I argue that the Universal Law formulation of the Categorical Imperative is best interpreted as a test or decision procedure of moral rightness and not as a criterion intended to explain the deontic status of actions. Rather, the Humanity formulation is best interpreted as a moral criterion. I also argue that because the role of a moral criterion is to explain, and thus specify what makes an action right or wrong, Kant's Humanity formulation yields a theory of relevant descriptions.

Some contemporary intepreters of Kant maintain that on Kant's view fulfilling duties of virtue require doing so from the motive of duty. I argue that there are interpretive and doctinal reasons for rejecting this interpretation. However, I argue that for Kant motives can be deontically relevant; one's motives can affect the deontic status of actions.

This article begins with the claim that the Formula of Universal Law, interpreted as a test of the deontic status of actions, can't be made to work. If not, then one might wonder whether what other work it might do in the overall economy of Kant's ethics. I defend what I call the "formal constraint" interpretation of FUL, explaining how it can figure in a defense of the Formula of Humanity, and its psychological significance in moral thinking.

In substantial ways, the strangest aspects of Leibniz's wild metaphysical architecture (monads and all that) lie grounded in his efforts to understand the "unreasonable effectiveness" of the mathematics utilized in the classical modeling of ordinary materials (of which we will adopt sword steel as a chief paradigm, for reasons to be explained later). In doing so, Leibniz proceeds in a more acutely reasoned fashion than does Eugene Wigner in the famously fuzzy article from which the phrase "unreasonable effectiveness" descends. There (...) But "Explain all of this in one stroke, can you?"represents the usual rhetorical gambit of zealots urging us to abandon science for faith (although that was probably not Wigner's own intent'). This paper offers a new way to make sense of disagreement expansion from a polylogical perspective by incorporating various places in addition to players and positions into the analysis. The concepts build on prior implicit ideas about disagreement space by suggesting how to more fully account for argumentative context, and its construction, in large-scale complex controversies. As a basis for our polylogical analysis, we use a New York Times news story reporting on an oil train explosion—a significant point in the (...) broader controversy over producing oil and gas via hydraulic fracturing. The spectre of the repugnant conclusion and the search for a population axiology that avoids it has endured as a focus of population ethics. This is in part because the repugnant conclusion is often interpreted as a defining problem for totalism, while the implications of averagism and related views are taken to illustrate the theoretical cost of avoiding the repugnant conclusion. However, we show that this interpretation cannot be sustained unless one focuses only on a special case of the repugnant (...) conclusion: namely, the subset of instances of the repugnant conclusion where there is no portion of the population unaffected by the choice between population outcomes (as in Derek Parfit’s original illustration). To avoid an inappropriate focus on only this proper subset of instances of the repugnant conclusion, we formulate a general characterization of the repugnant conclusion. We then prove formally that all leading welfarist axiologies imply this conclusion, including averagism and Ng’s Theory X0 , including probabilistic and ‘very repugnant’ variants that involve the addition of negative lives. We then prove that the full range of axiologies considered by population ethics each imply an extended version of the repugnant conclusion, including axiologies that are incomplete, intransitive, rank-dependent, person-affecting, and/or pluralist. The upshot is that the repugnant conclusion does not ultimately tell against any approach to axiology, and the methodological requirement to avoid the repugnant conclusion should be dropped from population axiology. To surmount the notorious difficulties of defining life, we should evaluate theories of life not by whether they provide necessary and sufficient conditions for our current preconceptions about life but by how well they explain living phenomena and how satisfactorily they resolve puzzles about life. This study investigates how dispute-mediators handle impasse in the re-negotiation of divorce decrees by divorced couples. Three sources of impasse and three strategies for handling impasse are identified based on analysis of mediation transcripts. The concern here lies not so much in the disputant's arguments but in the discussion procedures dispute-mediators use to craft the disputant's argumentation into a tool to solve conflict. Their moves are understood here as a practice of reconstructing argumentative discourse that is neither naïve nor critical (...) but reconstruction as design. Mediator's reconstruction reveals a type of communication work in contemporary societies involved in the crafting of forums and formats that mediate argumentative communication. This work is often invisible and strategic which makes its interpretation, judgment, and development a challenge for pragma-dialectical theory. Formal arguments have proven that avoiding the Repugnant Conclusion is impossible without rejecting one or more highly plausible population principles. To many, such proofs establish not only a deep challenge for axiology, but also pose an important practical problem of how policymaking can confidently proceed without resolving any of the central questions of population ethics. Here we offer deflationary responses: first to the practical challenge, and then to the more fundamental challenge for axiology. Regarding the practical challenge, we provide an (...) overview of recent literature that explores the implications for public policy of the Repugnant Conclusion and related puzzles within population ethics, and shows that there is more commonality in the implications of different population axiologies than is generally recognized. The upshot is that uncertainty about population ethics presents no important problem for policymaking, and the importance of population ethics to policymaking has been overstated. We then turn to more fundamental issues about axiology, and describe a new series of formal proofs that undermine the idea that any plausible axiology could avoid the Repugnant Conclusion, including those that are assumed to avoid it in the literature. The philosophical upshot is that the Repugnant Conclusion cannot plausibly be avoided, and so it is a mistake to assume as a constraint on a plausible axiology that it must be avoided, as is assumed by most of the literature in population ethics, including by all of the fundamental impossibility theorems. Many people have been enraged lately by the enormous increases in certain generic prescription drugs. But free marketeers defend these prices by arguing that they simply represent what the market will bear, and in a capitalist society there is accordingly nothing wrong with charging them. This paper argues that such a defense is actually contrary to the very principles that free marketeers claim to embrace. These prices are not only unjust and exploitative, but government interference with them would not render (...) the market less free, at least if what it means for a market to be “free” is properly understood. ABSTRACT We consider several ways in which a good understanding of modern techniques and principles in physics can elucidate ecology, and we focus on analogical reasoning between these two branches of science. Analogical reasoning requires an understanding of both sciences and an appreciation of the similarities and points of contact between the two. In the current ecological literature on the relationship between ecology and physics, there has been some misunderstanding about the nature of modern physics and its methods. Physics is (...) seen as being much cleaner and tidier than ecology. When compared to this idealized, fictional version of physics, ecology looks very different, and the prospect of ecology and physics learning from one another is questionable. We argue that physics, once properly understood, is more like ecology than ecologists have thus far appreciated. Physicists and ecologists can and do learn from each other, and, in this paper, we outline how analogical reasoning can facilitate such exchanges. (shrink)

As with the problem of universals, late medieval thinkers were very concerned with the ontological status of relations, for they were central to numerous theological and philosophical problems. These relations were of various types: relations of identity, qualitative similarity, quantitative equality, causal relations, and intentional relations, such as those between knower and the object known. Each of these relations was taken to be an Aristotelian accident. Does it differ from the substance which is related? Broadly speaking, I have discovered four (...) alternative theories: as sentence of the form "a is related by a real relation R to b" is true only if the relation R is an extra-mental thing really distinct from a and b ; R only exists as a concept in a mind ; a and b exist in a certain real way ; the term "R" is connotative, signifying a directly and connoting b . Using printed sources and my critical edition of various codices, I ask the following thinkers whether a real relation is distinct from that which is related: Thomas Aquinas, Giles of Rome, Henry of Ghent, Richard of Middleton, John Duns Scotus, Henry of Harclay, Hervaeus Natalis, and Peter Aurioli. It is argued here that large-scale organization and networked computing enable new divisions of communicative work aimed at shaping the content, direction, and outcomes of societal conversations. The challenge for argumentation theory and practice lies in attending to these new divisions of communicative work in constituting contemporary argumentative realities. Goffman’s conceptualization of participation frameworks and production formats are applied to articulate the communicative work of organizations afforded by networked computing that invents and innovates argument in all of its senses—as product, (...) process, and procedure. Communicative work, however, may be scaffolding argumentative contexts and practices that are quite different than what has constituted past argumentative realities. The computerization of argument happens as organizations invent and innovate argument practice relative to the demands and opportunities of interorganizational communication. The cases and examples examined here suggest that argument practice is evolving around the logic of conversation and the principle of personalization. The analysis challenges argumentation theory to seriously engage with the construction of communicative contexts and the realization of ideas about disagreement management in organizational practice and information infrastructures. Directions for integrating insights from a design perspective on argument with insights from organizational and information systems theory are proposed for coming to terms with an era of large-scale organization and computerization, in particular the evolution of argument practice, the inscription of argument in the built environment, and the absorption of socio-cultural argument practices by organizations and computation. Her work covers the early modern philosophy of Elisabeth of Bohemia, Margaret Cavendish, (...) Ann Conway, Mary Astell, Damaris Cudworth Masham and Catherine Trotter Cockburn. She points out the paradoxical relationship between current feminist philosophy and the writings of early Modern women. Broad concentrates on the metaphysical issues of mind-body dualism, thinking matter, and the role of reason in knowledge.Recent feminists have argued that even though Cartesianism appears to emphasize an egalitarian concept of reason, it entails a male bias which excludes women from philosophy. Broad covers the work of Genevieve Lloyd, Hilda Smith, Margaret Atherton and other feminists. Her goal is to show that the common Cartesian interpretation of early women's writings obscures the anti-Cartesian and anti-dualist aspects of their thought. On the basis of her letters she contends that Elisabeth can be regarded as a precursor to feminist philosophers who give an equal role to the body and emotions in their metaphysical and ethical writings.Like Elisabeth, Margaret Cavendish rejects Cartesian dualism. The common thread that runs through early Modern feminist philosophy is the argument that interaction between two unlike substances is inconceivable. Broad argues that like Cavendish, Anne Conway ascribes spiritual characteristics to the body and material properties to the soul. According to Broad, their ontological views amount to a rejection of the stereotypes of femininity.Broad argues that Mary Astell's metaphysical views diverge from the modern Cartesians of her time. Although she is indebted to Descartes, Broad contends that she supports a metaphysical system which avoids some of the gender biases identifiable in Cartesianism. Astell, for example, does not find a life based on reason as a rival to a life concerned with the body; her emphasis on rationality is simply a reaction to the stereotype of women as irrational material beings.Damaris Masham is generally considered a philosophical rival of Astell, but Broad argues that Masham's arguments are focused on the same presuppositions as Astell's.
