Background: The phenomenon of forceful physical restraint in pediatric care is an ethical issue because it confronts professionals with the dilemma of using force for the child’s best interest. This is a paradox. The perspective of healthcare professional working in pediatric wards needs further in-depth investigations. Purpose: To explore the perspectives and behaviors of healthcare professionals toward forceful physical restraint in pediatric care. Methods: This qualitative ethnographic study used focus groups with purposeful sampling. Thirty volunteer healthcare professionals (nurses, hospital aids, (...) physiotherapists, and health educators) were recruited in five pediatric facilities in four hospitals around Paris, France, from March to June 2013. The data were processed using NVIVO software (QSR International Ltd. 1999–2013). The data analysis followed a qualitative methodological process. Ethical Considerations: The research was conducted in compliance with the Declaration of Helsinki. Written informed consent was collected systematically from participants. Findings: This study provides elements to help understand why restraint remains common despite its contradiction with the duty to protect the child and the child’s rights. All participants considered the use of forceful physical restraint to be a frequent difficulty in pediatrics. Greater interest in the child’s health was systematically used to justify the use of force, with little consideration for contradictory or ethical aspects. Raising the issue of forceful restraint always triggered discomfort, unease and an outpour of emotions among healthcare professionals. The findings have highlighted a form of hierarchy of duties that give priority to the execution of the technical procedure and legitimize the use of restraint. Professionals seemed to temporarily suspend their ability to empathize in order to apply restraint to carry out a technical procedure. This observation has allowed us to suggest the concept of “transient empathic blindness.” Conclusion: Using physical restraint during pediatric care was considered a common problem by participants. This practice must be questioned, and professionals must have access to training to find alternatives to strong restraint. Conceptualizing this phenomenon with the concept of “transient empathic blindness” could help professionals understand what happens in their minds when using forceful restraint. (shrink)

As artificial intelligence technologies become increasingly prominent in our daily lives, media coverage of the ethical considerations of these technologies has followed suit. Since previous research has shown that media coverage can drive public discourse about novel technologies, studying how the ethical issues of AI are portrayed in the media may lead to greater insight into the potential ramifications of this public discourse, particularly with regard to development and regulation of AI. This paper expands upon previous research by systematically analyzing (...) and categorizing the media portrayal of the ethical issues of AI to better understand how media coverage of these issues may shape public debate about AI. Our results suggest that the media has a fairly realistic and practical focus in its coverage of the ethics of AI, but that the coverage is still shallow. A multifaceted approach to handling the social, ethical and policy issues of AI technology is needed, including increasing the accessibility of correct information to the public in the form of fact sheets and ethical value statements on trusted webpages, collaboration and inclusion of ethics and AI experts in both research and public debate, and consistent government policies or regulatory frameworks for AI technology. This article explores Leila Ahmed’s A Border Passage, and Nawal El Saadawi’s Memoirs from the Women’s Prison, A Daughter of Isis, and Walking Through Fire. It contrasts their works and argues that location and genderawareness play an important role in the writing of autobiographies. The focus is on showing how El Saadawi’s positioning as a feminist activist in Egypt and Ahmed’s location in the USA determine the texts’ themes and shape the construction of the autobiographical “I.”.

This edited volume is a comprehensive presentation of views on the relations between metaphysics and logic from Aristotle through twentieth century philosophers who contributed to the return of metaphysics in the analytic tradition. The collection combines interest in logic and its history with interest in analytical metaphysics and the history of metaphysical thought. It is difficult to understand the meaning of ‘dignity’ in human rights, bioethics and nursing literature because the word is used so vaguely. Unless dignity’s meaning is spelt out it can disappear beneath more tangible priorities. In this article we define dignity and show how this can help health workers to maintain the dignity of people in their care.

الحرب، بلا شك، تمثّل ساحة القتل والقتال والسعي لإضعاف طرف العدوّ. إلا أنّها ليست بأي حال من الأحوال مكانًا لاستحلال أي فعل؛ على الرغم من وجود قواعد الحرب وقوانينها التي تنظم سلوك المقاتلين، إلا أنّ هناك أفعالًا معينة تعتبر مجرمة ومحظورة حتى وإن وقعت في زمن الحرب. يطلق على هذه الأفعال مصطلح "جرائم الحرب"، وهي تندرج ضمن إطار القانون الدولي الإنساني. فعلى الرغم من عدم اعتماد الفقه الإسلامي على مصطلح "جرائم الحرب" بشكل صريح، إلا أنّ فكرتها ومضمونها متجذر في كتب (...) الفقه الإسلامي، خاصة في أبواب الجهاد والسير، عند الكلام عن أخلاق الحرب وآدابها. يأتي هذا البحث ليسلّط الضوء على جهود الباحثين في إرساء مفهوم جرائم الحرب من ناحية فقهية، محاولا دراسة أهم أركان جريمة الحرب كونها جريمة دولية. بالإضافة إلى ذلك سيحاول هذا البحث تناول النصوص المؤسسة لتوجه الشريعة في تجريمها لبعض الأفعال والسلوكيات والتصرفات في أثناء القتال، وأبرز تلك الأفعال والسلوكيات المجرمة شرعا والمُدرجة كجريمة حرب يمكن ترتيب عقوبة عليها، فتنصّ الشريعة الإسلامية على أنّ المقاتل ليس حرًّا في ارتكاب أي فعل يريده خلال القتال، بل جعلت لذلك قواعد وضوابط حاكمة ومنظمة لسلوكه في إطار تنظيمها للحرب والنزاعات المسلحة. تضمّنت تلك القواعد الأخلاقية التي طوّرتها الشريعة الإسلامية تنظيمًا دقيقًا لسلوك المسلمين في الحروب والقتال، حيث فرّقت بين المقاتلين وغير المقاتلين في جواز الاستهداف وعدم الجواز، فجرّمت ومنعت استهداف فئات معينة من الأشخاص مثل المدنيين والجرحى وأضفت الحماية عليهم، وأدخلت في مسمّى المدنيين كل الفئات التي لا يصبّ مجهودها في العمليات الحربية مثل الأطفال والنساء وكبار السن وغيرهم. كما تضمّنت القواعد الشرعية التي وضعتها الشريعة الإسلامية حماية لأسرى الحرب، حيث تم تحديد وضعية خاصة لهم تضمن لهم الحماية والمعاملة الإنسانية، ومنعت تعذيبهم أو إكراههم على اعتناق الإسلام. وتجدُر الإشارة إلى أنّ الشريعة الإسلامية لم تقتصر على تجريم استهداف الأفراد فحسب، بل نصّت أيضًا على تجريم استهداف الأموال والأعيان المدنية التي لا يستعملها العدو في الحرب، أو التي تكون كطرف محايد مثل المستشفيات ودور العبادة والأماكن التاريخية والأثرية. ولعلّ التجربة التاريخية الإسلامية خلال الفترة النبوية وفترة الخلفاء الراشدين حين فتوحهم، وتاريخ المسلمين من بعدهم في الحروب يُعدُّ أبرز انعكاس على تلك القواعد الشرعية التي وضعتها الشريعة الإسلامية، فالتزم المسلمون في حروبهم بتلك القواعد فلم يعرف التاريخ حروبا أكثر إنسانية من حروب المسلمين. This article discusses findings from a mixed method literature review that investigated cancer patients’ perceptions of what constitutes a good nurse. To find pertinent articles, we conducted a systematic key word search of five journal databases (1998—2008). The application of carefully constructed inclusion criteria and critical appraisal identified 12 relevant articles. According to the patients, good nurses were shown to be characterized by specific, but inter-related, attitudes, skills and knowledge; they engage in person-to-person relationships, respect the uniqueness of patients, and (...) provide support. Professional and trained skills as well as broad and specific nursing and non-nursing knowledge are important. The analysis revealed that these characteristics nurtured patient well-being, which manifests as optimism, trust, hope, support, confirmation, safety and comfort. Cancer patients’ perceptions of what constitutes a good nurse represent an important source of knowledge that will enable the development of more comprehensive and practice-based views on good nursing care for such patients. These perceptions help us to understand how nurses effectively make a difference in cancer patient care. (shrink)

The impact of stress and other psychological variables on Inflammatory Bowel Disease prognosis, treatment response, and functional level is well-established; however, typical IBD treatment focuses on the physiological pathology of the disease and neglects complementary stress-reducing interventions. Recent pilot studies report the benefits of mindfulness-based interventions in people living with IBD, but are limited by small sample sizes. Recruitment challenges to in-person studies may be in part due to the difficulty IBD patients often have adhering to fixed schedules and travel (...) as a result of IBD symptoms such as pain, fatigue, and incontinence. The current study aimed to address this barrier by offering participants access to online mindfulness training, allowing individuals to engage with intervention materials to fit their own schedule. Online mindfulness programs have gained popularity in recent years, as they increase access and flexibility and decrease cost to the user; however, the dropout rate tends to be high. The current study compared the rate of adherence and efficacy of mindfulness training as a function of level of support: self-guided versus supported. Analysis revealed no significant difference in the benefits received between participants in the two groups; however, a significant difference group was found in terms of rate of completion, with 44.1% of the supportive group completing the protocol compared to 11.7% of the self-guided. Common challenges to meditation were measured, but did not significantly predict adherence to the intervention, and experience of these challenges did not significantly change over the duration of the study. Implications of the current research, future directions for the use of MBI for IBD patients, and a discussion of methodological considerations are provided. (shrink)

Background: It is essential to pay attention to and respect the dignity of nurses to maintain them in their profession while they deliver skilled nursing care. Little is known, however, about how a sense of dignity influences the practitioner. Objectives: The purpose of this study is to describe nurses’ experiences of threats to their dignity occurring within clinical settings, which generates an intention to leave clinical practice. Research design and method: The study was performed using qualitative content analysis. The participants (...) were 21 clinical nurses with work experience who were employed across a range of clinical posts. Data obtained from the semi-structured interviews were analyzed and interpreted using a content analysis approach. Ethical considerations: The study was approved by the Ethics Committee of Tabriz University of Medical Sciences and was guided by the ethical principles of voluntary enrolment, anonymity, privacy, and confidentiality. Findings: Within data analysis, three main themes and nine categories were extracted as follows: (1) lack of professional pride (physician’s dominance, intangible nature of nursing, and negative attitude toward clinical nurses); (2) oppressive work environment (high workload, disrespect, discrimination, and lack of support); and (3) suppression of progressivism (lack of appreciation and attention to meritocracy). Discussion: Almost all of the participants have experienced some degree of disrespect and violation of dignity. In general, attempts made by the participants to show their objection to the threats and to support and protect their dignity have not been effective and in fact made them more inclined to leave the clinical work. Conclusion: According to the views of nurses themselves, identification of the factors threatening nurses’ dignity can be one of the appropriate solutions for the broader and deeper investigation of this phenomenon and can help promote and support nurses’ dignity and their retention within the profession. This article presents the results of a case study that aims to highlight the processes by which French female migrants in London and Manchester attempt to de/re/construct identities to negotiate the challenges of the cultural and social structures in England. This research centres on 15 semi-structured interviews with French women residents of diverse backgrounds. The interviews conducted represent counter-narratives to existing studies which focus only on highly skilled French migrants in London and define them as free movers and ‘invisible migrants’. (...) This study attempts to fill a gap by examining solely French women migrants in Manchester and London as a strategic research site for a number of key research questions taken from the current literature of intra-European migration, gender and identity. Indeed, the ways in which migrants negotiate their identity are crucial to migration studies and have to be analysed in relation to women’s specific experience. The study exemplifies how migrants’ identities are a ground of negotiation, contestation, deconstruction and reconstruction. Patterns that emerged in this study first highlight the high heterogeneity among women’s strategies of self-identification and definition and sense of belonging in a changing Europe. The article concludes by proposing a refined notion of transculturality as a useful concept for future explorations of changes in contemporary European societies and the role women can have in them. The process of agricultural unification will dominate the German scene for the next few years. At this stage, however, analysis and forecasts are hampered by the considerable problem concerning the viability of East German agriculture in a market economy and by the absence of reliable data in the German Democratic Republic (GDR). This can only be understood in terms of the agricultural situation in the GDR before unification, which is discussed in the first section. The political and economic incentives for (...) German unification are described in the next section of this paper, focusing especially on the integration of the GDR into CAP. The third section considers some critical structural, legal, social, and economic constraints in the process of integrating the two agricultural systems. Finally, the implications for German agriculture as well as the challenges for the CAP will be addressed. Data were collected from interviews with key agricultural policy makers, farm organizations, commodity groups, consumer groups, and agricultural experts, as well as interviewing East German farmers. Additional data were compiled from government statistics, EC publications, and press reports. The conclusions reached in this research show the urgent need for the German government to reconsider the objectives and rationale for structural policies in agriculture, and point out that the new Germany, itself full of paradoxes and uncertainty, stands at the center of European agricultural disorder. Background: Compassionate care is an international priority of healthcare professionals. There is little understanding about how workplace issues impact provision of compassionate care in nursing practice. Therefore, it is important to address the workplace issues and organizational factors which may hinder compassionate care delivery within nursing practice. Objective: The aim of this study was to explore workplace and organizational barriers to compassionate care from the nurses’ perspective. Research design: The study used a qualitative exploratory design, and data were analyzed by (...) conventional content analysis. Participants and research context: A total of 15 nurses working in different fields of nursing were recruited from four hospitals at northwest of Iran. Participants were selected by purposive sampling. Semistructured interviews were conducted for data collection. Ethical consideration: Ethical approval of this study was gained from the Ethical Review Board of Tabriz University of Medical Sciences. Findings: The main theme which emerged from data analysis was “unsupportive organizational culture.” This theme had two main categories including “excessive workload alongside inadequate staffing” and “the lack of value on compassionate care.” Discussion: Organizational barriers to development of compassionate in clinical practice were identified in this study. A closer examination of these barriers is required to move compassionate practice from an individual responsibility to a collective responsibility that is owned and shared by organizations. Conclusion: For compassionate care to flourish, policy makers, managers, and healthcare providers must foster an organizational atmosphere conducive to compassionate care. (shrink)

Dung’s (1995) argumentation framework takes as input two abstract entities: a set of arguments and a binary relation encoding attacks between these arguments. It returns acceptable sets of arguments, called extensions, w.r.t. a given semantics. While the abstract nature of this setting is seen as a great advantage, it induces a big gap with the application that it is used to. This raises some questions about the compatibility of the setting with a logical formalism (i.e., whether it is possible to (...) instantiate it properly from a logical knowledge base), and about the significance of the various semantics in the application context. In this paper we tackle the above questions. We first propose to fill in the previous gap by extending Dung’s (1995) framework. The idea is to consider all the ingredients involved in an argumentation process. We start with the notion of an abstract monotonic logic which consists of a language (defining the formulas) and a consequence operator. We show how to build, in a systematic way, arguments from a knowledge base formalised in such a logic. We then recall some basic postulates that any instantiation should satisfy. We study how to choose an attack relation so that the instantiation satisfies the postulates. We show that symmetric attack relations are generally not suitable. However, we identify at least one ‘appropriate’ attack relation. Next, we investigate under stable, semi-stable, preferred, grounded and ideal semantics the outputs of logic-based instantiations that satisfy the postulates. For each semantics, we delimit the number of extensions an argumentation system may have, characterise the extensions in terms of subsets of the knowledge base, and finally characterise the set of conclusions that are drawn from the knowledge base. The study reveals that stable, semi-stable and preferred semantics either lead to counter-intuitive results or provide no added value w.r.t. naive semantics. Besides, naive semantics either leads to arbitrary results or generalises the coherence-based approach initially developed by Rescher and Manor (1970). Ideal and grounded semantics either coincide and generalise the free consequence relation developed by Benferhat, Dubois, and Prade (1997), or return arbitrary results. Consequently, Dung’s (1995) framework seems problematic when applied over deductive logical formalisms. (shrink)

Sterilisation is the most desired method of contraception worldwide. In 1996, the Brazilian Congress approved a family planning law that legitimised female and male sterilisation, but forbade sterilisation during childbirth. As a result of this law, procedures currently occur in a clandestine nature upon payment. Despite the law, sterilisations continue to be performed during caesarean sections. The permanence of the method is an important consideration; therefore, information about other methods must be made available. Tubal sterilisation must not be the only (...) choice. We argue that review of this restriction will not contribute to the increase in caesarean sections but will allow for greater sterilisation choice for men and women. (shrink)

Iran is the only Muslim country that has legislation on embryo donation, adopted in 2003. With an estimated 10–15% of couples in the country that are infertile, there are not any legal or religious barriers that prohibit an infertile couple from taking advantage of Assisted Reproductive Technologies (ARTs). Although all forms of ARTs available in Iran have been legitimized by religious authorities, there is a lack of legislation in all ARTs except embryo donation. By highlighting ethical issues in embryo donation, (...) the paper presents a critical review of the Act of Embryo Donation in Iran. The paper argues that the Act does not provide enough safeguards for the future child and assurance for the safety of the donated embryos. It also does not restrict embryo donation to surplus embryos from infertile couples and is silent about the number of embryos that could be donated by each couple as well as the number of recipients for donated embryos by a couple. The Act is also silent about the issues of genetic linkage (nasab) and heritage which are challenging issues, especially in a conservative Islamic society. As a result, the future child may not inherit from their birth parents, as it is not required by the Act, or from the genetically related parents under the anonymity policy. Finally there is no standard national protocol or guidelines to evaluate the safety of the donated embryos. The paper concludes that despite its benefits, the Act lacks clarity, and it is subject to misunderstanding and confusion. (shrink)

During a dialogue, agents exchange information with each other and need thus to deal with incoming information. For that purpose, they should be able to reason effectively about trustworthiness of information sources. This paper proposes an argument-based system that allows an agent to reason about its own beliefs and information received from other sources. An agent's beliefs are of two kinds: beliefs about the environment and beliefs about trusting sources . Six basic forms of trust are discussed in the paper (...) including the most common one on sincerity. Starting with a base which contains such information, the system builds two types of arguments: arguments in favour of trusting a given source of information and arguments in favour of believing statements which may be received from other agents. BPA Production and Associated Health Risks Bisphenol A is a chemical agent found in many everyday products, including canned goods and plastic food containers. BPA exposure is linked to a variety of adverse health effects, such as obesity and diabetes. To protect the public's health — especially the health of vulnerable fetuses, infants, children, and pregnant women — BPA regulations should encompass products intended specifically for these populations. Even with tremendous public outcry against the use of BPA, current federal restrictions (...) do not reach far enough. The U.S. Food and Drug Administration recently banned the use of BPA in children's sippy cups and baby bottles, but failed to address its inclusion in canned infant formula or plastic tableware.BPA production began in the 1950s to make epoxy resins and was later employed to create polycarbonate plastic products. No presente artigo, interessa-nos apontar algumas possibilidades acerca da presença, no século X, da obra Formula Vitae Honestae, escrita por Martinho de Braga, que viveu na Galiza no século VI, na biblioteca de San Millán de la Cogolla, mosteiro localizado em La Rioja. De acordo com nossas conclusões, ainda parciais, vinculamos tal presença à identificação dos dois momentos históricos, o da Galiza no século VI e por La Rioja no X, marcados pela reorganização eclesiástica e monárquica.

A concretização do direito à saúde deve ser viabilizada pelo Estado, com foco na efetivação das políticas públicas para garantia da implantação e funcionamento dos serviços demandados pelos respectivos grupos populacionais. Destarte, essa escrita objetivou analisar como o direito à saúde é contemplado em comunidades quilombolas de uma região geográfica baiana. Metodologicamente enquadra-se como de abordagem qualitativa, com informações obtidas por meio de entrevistas estruturadas (sobre a infraestrutura e/ou serviços públicos de saúde) desenvolvidas com as representações das Associações de Moradores (...) de 14 quilombos da região geográfica de Guanambi/Bahia durante o ano de 2016. Os achados indicam que uma comunidade possuía estrutura física específica para atendimentos básicos em saúde, no entanto, estava desativada. Três comunidades não tinham cobertura do Programa de Agentes Comunitários de Saúde (PACS). Entre as 11 que indicaram cobertura do Programa, em sete as(os) profissionais não residiam no território do quilombo. Diante da ampla ausência de infraestrutura e recorrente inadequação na prestação de serviços do PACS, evidencia-se a permanente negligência ao direito à saúde nesta população quilombola. (shrink)

Many organizations must adjust their supply chains and business environments to remain competitive and retain market share. However, despite the benefits of such developments for organizations, they can lead to supply chain disruptions in many cases. An essential aspect of modern organizations is closed-loop supply chain management, which reduces risk by coordinating processes. This paper presents a mathematical model of a closed-loop green supply chain under uncertain conditions. A detailed description of the model and current assumptions for a specific industry (...) are provided. Consequently, the model is developed with several relevant objectives for the design of the network. Our proposed model has the following characteristics: being multiobjective, multiproduct, and multiperiodic. Our analysis indicates that the applied model can be used both to increase profitability and to reduce environmental damage. The problem was made more uncertain using fuzzy logic. Torabi and Hassini method is combined with Jiménez’s proposed method to solve the problem. (shrink)

Merleau-Ponty se vale de casos patológicos para elaborar una teoría de la percepción que ubica a la corporalidad como expresión central. El artículo indaga y problematiza la experiencia de enfermedad a partir de la propuesta fenomenológica en torno al cuerpo vivido o fe-nomenal. Repensar esta vivencia, desde las antípodas a un abordaje biomédico que la circunscribe a un cuerpo objetivo, permite considerarla a la luz de una perspectiva filosófica como instancia crítica. La experiencia de enfermedad, inaugura una disrupción en el (...) modo de ser-en-el-mundo e introduce la inhabitualidad, como dimensión que participa de una reconfiguración necesaria del esquema corporal. Este aspecto permite repensar los procesos de salud/enfermedad y discutir con concepciones de índole restitutivas, tan características a la hora de abordar los mismos.Merleau-Ponty uses pathological cases to elaborate a theory of perception that places corporality as the central expression. The article investigates and problematizes the experience of illness from the phenomenological proposal around the lived or phenomenal body. Rethinking this experience, from the antipodes to a biomedical approach that circumscribes it to an objective body, allows us to consider it in the light of a philosophical perspective as a critical instance. The experience of illness inaugurates a dis-ruption in the way of being-in-the-world and introduces the unusual, as a dimension that participates in a necessary reconfiguration of the body scheme. This aspect allows to rethink the health / disease processes and to discuss with concepts of a restorative nature, so characteristic when it comes to addressing them. (shrink)

Este artigo insere-se numa reflexão teórico-epistémica e metodológica sobre as formas biográficas no âmbito de um projeto de investigação centrado na experiência de mulheres que vivem com cancro da mama. Em termos metodológicos, recuperamos o valor heurístico da narrativa e da técnica da entrevista como um dos recursos de investigação mais férteis para o estudo da experiência. O artigo contribui para considerar as formas biográficas e o seu particular contributo para os estudos da socioantropologia da saúde, a centralidade da narrativa na sua capacidade configurativo-temporal e o lugar que a experiência da doença pode assumir como rutura biográfica no quadro de uma globalidade biográfica, face a contextos e cenários socioculturais. Estes aspectos actuam e orientam os posicionamentos subjectivos nos modos de narrar-se para dar conta de si, como uma narração incompleta, imersa em descontinuidades e opacidades no processo de configuração biográfica. Today, the US pursues the global capture of data (understood as a significant engine of growth) by way of bi- and plurilateral trade agreements. However, the project of securing the global free flow of data has been pursued ever since the dawn of digital telecommunication in the 1960s and the US has made significant legal efforts to institutionalise it. These efforts have two phases: In the first 1970s and 80s “freedom of information” phase, the legal justification (and contestation) of the (...) global free flow of data hinged on imagining data as information, and its exchange as a practice of liberty. The second phase began in the late 1990s and continues today. In this phase, the free flow of data is aligned with a free-trade agenda in the context of first e-commerce and, starting in the 2000s, through attempts at creating a global public domain of personal data for the platform economy. The global free flow of data is an intrinsic aspect of informational capitalism. Assuming a constitutive, but not commanding role for law in informational capitalism, we conclude that the US attempt at ensuring free flow for its informational corporations is neither an entirely contingent nor a necessary outcome. Rupp Queer Dilemmas of Desire The dilemmas of desire confronting young women in contemporary US society are all too familiar. In the face of the persistent double standard that separates sluts from good girls, young women mobilize a variety of strategies: they lack desire, deny desire, restrain desire, police desire, and sometimes embrace desire. (...) They confront expectations to be sexy but not too sexual even as they insist on the right to be just as sexually active as men. Even in the hookup scene on college campuses, potentially liberating in its facilitation of noncommittal sexual encounters, young women worry about hooking up too much. It is a familiar story, but one that most often leaves behind young women with queer desires. Where they do appear, there are hints that they are not as likely to suppress their desires as straight women, no doubt because it is hard to ignore one’s desires when they fly in the face of heteronormative expectations. But it is also hard to come to grips with queer desires, and that is why the dilemmas I explore here are different. Unlike young straight women working to control their desires, the queer students whose stories I tell report awareness and acceptance of their attractions, sometimes from a very young age. Yet they encounter other kinds of dilemmas, especially uncertainty about the boundary between erotic love and intense friendship, a dilemma harking back to an earlier world of romantic friendship. And in the end, despite a contemporary social context in which nonnormative sexualities are more visible than ever before, 68 Leila J. Rupp experiencing queer desires continues to elicit confusion. Much has changed, but much has not. We know a great deal about straight dilemmas of desire. On the one hand, the double standard that separates sluts from good girls has persisted, despite the loosening of restrictions we associate with the sexual revolution of the long 1960s. In the face of slut shaming, young women continue to mobilize a variety of strategies, which Deborah Tolman has documented so eloquently in Dilemmas of Desire. Young women of color face additional obstacles to enjoying their desire, as the Latina girls we encounter in Lorena Garcia’s Respect Yourself, Protect Yourself make clear through their policing of their own and other girls’ sexuality in the face of racist stereotypes of unrestrained sexuality and teenage motherhood.1 On the other hand, a whole raft of commentators depict young women increasingly insisting on the right to be just as sexual as men. From Ariel Levy’s Female Chauvinist Pigs to Peggy Orenstein’s Girls and Sex to Nancy Jo Sales’ American Girls, critics lament young women embracing sex as a form of empowerment.2 The tension arising from the contradictory responses of young women to the demands placed on their sexuality is nowhere clearer than in the ongoing debate about the impact of hookup culture on women. Is hooking up good for women because it allows them to be sexual while pursuing their studies and career goals unencumbered by intimate relationships, as Hannah Rosin has suggested? Or is it, as Kathleen Bogle first argued in Hooking Up, exploitative in fashioning sexual encounters around men’s preference for sex without commitment? Or is it somewhere in between, with some 1. Since Xi Jinping has taken office in 2012, China’s political repression has only but intensified so that the regime is definitively turning away from the 1990s legal reforms and the many expectations that followed in terms of rule of law and other rights fostering. In replacing these recent developments in a larger perspective including that of a “socialist harmonious society”, which had already shaded a particular light on Chinese reforms, this article proposes to envisage contemporary Chinese legal culture in an (...) evolutionary and theoretical framework. In doing so, it stresses the tensions between a language of rights now fully integrated by the Chinese citizens and the politics of law used, in a last legal ditch struggle, by the Chinese Communist Party as a tool for social stability in disciplining the people by all means including by the threat of its very legal creations. It then concludes in reflecting upon the legal culture emerging out of this great divide between the people and the State. (shrink)

According to objective self-awareness theory, when individuals are in a state of self-awareness, they tend to compare themselves to their standards. Self-to-standard comparison often yields unfavorable results and can be assimilated to a failure, activating an escape motivation. Building on recent research on the link between failure and suicide thought accessibility, the present experiment tested the hypothesis that mirror exposure alone provokes an increase in suicide thought accessibility. Participants were exposed to their mirror reflection while completing a lexical decision task (...) with suicide-related words. Self-to-standard discrepancy salience was manipulated by asking participants to list actual and ideal traits before versus after the lexical decision task. As predicted, mirror-exposed participants recognized suicide-related words quicker than those unexposed to their mirror image. Self-to-standard discrepancy salience did not moderate this effect. Discussion focuses on the role of the motivation to escape self-awareness in the availability of suicide-related ideas. (shrink)

This article discusses the nature and content of subsidiary model of state regulation of the social sphere and the possibility of its use in the Republic of Kazakhstan. Model of state paternalism, in which should be a massive and comprehensive support of the living standards of the population due to the state's resources, has exhausted itself and is not compatible with market principles. Defines the principles of vicarious model of state regulation of the social sphere: prevention; social investment; interactivity; tolerance. (...) The conditions of the subsidiary model of state regulation of the social sphere: transparency; openness; continuity and intensity of positive information space; public competition; contractual partnership. Matched procedural elements of interaction that will determine the nature of the practical implementation of the proposed ideological principles, namely, target-oriented approach; expert and assessment activities; contests; nontax incentive mechanisms; meeting site; social contract. Established economic and legal mechanisms and organizational solutions subsidiary structural model of state regulation of social services, such as community foundations. The principles, conditions and procedural elements, economic and legal mechanisms and organizational solutions subsidiary structural model of state regulation of social services allow us to determine the possibility of transition from a paternalistic model to subsidiary for the Republic of Kazakhstan. This means accessible and free to all citizens of basic social services, especially education and health; redistribution of state social spending in favor of the most vulnerable, while reducing assistance provided to families; reduce social inequalities; provide citizens with the highest possible level of social consumption from its own revenues. The need to achieve this transition imposes extremely stringent requirements for economic growth. Whereas the concept of "socialist rule of law" punctuated political discourse in the late 1990s, the idea of a "socialist harmonious society" is today casting a strange light on Chinese legal reform. Is there a Confucian vision of China's marketing law and practice? To what extent have China's norms for marketing, mainly intellectual property and advertising law, been challenged by the new government policy toward a harmonious society? In the post World Trade Organization accession period, the theoretical framework of the (...) "socialist harmonious society" has turned law into a disciplinary principle given over to society's moral construction. If law is seen as an instrument for legitimizing power, it remains implicitly bound primarily to ensure the regime's durability. Although more and more ordinary citizens and foreign companies are seizing hold of normative tools being put at their disposal, this does not necessarily mean that Chinese law is implemented in a uniform and timely manner throughout China's territory. China still suffers from a lack of coherence and political will in the drafting of a legal reform that aims mainly at preserving the current fragile political balance. Contradictory forces are indeed at work in this legal construction that is torn between liberal leanings and socialist authoritarianism. Without a deep change in perspective, one can expect only relatively slow progress in protecting the intellectual property rights of the many Chinese and foreign goods and services that can be found on the Chinese market.
