Personal data use is increasingly permeating our everyday life. Informed consent for personal data use is a central instrument for ensuring the protection of personal data. However, current informed consent practices often fail to actually inform data subjects about the use of personal data. This article presents the results of a requirements analysis for informed consent from both a legal and usability perspective, considering the application context of educational assessment. The requirements analysis is based on European Union law and a (...) review of current practices. As the main outcome, the article presents a blueprint which will be the basis for the development of an informed consent template that supports data controllers in establishing an effective and efficient informed consent form. Because the blueprint, and subsequently, the template, distinguishes between legal and usability requirements, it also provides the basis for the mapping of legal requirements in other contexts. In this paper we suggest the existence of a generalized task-related cortical network that is up-regulated whenever the task to be performed requires the allocation of generalized non-specific cognitive resources, independent of the specifics of the task to be performed. We have labeled this general purpose network, the extrinsic mode network (EMN) as complementary to the default mode network (DMN), such that the EMN is down-regulated during periods of task-absence, when the DMN is up-regulated, and vice versa. We conceptualize the (...) EMN as a cortical network for extrinsic neuronal activity, similar to the DMN as being a cortical network for intrinsic neuronal activity. The EMN has essentially a fronto-temporo-parietal spatial distribution, including the inferior and middle frontal gyri, inferior parietal lobule, supplementary motor area, inferior temporal gyrus. We hypothesize that this network is always active regardless of the cognitive task being performed. We further suggest that failure of network up- and down-regulation dynamics may provide neuronal underpinnings for cognitive impairments seen in many mental disorders, such as, e.g., schizophrenia. We start by describing a common observation in functional imaging, the close overlap in fronto-parietal activations in healthy individuals to tasks that denote very different cognitive processes. We now suggest that this is because the brain utilizes the EMN network as a generalized response to tasks that exceeds a cognitive demand threshold and/or requires the processing of novel information. We further discuss how the EMN is related to the DMN, and how a network for extrinsic activity is related to a network for intrinsic activity. Finally, we discuss whether the EMN and DMN networks interact in a common single brain system, rather than being two separate and independent brain systems. (shrink)

Kant’s revolutionary new approach to philosophy was accompanied by the introduction of a largely novel terminology. With the Kant-Lexikon, a lexical reference gives the modern reader access to his work on the basis of present-day editions and takes into account 20th century and contemporary research and advances in lexicology. The Kant-Lexikon includes 2395 entries authored by 221 scholars.

Following in a psychological and musicological tradition beginning with Leonard Meyer, and continuing through David Huron, we present a functional, cognitive account of the phenomenon of expectation in music, grounded in computational, probabilistic modeling. We summarize a range of evidence for this approach, from psychology, neuroscience, musicology, linguistics, and creativity studies, and argue that simulating expectation is an important part of understanding a broad range of human faculties, in music and beyond.

Forensic genomics now enables law enforcement agencies to undertake rapid and detailed analysis of suspect samples using a technique known as massively parallel sequencing (MPS), including information such as physical traits, biological ancestry, and medical conditions. This article discusses the implications of MPS and provides ethical analysis, drawing on the concept of joint rights applicable to genomic data, and the concept of collective moral responsibility (understood as joint moral responsibility) that are applicable to law enforcement investigations that utilize genomic data. The widespread and unconstrained use of this technology without appropriate legal protections of individual moral rights and associated accountability mechanisms, could potentially not only involve violations of individual moral rights but also lead to an unacceptable shift in the balance of power between governments and the citizenry. We argue that in light of the rights of victims and the security benefits for society, there is a collective moral responsibility for individuals to submit their DNA to law enforcement and for MPS to be used where other, less invasive techniques are not effective. However, this application should be limited by legislation, including that any data obtained should be directly relevant to the investigation and should be destroyed at the conclusion of the investigation. In environmental ethics, many approaches are searching for a justification of the protection of nature and biodiversity via an account of the intrinsic or inherent value of non-human nature, i. e. a justification that does not rely on the perspective of human beings. This leads to intricate problems regarding value theory. This paper proposes to avoid those problems by investigating explicitly anthropocentric pathways. It discusses what kinds of reasons for the protection of nature can be developed from the consistent practical (...) self-understanding of agents. First, it is argued that the practical commitments of agents necessarily involve some normative commitments to the protection of the generic conditions of agency, which are particularly relevant for the ecological conditions that enable us to act and to realise goals. Second, it is discussed whether the presence of non-human nature is particularly relevant from the perspective of philosophical anthropology. Is it not important for human beings to experience non-human nature as an environment that is not fully planned and designed by human beings? The general aim is to show that it is worthwhile to search for justifications of the protection of nature and biodiversity from the practical self-understanding of human beings. (shrink)

The third and fourth books of Cicero's Tusculan Disputations deal with the nature and management of human emotion: first grief, then the emotions in general. In lively and accessible style, Cicero presents the insights of Greek philosophers on the subject, reporting the views of Epicureans and Peripatetics and giving a detailed account of the Stoic position, which he himself favors for its close reasoning and moral earnestness. Both the specialist and the general reader will be fascinated by the Stoics' analysis (...) of the causes of grief, their classification of emotions by genus and species, their lists of oddly named character flaws, and by the philosophical debate that develops over the utility of anger in politics and war. Margaret Graver's elegant and idiomatic translation makes Cicero's work accessible not just to classicists but to anyone interested in ancient philosophy and psychotherapy or in the philosophy of emotion. The accompanying commentary explains the philosophical concepts discussed in the text and supplies many helpful parallels from Greek sources. (shrink)

Using a policy-capturing approach with a broad student sample we examine how individuals’ economic, social and environmental values influence their propensity to engage in a broad range of sustainability-related corporate actions. We employ a multi-dimensional sustainability framework of corporate actions and account for both the positive and negative impacts associated with corporate activity—termed strength and concern actions, respectively. Strong economic values were found to increase the propensity for concern actions and the willingness to work in controversial industries. Individuals with balanced (...) values were as likely as those with strong economic values to pursue positive economic outcomes, but without the same downside potential for concern actions. We also found significant gender effects, with females being less likely to engage in concern actions and more supportive of social and environmental strength actions. (shrink)

The very title of Sidgwick’s great work is fascinating: the methods of ethics. We hear much—and persons a hundred years ago heard much—of the methods of science. But we hear very little of the methods of ethics. Is ethics a science? No, and Sidgwick never thought that it was. But he did think that the methods, or something of the spirit, of scientific investigation could be imported into ethical studies, with results which, though they would not necessarily be dramatic and (...) would certainly not be edifying, would nevertheless be worthwhile. Sidgwick himself characterized his work as “essentially an attempt to introduce precision of thought into a subject usually treated in a too loose and popular way”. “I have thought that the predominance in the minds of moralists of a desire to edify has impeded the real progress of ethical science; and that this would be benefited by an application to it of the same disinterested curiosity to which we chiefly owe the great discoveries of physics”. This chapter examines an apparent tension created by recent research on neurological development and genetics on the one hand and cognitive development on the other. It considers what it might mean for intrinsic signals to guide the initial establishment of functional architecture. It argues that an understanding of the mechanisms by which the body develops can inform our understanding of the mechanisms by which the brain develops. It cites the view of developmental neurobiologists Fukuchi-Shimogori and Grove, that the patterning of (...) the part of the brain responsible for our higher functions is coordinated by the same basic mechanisms and signaling protein families used to generate patterning in other embryonic organs. Ethics consultation is a commonly applied mechanism to address clinical ethical dilemmas. However, there is little information on the viewpoints of health care providers towards the relevance of ethics committees and appropriate application of ethics consultation in clinical practice. We sought to use qualitative methodology to evaluate free-text responses to a case-based survey to identify thematically the views of health care professionals towards the role of ethics committees in resolving clinical ethical dilemmas. Using an iterative and reflexive model we identified (...) themes that health care providers support a role for ethics committees and hospitals in resolving clinical ethical dilemmas, that the role should be one of mediation, rather than prescription, but that ultimately legal exposure was dispositive compared to ethical theory. The identified theme of legal fears suggests that the mediation role of ethics committees is viewed by health care professionals primarily as a practical means to avoid more worrisome medico-legal conflict. The aesthetics of masochism can be found in the 20th century across different media: pictorial and literary models influenced the history of comics, photographic art, and ultimately film. In his book ›Aus Leiden Freuden‹ (1940), Theodor Reik mentions three essential elements: 1. imagination, 2. suspense and 3. the demonstrative character of the masochistic scenario. This gives rise to the idea of masochistic performance: masochistic aesthetics need a stage on which they can unfold their imagination and the staging of suspense. Masochistic (...) performance plays with the desire for fear in the face of the threatening and sublime. Masochistic aesthetics therefore do not require the clear drasticness of pornography, but rather play with suspense, the tension of expectation in the face of the strange and dangerous – and with the pleasure of this fear. The apparent very close similarity between the learning of the past tense by Adam and the Plunkett and Marchman model is exaggerated by several misleading comparisons--including arbitrary, unexplained changes in how graphs were plotted. The model's development differs from Adam's in three important ways: Children show a U-shaped sequence of development which does not depend on abrupt changes in input; U-shaped development in the simulation occurs only after an abrupt change in training regimen. Children overregularize vowel-change verbs more than no-change (...) verbs; the simulation overregularizes vowel-change verbs less often than no-change verbs. Children, including Adam, overregularize more than they irregularize; the simulation overregularized less than it irregularized. Interestingly, the RM model--widely criticized as being inadequate--does somewhat better, correctly overregularizing vowel-change verbs more often than no-change verbs, and overregularizing more often than it irregularizes. Although Plunkett and Marchman's (1993) state of the art model incorporated hidden layers and back-propagation, used a more realistic phonological coding scheme, and explored a broader range of parameters than Rumelhart and McClelland's model, their results are farther from psychological reality. It is unknown whether any connectionist model can mimic a child's performance without resorting to unrealistic exogenous changes in the training or input, but it is clear that adding a hidden-layer and back-propagation does not ensure a solution. Is the human tendency toward musicality better thought of as the product of a specific, evolved instinct or an acquired skill? Developmental and evolutionary arguments are considered, along with issues of domain‐specificity. The article also considers the question of why humans might be consistently and intensely drawn to music if musicality is not in fact the product of a specifically evolved instinct.

This paper elaborates on the value of a humanistic approach to the production and judgement of sociological knowledge by defending this approach against some common criticisms. It argues that humanising sociological knowledge not only lends an appropriate epistemological humility to the discipline, but also encourages productive knowledge development by suggesting that a certain irreverence to what is considered known is far more important for generating useful new perspectives on social phenomena than defensive vindications of existing knowledge. It also suggests that (...) the threat of what is called “relativism” evoked by critics of humanised conceptions of knowledge is largely illusory, and that in fact a far graver danger comes from dogmatic assertions of social truth that claim to have somehow secured access to non-contingent arenas of knowing, forestalling ongoing conversation, and tying future discovery to the limits of current perspectives. The transition from form to meaning is not neatly layered: there is no point where form ends and content sets in. Rather, there is an almost continuous process that converts form into meaning. That process cannot always take a straight line. Very often we hit barriers in our mind, due to the inability to understand the exact content of the sentence just heard. The standard division between formula and interpretation (or value) should therefore be given up when talking about the (...) process of understanding. Interestingly, when we do this it turns out that there are 'easy' formulae, those we can understand without further help, and 'difficult' ones, which we cannot. (shrink)

Common sense explanations of human action are often framed in terms of an agent's beliefs and desires. Recent widely received views also take believing and desiring as attitudes of an agent to linguistic or quasi‐linguistic entities. It is here claimed that such a narrow view of cognitive attitudes is not supportable, since even among lingual non‐verbal responses are often overriding evidence for belief and desire, even where they run counter to sincere verbal assents. The view is also curiously non naturalistic (...) in that it disallows ascribing beliefs and desires altogether to non‐lingual and pre‐lingual. In the present paper a “common sense” explanation of action in accordance with the triad Desire, Belief, Action, is seen as a useful phenomenological “theory” provided that language centrality is not taken as essential. The dominant theory of the evolution of moral cognition across a variety of fields is that moral cognition is a biological adaptation to foster social cooperation. This chapter argues, to the contrary, that moral cognition is likely an evolutionary exaptation: a form of cognition where neurobiological capacities selected for in our evolutionary history for a variety of different reasons—many unrelated to social cooperation—were put to a new, prosocial use after the fact through individual rationality, learning, and the development and transmission (...) of social norms. This chapter begins with a brief overview of the emerging behavioral neuroscience of moral cognition. It then outlines a novel theory of moral cognition that I have previously argued explains these findings better than alternatives. Finally, it shows how the evidence for this theory of moral cognition and human evolutionary history together suggest that moral cognition is likely not a biological adaptation. Instead, like reading sheet music or riding a bicycle, moral cognition is something that individuals learn to do—in this case, in response to sociocultural norms created in our ancestral history and passed down through the ages to enable cooperative living. In classical Chinese philosophy, the best kind of life is a life lived in line with the Dao (the “Way”). A core feature of this kind of life is attaining the ideal of wu-wei. In early Daoist writings, wu-wei denotes an ideal way of acting. However, since wu-wei is normally translated as “no-action” these ancient texts give us a picture of the best kind of life that may appear paradoxical to many philosophers. In this paper, I suggest a way to (...) make sense of this classical ideal. I argue that by applying a Merleau-Pontyian framework of action we can arrive at a non-paradoxical reading of wu-wei. On this reading, wu-wei is essentially manifested in a specific way we are aware of what we are doing. (shrink)

Technological development plays a critical role in society’s ability to address environmental issues. Building on Teece’s profiting from innovation framework, we articulate how a double-externality problem weakens the appropriability regime surrounding pollution reduction technology (PRT). We then develop a theoretical framework articulating how weak appropriability induces firms to modify their innovation strategies for PRT development by increasing the extent to which they engage in organizational exploration (rather than exploitation) and emphasizing incremental (rather than radical) technologies. Noting that the effects of (...) weak appropriability are unlikely to be static, we detail how the accumulation of organizational capabilities for reducing pollution diminishes the extent to which firms modify their innovation strategies for PRT. That is, firms become less exploratory and less focused on incremental technology as they gain experience with pollution reduction. Results of broad-sample empirical analyses of 206,277 patents held by 203 U.S. manufacturing firms over a 20-year period provide support for our framework. (shrink)

Plato’s Ion can be read as exposure of the relationship between text and performance. It’s a philosophical dialogue that exploits performative arguments and situations. I’ll make explicit these dramatic assumptions in the following translation of the Plato’s text.

This manuscript departs strongly from conventional accounts that ascribe a central role to war and the threat of war in Third World state building. Similarly, it challenges the conventional wisdom that abundant exportable natural resource wealth is likely to provoke institutional atrophy. Instead, it argues that a set of logically prior conditions—the social relations that govern the principal economic sectors and the pattern or intraelite conflict or compromise—launch path-dependent processes that help determine when, and if, either strategic conflict or resource (...) wealth contribute to, or impede, institutional development. The argument is tested in the comparative analysis of the state-building process in two Andean neighbors, both of which are situated in similar strategic and natural resource environments but which produced qualitatively different outcomes in terms of state capacity or “strength.”. Treatment-resistant depression (TRD) holds centrality in many debates regarding psychiatric euthanasia. Among the strongest reasons cited by opponents of psychiatric euthanasia is the uncertainty behind the irremediability of psychiatric illnesses. According to this argument, conditions that cannot be considered irremediable imply that there are possible remedies that remain for the condition. If there are possible remedies that remain for the condition, then patients with that condition cannot be considered for access to euthanasia. I call this the irremediability requirement (IR). I (...) argue that patients with TRD can, indeed, meet the operationalisation of irremediability in the IR. This is because the irremediability it asks for is not some global or absolute irremediability, but rather a present irremediability based on the current state of medical science. I show this by considering irremediability relating to (1) possible future treatments and (2) not trying presently available alternative treatments. I extend Schuklenk nd van de Vathorst’s argument from parity to terminal malignancies, to show that (1) is an unreasonable expectation for all cases of euthanasia. Taking (2) as a more serious opponent to psychiatric euthanasia, I show how the IR, based on how it is presently operationalised, can be realistically applied to cases of TRD. I do this by further developing Tully’s argument on broad-sense treatment resistance with the robust empirical data from the STAR*D trials. If my argument from Tully’s is valid, then we have reasons to, again, seek parity between the operationalisations of irremediability in terminal malignancies and TRD. (shrink)

Our aim is to propose several itineraries which follow the scenario having as a first step Euclid’s Fifth Postulate; as a second step the Bolyai–Lobachevsky’s non-Euclidean geometries and as a third step Einstein’s relativity theory. The role of Euclid’s fifth postulate is successively assumed by Archimedes’ axiom; Zermelo’s choice axiom; Cantor’s continuum hypothesis; von Neumann’s foundation axiom for set theory; Church–Turing thesis and Turing’s computability; the validity of classical logic under the form of the principles of identity, non-contradiction and excluded (...) middle; the macroscopic universe assumed as form of existence, including the fact that humans are macroscopic beings; human language and semiosis assumed as the unique way to approach understanding and communication; the old Greek ideal of order, symmetry and harmony, adopted for representation of the world in Art and Poetry. The common denominator of these starting steps is the fact that they all correspond to the sensorial-empirical perception of the world. We point out the strong interaction among the steps corresponding, in these different itineraries, to Einstein’s relativity theory. We infer in this way the need of a transdisciplinary approach. Critique currently leads a life akin to a zombie. It is torn between attempts to surpass it and radical gestures of its dismissal, while moderate forces dwell on the business of inventorying its history. Starting from critique’s historical turn on itself, this essay focuses on destabilization and self-questioning as its essential features. Regarding Adorno’s model, it seeks to locate critique’s focal point before it was split by surpassing and dismissal. This model is still challenging because it is situated at a (...) crossroads in critical thinking where the historical aspect of failure is tied to structural aspects of critique: resistance, disruption, and dissolution. It concerns a movement of critique that leads into delirium—without thereby abandoning its claim to objectivity. In the contemporary situation, where critique is at once generalized and dismissed, it is precisely the specific link of disrupting and claiming objectivity that challenges the universalized regime of opinion. It is often argued that Michael Walzer’s theory of social criticism, which underpins his theory of justice, is not much of a theory at all, but rather an impressionistic collection of historical anecdotes. Contrary to this perception, I argue that Walzer’s method can be accurately described as a version of John Rawls’ well-known method of wide reflective equilibrium. Through a systematic comparison it can be shown that the two methods are strikingly similar. This implies that, far from the critics’ claim, (...) Walzer’s method can be described as a philosophically sophisticated method. This also adds credibility to Walzer’s views on politics and justice. (shrink)
