At the heart of Youth Justice Conferencing, a form of restorative justice aimed at addressing youth crime, is the notion that young persons who have committed an offence should be ‘reintegrated’ into their communities (Braithwaite in Crime, shame and reintegration. Cambridge University Press, Cambridge, 1989). This paper focuses on the role of parents as support persons, in particular the ‘crying mum’, an identity often leveraged by the Convenor when prompting the young person to express remorse to the circle. We explore (...) an Avouchment genre that we have observed whereby support persons vouch for the character of the young person. Our analysis considers the ways in which values are composed (as ideational categories are coupled with evaluative interpersonal ones) and unfold in discourse as invitations for participants to align. Tradition has it that first-person thought is somehow special. It is also commonplace to maintain that the first-person concept obeys a rule of reference to the effect that any token first-person thought is about the thinker of that thought. Following Annalisa Coliva and, more recently, Santiago Echeverri, I take the specialness claim to be the claim that thinking a first-person thought comes with a certain guarantee of its pattern of reference. Echeverri maintains that such a guarantee is explained by a (...) fairly flatfooted interpretation of the thinker-reflexive rule. I argue, however, that the explanatory aspirations of the thinker-reflexive rule are fulfilled only if we accept an epistemically loaded gloss on the notion of a thinker of a thought featuring the rule. That gloss is unpacked in terms of the subject’s ability to be acquainted with the phenomenal character of their thoughts. (shrink)

Permissivism is the view that, sometimes, there is more than one doxastic attitude that is perfectly rationalised by the evidence. Impermissivism is the denial of Permissivism. Several philosophers, with the aim to defend either Impermissivism or Permissivism, have recently discussed the value of (im)permissive rationality. This paper focuses on one kind of value-conferring considerations, stemming from the so-called “truth-connection” enjoyed by rational doxastic attitudes. The paper vindicates the truth-connected value of permissive rationality by pursuing a novel strategy which rests on (...) two main planks: first, there is a distinction between a fine-grained and a coarse-grained type-individuation of belief-forming methods. Secondly, different kinds of decision-theoretic reasoning, i.e. expected-accuracy reasoning and accuracy-domination reasoning, must be paired with a fine-grained and a coarse-grained type-individuation of methods, respectively. I argue that while the first pair is wholly irrelevant to the question of the truth-connection, the second affords the means to a permissivist explanation of the truth-connected value of rationality. The article investigates the significance of the so-called phenomenon of apparent faultless disagreement for debates about the semantics of taste discourse. Two kinds of description of the phenomenon are proposed. The first ensures that faultless disagreement raises a distinctive philosophical challenge; yet, it is argued that Contextualist, Realist and Relativist semantic theories do not account for this description. The second, by contrast, makes the phenomenon irrelevant for the problem of what the right semantics of taste discourse should be. This article presents a fairness principle for evaluating decision-making based on predictions: a decision rule is unfair when the individuals directly impacted by the decisions who are equal with respect to the features that justify inequalities in outcomes do not have the same statistical prospects of being benefited or harmed by them, irrespective of their socially salient morally arbitrary traits. The principle can be used to evaluate prediction-based decision-making from the point of view of a wide range of antecedently specified (...) substantive views about justice in outcome distributions. The pluralist sheds the more traditional ideas of truth and ontology. This is dangerous, because it threatens instability of the theory. To lend stability to his philosophy, the pluralist trades truth and ontology for rigour and other ‘fixtures’. Fixtures are the steady goal posts. They are the parts of a theory that stay fixed across a pair of theories, and allow us to make translations and comparisons. They can ultimately be moved, but we tend to keep them fixed temporarily. Apart (...) from considering rigour of proof as a fixture, I discuss fixed models, invariant notions and fixed information about objects across theories. In this paper we argue that transparency of machine learning algorithms, just as explanation, can be defined at different levels of abstraction. We criticize recent attempts to identify the explanation of black box algorithms with making their decisions (post-hoc) interpretable, focusing our discussion on counterfactual explanations. These approaches to explanation simplify the real nature of the black boxes and risk misleading the public about the normative features of a model. We propose a new form of algorithmic transparency, that consists in (...) explaining algorithms as an intentional product, that serves a particular goal, or multiple goals (Daniel Dennet’s design stance) in a given domain of applicability, and that provides a measure of the extent to which such a goal is achieved, and evidence about the way that measure has been reached. We call such idea of algorithmic transparency “design publicity.” We argue that design publicity can be more easily linked with the justification of the use and of the design of the algorithm, and of each individual decision following from it. In comparison to post-hoc explanations of individual algorithmic decisions, design publicity meets a different demand (the demand for impersonal justification) of the explainee. Finally, we argue that when models that pursue justifiable goals (which may include fairness as avoidance of bias towards specific groups) to a justifiable degree are used consistently, the resulting decisions are all justified even if some of them are (unavoidably) based on incorrect predictions. For this argument, we rely on John Rawls’s idea of procedural justice applied to algorithms conceived as institutions. (shrink)

While it seems hard to deny the epistemic significance of a disagreement with our acknowledged epistemic peers, there are certain disagreements, such as philosophical disagreements, which appear to be permissibly sustainable. These two claims, each independently plausible, are jointly puzzling. This paper argues for a solution to this puzzle. The main tenets of the solution are two. First, the peers ought to engage in a deliberative activity of discovering more about their epistemic position vis-à-vis the issue at stake. The paper proposes an account of the rational response to higher‐order evidence whose key claim is that whenever we acquire such evidence we ought to engage in the inquiring activity of double‐checking. Combined with a principle that establishes a connection between rational inquiry and rational belief retention, the account offers a novel explanation of the alleged impermissibility of retaining one's belief in the face of higher‐order evidence. We argue that in extensive decision problems (extensive games with a single player) with imperfect recall care must be taken in interpreting information sets and strategies. Alternative interpretations allow for different kinds of analysis. We address the following issues: 1. randomization at information sets; 2. consistent beliefs; 3. time consistency of optimal plans; 4. the multiselves approach to decision making. In this study, we explore the role of Chief Executive Officers’ incentives, split between monetary and non-monetary, in relation to corporate social responsibility. We base our analysis on a sample of 597 US firms over the period 2005–2009. We find that both monetary and non-monetary incentives have an effect on CSR decisions. Specifically, monetary incentives designed to align the CEO’s and shareholders’ interests have a negative effect on CSR and non-monetary incentives have a positive effect on CSR. The study has (...) important implications for the design of executive remuneration plans, as we show that there are many levers that can affect the CEO’s decisions with regard to CSR. Our evidence also confirms the prominent role of the CEO in relation to CSR decisions, while also recognizing the complexity of factors affecting CSR. In this paper we discuss an often-neglected topic in the literature on the ethics of voting. Our aim is to provide an account of what states are obligated to do, so that voters may fulfil their role as public decision-makers in an epistemically competent manner. We argue that the state ought to provide voters with what we call a substantive opportunity for competence. This entails that the state ought to actively foster the epistemic capabilities that are necessary to achieve competent (...) participation in political decision-making practices. (shrink)

Here, we provide an ethical analysis of discrimination in private insurance to guide the application of non-discriminatory algorithms for risk prediction in the insurance context. This addresses the need for ethical guidance of data-science experts, business managers, and regulators, proposing a framework of moral reasoning behind the choice of fairness goals for prediction-based decisions in the insurance domain. The reference to private insurance as a business practice is essential in our approach, because the consequences of discrimination and predictive inaccuracy in (...) underwriting are different from those of using predictive algorithms in other sectors. Here we focus on the trade-off in the extent to which one can pursue indirect non-discrimination versus predictive accuracy. The moral assessment of this trade-off is related to the context of application—to the consequences of inaccurate risk predictions in the insurance domain. (shrink)

Deceptive communication and misinformation are crucial issues that are currently having a significant impact on social life. Parallel to the important work of identifying misinformation on digital platforms is understanding why such material proliferates. One approach to answering this question is to attempt to understand the values that are being targeted by misinformation as a means of interpreting the underlying social bonds that are at stake. This study examines the kinds of social bonds that are communed around and contested in (...) a corpus of YouTube video comments about the viral internet hoax ‘The Momo Challenge’. A social semiotic approach to ‘ambient affiliation’ is used to investigate how these bonds are negotiated in this digital discourse. This approach involves establishing the types of personae who were negotiating meaning in the comments on the basis of the values that they recurrently shared, deferred or disputed. The analysis suggests that, in addition to concern over whether Momo was real and dangerous, there was a deeper moral panic about parenting in the digital age and the legitimacy of institutions such as schools and media as brokers of knowledge. In the past decade the central principles of western feminist theory have been dramatically challenged. many feminists have endorsed post-structuralism's rejection of essentialist theoretical categories, and have added a powerful gender dimension to contemporary critiques of modernity. Earlier 'women' have been radically undermined, and newer concerns with 'difference', 'identity', and 'power' have emerged. Destabilizing Theory explores these developments in a set of specially commissioned essays by feminist theorists. Does this change amount to a real shift within feminist theory, or will (...) feminism's links with an emancipatory modernism reinstate an older political agenda? In this paper I aim to illuminate the significance of thought insertion for debates about the first-person concept. My starting point is the often-voiced contention that thought insertion might challenge the thesis that introspection-based self-ascriptions of psychological properties are immune to error through misidentification relative to the first-person concept. In the first part of the paper I explain what a thought insertion-based counterexample to this immunity thesis should be like. I then argue that various thought insertion-involving scenarios do not give (...) rise to successful counterexamples to the immunity of the target class of self-ascriptions. In the second part of the paper I turn to defend a Metasemantic Explanation of why the immunity thesis holds. The Metasemantic Explanation rests on a reference-fixing story about the mental ‘I’ whose key contention is that introspective impressions play an essential role in fixing its reference. It is part of my argument in favour of the proposed reference-fixing story, as well as of the Metasemantic Explanation, that they respect the paradigmatic features of self-ascriptions of inserted thoughts. The presence of easily accessible yet unpossessed evidence seems to matter epistemically. In this chapter I offer an inquiry-theoretic explanation of this datum. I argue that agents in the target cases fail to be competent inquirers and gather the relevant easily accessible evidence. This offers a deflationary explanation of the initial datum. I then show how to inflate this explanation to vindicate the thought that unpossessed evidence has defeating power over the justificatory status of one’s beliefs. The inflationary explanation rests (...) on two main planks. First, the subject who believes that p in the target cases ought to have gathered the target piece of evidence that bears on p. Secondly, such a duty is incompatible with justifiedly believing p. Along the way, the chapter offers a framework for thinking about zetetic competence, comments on the existence of epistemic duties of inquiry, and discusses the relationship between such duties and traditional epistemic norms of belief. The concept of cultural capital has been increasingly used in American sociology to study the impact of cultural reproduction on social reproduction. However, much confusion surrounds this concept. In this essay, we disentangle Bourdieu and Passeron's original work on cultural capital, specifying the theoretical roles cultural capital plays in their model, and the various types of high status signals they are concerned with. We expand on their work by proposing a new definition of cultural capital which focuses on cultural and (...) social exclusion. We note a number of theoretical ambiguities and gaps in the original model, as well as specific methodological problems. In the second section, we shift our attention to the American literature on cultural capital. We discuss its assumptions and compare it with the original work. We also propose a research agenda which focuses on social and cultural selection and decouples cultural capital from the French context in which it was originally conceived to take into consideration the distinctive features of American culture. This agenda consists in 1) assessing the relevance of the concept of legitimate culture in the U.S.; 2) documenting the distinctive American repertoire of high status cultural signals; and 3) analyzing how cultural capital is turned into profits in America. Em minha tese de doutorado defendi que, para compreender como Hegel articula a passagem da contradição dialética à lógica, o conceito hegeliano de contradição deve ser analisado sob a perspectiva de uma antinomia. Para sustentar este argumento, propus uma atualização deste conceito a partir de uma estrutura antinômica. Essa atualização, porém, trouxe um outro problema: nessa reconstrução, a contradição, em Hegel, continua a se desenvolver de maneira gradativa, ao passo que a lógica tradicional trabalha apenas com valores de p e (...) -p, e não com níveis de gradação. Assim, para continuar sustentando o argumento de que o conceito hegeliano de contradição, sob a perspectiva de uma antinomia, pode ser compreendido como uma contradição lógica, seria necessário encontrar uma lógica que não operasse apenas com valores binários, mas também com níveis de gradação. Foi a partir dessa necessidade que surgiu a ideia de aplicar o conceito de contradição em Hegel à Lógica Difusa, e esta é, portanto, a proposta do presente artigo. (shrink)

Over the last decades the problem of the existence of Byzantine philosophy has been posed in terms of the determination of its status, its function, and its subject matter. To a certain extent, this approach to Byzantine philosophy has been motivated by the increasing disciplinary autonomy reached by the other branches of what is nowadays called «medieval philosophy». A series of significant scholarly achievements over the last twenty years have contributed to the development of more-or-less well defined scholarly fields of (...) research concerning the medieval Latin, Arabic, and Jewish philosophical traditions. In regard to Byzantine philosophy the situation is much more complicated. In the first chapter of his La philosophie médiévale, Alain de Libera devotes his first words to the retarded scholarly development of the study of Byzantine philosophy. He claims that Byzantine philosophy has been mainly ignored and misunderstood, and has not been deeply studied. However, from the second half of the twentieth century one can find relevant and extremely important attempts to establish not only the basic features and developments, but the very existence of Byzantine philosophy. In this Forschungsbericht I shall attempt to reconstruct the scholarly debate on this topic, testing the main interpretive attitudes against some concrete cases of thinkers who lived in the area of the Eastern Roman Empire and who are labelled by most modern historians as «Byzantine». In 2003, the South Carolina Supreme Court upheld the conviction of Regina McKnight, an African American woman who was convicted at the age of twenty‐two for committing “homicide by child abuse.” She became the first woman in the United States to be arrested, prosecuted, and convicted for experiencing a stillbirth. Rather than an outlier case in the annals of American jurisprudence that stretched law beyond reason while restraining compassion and justice, McKnight's conviction inspired similar prosecutions of other poor black women (...) and then of other women. More than one‐third of states consider pregnant women's illicit drug use a form of child abuse, resulting in unprecedented forms of criminal and civil punishment. Laws previously understood to protect pregnant women from domestic violence during pregnancy, such as fetal protection laws, now serve as the vehicles for prosecuting pregnant women. What these prosecutions and laws expose are the multitudinous ways in which the criminalization of poor pregnant women—and normalization of that criminalization, such that even doctors and nurses are expected to participate in it—serve to humiliate women, interfere with their reproductive health, and ultimately rob women of reproductive autonomy. This paper applies Plato’s cave allegory to Enron’s success and downfall. Plato’s famous tale of cave dwellers illustrates the different levels of truth and understanding. These levels include images, the sources of images, and the ultimate reality behind both. The paper first describes these levels of perception as they apply to Plato’s cave dwellers and then provides a brief history of the rise of Enron. Then we apply Plato’s levels of understanding to Enron, showing how the company created its image (...) and presented information to support that image, and how the public eventually emerged from the cave to realize the truth about Enron’s actual accounting practices and financial state, which led to the corporation’s downfall. We find Plato’s allegory both useful in analyzing the relationship between Enron and the public and instructive about the power and moral responsibility of Enron’s executives. (shrink)

Trust and monitoring are traditionally antithetical concepts. Describing trust as a property of a relationship of reliance, we introduce a theory of trust and monitoring, which uses mathematical models based on two classes of functions, including _q_-exponentials, and relates the levels of trust to the costs of monitoring. As opposed to several accounts of trust that attempt to identify the special ingredient of reliance and trust relationships, our theory characterizes trust as a quantitative property of certain relations of reliance that (...) can be quantified and expressed as a scalar quantity. Our theory is applicable to both human–human and human–artificial agent interactions, as it is agnostic with respect to the concrete realization of trustworthiness properties, and is compatible with many views differing on which properties contribute to trust and trustworthiness. Finally, as our mathematical models make the quantitative features of trust measurable, they provide empirical studies on trust with a rigorous methodology for its measurement. (shrink)

In the literature, there have been several methods and definitions for working out whether two theories are “equivalent” or not. In this article, we do something subtler. We provide a means to measure distances between formal theories. We introduce two natural notions for such distances. The first one is that of axiomatic distance, but we argue that it might be of limited interest. The more interesting and widely applicable notion is that of conceptual distance which measures the minimum number of (...) concepts that distinguish two theories. For instance, we use conceptual distance to show that relativistic and classical kinematics are distinguished by one concept only. (shrink)

In this paper, I introduce a new term, adoptism, to characterize the unique form(s) of marginalization to which adopted persons are subjected. Adoptism shows up primarily as enforced gratitude, and this injunction to be grateful carries with it epistemic harms that have heretofore been overlooked because the dominant social narrative surrounding adoption is that it is an overwhelmingly positive practice. This dominant view stems largely from adoptive parents and the adoption industry, which is an institution, I argue, that is far (...) from child-centered and beneficent. Because those most impacted by being adopted, adopted persons, are conspicuously absent in discussions of adoption, there is a great potential for epistemic injustice. These injustices are magnified when adoptees attempt to provide testimony that challenges the prevailing social script surrounding adoption. Using my lived experience as a domestic adoptee, as well as the testimony of many other adopted persons, I uncover and examine the ways adoptees are harmed in our capacities as knowers. Finally, after dispelling the myths that adoptist ideology upholds, I suggest ways to redress the otherwise hidden injustices of adoption. (shrink)

And an artist might lead his public on to appreciate finer things than they had wanted at first; but he could do this only by being; from the first, if not merely entertaining, yet entertaining, and if not completely intelligible, yet very largely intelligible.” This constraint—let us call it intelligent (or purposeful) design, in keeping with a basic analogy that we will draw upon in these pages—had however been lost, Lewis observed. Hence, even “in the highest aesthetic circles one now hears nothing about the artist’s duty to us. It is all about our duty to him. He owes us nothing; we owe him ‘recognition,’ even though he has never paid the slightest attention to our tastes, interests, or habits.”1 In short, the artist of modernity need not pay the slightest attention to an intention, not even his own. Modern art need not be an expression of intelligence or [End Page 363] understanding; it is expression as such (tout court): personal and autonomous.2Lewis’s remarks do not point merely to the increasingly relativist tendencies of art in the Western world, to the lack of objective criteria or norms governing the artistic disciplines. They also point to the growing disregard among artists for the sociocultural expectations of their publicum. Mediating between the two is, without a doubt, the basis upon which both artistic and social norms were traditionally founded: nature, which served as a classic analogy for both art (understood in the broad sense, so as to include not only the fine arts, but also technology and practical sciences) and ethics in virtue of nature’s intrinsic inclination towards its defining end and perfection.With regard to the first of these analogies (that of art and nature), Mark Schiefsky explains that although art does bring about “results that nature itself cannot,” it does so in the classic understanding “by acting in a natural way—the way nature would act if it could generate the products of art.”3 As for the difference between the two, nature is moved to its specifying end by way of intrinsic inclinations that are implicit to it, whereas a work of art is moved to its end extrinsically, and thus with more or less violence.4 A sculptor, for example, who introduces a form into a piece of marble, does so by chiseling [End Page 364] and hammering away at the fine stone.5 “Art is,” Aristotle explains, “the principle and form of the thing that comes to be [let us say, a sculpture]; but it is located elsewhere [in, for example, the artist’s mind or in a sketch that he has made] than in that thing, whereas the movement of nature is located in the thing itself that comes to be [a tree, for example, or a baby], and is derived from another natural organism [a tree or human parents] which possessed the form in actuality.”6This classic distinction between art and nature parallels the distinction between art and ethics. Ethics “does not affect human action in the same way as do art and technique,” Servais Pinckaers explains. Unlike art and technique, which are concerned with “the external work produced by human action”—this painting or that machine, for example—ethics is concerned with an immanent principle, qualifying the actor as such: the stable dispositions (or habitus: virtues or vices) at the origin of “the active willing that is the principle source of the action.”7 This immanent principle at the source of ethical action is—to complete our analogy—creative in only a limited sense. This paper supports the personal data platform cooperative as a means of bringing about John Rawls’s favoured institutional realisation of a just society, the property-owning democracy. It describes personal data platform cooperatives and applies Rawls’s political philosophy to analyse the institutional forms of a just society in relation to the economic power deriving from aggregating personal data. It argues that a society involving a significant number of personal data platform cooperatives will be more suitable to realising Rawls’s principle of fair (...) equality of opportunity. (shrink)

Ethical reflection on Artificial Intelligence (AI) has become a priority. In this article, we propose a methodological model for a comprehensive ethical analysis of some uses of AI, notably as a replacement of human actors in specific activities. We emphasize the need for conceptual clarification of relevant key terms (e.g., intelligence) in order to undertake such reflection. Against that background, we distinguish two levels of ethical analysis, one practical and one theoretical. Focusing on the state of AI at present, we (...) suggest that regardless of the presence of intelligence, the lack of morally relevant features calls for caution when considering the role of AI in some specific human activities. The aim of this paper is to provide an account of how hunger motivates us to seek food and eat. It seems that the way that it feels to be hungry must play some role in it fulfilling this function. We propose that hunger is best viewed as a complex state involving both affective and somatic constituents, as well as, crucially, changes in the way in which the hungry agent’s attention is deployed. We argue that in order to capture the (...) distinctive way in which hunger motivates we need to articulate the relations amongst such components. The resulting account explains how hunger as an aversive affective reaction to a state of need motivates us specifically to eat and not to just to rid ourselves of the unpleasant sensations associated to it. We suggest, however, that there is more than this to the overall affective experience of the hungry agent, because hunger ordinarily facilitates the elicitation of other, positive affective reactions such as interest and appetite, and recruits them to further its function.
