ABSTRACTAlthough often neglected, Luther's concept of unio cum Christo in justification is a fruitful model for integrating faith and ethics. According to this model, the Christian is justified in union with Christ who is present in faith. Since Christ is the incarnation of God's self‐giving love, the Christian united with Christ will in turn love her neighbor. This model of integration reveals an intrinsic connection between faith and ethics. Justification concerns not only the dyad of self and God, but also (...) the self's relations with other persons. For Luther, loving the neighbor completes justification. Nonetheless, in both Luther's writings and for the purposes of constructive ethics, unio cum Christo is best understood not as an exhaustive account of integration, but as a helpful model for illuminating certain theological commitments, especially the importance of neighbor love to the God‐relation. We frequently cannot reason about nature in the straightforward manner we anticipate, but must use alternative thought processes that reach useful answers in opaque and roundabout ways; and philosophy must find better descriptive tools to reflect this.

The COVID-19 pandemic has, of necessity, demanded the rapid incorporation of virtual technologies which, suddenly, have superseded the physical medical encounter. These imperatives have been implemented in advance of evaluation, with unclear risks to patient care and the nature of medical practice that might be justifiable in the context of a pandemic but cannot be extrapolated as a new standard of care. Models of care fit for purpose in a pandemic should not be generalized to reconfigure medical care as virtual (...) by default, and personal by exception at the conclusion of the emergency. (shrink)

In this book Mark Wynn argues that the landscape of philosophical theology looks rather different from the perspective of a re-conceived theory of emotion. In matters of religion, we do not need to opt for objective content over emotional form or vice versa. On the contrary, these strategies are mistaken at root, since form and content are not properly separable here - because 'inwardness' may contribute to 'thought-content', or because emotional feelings can themselves constitute thoughts; or because, to put (...) the point a further way, in religious contexts, perception and conception are often infused by feeling. Wynn uses this perspective to forge a distinctive approach to a range of established topics in philosophy of religion, notably: religious experience; the problem of evil; the relationship of religion and ethics, and religion and art; and in general, the connection of 'feeling' to doctrine and tradition. Measuring gene expression on a global scale has been one of the vexing problems of cell biology. Velculescu et al.(1) recently proposed a system for identifying gene expression levels based on very short sequence tags – about nine base pairs – located at a specific site within a gene transcript. By coupling the strategy to current automated sequencing machines and the large expressed sequence tag databases, it should be possible to follow changes in gene expression for large numbers of genes (...) economically and accurately. This dissertation examines the general problem of how to give a philosophical account of the nature of representation by looking at three specific philosophies of language and the philosophic treatment of fictional discourse. I argue that Edmund Husserl, Ludwig Wittgenstein, and J. L. Austin all try to give accounts of meaning by arguing for what I call a "closure of meaning" in language. The closure thesis is the claim that some set of criteria can exhaustively determine the ways in which (...) language can be meaningful. This thesis is implicit in Husserl's theory of expressive meaning in the Logical Investigations, in Wittgenstein's picture theory, and in J. L. Austin's pragmatic account of meaning in speech act theory. My general thesis is that the three philosophers in question do not successfully defend the closure thesis for linguistic representation. Since fictional discourse is a source of counterexamples to the closure thesis, I look specifically at two recent philosophical accounts of fiction by David Lewis and John Searle. I criticize these attempts to account for fictional discourse within referential and pragmatic theories of language. Since such attempts are usually part of a closure thesis, my discussion of fiction provides further reasons for doubting the general possibility of accounting for a closure of meaning in language. Since the beginning ofthe 1980s, successive Belgian governments have pursued a social security policy that is a combination of cutting social expenditure on the one hand and improving the plight of lower income categories among benefit recipients on the other. This has been realised by means of a strategy of 'targeting within universalism ', i.e. improving the benefits for the poor and restricting them for the better off, but without abolishing the entitlements oft he latter category completely. The Belgian experience (...) puts inperspective the 'middle class matters' argument, which predicts that, if cuts are made in social expenditure,the middle classes will use their political resources to defend the provisions they benefit from and to diminish the benefits reserved for the poor. Boeckx & Stjepanovic (2001) claim to have evidence from the analysis of pseudogapping that head movement is best viewed as not occurring in the overt syntax, but rather in the PF component. In this squib, I will show that all of the movements that are needed in the analysis of pseudo-gapping are phrasal, hence demonstrating that the analysis of pseudo-gapping shows nothing about the place of head movement in the grammar.1 Their evidence is based on Lasnik’s (1995) analysis of pseudo-gapping, (...) exemplified in.. In a series of impressive articles, Kenneth Westphal argues that Hegel should be understood as a natural law constructivist. In this essay, I examine what Westphal means by this, showing that any such position requires postulating rights or duties that exist prior to the formation of political institutions. I show that Hegel consistently denies the existence of any such natural rights or duties and conclude that he must have a fundamentally different, non-foundationalist conception of the fundamental task of moral philosophy.

Background Research ethics boards exist for good reason. By setting rules of ethical behaviour, REBs can help mitigate the risk of researchers causing harm to their research participants. However, the current method by which REBs promote ethical behaviour does little more than send researchers into the field with a set of rules to follow. While appropriate for most situations, rule-based approaches are often insufficient, and leave significant gaps where researchers are not provided institutional ethical direction. Results Through a discussion of (...) a recent research project about drinking and driving in South Africa, this article demonstrates that if researchers are provided only with a set of rules for ethical behaviour, at least two kinds of problems can emerge: situations where action is required but there is no ethically good option and situations where the ethical value of an action can only be assessed after the fact. These dilemmas highlight and help to articulate what we already intuit: that a solely rule-based approach to promoting ethical research is not always desirable, possible, effective, or consistent. Conclusions In this article, I argue that to better encourage ethical behaviour in research, there is a need to go beyond the rules and regulations articulated by ethics boards, and focus more specifically on creating and nurturing virtuous researchers. A conceptual ontology was used to semantically enrich the Wittgenstein Archives at the University of Bergen’s taxonomy for Wittgenstein Source to facilitate improved searching in the areas of the philosophies of mathematics and psychology. The classes and sub-classes of the multilingual taxonomy were employed to further refine the ways in which themes in these areas of philosophy could be organised. The taxonomy was intended to facilitate the identification of thematic similarities between remarks in instances where this similarity might not be (...) apparent with free text search and in cases where the classified subject of the remarks differed. The approach taken to constructing the taxonomy allows for both its alteration and potential expansion. (shrink)

Philosophers have given relatively little attention to the ethical issues surrounding the nature of intellectual property in spite of the fact that for the past ten years the public policy debate over "fair use" of copyrighted materials in higher education has been heating up. This neglect is especially striking since copyright ethics are at stake in so many aspects of academic life: the photocopying of materials for classroom use and scholarly work, access to electronic texts, and the cost and availability (...) of single-source information technology such as Dialogue, library card catalogues, the Oxford English Dictionary, and a variety of other print and electronic resources. Of course, the ethics of copyright are not only an issue for those of us in the business of education: recent allegations of copyright infringement by Texaco, which regularly photocopied articles from scientific and technical journals for its employees, suggests that questions about copyright ethics may arise regularly for every corporation and business. While the current lawsuit against Kinko's Copies(1) and Texaco may settle some public policy questions in the short run, the legal discourse on fair use depends upon competing ethical intuitions which are not likely to be resolved soon. A common sales tactic is for a seller to encourage a potential customer to make her purchase decision quickly. We consider a market with sequential consumer search in which firms often encourage first-time visitors to buy immediately, either by making an “exploding offer” (which permits no return once the consumer leaves) or by offering a “buy-now discount” (which makes the price paid for immediate purchase lower than the regular price). Prices often increase when these policies are used. If firms cannot (...) commit to their sales policy, the outcome depends on whether consumer incur an intrinsic cost of returning to a firm: if there is no such return cost, it is often an equilibrium for firms to offer a uniform price to both first-time and returning visitors; if the return cost is positive, however, firms are forced to make exploding offers. A national survey on researchers’ experiences with their institutional review boards (IRBs) is presented, focused exclusively on social and behavioral researchers. A wide range of experiences is apparent in the data, especially in terms of turnaround time for submitted protocols, incidence of data collection without prior IRB approval, and stated reasons for "going solo." Sixty-two percent felt that the turnaround time they typically experience is "reasonable," and 44% said they had not experienced long delays in obtaining approval. However, 48% of (...) respondents reported either conducting a project without IRB approval or modifying an existing project without IRB approval, with anticipated time for approval being the dominant reason offered for doing so. This adds a new dimension to the widely discussed "national IRB crisis" (e.g., Illinois White Paper, 2005). The article concludes with 2 preliminary recommendations for IRB reform. (shrink)

We live in an information society where the usage, creation, distribution, manipulation, and integration of information is a significant activity. Computations allow us to process information from various sources in various forms and use the derived knowledge in improving efficiency and resilience in our interactions with each other and with our environment. The general theory of information tells us that information to knowledge is as energy is to matter. Energy has the potential to create or modify material structures and information (...) has the potential to create or modify knowledge structures. In this paper, we analyze computations as a vital technological phenomenon of contemporary society which allows us to process and use information. This analysis allows building classifications of computations based on their characteristics and explication of new types of computations. As a result, we extend the existing typologies of computations by delineating novel forms of information representations. While the traditional approach deals only with two dimensions of computation—symbolic and sub-symbolic, here we describe additional dimensions, namely, super-symbolic computation, hybrid computation, fused computation, blended computation, and symbiotic computation. Reasons play an important role in social interaction. We study reasons-giving in the context of request sequences in Russian. By contrasting request sequences with and without reasons, we are able to shed light on the interactional work people do when they provide reasons or ask for them. In a systematic collection of request sequences in everyday conversation, we find reasons in a variety of sequential positions, showing the various points at which participants may orient to the need for a reason. (...) Reasons may be left implicit, or they can be made explicit. Participants may make reasons explicit either as part of the initial formulation of a request or in an interactionally contingent way. Across sequential positions, we show that reasons for requests recurrently deal with three possible issues: providing information when a request is underspecified, managing relationships between the requester and requestee and explicating ancillary actions implemented by a request. By spelling out information normally left to presuppositions and implicatures, reasons make requests more understandable and help participants to navigate the social landscape of asking assistance from others. “Unconscionable.” “Outrageous.” “Indefensible.” These are just some of the tamer descriptions for the billing practices of most hospitals, and also many physicians, that have recently come to the public's attention. Earlier this year, Time magazine published an extraordinary 24,000‐word exposé—the longest article it has ever published—detailing how even charitable hospitals routinely price‐gouge their patients.1 With characteristic flare for telling details, journalist Steven Brill documented ten‐fold markups of charges over costs at some prominent hospitals for common services like X rays and (...) lab tests, and one‐hundred‐fold mark‐ups on mundane supplies such as gauze pads and generic aspirin. Just as the buzz from Brill's article was abating, the Centers for Medicare & Medicaid Services released a comprehensive data set in May that galvanized local and national media across the country. This news tsunami caught hospital managers flat‐footed and tongue‐tied. Typical responses conceded that hospitals’ pricing practices are based neither on actual cost structures nor rational marketplace dynamics. Instead, hospitals attempted to deflect blame by noting that hardly anyone actually pays list prices, and they characterized their indefensible pricing as a symptom of a broken system that is beyond them to fix. Over the last thirty years, personal debt loads have increased dramatically. Lower income earners borrow money to purchase basic goods and services, so their debt is frequently non-discretionary. The impact of non-discretionary personal debt on debtors can be as, if not more, harmful than government regulations that have been declared unconstitutional. In this regard, the impact of personal debt is tantamount to the impact of a civil rights violation. What separates the impact of unconstitutional state action from that of personal (...) debt is the assumption that only the latter are the result of consensual transactions. Consent, however, is not a dyadic phenomenon, it exists in gradations. The quality of consent is weakened when the agent is making choices in response to pressures, and the empiricalquestion of the extent to which a consent transaction is unforced is distinct from the normative question of whether a transaction is legitimate, or fair. It is necessary to devise a new taxonomy of language to clearly distinguish the empirical and normative questions. This elucidates the fact that lower income people are under more pressure to borrow money than are upper income individuals to pay progressive rates of income tax. To argue that the latter are ‘coerced,’ is to admit that the low income individual’s decision to borrow is similarly forced. This admission suggests that a significant portion of citizens of market-based economies (notably Canada and the U.S.) are being forced to endure harms tantamount to civil rights violations. The admission also suggests that free markets harbour forces that undermine individual autonomy, and the absence of corrective state regulation exacerbates the problem. (shrink)
