The article analyzes ethnic data collection pertaining to criminal justice in Hungary. With such a sensitive and delicate issue at hand, Hungary has decided on an evasive approach, resisting ethnic data collection by law enforcement authorities. The author argues that this approach has become one of the obstacles in fighting discrimination and ethnic profiling. Moreover, Hungary’s restrictive approach to ethno-national data classification also causes severe constitutional problems in other, noncriminal legal circumstances, where ethnic data is used in the context of (...) additional rights and affirmative protection provided for ethno-national minorities. The first part of the article describes general problems relating to ethnic data collection and analyses of the Hungarian minority protection framework, in particular, the minority self-government structure (a unique constitutional institution). The second part focuses on the criminal justice system; the author’s aim is to show that prohibiting the official recognition and collection of data on ethnicity by criminal justice authorities has potentially ethnically discriminatory consequences. As regards the question of what matters in survival two views have been identified: on the one hand, we have the view that what matters is identity (the so-called 'commonsense view') and, on the other hand, we have the view that what matters is the holding of certain psychological connections between various mental states over time (the relation R). Several attempts have tried to reconcile these two views involving the so-called 'multiple occupancy view' or 'cohabitation thesis'. Even if the latter (...) comes in several formulations, common elements are, positing the appropriateness of a description of the fission case according to which the post-fission persons existed prior to fission and also, that what determines that two persons who exist at a certain time are distinct can be facts about what is the case at other times. The paper discusses three of the most influential formulations of the multiple occupancy view, which intend to reconcile identity with what matters, and argues that for various reasons these at least do not work in this regard. Toutes les occurences des trois termes presentes dans les fragments des philosophes presocratiques ainsi que dans les oeuvres de Platon et d'Aristote ont ete examinees par une quinzaine de professeurs et de chercheurs issus des Universites de Liege, de Bruxelles, de Louvain-la-Neuve et de Leuven. Les resultats de l'enquete ont ete presentes et discutes au cours d'un colloque qui s'est tenu a Liege en mars 2001. Dans le volume, chacun des trois corpus donne lieu en outre a un tableau recapitulatif (...) des occurences et a des conclusions propres. Un quatrieme chapitre comprend une etude sur Proclus ainsi que des investigations relatives aux traductions arabes et latines du vocabulaire concerne. Pour finir, Enrico Berti degage les principaux resultats du travail et montre aussi certains enjeux de cette philosophie de la forme inauguree par les penseurs grecs. L'ouvrage comprend une bibliographie de quelque deux cents quarante titres ainsi qu'un index des mots semantiquement apparentes aux trois termes etudies et des autres mots qui apparaissent frequemment dans leur voisinage. L’article revient sur un contexte funéraire découvert au xixe s. à Camiros par l’archéologue Auguste Salzmann et récemment reconstitué au musée du Louvre, où il est conservé. L’étude stylistique et typologique du mobilier a été prolongée par une campagne d’analyses des contenus, une approche qui réactualise, par des moyens d’investigations modernes, l’intérêt suscité par le tombeau A. Nell’intervista concessa nell’ottobre 1969 al regista e suo ex-allievo András Kovács, Lukács è sollecitato ad esprimere un giudizio su Trockij. A tal fine egli evoca una formula già utilizzata da Lenin in un dialogo con Gor’kij: «Trockij cammina con noi, ma in realtà non fa parte di noi». Dalle poche ma significative lettere che compongono l’epistolario tra Lukács e Anders, l’immagine che del secondo offre il primo potrebbe essere icasticamente resa attraverso il capovolgimento di tale giudizio. Secondo Lukács quindi Anders (...) «non cammina con noi», non fa cioè parte di alcuna forza politica organizzata ispirantesi al socialismo, ma «fa parte di noi», è cioè tra coloro che con più energia si oppongono alla «Entfremdung» contemporanea. Obiettivo del presente contributo è legittimare tale tesi interpretativa attraverso una discussione critica dei nodi essenziali del loro epistolario. (shrink)

Maurice Merleau-Ponty et Paul Ricoeur pensent tous deux l’inscription du corps dans la chair du monde, mais ne tirent pas les mêmes conséquences de ce point de départ anthropologique. Le premier creusera toujours plus profond la signification et la portée de toute inscription charnelle en développant une ontologie du sensible, une esthétique de cet entrelacs qui lie l’homme et le monde. Ricoeur, à la différence de son ainé, médiatisera de plus en plus cette inscription dans une herméneutique des identités individuelles (...) et culturelles reconnaissant l’importance structurante des institutions, accentuant la dimension éthique. Entre une quête de l’originaire qui veut retrouver l’expérience d’un être sauvage et une philosophie pour laquelle la vérité est révélation, pour un sujet, d’un sens profond que nous livre une herméneutique de la récollection du sens, quelles affinités et quels motifs de divergence alors? Le point de rupture, s’il en est un, entre les deux philosophes ne tient-il pas à ce que Ricoeur, fidèle à la tradition réflexive, maintient l’idée d’une personne, au moins capable d’une reprise de l’expérience du monde, là où Merleau-Ponty a cherché à s’en affranchir? Faut-il opposer une philosophie de la chair et de la « vision » à une philosophie du texte et de la narration jusque dans leurs conséquences pratiques?If Maurice Merleau-Ponty and Paul Ricoeur both think the inscription of the body in the “flesh” of the world, they differ as regards the consequences they draw from this anthropological starting point. Merleau-Ponty delves ever deeper into the meaning and scope of this carnal inscription, developing an ontology of the sensible, an aesthetic of the intertwining of human and world. Ricoeur, by contrast, explores the implications of this inscription for a hermeneutics of individual and cultural identities which recognizes the structuring importance of institutions, emphasizing the ethical dimension. But what affinities and what divergences are there between a quest for the originary that wishes to recover the experience of wild being and a philosophy for which truth is revelation, for a subject, of a profound meaning yielded to us by a hermeneutic of the recollection of meaning? Does the point of rupture between the two philosophers, if there is one, lie in the fact that Ricoeur, in faithfulness to the reflexive tradition, maintains the idea of a person capable at least of appropriating the experience of the world, while Merleau-Ponty relinquishes it? Ricoeur medierà sempre più quell’iscrizione andando verso un’ermeneutica delle identità individuali e culturali, riconoscendo l’importanza strutturante delle istituzioni e accentuando il rilievo della dimensione etica. Quali affinità e quali divergenze sussistono allora tra una ricerca dell’originario che mira a ritrovare l’esperienza dell’essere selvaggio e una filosofia che pensa la verità come rivelazione al soggetto di un senso profondo che ci viene restituito dal movimento di un’ermeneutica che ne raccoglie pazientememnte le tracce? Il punto di rottura tra le due prospettive non ha forse a che vedere col fatto che Ricoeur resta fedele alla tradizione della riflessione, conserva l’idea che la persona sia capace di una ripresa dell’esperienza del mondo, mentre Merleau-Ponty cerca di affrancarsene? Legal decision-support systems have the potential to improve access to justice, administrative efficiency, and judicial consistency, but broad adoption of such systems is contingent on development of technologies with low knowledge-engineering, validation, and maintenance costs. This paper describes two approaches to an important form of legal decision support—explainable outcome prediction—that obviate both annotation of an entire decision corpus and manual processing of new cases. The first approach, which uses an attention network for prediction and attention weights to highlight salient case (...) text, was shown to be capable of predicting decisions, but attention-weight-based text highlighting did not demonstrably improve human decision speed or accuracy in an evaluation with 61 human subjects. The second approach, termed semi-supervised case annotation for legal explanations, exploits structural and semantic regularities in case corpora to identify textual patterns that have both predictable relationships to case decisions and explanatory value. The philosophy of cognitive paleoanthropology involves three related tasks: (1) asking what inferences might be drawn from the paleontological and archaeological records to past cognition, behavior and culture; (2) constructing synthetic accounts of the evolution of distinctive hominin capacities; (3) exploring how results from cognitive paleoanthropology might inform philosophy. We introduce some distinctive cognitive paleoanthropological inferences and discuss their epistemic standing, before considering how attention to the material records and the practice of paleoanthropology can inform and transform philosophical approaches.

This paper concludes a special feature of Sustainability Science that explores a broad range of social value theoretical traditions, such as religious studies, social psychology, indigenous knowledge, economics, sociology, and philosophy. We introduce a novel transdisciplinary conceptual framework that revolves around concepts of 'lenses' and 'tensions' to help navigate value diversity. First, we consider the notion of lenses: perspectives on value and valuation along diverse dimensions that describe what values focus on, how their sociality is envisioned, and what epistemic and (...) procedural assumptions are made. We characterise fourteen of such dimensions. This provides a foundation for exploration of seven areas of tension, between: (1) the values of individuals vs collectives; (2) values as discrete and held vs embedded and constructed; (3) value as static or changeable; (4) valuation as descriptive vs normative and transformative; (5) social vs relational values; (6) different rationalities and their relation to value integration; (7) degrees of acknowledgment of the role of power in navigating value conflicts. In doing so, we embrace the 'mess' of diversity, yet also provide a framework to organise this mess and support and encourage active transdisciplinary collaboration. We identify key research areas where such collaborations can be harnessed for sustainability transformation. Here it is crucial to understand how certain social value lenses are privileged over others and build capacity in decision-making for understanding and drawing on multiple value, epistemic and procedural lenses. Il saggio muove da una ricostruzione storico-concettuale dell’interpretazione merleau-pontyana del manoscritto di Husserl Rovesciamento della dottrina copernicana nell’interpretazione della corrente visione del mondo, con cui Merleau-Ponty è in dialogo sin dalla Fenomenologia della percezione, per ripercorrere gli sviluppi del tema della Terra nell’avanzare della riflessione merleau-pontyana sul corpo-proprio, sull’organismo vivente, sulla dimensione carnale dell’essere. La proposta di un ritorno alla Terra, intesa come Boden irriducibile dell’esperienza, trova infatti il suo risvolto ontologico nell’idea di Spielraum, che già Husserl definiva come “ambito (...) di possibilità”, e che in Merleau-Ponty assume il senso di un margine di gioco sempre aperto nella carne. Boden e Spielraum, non a caso tematizzati da Merleau-Ponty in due corsi paralleli tenuti al Collège de France nell’anno 1959-1960, permettono una rivalutazione del vivente secondo un modello che, contro il riduzionismo meccanicista, privilegi la spontaneità e la contingenza, e aprono allo sviluppo dell’ontologia porosa che il filosofo andrà proponendo negli ultimi anni. Ricostruendo la funzione della riflessione sulla corporeità e sul rapporto del vivente al mondo-ambiente in questa maturazione, si argomenterà che la critica che Merleau-Ponty muove al dualismo empirismo-idealismo trovi nell’idea di Terra un momento chiave, che contribuisce ad orientarla in direzione di una filosofia della carne. Questo passaggio riconfigura la Natura stessa, pensata non già come un originario, ma in quanto ambito di possibilità processuale e transindividuale, come quel quasi-oggetto, come lo definiva, ancora, Husserl, che presenta un’irriducibile resistenza ad un pensiero di sorvolo, proprio in quanto è condizione del pensiero stesso e ancoraggio della vita tutta.This essay begins with a historico-conceptual reconstruction of the Merleau-Pontian interpretation of Husserl’s manuscript, “Foundational Investigations of the Phenomenological Origin of the Spatiality of Nature,” with which Merleau-Ponty is in dialogue from Phenomenology of Perception onward, and revisits the development of the theme of the Earth in the progression of Merleau-Ponty’s reflection on le corps propre, the living organism, and the carnal dimension of being. The proposal for a return to the Earth, taken as irreducible Boden of experience, indeed finds its ontological reverse side in the idea of Spielraum, which Husserl already defined as a “milieu of possibilities,” and which in Merleau-Ponty takes on the sense of a margin of play always open in the flesh. Boden and Spielraum, two notions that Merleau-Ponty does not thematize by chance in the two parallel courses given at the Collège de France over the years 1959-1960, enable a reassessment of the living being according to a model that, against mechanistic reductionism, privileges spontaneity and contingency, and opens to the development of the porous ontology that the philosopher would propose in his final years. Reconstructing the function of reflection on corporeality, and on the relationship of the living being with its milieu in the process, it will be argued that the criticism directed by Merleau-Ponty against the dualism of empiricism-idealism finds in the idea of the Earth a key moment that contributes to orienting him in the direction of a philosophy of the flesh. This passage reconfigures Nature itself, no longer conceived of as an originating, but as a milieu of processual and transindividual possibilities, like that quasi-object, as Husserl again defined it, that presents an irreducible resistance against high-altitude thinking, precisely as the condition of thought itself and the anchorage of all life.Cet essai commence avec une reconstruction historico-conceptuelle de l’interprétation merleau-pontienne du manuscrit de Husserl, Renversement de la doctrine copernicienne, avec lequel Merleau-Ponty est en dialogue depuis la Phénoménologie de la perception, et revisite les développement du thème de la Terre dans la progression de la réflexion merleau-pontienne sur le corps propre, sur l’organisme vivant, sur la dimension charnelle de l’être. This paper provides a series of reflections on making the case to senior leaders for the introduction of clinical ethics support services within a UK hospital Trust at a time when clinical ethics committees are dwindling in the UK. The paper provides key considerations for those building a case for clinical ethics support within hospitals by drawing upon published academic literature, and key reports from governmental and professional bodies. We also include extracts from documents relating to, and annual reports of, (...) existing clinical ethics support within UK hospitals, as well as extracts from our own proposal submitted to the Trust Board. We aim for this paper to support other ethicists and/or health care staff contemplating introducing clinical ethics support into hospitals, to facilitate the process of making the case for clinical ethics support, and to contribute to the key debates in the literature around clinical ethics support. We conclude that there is a real need for investment in clinical ethics in the UK in order to build the evidence base required to support the wider introduction of clinical ethics support into UK hospitals. Furthermore, our perceptions of the purpose of, and perceived needs met through, clinical ethics support needs to shift to one of hospitals investing in their staff. Finally, we raise concerns over the optional nature of clinical ethics support available to practitioners within UK hospitals. (shrink)

There is a popular hypothesis that performance on implicit and explicit memory tasks reflects 2 distinct memory systems. Explicit memory is said to store those experiences that can be consciously recollected, and implicit memory is said to store experiences and affect subsequent behavior but to be unavailable to conscious awareness. Although this division based on awareness is a useful taxonomy for memory tasks, the authors review the evidence that the unconscious character of implicit memory does not necessitate that it be (...) treated as a separate system of human memory. They also argue that some implicit and explicit memory tasks share the same memory representations and that the important distinction is whether the task (implicit or explicit) requires the formation of a new association. The authors review and critique dissociations from the behavioral, amnesia, and neuroimaging literatures that have been advanced in support of separate explicit and implicit memory systems by highlighting contradictory evidence and by illustrating how the data can be accounted for using a simple computational memory model that assumes the same memory representation for those disparate tasks. Up till now, China has not enacted any legal mechanisms governing certification or supervision for ethics committees. This article analyses deficiencies in the protection of subjects in clinical drug trials under China’s current laws and regulations; it emphasizes that investigators, as practitioners who have direct contact with subjects, play significant roles in protecting and safeguarding subjects’ rights and interests. The paper compares the status quo in China in this area to that of other countries and discusses ways China might enhance (...) the protection of rights and interests of trial subjects, such as enhancing the ethical awareness of investigators through training, improving laws and regulations, and strengthening the communication between investigators and ethics committees. The Suffering of the Impassible God provides a major reconsideration of the notion of divine impassibility in patristic thought. The question whether, in what sense, and under what circumstances suffering may be ascribed to God runs as a golden thread through such major controversies as Docetism, Patripassianism, Arianism, and Nestorianism. It is commonly claimed that in these debates patristic theology fell prey to the assumption of Hellenistic philosophy about the impassibility of God and departed from the allegedly biblical view, according (...) to which God is passible. As a result, patristic theology is presented as claiming that only the human nature of Christ suffered, while the divine nature remained unaffected. Paul L. Gavrilyuk argues that this standard view misrepresents the tradition. In contrast, he construes the development of patristic thought as a series of dialectical turning points taken to safeguard the paradox of God's voluntary suffering in the flesh. For the Fathers the attribute of divine impassibility functioned in a restricted sense as an apophatic qualifier of all divine emotions and as an indicator of God's full and undiminished divinity. The Fathers at the same time admitted qualified divine passibility of the Son of God within the framework of the Incarnation. Gavrilyuk shows that the Docetic, Arian, and Nestorian alternatives represent different attempts at dissolving the paradox of the Incarnation. These three alternatives are alike in that they start with the presupposition of God's unrestricted impassibility: the Docetic view proposes to give up the reality of Christ's human experiences; the Arian position sacrifices Christ's undiminished divinity; while the Nestorian alternative isolates the experiences and sufferings of Christ's humanity from his Godhead. In contrast to these alternatives, the mind of the Church succeeded in keeping God's transcendence and undiminished divinity in tension with God's intimate involvement in human suffering. It is precisely because God's divinity and transcendence are never lost in suffering that the Incarnation becomes a genuine act of divine compassion, capable of transforming and healing the human condition. Il importe de situer les enjeux humains de ce mouvement que d'aucuns qualifient de « nouvel ordre mondial » : quel souci de l'être humain en tant que tel manifeste-t-il ? L'homme est un être d'appartenances individuelles et collectives, il s'éprouve dans sa liberté et dans sa participation à l'histoire qui se fait. La société qui s'annonce sera-t-elle pour lui, offerte à son engagement, ou contre lui, le contraignant à se soumettre ou à se démettre ? Des penseurs contemporains montrent (...) que l'homme se construit en habitant l'écart entre particulier et universel , individualité et solidarité , « territoire » et « planète » . Comment cette « dialectique » pourra-t-elle s'exercer demain dans un univers aux contours flous et aux logiques opaques? On ne peut fonder un « contrat » éthique et politique avec d'autres si le temps social, économique ou culturel dissout les particularités et rend l'avenir improbable. Il se pourrait que la mondialisation oblige les « instances de sens » à faire mémoire, à raconter comment on devient hommes ensemble dans la complexité d'une histoire à faire. L'urgence est à la transmission. It is important to situate the human stakes of this movement that some people qualify as « new world order » : what concern of the human being as such does it manifest ? Man is a being of individual and collective belonging. He tests himself in his freedom and in his participation in history in the making. Will future society be for him, inviting him to participate, or against him, forcing him to submit or to give up ? Contemporaneous thinkers show that man constructs himself in living the gap between the particular and universal , individuality and solidarity , « territory » and « planet » . How can this « dialectic » be practiced tomorrow in a universe with vague outlines and opaque logics ? One cannot establish an ethical and political « contract » with others if the social, economic, or cultural time dissolves particularities and makes the future improbable. Il is possible that globalization obliges the « moments of sense » to remember, to tell about how we become human together in the complexity of a history to be made. The urgency is the transmission.
