, the author analyses whether refraining from making a reference for a preliminary ruling can lead to the duty to pay damages to an individual. Taking into account the criteria of a sufficiently serious breach formulated in the Köbler case, the author comes to the conclusion that the infringement of the obligation to make a reference for a preliminary ruling is one of the most important criteria in assessing whether a Member State has to pay damages for any loss suffered by an individual, but the infringement itself is not sufficient to make a state liable. A popular argument form uses general theories of cognitive architecture to motivate conclusions about the nature of moral cognition. This paper highlights the possibility for modus tollens reversal of this argument form. If theories of cognitive architecture generate predictions for moral cognition, then tests of moral thinking provide feedback to cognitive science. In certain circumstances, philosophers' introspective attention to their own moral deliberations can provide unique data for these tests. Recognizing the possibility for this sort of feedback helps to illuminate (...) a deep continuity between the disciplines. (shrink)

Recent work on enculturation suggests that our cognitive capacities are significantly transformed in the course of the scaffolded acquisition of cognitive practices such as reading and writing. Phylogenetically, enculturation is the result of the co-evolution of human organisms and their socio-culturally structured cognitive niche. It is rendered possible by evolved cerebral and extra-cerebral bodily learning mechanisms that make human organisms apt to acquire culturally inherited cognitive practices. In addition, cultural learning allows for the intergenerational transmission of relevant knowledge and skills. (...) Ontogenetically, enculturation is associated with neural plasticity and the development of new motor routines and action schemas. It relies on scaffolded learning that structures novice-teacher interactions. The acquisition of reading and writing are paradigm examples of enculturation. Based on an empirically informed analysis of the components of enculturation, I will apply the emerging account of enculturated cognition to narrative practices. To date, research on the impact of narratives on the constitution of the self and our understanding of folk psychology has not paid much attention to the question how narratives are influenced by cumulative cultural evolution and our capacity to acquire reading and writing during ontogeny. I will argue that textual narratives, above and beyond oral narratives, provide genuinely new ways of narration. Therefore, the enculturated interaction with textual narratives has the potential to contribute to a better understanding of ourselves and other cognitive agents. (shrink)

Recent empirical work appears to suggest that the moral intuitions of professional philosophers are just as vulnerable to distorting psychological factors as are those of ordinary people. This paper assesses these recent tests of the ‘expertise defense’ of philosophical intuition. I argue that the use of familiar cases and principles constitutes a methodological problem. Since these items are familiar to philosophers, but not ordinary people, the two subject groups do not confront identical cognitive tasks. We report the results of one visual‐world eye‐tracking experiment and two referent selection tasks in which we investigated the effects of information structure in the form of prosody and word order manipulation on the processing of subject pronouns er and der in German. Factors such as subjecthood, focus, and topicality, as well as order of mention have been linked to an increased probability of certain referents being selected as the pronoun's antecedent and described as increasing this referent's prominence, salience, or (...) accessibility. The goal of this study was to find out whether pronoun processing is primarily guided by linguistic factors (e.g., grammatical role) or nonlinguistic factors (e.g., first‐mention), and whether pronoun interpretation can be described in terms of referents' “prominence” / “accessibility” / “salience.” The results showed an overall subject preference for er, whereas der was affected by the object role and focus marking. While focus increases the attentional load and enhances memory representation for the focused referent making the focused referent more available, ultimately it did not affect the final interpretation of er, suggesting that “prominence” or the related concepts do not explain referent selection preferences. Overall, the results suggest a primacy of linguistic factors in determining pronoun resolution. (shrink)
