In this paper I will set out my understanding of Bas van Fraassen’s constructive empiricism, some of the difficulties which I believe beset the current version, and, very briefly, some valuable lessons I believe are nonetheless to be learned by considering this view.We’ll need to begin with a review of how van Fraassen conceives of this kind of discussion.

Several philosophers and psychologists have argued that evidence of moral framing effects shows that many of our moral judgments are unreliable. However, all previous empirical work on moral framing effects has used between-subject experimental designs. We argue that between-subject designs alone do not allow us to accurately estimate the extent of moral framing effects or to properly evaluate the case from framing effects against the reliability of our moral judgments. To do better, we report results of our new within-subject study (...) on four types of moral framing effects, and we discuss the implications of our findings for the reliability of moral judgments. Overall, our results strengthen the evidence from moral framing effects against the reliability of some of our moral judgments. (shrink)

This study examines the effects of demographic characteristics on ethical perceptions. While earlier research has produced conflicting results regarding the predictive power of these variables, significant and definite insights were obtained with proper controls. The following predictors of ethical attitudes are examined: age, gender, marital status, education, dependent children status, region of the country and years in business, while controlling for job status. A nation-wide random sample of employees was used in obtaining a response rate of fifty-three percent (total n (...) of 423). Indices of aspects of business ethical attitudes were constructed using factor analysis. Linear multiple regression analysis indicated the significant predictive variables. Age was found to be a most-significant predictor. Older workers had stricter interpretations of ethical standards. Gender and region predicted attitudes about job-discrimination practices only, with women and persons from the Midwest most strongly opposed to the practice. All the other variables proved to be unreliable ethics predictors. (shrink)

A framework is presented for studying ethical conduct in public accounting practice. Four levels of analysis are distinguished: individual, local office, multi-office firm and professional institute. Several propositions are derived from the framework and discussed: (1) The effects of ethical vs. unethical behavior on an accountant's prospects for advancement are asymmetrical in nature; (2) the way individuals perceive or frame the decision problem at hand will make an ethical response more or less likely; (3) the economic incentives present in competitive (...) markets influence the work goals of firms and offices, and lead to ethical dilemmas for individuals; and (4) initiatives at the firm or institute level aimed at compliance with professional ethical standards will by themselves have little effect on individual ethical behavior. Research into ethical behavior of practitioners will capture self-conscious and biased responses unless it is designed so as to permit indirect observation and recording of spontaneous comments. To assure valid research findings, practitioners should be interviewed and their motives assessed indirectly. A longitudinal approach is recommended, beginning with students who are choosing an accounting career. Two types of questions for use in these interviews are described. (shrink)

COVID-19 continues to dominate 2020 and is likely to be a feature of our lives for some time to come. Given this, how should health systems respond ethically to the persistent challenges of responding to the ongoing impact of the pandemic? Relatedly, what ethical values should underpin the resetting of health services after the initial wave, knowing that local spikes and further waves now seem inevitable? In this editorial, we outline some of the ethical challenges confronting those running health services (...) as they try to resume non-COVID-related services, and the downstream ethical implications these have for healthcare professionals’ day-to-day decision making. This is a phase of recovery, resumption and renewal; a form of reset for health services.1 This reset phase will define the ‘new normal' for healthcare delivery, and it offers an opportunity to reimagine and change services for the better. There are difficulties, however, healthcare systems are already weakened by austerity and the first wave of COVID-19 and remain under stress as the pandemic continues. The reset period is operating alongside, rather than at the end, of the pandemic and this creates difficult ethical choices. ### Balancing the greater good with individual care Pandemics—and public health emergencies more generally—reinforce approaches to ethics that emphasise or derive from the interests of communities, rather than those grounded in the claims of the autonomous individual. The response has been to draw on more public health focused ethics, ‘if demand outstrips the ability to deliver to existing standards, more strictly utilitarian considerations will have to be applied, and decisions about how to meet the individual's need will give way to decisions about how to maximise overall benefit’.2 Alongside this, effective …. Educational research is dominated by a particular model: data is gathered and analysed. Much literature on methods concerns either ways of processing data, or ethical issues regarding its collection and handling. The present paper looks beyond these matters to the taken‐for‐granted idea of data itself. What can be meant by ‘data’? How does this connect with ideas of the given? What is the place of giving in education—in teaching and learning, in research itself? Non-reductive Physicalism together with environment-dependence of content has been thought to be incompatible with the claim that beliefs are efficacious partly in virtue of their possession of content, that is, in virtue of their intentional properties. I argue that this is not so. First, I provide a general account of property causation. Then, I explain how, even given the truth of Non-reductive Physicalism and the environment-dependence of content, intentional properties will be efficacious according to this account. I go on to (...) relate my discussion to that concerning whether Anomalous Monism is committed to epiphenomenalism. Franklin G. Miller and colleagues have stimulated renewed interest in research ethics through their work criticizing clinical equipoise. Over three years and some twenty articles, they have also worked to articulate a positive alternative view on norms governing the conduct of clinical research. Shared presuppositions underlie the positive and critical dimensions of Miller and colleagues' work. However, recognizing that constructive contributions to the field ought to enjoy priority, we presently scrutinize the constructive dimension of their work. This paper examines a nonreductive supervenience relation central to a philosophically popular version of nonreductive physicalism inspired by Donald Davidson. The paper argues that this global supervenience relation faces a serious epistemological problem that blocks its being superior to weaker, less general supervenience relations.

A scholastic-Cartesian schema faithfully maps ordinary, effective ways of dealing with intentionality; yet its apparent incoherence provokes philosophers into opting for one of two stances, 'Cartesian' or 'direct realist', seemingly incompatible, yet each seem in accord with ordinary thought. A wide range of canonical and current theories, realist, idealist and hybrid, essentially involve one option or the other. We should instead consider why the language of intentionality, with its apparent anomalies, works so well. Released from the obligation to opt for (...) one stance over the other, we can identify a robust realism different in kind from anything currently on offer. (shrink)

I first provide an accessible overview of the DWE (Doing Well Enough) logical and semantic framework for representing going beyond the call and its family of kindred concepts in a tightly intergraded way. Next, a module, for representing some basic agent-evaluative notions is developed (“AA” for “Aretaic Assessment”), and then it is integrated with the more act-evaluative notions of DWE, thereby allowing for a representation of suberogation and supererogation (as distinct from going beyond the call) and many other combined deontic (...) and agent-evaluative notions. I then probe more deeply into how the semantic structures for the DWE framework might themselves be generated and then offer some brief reflections on the classic supererogation puzzle, as well as that of supererogatory holes and the all or nothing problem, framing options via the preceding reflections. Mysticism and Guilt-Consciousness in Schelling's Philosophical Development was Paul Tillich's 1912 dissertation for the licentiate in theology from the University of Halle. He published it the same year and it reappears in the first volume of Tillich's collected works in German.

Electronic health record (EHRs) have largely replaced obsolete paper medical charts. This replacement has produced an increased demand on physicians’ time and has compromised efficiency. In an attempt to overcome this perceived obstacle to productivity, physicians turned to medical scribes to perform the work required by EHRs. In doing so, they have introduced an uninvited participant in the physician-patient relationship and compromised patients’ confidentiality. Scribes may be a successful work around for physicians frustrated by EHRs, but patients’ confidentiality should not (...) be sacrificed in the process. (shrink)

This article deals with issues of litigation based on claims of personal injuries. It briefly describes the way that economists have tended to think about the “litigation process.” It discusses a number of areas of empirical work. It begins with case outcomes and looks at the ways in which the legal system itself can influence matter through the encouragement of information transfer and the rules used for allocating legal costs. It considers the role of lawyers by looking at the effects (...) of different legal fee arrangements on case outcomes. Furthermore, it discusses the liability-based legal system that produces the deterrence benefits often claimed for in conceptual work. The deterrent potentials of liability-based litigations are subject to objective and subjective contexts of the injurer. Finally, the article concludes that alternative means such as the “no fault” scheme that allots compensation irrespective of personal fault of the accused, require greater analysis. (shrink)

The systems T N and T M show that necessity can be consistently construed as a predicate of syntactical objects, if the expressive/deductive power of the system is deliberately engineered to reflect the power of the original object language operator. The system T N relies on salient limitations on the expressive power of the language L N through the construction of a quotational hierarchy, while the system T Mrelies on limiting the scope of the modal axioms schemas to the sublanguage (...) L infM +, which corresponds exactly with the restrictive hierarchy of L N. The fact that L infM + is identical to the image of the metalinguistic mapping C + from the normal operator system into L M reveals that iterated operator modality is implicitly hierarchical, and that inconsistency is produced by applying the principles of the modal logic to formulas which have no natural analogues in the operator development. Thus the contradiction discovered by Montague can be diagnosed as the result of instantiating the axiom schemas with modally ungrounded formulas, and thereby adding radically new modal axioms to the predicate system.The predicate treatment of necessity differs significantly from that of the operator in that the cumulative models for the predicate system are strictly first-order. Possible worlds are not used as model-theoretic primitives, but rather alternate models are appealed to in order to specify the extension of N, which is semantically construed as a first-order predicate. In this manner, the intensional aspects of modality are built into the mode of specifying the particular set of objects which the denotation function assigns to N, rather than in the specification of the basic truth conditions for modal formulas. Intensional phenomena are thereby localised to the special requirements for determining the extension of a particular predicate, and this does not constitute a structural modification of the first-order models, but rather limits the relevant class of models to those which possess an appropriate denotation function.
