This paper aims to provide a brief overview of the ethical challenges facing researchers engaging with web archival materials and demonstrates a framework and method for conducting research with historical web data created by young people.,This paper’s methodology is informed by the conceptual framing of data materials in research on the “right to be forgotten” (Crossen-White, 2015; GDPR, 2018; Tsesis, 2014), data afterlives (Agostinho, 2019; Stevenson and Gehl, 2019; Sutherland, 2017), indigenous data sovereignty and governance (Wemigwans, 2018) and feminist ethics (...) of care (Cifor et al., 2019; Cowan, 2020; Franzke et al., 2020; Luka and Millette, 2018). It demonstrates a new method called an archive promenade, which builds on the walkthrough and scroll-back methods (Light et al., 2018; Robards and Lincoln, 2017).,The archive promenades demonstrate how individual attachments to digital traces vary and are often unpredictable, which necessitates further steps to ensure that privacy and data sovereignty are maintained through research with web archives.,This paper demonstrates how the archive promenade methodological intervention can lead to better practices of care with sensitive web materials and brings together previous work on ethical fabrications (Markham, 2012), speculation (Luka and Millette, 2018) and thick context (Marzullo et al., 2018), to yield new insights for research on the experiences of growing up online. Background: Exploring the concept of ethical competence in the context of healthcare is essential as it pertains to better quality of care. The concept still lacks a comprehensive definition covering the aspects of ethical expertise, ethical knowledge and action of a health professional. Objective: This article aims to report an analysis of the concept of ethical competence. Method: A modified strategy suggested by Walker and Avant was used to analyse the concept. Results: As a result, the concept of ethical competence (...) can be defined in terms of character strength, ethical awareness, moral judgement skills and willingness to do good. Virtuous professional, experience of a professional, human communication, ethical knowledge and supporting surroundings in the organisation can be seen as prerequisites for ethical competence. Ethical competence results in the best possible solutions for the patient, reduced moral distress at work and development and democratisation of society. Conclusion: The results of the analysis establish a basis for an instrument to evaluate health professionals’ ethical competence. It will guide educators, as well as managers in healthcare, to support the development of ethical conduct in healthcare. (shrink)

This paper explores what is meant by ‘loss and damage’ within the area of climate policy focused on loss and damage. I present two possible understandings of loss and damage, one of which connects it to harm and one of which connects it to value. In both cases, I argue that the best contemporary philosophical understandings of these concepts suggest a much broader range of losses and damages than is currently being considered within the usual discussions in this area. Evangelical Christianity is often thought of as oppressive to women. The #MeToo era, when many women hit a breaking point with rampant sexism, has also reached evangelical communities. Yet more than thirty million women in the United States still identify as evangelical. Why do so many women remain in male-dominated churches that marginalize them, and why do others leave? This book explores the nature, value, and role of hope in human life under conditions of oppression. Oppression is often a threat and damage to hope, yet many members of oppressed groups, including prominent activists pursuing a more just world, find hope valuable and even essential to their personal and political lives. This book offers a unique evaluative framework for hope that captures the intrinsic value of hope for many of us, the rationality and morality of hope, and ultimately how (...) we can hope well in the non-ideal world we share. It develops an account of the relationship between hope and anger about oppression and argues that anger tends to be accompanied by hopes for repair. When people’s hopes for repair are not realized, as is often the case for those who are oppressed, anger can evolve into bitterness: a form of unresolved anger involving a loss of hope that injustice will be sufficiently acknowledged and addressed. But even when all hope might seem lost or out of reach, faith can enable resilience in the face of oppression. Spiritual faith, faith in humanity, and moral faith are part of what motivates people to join in solidarity against injustice, through which hope can be recovered collectively. Joining with others who share one’s experiences or commitments for a better world, and uniting with them in collective action, can restore and strengthen hope for the future when hope might otherwise be lost. Recently in environmental ethics some theorists have advocated narrative accounts of value, according to which the value of environmental goods is given by the role that they play in our narratives. I first sketch the basic theoretical features of a narrative accounts of value and then go on to raise some problems for such views. I claim that they require an evaluative standard in order to distinguish the valuable from the merely valued and that the project of constructing such a (...) standard faces significant problems. I conclude by questioning whether narrative accounts of value really offer advantages over other pluralistic and context-sensitive accounts of value. (shrink)

When once-successful physical theories are abandoned, common wisdom has it that their characteristic theoretical entities are abandoned with them: examples include phlogiston, light rays, Newtonian forces, Euclidean space. But sometimes a theory sees ongoing use, despite being superseded. What should scientific realists say about the characteristic entities of the theories in such cases? The standard answer is that these ‘theoretical relicts’ are merely useful fictions. In this paper we offer a different answer. We start by distinguishing horizontal reduction (in which (...) a superseded theory approximates the successor theory) from vertical reduction (in which a higher-level theory abstracts away from the lower-level theory, but nonetheless can be constructed from it); these are usually regarded as having different ontological consequences. We describe a ‘verticalization’ procedure which transforms horizontal reductions into vertical reductions. The resulting verticalized theories are abstractions rather than approximations, with restricted domains. We identify a sense in which the higher-level theory describes distinct subject matters from the lower-level theory, enabling in certain cases the higher-level theory to retain distinctive explanatory power even in the presence of reduction. We suggest that theoretical entities from superseded theories should be retained in a scientific realist worldview just when, reinterpreted as higher-level abstractions, those theories and their characteristic entities continue to perform distinctive explanatory work in providing the best explanation for less-fundamental phenomena of interest. The search for the statistical mechanical underpinning of thermodynamic irreversibility has so far focussed on the spontaneous approach to equilibrium. But this is the search for the underpinning of what Brown and Uffink have dubbed the ‘minus first law’ of thermodynamics. In contrast, the second law tells us that certain interventions on equilibrium states render the initial state ‘irrecoverable’. In this article, I discuss the unusual nature of processes in thermodynamics, and the type of irreversibility that the second law embodies. (...) I then search for the microscopic underpinning or statistical mechanical ‘reductive basis’ of the second law of thermodynamics by taking a functionalist strategy. First, I outline the functional role of the thermodynamic entropy: for a thermally isolated system, the thermodynamic entropy is constant in quasi-static processes, but increasing in non-quasi-static processes. I then search for the statistical mechanical quantity that plays this role—rather than the role of the traditional ‘holy grail’ as described by Callender. I argue that in statistical mechanics, the Gibbs entropy plays this role. (shrink)

L. Austin, W. V. O. Quine, and Stanley Cavell. Bourbon's ideas contribute new (...) dimensions to the elusive concept of poetry and pivots the reader's attention inward: how can we recognize poetry in our day-to-day and why should we? At sentence level, his claims are clear and compelling to readers across disciplines with varying knowledge of philosophy and poetry. This book is thus addressed to "poets, literary scholars, philosophers, and students of religion, and anyone who cares about the ethics of everyday life, about the surprises that punctuate and give our lives form" (p. ix).Poems themselves are such "events of form," Bourbon emphasizes, which live among us and need not be constituted by words. Wordless poems can be uncovered and embraced through the development of a "poetic vulnerability" to ordinary experiences that are not necessarily wedded to one's aesthetic reaction. Bourbon designates the alphabet as one such example of what he calls a "primal everyday poem"; the alphabet is wordless and consists of a patterned order whose mere form does not encompass its meaning. The ordinary expression "I love you" also falls under this classification; the phrase is a performative poem whose intricate connotation is simplified by common language, yet is not the equivalent of its mere words. Bourbon asserts that, like the phrase "I love you," poems of the everyday cannot be reduced to mere language, conditions, or creative modes.Of the ineffable nature of poetry, Bourbon claims, "Poetry, like death, is that which we can only know by analogy—by examples—but it has a scope beyond all our examples" (p. 108). In terms of examples, he draws from poignant personal experiences to reinforce his arguments and provide insight into his keen sensibility. In chapter 1 ("Poems of the Everyday"), Bourbon recounts his own dismissal as a young boy of poetry's worthiness until one day while watching an old film, he in fact was struck by the phrase "I love you." This ordinary phrase allowed him to reconsider the parameters of what constitutes poetry and acknowledge the dichotomy of the phrase's formal power constituted by trivial symbols.Chapter 4 ("Epithalamion") is also rooted in personal experience. Bourbon opens with the flat assertion, "I have never liked weddings" (p. 43), but he notes a difference between a "marriage of forms" and "marriage of intimacy and stability": his distaste is for the former. He believes that a successful marriage can become a poem of the everyday—an event of power and "linguistic surrogacy"—where the event itself fosters more meaning than the words alone [End Page 475] can carry. Marriage can be a poem of discovery that arises from the action of learning what it means to love. But in the objects of the wedding and all its trite, heart-shaped symbols, Bourbon remarks, no poems are to be found.Bourbon dedicates chapter 5 ("Is a Poem the Same as Its Words?") to his claim that what a poem is cannot be bound by its words entirely or by meaning alone. If one finds each line of a poem intelligible, that does not indicate that the poem's meaning is consequentially understood. Conversely, a reader may not know a poem's meaning with complete certainty; what is said may not illuminate what is meant. In Bourbon's explanation of the sentence as a model for how particular words construct a poem, he says that one must determine how such a sentence-poem would be meaningful through our own reading. He claims that a poem is more than its words and cannot be simplified into sets of sentences or phrases. In what sense are the special sciences autonomous of fundamental physics? Autonomy is an enduring theme in discussions of the relationship between the special sciences and fundamental physics or, more generally, between higher and lower-level facts. Discussion of ‘autonomy’ often fails to recognise that autonomy admits of degrees; consequently, autonomy is either taken to require full independence, or risk relegation to mere apparent autonomy. In addition, the definition of autonomy used by Fodor, the most famous proponent of the autonomy of (...) the special sciences, has been robustly criticised by Loewer. In this paper I develop a new account of autonomy following Woodward which I dub ‘generalised autonomy’ since it unifies dynamical, causal and nomic autonomy. Autonomy, on this account, can be partial: some lower-level details matter while others do not. To summarise: whilst the detailed lower level is unconditionally relevant, conditionalising on the higher-level facts renders some lower-level details irrelevant. The macrodependencies that the higher-level facts enter into — be they dynamical, causal or nomic — screen off the underlying microdetails. This account helps resolve an explanatory puzzle: if the lower-level facts in some way underpin the higher-level facts, why don’t the lower-level details matter more for the day-to-day practice of the special sciences? The answer will be: the facts uncovered by the special sciences are autonomous in my sense, and so practitioners of these special sciences need not study more fundamental sciences, since these underlying facts are genuinely irrelevant. Internet protocol development is a social process, and resulting protocols are shaped by their developers’ politics and values. This article argues that the work of protocol development poses barriers to developers’ reflection upon values and politics in protocol design. A participant observation of a team developing internet protocols revealed that difficulties defining the stakeholders in an infrastructure and tensions between local and global viewpoints both complicated values reflection. Further, Internet architects tended to equate a core value of interoperability with values (...) neutrality. The article describes how particular work practices within infrastructure development overcame these challenges by engaging developers in praxis: situated, lived experience of the social nature of technology. Richard Rudner famously argues that the communication of scientific advice to policy makers involves ethical value judgments. His argument has, however, been rightly criticized. This article revives Rudner’s conclusion, by strengthening both his lines of argument: we generalize his initial assumption regarding the form in which scientists must communicate their results and complete his ‘backup’ argument by appealing to the difference between private and public decisions. Our conclusion that science advisors must, for deep-seated pragmatic reasons, make value judgments is further (...) bolstered by reflections on how the scientific contribution to policy is far less straightforward than the Rudner-style model suggests. Privacy is a critical challenge for corporate social responsibility in the mobile device ecosystem. Mobile application firms can collect granular and largely unregulated data about their consumers, and must make ethical decisions about how and whether to collect, store, and share these data. This paper conducts a discourse analysis of mobile application developer forums to discover when and how privacy conversations, as a representative of larger ethical debates, arise during development. It finds that online forums can be useful spaces for (...) ethical deliberations, as developers use these spaces to define, discuss, and justify their values. It also discovers that ethical discussions in mobile development are prompted by work practices which vary considerably between iOS and Android, today’s two major mobile platforms. For educators, regulators, and managers interested in encouraging more ethical discussion and deliberation in mobile development, these work practices provide a valuable point of entry. But while the triggers for privacy conversations are quite different between platforms, ultimately the justifications for privacy are similar. Developers for both platforms use moral and cautionary tales, moral evaluation, and instrumental and technical rationalization to justify and legitimize privacy as a value in mobile development. Understanding these three forms of justification for privacy is useful to educators, regulators, and managers who wish to promote ethical practices in mobile development. (shrink)

This paper defends an account of moral shock as an emotional response to intensely bewildering events that are also of moral significance. This theory stands in contrast to the common view that shock is a form of intense surprise. On the standard model of surprise, surprise is an emotional response to events that violated one's expectations. But I show that we can be morally shocked by events that confirm our expectations. What makes an event shocking is not that it violated (...) one's expectations, but that the content of the event is intensely bewildering. What causes moral shock is, I argue, our lack of emotional preparedness for the event. And I show that, despite the relative lack of attention to shock in the philosophical literature, the emotion is significant to moral, social, and political life. (shrink)

This study identified and described ethical problems encountered by physiotherapists in their practice and physiotherapists’ moral sensitivity in ethical situations. A questionnaire-based survey was constructed to identify ethical problems, and the Moral Sensitivity Questionnaire Revised version was used to measure moral sensitivity. Physiotherapists (n = 116) working in public health services responded to the questionnaire. Based on the results, most of the physiotherapists encounter ethical problems weekly. They concern mainly financial considerations, equality and justice, professionalism, unethical conduct of physiotherapists or (...) other professions and patients’ self-determination. The dimension of moral strength was emphasised in physiotherapists’ self-evaluations of their moral sensitivity. As a conclusion, ethical problems do occur not only at individual level but also at organisational and society level. Physiotherapists seem to have moral strength for speaking on behalf of the patient. Scarce resources make them feel insufficient but much could still be done to provide quality care in co-operation with other health-care professionals. (shrink)

There are at least two plausible generalisations of subjective expected utility (SEU) theory: cumulative prospect theory (which relaxes the independence axiom) and Levi’s decision theory (which relaxes at least ordering). These theories call for a re-assessment of the minimal requirements of rational choice. Here, I consider how an analysis of sequential decision making contributes to this assessment. I criticise Hammond’s (Economica 44(176):337–350, 1977; Econ Philos 4:292–297, 1988a; Risk, decision and rationality, 1988b; Theory Decis 25:25–78, 1988c) ‘consequentialist’ argument for the SEU (...) preference axioms, but go on to formulate a related diachronic-Dutch-book-style’ argument that better achieves Hammond’s aims. Some deny the importance of Dutch-book sure losses, however, in which case, Seidenfeld’s (Econ Philos 4:267–290, 1988a) argument that distinguishes between theories that relax independence and those that relax ordering is relevant. I unravel Seidenfeld’s argument in light of the various criticisms of it and show that the crux of the argument is somewhat different and much more persuasive than what others have taken it to be; the critical issue is the modelling of future choices between ‘indifferent’ decision-tree branches in the sequential setting. Finally, I consider how Seidenfeld’s conclusions might nonetheless be resisted. (shrink)

This article defends an account of collective hope that arises through solidarity in the pursuit of justice. I begin by reviewing recent literature on the nature of hope. I then explore the relationship between hope and solidarity to demonstrate the ways in which solidarity can give rise to hope. I suggest that the hope born of solidarity is collective when it is shared by at least some others, when it is caused or strengthened by activity in a collective action setting, (...) and when the reciprocal hopeful expressions of individual group members result in an emotional atmosphere of hope that extends across the group. In the context of social movements, collective hope emerges alongside the collective intentions and actions of the solidarity group; namely, in the pursuit of a form of social justice that inspires the movement. The Bayesian maxim for rational learning could be described as conservative change from one probabilistic belief or credence function to another in response to newinformation. Roughly: ‘Hold fixed any credences that are not directly affected by the learning experience.’ This is precisely articulated for the case when we learn that some proposition that we had previously entertained is indeed true (the rule of conditionalisation). But can this conservative-change maxim be extended to revising one’s credences in response to entertaining propositions or (...) concepts of which one was previously unaware? The economists Karni and Vierø (2013, 2015) make a proposal in this spirit. Philosophers have adopted effectively the same rule: revision in response to growing awareness should not affect the relative probabilities of propositions in one’s ‘old’ epistemic state. The rule is compelling, but only under the assumptions that its advocates introduce. It is not a general requirement of rationality, or so we argue. We provide informal counterexamples. And we show that, when awareness grows, the boundary between one’s ‘old’ and ‘new’ epistemic commitments is blurred. Accordingly, there is no general notion of conservative change in this setting. Epigenetics – the study of mechanisms that influence and modify gene expression – is providing unique insights into how an individual’s social and physical environment impact the body at a molecular level, particularly in populations that experience stigmatization and trauma. Researchers are employing epigenetic studies to illuminate how epigenetic modifications lead to imbalances in health outcomes for vulnerable populations. However, the investigation of factors that render a population epigenetically vulnerable present particular ethical and methodological challenges. Here we are concerned with (...) demonstrating how, in targeting certain populations for epigenetic research, this research may be pathologizing socio-cultural and medical practices in those populations in a way that increases their vulnerability. Using a case study approach, this article examines three vulnerable populations currently of interest to epigenetic researchers – Indigenous, autistic, and transgender populations – in order to highlight some of the challenges of conducting non-stigmatizing research in epigenetics. KATIE McSHANE | : Taking the Fifth Assessment Report of the Intergovernmental Panel on Climate Change as representative, I argue that animal ethics has been neglected in the assessment of climate policy. While effects on ecosystem services, biodiversity, and human welfare are all catalogued quite carefully, there is no consideration at all of the effects of climate change on the welfare of animals. This omission, I argue, should bother us, for animal welfare is not adequately captured by assessments of (...) ecosystem services, biodiversity, or human welfare. After describing the paper’s assumptions and discussing the role of the IPCC’s Assessment Reports in climate policy, I consider the presentation of climate impacts in the IPCC’s Fifth Assessment Report, noting the aspects of animal welfare that are considered there, and comparing the report’s treatment of animal welfare to its treatment of human welfare. Next, I argue that the concepts of ecosystem services, biodiversity, and human welfare do not adequately capture the welfare of animals. Finally, I discuss concerns about human responsibility for animal welfare and the practicality of including considerations of animal welfare among the climate impacts studied by the IPCC. | : En prenant le Cinquième Rapport d’évaluation du Groupe d’experts intergouvernemental sur l’évolution du climat à titre de cas représentatif, je soutiens que l’éthique animale a été négligée dans l’évaluation de la politique climatique. Alors que les effets sur les services écosystémiques, la biodiversité et le bien-être humain y sont tous soigneusement recensés, les effets du changement climatique sur le bien-être des animaux n’y sont aucunement pris en considération. Je soutiens que cette omission devrait nous préoccuper, étant donné que l’évaluation des services écosystémiques, de la biodiversité et du bien-être humain ne rend pas compte adéquatement du bien-être des animaux. Après avoir décrit les présupposés de l’article et réfléchi au rôle des Rapports d’évaluation du GIEC quant à la politique climatique, j’examine la présentation des effets climatiques dans le Cinquième Rapport du GIEC, en indiquant les aspects du bien-être animal qui y sont pris en considération, tout en comparant le traitement que fait le rapport du bien-être animal à celui qui est fait du bien-être humain. Ensuite, je soutiens que les concepts de services écosystémiques, de biodiversité et de bien-être humain ne reflètent pas adéquatement le bien-être des animaux. Context In response to outbreaks of vaccine‐preventable disease and increasing rates of vaccine refusal, some political communities have recently implemented coercive childhood immunization programs, or they have made existing childhood immunization programs more coercive. Many other political communities possess coercive vaccination policies, and others are considering developing them. Scholars and policymakers generally refer to coercive immunization policies as “vaccine mandates.” However, mandatory vaccination is not a unitary concept. Rather, coercive childhood immunization policies are complex, context‐specific instruments. Their legally and morally (...) significant features often differ, and they are imposed by political communities in varying circumstances and upon diverse populations. Methods In this paper, we introduce a taxonomy for classifying real‐world and theoretical mandatory childhood vaccination policies, according to their scope (which vaccines to require), sanctions and severity (which kind of penalty to impose on vaccine refusers, and how much of that penalty to impose), and selectivity (how to enforce or exempt people from vaccine mandates). Findings A full understanding of the operation of a vaccine mandate policy (real or potential) requires attention to the separate components of that policy. However, we can synthesize information about a policy's scope, sanctions, severity, and selectivity to identify a further attribute—salience —which identifies the magnitude of the burdens the state imposes on those who are not vaccinated. Conclusion Our taxonomy provides a framework for forensic examination of current and potential mandatory vaccination policies, by focusing attention on those features of vaccine mandates that are most relevant for comparative judgments. Foundational puzzles surround gravitational thermal physics—a realm in which stars are treated as akin to molecules in a gas. Whether such an enterprise is successful and the domain of thermal physics extends beyond our terrestrial sphere is disputed. There are successes and paradoxical features. Callender :960–981, 2011) advocates reconciling the two sides of the dispute by taking a broader view of thermodynamics. Here I argue for an alternative position: if we are careful in distinguishing statistical mechanics and thermodynamics, then no (...) reconciliation is required. Both sides can live in harmony because whilst statistical mechanics applies, thermodynamics does not. This state of affairs—the applicability of statistical mechanics without the emergence of thermodynamic behaviour—can be explained in terms of an infamous infinite idealisation: the thermodynamic limit. The consistent histories reformulation of quantum mechanics was developed by Robert Griffiths, given a formal logical systematization by Roland Omn\`{e}s, and under the label `decoherent histories', was independently developed by Murray Gell-Mann and James Hartle and extended to quantum cosmology. Criticisms of CH involve issues of meaning, truth, objectivity, and coherence, a mixture of philosophy and physics. We will briefly consider the original formulation of CH and some basic objections. The reply to these objections, like the objections themselves, involves a (...) mixture of physics and philosophy. Since his death in 2003 at the age of fifty-six, Warren Zevon’s following has grown, and seven books on Zevon have appeared in the last few years, with more in the works. The Zevon legend continues to attract attention both because of the outstanding quality of his best songs and because of the poignant trajectory of his life. Zevon’s descent into alcoholism and other addictions, along with his debauchery and erratic behaviour, took its toll and his performances suffered, an aspect (...) disturbingly captured in the memoir by his ex-wife Crystal Zevon. This collection of chapters on Zevon’s life and music, authored by philosophers who are also Zevon fans, will provide new and exciting insights into Zevon’s thinking, his cynical lyrics, and the cruel ironies of his roller-coaster life and career.
