Levinas never engaged closely with Fichte’s work, but there are two places in the chapter “Substitution,” in Otherwise than Being (1974), where he mentions Fichte by name. The point that Levinas underscores in both of these passages is that the other’s encounter with the subject is not the outcome of the subject’s freedom; it is not posited by the subject, as Fichte has it, but is prior to any free activity. The aim of this paper is to deepen the comparison (...) between Levinas and Fichte, giving special attention to Fichte's own novel theory of intersubjectivity and the summons. One result that emerges from this treatment is that both Levinas and Fichte view the second person in a way that has no equivalent in the current philosophical landscape. On this reading, each thinker views responsibility to the other, not only as an immediate and particular obligation, but also as an asymmetrical relation that gives the other moral priority. Lack of guidance and regulation for authorizing medical cannabis for conditions involving the health and neurodevelopment of children is ethically problematic as it promulgates access inequities, risk-benefit inconsistencies, and inadequate consent mechanisms. In two virtual sessions using participatory action research and consensus-building methods, we obtained perspectives of stakeholders on ethics and medical cannabis for children and youth. The sessions focused on the scientific and regulatory landscape of medical cannabis, surrogate decision-making and assent, and the social and political culture of medical (...) cannabis. We found that evidence-gathering and data dissemination, pressures on clinical relationships, and the lack of integration of culturally diverse perspectives and Indigenous knowledges were key areas of concern. Participants emphasized the importance of utilizing adaptive study designs, highlighted the importance of trust-building between clinicians, patients and caregivers, and discussed barriers including historical and ongoing stigmatization of medical cannabis. We conclude that continued public consultation and strength-based research that integrate diverse perspectives are critical steps forward. (shrink)

The only suggestion of a perceived crisis of socialism is in the title and in a few sentences in the introduction about crises of identity on the left and about crises of “principles, institutions, and practices”, of socialism, the themes of the three parts of this wide-ranging book. Trade cards were a means of advertising products or services and thereby attracting customers to the owner's shop. They often included a variety of details about the proprietor and his business, and illustrated his wares. Cards for the scientific instrument industry depicted all classes of instrument and the products from which they were made. A careful study of the cards can reveal much supplementary information about the way the industry worked, so their use, and limitations, as a source of historical (...) evidence is discussed in detail. Over sixty English trade cards from London and the provinces, covering the period 1670 to 1900, are illustrated . By careful analysis, it is shown that aesthetic style and type-face design, combined with written and pictorial content, may be used to deduce dates and business practices. Langst als der grosse Klassiker der Soziologie und Gesellschaftstheorie unserer Zeit anerkannt, ist Bourdieu in seiner Bedeutung fur politische Theorie wie politische Wissenschaft noch kaum gewurdigt. Die Frage des Staates und der Politik hangt direkt mit derjenigen der symbolischen Gewalt zusammen (und damit auch mit der Frage nach dem politischen Wert von politischer Wissenschaft, welche dann nicht mehr nur als Aufklarung, sondern auch als Kampf verstanden werden kann), welche Bourdieu (...) zufolge eben vom Staat "monopolisiert" wird. So ware der eigentlich politische Kampf der Kampf um die Hegemonie oder, wie Bourdieu es ausdruckt, um die legitime Sichtweise der sozialen Welt - um die "Soziodizee," die "Legitimation der sozialen Ordnung, wie sie ist." Der Begriff des Staates wird in Anlehnung an Max Webers Definition des Staatsbegriffs als Inhaber des Monopols nicht nur der legitimen physischen Gewaltsamkeit, sondern auch der legitimen symbolischen Gewalt konzeptualisiert. Aus Sicht von Libertären des 20. Jahrhunderts ist Mill durch seine Eigentumstheorie zu einem gefährlichen Wegbereiter des Sozialismus geworden. „Mill“, so schreibt Ludwig von MisesMises, Ludwig von, „is the great advocate of socialism. All the arguments that could be advanced in favour of socialism are elaborated by him with loving care. In comparison with Mill all other socialist writers – even MarxMarx, Karl, EngelsEngels, Friedrich, and LassalleLassalle, Ferdinand – are scarcely of any importance“ (Ludwig von Mises, zit. nach Miller 2003, (...) 213–214). Richtig ist an dieser Einschätzung, dass nach Mill jegliche Eigentumsordnung an Maßstäben der Verteilungsgerechtigkeit zu messen ist. Insofern kann man ihn tatsächlich als Vordenker moderner Gerechtigkeitstheorien sehen. Irreführend ist jedoch, Mill als ‚Advokaten‘ des Sozialismus zu bezeichnen, weil er es als eine offene Frage betrachtete, ob eine sozialistische oder eine auf Privateigentum an Produktionsmitteln basierende Markwirtschaft zu bevorzugen wäre. Die Kategorie des Sinns oder des Sinnvollen findet in der jüngeren Diskussion um die normative Theorie des guten Lebens erhöhte Aufmerksamkeit. Viele Autoren gehen mittlerweile davon aus, dass eine umfassende Bestimmung des guten Lebens nicht mehr ohne die Erwähnung und Erläuterung der Wertdimension des sinnvollen Lebens auskommt. Typischerweise wird dieses Syntagma so verstanden, dass damit ein Wertaspekt des Teil- oder Gesamtlebens eines Individuums gemeint ist, welches in einer bestimmten, von anderen Wertdimensionen des guten Lebens noch abzugrenzenden Hinsicht als lobenswert, bedeutsam (...) oder bewundernswert ausgezeichnet wird. Umstritten ist dabei jedoch zum einen, ob das sinnvolle Leben eine eigenständige Wertkategorie innerhalb des guten Lebens darstellt, und zum anderen, falls dem so wäre, wie diese Kategorie dann genau zu explizieren wäre, nicht zuletzt im Verhältnis zu den etablierten Wertkategorien innerhalb des guten Lebens, wie etwa dem Wohlergehen. In den USA und in der EU werden die jeweiligen Zulassungsverfahren für Arzneimittel und Tests schrittweise angepasst und integriert. Zulassung und Erstattungsentscheidungen sollen koordiniert werden. Eine Privilegierung, wie bei Arzneimitteln (...) für seltene Indikationen, findet jedoch für personalisierte Medizin nicht statt. Es bestehen keine unzumutbaren Hürden für die Hersteller. What's Next? Michael Crichtons und Mikhail Bulgakovs Kritik der Fetischisierung in den Lebenswissenschaften. Dieser Beitrag wurde angeregt durch den Thriller Next (2006) von Michael Crichton. Im Gegensatz zu dessen State of Fear (2004), wo die Behandlung eines aktuellen wissenschaftspolitischen Problems – des Klimawandels – mit einer harschen Kritik am Umgang politischer Aktivisten mit wissenschaftlichen Ergebnissen einhergeht, setzt Next Hoffnungen und Ängste ins Zentrum, die im Zusammenhang mit dem ‚Human Genome Project‘ verhandelt wurden. Crichton stellt hier wissenschaftlich‐ökonomische Verflechtungen dar, (...) vor denen er schon in seinen Romanen zu Jurassic Park (1990) warnte. Hier wird auf die Gefahr der Fetischisierung im Zusammenhang mit utopisch untermalten wissenschaftlich‐technischen Großprojekten und der Phantasie ‚Leben zu machen‘ hingewiesen, und es werden entsprechende Motive und Narrative der,longue‐durée‘ aufgegriffen, z.B. künstliche Menschen, menschliche Hybris und das Außer‐Kontrolle‐Geraten wissenschaftlich‐technischer Großprojekte. Unter der Fragestellung, wie kritische Wissenschaftsreflexion im Medium von Literatur erfolgen kann und was der spezifische Beitrag aus der Wissenschaftsgeschichte wäre, behandelt dieser Essay neben Werken von Michael Crichton (vor allem Next und Lost World, 1997) auch die satirischen Novellen Die verhängnisvollen Eier (1924/1925) und Hundeherz (1926/1968) von Mikhail Bulgakov, da bereits dort die (mögliche) künstliche Hervorbringung von Lebewesen unter der Bedingung eines (versuchten) direkten Zugriffs auf deren Reproduktionsmechanismen fokussiert wurde. Wissenschaftskritik als Gesellschaftskritik zeigt sich hier als Reflexion auf die Grenzen zwischen Wissenschaft und Gesellschaft und auf die Verantwortung der entlang dieser Grenzen agierenden Menschen, aber auch auf strukturelle Gewalt und deren Auswirkungen auf die Verhältnisse zwischen Menschen und Naturdingen sowie unter Menschen.Summary: What's Next? Michael Crichton's and Mikhail Bulgakov's Criticism of Fetishism in the Life Sciences. This paper was first inspired by Michael Crichton's last thriller, Next (2006), which staged hopes and fears triggered by the completion of the Human Genome Project and by the perfection of Polymerase chain reaction techniques, enabling the replication of DNA on a large scale. These developments nourished fantasies about the artificial (re)construction of living beings from DNA. Crichton had already warned of the fetishization of artificially produced living beings in Jurassic Park and in the novels on which the film was based inventing a futuristic scenario where this was happening on a large scale. Here, the topics of hubris and hybrids were center stage. In Next, the fetishization of life is an effect of the growing encroachment of economic actors upon the life sciences. This paper compares Crichton's criticism of techno‐scientific fetishism with Mikhail Bulgakov's critical account of human tinkering with the reproductive organs of humans and non‐humans in his two satirical novels The Fateful Eggs and Dog's Heart. The works of both authors link criticism of science with criticism of society. They focus the borders between science and society and analyze the responsibilities of humans who are acting along those borders. The thrillers and satirical novels illustrate the – often violent – power relations between humans and nature and also among humans. Comparing two authors who wrote nearly a century apart from each other and focussing different social systems will help compare longue‐durée and more specific forms of techno‐scientific fetishism. Some authors argue that the ethics of medical care and the ethics of research differ, and that it is a mistake to conflate the two. They propose “that medical research and medical treatment are two distinct forms of activities, governed by different ethical principles.” This raises the question of whether physicians who are also clinical investigators may separate their role as physician from that of researcher when they are involved in clinical trials, thereby avoiding the obligations required in the physician-patient (...) relationship. Miller and Brody suggest that medical training is to blame for what they believe is the physicians’ tendency to confound the obligations of research and practice. “Physician-investigators, after all, went to medical school” they explain. They believe that considering research with patients outside the ethical framework of the physician-patient relationship may be “difficult and threatening” to physicians who have “psychological needs” to consider the ethical obligations flowing from their relationship with their patients. New brain-computer interface and neuroimaging techniques are making differentiation less ambiguous and more accurate between unresponsive wakefulness syndrome patients and patients with higher cognitive function and awareness. As research into these areas continues to progress, new ethical issues will face physicians of patients suffering from total locked-in syndrome, characterized by complete loss of voluntary muscle control, with retention of cognitive function and awareness detectable only with neuroimaging and brain-computer interfaces. Physicians, researchers, ethicists and hospital ethics committees should be aware of (...) and prepared to handle ethical issues unique to these totally locked-in patients. Several thought experiments are discussed, to highlight potential ethical dilemmas surrounding surrogate decision-making, autonomy, end-of-life care, and pediatric care, which will be unique to total LIS patients. These, along with other ethical problems especially relevant to total LIS patients, merit further discussion among physicians, researchers, ethicists and hospital ethics committees, to facilitate consensus regarding these issues, and improve patient care. In previous work I have argued against internalism by means of a dilemma intended to force all internalists to accept one of two undesirable options: either their internalism is unmotivated or it is saddled with vicious regress problems. Recently it has been argued that Phenomenal Conservatism—a theory of justification according to which justification depends on seemings—is a kind of internalism that can escape this dilemma. In this paper, I argue that Phenomenal Conservatism cannot escape my dilemma for internalism. In order (...) to do this, it is helpful to get clear on what Phenomenal Conservatism is saying, and for that reason I begin, in section I, by examining in some detail what seemings are. I then argue, in the remainder of the paper, that, whichever horn of the dilemma for internalism they take, Phenomenal Conservatives are in trouble. (shrink)

We are continually trying to make sense of our world through the stories we tell and are told, but in our search for coherence, we often sacrifice our freedom and the rich randomness of life. In this passionate and lucid book, Michael André Bernstein challenges our practice of "foreshadowing," in which we see our lives as moving toward a predetermined goal or as controlled by fate. Foreshadowing, he argues, demeans the variety and openness that exist in even the most (...) ordinary moments of life. Foregone Conclusions is an extraordinarily wide-ranging book, both in its scope and in its broader intellectual and moral implications. From the latest biographies of Kafka to the peace accords between Israel and the PLO, from the role of cultural diversity in universities to the Crown Heights riots, Bernstein warns us against passively accepting our identities as being shaped primarily by historical or personal victimization. His book liberates us from stereotyped patterns of understanding the relationship between our lives as individuals and as members of racial, sexual, and historic/ethnic communities. Berstein ultimately opens a powerful new way to understand the principles governing how we read and write narratives--whether historical, personal, or literary. In striking original juxtapositions and critical evaluations of Marcel Proust, Robert Musil, and Aharon Appelfeld, Bernstein sugests the need for a new literary model based on the prosaics of daily life. Bernstein speaks directly and persuasively to many of the most pressing issues in Jewish history, Holocaust studies, literary criticism, and cultural history. Michael Ruse, a leading expert on Charles Darwin, presents a fictional dialogue among characters with sharply contrasting positions regarding the tensions between science and religious belief.

The paper explains why an ontology of permanent point particles that are individuated by their relative positions and that move on continuous trajectories as given by a deterministic law of motion constitutes the best solution to the measurement problem in both quantum mechanics and quantum field theory. This case is made by comparing the Bohmian theory to collapse theories such as the GRW matter density and the GRW flash theory. It is argued that the Bohmian theory makes the minimal changes, (...) concerning only the dynamics and neither the ontology nor the account of probabilities, that are necessary to get from classical mechanics to quantum physics. However, if freedom is a mark of perfection, and loving God is only possible when one freely loves God, will we be loving God at all if we are not free not to love him? Three cumulative arguments for an affirmative answer are developed. The first is to (...) distinguish the ability to love or sin from the opportunity to do so. In heaven we are loving God in an infinite variety of ways, so we are freely exercising our ability to love, even when God has taken away any opportunities for sinning. However, one might reply that our freedom will only be the freedom to love God in various ways, not the freedom to love God or not. Hence the second argument is that in heaven are only people who have freely chosen to love God while on earth, where there was a real opportunity not to love God. Since the free choice to love God was made before entering heaven, loving God in heaven remains a free choice. Moreover, since in heaven God takes away the opportunity to sin, and stopping to love God would be a sin, you will remain steadfast in that free choice. However, one might reply that also having the opportunity to sin would add an extra possibility for willing something, so one would be 'more free' in heaven, and heaven would be more perfect, if one would also have the opportunity to sin. Hence the third argument is that freedom is a perfection shared by both God and humans, and the freedom of God is in an important respect a freedom to create. Hence, our human freedom is also greater if our creative power is greater. We have no creative power but by participating in God’s creative power, which is necessarily directed towards the good. So by willing what is good we extend and perfect creation and thereby extend and perfect our possibilities for willing, hence we become more free. On the contrary, by sinning we destroy creation and possibilities for willing and we become less free, so an opportunity to sin is not a possibility that increases our freedom. (shrink)

He deals with major figures in the current science/religion debate and considers in detail the claims of the new creationism, revealing some surprising parallels between Darwinian materialists and traditional thinkers such as St. Augustine. After outlining why the notion of conscious control of action matters to us and after distinguishing different challenges to that notion, the contribution focuses on the challenge posed by the literature on unconscious goal pursuit. Based on a conceptual clarification of the notion of consciousness, I argue that the understanding of consciousness in that literature is too restricted. The hypothesis that the behaviors reported can be accounted for by nonconceptual forms of consciousness, such as emotions and motor experiences, rather than (...) by—conscious or unconscious—conceptual level intentions tends to be disregarded, even though it promises to be empirically fruitful. The various jurisdictions worldwide that now legally permit assisted suicide (or voluntary euthanasia) vary concerning the medical conditions needed to be legally eligible for assisted suicide. Some jurisdictions require that an individual be suffering from an unbearable and futile medical condition that cannot be alleviated. Others require that individuals must be suffering from a terminal illness that will result in death within a specified timeframe, such as six months. -/- Popular and academic discourse about assisted suicide paradigmatically focuses on individuals (...) with ‘physical,’ i.e., non-psychiatric medical conditions, such as cancer or AIDS. Here I defend analyses of the notions of unbearable suffering, futility, and terminality that imply that, regardless of which of these medical conditions is invoked, at least some individuals with severe and persistent psychiatric illnesses satisfy these conditions and ought to be classified as legally eligible for assisted suicide. The legal and moral case for a right to assisted suicide is therefore not in principle weaker for the severely psychiatrically disordered than for those with ‘typical’ terminal or futile medical conditions. This book presents a comprehensive analysis of Kant’s justification of the categorical imperative. The book contests the standard interpretation of Kant’s views by arguing that he never abandoned his view about this as expressed in his Groundwork. It is distinctive in the way in which it places Kant’s argument in the context of his transcendental philosophy as a whole, which is essential to understand it as an argument from within human agential self-understanding. The book reviews that existing literature, then presents (...) a logical construction of Kant’s argument, which it defends by examining what Kant has to say about synthetic a priori practical propositions in the context of his transcendental philosophy as a whole, and by a detailed examination of how he presents his argument in the Second Critique and the Groundwork. Particular attention is given to the views of two scholars who share many of the views expressed in this book: Klaus Steigleder and Michael Wolff. Special attention is also given to the views of Owen Ware, who, while sharing many of our arguments has a very different overall view.
