This article focuses on Court of Appeal sentencing practice in cases of marital and relationship rape. In particular, it examines the sentencing principle set out in the case of Berry in which it was stated that cases of marital and relationship rape sometimes involve less 'violation' and 'defilement' than cases of stranger rape and consequently are given reduced sentences. This article argues against such an approach on the basis that it is poorly reasoned and lacks support from the research literature (...) on rape trauma. In addition, a statistical analysis of Court of Appeal sentencing appeals indicates that the Berry principle is seriously undermining the Billam sentencing guidelines for rape. An analysis of appellate decisions in the USA indicates a very different attitude to the seriousness of marital and relationship rape based upon a willingness of the appellate judges to utilize research evidence in their decisions. In contrast to embryo donation, the permissibility of 2PN cell donation is highly controversial in Germany. This article is based on there being a legal loophole with respect to 2PN cell donation, which results from an inconsistency within the Embryo Protection Act on the normative status of 2PN cells. Following that thesis, the article argues that, on the basis of the normative criterion totipotency (i.e. the capacity to develop into a born human being), 2PN cells should also be considered human (...) embryos within the meaning of the Act and thereby be protected by that Act in the same way as embryos. However, the normative assumption that 2PN cells should already be endowed with human dignity and the right to life has absurd consequences. Moreover, the consistent continuation of the Embryo Protection Act, as well as of the underlying ethical position or argumentation (i.e. the potentiality argument), leads to the even more absurd consequence of having to place every human somatic cell under the protection of human dignity and the right to life. As totipotency or the developmental potential therefore cannot delimit entities considered worthy of protection (i.e. human embryos) from entities considered not worthy of protection (i.e. 2PN cells, gametes, hESC, hiPSC and human somatic cells), it is not a suitable normative criterion. As a paradigmatic case, 2PN cell donation demonstrates that by retaining this normative criterion the now obsolete German Embryo Protection (Act) ultimately undermines itself. (shrink)

In the static field configuration, a spatially-Variable Speed of Light (VSL) scalar gravity model with Lorentz-Poincaré interpretation was shown to reproduce the phenomenology implied by the Schwarzschild metric. In the present development, we effectively cover configurations with source kinematics due to an induced sweep velocity field w. The scalar-vector model now provides a Hamiltonian description for particles and photons in full accordance with the first Post-Newtonian (1-PN) approximation of General Relativity Theory (GRT). This result requires the validity of Poincaré’s Principle (...) of Relativity, i.e. the unobservability of ‘preferred’ frame movement. Poincaré’s principle fixes the amplitude of the sweep velocity field of the moving source, or equivalently the ‘vector potential’ ξ of GRT (e.g.; S. Weinberg, Gravitation and cosmology, [1972]), and provides the correct 1-PN limit of GRT. The implementation of this principle requires acceleration transformations derived from gravitationally modified Lorentz transformations. A comparison with the acceleration transformation in GRT is done. The present scope of the model is limited to weak-field gravitation without retardation and with gravitating test particles. In conclusion the model’s merits in terms of a simpler space, time and gravitation ontology—in terms of a Lorentz-Poincaré-type interpretation—are explained (e.g. for ‘frame dragging’, ‘harmonic coordinate condition’). Originally published in 1985, this distinguished and constructive critique of modern culture introduced into our language a brand-new term, ‘PN’, standing for ‘psychic nutrition’, which at the time promised to become a household expression. Drawing on his first-hand knowledge of oriental civilizations; on discoveries of Jung, especially his concept of psychic energy; on the ideas of the cultural anthropologists; and not least on the New Science implicit in microphysics and microbiology, E.W.F. Tomlin, whose philosophical books have been translated into several (...) languages, shows how the human psyche requires its own kind of nourishment just as urgently as the body needs food. In the industrial societies of the West, this need has often been ignored. Reformers, in their earnest though sometimes inept endeavours to create a better world, have too often exposed us to the dangers of psychic starvation and the noxious effects of what may be called ‘neg-PN’. Here lie the roots of violence and the lack of direction so conspicuously afflicting modern man and woman. Examples of PN, positive and negative, are given, lending the book an immediacy and practical character often lacking in studies of this kind. In the new scientific approach here adopted, the divisions between matter and life, and life and mind, are discarded, and the old conflict between science and religion shown to belong to an out-of-date world view. The result is a radical reappraisal of the nature and function of religion and art, the two great psychic forces in history. Indeed, the present crisis is shown to originate in the psychic sphere rather than in the political and economic order. Deeply felt and elegantly written, yet not lacking in wit and humour, the book ends with some concrete ideas on how a more balanced culture may be achieved. (shrink)

Idea que Comte extrapoló para justificar un progreso social atado a la aparición de las ciencias positivas. Este trabajo también evalúa la crítica de Comte a Lamarck acerca del papel del medioambiente, cuyo potencial de cambio estaría limitado por “la existencia de “obstáculos interiores” a la modificación, superados en los humanos mediante la emergencia de la sociedad. Ambos autores estuvieron influenciados por François Quesnay, quien propugnaba una sociedad regida por una ética basada en una ley natural biológica. Pero, mientras Lamarck anticipaba el riesgo de la autoextinción humana, Comte consideraba que el verdadero progreso se lograría al convertir esa ley natural en fundamento de una nueva religión secular. Personalised nutrition (PN) has emerged over the past twenty years as a promising area of research in the postgenomic era and has been popularized as the new big thing out of molecular biology. Advocates of PN claim that previous approaches to nutrition sought general and universal guidance that applied to all people. In contrast, they contend that PN operates with the principle that “one size does not fit all” when it comes to dietary guidance. While the molecular mechanisms studied within (...) PN are new, the notion of a personal dietary regime guided by medical advice has a much longer history that can be traced back to Galen’s “On Food and Diet” or Ibn Sina’s (westernized as Avicenna) “Canon of Medicine”. Yet this history is either wholly ignored or misleadingly appropriated by PN proponents. This (mis)use of history, we argue helps to sustain the hype of the novelty of the proposed field and potential commodification of molecular advice that undermines longer histories of food management in premodern and non-Western cultures. Moreover, it elides how the longer history of nutritional advice always happened in a heavily moralized, gendered, and racialized context deeply entwined with collective technologies of power, not just individual advice. This article aims at offering a wider appreciation of this longer history to nuance the hype and exceptionalism surrounding contemporary claims. (shrink)

A number of prominent metaphysicians have recently defended a set of ideas which I will call ‘essentialist plenitude.’ Very roughly, and to a first approximation, essentialist plenitude says that wherever there is an object with properties P1, …, Pn there is in fact a plenitude of coincident objects that differ only in the distribution of essentiality and accidentality across P1, …, Pn (§1). The main purpose of this paper is to arouse the suspicion that essentialist plenitude may have far-reaching consequences (...) for the semantics of proper names. More specifically, I will argue that neither descriptivist nor causal theories of proper names work in a plenitude setting (§2). I will close by suggesting that our use of proper names may be thoroughly infected by semantic indecision about which among many coincident objects is referred to (§3). (shrink)

Post-normal science is presented by its proponents as a new way of doing science that deals with uncertainties, value diversity or antagonism, and high decision stakes and urgency, with the ultimate goal of remedying the pathologies of the global industrial system for which, according to Funtowicz and Ravetz, existing science forms the basis. The authors critically examine whether PNS can fulfill this claim in the light of empirical and theoretical work on politics and policy making. The authors credit PNS as (...) an innovative frontrunner in raising important issues regarding the limited problem-solving capacity of ‘‘normal science’’ and ‘‘professional consultancy.’’ Yet, the authors notice that PNS lacks important considerations about the governance of problems and aspects of participatory and deliberative democracy. PNS in effect implies that methodological ‘‘ratiocination’’ would prevail over political deliberation and democratic interaction and that merely changing scientific input in public policy making would have the power to change its outcomes. This scientistic hubris can be traced back to PNS’s origin in concerned scientists’ activism, which in effect accessed the political arena through the scientific entrance. The authors conclude that the art of politics needs to come back into the discussion on environmental problems if societal change is to occur. (shrink)

This is a tense logic in which the past and future operators P and F have an index representing a temporal distance, so that Pnα means that α was true n -much ago, and Fn α means that α will be true n -much hence. ‘‘Post-normal science’’ has received much attention in recent years, but like many iconic concepts, it has attracted differing conceptualizations, applications, and implications, ranging from being a ‘‘cure-all’’ for democratic deficit to the key to achieving more sustainable futures. This editorial article introduces a Special Issue that takes stock of research on PNS and critically explores how such research may develop. Through reviewing the history and evolution of PNS, the authors seek to clarify the extant definitions, conceptualizations, and uses of PNS. (...) The authors identify five broad areas of research on, or using, PNS which have developed over four decades. Their analysis suggests that the 1990s represent a symbolic watershed in the use of PNS terminology, when the concept was further developed and applied to highly complicated issues such as climate change. The authors particularly distinguish between uses of PNS as a normative prescription and as a practical method. Through this classification, they set out gaps and research questions arising. They then briefly summarize the Special Issue articles and consider their relationship to each other and the research questions raised by their analysis. They conclude by considering what the articles in this issue suggest for future theory building in PNS and related scholarship. (shrink)

I present a cumulative case for the thesis that we only know propositions that are certain for us. I argue that this thesis can easily explain the truth of eight plausible claims about knowledge: -/- (1) There is a qualitative difference between knowledge and non-knowledge. (2) Knowledge is valuable in a way that non-knowledge is not. (3) Subjects in Gettier cases do not have knowledge. (4) If S knows that P, P is part of S’s evidence. (5) If S knows (...) that P, ~P is epistemically impossible for S. (6) If S knows that P, S can rationally act as if P. (7) If S knows that P, S can rationally stop inquiring whether P. (8) If S knows each of {P1, P2, … Pn}, and competently deduces Q from these propositions, S knows that Q. -/- I then argue that the skeptical costs of this thesis are outweighed by its explanatory power. In the early seventies, several logicians developed a semantics for propositional systems of relevance logic. The essential ingredients of this semantics were a privileged point o, an ‘accessibility’ relation R and a special operator * for evaluating negation. Under the truth- conditions of the semantics, each formula A(Pl,…,Pn) could be seen as expressing a first order condition A+(pl,…,pn, o, R,*) on sets p1,…,pn and o, R, *, while each formula-scheme could be regarded as expressing the second-order condition ∀p1,…,∀pn A+(p1,…,pn, o, (...) R, *). It could then be shown that many standard systems of propositional relevance logic were complete in the sense that their theorems were just those formulas true in all models whose components o, R and * conformed to the second-order conditions expressed by the axioms of the system. What is the relation between entailment and reasons for belief? In this paper, I discuss several answers to this question, and I argue that these answers all face problems. I then propose the following answer: for all propositions p1,...,pn and q, if the conjunction of p1,..., and pn entails q, then there is a reason against a person's both believing that p1,..., and that pn and believing the negation of q. I argue that this answer avoids the problems that the (...) other answers to this question face, and that it does not face any other problems either. I end by showing what the relation between deductive logic, reasons for belief and reasoning is if this answer is correct. (shrink)

About a decade ago, the Netherlands Environmental Assessment Agency unwittingly embarked on a transition from a technocratic model of science advising to the paradigm of ‘‘post-normal science’’. In response to a scandal around uncertainty management in 1999, a Guidance for ‘‘Uncertainty Assessment and Communication’’ was developed with advice from the initiators of the PNS concept and was introduced in 2003. This was followed in 2007 by a ‘‘Stakeholder Participation’’ Guidance. In this article, the authors provide a combined insider/outsider perspective on (...) the transition process. The authors assess the extent to which the PNS paradigm has delivered new approaches in the agency’s practice and analyze two projects—on long-term options for Dutch sustainable development policy and for urban development policy—the latter in somewhat more detail. The authors identify several paradoxes PBL encounters when putting the PNS concept into practice. It is concluded that an openness to other styles of work than the technocratic model has become visible, but that the introduction of the PNS paradigm is still in its early stage. (shrink)

We attempt a conclusive resolution of the debate over whether the principle of natural selection (PNS), especially conceived as the `principle' of the `survival of the fittest', is a tautology. This debate has been largely ignored for the past 15 years but not, we think, because it has actually been settled. We begin by describing the tautology objection, and situating the problem in the philosophical and biology literature. We then demonstrate the inadequacy of six prima facie plausible reasons for believing (...) that the tautology debate has been satisfactorily resolved (the PNS is strictly a methodological principle; scientific theories can contain tautologies; the scope of the PNS has been reduced; theories should be understood as models and not exceptionless laws; the widespread acceptance of the propensity interpretation of fitness; and the abandonment of operationalism and verificationism). We proceed to a detailed discussion of Brandon's law (D) describing the PNS, and show that law (D) seriously misrepresents the structure of evolution by natural selection. In the final sections, we provide and defend a novel reinterpretation of the structure of the principle (or, we prefer, model) of evolution by natural selection. (shrink)

The characteristic sequence of hypergraphs Pn:n<ω associated to a formula φ, introduced in Malliaris [5], is defined by Pn=i≤nφ. We continue the study of characteristic sequences, showing that graph-theoretic techniques, notably Szemerédi’s celebrated regularity lemma, can be naturally applied to the study of model-theoretic complexity via the characteristic sequence. Specifically, we relate classification-theoretic properties of φ and of the Pn to density between components in Szemerédi-regular decompositions of graphs in the characteristic sequence. In addition, we use Szemerédi regularity to calibrate (...) model-theoretic notions of independence by describing the depth of independence of a constellation of sets and showing that certain failures of depth imply Shelah’s strong order property SOP3; this sheds light on the interplay of independence and order in unstable theories. The 20th century eugenics movement in the USA and contemporary practices involving prenatal screening (PNS), prenatal diagnosis (PND), abortion and preimplantation genetic diagnosis (PGD) share important morally relevant similarities. I summarise some features of the 20th century eugenics movement; describe the contemporary standard of care in the USA regarding PNS, PND, abortion and PGD; and demonstrate that the ‘old eugenics’ the contemporary standard of care share the underlying view that social resources should be invested to prevent the birth of people (...) with certain characteristics. This comparison makes evident the difficulty of crafting moral arguments that treat some uses of PNS, PND, abortion and PGD as licit and others as illicit. (shrink)

In 1958 Gödel published his Dialectica interpretation, which reduces classical arithmetic to a quantifier-free theory T axiomatizing the primitive recursive functionals of finite type. Here we extend Gödel's T to theories Pn of “predicative” functionals, which are defined using Martin-Löf's universes of transfinite types. We then extend Gödel's interpretation to the theories of arithmetic inductive definitions IDn, so that each IDn is interpreted in the corresponding Pn. A well-known theory about under which circumstances a statement is true in a fiction is The Reality Principle, which originate in the work of David Lewis: (RP) Where p1... pn are the primary fictional truths of a fiction F , it is true in F that q iff the following holds: were p1 ... pn the case, q would have been the case (Walton 1990: 44). RP has been subjected to a number of counterexamples, up to a point where, in (...) the words of Stacie Friend “it is widely recognized that the Reality Principle […] cannot be a universal inference rule for implied story-truths” (Friend 2017: 33). This chapter argues that the strength of these counterexamples is widely overestimated, and that they do not, on closer scrutiny, constitute reasons for rejecting RP. (shrink)

Post-Normal Science as a theory links epistemology and governance. It not only focuses on problem situations where facts are uncertain, values in dispute, stakes high and decisions urgent, but also tries to develop epistemic approaches that allow for sound scientific answers. The following article addresses major epistemological challenges within a typical ‘‘wicked-problem situation’’, i.e., risk assessment of emerging technologies. Such challenges include epistemological problems intrinsic to the task of proving the absence of risk, problems related to the multi-sited production of (...) evidence and the multitude of epistemic cultures involved, the incompatibility of the various implicit objectives and the complex actor-constellations, that shape not only the way scientific knowledge is translated into action, but also which kind of knowledge is produced and which experts are listened to. To illustrate and discuss these characteristics, the article draws on an empirical study of risk research in the fields of agri-biotechnology and telecommunication technology in Germany. It concludes that although some aspects of PNS are already part of current epistemic practices in these fields, a state of ‘‘functional post-normality’’ depends upon a meaningful co-evolution between post-normal science and post-normal governance that has not yet been achieved. Philosophers of mind, both in the conceptual analysis tradition and in the empirical informed school, have been implicitly neglecting the potential conceptual role of the Peripheral Nervous System (PNS) in understanding sensory and perceptual states. Instead, the philosophical as well as the neuroscientific literature has been assuming that it is the Central Nervous System (CNS) alone, and more exactly the brain, that should prima facie be taken as conceptually and empirically crucial for a philosophical analysis of such states This is (...) the first monograph that focuses on the PNS and its constitutive role in sensory states, including pain, mechanoception, proprioception, tactile perception, and so forth. -/- The author argues that the brain-centeredness of current philosophy of mind is a prejudice, and proposes a series of original ways in which classic puzzles in the philosophy of mind can be solved once the hypothesis that PNS is a constitutive element of mental states is taken seriously. The author calls this “the Peripheral Mind Hypothesis”, and employs it in a vast range of issues, such as functionalism, physicalism, mental content, embodiment, as well as some issues in neuroethics. -/- Making equal use of conceptual analysis, empirical data from neuroscience, first-person phenomenological data, and philosophical speculation, this work offers a fresh look at, and novel solutions to many philosophical problems. Test anxiety is a widespread and primarily detrimental emotion in learning and achievement settings. This research aimed to explore the autonomic nervous system response patterns of test-anxious individuals in response to evaluative stress. By presenting a standard interview task, an evaluative scenario was effectively induced. Heart rate variability, a biomarker that can accurately reflect the ANS activity, was used to reflect the physiological responses of 48 high test-anxious subjects and 49 low test-anxious subjects. Results indicate that: both groups show a (...) significantly increased emotional arousal in the evaluative scenario; high test-anxious individuals show a significantly decreased emotional pleasantness in the evaluative scenario, whereas low test-anxious individuals show no significant changes; both groups show a significantly increased low-frequency HRV; high test-anxious individuals show a significantly decreased high-frequency HRV and root mean square of successive heartbeat interval differences, whereas low test-anxious individuals remain stable. These findings suggest that high test-anxious individuals display an increased sympathetic nervous system activity and a decreased parasympathetic nervous system activity in response to evaluative stress, while low-anxious individuals display an increased SNS activity and a stable PNS activity in response to evaluative stress. A consistent claim from governments around the world during the Coronavirus pandemic has been that they were following the science. This raises the question, central to this paper, of what and whose knowledge is or should be sought, which is being side-lined through the choice of particular framings and discourses, and with what consequences for the creation and implementation of evidence-based policy to tackle wicked problems. Through the lens of Fricker’s epistemic injustice, I problematise the expertise that has guided the (...) COVID-19 response as epistemically narrow and argue that counteracting a monolithic culture of expertise requires tackling the structural inequalities in the systems of knowledge production to diversify the social and epistemological foundations of science. Drawing on Post-normal Science (PNS) theory, I suggest that the expertise needed to respond to the challenges of a post-COVID world is one that embraces greater pluralism, avoids groupthink, challenges the accepted orthodoxy and helps us revert old models and rigid path dependencies that so often neglect the lived realities and demands of those left behind. This can only be realised by overcoming epistemic injustice and embracing epistemic democracy in the practice of evidence-based policy. (shrink)

The primary goal of this monograph is to justify the possibility of building a hybrid theory of normative ethics which can combine ethical consequentialism, deontology and virtue ethics. The aim of the book is to demonstrate the possibility of constructing a synthetic theory from ethical traditions that are generally considered to be contradictory. In addition, I propose an outline of an original theory which tries to carry out such a synthesis. I call it Institutional Function Consequentialism. The justification for a (...) hybrid theory of normative ethics requires the resolution of certain meta-ethical issues. I discuss them in part 1.1. After a brief overview of my research aims I consider the answer to the following questions: “What kind of meta-ethical beliefs must we assume for normative ethics?” and "Why should we build ethical theories?". I also discuss the various forms of ethical scepticism, which should be rejected if we develop a hybrid theory of normative ethics. I also describe possible methods of justifying any ethical theory. At the end of part 1.1 I explain that the best method for justifying any ethical theory is the method of wide reflective equilibrium. In parts 1.2, 1.3 and 1.4 I analyse three main types of normative ethics which are considered to be competitive: consequentialism, deontology, and virtue ethics. Part 1.2 is about consequentialism and its difference between utilitarianism and teleological theories. I also present the main reasons for the popularity of consequentialism. In part 1.3 I define deontology, present its variations and show important benefits that motivate its continuous growth. In part 1.4 I discuss virtue ethics, which is often referred as the viable alternative to consequentialism and deontology. If we want to build any new ethical theory, first we should describe the problems of the old ones. For this reason, in chapter 2 I describe the most important arguments against ethical consequentialism, and in chapter 3 I explain the difficulties of deontology. Critical remarks on virtue ethics are considered in part 1.4. The last two chapters directly concern the main aim of the monograph. Because in chapter 3 I show that deontology suffers from a number of problems such as the paradox of deontology, in chapters 4 and 5 I present only consequentialist versions of hybrid theories. These versions try to avoid the common pleas of utilitarianism and combine the advantages of opponents to utilitarianism. I answer the question (4.1) "What is hybrid consequentialism?" and briefly describe (4.2) the most important examples of hybrid theories by others. I discuss the prerogatives without restrictions idea by Samuel Scheffler, rule consequentialism by Brad Hooker, Kantian consequentialism by Richard M. Hare, David Cummiskey and Derek Parfit and consequentializing procedure proposed by Douglas W. Portmore. In the last chapter I present a new hybrid version of consequentialism that I call Institutional Function Consequentialism. I start from the thesis (5.1) that traditional meta-ethics of analytic philosophy incorrectly defines the main field of its research. Rather than focusing on the philosophy of language and metaphysics it should try to answer one question: “What should morality and ethics be for?”. Therefore I introduce an original methodology for meta-ethics that I call the Functional Model of Analysis (FMA). It is a meta-ethical framework in which the fundamental questions concern the practical functions of normative domains such as morality and ethics and the most rational way of achieving them. FMA is meta-ethical project that (a) explains the persistence of fundamental ethical disagreement among experts, (b) sets the background for explaining or justifying the correct structure of the ethical theory, (c) gives the possibility to create a hybrid theory of normative ethics. In part 5.2 I formulate a generalized argument against various popular theories of normative ethics which states that most of the popular theories are too narrow and one-sided, causing permanent dispute between them. There are many distinct practical functions of morality that are usually based on different types of normative theories such as Aristotelian ethics, utilitarianism, contractarianism and contractualism. In order to remove these conflicts, the correct ethical theory should try to take into account all of these relevant features of moral life. Unfortunately, most ethical theories are mono-functional. This means that their supporters consciously or unconsciously (1) recognize or accept only one genuine practical function, (2) think that this one practical function overrides all other practical functions or (3) try to reduce all practical functions to the one that is chosen. In part 5.2 I present a description and justification of a new normative account that I call Hybrid Function Consequentialism. The formal scheme of this consequentialism can be summarized in the following way: we should act according to some important focal points P1…Pn with contents C1…Cn that are selected on the basis of considerations about which kind of P with C will bring the best realization of the best mix of normative functions F1...Fn. In the next part (5.2.2) I present the new way of “consequentializing” particular theories of normative ethics by applying the scheme of Hybrid Function Consequentialism. As an example of the use of this procedure, I formulate perfectionist virtue consequentialism, contractarian institution consequentialism, contractualist rule consequentialism and consequentialism of salvation. In part 5.3 I formulate an original theoretical concept that I call Institutional Function Consequentialism (IFC). It is a hybrid theory that is based on the previously described Functional Model of Analysis and a reflection on the role of institutions in modern developed societies. IFC claims that we should always act according to some rules, virtues, motives and intentions that constitute the homeostasis of normative institutions whose internalization by the overwhelming majority of each new generation has maximum expected value in terms of the best realization of the equilibrium of the most important practical functions of normative domains. Responsibility and sanctions related to wrongful actions should be dependent on the particular institution whose standards have been violated. IFC has several unique features which are described and justified in part 5.3. It is a form of hybrid consequentialism – it mixes features of consequentialism, deontology and virtue ethics. It does this on three different levels: justification, structure and content. The main focal point of the theory is not rules or virtues, but normative institutions. Values to be optimized in the framework of consequentialism are not "happiness", "well-being" or "preferences", but the fulfilment of normative functions. IFC is not limited to the field of ethics only, but it is a meta-normative account of justification for an entire social order which is comprised of a number of different institutions. It also assumes a specific, circular relationship between practical ethics (e.g. research on such important issues as civil disobedience, fair distribution of wealth, philosophy of punishment or autonomy of conscience), and the content of the general rules that may constitute the optimal homeostasis of institutions. It rejects the simplistic belief that moral thinking is based solely on deductive implications from general ethical principles or meta-ethical beliefs. (shrink)

The events surrounding COVID-19, combined with the mandatory quarantines widely imposed in Asia and Europe since the virus outbreak, have reignited discussion of the balance between individual rights and liberties and public health during epidemics and pandemics. This article analyses this issue from the perspectives of precaution and necessity. There is a difficult relationship between these two seemingly opposite principles, both of which are frequently invoked in this domain. Although the precautionary principle encourages the use of quarantines, including mandatory quarantines, (...) and associated restrictive measures, the principle of necessity puts a break on such measures. The COVID-19 pandemic reveals once again the different interrelations between these two principles. However, the alleged conflict between the PN and the PP is based on a superficial analysis. The relation between these two principles is far more complex, as this article will demonstrate. (shrink)

The “brain in a vat” thought experiment is presented and refuted by appeal to the intuitiveness of what the author informally calls “the eye for an eye principle”, namely: Conscious mental states typically involved in sensory processes can conceivably successfully be brought about by direct stimulation of the brain, and in all such cases the utilized stimulus field will be in the relevant sense equivalent to the actual PNS or part of it thereof. In the second section, four classic problems (...) of Functionalism are given novel solutions based on the inclusion of peripheral nervous processes as constituents of mental states: The mad pain problem, the problem of pseudo-normal vision, the China-brain problem, and the triviality problem.
